B. MINUTES
Commissioner Crisp moved, seconded by Commissioner O'Rorke, that
the reading of the minutes of May 24, 1965 be waived and that the
minutes be approved subject to. the following corrections:
1. Page 4...Item III, B ...... Revise the second paragraph to read
as follows:
"After discussion, it was requested that Mr. Heiss meet with
the Subdivision Committee On the afternoon of June 7, 1965
for further study relative to this application."
2. Pag~ 7...Item VII, A ...... Modify the second paragraph to read
as follows:
"Commissioner Cowley moved, seconded by Commissioner O'Rorke,
that the Design Review Committee Report of April 26, 1965
relative to Design Standards for Subdivision Homes be adopted
as the policy of the Commission; motion carried unanimously."
3. Pag~ 7...Item VII, B ...... ~evise to read as follows:
"After discussion, Chairman Norton directed that the Secretary
request that the applicant 1) obtain written authorization
from the State Division of Highways to display the subject ban-
ner and 2) file a copy of this authorization with the Planning
Department. He then referred this matter to the Design Review
Committee for study and directed same continued off the agenda
until authorization from the State Division of Highways had been
received."

Chairman Norton declared public hejarings open for the evening at 7:36 PoM.
A. C-83 - Hamilton Development Corporation, Pierce Road - Request for
Change of Zoning from '~-1-40,000~ (Single Family Residential)
to '~-1-40,000 P-C" (Single Family Residential Planned Com-
munity) - Continued from May 24~ 1965
" The Secretary briefly reviewed. this application and read 1) a peti-
tion opposing the proposed change of zoning signed by 16 residents in
the vicinity of the subject p~operty and 2) a letter from the Hamil-
ton Development Corporation granting a 45 day extension of time for
action on the tentative map filed in conjunction with this application.
SCOTT SMITH, Pierce Road, prot'ested the proposed change of zoning on
the basis that it would permit. establishment of a stable on the sub-
ject property that would be inconsistent with the surrounding area.
In answer to a question from ROBERT W~LKER of Surrey Lane, the Com-
mission explained that a consultant (Lawrence Lackey of San Francisco)
had been engaged by the City tb review and analyze the proposed plan-
ned community development. Itz was further explained that because of
a lack of experience with this type development, it was felt that it
would be worthwhile to enlist lthe services of a specialist and follow
the process of analysis step bY step.
After further discussion, Chailrman Norton directed C-83 continued
until the next regular meeting!.
B. q-85 - Loma Serena Development' Company, Inc., Prospect Road - Request
for Change of Zoning from "A" (Agricultural) to "R-l-10,000"
(Single Family Residential) - Continued from May.24~ 1965
The Secretar~ briefly reviewedl this application and advised that there
were no further additions to the file.
Commissioner Crisp ~·.l)~%advisedl that there was a problem to be' worked
out in connection with the tentative map filed in conjunction with
this application and 2) sugge=sted that, for this reason, C-85 be con-
tinued until the ne~ct regular meeting.

from "R-I-IO,O00" (Single Family Residential) to '~R-M-3,000"
(Multiple Residential):- Continued from May 24~ 1965
The Secretary I) briefly rev{ewed this application 2) advised that
the applicant had submitted tentative plans indicating the character
of the proposed development and 3) read a comnunication filed by
the Board of Governors of "Th~ Saratogan" protesting the proposed
change of zoning.
The applicant was present and ~again called attention to the fact that
the subject property is bordered on three sides by existing apart-
ment developments ("The Saratogan" on the south, "Crystal Terrace"
(a legal non-conforming use) On the north, and '~Brookside Glen" across
the creek to the west). He f~rther stated 1) there is an established
need for two and three bedroom apartments in Saratoga 2) deluxe
apartments of 1600 to 1900 square feet are proposed 3) no children
will be accepted and 4) rental units are planned only if condominium
financing cannot be obtained.:
ARTHUR WILSON, owner of the adjacent "Crystal Terrace'~ apartment
development, spoke in support~of the proposed change of zoning on the
basis that it is the best possible use of the land. He expressed con-
cern, however, relative to the possibility of construction of a four-
story building on the front o~ the property.
Commissioner Crisp explained ~hat Ordinance NS-3, Section 5.8, would
limit the height of the proposed building to 30 feet.
Mr. Chase and his designer, Mr. Ayers, then presented colored slides
showing the 1) subject property 2) surrounding area and 3) pro-
posed development, together with a colored rendering of the proposed
development. During this presentation, Mr. Ayers advised 1) all of
the existing trees would be p~eserved 2) the proposed setbacks are
greater than those required b~ the Ordinance 3) the proposed site
coverage is less than permitted by the Ordinance and 4) two covered
parking spaces are proposed for each unit in addition to open parking
for guests.
After further discussion, Commissioner Crisp advised that it was the
recommendation of the SubdiviSion Committee that this matter be con-
tinued until the plans had been reviewed by the Design Review
Committee.
On the basis of the foregoingi Chairman Norton, with concurrence of
the Commission, directed C-86, Nell K. Chase~ continued until the
meeting on July.12, 1965.

II. D. UP-80 - Church of the Ascension, Prospect Avenue - Request for Use
Permit for Church and School - Continued from May 24~ 1965
The Secretary briefly reviewed this application and advised that
nothing further had been added. to the file.
There was not. zone present who ~ished to comment with regard to this
matter. :
Commissioner Crisp read the report of the Subdivision Committee
relative to this application, 'reconm~ending that same be approved.
It was moved by Commissioner Crisp and seconded by Commissioner
McFall that the public hearing on UP-80 be closed; motion carried
unanimously and the hearing was closed at 8:21 P. M.
Commissioner Kellum moved, seconded by Commissioner McFall, that the
Subdivision Connnittee Report of June 8, 1965 relative to UP-80,
Church of the Ascension, be approved and that the Use Permit be
granted subject to the conditions set forth in said report; motion
carried unanimously.
E. UP%8! - Bryce W. Baker, Cox A~enue - Request for Use Permit for
Nursery School - Continued from May 24~ 1965
The Secretary briefly reviewed this application and advised that no
written communications had been received.
The applicant was present but 'stated that he had no further comment
at this time.
Commissioner Crisp read the report of the Subdivision Committee
relative to this matter, recommending approval of same.
Commissioner O'Rorke suggested that the term "living quarters" (used
in the last sentehce of paragraph 3 of said report) be changed to
"single family residence:'.
Commissioner Crisp, with concurrence of the Subdivision Committee,
directed that the Secretary modify the report as suggested by Com-
missioner O'Rorke.
It was moved by Commissioner Crisp and seconded by Commissioner
McFall that the hearing on UP-81 be closed; motion carried unanimously
and the Chairman declared the lhearing closed at 8:27 P. M.

Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Subdivision Connnittee Report of June 8, 1965 relative to UP-8!,
Bryce W, Baker, be approved a~ modified and that the Use Permit be
granted subject to the condit{ons specified in said report; motion
carried unanimously. :
F. VT257 - Claire C. Goodwin, Suilivan Way - Request for Variance in
connection with Required Front and Side Yard Setbacks -
Continued from May 24~..!965
The Secretary briefly reviewed this application and read a letter
from J. L. Atkinson, adjacent%property owner, supporting this re-
quest.for a variance. ,
Mr. Goodwin was present but slated that he had no further comnent
at this time.
Commissioner O'Rorke read the'report of the Variance Committee rela-
tive to this application, recommending approval subject to certain
conditions.
After discussion Commissioner .Crisp moved, seconded by Commissioner
O'Rorke, that the public hearing on V-257 be closed; motion carried
unanimously and the Chairman closed the hearing at 8:37 P. M.
Commissioner O'Rorke moved, s~conded by Commissioner Crisp, that the
report of the Variance Committee of June 8, 1965 relative to V-257,
Claire C. Goodwin, be approved and that the Variance be granted sub-
ject to the conditions set forth in said report; motion carried
unanimously. :
G. V-258 - Clay V. Brown, Canyon.View Drive - Request for Variance in
connection with Required Front Yard Setback - Continued from
May 24, 1965
The Secretary briefly'reviewed this application and advised that
nothing further had been added to the file.
There was no one present who wished to comment with regard to this
matter.
Commissioner O'Rorke read thelreport of the Variance Committee rela-
tive to V-258, recommending approval of same.
It was moved by Commissioner Crisp and seconded by Commissioner
Kellum that the public hearing on V-258 be closed; motion carried
unanimously and the hearing was closed at 8:41 P. M.

Commissioner Crisp moved, seconded by Commissioner O'Rorke, that
the Variance Committee Report~of June 8, 1965 relative to V-258,
Clay V. Broom, be approved and that the Variance be granted as
requested; motion carried unanimously.
H. UP-82 - Crest Development Company, Prospect Avenue - Request for
Use Permit for Node1 Home Sales Office
The public hearing on UP-82 was opened at 8:41P. M. The Secre-
tary advised that Notices of Hearing had been mailed and there
were no written communications on file.
The applicant's representative explained that Crest Development
Company 1) planned to build on the remaining 19 lots in the Blos-
som View Subdivision and 2) desired to utilize the proposed home
on Lot 7 as anode1 Home Sales Office.
The Secretary read a Staff Report recommending approval of this
request.
It was moved by Commissioner Crisp and seconded by Commissioner
Kellum that the public hearing on UP-82 be closed; motion carried
unanimously and the hearing was closed at 8:45 P. M.
Commissioner McFall moved, seconded by Commissioner Kellum, that
UP-82, Crest Development Company, application for Use Permit for
Model Home Sales Office, be granted in accordance with the Staff
Report of June 14, 1965 relative to this matter; motion carried
unanimously.
Chairman Norton declared public hearings closed for the evening at
7:47 P. M.

III. SUBDIVISIONS AND BUILDING SITES
A. SD- 567 - Loma Serena DeVelopment Company, Prospect Road - Subdivi-
sion - 55 Lots - Continued fromMay 24, 1965 .....
Commissioner Crisp advised 1). the Subdivision Committee had found
the tentative map for SD-567 quite satisfactory 2) there was a
question, however, as to whether access could be obtained across the

railroad track to the property beyond 3) the Director of Public
Works had an appointment with 'representatives of Southern Pacific
to try to find a solution to this matter and 4) in view of this,
it was the recon=nendation of the Subdivision Committee that this
application be continued until the next regular meeting.
Chairman Norton so directed.
B. SD- 569 - Hamilton Development Corporation, Pierce Road - Subdivi-
sion - 65.Lots - Continued fromMay 24, 1965
Commissioner Crisp recommended that this application be continued
until the meetin~ on June 28, '1965 in view of 1) review and ana-
lysis of the proposed planned con~nunity development by Lawrence
Lackey and 2) the 45 day extension of time for action on this ten-
tative map (see discussion relative to C-83).
Chairman Norton so directed.
C. SDR-573.- Donald R. McCormack~ Farwell Avenue - Building Site Appro-
val - 2 Lots
The applicant was not present.
Commissioner Crisp moved, sec6nded by Commissioner Kellum, that the
Building Site Committee Report of June 14, 1965, relative to SDR-573,
Donald R. McCormack, be adopted and that the tentative map (Exhibit
"A", filed May 27, 1965) be approved subject to the conditions set
forth in said report; motion carried unanimously.
D. SDK-574 - John Kirkpatrick, Pike Road - Building Site Approval -
1 Lot
Commissioner Crisp advised that the subject application had been con-.
ditioned but that the Health Department had disapproved the site for
septic tank development.
The applicant and his engineer were present and requested that this
matter be continued to allow adequate time for them to confer with
the Health Department.
On the basis of this request, Chairman Norton directed SDR-574 con-
tinued until the meeting on June 28, 1965.

III. E. SDR-575 - Bryce W. Baker~ Cox'Avenue - Buildin~ Site Approval - 1 Lot
The applicant was present andSexpressed satisfaction with the pro-
posed conditions of approval.~
The Commission called Mr. Baker's attention to an error on the ten-
tatlye map with respect to the location of the easement for the Church,
and requested that it be .relocated so that it actually abutted the
Church property. Mr. Baker agreed to comply with this request.
It was moved by Commissioner Crisp and seconded by Commissioner McFall
that the Building Site Committee Report of June 14, 1965 relative to
SDR-575, Bryce W. Baker, be adopted and that the tentative map (Exhi-
bit 'A", filed June 4, 1965) be approved subject to the conditions
set forth in said report; motSon carried unanimously.
F. SDR-576 - Walter Hileman, Madtone Hill Road - Building Site Approval -
1 Lot
Commissioner Crisp advised that conditions had been prepared for this
application but the Health Department had withheld a decision rela-
tive to septic tank development until percolation tests had been run.
In view of the foregoing, Chairman Norton directed SDR-576 continued
until the meeting on June 28,=1965.
G. SDR-577 - Mijo Corporation, Saratoga-Sunnyvale Road - Building Site
Approval - 1 Lot ~
On behalf of the Building Site Connnittee, Commissioner Crisp expressed
concern with respect to the great amount of fill and large pieces of
concrete bulldozed into the creek by the applicant. He explained, how-
ever, that the Staff had contacted the applica~e withregard to this
matter and that the situation'would be corrected.
Mr. Menard, architect for the'applicant, further explained that the
fill and concrete had been dumped into the creek by accident while
the applicant was trying to stabilize the bank and that his client
would correct the situation.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Site Committee Report of June 14, 1965 relative to SDR-577,
Mijo Corporation, be adopted and that the tentative map (Exhibit "A",
filed June 4, 1965) be approved subject to the conditions set forth
in said report; motion carried unanimously.

The applicant was not present,
Commissioner Crisp moved, seconded by Colmnissioner McFall, that the
Building Site Committee Report of June 14, 1965 relative to SDR-578,
Edwin P. Gerth, be adopted and that the tentative map (Exhibit '~",
filed June 4, 1965) be approved subject to the conditions set forth
in said report; motion carried unanimously.
IV. DESIGN REVIEW
A. A-172 - Dura Style Homes, Inc~, Cox Avenue - Final Design Review -
Additional Model - Continued fromMay 24, 1965
After a brief review of this application, Commissioner O'Rorke moved,
seconded by Commissioner Kellum, that final design review be granted
in connection with the additional model submitted under A-172 as
shown on Exhibits "B-2" and "F"; motion carried unanimously.
B. A-180 - Montessori School, Norton Road - Final Design Review -
Pre-School
Commissioner O'Rorke advised Chat the Committee had reviewed the
plans for the proposed school.and had found them satisfactory.
After discussion CommissionerO'Rorke moved seconded by Commissioner
Crisp, that final design approval be granted in connection with
A-180, Montessori School, on the basis of Exhibits "A", "B" and "C";
motion carried unanimously.
C. A-181 - Morris Lou~hran, Bi~ Basin Way - Final Design Review - Sign
Commissioner O'Rorke advised that the Committee had reviewed the
plans for the proposed sign and that same met all requirements of
Ordinance MS-3, Section 10.
It was moved by Commissioner 0'Rorke and seconded by Commissioner
Crisp that final design approval be granted A-181, Morris Loughran,
for the sign shown on Bxhibits "A" and 'J"; motion carried
unanimously.
D. A-182 - Bryce W. Baker, Cox A~enue - Final Design Review - Nursery
School
After a brief discussion of this application, Commissioner O'Rbrke
moved, seconded by Commissioner Crisp, that A-182, Bryce W. Baker,
be granted final design approval for the Nursery School as shown on
Exhibits "A" and "B"; motion Carried unanimously.

IV. D. A-182 - Bryce W. Baker
In answer to a comment by Commissioner OtRorke that the proposed
building would lend itself well to conversion into apartment
units, Mr. Baker assured the Commission 1) he was well aware of
. the "R-I" zoning on the subject property 2) although the building
might lend itself well to such a conversion, it was completely
unintentional and 3) the design was the result of combining
necessity with an attempt to retain the aesthetic quality of the
building.
E. ~-183 - Crest Development Company, Prospect Avenue - Final Design
Review - Blossom View Subdivision Homes
Commissioner O'Rorke advised that the Committee had reviewed the
plans submitted in connection.with A-183 and that they met all re-
quirements of the Ordinance.
After discussion Commissioner O'Rorke moved, seconded by Commissioner
McFall, that final design approval be granted A-183, Crest Develop-
ment Company, for the subdivision homes as shown on Exhibits "A"
through "H"; motion carried unanimously.
F. A-184 - Mijo Corporation, Saratoga-Sunnyvale Road - Preliminary
Design Review - Commercial Buildin~
Commissioner O'Rorke recommended that A-184 be continued for further
study by the Desig, n Review Committee in view of 1) the situation at
the site (see.discussion re SDR-577) and 2) absence of two members
of the Committee when the plans were previously reviewed.
On the basis of this recommendation, Chairman Norton directed A-184
continued until the meeting on June 28, 1965.
G. SS-41 - Prospect Hills Subdivision, Prospect Road - Final Design
Review - Identification Sign
Commissioner O'Rorke advised that the proposed sign met all require-
ments of the Ordinance.
After discussion,' it was moved by Commissioner O'Rorke and seconded
by Commissioner McFall, that final design approval be granted SS-41,
Prospect Hills SubdiviSion, in accord with Exhibit "A"; motion car-
ried unanimously.
V. CITY COUNCIL MEETING
Commnissioner McFall gave a brief report on action taken by the City Coun-
cil at the meeting on June 2, 1965, with emphasis on. items of particular
interest to the Commission..

Chairman Norton extended a welcome to Mrs. Parker of the Good Government Group
and Mrs. Ottenberg of the League of Women Voters, and expressed appreciation
for the coffee served by Mrs. Parker during intermission.
VI. NEW BUSINESS
A. Ordinance NS-3.10
Commissioner Kellum explained
control parking and storage on private property~ and advised that
such an ordinance had been drifted by the City Attorney and was under
study by the General Plan Committee.

At the suggestioa of Commissione~r-'eK~lums Chairman Norton directed
that the Secretary set a public hearing on the proposed ordinance for
the meeting on July 12~ 1965 ~nd requested that the General Plan Com-
mittee submit its report at that time.
B. Areas Subdivided Prior to Incdrporation
Chairman Norton raised a question relative to the advisability of
amending the Ordinance to accqmodate sections of the City that were
subdivided under County restrictions (prior to incorporation).
After a brief discussion~ theiChairman requested that this matter be
discussed with the City Attorney and that the Staff make a study rela-
tive to this possible need.
VII. OLD BUSINESS :
A. SDR-565 - Robert F. Planes Douglas Lane - Request for Reconsideration -
Continued fromMay 2~ 1965
The Secretary advised that Mr.. Plane had requested that this matter
be continued since additional time was needed to try to work out the
problems involved with the subject property.
On the basis Of this request~ 'Chairman Norton directed SDR-565 con-
tinued until the meeting on June 28~ 1965.
B. SDR-421 - Dr. M. A. Broemser~ .Saratoga Hills Koad - Request for Exten-
sion - Continued fr0mMa~ 24~ 1965
After a brief discussion~ Commissioner Crisp moved~ seconded by Com-
missioner McFa11~ that an extension be granted in connection with
SDR-~21.for a period of six m6nths from June 10~ 1965s subject to the
following additional condition~
"Provide underground utilfties from nearest pole."
Motion carried unanimously.

.. Pon Propert.y - Miller and Prospect Avenues
Commissioner McFall advised that a brochure referred to as "The
Strawberry Patch" was being circulated in support of a proposed
shopping center on the northeast corner of'the.intersection of
Miller and Prospect Avenues (Pon property). He recalled that
such a proposal had been submitted to the City of San Jose pre-
viously, that residents in the area had opposed same and that
the proposal was eventually defeated. He explained that a door-
to-door campaign was now under way to try to change the attitude
toward locating a shopping center at this intersection, and 'that
they hoped to gain the suppor~ of groups such as the West Valley
Homeowners Association. He observed that because of its proxi-
mity to Saratoga, this proposed development was a matter of con-
cern and that, no doubt, morewould be heard about it later.
IX. ADJOURNMENT
Chairman Norton declared the meeting adjourned at 10:25 P. M.
