I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:32 P.M.
A. ROLL CALL
Present: Connnissioners Cowley, Crisp, Kellum, McFa11 and Norton.
Absent: Comnissioners OsRorke and 14right.

Commissioner Kellum moved, seconded by Commissioner McFall, that the
reading of the minutes of June 28, 1965 be waived and that the minutes
be approved subject to the following corrections:

Change "the next regular meeting" to "the meeting on July
1965".

Revise this paragraph to read as follows:

PUBLIC HEARINGS
The Chairmen declared public hearings open for the evening at 7:39 P.M.
A. C-83 - Hamilton Development Corporation, Pierce Road - Request for Change
of Zoning from "R-1-40,000" (Single Family Residential) to
"R-1-40,000 P-C" (gingle Family Residential Planned Ccs~unity)

Chairman Norton advised that the Subdivision Committee had met with 14r.
Lackey and his Staff and that, while progress was being IDades the study
had not yet been completed. He then directed C-83 continued until the
next regular meeting pending further developments in connection with
this study.
B. C-.85 - Loma Serene DevelopmenE Company, Inc., Prospect Road - Request for
Change of Zoning from 'A' (A~ricultural) to '~a-1-10,000" (Single
Fatal17 Residential) - Continued from June 28s 1965 .....
The continued hearing on C-85 was res-med at 7:/d) P.M. The Secretary
briefly reviewed this application and advised that there were no additions
to the file.
There was no one in the audience who wished to co~mnent with regard to this
matter.
Co~snissioner Crisp read the report of the Subdivision Committee relative
to C-85, recomending approval of same.
It was moved by Co~missioner Crisp and seconded by Commissioner Kellum
that the hearing on C-85 be closed; motion carried unanimously and the

II. B. C-85 - Loma Serene Development Compsny~ Inc.
Connissioner Crisp moved, seconded by Commissioner McFall, that the
Subdivision Committee Report of July 12, 1965 relative to C-85 be edopted
and transmitted to the City Council as the recommendation of the Connnis-
sion; motion carried unanimously.
C. C-86 -Neil K. Chase, Saratoga Avenue - Reqnest for Change of Zoning from
'R-1-10,000" (Single Family Residential) to 'R-M-3,000' (Multiple
Residential) - Continued from June 14, 1965 .
The Secretary advised 1) nothing further had been submitted for the file
and 2) the applicant had requested that this matter be continued since
the plans for the Design Review Committee had not yet been completed.
Chairman Norton, with concurrence of the Commission, directed C-86 con-
tinued until the meeting on July 26, 1965.
D. C-87 - M.V.S. Company,. Saratoga Avenue - Request for Change of Zoning
from "A" (Agricultural) to 'R-M-4,000 P-C" (Phltiple Residential
Planned Community) - Continued from June 28~ 1965 .
The continued hearing on C-87 x~as resumed at Y:4~ P.H. ~he Secretary
read communications f~led in support of this application by 1) Mrs.
M. E, Pickworth and 2) Mrs. R. H. Rhodes.
Pete Passtin, Saratoga-Los taros Road, stated 1) he had reviewed the
subject application and felt it ~ras the finest presentation he had ever
seen 2) he did not feel that Saratoga would have an opportunity to get
another project equal to it for this site 3) the proposed three-story
buildings would be screened by trees and he felt it would be a mistake to
try to eliminate them. 4) he felt that approximately 1~0 units would be
needed to make this development feasible 5) he, personally, ~ras opposed
to strictly "senior citizen" developments so felt that such a project
should be open to all ages and 6) he felt that a feasibility study was
~arranted to determine whether or not Saratoga could support such a develop-
mont.
In answer to a question from Chairman Norton, Mr. Pasetta explained that
that he ~as only endorsing this particular project in this particular
location, no~ such projects in general.
In discussing wLth Commissioner Crisp a feasibility study on fe~er units,
Mr. Pasetta advised that he felt a smaller development would be less feasi-
ble s~nce it would increase the unit cost of the land. He further observ-
ed that the proposed density ~as only one-fourth that of developments across
the City boundary.
Coa~aissioner Kellumadvised that the Committee had studied this matter
very carefully during the past few weeks and 1) had formed an opinion
similar to that voiced by Mr. Passira 2) felt that the proposed develop-
ment ~as an approximation of the intention of the ordinance permitting
cluster developments and 3) felt that they would like to talk to the
developer about a market analysis and make a further study of several
other items. He further advised that~ for these reasons, it ~ns the
recommendation of the Subdivision Committee that this matter be continued.
Chairman Norton advisdd that it had been suggested that this matter be
made a part of the Conera1 Plan Revie~ since the General Plan Hap had at
one time indicated this property as future multiple zoning but had since
been changed,
During the discussion.that followed, Dr. Abrams expressed willingness to
wait for a reasonable period of time for the review of the General Plan.
Chairman Norton then directed C-87 continued until the next regular meet-
ing and referred this matter jointly to the Subdivision Committee and Gen-
eral Plan Committee for analysis and a feasibility study.

II. E. C-88 - Finnegan Construction Company, Inc., Wardell Road - Request for
Change of Zoning from '~-1-15,000" and '~-1-40,000" (Single Family
Residential) to "R-1-20,000" (Single Family Residential) - Contin-
ued from June 28~ 1965 . . .
The continued hearing on C-88 was resumed at 8:05 P.M. The Secretary
briefly reviewed this application and read a statement filed by the
applicant,
Miles Rankin was present to represent the applicant but advised that he
had no comment at this' time.
Mr. Ottenberg of Foothill Lane stated that he felt any transition from
one zoning district to another sould be made within the subject property,
not at the boundary of same.
Commissioner Crisp stated I) acre sites on flat land are difficult to
develop 2) for this reason the GenEral Plan Committee has been asked to
review the acre zoning along the north side of Allendale Avenue and 3) the
Subdivision Committee recommends that this matter be continued and referred
to the General Plan Committee for review and report.
After further discussion, Chairman Norton referred C-88 to the General
Plan Committee and dlrected same continued off the agenda until It could
be studied under the annual review of the General Plan,
F. UP-83 - Santa Clara County Library Commission - Request for Use Permit for
Branch Library at Quito Shopping Center - Continued from June 28,

The continued hearing on UP-83 was resumed at 8:lg P. M. The Secretary
briefly reviewed this applicationand advised that no further communica-
tions had been received.
Joe Monley, representing Charles Early of the Saratoga Library Commission,
expressed concern that establishment of the ~uito Branch Library would
prohibit the location of a Central Library at the Civic Center.
Commissioner Crisp observed that the vote for funds for a Central Library
at the Civic Center h~d been defeated at the polls.
Commissioner Crisp read the report of the Subdivision Committee relative
to UP-83, recommending that "Library" be added to the list of conditional
uses for C-N Zoning Districts and that this application then be approved.
It was moved by Commissioner Crisp and seconded by Commissioner Kellum that
the public hearing on. UP-83 be closed; motion carried unanimously and the
hearing was closed at 8:29 P.M.
Commissioner McFall maved, seconded by Commissioner Kellum, that "Library"
be added to the list of conditional uses for C-N Zoning Districts; motion
carried unanimously.
Commissioner Crisp moved, seconded by Conmissioner McFall, that UP-83,
application for Use Permit for Library at Quito Shoppit,g Center,
be approved in accordance with the Subdivision Committee Report of July 12,
1965 relative to same; motion carried unanimously.

II. G. V-26_~0 - given Nursery, Saratoga-Sunnyvale Road - Request for Variance to
allow Expansion of Legal Non-Conforming Nursery - Continued from
June 28, 1965
The continued hearing V-260 was resumed at 8:32 P.M. The Secretary
briefly reviewed this application and advised that there were no further
additions to the file.
The applicant was present but stated that he had no further coRncent.
There was no one else present who wished to comment with regard to this
matter.
Commissioner McFall read the report of the Variance Committee relative
to V-260~ recommending disapproval of this application.
After discussion, it was moved by Conxnissioner Crisp and seconded by
Commissioner Kellum that tile public hearing on V-260 be closed; motion
carried unanimously and the hearing was closed at 8:39 P.M.
Commissioner Crisp moved~ seconded by Commissioner Kellum, that the
Variance Committee Report of July 12, 1965 relative to V-260 be adopted
and that the variance be denied on the basis of the report; motion
carried unanimously.
Chairman Norton then explained to Mr. Pardtore, the applicant, his right
of appeal to and the power of the City Council.
H. .Ordinance NS-3.10 - An Ordinance Regulating Open Storage in Residential
District~
The public hearing on Ordinance NS-3.10 was opened at 8:41 P.M. The
Secretary advised that a Notice of Hearin~ had been p[~lished and read
three communications filed in support of such an ordinance by 1) Mrs.
Warner W. (Ruth D.) Angerer 2) William B. and Kreena Smyth and 3) "A
conscientious Saratogan".

II. H. Ordinance NS-3.10
The Secretary then read the first three sections of the proposed ordinance
and a portion of a letter frora the City Attorney recommending that an
additional sub-section be added to Section 1 of Ordinance NS-3.10.
Robert Walker of Surrey Lane spoke in support of the proposed ordinance.
Re stated that he would prefer not to have laws passed if the matter could
be controlled in another ~ay, but he felt that the need for such an ordi-
was now established in S~ratoga.
Joe Monley of Scotland Drive spoke in support of the proposed ordinance
and stated that he had heard favorable comments from many others in the
area.
After discussion Commissioner McFall moved, seconded by Cormniseioner Kellum,
that the hearing on Ordinance NS-3.10 be closed; motion carried unanimously
and the hearing was closed at 9:00 P, M.
Commissioner Crisp movedr seconded by Commissioner Kellum, that Sub-section
3.14-1 as set forth in the City Attornoy's letter of June 30, 1965 be added
at the end of Section I of Ordinance NS-3.10 and that the Ordinance then
be transmitted to the City Council ~rith the recommendation that it be en-
acted; motion carried unanimously.
Attention was called to the word "prescribed" as used in the third para-
graph on page 2 (of Ordinance NS-3.10). The Chairman requested that the
Staff confirm with the City Attorney that this was the word intended.
Commissioner Cowley observed that enforcement of the Ordinance (Section
3.14-1) might well place a great deal of pressure on the Planning Director
After discussion of this possibility, Chairman Norton requested that the
Planning Director, at his convenience, submit to the Commission a list of
items that would be of a~sistance as policy ~uidelines for the enforcemoot
of this section of the ordinance. The Planning Director concurred that
such guidelines would be of assistance and stated that he would submit the
list upon adoption of the proposed ordinance by the City Council.
Chairman Norton declared public hearings closed for the evening at 9:09 P.M.
RECESS AND RECONVENE
XlI. SUBDIVISIONS AND BUILDING SITES
A, SD-567 - Loma Serene Development Company, Inc., Prospect Road - Subdivi-
sion - 55 Lots - Continued from June 28t 1965
Bill Heiss~ applicantss engineer, was present to discuss the proposed
conditions of approval with the Commission.
Con~nissioner Crisp moved, seconded by Commissioner McFalls that the
Subdivision Committee Report of L2 July 1965 relative to SD-567 be
adopted and that the tentative map (Exhibit A-l, filed 9 July 1965) be
approved subject to the conditions set forth in said report; motion
carried unanimously.
B. ~p7569 - Hamilton Development Corporation, Pierce Read - Subdivision -
65 Lots - Continued from June 28~ 1965
Commissioner Crisp recommended that this matter be continued until the
next regular meeting pending further developments with the review and
analysis being done by Mr. Lackey.
Chairman Norton so directed.
C. SDR-574 - John Kirkpatrick, Pike Road - Building Site Approval ~ 1 Lot
Continued from June 28, 1965
Commissioner Crisp called attention to Condition II-I of the proposed
conditions of approval and explained 1) because of the required dedi-
cation along Pierce and Pike Roads, the area of the subject parcel is
inadequate for septic tank development 2) for this reason, it was

necessary to require sanitary sewers and 3) the applicant had advised
that he would accept this condition and take the matter up with the City
Council at a later date.
Commissioner Crisp move~, seconded by Commissioner McFall, that the
Building Site Committee Report of 12 July 1965 relative to SDR-574 be
adopted and that the tentative map (Exhibit "A", filed 4 June 1965) be
approved subject to the conditions outlined in said report; motion
carried unanimously.
D. SDR-579 - Richard W. Rutowski, Soboy Road - Building Site Approval -
2 Lots - Continued from June 28~ 1965
Commissioner Crisp advised that the Health Department would approve only
one septic tank on the subject property. He suggested that the appli-
cation for approval of two lots be denied without prejudice and that the
applicant re-apply for approval of one lot if he so desired.
After discussion, Commission Crisp moved, seconded by Commissioner McFall,
that SDR-579, Richard W. Rutowski, be denied without prejudice on the
basis of the Health Department report; motion carried unanimously.
E. SDR-580 - Santa Clara County Library Commission - Building Site Approval
- 1 Lot - qulto Shoppin~ Center - Continued from June 2~, 1962
Messrs. Stern, Rensel and Fartier were present and expressed satisfaction
with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Site Committee Report of 12 July 1965 relative to SDR-580,
Santa Clara County Library Commission, be adopted and that the tentative
map (Exhibit "A", filed 11 June 1965) be approved subject to the condi-
tions set forth in said'report; motion carried unanimously.
F. SDR-582 - Saratoga Union School District, Via Escuela Drive - Building
Site Approval - 1 ~ot - Continued from June 28. 1965
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Site Committee Report of 28 June 1965 relative to SDR-582,
Saratoga Union School District, be adopted, that the tentative map
(Exhibit "A", filed 18 June 1965) be approved subject to the conditions
set forth in said report, and that special attention be invited to the
note re improvement of Via Escuela, said note being merely an expression
of opinion; motion carried unanimously~
G. SpR-583 - Dr. Robert B. Riobards, Sobey Road - Building Site Approval -
1 Lot - Continued from June. 28, 1965
Commissioner Crisp advised that the proposed conditions of approval had
been discussed with the applicant and his architect and they had express-
ed satisfaction with s~me.
Commissioner Crisp moved, seconded by Conm~issioner McFell, that the
Building Site Committee Report of 12 July 1965 relative to SDR-583
be adopted and that th~ tentative map (Exhibit '~", filed 18 June 1965)
be approved subject to the conditions set forth in said report; motion
carried unanimously.
IV. DESIGN REVIEW
A. A-185 - Santa Clara County Library Commission - Preliminary Design Review
- Branch Library Building - Quite Shopping Center - Continued
from June 28, 1965
After discussion relat£ve to the plans submitted for the proposed library,
Commissioner Cowley moved, seconded b~. Commissioner Kellum, that prellm-
inary design approval be granted A-185 in accordance with Exhibit "A";
motion carried unanimously.

IV. DESIGN REVIEW
B. A-186 - Saratoga Union School District, Via Escuela Drive - Final Design
Review - Elementary School (Congress Springs School) - Continued
from June 28, 1965
Conmaissioner Cowley moved, seconded by Commissioner Crisp, that final design
approval be granted A-186, Saratoga Union School District, for the Congress
Springs School on Via Escuela Drive as shown on Exhibits '~", "B" and "C";
motion carried unanimously.
C. A-188 - First Church of 6hrist, Scientist, Lomita Avenue - Final Design
Review 7 Identification Sign
Commissioner Cowley advised that the Design Review Committee had reviewed
the plans for the proposed signs (identification sign and directional sign)
and it w~s the Committee recommendation that same be approved.
After discussion Commissioner Cowley moved, seconded by Commissioner Crisp,
that final design approval be granted A-188, First Church of Christ, Scien-
tist, for the two signs (identification and directions1) shown on Exhibits
'~" and "B"; motion carried unanimously.
D. A-164 - t~len K. Rayburn, Big Basin Way - Final Design Review - Commercial
BuildinM
Commissioner Cowley explained 1) preliminary design approval of this pro-
posed conmaercial building had been granted some time ago 2) ten parking
spaces, four of which are already improved, are being leased from the
Plumed Horse and 3) it ~as the Committee recommendation that final design
approval be granted subject to the applicant~s posting a bond Euaranteeing
that the six addttinrml parking spaces would be developed prior to occu-
pancy of the building.
The Secretary confirmed that the applicant had filed a letter from Mrs.
Anderson of the Flumed Horse agreeing to lease ten improved parking spaces
to meet the requirements'for the subject building. He further confirmed
that Mrs. Anderson would still have an adequate number of spaces left to
fill her own parking requirements and other lease obligations.
Commissioner Cowley moved, seconded by C~.issioner McFall, that final
design approval be granted A-164, Helen K. Rayburn, for the commercial
building shown on Exhibit '~-1", subject to the applicant's posting a
bond guaranteelag that the ten parking spaces required for this building
will be improved and available prior to the time of occupancy of the build-
ing; motion carried unanimously.
E. A-170 - Mason Shaw, Big Basin Way - Final Design Review - Coum~ercial
Building
Commissioner Cowley advised 1) preliminary design approval of the pro-
posed building had previously been granted 2) the exhibits required for
final approval had now been submitted with the exception of a color sched-
ule and landscape plan 3) the only landscaping contemplated w~s some plant-
ing along Third Street, adjacent m the theatre building and 4) the appli-
cant had filed a letter setting forth the proposed color schedule. After
reading the applicant's letter relative to the proposed colors, Commissioner
Cowley recommended that this application be continued until the color sched-
ule had been submitted since 1) it was the policy of the Commission and
2), the letter gave insufficient information about the proposed colors.
On the basis of this recommendation, Chairman Norton directed A-l/0 con-
tinued until the meeting on July 26, 1965, and requested that the Staff
advise the applicant that the color schedule would be required.
F. A-184 - Mile Corporation, Saratoga-Sunnyvale Road - Final Design Review -
Commercial Building - Continued from June 28~ 1965
Commissioner Cowley advised that the Design Review Committee had reviewed
the subject plans and had found them satisfcctory subject to Flood Control
District approval relative to Calabazas Creek channel.

IV. F. A-184 - Mijo Corporation, Saratoga-Sunn~vale Road
After discussion of this matter, Commissioner Cowley moved, seconded by
Commissioner Kellum, that final design approval be granted A-184, Mijo
Corporation, in accordance with EFa, ibit "A-i", subject to Flood Control
District approval with respect to the Calabazas Creek channel; motion
carried unanimously.
Chairman Norton extended a welcome to Councilman Burry, to Mrs. Parker and Mrs.
Stark of the Good Government Group, and to Mrs. Walker, wife of the Planning
Director. He also expressed appreciation for the coffee served by Mrs. Parker at
recess.
V. CITY COUNCIL REPORT
In the absence of Commissioner O'Rorke (who artended that last City Council
meeting on behalf of the Commission), the Secretary gave a brief report on
action taken by the Council.

VII. OLD BUSINESS
A. County-Wide Census - City Council Request for Planning Commission Recom-
mendation relative to Saratoga Participation -
Continued from June 28, 1965
Commissioner Kellumadvised that he had reviewed this matter with the City
Administrator and had been advised 1) the County will have to do this
cnesus whether or not the cities participate 2) it is possible that Sara-
toga will need a census of its own prior to 1970 and 3) the City Adminis-
trator feels that the estimated cost of $3,500 is negotiable. Commissioner
Kellum then called attention to the Committee Report in the Commissioner's
folders recommending 1) that Saratoga participate in the subject census and
2) that the City Administrator be allowed to negotiate with respect to the
cost of same.
After discussion Commissioner Crisp moved, seconded by Commissioner Kellum,
that the General Plan Committee Report relative to the County-Wide Census
be adopted and transmitted to the City Council as the recommendation of the
Commission; motion carried unanimously.
B. 9eneral Plan Review - Request from Mayor that Planning Commission proceed
with typical Annual Review in lieu of full-scale
Five-Year Review - Continued from June 28, 1965
Commissioner Kellum advised that it was the recommendation of the General
Plan Committee that the Commission proceed with a typical annual review of
the General Plan as suggested by the Mayor. Me then called attention to a
preliminary draft of an ag'enda for the General Plan Review in the Commis-
sioner's folders, and requested that each Commissioner review the items
listed and advise the Planning Department of any suggested additions to this
list.
Commissioner Crisp advised that he felt it was important that the General
Plan and Map be corrected this year with respect to major changes.
During the discussion that followed, questions were raised with regard to
l) the date of public hearing and 2) the possible need for a special meet-
ing for said hearing.
Chairman Norton directed this matter continued until the next regular meet-
ing for further study and report at that time.
C. Ordinance NS-5.9 - - An Amendment to Ordinance NS-5 relative to Site
Approval Requirements and Exceptions Thereto - Continued
from June 28, 1965
The Secretary reviewed proposed Ordinance NS-5.9 with the Coa~ission.
After discussion of this me~ter, Commissioner Crisp moved, seconded by
Commissioner Kellum, that the Commission recommend to the City Council that

D. SDR-568 - D. R. ~nroe, Paul Avenue - Request fol' Reconsideration -
~ontinued from June.28, 1965 .
Tile Secretary road a letter from the applicant requesting that this
matter be continued since he needed additional time to work out the pro-
blem of obtaining a written communication from the mortgage company with
regard to the required offer of dedication.
Chairman Norton, with concurrence of the Commission, directed SDR-568,
D. R. Monroe, continued off the agenda until further cormnunieation had
been received from b~. Monroe.
VIII. CO~IUNICATION~
A. WRITIEN
1. SDR-50? - G~.gr~e O. Lindem, Oriole Road - Request for Extension
The Secretary read a letter requesting an extension in connection
with SDR-507.
ConKnissioner Crisp advised that it was the recormmendation of the
Subdivision Cu~ittee that this matter be continued so that the
Committee could make an on-site inspection of the subject property
to determine whether or not it felt underground utilities should be
be required.
On the basis of this recorm~endation, Chairman Norton directed SDR-507
continued until the next regular meeting.
2. SDR-513 - X~91taire~ Inc., Prospect Avenue - ReqUest for Extension
The Secretary advised that a communication had been received
requestins an extension in connection with SDR-bl3.
Commissioner Crisp advised that the Subdivison Committee had review-
ed this request and it was the recommendation of the Committee that
the extension be granted subject to the requirement of underground
utilities.
Commissioner Crisp moved, seconded By Commissioner McFall, that an
extension of one year from the present date of expiration be granted
in connection with SDR-513 subject to the additional requirement that
the applicant provide underground utilities; motion carried unanimous-
3. UP-63 - Faith Bible Chapel~ Big Basins Wa7 - Request for Termination
of Use Permit
The Secretary advised that the City Attorney had confirmed that the
Co~aission needed only to grant the request of the Faith Bible
Chapel and terminate their Use Permit.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
request of the Faith Bible Chapel be granted and that the Use Permit
granted under UP-63 be terminated; motion carried unanimously.
