I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:30 P.M.
A. ROLL CALL

B. MINUTES
Commissioner McFall moved, seconded by Commissioner Kellum, that the reading
of the minutes of March 8, 1965 be waived and that the minutes be approved
sdbject to the following modification:

VIII. A. 3. SD-481 - John Antonuccio, Brandywine Drive - Request for Extension
The Secretary advised that a request had been
filed for an extension of one (1) year in connec-
tion with SD-481.
Commissioner Crisp, moved, seconded by Commlissioner
Kellum, that an extension of one (1) year from the
present date of expiration be granted in connection
with SD-481 as requested; motion carried unanimously.
Motion carried unanimously.
II. PL~LI~..H. EARINGS
The Chairman declared public hearings open for the evening at 7:35 P.M.
A. C-76 - Robert Taylor Construction Company, Prospect Road - Change of
Zoning from "R-I-40,000" (Single Family Residential) to "R-I-40,000
P-C" (Single Family Residential Planned Community) - Continued from
March 8, 1965
The applicant was present and advised 1) they had been working diligently
on the revised tentative map 2) they felt the City would find the new map
satisfactory and 3) a sixty (60) day extension was requested since addition-
al time was needed to complete the map and the City would need sufficient
time for review of same.
Commissioner Crisp explained that he would prefer a six month extension
since he felt sixty (60) days would not be adequate for completion of the
revised map and processing of same by the City.
N. P. Moerdyke, one of the owners of the subject property, advised 1) the
owners were opposed to a lengthy extension of time 2) they realized, however,
that Mr. Taylor had invested a areat deal of money in engineering fees and
wanted to be reasongibe and 3) it was the suggestion of the owners that
Mr. Taylor withdraw the applications and re-file, if he so desired, at a
later date.
Commissioner McFall concurred that sixty (60) days would he inadequate for
completion of the revised map and processing of same.

II. A. C-76 - Robert Taylor Construction gompany~ Prospect Read
After further discussion, r~. Taylor submitted a letter requesting with-
drawal of 6-76 and SD-529 without prejudice.
Commissioner McFall moved, seconded by Commissioner Crisp, that the public
hearing on C-76 be closed; motion carried unanimously and the Chairman
declared the hearing closed at 7:43 P.M.
Commissioner Crisp moved, seconded by Commissioner McFall, that Mr. Taylor~s
request for withdra~ral without prejudice of C-76 and SD-529 be granted;
motion carried unanimously.
B. UP-74 - Dr. Robert Wade, Souza Lane - Use Permit to allow Convalescent
Hospital adjacent to Westmoreland Convalescent Hospital - Continued

C. UP-75 - Mrs. Luceal W.e. stmoreland, Souz~ Lane - Use Permit to allow expansion
of Westmoreland Hospital - Continued from March 8, 1965
Commissioner Kellum advised, with reference to UP-74 and UP-75, that the
Committee had contacted tile State, the Fire Marshal, the Sheriff"s Office
and others in its review of these applications but that further study was
needed before a recommendation could be made.
On the basis of the foregoing, Chairman Norton directed L~-74, D~. Robert
Wade, and UP-75, Mrs. Luceal Westmoreland, continued until the meeting on
April 12, 1965,
D. UP-76 - Rachel A. Day and Mary E. Johnson, Pas~o Tierra - Use Permit for
Nursery School - Continued from March 8, 1965
The Secretary advised that no further exhibits had been ~iled in connection
with this application.
There was no one in the audience who wished to comment with regard to this
matter.
Commissioner Crisp read the report of the Subdivision Committee pertaining
to UP-76, which report recommended denial of the application.
It was moved by Commissioner McFall and seconded by Commissioner Crisp
that the public hearing on UP-76 be closed; motion carried unanimously
and the hearing was closed at 7:49
Commissioner Kellum moved, seconded by Commissioner Crisp, that the
Subdivision Committee Report relative to UP-76 be approved and that the
application be denied for the reasons set forth in said report; motion
carried unanimously.
E. PHARMACISTS - Request from Dr. Isaac N. Abrams,"Pharmacists' be added
to the list of Permitted Uses for the Medical Village at
Saratoga and Cox Avenues - Continued from M~rch 8, 1965
The Secretary read a letter from Herman J. Mager of Haloroe, Mager & Chasuk,
attorneys for the Quito Shopping Center, opposing the granting of the subject
Use Permit on behalf of the Shopping Center.
There was no one in the audience who wished to comment with regard to this
matter.
Commissioner Crisp read the report of the Subdivision Committee relative
to the subject request, recommending denial of same.
After further discussion Commissioner McFall moved, seconded by Commissioner
Crisp, that the report of the Subdivision Committee relative to Dr. Abrams
request that "Pharmacists" be added to the list of permitted uses for the
Medical Village be adopted and that the request be denied on the basis of
said report; motion carried unanimously.

II. F. AUTOMOTIVE REPAIR SHOP - Request from Charles M. Schwab that "Automotive
Repair Shop" be added to the list of Conditional
Uses for the "C-N" (Neighborhood Commercial)
Zoning District - Continued from March 8, 1965
The Secretary briefly reviewed this matter and advised that no further
exhibits had been received.
B. T. Galeb, Seagull Way, again advised that he felt the proposed use, on
a temporary basis, would be an asset to the area.
CoF~issioner Crisp read the report of the Subdivision Committee relative
to this matter, recommending that Mr. Schwab's request be denied.
After discussion Commissioner McFall moved, seconded by Commissioner Crisp,
that the report of the Subdivision Committee relative to Mr. Schwab's
quest be adopted and that the request be denied for the reasons set forth
in the report; motion carried unanimously.
G. UP-77 - Sisters of Notre Dame De Namur, California Province, Norton Road-
Use Permit for Montessori Pre-School
The hearing on UP-77 was opened at 8:00 P.M. The Secretary advised that
Notices of Hearing had been mailed and there were no written communications
on file.
Don French, applicant's architect, explained 1) the proposed school was
planned for a maximum of thirty (30) students 2) traffic would consist of
approximately twelve (12) cars at 9:00 A.M., 12:00 Noon, 1:00 P.M. and
~:00 P.M. 3) there was ample space for parking and 4) a traffic turn-
around was planned.
There was no one in the audience who wished to comment with regard to
this matter.
After further discussion, Chairman Norton directed UP-77 continued until
the meeting on April 12, 19~5 and referred same to the Subdivision Committee
for study and a report at that time.
H. UP-.7.8 - George W. Day Construction CompanT, Ranfre L~ne - Use Permit for
Model Home Sales Office
The public hearing on UP-78 was opened at 8:06 P.M. The Secretary advised
that Notices of Hearing had been mailed and there were no written communi-
cations on file.
Ed Kolstad was present to represent the applicant but stated that he had
no further comment at this time. In answer to a question from the Planning
Director, he advised that the model home and corporation yard in the
Glenview Subdivision would be discontinued at the time the subject model
home was established.
Frank Dees, Ranfre Lan%,who stated that he also represented others in the
neighborhood, advised that he had no objection to the granting of the
subject Use Permit, but requested that, for the benefit of all (from an
aesthetic viewpoint), the existing "Kentfield" identification sign be
replaced with a more appropriate permanent identification sign.
Mr. Kolstad assured Mr. Dees of their willingness to comply with this
request.
After further discussion Conunissioner Kellum moved, seconded by Co~mis-
siouer McFall, that the hearinG on UP-78 be closed; motion carried
unanimoulsy and the hearing was closed at 8:10 P.M.
It was moved by Commissioner Crisp and seconded by Commis loner Kellum
that UP-78, George W. Day Construction Company, Use Permit for model
home sales office, be Granted for a period of one (1) year; motion
carried unanimously.

II. I. pP-79 - Bryce Eaker~ Allendale Avenue - U~e Permit for Nursery School
The public hearing on UP-79 was opened at 8:11PoMo The Secretary
advised that Notices of Rearing had been mailed and there were no written
communications on file.
}k'. and ~s. Baker were present and advised 1) their program was varied,
designed to prepare the children for school 2) four classrooms were pla~med
with a maximum of twenty (20) children per classroom and a maximum of ten
(10) students per teacher 3) startin~ times for the various classes would
be staggered to ease the traffic situation and 4) they felt that the sub-
ject site would De desirable for this use, particularly with respect uo
accessibility.
Megdames Springer and Grabill and Messrs. Schram, I~itlock, Seequist, Sepo
and Basserr, all residents of the subject area, opposed the granting of
this Use Permit on the basis of 1) the noise factor 2) traffic congesti~
and 3) incompatibility with residential atmosphere of area. ~. Schram~
also f~led a petition protesting the proposed use, signed by forty-one (41)
residents of the general area.
Donald Jones of San Jose, former Santa Clara University professor, stated
that he was quite familiar with Mr. and ~,~s. Baker's existing school
(}~milton Avenue) and felt that a school operated by the Bakers would be a
credit to any community.
Mrs. Kent, Clemson Avenue, spoke in support of the subject application.
She explained 1) she, too, was familiar with the Bakers school 2) she
felt that there was a need for such a school in Saratoga and 3) based
upon her experience (both Mrs. Kent and her husband are teachers) she felt
that denial of the Use Permit would deprive Saratoga of a wonderful
opportunity.
Floyd Davis, Fortune Court, stated that he had no objection to the proposed
nursery school.
Dan Roberrs, Harleigh Drive~ advised that he was one of the owners of the
subject property and observed I) Mr. Baker had approached this matter in
a very professional manner 2) his existing school enjoys an excellent
reputation and 3) responsibile parents would be driving the children to
and from school and the circular driveway would provide a safe place for
loading and unloading.
Bob Frederichs stated that he felt there were definite advantages in having
~ood pre-schools and he would like to have the Bakers open the proposed
school.
When Chairman Norton requested a show of hands relative to this matter,
eighteen (18) persons indicated that they were opposed to the granting of
this Use Permit and seven (7) persons indicated that they were in favor.
After discussion Chairman Norton directed UP-79 continued until the
meeting on April 12, 1965 and referred same to the Subdivision Committee
for study and a report at that time.
The Chairman declared public hearings closed for the evenins at 8:39 P.M.

III. B. SDR-546 - Mason Shaw. Big Basin Way
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Build-
in8 Site Committee Report of 22 ~arch 1965 relative to SDR-546 be adopted
and that the tentative map (Exhibit "A-I", filed 11 March 1965) be approved
subject to the conditions set forth in said report; motion carried unanimous-
ly.
C. SD-552 - George W. Day Const[uction Con~an7. Fruitvale Avenue - Subdivisto,~
- 45 Lots
After discussion Jim Cole, applicant~s engineer, expressed satisfaction
with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Sub-
division Committee Report of 22 ~rch 1965 relative to SD-552 be adopted
and that the tentative map (Exhibit "A", filed 4 March 1965) be approved
subject to the conditions set forth in said report; motion carried unaninlous-
ly.
D. ~DR-553 - Marion Day. Le.rpa Rio - Buildin~ Site Approval - 4 Lots
After discussion the Building Site Committee directed that Condition II.,
B., of the proposed conditions of approval be modified to read as follow~:
II. B. Construct storm drain from southeast corner of Parcel D
to Saratoga Creek in accord with Saratoga Master Storm
Drainage Plan as approved by the Director of Public Works.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Build-
ing Site Committee Report of 22 ~rch 1965 relative to SDR-553, as modified,
be adopted and that the tentative map (Exhibit "A", filed 9 March 1965) be
approved subject to the conditions set forth in said Committee Report;
motion carried unanimously.
E. ~DR-554 - Michael E. Purcell, Pierc~.Road - Building Site Approval - 1 Lot
The applicant's representative (Mr. Brow) expressed satisfaction with the
proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Side Committee Report of 22 March 1965 relative to SDR-554 be
adopted and that the tentative map (Exhibit "A", filed 10 March 1965) be
approved subject to the conditions set forth in the Committee Report;
motion carried unanimously.
F.SDR-555 - Mrs. Rose Rober~son~ Piedmont Road - Building Site Approval -
The applicant was not present.
After a brief discussion, Commissioner Crisp moved, seconded by Commissioner
Kellum, that the report of the Building Site Committee of 22 b~rch 1965
relative to SDR-555 be adopted and that the tentative map (Exhibit "A",
filed 11 March 1965) be approved in accordance with the site development
plan (Exhibit "A" , filed 11 March 1965) subject to the conditions set forth
in said report; motion carried unanimously.
G. SDR-556 -Chet Akins. Saratoga Avenue - Building Site Approval - 1 Lot
Commissioner Crisp advised that the Committee had been unable to complete
its report relative to SDR-556 but that there were no obvious problems and
the report would, no doubt, be ready for the next regular meeting.
On the basis of the foregoinG, Chairman Norton directed SDR-556 continued
until the meeting on April 12, 1965
Chairman Norton extended a welcome to Councilman Drake and to Mrs. Parker of the
Good Government Group, and expressed the appreciation of all for the coffee served
by Mrs. Pakker at intermission.

IV. DESIGN R~VIEW
A. A-140 - Finne~an Construction Company, Herriman Ave~_~u~ - Final Design
Approval - ~lence
Chairman Norton deferred discussion of this matter until later in the
evening since Mr. Finnegan had not arrived.
B. A-170 - ~son Shaw,~iR Basin Way - Preliminary Design Reivew - Commercial
Building - Revised Plans
Cormnissioner Cowley advised that the Committee had reviewed Mr. Shaws
revised plans and had found the change commendable.
After disccussion, Commissioner Cowley moved, seconded by Commissioner
O'Rorke, that preliminary design approval be granted A-170, Mason Shaw,
for the commercial building sho~ on Exhibit A-Z; motion carried unanimous-
ly.
C. A~174 - Drs. Coo.ley and Polk, Saratoga Avenue - Final Design Review -
Medical Building -~Medical Village
Commissioner Cowley advised that the Comanittee had met with the applicants
to review the plans for A-174 and had found that the parking ~s inadequate
He further advised that the applicants had hoped to revise the plans before
this meeting but had been unable to do so, so suggested that this matter be
continued.
Dr. Abrams explained that the revised plans had been delayed since they
were trying to work out a solution to the parkinG for the entire Medical
Village.
Dr. Cooley requested that the Commission grant a conditional approval sub-
ject to provision of adequate parking so that they could proceed with bids
on the building.
Commissioner Cowley advised that the plans were quite satisfactory with
the exception of the parking, so he had no objection to grsating preliminary
design approval.
After discussion Commissioner Cowley moved, seconded by Commissioner
O'Rorke, that A-174, Drs. Cooley and Polk, be granted preliminary design
approval of the medical building as shox~ on Exhibit "A" subject to resolu-
tion of the parking problem associated ~.~th A-174; motion carried unanimous-
ly.
A. A-140 - Finne~n Construction Company~ Herriman Avenue - Final Design
Approval - Pence
Mr. Finnegan was present and submitted a color rendering of the proposed
~ence.
After discussion Commissioner Cowley moved, seconded by Commissioner O'Rorke,
that final design approval be granted A-140 for the fence as sho~m on Exhibits
"A" and "B" (fence to run approximately 600 feet along tIighway 9), Exhibit
"B" of which is the new color rendering, and that the applicant be required
to plant a three (3) foot strip of ground cover between the fence and walk-
way, planting to be approved by the Planning Director; motion carried
unanimously.
V. CITY COUNCIL R~PORT
Commissioner O~Rorke advised that he had artended the City Council meetin~
on M~rch 17, 1965 and while it was a busy meeting, there ~as nothing of
particular interest t~ the Commission.

VI. NEI~ BUSINESS
SDR-530 - B. Michael Anderson~ Pike Road - Request for Modification of Condition
The Secretary advised 1) B. M. Anderson had filed a request for modification
of Condition II., A., established under SDR-530 2) this condition requires
improvement of the access road from Pike Road to the southerly property line
3) Mr. Anderson had requested that he be allowed to post bond for the last 150
feet of this road since it would not be used at the present time and would only
deteriorate as a result 4) the thirty (30) day period for requesting reconsid-
station from the Commission had expired so this request would have to gc to the
City Council and 5) he had brought the matter to the attention of the Commission
since the Council would no doubt ask for a recommendation.
After discussion Chairman Norton, with concurrence of the Commission, directed
that the Secretary inform the City Council that the Commission had no objection
to Mr. Anderson's being allowed to post a bond coverin~ improvement of the last
150 feet of the subject access road.
VII. OLD BUS~ESS
A. SDR-467 - Joyce Nen~ry. Canyon View Drive - Request for Extension
Commissioner Crisp advised that after a review of the conditions established
in connection with the subject building site approval, it ~as the recommend-
ation of the Committee that an extension of one (1) year (total) be granted
as requested.
Commissioner Crisp moved, seconded by Commissioner Kellum, that SDR-467 be
granted an extension of one (1) year total, makins the new expiration date
March 9, 1966; motion carried unanimously.
B. County Planning A~enda Items
1. Service S~ation - Prospect and Johnson Avenues
The Secretary advised that the application for a service station at
Prospect and Johnson Avenues had been denied by the County Planning
Commission but had been appealed .to the Board of Supervisors.
Consissioner O'Rorhe moved, seconded by Commissioner Crisp, that the
Planning Director be authorized to attend the meeting of the Board
of Supervisors and oppose the grantin~ of this application on behalf
of the City of Saratoga; motion carried unanimously.
2. Variance in Site Area - Bainter Avenue Area
Chairman Norton advisJd that he had noticed an article in the paper
stating that variances in site area had been granted in the Bainter
Avenue area, but he had been unable to determine just how significant
the variances were.
Durin% the discussion that followed, it ~ras determined that 1) the
County~s acre zonin3 requires a full 43,560 square feet 2) the
variances had been granted to allow approximately ,9 acre lots and
3) the matter was being appealed to the County Planning Commission.
Chairman Norton, with concurrence of the Commission, directed that the
Secretary check into this matter and, if the lots are substantially
smaller than those allowed in Saratoga, oppose on behalf of Saratoga.
VIII. COM~.[JNICATIONS
A. E'~ITTEN
1. B~!ders Association - Santa Clara County
The Secretary read a letter filed by Ernest M. Ornel!as, Executive
Vice President of the Builders Association, requesting a study session
to discuss the design standards incorporated into Ordinance NS-3 under
Ordinance NS-3.7.

VIII. A. !. Builders Associotion - Santa Clara County
Commissioner Cowley suggested that this study session be held with
the entire Commission rather than just the Design Review Committee
and that the Commission request that an outline of items to be
discussed, including constructive proposals, be submitted by the
Builders Association ten days prior to the study session.
The Commission concurred with Commissioner Cowley's suggestion
and Chairman Norton directed that the Secretary notify Mr. Ornellas
accordingly.
2. SDR-480 - A. D. Houston. Houston .Court - Request for Extension
The Secretary read a letter requesting an extension in c~nection
with SDR-~80.
After discussion Co~issioner Crisp moved, seconded by Co~issioner
McFall, that an extension of one (1) year from the present date of
expiration be granted in connection with SDR-480; motion carried
unanimously.
3. SDR-346 - Dr. ~x Robbing, S~ratoRa Avenue - Request for Extension
SD-347 - Dr. Isaac N. Abrams. Saratoga Avenue - Request for ExteDsion
The Secretary 1) read a letter from Dr. Abrams requesting an extension
until September 1, 1965 in connection with SDR-346 and an extension
of one (1) year in connection with SD-347 2) advised that it would
be necessary to refer this request to the City Council since both
tentative maps had previously been extended and 3) suggested that
the Commission ~ke a rec~endation to the Council regarding the
request.
After discussion Commissioner Crisp moved, seconded by Commissioner
Kellum, that the Planning Commission reco~end to the City Council
that Dr. Abrams' request for extensions in connection with SDR-346
and SD-347 be approved as requested; motion carried unanimously.
B. O~L
SDR-534 - Donald R. McCormac~, Douglas Lane
The Secretary advised that this application had been extended to ~rch
23, 1965 in view of the pending adoption of Ordinance NS-3.9, pertaining
to inclusion of Flood Control Easemen~ square footage in the site area
of half-acre and acre lots. He further advised that while the ordinance
had been adopted, it was still in the 30 day waiting period, so a further
extension would be required in connection with SDR-534.
During the discussion ~hat followed it was decided that this application
could be approved subject to elimination of Conditions II., E., and
G.
Co~issioner Crisp moved, seconded by Co~issioner McFall, that the
Building Site Co~ittee Report of 23 November 1965 relative to SDR-534
be adopted and that the tentative map (Exhibit "A", filed 13 November 1964)
be approved subject to the conditions set forth in said report with the
exception that Conditions II., E., and II., G., of the report are to be
eliminated; motion carried unanimously.

Chairman Norton declared the meeting adjourned at 10:24 P.M.
