Present: Commissioners Cowley, Crisp, Kellum, McFall, Norton, and
O'Rorke.
Absent: Commissioner Glenn.
B. MINUTES :
· Commissioner McFall moved, seconded by Commissioner Kellum, that the
reading of the minutes of December 28, 1964 be waived and that the
minutes be a~proved as distributed to the Commission; motion carried
unanimously.

The Secretary read a letter from..~the applicant r~questing that
C'~4 and SD-516 (subdiViSion. app~a~oh filed in ~onjunction
with,~he application for ~ha~ge of-~oning) be withdrawn and that
the filing fees, or a portion thereof, be returned if possible.
The Co~ission observed that th~ applicant would have to contact
the'City Council about any possible refund of filing' fees.
After discussion it was moved by Commissioner Crisp and seconded
by Commissioner O'Rorke that the public hearin~ on C-74 be closed;
motion carried unanimously and the hearing was closed at 7:39 P.M.
Commissioner' Crisp moved,. seconded by Commissioner Kellum, that
the request for withdrawal of C-74 and SD-516 be approved; motion
carried unanimously.

from December 28, 1964
The Secretary advised that no further exhibits had been filed by
the'applicant in connection with this application or SD-529, sub-
division application filed in conjunction with C-76.
On the basis of this information, Chairman Norton directed this
matter continued until the meeting on January 25, 1965.
C. C-81 - Paul Masson, Inc., 'Saratoga Avenue - ChanSe of Zoning from
"R-I-10~b00" ('Singie Family Residential) to "Conditional M"
(Conditional Industrial)'- Continued from December 28, 1964
The Secretary advised 1) the applicant's representatives had met
with the Subdivision Committee and the Plannin~ Committee of the
Council and 2) it had been decided that this matter should be
continued to allow further time for the study and report.

report 'and recommendation prepared prior to the next regular

Chairman Norton, with concurrence of the Commission, deferred
discussion of this matter until later in the evening (when the
subdivision application filed in conjunction ~th C-82~vas up
for discussion).
E. V-252 - Anatol Romanof¶ FoOthill.Lane ~ Variance in Connection with
Site gidth and Area - Continued from December 2a, 1964
The Secretary read a statement from the City Attorney relative to
this application, indicating that the Plannina Commission had a
basis on which to grant the subject Variance.
The applicant was present but stated that he had no further
comment at this time.
Commissioner Kellum 1) advised that the Variance Committee had
made an on-site inspection of this property and 2) read a report
from the Variance Committee recommendinS approval of V-252, which
report was modified to require an irrevocable offer of dedication
for five (5) feet along ~he entire frontage of the property.
After discussion it was .moved by Commissioner Crisp and ~ecouded
by Commissioner .K~llum that' the public'hearing on V-252 be closed.
Motion carried unanimously and the hearing was closed at 7:50

Commissioner Kellummoved, seconded by Commissioner OsRorke, that
V-252, Anatol Romanof, be approved subject. to the condition out-
lined iu the modified report of the Variance Committee relative
to V-252; motion carried unanimously.
F. UP-72 -'.Lutbaran Church, Fruitvale Avenue - Use Permit for Church
The hearing on UP-72 was opened at 7:51P. M. The Secretary
advised that Notices of Hearing had been mailed and there were
no written communications on file. He then read the statement
of reason filed by the applicant.
A representative from the Church was present'but stated that he
had no further comment at this time.
There was no one else present who wished to speak with regard
to this application.
After discussion Chairman Norton directed this matter continued
until the next regular meeting, referred same to the Subdivision
Committee for study aud'a report at that time, and requested that
the applicantss representatives arrange to meet with the Sub-
division'Committee on Nonday, January 18, 1965, to discuss the
application further.
G. V-2~) - John B. Moohey, Ted Avenue - Variance to allow 3' Side Yard in
lieu of the required 8~2Side Yard and one covered Parking Space
in lieu of the required'two covered Parking Spaces
The hearing on V-253 was opened at 7:59 P. H. The Secretary
advised that Notices of Hearing had been mailed and there were'
no written communications on file. He then briefly reviewed
this application.

The applicant x~as present and explained 1)'it had become
necessary to;enlarge his home so the garage had been converted
2)' he" had encountered difficulty in trying to place a two-car
carport on the buck of the lot in a manner that ~ould allow him
to save the 30 foot Monterey Pine in his rear yard 3) while he
felt very strongly about saving the tree, neither did he wish to
give up his pool and patio area on the other side of the yard
4) since this subdivision was developed prior to incorporation,
many homes. in the area did not meet the present ordinance require-
ments. . .of the 41 homes built at the same time as his, 15 have
converted the garages and only three (3) have built new garages
or carports 5) at least one (1) similar variance had been'
granted in the area (Mr. Mercer) and 6) he did not feel ~hat
the subject request, if granted, would be injurious to the public
in any respect.
Gordon Smi'th of Ted Avenue spoke in support. of this application
and observed that Mr. Moohey would encounter difficulty if he
tried to move his portable poOl"to allow space for the second
carport because of the slope'of the lot and the fact that the
pool had been "dug in".'
After discussion Chairman Norton directed V~253 continued until
the next regular meeting and' referred sam~ to the Variance
Committee for study and. a report.

In the absence of revised exhibits for SD-529, Chairman Norton
directed this matter continued until the meeting on January 25,

28, 1964
The continued hearing on C-82 was resumed at 8:14 P. M.
After discussion it was.moved by Commissioner O'Rorke and second-
ed by Commissioner McFall that the public hearing on C-82 be
closed. Motion was vacated by unanimous consent.
Commissioner Crisp read.the report of the Subdivision Committee
relative to 8-82.
After further discussion it was moved by Commissioner Crisp and
seconded by Commissioner O'R0rke'that the hearing on C-82 be
closed; motion carried unanimously and the hearing was closed
at 8:25 P'. M.'=.

Commissioner Crisp moved, seconded by'Commissioner O'Rorke, that
the Subdivision Committee Report of January 11, 1965 relative to
C-82 be adopted and that', subject to approval of the tentative
map for SD-536 (subdivision proposed for this properey), the
Commission recommend to the City Council that C-82 b~ approved
in accordance with said Subdivision Committee Report. Roll call
vote: Ayes: Commissioners Cowley, Crisp, Kellum, McFall, Norton
and O'Rorke. Noes: None. Absent: Commissioner Glenn. Motion
carried unanimously.

Continued from December 28, 1964
M. L. Splitstone, engineer for the applicants, expressed
satisfaction with the. proposed conditions of approval.
Commissioner Crisp moved,' seconded ..by Commissioner Kellum, that
the Subdivision COmmittee Report of January 11, 1965 relative to
SD-536 be adopted ,and that ~he tentative map (Exhibit "A-3",
filed January 5, i965) be approved subject to'.l) the conditions
set forth in the Subdivision Committee Report.and 2) City
Council approval of C-82, application for change of zoning ou the

The Secretary advised that the applicant had requested that this
matter be continued until the next regular meeting.
Chairman Norton, with concurrence of the Commission, so directed.
F. SDR-540 - Dr. Thomas Ciannett.?, Farwell Avenue - Building Site Approval
- 1 Lot
After discussion Commissioner Crisp moved, seconded by.
Commissioner McFall,'that the Building Site Committee Report
of January 11, 1965 relative to SDR-540, Dr. Thomas Ciannetto,
be adopted and that the tentative map (Exhibit "A", filed
December 30, 1964) be approved subject to the conditions
set forth in the Building Site Committee Report; motion
carried unanimously.'
G. SDR-541 - Thomas L. Wallacew Saratoga Avenue - Building Site Approval -
4 Lots
Mr. Wallace was present and expressed satisfaction with the
proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner HcFall,
that the Building Site Committee Report of January 11, 1965
relative to SDR-541, Thomas L, Wallace, be adopted and that
the tentative map (Exhibit "A", filed December 31, 1965) be
approved. subject to the conditions set forth in the Building
Site Committee Report; motion carried unanimously.

The applicant expressed satisfaction with the proposed
· conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum,
that the Subdivision Committee:Report.of January 11, 1965
relative to SD-542 be'adopted and that:the tentative m~p
(Exhibit "A", filed December 31, 1964) be approved subject
to the conditions set forth in the Subdivision'Committee
Report; motion carried unanimously.
RECESS AND RECONVENE '
Chairman Norton welcomed Mrs. Owens and Messrs. Smith and Robbins of the Good
Government Group and expressed appreciation for the coffee served by Mrs. Owens
at intermission. He also ackno~ledged, with pleasure, the presence of Mrs.
Walker, wife of the Planning 'Director.
IV. DESIGN REVIEW
A.. A-158 - Texaco~. Inc.~ Sarato~a-Sunnyvale Road-- Design Review - Sign
for Texaco Service'Station - Continued from December 28, 1964
Commissioner Cowley advised l) revised plans had not been
received at the time.of the Design Review Committee meeting
on Jahuary 7, 1965 and 2) unless the revised'plans had been
received since that time it was the recommendation of the
Committee that this application be denied without prejudice.
The .Secretary advised that no further exhibits had been
received.
Commissioner Cowley mOVed, seconded by CommissiOner OtRorke,
that'A-158 be denied without prejudice since revised plans
had not been filed; motion carried unanimously.

Design Review - Church Building
Commissioner Cowley advised that the Design Review Committee
had reviewed the additional p~ans submitted by the' applicant
and had found them quite satisfactory.
~he Secretary explained'that olive trees were proposed as a
sound buffer between the church building and the highway.
Reese Willjams was present to represent the Church but stated
that he he had no further comment.
Commissioner Cowley moved,'seconded by Conunissioner Kellum,
that final design approval be granted A-156, Saratoga United
Presbyterian-Church, in accordance with Exhibits "A-I", "B-I"
and "C"; motion carried unanimously.
C. A-165 - Dr. ~rcus K. Bitter, Cox Avenue ·-'Final Design Review - Medical
Office Building - Lo~ 2, Unit I, Medical Village
Commissioner Cowley explained that the Committee had decided to
regard these plans a~ preliminary since there was a discrepancy
between the elevations and the site plan that would require a
revision. He further suggested that the Secretary l) advise·
the applicant that the entrance from Cox Avenue·was undesirable
and suggest that it be eliminated.
After discussion Chairman Norton requested that the Secretary
write the applicant and request that he meet with the Planning
Director and Director of Public WOr~s to 1) explore the possi-.
b'ility of installing.a foot path along the Cox Avenue frontage
and 2) discuss the.elimination of the Cox Avenue entrance.
~he Chairman further'requested that the Secretary contact Dr.
Abrahams relative to=the possibility of eliminating by mutual
consent, his walk-way to Cox Avenue.

Commissioner O'Rorke Save a brief report on action taken at the City Council
meeting on January 6, 1965, with emphasis on items of particular interest to
the Planning Commission.
VI. NEW BUSINESS

The Secretary read a letter from Arthur Wi Anderson requesting
reconsideration of Conditions "B", "C", and "E" established'
under'approval of the tentative map for SDR-535.
After discussion Chairman Norton directed this matter continued
until the next regular meeting and referred same to the Sub-
division Committee for study and a report at that time.
B, FLOOD .CON~QL DISTRICT
CommiSsioner Crisp explained 1) at a recent meeting of the Subdivision
Committee, Planning C0mm~t~ee and Flood Control District representatives,
it.was the coBsensus that an easement, in lieu of the present fee title
dedicatiom~.~eu!d be satisfactory in connection with acre and half-acre
lots~ :but t.h~ fee.title dedication was necessary in.the case of smaller

After discussion it was the consensus of the Commission that 1) an
easement in the acre and half-acre zonina districts would be acceptable
and 2) specification of building lines on maps for property in low-lying
areas or, in some cases, raised foundations to avoid flood damage, would
be agreeable.
Chairman Norton then directed that 1) the Plannin~ Director request
that the City Attorney draft an amendment to Ordinance NS-3 covefinE
the proposed change from fee title dedication to an easement in connec-
tion with acre and half-acre lots and 2) the PlanninE Director draft
a resolution supForting the Flood Control District's proposed policy
relative to showins building lines on future maps or perhaps allowing
raised foundations in some cases.
C. UNDERGROUND UTILITIES
Commissioner Crisp observed that it appeared desirable to include build-
ing sites in the policy statement relative to underground utilities
where practicable. The Commission concurred.
Chairman Norton requested that the Secretary revise the policy statement
relative to underground utilities to include building sites and submit
same to the Commission as soon as possible.

At the request of the Secretary, Chairman Norton directed this matter
