I. ROUTINE ORG.ANIZATION '
The meeting was called to order by .Chairman Norton at 7:50 P. M.
The Chairman explained that OPEN HO'USE at Saratoga High School had necessi-
tated the transfer of the Planning Commission meeting to Foothill School. He
fur. ther explained that the City had been unaware of this relocation until
after the agendas had been mailed, and extended apologieu for any inco'avenience
incurred because of the change.

Present: Commissioners Cowley= Crisp, Kellum, McFall, and Norton.
Absent: Commissioners Glenn and O'Rorke.
B. MINUTES
Commissiener Kellum moved, sec6nded by Commissioner Crisp, that the reading
of the minutes of September 28, 1964 be waived and that the minutes be ap-
proved as distributed to the C6mmission; motion carried unanimously.

The Chairman declared public hearings open for the evening at 7:55 P. M.
A. C-7___!1 - Maxmar Investment Company, Walnut Avenue - Change of Zoning from
"R-1-12,500" (Single Family Residential) to '~-M-5,000 P-C" (Multi-
ple Family Residential Planned Community) - Continued from Septem-

~e Secretary briefly reviewed~this application and advised that the docu-
ments requested by the SubdiviSion Committee (Sample Grant Deed and Declara-
tion of Covenant, Conditions, ~nd RestrictiOns) had been submitted.
MYREN B. STERN of Los Altos Hills (owner of Brookside Glen Apartments)
stated that at no time would the use of the easement through the Brookside
Glen Apartment property be extended...that it was a private road and would
always be.
A. J. OBERHAUS, Alta Vista Avenue, again opposed the granting of the sub-
ject application for change of zoning.
In answer to a question regarding Mrs. Eaton, former owner of the subject
properrye Mr. Resner of the Maxmar Investment Company advised that he was
aware of his obligation and satisfactory arrangements would be made.
Commissioner Crisp read the report of the Subdivision Con~nittee relative
to this application.
It was moved by Commissioner C.risp and seconded by Commissioner Kellum
that the public hearing on C-T1, Maxmar Investment Company, be closed.
Motion carried unanimously and' the hearing was closed at 8:05 P. M.

After discussion Commissioner C~isp moved, seconded by Com~aissioner Kellum,
that the Subdivision Committee Report of October 2, 1964 relative to C-71,
Maxmar Investment Company, be adopted and transmitted to the City Council
with the recommendation that this application for change of zoning be ap-
proved. Roll call vote: Ayes:~ Commissioners Cowley, Crisp, Kellum,
McFall, andNorton. Noes: None. Absent: Commissioners Glenn and O'Rorke.
Motion carried unanimously.
B. C-73 - Westhope Presbyterian ChUrch, Cox Avenue - Change of Zoning from
'~-1-10,~00'' (Single Family Residential) to "C-N" (Neighborhood
Commercial) - Con~.inued from September 28. 1964
The Secretary briefly reviewed this application and advised that the appli-
cant had filed a written request that the subject property be rezoned to
Conditional Neighborhood Commerc~ial, limiting uses to those not already
established in the Quito Shopping Center. He also read a letter from Mr.
Renzel of the Quito Shopping Center suggesting that perhaps multiple family
zoning might provide better use=of the Church property.
Elmer Garrison was present to represent the Church but stated that he had
no further comment at this time.
After a brief discussion, Chairman Norton directed C-73 continued until the
next regular meeting to allow time for further study of this matter.
C. C-74 - Frank Bonnet, Pierce Road - Change of Zoning from '~-l-4O,O00"
(Single Family Residential) to '~-1-40,0C~0 P-C" (Single Family Resi-
dential Planned Community) - Continued from September 28. 1964
Commissioner Crisp advised that.there were no further developments in con-
nection with this matter except.that the applicant had filed a letter
granting a three month extension relative to action on the tentative map.
In view of this, he suggested that C-74 be continued until the meeting on
October 26, 1964.
Chairman Norton so directed.
D. ~UP-70 - Robert Adair, Prospect Avenue - Use Permit to allow Cocktail Lounge
in Commercial District on Prospect Avenue - Continued from Septem-
ber 28.. 1964 .....
The Secretary briefly reviewed this application and read a letter filed by
Mrs. Elsie Patrick in opposition to the proposed Use Permit. He then read
a letter from Mr. and Mrs. Lloyd Fulton, presented by Rev. Nelson of the
Saratoga Avenue Baptist Church, Zopposing the granting of this Use Permit.
Ihe applicant was present but stated that he had no further co~aent at this
time.
Rev. Nelson, Messrs. Stapleton,!Carney, Dixon, Adler, and Salter, and Mes-
dames McGee and Schults were present to represent the Saratoga Avenue Bap-
tist Church, and opposed the granting of this Use Permit on the basis of
1) possible influence of the Cocktail Lounge on the Church and 2) possible
increased traffic hazard at the=interesection.
Commissioner Crisp advised that'he and Commissioner Kellumhad visited the
site and it was their recommendation that this matter be continued to allow
time for the other members of the Commission to make an on-site inspection.
On the basis of this recommendation, Chairman Norton directed UP-70 con-
tinued until the meeting on Oct6ber 26, 1964.

I!. E. V-249 - Wynn &Dumas, Wardell Road - Variance in connection with Site
De~th Re~u. irements
The hearing on V~249 was opened =at 8:35 P. Mo ~"ne Secretary advised that
Notices of ltearing had been mailed and read a conm~unication from LaRue
Moore~ adjacent property owner, istating that he was not interested in sel-
ling the applicant additional land as requested.
Bill Kae~nnerling of George Nolte, Inc. was present to represent the appli-
cant. He advised that the City'.policy relative to creek dedication, toge~
ther with the need for a 40 foot right-of-way~ created the need for the
subject Variance. He further explained that although the two lots in ques~
tion were of substandard depth, they contained more than sufficient area.
Mrs. Jett, Wardell Road, protested the granting of this Variance on the
basis that it would set a precedent in the area.
Mrs. Ottenberg, Foothill Lane, .questioned the purpose of the Ordinance if
hardships were to be removed by' the granting of variances.
After discussion Chairman Norto~ directed V-249 continued until the meeting
on October 26, 1964 and referred same to the Variance Committee for study
and a report at that time. ~
F. V-250 - Harold A. Beaudoin, Wildwood Way - Variance in connection with
Front and Street-Side Setback Requirements
The hearing on V-250 was opened at 8:54 P. M. The Secretary advised that
Notices of Hearing had been mailed and there were no written communications
on file. He then read the statement of reason filed in conjunction with
the subject application.
The applicant was present but stated that he had no further comment at
this time. '.
Commissioner Kellum advised that the Variance Co~znittee had considered
the subject application but was: not prepared to make a recommendation at
this time. He explained 1) the subject property has been a legal lot for
60 years 2) the applicant's adjacent property is a credit to the neighbor-
hood and it was felt that the Subject property would be developed in the
same manner and 3) the Committ'.ee had a few suggestions to make to the
applicant when an appointment could be arranged.
Mrs. Sherle, Paul Avenue, stated that she was happy that Mr. Beaudoin
planned to build a new house in the area but questioned 1) whether the
granting of the Variance might .set a precedent in the area and 2) whe-
ther development of this property might create a traffic hazard at the
intersection.
After further discussion, Chairman Norton directed V-250 continued until
the next regular meeting and referred same to the Variance Committee for
study and a report at that time.
~he Chairman declared public hearings closed for the evening at 9;06 P. M.
Chairman Norton acknowledged, with pleasure, the presence of Councilman Tylers Mr.
Smith of the Good Government Group, and 'Mrs. Ottanberg of the League of Women
Voters.

III. SUBDIVISIONS AND BUILDING SITES
A. ~_DT 51_~6- Frank Bonnet, Pierce Road - Subdivision --80 Lots - Continued
from September 28. 1964
Commissioner Crisp advised that~a three month extension had been granted
in connection ~ith action on the tentative map so suggested that this
matter be continued until the next regular meeting.

B. SDR-523 - United Presbyterian Church, HerrimanAvenue - Building Site
Approval - 1 Lot . . ......
Reese Williams was present to represent the Church and expressed satis-
faction with the proposed Conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Buil-
ding Site Committee Report of OCtober 13, 1964 relative to SDR-523,
United Presbyterian Church, be adopted and that the tentative map
(Exhibit "A", filed October 2, i964) be approved subject to the conditions
outlined in the Committee Report; motion carried unanimously.
C. SD- 524 - R. Fz. Stu~be, Chester~ Avenue - Subdivision Approval - 13 Lots
Commissioner Crisp advised that. the Subdivision Committee had met with
the applicant's engineer to discuss this subdivision and the Committee
would be ready to make a recommendation at the next meeting.
In view of the foregoing, Chairman Norton directed SD-524, R. F. Stubbe,
continued until the meeting on October 26, 1964.
D. SD- 525 - Wynn & Dumast Wardell Road - Subdivision A~pproval - 11 Lots
Commissioner Crisp recommended that this matter be continued until action
had been taken on the Variance ~V-249) filed in conjunction with this
application.
On the basis of this recommendation, Chairman Norton directed SD-525, Wynn
& Dumas, continued until the meeting on October 26, 1964.
E. SDR-526 - Harold Beaudoin~ Wildwood Wa~ - Building Site Approval - 1 Lot ·
Commissioner Crisp explained that since the appltcant's application for
Variance (V-250 - continued until October 26, 1964) relates to setbacks
only~ there was no need to delay action on the tentative map.
The applicant was present and, after discussion, expressed satisfaction
with the proposed conditions of[approval.
Connnissloner Crisp moved, seconded by Comnissioner McFall, that the
Building Site Committee Report Of 13 October 1964 relative-to SDR-526 be
adopted and that the tentative map (Exhibit "A'~, filed October ~ 1964)
be approved subject to the conditions outlined in the Committee Report;
motion carried unanimously.
F. SD- 527.- Maxmar Investment Corporation, Walnut Avenue - Subdivision -
35 Lots
Commissioner Crisp read 1) Subdivision Committee Report recommending
approval subject to certain conditions and 2) report relative to access
to site, prepared for Chairman's signature.
Myren B. Stern again advised that access across the Brookside Glen Apart-
ment property would be denied ahd legal proceedings would be instigated
immediately. Chairman Norton e~plained that the right of access across
his property was a matter for him to settle with the applicant.

III. F. SD-527 - Maxmar investment Corp2~a~ion
A. J. Oberhaus, Alta Vista Aven6e, observed that a previous Subdivision
Committee Report (August 12, 1964) acknowledged the potential traffic
increase on Walnut Avenue but failed to recognize the possible increase
on Alta Vista and WillJams Avenues.
Mr. Rasher, on behalf of Maxmar:Investment Corporation, expressed satis-
faction with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Conmxissioner Kellum, that the Sub-
division Committee Report of 13 October 1964 relative to SD-527~ Maxmar
Investment Corporation, be adopted and that the tentative map (Exhibit "A-I",
filed 13 October 1964) be approved in accordance with the final development
plan (Exhibit "B", filed 13 October 1964) subject to 1) conditions 1
through 11 as set forth in the Subdivision Committee Report and 2) City
Council approval of C-71, application for change of zoning of the subject
property, and that this application (SD-527) be transmitted to the City
Council for its study and review in connection with further action on the
application for rezoning this property (C-71); motion carried unanimously.
It was moved by Commissioner Crisp and seconded by Co~missioner Kellum that
the Commission make the finding that Condition '~" of the Subdivision Com~
mittee Report of 12 August 1964.has been met by the applicant as set forth
in the report from the Chairman.dated October 7, 1964, and that the Chair-
man be authorized to Sign this Statement for the file. Motion carried
unanimously.
IV. DESIGN REVIEW
A. A-154 - Richfield Oil Corporati6n, Big Basin Way - Preliminary Design
Review - Plans for Remodeling Service Station - Continued from
September. 28~ 1964 ......
Commissioner Cowlay advised that no further exhibits had been received in
connection with this applicatio~ and recommended that same be continued
until the next regular meeting.'
Chairman Norton so directed.
B. A-114 - Eichler Homes, Inc., Cox Avenue - Final Design Review - Subdivision
Homes for Tract 3572
Commissioner Cowley advised thee the applicant had submitted a new eleva-
tion with a request that he be allowed to substitute same for use in Tract
3572 as shown on the accompanying site plan. He further advised that the
new elevation was similar to those already approved for this subdivision
and stated that the Design Review Committee had no objections to the pro-
posed substitution.
Commissioner Cowlay moved, seconded by Commissioner Kellum, that final
design approval be granted the new elevation (Exhibit "K") and the new
site plan (Exhibit "B-4") submitted under File No. A,-l14 in connection
with Tract No. 3572; motion carried unanimously.
C. A-140 - Finnegan Construction Company, Inc. - Final Design Review - Subdi-
vision Homes for Tract 3034
Commissioner Cowlay advised 1) 2the applicant planned to use the same
elevations for the second unit that were previously approved for the
first unit and 2) he had no objection to granting the same flexibility
that had been granted in connection with the Lindsay subdivision as to
selection of the elevations for~the various lots.
After discussion Commissioner Cowlay moved, seconded by Commissioner Kel-
lum, that final design approval.be granted A-140 for the second unit of
Tract 3034 subject to submittal of a site plan, complying with Design
Standards for Residential SubdiVisions, for the approval of the Planning
Director; motion carried unanimously.

IVo Do A-141 - Claude T. Lindsay, Cox Avenue - Final Design Review '- Subdivision
Homes for Tract 3777 :
Commissioner Cowlay advised that the applicant planned to use the same
elevations as in the previous unit and that the lay-out indicated that the
criteria established by the Planning Commission was being followed with
the exception of one item which the applicant had agreed to change,
After discussion Commissioner Cowlay moved, seconded by Commissioner Crisp,
that final design approval be granted for the second unit of Tract 3777 as
shown on Exhibit '~" subject to use of a curved driveway on Lot No. 10;
motion carried unanimously.
E. A-l~6 - Saratoga United Presbyterian Church, Herriman Avenue - Preliminary
pesign Review .= Cbur.~h Building
Commissioner Cowlay advised that the preliminary plans appeared satisfac-
tory, but observed that the building would look better without the side-
walk and fence required under the subdivision conditions.
The Secretary e::plained that the applicant would not be required to com-
ply with the subject condition in connection with construction of the
Church. He further advised tha~ the applicant would like to provide par-
king at the ratio of ~o spaces~for five seats at the present time and
post a bond guaranteeing improvement of the additional spaces at a later
date.
Commissioner Cox~!ey indicated that this might be arranged if a plan was
submitted demonstrating that the required number of spaces could be pro-
vided on the site.
After further discussion Commissioner Cowlay moved, seconded by Commis-
sioner Kellum, that A-156 be granted preliminary design approval as sho~.m
on Exhibit "A'~ with the provision that at the time of issuance of a
building permit a bond be posted guaranteeing improvement of the balance
of the required parking spaces that are not being improved at the time of
construction of the building; motion carried unanimously.
F. A-1.5.7 - Columbus Savings & Loan,' Big Basin Way - Final Design Review -
Identification Sign for'Commercial Building
The applicant's representative requested, in addition to the subject
application, permission to post a temporary sign on the front of the
building during the period of construction.
After discussion Commissioner Cowlay moved, seconded by Commissioner Kei-
lum, that final design approval.be granted A-157, Columbus Savings & Loan,
for the sign sho~.m on Exhibits "A" and "B'~ subject to the condition that
the illumination not exceed 430.milliamperes, and that the applicant be
granted permission to erect a temporary sign (4' x 4') on the front of th~
building during the time of construction; motion carried unanimously.

V. CITY COUNCIL REPORT
Commissioner Cowley gave a brief report on action t~:en during the first half
of the City Council meeting on October 7, 1964, and explained that he had left
at that time because of illness.

A. Richfield Oil Corporation - Qui~o Shopping Center - Request for Informa-
tion relative to possible Remodeling or
RecOnstruction of Station at Paseo Presada and
Cox Avenue
The Secretary suggested that this request be referred to the Staff for
consultation with the City Attorney and a report to the Commission as
soon as possible.
Chairman Norton so directed. :
B. CamDbe.~ HiRh SchOol District. Prospect Avenue - Future School Site
Ihe Secretary read a letter from the Campbell High School District stating
that the District was contemplating the purchase of property on Prospect
Avenue for a future school site..
After discussion Chairman Norton suggested that an informal hearing be
held relative to this matter at 'the ne~t meeting. The Commission con-
curred and requested that the Secretary advise the applicant and the
newspapers. :
The Chairman then directed this matter continued until the meeting on
October 26, 1964 and referred same to the General Plan Co=aittee for
study and a report at that time..
C. Campbell Elementary School District, Alle~dale Avenue - Future School Site
The Secretary advised that the Campbell Elementary School District had
submitted a letter starinS their intent to purchase property on Allendale
Avenue fer a future Elementary School.
After discussion Chairman Norton directed that this matter be included in
the informal hearinS to be held:in connection with the proposed Campbell
HiSh School District site and continued same until the meetinE on Octo-
ber 26, 1954.
VII. OLD BUSIneSS :

from September 28. 1964
The Secretary advised that the report relative to this matter was not ready
and recommended that same be continued until the meeting on October 26, 1~4.
Chairman Norton so directed.
VIII. C0M}~NICATIONS
A. WRITTEN
1. SDR-447 - M. L. SnqE,.L_om~t~ Avenue - Request for Extension
The Secretary advised that Mr. Snow had submitted a letter requesting
an extension of one (1) year in connection with SDR-447.
After discussion Chairman Norton directed this matter continued until
the meeting on October 26, 1964 and referred same to the Building
Site Committee for review apd a recommendation at that time.

VIII. A. 2. Elizabeth Gaudreau - Big Basin Way - Request that "Real Estate Office"
be added to List of Pe=mitted Uses for Profes-
siona!-Administrative District
~e. Secretary read a letter ~rom Elizabeth Gaudreau requesting that
'~eal Estate Office" be added to the liste of permitted uses for
Professional-Administrative Districts so that her office could be
moved to the former Catholic'Church property on Big Basin Way.
Chairman Norton directed this nmtter continued until the meeting on
October 2~, 1~64 and referred same to the Subdivision Committee for
study and a report at its earliest convenience.
3. Henry A. Dietz Letter re Proposed West Valley Junior Colle~S__]t__e
The Secretary advised tha~ H~nry A. Dietz had submitted a copy of a
letter written to the Governing Board of the West Valley Junior Col-
lege District. Me explained that Mr. Dietz was a resident of Saratoga,
a former Assistant Attorney General of California, a former County
Counsel of San Diego County,!and, at present, a Professor of Law at
the University of Santa Clar~, and had written a letter that he felt
would be of interest to the Commission.
Chairman Norton directed tha~ the letter be filed and ~uggested that
the Commissioners read the letter at their earliest convenience.
