TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton at 7:30 P. M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Kellum, McFall, Norton and O'Rorke. Absent: Commissioner Glenn, B. MI~HJTE S Chairman Norton, with concurrence of the Commission, directed that the following statement be inserted~ as the last paragraph under III, C, on page 4: "~here shall be no approval or development of Building sites on Pike Road until the road improvements have been completed." Commissioner Kellum moved, seconded by Commissioner Cowley, that the reading of the minutes of November 23, 1964 be waived and that the minutes be approved as modified; motion carried unanimously. II. PUBLIC HEARINGS Chairman Norton declared public hearings open for the evening at 7:33 P. M. A. C-75 - Margaret Carniel et al, 'Saratoga-Sunnyvale Road - Change of Zoning from '~-1-12,500" (Single Family Residential) to '~-A" (Profes- sional-Administrative) - Continued from November 23 ~ ...1964 Mr. Finn, representing the applicants, requested that this matter be sub- mitted for study under the General Plan Review. Commissioner Crisp advised 1) i:the Subdivision Committee had prepared a report recommending that this application be denied and 2) he could see no reason to hold this matter for the General Plan Review since the appli- cants had the right to request =.review at that time even though action had been taken on the application. Mr. Finn then requested that C-.75 be continued until the next regular meeting to allow adequate time !for him to discuss this matter with the applicants. Chairman Norton, with concurrence of the Commission, so directed. B. C-?__6 - Robert Taylor Construction Company, Prospect Road - Change of Zoning from "R-1-40,O00" (Singl~e Family Residential) to "R-1-40,O00 P-C" (Single Family Residential Planned Community) - Continued from November 23~ 1964 ..... The Secretary advised that a c0ummnication had been received from the appli- cant granting an extension of 60 days in connection with SD-529, the sub- division application filed in conjunction with the subject application for change of zoning. Followin~ a discussion relative to a possible recreational hall, the Ghair- mans with concurrence of the COmmission, directed that the Subdivision Com- mittee Report be amended to require a recreational building. It was moved by CommiSsioner MSFall and seconded by Commissioner Crisp, that the Subdivision Committee iReport of December 10, 1964 relative to 8-?6, Robert Taylor Construction Company, be approved as amended; motion carried unanimously. At the request of the CommissiOn, the Secretary read the applicant's letter granting the 60 day extension in connection with SD-529. Chairman Norton then directed C-76 continued until the next regular meeting. C. C-78 - Mrs. Chincy Orlando, Prospect Avenue - Change of Zoning from '~-1-10,000" (Single Family Residential) to "C-S" (Commercial Service)-- Co~t.~Rued from Novembe[ 23, 1964. D. .C-79 - Edwin Cox etal, Prospeat Avenue - Chan~e of Zonins from '~-1-10,000" (Single Family Residential) to "C-N" (Neighborhood Commercial) - Continued:from November 23, 1964 As the-combined hearing on C-78 and C-79 was resumed, the Secretary, at the request of Chairman Nortonl read the applicants.' statement of reason for the requested zone changes. Mr. Chasek, representins the applicants, requested that the subject appli- cations be continued for a period of 60 days.... After discussio.n Commissioner McFall moved, seconded by Commissioner Kellum, that the Commission continue C~78 and C-79 until the first meeting in February (February 8s 1965) as!requested with the recommendation that all the people involved in these applications be notified prior to that time that these items will egain be. taken under consideration at that meeting. Motion carried unanimously and. Chairman Norton So directed. E. ~rS0 - Clarence W. Neale, Saratoga-SunnFale Road - Change of Zoning from '~-M-4,000" (Multiple Residential) to "Gonditional C-C" (Conditional Conmmn~tv Commercial).-[Contin3!e4 from November ~3, 1~64 ~he Secretary briefly reviewed!this application for change of zoning. Mr. William HiESins,' Brookwoodi Lane, opposed the subject application on the basis that it was not in cOnformance with the General Plan. Sam Hernandez, Big Basin Way, stated that although he was not opposed to the subject request for change'of zoning he felt it would be unwise to give consideration to any request for change of zonins prior to review of the General Plan. Commissioner Crisps in answer ~o a question from Mr. Higgins, advised that it was the consensus of the Committee that this property would not lend itself well to either single family or multiple.residential development. Commissioner Crisp then read the report of the Subdivision Committee rela- tive to this application. : It was moved by Connnissioner C;isp and seconded by Comm{ssioner OsRorke that the public hearing on C-80 be closed. Neale Commissioner Crisp moved, seconded by Commissioner Kellum, that the Sub- division Committee Report of 10 December 1964 relative to C-80, Clarence W. Neale, (recommending approval) be approved and that the report be for- warded to the City Council as the recommendation of the Commission. Roll call vote: Ayes: Commissioners Cowley, Crisp, Kellum, McFall, Norton, and O 'Rorke. Noes: None. Absent: Commiss loner Glenn. Motion carried unanimous ly. F. C-81 - Paul Masson, Inc. :, Saratoga Avenue - Change of Zoning from '~-1-10,000" (Single Family Residential) to Conditional '~" (Con- ditional Industrial} : The hearing on C-81 was opened~ at 8:36 P. M. The Secretary advised that a Notice of Hearing had been published and. there were no written communi- cations on file. MessrS. Otto Mayer and LeO. Ber~i, present to represent. Paul Masson, .Inc. advised 1). the subject property is located ~.mmediately north of the existing Paul Masson development 2) they ho~e, in time, to acquire both the San Jose Water Works property and the Passantino property 3) a ~ster Plan for the over-all Paul Masson development has been prepared as sug- gested 4) the past five years have proven successful to the extent that they now need to expand to provide additional storage space for aging both bulk and bottle wine 5) plans for relocating the San Francisco Offices of Paul Masson, Inc. in Saratoga are now under discussion 6) theirs was a long range building plan to provide expanded facilities for the plant, a nice restaurant they felt was needed in conjunction with their develop- ment, a larger tasting room,' art gallery and gift shop, and offices 7) they would like to build the office wing large enough to be compatible ~n size with the other buildings, especially since these offices would be utilized in time by Paul Masson, Inc., but would like to rent a portion of the office space for other .related uses until such time as it was needed for their own use, ~nen Commissioner Crisp explained that if this application was approved it would be necessary to restrict the offices to uses compatible with the over-all developments Mr. Meyer expressed concurrence with this limitation, Sam Hernandez expressed appreciation of the Paul Masson development in Saratoga and stated that he was confident that any future development would also be a credit to the =.City. He added that he ~ould not like to see commercial stores in the future development, however, that would be in competition with the Village, . He was assured by the Paul Masson repre- sentatives that this was not their intent. After further discussion, Chairman Norton directed C-81, Paul Masson, Inc., continued until the meeting on December 28, 1964 and referred same to the Subdivision Committee for study and a report at that time, G, c-..8.2 - Bell-Scott Developers, :Big Basin Way - Change of Zoning from '~-1-40,000" (Single Family Residential) to '~-1-40,O00 P-D" (Single F~m~.ly.. Residential Planned Developm..e. nt) The hearing on C-82 was opened] at 8:52 P. M. The Secretary advised that a Notice of Hearing had been published and there were no written communi- cations on file. He then briefly reviewed this application. M, L, Splitstone, applicant~s.engineer, advised 1) the same number of lots were proposed under the requested '~-D" zoning that could be obtained under the existing ~-1-40,000" zoning 2) larger lots were proposed for the perimeter of the property~ placing the smaller lots in the interior of the subdivision and 3) the "~-D" zoning had been requested for the purpose of providing better home sites, a better development in general, Planning Co~mlssion Minutes - December ~4~ ,~96~,r ,Continued II. C. C-82 - Bell-Scott Developers There was no one in the audience who wished to coment with regard to this application. Commissioner Crisp advised tha~ the Subdivision Committee had met with the applicant and his engineer and:had reviewed several preliminary maps. He further advised that the matter was progressing nicely and the Committee would probably be prepared to m~ce a recommendation at the next regular meeting. : In view of the foregoing, Chai~an Norton directed C-82 continued until the meeting on December 28, 1964 and referred same to the Subdivision Committee for further study and a report at that time. The Chairman declared public hearings closed for the evening at 8:59 P. TEN MINDTE RECESS III. SUBDIVISIONS AND BUILDING SITES : A. SD-529 -'Robert Taylor ConstruCtion Company, Prospect Road - Subdivision - 180 ~ots - Continued fro~ November 23, ~964 Commissioner Crisp recommendedithat SD-529 be continued until the next regular meeting since a satisfactory tentative map had not been submitted. Chairman Norton so directed. B. SDR-532 - J. J. Port, Verde visea Lane - Building Site Approval - 1 Lot - Continued from November23., 1~4 The Secretary advised that the~applicant had agreed to accept the proposed conditions of approval and requested that the Commission take action in connection with this application. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Buil- ding Site Committee Report of 9 November 1964 relative to SDR-532, J. J. Pon, be adopted and that the tentative map (Exhibit '~", filed 28 October 1964) be approved subject to the conditions set forth in the Counnlttee Report; motion carried unanimously. C. ~D- 478 - Clande T. Lindsay, Cox Avenue - Revised Tentative Map on Portion of qriginal Subdivision - Continued from November 23.~. 1964 Commissioner Crisp advised that a revised tentative map had been sub- mitted on a portion of the original subdivision because it was found tlmt an existing San Jose Water Works line ran through a number of the lots. He explained that this portioniof the subdivision had been re-designed to allow this line to run down the street. Commissioner Crisp moved, seconded by Commissioner Kellum, that the revised tentative map for SD-4~8 (Exhibit '~", filed 12 November 1964) be approved subject to the conditions established under the original approved tentative map; motion'carried unanimously. D. SDR-534 - Donald R. McCormacks!Douglas Lane - Building Site Approval - 1 Lot - Continued from November 23s 1964 The Secretary read a letter fram the applicant requesting that this appli- cation be continued until the end of January or the first of February. Chairman Norton, with concurrence of the Commission, directed SDR-534 continued until the meeting on'February 8, 1964. PlanntnR Commission MinutesL- December 14i 1964 - Continued E. SDR-535 - Arthur W. Anderson, Sperry Lane - Building Site Approval - 1 Lot The applicant unts not present. Commissioner Crisp moved, seconded by Commissioner HcFall, that the Building Site Committee Report qf 10 December 1964 relative to SDR-535, Arthur W. Anderson, be adopted and that the tentative map (Exhibit "A", filed 19 November 1964) be apprOved subject to the conditions set forth in the Committee Report; motion:carried unanimously. F. SD-~36 - Bell-Scott Developers~:Big.~asin Wa~ - Subdivision - 51 Lots Commissioner Crisp explained that a revised tentative map ~as being submitted by the applicant and ~econnnended that SD-536, Bell Scott Developers, be continued until the next regular meeting. Chairman Norton so directed. G. SD-537 - Ra7 3ones~ Pierce Road Subdivision - 25 Lots Commissioner Crisp advised that ithe Subdivision Committee had reviewed the tentative map for this subdivision and had found it satisfactory · but that the conditions of approval had not yet been prepared. He further-advised that the applicant had requested an informal expression of intent to approve the tentative map for this subdivision. After discussion, Chairman NortOn directed that the minutes show 1) the Subdivision Committee informally reported that the tentative map for SD-537 appears to be satisfactory and 2) the Commission expressed the consensus that if the map was satisfactory with the Subdivision Committee, it would be satisfactory with the Commission. Chairman Norton then directed SD-537, Ray Jones, continued until the meeting on December 28, 1964. H. SDR-538 - John A. Hinker~.Austin Wa~ - Buildin2 Site Approval - 1 Lot Jim Ferguson, representing the applicant, expressed satisfaction with the proposed conditions of approval. It was moved by Commissioner Crisp and seconded by Commissioner Kellum that the Building Site Committee Report of 10 December 1964 relative to SDR-538, John A. Hinker, be adopted and that the tentative map (Exhibit 'A", filed 4 December 1964) be approved subject to the conditions set forth in the Committee Report; motion carried unanimously. I. SDR-533 - F. & M. Construction Company, Sobey Road-Buildin~ Site Ap9roval - 1 Lot - Revised Tentative Map Commissioner Crisp explained 1)~the Commission disapproved the tentative map for SDR-533 at the last regular meetins 2) since that time the appli- cant met with the representative from the County Health Department to try to find a solution to the septic= tank but a Variance on lot width would be required 4) at a meeting with' the applicant (earlier today) the Build- ing Site Committee had encouraged him to again contact the Health Depart- ment and try to re-desiZn the lots so that a Variance would not be needed. After discussion, Chairman Norton directed SDR-533 continued until the next regular meeting. ~ IV. DESIGN REVIEW A. A-158 - Texaco, Inc., Saratoga-Sunnyvale Road - Design Review - Sign for Texaco Service StatiOn - Continued from November 23,. 1964 Commissioner Cowley recommended ~that this matter be continued until the meeting on December 28, 1964; since the revised plans requested by the Commission had not been submitted. A-159 - Borden Melton, Big Basin Way - Final Design Review - Plans for Conversion of Residence to Commercial Building - Continued from ~ovember 23T 1964 Commissioner Cowley advised 1) th~ Design Review Committee had met with the applicant and the parking requirements had been satisfied 2) the applicant should be cautioned, however, that a change in tenants (from office to retail use) could place'his parking in jeopardy 3) the applicant had agreed to use vertical aluminum strips at the windows to help break up the overall appearance of the flat surface (on the front elevation) and 4) the applicant had neither agreed nor refused, however, to consider changing the roof line on the proposed building as suggested by the Committee. Mr. and Mrs. Melton were present and advised 1) the vertical strips would be used as agreed and 2) they did!not desire to change the roof line on the building since it was not onl~ the most convenient approach to the roof line but archttectuall~ satisfactory to them. Commissioner Cowley moved, seconded by Commissioner O'Rorke, that final design approval be ~ranted A-159,~Bordon Melton, for the building as shown on Exhibit "A" with the recommendation that the applicant give further consideration to the architectural treatment of the roof line on the front of the building; motion carried unanimously. C. A7160 - Paul Flanagan~ Big Basin Way - Final Design Review - Change of Use from. P~qf~spi~nal to.tqm~.erc~al. , The SeCretary discussed with the Commission the Staff Report submitted in connection with this application.! Commissioner Cowley moved, seconded by Commissioner O'Rorke, that A-160, Paul Flanagan, be granted final design approval for the change of use from Professional to Commercial as shown on Exhibit "A" and as set forth in the Staff Report dated December 14, 1964; motion carried unanimously. D. A-161 - Santa Clara County Central Fire District, Cox Avenue - Preliminary Design Review - Fire Station Commissioner Cowley explained 1) plans for the proposed fire station had been reviewed with the architect 2) the Committee concurred with the architect's recommendation that the fence required under subdivision approval be abandoned in favor of]a more aesthetic concept of landscaping and/or fencing 3) the architect s~ated that the architectural presentation was preliminary.. . a concept drawing.. . that the final drawings would be basically the same but that the details might be changed. After discussion Commissioner Cowley moved, seconded by Commissioner O'Rorke, that A-161, Santa Clara County Central Fire District, be granted preliminary design approval for the fire station as shown on Exhibits "A" and "B"; motion carried unanimously. E. A-162 - R. J. O'Neill, Village Laae - Preliminary Design Review - Medical Office - Lot 5, Unit ~, Medical. Village Commissioner Cowley advised that the Design Review Committee had reviewed the subject plans with the architect and found them basically satisfactory. Commissioner Cowley moved, seconded By Commissioner O'Rorke, that A-162, R. J. O'Neill, be granted preliminary design approval for the medical office as shown on Exhibits "A" and "B"; motion carried unanimously. F. A-163 - Redwood Empire, saratoga-Sunnyvale Road - Design Review - Identi- fication Sign The Secretary advised 1) the applicant had explained that the entire 200 feet of frontage on SaratoGa-Sunnyvale Road would be covered by the proposed sign 2) on this basis, it would be conceivable that the size of the proposed sign would be satisfactory and 3) it was his suggestion Planning Commission Minutes - December 14,' 1964 - Continued .. A-163 - Redwood Empire, Saratoga-Sunnyvale Road - Design Review - Identi- fication that this matter be continued and a meeting arranged with the applicant because of the various signs nowzin existence on this property. Chairman Norton, with concurrence of the Commission, directed A-163, Redwood Empire, continued until ~he meeting on December 28, 1964. G. A-164 - Helen K. Rayburn, Big BaSin Way - Preliminary Design Review - Commercial Building Commissioner Cowley advised 1) the applicant had obtained parking space from the Plumed Horse Restaurant!2) the aptking space at the Plumed Horse ~ms being increased so they could legally lease more spaces 3) in view of this the applicant wouldzhave more buildable area and 4) the parking lease would cover a period of five (5) years. The Secretary explained i) Mrs. Anderson of the P!umed Horse had sub- mitted a formal agreement to increase the number of parking spaces at the restaurant 2) a minimum imprpvement could be provided at this time and credit could be received in Connection with the parking district and 3) even if the parking district failed, the people in this area were interested in providing better parking arrangements. After further discussion, Commissioner Cowley moved, seconded by Com- missioner O'Rorke, that A-164, H&len K. Rayburn, be granted preliminary design approval of the commercial buildins in accordance with Exhibit "A" and the letter on file relative to parking; motion carried unanimously. Chairman Norton acknowledged, with pleasure, the presence of Mesdames Owen and Parker of the Good Government Group, and Mr. Butera of the Chamber of Commerce. : V. CITY COUNCIL REPORT ' Chairman Norton gave a brief report!on action taken at the City Council meeting on December 2, 1964 with emphasis on items of particular interest tO the Commission. VI. NEW BUSINESS VII. OLD BUSINESS Saratoga Post Office - Request thatZDiagonal Parking be permitted along SaratoZa Avenue - Continued from November 23. 1964 The Secretary reviewed ~.~th the Commission the Staff Report submitted in connection with this matter. In the discussion that followed, the possi- bility of cutting the sidewalk back!and/or realigning Saratoga Avenue was considered. The Secretary explaine~ that these ideas had not been explored. Chairman Norton, with concurrence of the Commission, directed this matter continued until the meeting on December 28, 1964. VIII. COMMUNICATIONS : A. WRITTEN SDR-460 - Richard O. Bywater, S~bey Road - Request for Extension The Secretary read a letter requesting a six (6) month extension in connection with SDR-460. After discussion Commissioner C~isp moved, seconded by Commissioner Kellum, that an extension of sik (6) months from the present date of expiration be granted in connection with SDR-460, Richard O. Office Use Commissioner O'Rorke advised tha~ at timeo the parking requirements established by Ordinance NS-3 for general office use appeared inadequat~ and'the Design Review Committee had discussed the merit of a possible revision. '. After discussion Chairman Norton~requested that the Design Review· Committee and the Staff check into this matter and prepare a report for consideration by the Commission. IX.
