ROLL CALL Present: Connnissioners Cowley, Crisp, Kellums Norton, and McFall. Absent: Commissioners Glenn and O~Rorke. B. MINUTES It was moved by Commissioner Kellum and seconded by Commissioner HcFall that the reading of the minutes of October 13, 1964 be ~aived and that the minutes be approved as distributed to the Commission. Notion carried unanimously. II. PUBLIC ~EARINOS The Chairman declared public hearings open for the evening at 7:33 A. C-73 - ~lesthope Presby~erian Church, Cox Avenue - Change of Zoning from "R-I-IO,000' (Single Family Residential) to "C-N' (Nei~hbor~9od Commercial) - Continued from October 13, ~64 The Secretary advised that no further coz~unications had been recetve~ in connection with this application. Nr. Ecke, representing the Church, stated that he had no further cogent at this time. Comissioner Crisp read the report of the Subdivision Committee relative to this matter, recommending that it be held in abeyance. After discussion Commissioner Crisp moved, seconded by Commissioner l~cFa11, that the hearing on C-73 be closed. Notion carried unanimously and the Chairman declared the hearing closed at 7:37 P.~. It was moved by Commissioner Kellum and seconded by Commissioner HcFall that the report of the Subdivision Committee relative to C-73, ~esthope Presbyterian Church, be adopted and transmitted to the City Council as the recommendation o~ the Commission. Notion Carried unanimously. II. B. C-7__4 - Prank Bonnet, Pierce Road - Change of Zoning from "R-I-40,000" (Single Family Residential) to "R-1-40,000 P-C" (Single Family ~esidential Planned Connu~ity) - Continued from October. 13~ 1964. Jim Cole, applicantss engineer, advised that the Subdivison Committeess suggestions were being incorporated into a revised map which would be filed iu the very near future. In view of the foregoing, Chairman Norton directed C-74, Prank Bonnet, continued until the meeting on November 9, 1964. C. U~.770 - Robert Adair, Prospect Avenue - Use Permit to allow Cocktail Lounge in Commercial District on Prospect Avenue - Continued from Octgber 13~ 1964 The Secretary read a letter from the applicant requesting that the subject application be withdra~m. Commissioner Crisp moved, seconded by Ccmmlssioner Cowley, that the hearin~ on UP-70 be closed. Notion carried unanimously and the Chairman declared the hearing closed at 7:46 P. M. Commissioner Cowley moved~ seconded by Commissioner Kellum, that the applicanh~s request for withSrawal of UP-70 be granted; motion carried. D, V-249 - ~ynn & Durnas~ ~ardell Road - Variance in connection with Site Depth Requirements - CoStinned frg~Oc~ober 13~ 1964 ... Bill Kaemmerling ~as present to represent the appiicant but stated that he had no further comment at this time. Commissioner Kellum advised that the Variance Committee had studied this matter at length and that the Staff Report wa~ also representative of the Ccmmittee*s point of view. The Secretary read the Staff Report relative to this matters recommend- ing that the subject application be granted. Commissioner Kellum moveds seconded by Commissioner Cowley, that the hearing ou V-249 be closed. Hotion carried unanimously and the hearing was closed at 7:52 P. H. Commissioner Kellum moved, seconded by Commissioner HcFall, that V-249, ~ynn & Dumas, be granted; motion carried unanimously. Chairman Norton closed public hearings temporarily at 7:54 P. H. so that the Commission could give consideration to the subdivision map filed in conjunction ~rtth the above variance (V-249). III. SUBDIVISION AND BUILDING ~ITES C. SD-525 - ~ynn & Dumas, ~ardell Road - Subdivision - 11 Lots - Continued from October 13~ 1964 Bill Kaemmerling, representing the applicant, expressed satisfaction with the proposed conditions of approval. ~2- llI. SD~525 - Wynn & Dumas Commissioner Crisp moved, seconded by Comnissioner HcFall, that the Subdivision Ceu=aittee Report of October 26, 1964 relative to SD-525 be adopted and that the tentative map (Exhibit "A', filed October 2, 1964) be approved subject to the conditions set forth in the Committee Report; motion carried unanimously. Chairman Norton re-opened public hearings at 7:58 P. M. II. E. ~T~50 - Harold A. Beaudoin, Wildwood Way - Variance in connection with Front and Street-Side Setback Requirements - Continued from October 13, 1964 The applicant was present but stated that be had no further comment at this time. The Secretary read a Staff Report relative to this matter. Commissioner Kellum advised that the Staff Report also represented the recommendation of the Variance Committee. Mr, Beaudoin stated that the recommended 8 foot setback from Fourth Street was satisfactory with him. Commissioner MeFall moved, Seconded by Commissioner Kellum, that the bearing on V-250 be closed. Motion carried unanimously and the Chairman declared the hearing closed at 8:01P. N. It was moved by Commissioner Kellum and seconded by Commissioner HcFa11 that V~250, Harold A, Beaodoin, be granted as set forth in the Staff Report of October 26, 1964; motion carried unanimously. iX. F. Campbell High ~chool District, Prospect Avenue - Informal Hearing Relative to Proposed Future School Site - Continued from October 13, ~64 The Chairman briefly explained 1) the Campbell High Sch6ol District had submitted a proposal for a high echool on ProSpect Avenue and 2) although it was not required by law, the Commission had decided to hold an informal public hearing relative to this matter. The hearin~ was opened by Chairman Norton at 8:04 P. ~. Nr. Hill, District Superintendent, and Hr. Russell, Assistant Superintendent, were present to represent the Campbell High School District. Hr. Hill presented a map sho~r~ng the District boundaries and the various schools in the District. He explained 1) the District now has 1,000 Saratoga students and 2,000 to 3,000 are anticipated within the next seven years 2) although existing schools will be expanded the District will still need another school site in this area 3) the subject site is the only one available in the area that will serve the needs of a high school and 4) no safety problem is anticipated. Kenneth l~alovos, attorney, opposed the location of the proposed school on behal£ of the Cox and 0rlando families, o~ners of the subject property. He explained that it ~as felt that this property had unique commercial potential. II. F. Campbell High School District, Prospect Avenue - Informal Hearing Relative =o Proposed Future School Site - Continued from October 13, 1964 - Continued from Pa~e 3 The Secretary read couu~.unications from 1) Don S. Orlando and 2) Edwin E. Cox opposing the proposed location of the school. Mr. Orlando questioned Mr. Hillis statement that the subject 40 acre parcel offered 31 usable acres. He advised that he felt that require- meets in connection ~Lth the creek, the freeway, and the street would leave approximately 23 acres which would be inadequate for the school. Chairman Norton d~rected this matter continued until the meeting on November 9, 1964 and referred same to the General Plan Committee for consideration at ~heir meeting on Monday,' November 2, 1964. He also invited the school representatives and o~nere of the subject property ~o attend this meeting if they so desired. G. Campbell ~lementary School DistriCt, Allendais Avenue - Informal Hearing Relative to Proposed Future School Site - Continued from October l~, 1964 .... Chairmen Norton explained that the Campbell Elementary School District had submitted a proposal for an elementary ~chool ou Allendale'Avenue and the Commission had decided to hold the same type of informal public hearing on this matter that had been scheduled in connection with Campbell High School District proposal. The hearing ~as opened at 8:35 P. H. Mr. Henley, District Superintendent, presented a map showing the District boundaries and the various schools ~thin the District. He then explained 1) the need for an additional school site in this area 2) that the subject school would not serve any students east of quito Road and 3) that although they were aware of the proximity of the proposed Junior College, no serious safety problem was anticipated. Chairman Norton read the report of the General Plan Committee and, after [urther discuss~on with Mr. Henley, suggested that thts report be reviewed by the Commi=tee. The Commission concurred. Chairman Norton then directed this matter continued unt~l the meeting on November 9~ 196~ with a request that the General Plan Committee ~ive further consideration to the report at its meeting on Monday, November 2, 1964. H. ~75 - ~argaret Carniel et al, Saratoga-Sunnyvale Road and Carniel Avenue - Change of Zonin~ from 'R-1-12,500" (Single Family Residential) to "P-A" (Professional-Administrat~ve) The hearing on C-75 was opened at 8:53 P. M. The Secretar~ advised that a Notice of Hearing had been published and no communications had been received. H. C~Z5 - Margaret Carniel at ~1 -. Continued.~ro~ Pa~e 4 The applicants' representative explained that the subject property was bordered by nursery property and did not lend itself well to residential use. In answer to a request from the Commission, he advised that he would be happy to attempt to establish the need for "P-A" zoning in this area. There was no one else in the audience who wished to comment regarding this matter. Chairman Norton directed C-75, Margaret Carniel etal, continued until the meeting on November 9, 1964 and referred same to the Sbudivlston Committee for study and a report at that time. I. C-76 - Robert Taylor Construction Company, Prospect Road .- Change of Zoning from "R-1-40,000" (Single Family Residential) to "RTt-40,000 P-C" (Sinale FamilX R~pidential ~l~nned Community)__ The hc~ring on 8-76 was opened at 8:58 P. M. The Secretary advised that a Notice of Hearing had been published and there were no written communications on file. He then briefly reviewed this application and advised that it covered the 200 acre parcel known as the "Parker Ranch". Jira Cole, applicantms engineer, and FrgnkMahr, developer, explained 1) the need for the "P-C" zoning 2) that much of the "common green" area would be left in its natural state 3) that each resident would o~.m his own home and a share in the common green 4) that facilities for the common green had not been determined because of the proximity of the Country Club and 5) they would be happy to file a tentative contract with the City for review although final details had not yet been worked out. Chairman Norton directed this matter continued until the next regular meeting and referred same to the Subdivision Committee for study and a report at that time. J. C~77 - Rober F. Planes Douglas Lane - Change of Zoning from "A" (A~ricultural) to "R. T1-/+0,00.0"..(Single Fa~ly. Reeidential) ..... The hearing on C-77 was opened at 9:04 P. M. The Secretary advised thaC a Notice of Hearing had been published and therewere no written communications on file. He briefly reviewed this application and advised that the requested "R-l-40,000" zoning was in accordance with the General Plan. During the discussion that followed, the Comm{ssion concurred that they were familiar with the subject property and that the request for change of zonin~ was in accord with the General Plan for the City. There was no one in the audience who wished to comment with regard to this matter. -5~ II. 3. C-77 - Robert F. Planew Douglas Lane - Continued from Pa~ 5 Couunissioner Kellum moved~ seconded by Cormnissioner Cowl~y, that the hearing on C-77 be closed. Motion carried unanimously and the bearing' was closed at 9:09 P. M. It was moved by Comnissioner Crisp and seconded by Commiezoner Kellum that the Commission recommed approval of the change of zoning requested under File No. C-77 and that the Secretary be authorized to prepare and submit to the City Council a ~mitten statement setting forth this recommendation. Motion carried unanimously. The Chairman declared public hearings closed for the evenin~ at 9=11 P. M. TEN IaNUTE RECESS III. SUBDIVISIONS AND BUILDING SITES A. SD-516 ~ Prank Bonnet, Pierce Road - Subdivision - 80 Lots - Continued from October 13~ 1964 In view of the continued hearing on C-74, change of zoning application filed in conjunction with this subdivision, Chairman Norton directed SD-516 continued until the meeting on November 9, 1964. B. SD-524 - R. F. Stubbe, Chester AvenUe - Subdivision - 13 Lots - Continued from October 13~ 1964 .. The applicant was not present. Commissioner Crisp moved, seconded by Commissioner McFa11~ that the Subdivision Committee Report of October 26, 1964 relative to SD-528 be adopted and that the tentative map (Exhibit 'A', filed October 15, 196A) be approved subject to the conditions set forth in the Subdivision Committee Report; motion carried unanimously. E, SD-529 ~ Robert Taylor Construction Company, Prospect Road - Subdivision - 180 Lots In view of the continued hearing on C~76, filed in conjunction with this subdivision, Chairman Norton directed SD-529 continued until ~he meeting on November 9, 1964. IV. D~SIGR REVIE~ ~r154 - Richfield Oil Corporation, Big Basin Way - Preliminary Design Review - Plans for Remodeling Service Station - Continued from October 13~ ~964 ..... Con~nissioner Cowley recommended that this matter be continued until the next regular meeting since the revised plans had not been submitted. Chairman Norton so directed. The Chairman acknowledged, with pleasure, the presence of Councilman Burry the Messrs. Robbins and Pierce of the Good Government Group. V. CITY COUNCIL REPORT Commissioner Kellum gave a brief report on action taken at the City Council meeting on October 21, 1964 and informed the Ccmmission that the dedication of the Council Chambers was set for December 6, 1964. He further advised that the Saratoga High School Civics Class had artended this meeting and commented that he was quite favorably impressed with the questions asked by the group. VI. ~E~ BUSINESS George Akers - E1Cami~o G~ande The Secretary advised that Harry Aumack of Mark Thomas, Inc. had requested that an 18 foot private road be considered in connection with development of the George Akers property off E1 Camino Grande in lieu of the standard 26 foot street because of the topography of the area. Mr. Akers was present to discuss this request with the Commission, and was advised that it was the consensus of the Commission that the ~tahdard 26 foot street would be required. VII. pbD BUSINESS A. Helen Rayburn Property, Big Basin Way - Proposal for Development - Continued from October 13t 1964 After further discussion of this proposal, Chairman Norton directed that this matter be removed from the agenda and referred same to the Staff for study and further consultation with the applicant. He also requested that the Secretary report back to the Commission as soon as convenient as to further developments relative to this situation. B. Richfield Oil Corporation, Quito Shopping Center - Request for Informa- tion Relative to Possible Remodeling or Reconstruction of Station at Paseo Presada and Cox Avenue - Continued from October 13~ 1964 The Secretary briefly reviewed this matter and advised 1) Design Review would be required for remodeling the subject station and 2) both Design Review and Building Site Approval would be required for reconstruction. In answer to a question from Cor~nissioner Crisp, he advised that he would check with the City Attorney as to whether, under the emergency ordinance relative to service stations, a Use Permit would be required. -7- VII. OLD BUSINESS B. Richfield__ell Corporation, Continued from pare ? Chairman Norton directed that this matter be removed from the agenda and that the Staff advise Richfield Oil Corporation of the required procedure for remodeling or rebuilding the subject station. C. SDR-447 - M. L. Snow, Lomita Avenue - Building Site Approval - 2 Lots - Request for Extension - Continued from October 13. 1964 Commissioner Crisp moved, seconded by Commissioner McFall, that an extension of one (1) year from the present date of expiration (October 14, 1964) be granted in connection with SDR-447, M. L. Snow; motion carried unanimously. D. Elizabeth Gaudreau, Big Basin Way - Request that "Real Estate Offices" be added to the list of Permitted Uses for Professional - Administrative Districts - Continued from Oqtober 13, 1964 The Secretary advised that Mrs. Gaudreau was unable to attend the meeting because of illness. After a brief discussion relative to this matter, Chairman Norton directed same continued until the meeting on November 9, 1964. VIII. COMMUNICATIONS A. WRITTEN 1. SDR-451 - Wade Hover~ Peach Hill Baod - Request for Extension The Secretary read a letter from Wade Hover requesting an extension in connection with SDR-451. He explained 1) Mr. Hover received final site approval on one lot at the Council meeting on October 21, 1964 2) the request for an extension was in connection with the remaining lot and 3) the tentative approval on the sub]ect lots expired October 14, 1964. Chairman Norton directed SDR-451 continued until the meeting on November 9, 1964 and referred same to the Subdivision Committee for study and a recommendation at that time. 2. W~st Valley Junior ColloRe District The Secretary read a letter from the West Valley Junior College District requesting that the Planning Commission submit a report of recommendations relative to the District's proposed acquisition of a site at Fruitvale and Allendale Avenue in Saratoga. -8- VIII.
