Chairman Norton called the meeting to order at 7:34 P. N.
A. ROLL CALL
Present: Commissioners Cowley, Crisps Kellum, ~cFall, Norton, and
O * Rorke.
Absent: Commissioner Glenn.

Commissioner McFall moved, seconded by Cor~nissioner Kellum, that the
reading of the minutes of December 28, 1964 be waived and that the
minutes be approved as distributed to the Commission; motion carried
unanimous ly.

The Secretary read a letter .from the applicant requesting that
C-74 and SD-516 (subdivision application filed in conjunction
with the application for change of zoning) be withdrawn and that
the filing fees,'or a portion thereof, be returned if possible.
The Cviumission observed that the applicant ~ould have to contact
the City Councll about any possible refund of ~iling fees.
After discussion it ~ss moved by C~mnissioner Crisp and seconded
by Commissioner O*Rorke that the public hearing on C-74 be closed;
motion carried unanimously and the hearing ~as closed at 7:39 P,M,
Commissioner Crisp moved, seconded by Conunissioner Kellum, that
the request for withdrawal of C-74 and SD-516 be approved; motion
carried unanimously.

Zoning from 'R-I-~O,000' (Single Family Residential to 'R-I-~O,000
P-C' (Single Family Residential Planned Community) - Continued
from December 2a, 1964
The Secretary advised that no £urther exhibits had been filed by
the applicant in connection with this application or SD-529, sub-
division application filed in conjunction with C-76.
On the basis of this information, Chairman Norton directed this
matter continued until the meeting on January 2~, 196S.

(Conditional Industrial) - Continued from December 28, 1964
The Secretary advised 1) the applicantss represantatives had met
~th the Subdivision Committee and the Planning Connnittee of the
Council and 2) it had been decided that this matter should be
continued to allow further time for the study and report.

Comnissioner Crisp advised that the Committee hoped to have its
report and recommendation prepared prior to the next regular
meeting.
On the basis of the foregoing, Chairman N~rton directed C-81
continued until the meeting on January 25, 1965.
D. C-82 - Bell-Scott Developers, BIR Basin Way - Change of Zoning from
"R-I-40,000" (Single Family Residential) to "R-1-40,O00 P-D"
(Single Family Residential Planned Development) - Continued from
December 28, 1964
Chairman Norton, with concurrence of the Commission, deferred
discussion of this matter until later in the evening (when the'
subdivision application filed in conjunction x~th C-82 ~as up
for discussion).
E. V~252 - ~atol Romanoft Foothill Lane - ~ariance in connection with
Site Width and Area - Continued from December 29, 1964
The Secretary read a statement from the City Attorney relative to
this application, indicating that the Planning Commission had a
basis on which to grant the subject Variance.
The applicant was present but stated that he had no further
comment at this time.
~ommissioner Kellum i) advised that the Variance Committee had
made an on-site inspection of this property and 2) read a report
from the Variance Committee recommending approval of V-252, which
report yes modified to require an irrevocable offer of dedication
for fi~e (5) f~et along the entire frontage of the property.
After discugai6n it was moved by Commissioner Crisp and seconded
by Commissioner:Kellum that the public hearing on V-252 be closed.
Motion carried finanimously and the hearing was closed at 7:50
P.M.
Commissioner Kellum moved, seconded by Commissioner O~Rorke, that
V-252, Anatol Romanof, be approved subject to the condition out-
lined in the modified report of the Variance Comuittee relative
to V-252; motion carried unanimously.
F. UP-72 - Lutluran. Churehw. Fruitvale 4yenu~.- Us~ Permit for Church
The hearing on UP-72 was opened at 7:51 P. M. The Secretary
advised that Notices of Hearing had been mailed and there were
no ~ritten communications on file. He then read the statement
of reason filed by the applicant.
A representative from the Church was present but stated that he
had no further comment at this time.
There ~as no one else present who wished to speak with regard
to this application.
After discussion Chairman Norton directed this matter continued
until the next regular meeting, referred same to the Subdivision
Ceu~ittee for study and a report at that time, and requested that
the applicantss representatives arrange to meet with the Sub-
division Committee on Monday, January 18, 1965, to discuss the
application further.
G. y-253 - John B. Mooney~ Ted Avenue - Variance to allow 3' Side Yard in
lieu of the required 8' Side Yard and one covered Parking Space
in lieu of the required two covered Parking Spaces
The hearing on V-253 was opened at 7:59 P. M. The Secretary
advised that Noticcs of Hearing had been mailed and there ~ere
no ~Titten communications on file. Me then briefly reviewed
this application.

II. C. V~253 - John B. Mooheyt Ted Avenue
The applicant ~s present and explained 1) it had become
necessary to enlarge his home so the garage had been converted
2) he had encountered difficulty in trying to place a two-car
carport on the back of the lot in a manner that would allow him
to save the 30 foot Monterey Pine in his rear yard 3) ~nile he
felt very strongly about saving the tree, neither did he wish to
give up his pool and patio area on the ocher side of the yard
~) since ~his subdivision was developed prior to incorporation,
mahy homes in the area did not meet the present ordinance require-
mehts. .of the ~1 homes built at the same time as his, 15 hav~
converted the garages and only three (3) have built new garages
or carports 5) at least one (1) similar variance had been
granted in the area (Mr. Mercer) and 6) he did not feel that
the subject request, if granted, would be injurious to the public
in any respect.
Cordon Smith of Ted Avenue spoke in support of this application
and observed that Mr, Hooney would encounter difficulty if he :
tried to move ~is portable pool to allow space for the second
carport because of the slope of the lot and the fact that the
pool had been 'rdu in".
After discussion Chairman Norton directed V-253 continued until
the next regular meeting and referred same to the Variance
Conunities for study and a report.
Chairman Norton declared public hearings closed for the evening ht 8:08
with the exception of C-82 ~hich would be discussed later in the evening in
connection with SD-536.
Chairman Norton observed that three (3) newspapers had credited the Conmission
with having opposed the location of a high school bn Prospect Avenue..To clarify
this ~ltuation he explained that.~hile ~he Con~niss~on had discussed'the advantages
and disad~antages bf C~e proposed site and h~d advibed the School District accord-
ingly, the Commission had neither supported nor opposed this lo~a~i~.

In the absence of revised exhibits for SD-529, Chairman Norton
'directed this matter continued until the meeting on January 25,
1965.

After discussion it mas moved by Commissioner O*Rorke and second-
ed by Connissioner RcFa11 that the public hearing on C-82 be
closed. Rotion'~as vacated by unanimous consent.
Commissioner Crisp read the report of the Subdivision Committee
relative to.C-U2.
After further discussion it ~as moved by Commissioner Crisp and
seconded by Commissioner O'Rorke that the hearing on C-82 be
closed; motion carried unanimously and the hearing was closed
at 8:25 P. M,

Commissioner Crisp moved, seconded by Connissioner OsRorke, that
the Subdivision Committee Report of January 11, 1965 relative to
C-82 be adopted and that, subject to approval of the tentative
map for SD-536 (subdivision proposed for this property), the
Commission reconnend to the City Council that C-82 be approved
in accordance with said Subdivision Committee Report. Roll call
vote: Ayes: Commissioners Cowlay, Crisp, Kellum, HcFall, Norton
and OsRorke, Noes: None. Absent: Commissioner Glenn. Hotion
carried unanimously.
III. C. SD-536-Bell Scott Developers, Bi~ Basin Way - Subdivision - 51 Lots
Continued from December 28, 1964
H. L. Splitstone, engineer for the applicants, expressed
~atisfactiou with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Connnissioner Kellum, that
the Subdivision Committee Report of January 11, 1965 relative to
SD-536 be adopted and that the tentative map (Exhibit
filed January 5, 1965) be approved subject to 1) the conditions
~et forth in the Subdivision Committee Report and 2) City
Council approval of C-82, application for change of zoning on the
subject property; motion carried unanimously.
D. SDR7533 - F. &.~. Construction Company, Sobey Raod - Building Site
Approval - I Lot - Revised Tentative 14ap - Continued from
December 28, 1964
The Secretary advised that no word had been received from the
applicant as to whether a solution to the septic tank problem
had been worked out.

Kellum, that SDR-533, F. & H. Construction Company, be denied
without prejudice; motion carried unanimously.
E. SDR-539 - William G. Clark. Horseshoe Driye - Building Site Approval

The Secretary advised that the applicant h~d requested that this
matter be continued until the next regular meeting.

A~ter discussion Commissioner Crisp moved, seconded by
Commissioner HcFall, that the Building Site Co~ittee Report
of January 11, 1965 relative to SDR-540, Dr. Thomas Giannetto,
be adopted and that the tentative map (Exhibit '~', ~iled
December 30, 196~) be approved subject to the conditions
set forth in the Building Site Committee Re~ort; motion
carried unanimously,
G. SDR-5~I - Thomas L. Wallace, Saratoga Avenue - BuildinS Site Approval -
4 Lots
~r. Wallace ~as present and expressed satisfaction with the
proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner ~cFall,
that the Building' Site Committee Report of January 11, 1965
relative to SDP,-541, Thomas L. Nallace, be adopted and that
the tentative mal~ (Exhibit "A', filed December 31, 1965) be
approved subject to the conditions set forth in the Building
Site Connnittee Report; motion carried unanimously.

III. H. SD-542 - Harvey H. Green. Verde Vista Lane - Subdivision - 12 Lots
The applicant expressed satisfaction with the proposed
conditions of approval.
Commissioner Crisp moved, seconded by Commiss~oner Re llum,
that the Subdivision Committee Report of January 11, 1965
relative to SD-542 be adopted and that the tentative map
(Exhibit "A", filed December 31, 1964) be approved subject
to the conditions set forth in the Subdivision Committee
Report; motion carried unanimously.
RECESS AND RECONVENE
Chairman Norton welcomed Mrs. Owens and Messrs. ~mith and Robbins of the Good
Government Group and expressed appreciation for the coffee served by Mrs. Owens
at intermission. He also acknowledged, with pleasure, the presence of Mrs.
Walker, wife of the Planning Director.
IV. DESIGN REVI~4
A. A-158 - TeXaco. inc., SaratoRa-Sunn,~rvale Road .~ Design Review - Sign
for Texaco Service Station - Continued from December 28, 1964
Commissioner Cowley advised 1) revised ~lans had not been
received at the ~ime of the Design Review Committee meetins
on January 7, 1965 a~d 2) unless the revised plans had been
received since that time it was the recommendation of the
Committee that this application be denied with6ut prejudice.
The Secretary advised that no further exhibits had been
received.
Connissioner Cowley moved, seconded by Commissioner OtRorke,
that A-158 b~ denied without prejudice since revised plans
had no~ been filed; motion carried unanimously.
B. 4-156 - Saratoga United Presbyterian Church, Hertitan Avenue - Final
Design Review - Church Building
Commissioner 'CoOley advised that the .Design Revi&v Committee
had reviewed the additional plans submitted by the applicant
and had found them quite satisfactory.
The Secretary explained that olive tree& were proposed as a
sound buffer between the church building and the highway.
Reese Willjams was present to represent the Church but stated
that he he had no further comment.
Commissioner Cowley moved, seconded by Commissioner Kellum,
that final design approval be granted A-156, Saratoga United
Presbyterian Church, in accordance with Exhibits "A-I", "B-l"
and "C"; motion carried unanimously.
C. A-165 - Dr. Marcus K. Bitter, Cox Avenue - Final Design Review - Medical
Office Building - Lot 2, Unit I, Medical Village
Commissioner Cowley explained that the Committee had decided to
regard these plans as preliminary since there was a discrepancy
between the elevations and the site plan that would require a
revision. He further suggested that the Secretary 1) advise
the applicant that the entrance from Cox Avenue was undesirable
and suggest that it be eliminated.
After discussion Chairman Norton requested that the Secretary
write the applicant and request that he meet with the Planning
Director and Director of Public Works to 1) explore the possi-
bility of installing a foot path along the Cox Avenue frontage
and 2) discuss the elimination of the Cox Avenue entrance.
The Chairman further requested that the Secretary contact Dr.
Abrahams relative to the possibility of eliminating by mutual
consent, his walk-way to Cox Avenue.

IV. ~ESIGN REVIE~

It ~as the consensus of the Commission that no action was
necessary until final plans had been filed.
V. CITY COUNCIL REPORT
Commissioner O*Rorke gave a brief report on action taken at the City Council
meeting on January 6, 1965, with emphasis on items of particular interest to
the Planning Commission.
VI. NEt4 BUSINESS
A. SDR-535 - Arthur W. An~erscn~ Sperry Lane - Request for Reconsideration
The Secretary read a letter from Arthur I4. Anderson requesting
reconsideration of Conditions "B', 'C", and "E' established
under approval of the tentative map for SDR-535.
After discussion Chairman Norton directed this matter continued
until the next regular meeting and referred same to the Sub-
division Committee for study and a report at that time.
B. FLOOD ~ONTROL DISTRICT
Commissionif Crisp explained 1) at a recent meeting of the Subdivision
Conmitted, Planning Committee and Flood Control District representatives,
it was the consensus that an easemeht, in lieu of the present fee title
dedication, would be satisfactory in connection with acre and half-acre
lots, but that fee title dedication was necessary in the case of smaller
lots,2) such a change would require an amendment to the ordinance and
3) it ~ras agreed at the meeting that the Flood Control District would
insti3ate a policy of specifying buildin~ lin~s on future maps for
property in low-lying areas or, in some cases, perhaps permit builders
to raise foundations to avoid damage by flooding.
After discussion it ~s the consensus of the Conmisslon that 1) an
easement in the acre and half-acre zoning districts would be acceptable
and 2) specification of building lines on mps for property in low-lying
areas or, in some cases, raised foundations to avoid flood damage, would
be agreeable.
Chairman Norton ~hen directed that 1) the Planning Director request
that ~he City Attorney draft an amendment ~o Ordinance NS-3 covering
the proposed change from fee title dedication to an easement in connec-
tion with acre and half-acre lots and 2) the Planning Director draft
a resolution supl,orting the Flood Control District's proposed policy
relative to showing building lines on future maps or perhaps allowing
raised foundations in some cases.
C. UNDERGROUND UTILITIES
Commissioner Crisp observed that it appeared desirable to include build-
ing sites in the policy statement relative to underground utilities
where practicable. The Commission concurred.
Chairman Norton requested that the Secretary revise the policy statement
relative to underSround utilities to include buildin~ sites and submit
same to the Commission as soon as possible.
VII. OLD BUSINESS
Saratoga Post Office
At the request of the Secretary, ~airman Norton directed this matter
continued until the next regular meeting.
