MINUTES Commissioner McPall moved, seconded by Commissioner Crisp, that the readins of the minutes of March 22, 1965 be ~mived and that the minutes be approved as submitted to the Commission; motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:32 P,M. A. UP-74 - Dr. Robert ~de, Souza Lane - Use ~ermit to allo~ Convalescent Hospital adjacent to Westmoreland Convalescent Hospital - Continued from March 22~ 1965 . B. UP-75 - Mrs. Luceal Westmoreland, Souza Lane - Use Permit to allow expansion of Westmoreland Convalescent Hospital - Continued from March 22, 196~ The combined public hearing on UP-74 and UP-75 was resumed at 7:33 P.M. The Secretary advised that no further communications had been filed in connection with these applications. Both applicants were present, together with their representatives. Cormnissioner Kellum read the report of the Subdivision Committee per- taining to these matters, recommending that both UP-74 and UP-75 be approved subject to certain conditions. Carl Koch, Souza Lane and quite Road, requested that a bond be posted with the City of Saratoga to guarantee protection of his property when the eucalyptus tree ~.ms removed. After discussion, the Subdivision Committee directed that its report of April 6, 1965 relative to UP-74 and UP-75 be amended as follows: Page 2. .paragraph 4, c...second line...Omit"a". Page 3. .paragraph 5, f. . . Add the following: "Insurance or bond for protection of property required." Commissioner Crisp moved, seconded by CoFmissioner McFall, that the public hearing on UP-74 and UP-75 be closed; motion carried unanimously and the hearin~ was closed at 7:44 P.M. It was moved by Con~aissioner Crisp and seconded by Commissioner Kollum that the Subdivision Committee Report of April 6, 1965 relative to UP~74 and UP-75 be approved, as amended, and that UP-74 and UP-75 be granted subject to the conditions set forth in said report; motion carried unanimously. -1- Plannin~ Commission Minutes - April 12, 1965 - Continued C. UP-77 - Sisters of Notre Dame De Namur, California Province, Norton Road Use Permit for Montessori Pro--School - Continned from 1.|arch 22. 1965 _ Donald French, architect, present to represent the applicant, stated that he had no further comment at this time. Commissioner Crisp read the report of the Subdivision Conmittee rela- tive to this matter, recommending approval. After discussion, it was moved by Commissioner McFall and seconded by Commissioner Crisp, that the public hearing on UP-77 be closed; motion carried unanimously and the hearing was closed at 7:50 P.M. Conmlissioner Crisp moved, seconded by Commissioner McFall, that the report of the Subdivision Committee of April 12, 1965 relative to UP-77 be approved and that UP-77 be granted subject to the conditions set forth in said report; motion carried unanimously. D. UP-79 - Bryce Ba~er, Allendale Avenue - Use Permit for Nursery School ~ Continued from March 22. 1965 The Secretary advised that three (3) petitions had been filed by the applicant in support of his application. One petition was signed by 43 residents of the immediate area, another by 92 residents of Saratoga, and the third by 20 residents of the immediate area of his existing school (Hamilton Avenue). Both Mr. and Mrs. Baker ~-ere present and expressed willingness to answer questions relative to their proposed school. Commissioner Crisp advised that the Committee had been unable to complete its study so recommended that this matter be continued until the meeting on April 26, 1965. Chairwan Norton, with concurrence of the Conmission, so directed. Ihe Chairman declared public hearings closed for the evening at 7:56 P.M. III. SUBDIVISIONS AND BUILDING SITES A. ~DR-556 - Chat Akins, Saratoga Avenue - Building Site Approval - 1 Lot - Continued from March 22. 1965 The applicant was not present. After discussion, Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 8, 1965 rela- tive to SDR~556, Chat ~'2~ins, 1 lot on Saratoga Avenue, b~ adopted and that the tentative ~qp (Exhibit "A", filed ;~rch !2, 1965) be approved subject to the conditions set forth in said report; motion carried unani~nously. B. SDR-557 - Cdr. Lloyd N. Case Verde Vista Lane - Building Site Approval - 1 Lot Cdr. Case expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 12, 1965 relative to SDR-557, Cdr. Lloyd N. Case~ 1 lot on Verde Vista Lane, be adopted and that the tentative ma.p (Exhibit "A", filed March 25, 1965) be approved subject to the conditions set forth in said report; motion carried unanimously. C. SDR-558 - Dr. R. G. Merkle7. Pike Road - Buildin% Site Approval - 2 Lots Ty Papalias, present to represent the the applicant, expressed satis- faction with the proposed conditions of approval, after being assured by the Commission and the Planning Director that credit would be given for the bond posted by }~. Merkley~ Pike Road - Buildin~ Site Approval - 2 Lots ConuniSsioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 12, 1965 relative to SDR-558, Dr. ~o G. Merkley, 2 lots on Pike Road, be adopted and that the tenta- tlve map (Exhibit "A", filed April 1, 1965) be approved subject to the conditions set forth in said report; motion carried unanimously. D. SDR-559 - Jerome J, Lohr, Blauer Drive - BuildinR Site ApDroval - 1 L~t ~. Lohr expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Co~issioner Kellum, that the Building Site Committee Report of April 12, 1965 relative to SDR-559, Jerome J. Lohr, I lot on Blauer Drive, be adopted and that the tenta- tive map (Exhibit "A", filed April 1, 1965) be approved subject to the conditions set forth in said report; motion carried unamimously. E. SDR-560 - Stuart S. Smith, Hill Avenue - Building Site Approval - 1 Lot The applicant was ~ot present. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 12, 1~65 relative to SDR-560, Stuart S..Smith, 1 lot on Hill A~enua, be adopted and that the tenta- tive ~ap (Exhibit "A", filed April 2, 1965) be approved subject to the conditions set forth in said report; motion carried unanimously. IV. DESIGN REVIEW A. A-171 - Immanuel Lutheran Church (American), Saratoga Avenue - Final Design Review - Church Buildin~ Commissioner Cowley advised 1) the Committee had reviewed the plans for the proposed Church and 2) the only question raised was with refer- ence to the proposed egress onto Saratoga Avenue. The Secretary explained that under the Use Permit for the subject Church, the Saratoga Avenue entrance was restricted to ingress only. Norman Milde was present to represent the Church and advised that he would inform the Building Committee. Commissioner Cowley moved, seconded by Commissioner Wright, that final design approval be granted A-171, Im~nucl Lutheran Church, for the church building shoxQn on Exhibits "B" and "C", with the condition that there be no egress from the entrance on Saratoga Avenue; motion carried unanimously. B. A-174 - Drs. Cooley and Polk, Saratoga Avenue - Final Design Review - Medical Buildin~ - Medical Village The Secretary advised that he had been informed by the applicant that the parking plan for the subject medical building had not yet been completed but would be submitted prior to the meeting on April 26, 1965. On the basis of the foregoing, Commissioner Cowley recommended tha~ A-174 be continued until the meeting on April 26, 19~5. Chairman Norton so directed. C. A-175 - Saratoga Carpet, Saratoga-Sunnyvale Road - Final Design Review Identification Sign Commissioner Cowley recommended that this matter (A-175) be continued until the next reZular meeting since the existing signs on the subjact property had not been removed as required in connection {Qith approval of the Redwood Empire sign. A-176 - St. Androws Episcopal Church, Saratoga Avenue - Preliminary Design Revieu - Classrooms Commissioner Crisp requested tibet he be excused from participation in this m~tter becau~;e of his affiliation with St. Andtongs Church. Chair- man Norton granted this request, at which time Com~issioner Crisp joined the audience. The Secretary advised that there had been a misunderstandin~. .that the applicant had desired final approval instead of preliminary appro~,al as indicated. Commissioner Cowley advised that the Design Review Committee was not prepared to make a recommendation in connection with final approval. After discussion, ~larren Held, architect, stated that prelin~inary approval would be satisfactory and requested that this matter be placed on the aaenda for final approval at the next regular meeting. Commission Cowley moved, seconded by Commissioner O'Rorke, that prelim- inary design approval be granted A-176, St. Androws Episcopal Church, for the additional classrooms sho~ on Eyl~ibit "A"; motion carried (with Commissioner Crisp abstaining). E. A-!77 - Claude T. Lindsay, Charlesto~m Drive - Final DesiEu Review - Model Homes for Portion of Tract 3819 After discussion, Commissioner Cowley moved, seconded by Commissioner O'Rorke, that A-177, Claude T. Lindsay, be granted final design approval in accordance with Exhibits "A", "B", '~B-I", "B-2", "B-3", and the color schedule approved under previous applications; motion carried unanimously. RECESS AND RECONVENE V. CITY COL~CIL REPORT The Secretary gave a brief report on the City Council meetinE of April 7, 1965 since Commissioner ~ight had been unable to attend. VI. ~ET'~ BUSINESS Fences alonZ Major Streets Commissioner Crisp advised that the Subdivision Committee felt that the requirement for fences along major streets was~ in some instances unnec- essary. As an example, he referred to Allendale Avenue and Prospect Road west oE Saratoga-Sunn~vale Road. He suggested that a study be made and that a list be submitted to the Commission, outlining the streets on which fences should be required and the ones on which fences appeared unnecessary. Following a general discussion, Chairm~n Norton requested that the "Fencing Co~mnittee" review this ~atter and submit a report to the Commission. Commissioner Crisp advised that the Committee had reviewed a preliminary map covering three (3) lots proposed to front on Prospect Road west of Saratoga-Sunnyvale Road and requested the Co~mnission's opinion in this matter. Ihe Commission concurred that there was no real need for fences in this particular case so there appeared to be no reason why the lots should not front on Prospect Road, VII. OLD BUSINESS VIII. CO~3]ICATIONS A. ~P. ITTEN 1. SDR-419 - I~rren L. Peticolas, Bohlman Road - Request for Extension The Secretary advised that an extension of ninety (90) days had been requested in connection with SDR-419. -4- Plannin~ Commission Minutes - April 12. i965 - Continued VIII. Bohlman Road - Request for Extension After discussion~ Commissioner Crisp moved, seconded by Conm~issioner O'Rorke, that an extension of ninety (90) days from the present dste of expiration (April 8, 1965) be granted in connection with SDR-419; motion carried unanimously. 2. SD-478 - Claude T. Lindsay. Cox Avenue - Request for Extension The Secretary advised that an extension of one (1) year had been requested in connection with SD-478; Clande T. Lindsay. He explai~x.. ed that while the tentative map covered the entire development, the subdivision was being developed in units, so the request for eXCCD- Sion covered only the remaining lots. Com~nissioner Crisp moved, seconded by Commissioner McFall, that an extension of one (1) year from the present date of expiration be granted in connection with SD-47~, Claude T. Lindsay; motion carried unanimously. 3. UP-63 - Faith'Bible Chapel~ Bi% Basin l-lay - Roquest for Extension The Secretary advised that an extension of one (1) year had been requested in connection with UP-63, Faith Bible Chapel. George Latham, representing the Church, advised 1) plans were still indefinite 2) they would like to remain in their present location for another year and 3) they did not feel that the limi~- atien of fifty (50) people would present a problem. After discussio~ Commissioner McFall moved, seconded by Commissioner Kellum, th t an extension of one (1) year from present date of expiration be,granted in connection with UP-63, Faith Bible Chapel; motion carried unanimously. B. ORAL 1. Chairman Norton extended a welcome to Fl-s. O~les and ~. Metcalf of the Good Government Group and expressed appreciation for the coffee served by Mrs. Owens at intermission. 2. Cormnissioner ~'Rorke advised that he would be unable to attend the meetings on April 26th and l~y lOth since it was necessary for him to be away on business. 3. Commissioner Cowley advised that he would be unable to attend the Design Review Committee meeting on April 22nd and observed that since Commissibner O'Rorke would be away, Commissioner I.~ight would be the only Committee member available. After discussion, Chairman Norton advised that if it was necessary to hold a Design Review Committee meeting, both he and Commissioner Crisp would be available to assist Commissioner Wright. IX. ADJOUR~.~4ENT Chairman Norton declared the meeting adjourned at 9:25 P.M. Respectfully submitted, _~-
