The meeting was called to order at 7:35 P. ~. by Chairman Norton.
A. ROLL CALL
Present: Commissioners Crisp, Kelitun, NcFa11, Norton, and O'Rorke.
Absent: Commissioners Cowley and:Glenn.
Commissioner McFall'moVed, seconded by Commissioner O'Rorke, that the
reading of the minutes of November!9, 1964 be waived and that the minutes
be approved as submitted to the Co~nission; motion carried unanimously.
PUBLIC ,HEARINGS '

Commissioner Crisp advised that the Subdivision Committee had reviewed
the revised tentative map (SD-516)'filed in conjunction with the subject
application and had prepared a report (for the Chairman's signature) rela-
tive to the unsatisfactory featutah of this map. He then read this report,
~hich had been prepared for transmittel to the applicant.
Jim Cole~ applicant's engineer, a~ised that he would like to review this
report ~ith}tr. Bonnet, then again!revise the tentative map. LIe requested
that this matter be continued until the meeting on December 28, 1964 to
allow adequate time.
Chairman Norton, with concurrence Of the Commission, so directed.
It was moved by Commissioner Crisp'and seconded by Commissioner Kellum
that the Chairman be authorized torsion the report prepared by the Subdi-
vision Committee (relative to SD-5!6) and that same be transmitted to the
applicant; motion carried unanimously.
B. ~-75 - }largaret Carniel et al, Saratoga-Sunnyvale Road and Carniel Avenue -
Change of Zoning from '~-1-i2,500" (Single Family Residential) to
'~-A' (Professional-Administrative) - Continued from November 9s

Commissioner Crisp advised that the Subdivision Committee had met with the
applicants and they (the applicantS) had requested a continuance. IIe
ther advised that it was the recommendation of the Conlnittee that this
quest be granted.
Bo T° GALEB, Seagull ~ay, stated that he felt this matter should be studied
in conjunction with review of the ~eneral Plan.
Chairman Norton directed C-75 continued until the meeting on December 14,
1964.

II. C. ~-76 - Robert Taylor Construction Company, Prospect Road - Change of Zoning
from "R-I-40,000" (Single F~mily Residential) to '~-1-40,000 P-C':
(Single Family Residential Planned Community) - Continued from Novem-
ber 9, 1964
ll~e Secretary read a report prepared by the Subdivision Committee for the
Chairman's signature (for transmittel to the applicant), pertaining to
unsatisfactory features shown on the revised tentative map for SD-529 which
was filed in conjunction with the ~ubject application. He then advised,
however, that since the report was'written the following items had been
submitted: 1) letter of extensioniin connection with action on the tenta-
tive map 2) site development plans and 3) plans for development of trails.
Chairman Norton, with concurrence 0f the Committee, directed that the sen-
tences pertaining to thes~ three i~ems (as listed above) be deleted from the
report. :
Fir. Seagrave and his engineer, Mr.!Cole, stated that they had no comment at
this time.
Commissioner Crisp moved, seconded'by Commissioner McFall, that the Chairman
be authorized to sign the report prepared by the Subdivision Committee, as
modified, and that same be transmitted to the applicant; motion carried
unanimously.
Chairman Norton then directed this matter continued until the meeting on
December 14, 1964. :
D, .~P-71 - Central Fire District, Cox:Avenue - Use Permit for Fire Station

Commissioner Crisp read the report~of the Staff and Subdivision Committee
relative to this application, reco;~mending that same be granted.
Mr. Luhring was present but stated. that he had no further connnent,
There was no one in the audience who wished to comment with regard to this
matter. ;
Commissioner Crisp moved, seconded:by Commissioner OtRorke, that the hearing
on UP-71 be closed; motion carriediunanimously and the hearing was closed
at 8:03 P.M. :
Commissioner Crisp moved, seconded~by Commissioner McPall, that UP-71, Cen-
tral Fire District application for~Use Permit for Fire Station, be granted
as recommended in the Staff and Subdivision Committee Report; motion car-
ried unanimously,
E. V-.251 - George A. Anthony, Camino Rico - Variance to allow Street-Side
Setback of 15 feet in lieu;of the required 25 feet - Continued from
November 9. 1964 .
The applicant was present but stated that he had no further comment with
regard to this application. :
There was no one in the audience who wished to speak with regard to this
matter.
Commissioner Kellum advised 1) theVariance Committee had made an on-site
inspection of the subject propertyl '2) while the applicant's plans for fur-
ther development of his property were good, the required findings for the
granting of the Variance could not~bemade so 3) it was the recommendation
of the Committee that this application be denied.
It was moved by Commissioner McFall and seconded by Commissioner Crisp that
the hearing on V-251 be closed; motion carried unanimously and the Chairman
declared the hearing closed at 8:07 P. M.

Commissioner Kellum moved, seconded by Commissioner O'Rorke, that V-251,
George A. Anthony, application for!a Variance in connection with street-
side setback requirements, be denied since the findings required for the
granting of a Variance could not be made; motion carried unanimously.
F. C-?~ - Mrs. Chincy Orlando, Prospect Avenue - Change of Zoning from
"R-1-10,000" (Single Family ~ Residential) to "C-S" (Commercial
Service)
G. C-79 - Edwin Cox etal, Prospect A~enue - Change of Zoning from "R-l-10,000"

It was decided that a combined hearing would be held on C-78 and C-79 since
the properties are adjacent. Chairman Morton declared the hearins on both
applications open at 0:09 P. H,
The Secretary advised that Noticeslof Hearing had been published and read
a statement of reason filed by Edwin Cox.
A1Chasek, attorney representing the applicants: requested that these two
applications (C-78 and C-79) be continued until the next regular meeting
so that 1) the applicants and their representsaires could meet with the
Brookview Ilomeo%mers Association and 2) the applications could be revised.
LOUIS STO~a~EL, representiRE the Br0okview llomeowners Association, stated
1) the Association had consistentl~ opposed further commercial zoning in
this area in recent years 2) the Association represents 294 homes 3) the
Association had voted to oppose the two subject applications except for
the 4.4 acres between the expressway and the City boundary on the east and
4) the Association had appointed three persons to work with the applicant's
representatives to find another t~e of zonins for the balance of the pro-
perty that would be mutually satisfactory.

MRS. NYBERG, San Jose, stated thatishe felt many residents of the area had
signed the petition relative to changinE school districts because of inade-
quate information...that they did not realize the property might become
commercial if it was not used for School purposes. When Chairman Morton
requested a show of hands, six people indicated that they would like to
withdraw their names from the petition.
WADE I{OVEK, representing the Campbell High School District, stated that
they were proceeding with their plans to develop a high school plant on
this property.
JOllN GRAMDE stated that he did not~ object to the proposed change of zoning.
MRS. I{ARLAN 51DS~CIIR, Mabel Court, stated that she was opposed to commer-
cial zoning on this property.
After further discussion, Chairman'Norton directed 6-~8 and C-79 continued
until the meetin~ on December 14, i964 and referred same to the Subdivision
Committee for study and a report at that time. He further suggested that
the applicant's attorney make arrangements to meet with the Committee prior
to the meetiRE. :
11. C-80 - Clarence ~'3'. Neale, Saratoga~Sunnyvale Road - Change of Zoning from
'~-M-4,000': e~ultiple Resid~ntial) to "Conditional C-C" (Condi-
tional Community Commercial)
Chairman Norton opened the hearinS~on C-80 at 8:35 P. M. The Secretary
advised that a Notice of Ilearing had been published and read the appli-
cant's statement of reason.

The applicant stated 1) he had been in business in Saratoga for many
years and would like to be able to continue 2) the subject property is
only 100 feet from the present location of his business 3) he proposed
to build a new building that would be a credit to Saratoga and 4) the
existing home on the property would be used as an office and art gallery,
There was no one in the audience who wished to comment with regard to this
application, :
Chairman Norton directed 8-80 continued until the next regular meetin~ and
referred same to the Subdivision Committee for study and a report at that
time,

Commissioner Crisp recommended that SD-516 be continued until the meeting
on December 28, 1964, in view of 'the discussion and action in connection
with C-74.
Chairman Norton so directed.
B. SD- 529 - Robert' Taylor Construction Company, Prospect Road - Subdivision -
180 Lots - Continued from November 9t. 1964
On the basis of the discussion a~d action relative to C-76, CoEmissioner
Crisp recommended that SD-529 be 'continued until the meeting on December 14,
1964.
Chairman Norton so directed.
C. SDR-530 - B. Michael Anderson, Pike Road - Building Site Approval - 1 Lot -
Con~igue~ fro~ November 9,.1964
The applicant was present and exp]ressed satisfaction with the proposed
conditions of approval.
Cou=nissioner Crisp moveds seconded by Commissioner McFall, that the Buil-
ding Site Committee Report of November 23, 1964 relative to SDR-530 be
adopted and that the tentative m~p (Exhibit '~';s filed October 19, 1964)
be approved subject to the conditions set forth in the Committee Report;
motion carried unanimously.
D. SDR-532 - J. J. Pons Verde Vista ]Lane - Building Site Approval - 1 Lot -
Continued from November 9~ 1964
At the request of the applicant, 'Chairman Norton directed SDR-532 con-
tinued until the meeting on December 14, 1964 after the applicant 1) ver-
bally ~ranted an extension of time for action on the tentative map and
2) stated that he would submit a 2written statement for the files granting
the extension of time. ;

COmmissioner. Crisp' recommended that SD-478 be .continued until the next
regular meeting since the DirectOr of Public Works had requested addi-
tiona~ time for further review of this map ~nd a proposal for revision
Of same.
Chairman Norton so directed.

COmmissioner Crisp advised ~hat ~he revised tentative map for SD-527 had
been submitted because of a minor variation in the boundaries of the
property.
After discussion, Commissioner C~isp moved, seconded by Commissioner Kel-
lum, that the revised tentative map for SD-527 (Exhibit '~-2", filed
November 13, 1964) be.approved subject to the conditions established in
connection with the original approved ten=alive map for SD-527; motion
carried unanimously.
II. SDR~534 - Donald R, McCormack, Douglas Lane - Buildin~ Site Approval
1 Lot
The applicant was present ~o discuss the proposed conditions of approval
with the Commission. lie advised. 1) Condition II, E, would create a
hardship since it would eliminate one lot in the over-all development of
the property and 2) he did not feel that this dedication was necessary
inasmuch as he had State water rights and had built a dam.
After discussion Chairman Norton!directed SDR-534 continued until the
next regular meeting and requested that the applicant make arrangements
to meet with the Subdivision Committee and Flood Control representatives
to discuss this matter prior to that time.
Chairman Norton extended a welcome to Mrs.~Owens of the Good Government Group and
expressed the Commission's' appreciation fo* her attendance.
IV. DESIGN REVIEW
A. A-158 - Texaco, Inc., Saratoga-S~nnyvale Road and Prospect Avenue - Sign
~or Texaco Service Station
Commissioner O'Ro=ke advised that the sign, as submitted, did not meet
ordinance requirements relative to size and that there was insufficien~
information as to the intensity ~f illumination.
The Secretary advised that the applicant had telephoned and l) agreed
to comply with the 40 square foot limitation on size 2) stated that the
intensity of illumination would be 430 milllamp,tea and 3) requested
that the Commission approve the ~pplication subject to compliance with
,
Commissioner O'Rorke stated that: he would prefer that A-158 be continued
until the next regular meetin~ and that the applicant be requested to
submit a revised plan.

1V. B, A-1.59 - Borden Melton, Big BasiniWay - Plans for Conversion of Residence
to Commercial Building
Commissioner OIRorke advised tha~ before making a reconmendation the
Design Review Committee would like to meet with the applicant to discuss
the design of the building and the off-street pa~cing,
Mr, Melton was present and agreed to meet with the Committee prior to the
next Planning Commission meeting,
Chairman Norton directed A-159 continued until the meeting on December 14,
1964,
V. CITy.. COUNCIL REPORT
Commissioner Kellum gave a brief report on action taken by the City Council
at the meeting on November 18, 1964,]
VI. NM4 BUSINESS

~e Secretary advised that a communication had been received from the Post
~hster requesting that diagonal parking be allowed in front of the Post Office.
In the discussion that followed, Commissioner Crisp advised that the Director
of Public Works was opposed to permitting the diagonal parking because of the
safety hazard involved,
Chairman Norton directed this matter continued until the meeting on Decem-
ber 14~ 1964 and referred same to t~e Staff for a report at that time.
VII. OLD BUSINESS =
A, Campbell t~igh School District, Prospect Avenue - Proposed Future School
Site - Continued fromiNovemher 9, 1964
In the discussion of this matter, the consensus of the Commission was
that it was needless to take further action since the School District
was apparently proceeding with plans to develop a high school plant on
this site.
On the basis of this, Chairman ~orton directed this matter dropped from
the agenda.
Mr~ Orlando and his attorney advised that they were meeting with the
Cupertino School Distric~ relative to the petition and would continue
to oppose the development of a high school on the subject property,

Commissioner Crisp read the report of the Subdivision Committee relative
to the applicant's request for reconsideration of conditions.
After discussion Commissioner Crisp moved, seconded by Commissioner
McFall, that the Subdivision Committee Report be adopted and transmitted
to the City Council as the recommendation of the Commission; motion car-
ried unanimously.

VII. C. ACTA Enterprises, Saratoga-Sunny~iale Road - Request for Additional Permit-
ted Use in Commercial Service District to allow Assembling of
Products - Continued f~op November 9m 196~
Commissioner Crisp advised l) the Subdivision Committee had met with the
applicant and the o~.mer of the EURay Plumbing Building 2) in the o~raer's
absence, his wife and the applicant had entered into the lease in good
faith 3) the proposed use could'not be permitted in the Commercial Ser-
vice District since it x~ms an industrial use and 4) it was the recommen-
dation of the Committee that no action be taken at this time...that the
applicant be advised that he would have to relocate his business...that
no action be taken to close his business at its present location for a
period of six months.
The Commission concurred with the recommendation of the Subdivision Com-
mittee and Chairman Norton requested that the Secretary advise the appli-
cant of the Commission's decision.
VIII. COMMUNICATIONS
A. ~ITTEN
1.. Ross Dorsa Letter
Commissioner Crisp read a letter from Mr. and Mrs. RoSs Dorsa of Far-
well Avenue expressing theirsappreciation for the Commission's efforts
relative to the proposed Fruitvale Avenue-A!lendale Avenue location
of the West Valley Junior College.
The Commission requested that the Secretary answer the letter and
extend the Commission's appreciation for their support.
2. SDR-461 - Dolores Ilickman, S0bey Road ~ Request for Extension
The Secretary read a letter requesting an ~:tension in connection with
SDR-461.
Commissioner Crisp moved, seconded by Commissioner Kellum, that an
extension of one (1) year from the present date of expiration be
granted in connection with SDR-461; motion carried unanimously.
3. SDR-463 - Francis Minshall, Saratoga Avenue - RequeSt for. Extension
The Secretary read a communication from the applicant requesting an
extension in connection with.SDR-463.
After discussion Commissione~ Crisp moved, seconded by Commissioner
Kellum, that an extension ofione (1) year from the present date of
expiration be granted in connection with SDE-463, Francis Minshall;
motion carried unanimously.
1. SDR-451 - W~de IIoXer
Mr. IIover inquired about denial of his request for an extension in
connection with SDR-451.
Chairman Norton explained 1) the City Attorney had confirmed that
tentative map approval had e~pired prior to the request for extension
and 2) it was the policy of.the Commission to deny a request for
extension filed after expiration of the tentative map.
After discussion it was agreed that Mr. IIover would file a new appli-
cation on the remaining lot..

VIII. B. 2. tampbell IIigh School District - Future School Site
Mr. Hover observed that a change of zoning on the Cox and Orlando
property on Prospect Avenue.(as requested) would be reflected in
the acquisition price of this property.
Chairman Norton explained that the Commission was aware of this but
that the Cox and Orlando applications must be processed in the usual
manner.
