I. ROUTINE ORGANITATION
The meeting was called to order by Chairman Norton at ?:35 P. M.'
A. ROLL CALL
Present: Commissioners Cowley, CriSp, Kellum, McFall, Norton and O'Rorke.
Absent: Comnlissioner Wright.
B. MINUTES
Cormnissioner Crisp moved, seconded by Commissioner O'Rorke, that the reading
of the minutes of 9 August 1965 be waived and that the minutes be approved
as submitt~di motion carried unanimously.
II. PUBLIC HEARINGS
Chairman Norton declared public hearings open for the evening a~ 7~36 ~i M.
C-83 - Hamilton Development Corporation, Pierce Road - Request for Change
of Zoning from "R-1-40,000" (Single Family Residential) to
"R-1-40,000 P-C" (Single Family Residential Planned Community) -
Continued .from. August 9, 196~ .
The continued hearing on C-83 was not re-opened at this time since 1) there
were no additions to the file 2) there were no reports and 3) there was no
one present who wished to comment with regard to this matter.
The Chairman directed the hearing on C-83, Hamilton Development Corporation,
continued until the meeting on 13'September 1965.
Bo C_286 -Neil K. Chase, Saratoga Avenue - Request for Change of Zoning from
"R-1-10,000" (Single Family Residential) to "R-M-3,000" (Multiple
Residential) - Continued from AuZust 9, 1965
The continued hearing on C-86 was resumed at 7:39 P. M. The Secretary brief-
l'y reviewed this application and advised that there were no further additions
to the file.
There was no one present who wished to comment with regard to this matter.
Commissioner Crisp read the report of the Subdivision Committee relative to
this application, recommending approval of same.
After discussion, it was moved by Commissioner Crisp and seconded by Commis-
sioner Kellum that the public hearing on C-86 be closed; motion carried un-
animously and the Chairman declared the hearing closed at 7:44 P. M.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Subdivi-
sion Committee Report of 23 August 1965 relative to C-86, Nell K. Chase, be
approved and forwarded to the City Council as the recommendation of the
Commission. Roll call vote: Ayes: Commissioners Cowley, Crisp, Kellum,
McFall, Norton and O'Rorke. Noes: None. Absent: Commissioner Wright.
Motion carried unanimously.
C. C-87 - MoV.S. Company, Saratoga Avenue - Request for Change of Zoning from
"A" (Agricultural) to "R-I-M-4,000 P-C" (Multiple Residential Planned
Community) - Continued from AugUSt 9, 1965
The public hearinE on C-87 was resumed at 7:45 P. M. The Secretary briefly
reviewed this application and read a letter from Mr. and Mrs. Harry S. White-
man filed in support of same.

There was no one present who wished to comment with regard to this matter.
Commissioner Crisp ~dvised that it ms the reconmlendatton of the Subdivision
Committee that C-87'~ M.V.S. Company, be continued until the meeting on 13
September 1965, pending further developments in connection with the General
Plan Reviewo
Chairman Norton so directed (7:49 P. M.).
D. C-90 - Town and Country Realty, Cox Avenue and Saratoga Avenue - Request
for Change of Zoning from "A" (Agricultural) to "P-A" (Professional-
Administrative) - Continued. from August 9, 1965
The continued hearihg on C-90 was resumed at 7:50 P. M. The Secretary
briefly reviewed this application and advised that there were no further
additions to the file.
Commissioner Crisp advised 1) very restrictive conditional P-A zoning had
been placed on the other.property on this corner (Medical Village) 2) in
view of this, the Subdivision Committee had requested that applicant furnish
further information relative to the type building proposed and 3) since
this additional information had not.been filed, it was the recommendation
of the Subdivision Committee that this matter be c6ntinued.
On the basis of this recommendation, Chairman N~rton (at 7:52 P. M.)
directed C-90, Town and Country Realty, continued until the next regular
meeting.

The public hearing on V-261 was resumed at 7:53 P. M. After briefly review-
ing this application, the Secretary advised that no further communications
had been filed in connection with this matter.
There was no one in the audience who wished to comment with regard to this
request for variance.
Commissioner O'Rorke read the report of the Variance Committee relative to
V-261, recommending approval of same.
It was moved by Commissioner Crisp and seconded by Commissioner O'Rorke that
the hearing on V-261 be closed; motion carried unanimously and the Chairman
declared the hearing closed at 7:~6 P. M.
Commissioner O'Rorke moved, seconded by Commissioner McFall, that the
Variance Committee Report of 23 August 1965 relative to V-261, Raymond
Micotti, be approved and that the subject variance be granted in accordance
with said report; motion carried unanimously.
F. General Plan - Annual Review
The continued hearing on the annual review of the General Plan was resumed
at 7:'57 P. M. The Secretary read a communication from Mr. and Mrs. A.
Ottenberg of Foothill Lane pertaining to zoning in general and, specifically,
opposing the downgrading of zoning in the Wardell Road area as proposed by
the Finnegan Construction Company.
Sam Hernandez stated that he felt it was imperative that a pathway be pro-
vided along Saratoga-Sunnyvale Road from the Village to the High School.
Commissioner Crisp explained that a pathway had been required in connection
with all recent development along Saratoga-Sunnyvale Road, but that there
was no provision for a pathway in areas where there had been no development.
Mr. Peterson observed that the City had constructed a pathway along Fruit-
vale Avenue and raised a question as to whether a similar provision might
be made along Saratoga-Sunnyvale Road.

II. F. Generul Plan
After further discussion, 'Commission Kellum requested tha~ this matter be
continued until the next regula~ meeting and advised that, at this time,
the General Plan Committee hoped to be able to submit a report.
Chairman Norton so directed (8:10 P. M.).
G. UP-89 - St. Andrews Episcopal Church, Saratoga and Crestbrook Avenue
Request for Use Permit for General Church Use
The public hearing on UP-89 was'opened at 8:11 P. M. The Secretary advised
1) Notices of Hearing had been mailed 2) no written communications had
been filed 3) the Commission had previously granted a Use Permit for St.
Andrews Church to utilize this property and 4) the Church had allowed the
Use Permit to expire so had re-filed.
Mr. Givens was present to represent the Church and expressed willingness
to answer questions regarding this application.
Frank Watkins, who explained that he lived across the street from this
property, questioned the extent to which the Church would be permitted to
use the subject property under this application if same was granted.
Chairman Norton explained that ~he application had been filed for use for
"general church purposes" which ~would permit unlimited use of the property.
He further explained, however, that any construction would be subject to
both Building Site Approval and Design Review.
After further discussion, Chairman Norton (at 8:15 P. M.) directed UP-89
continued until the next regular meeting and referred same to the Subdivi-
sion Conunittee for study and a ~eport at that time.

that Notices of Nearing bad been nmiled and ~e~d a communication from the
applicant ~equesting ~itharawal.of the subject application.
Commissioner O~Rorke moved, seconded by Commission McFall, that the appli-
cant be allowed to withdra~ this application for variance (V-262) without
prejudice; motion carried unani~ously.
The Chairman declared public hearings closed for the evening at 8:18 P.M.
III. SUBDIVISIONS AND BUILDING SITES
A. SD-569 - Hamilton Development Corpora=ion, Pierce Road
65 Lots - Continued [rom August 9, 1965
In answer to a question from the applicants~ representative Commissioner
Crisp stated 1) that the Subdivision Committee was not prepared to make
a recommendation at this time and 2) that the Subdivision Committee would
meet with Mr. Lackey (the consultant) and the developer before the next
regular meeting to discuss this matter.
On behalf of the Subdivision Committee, Commissioner Crisp recommended
that this application be continued until the next re[ular meeting.
Chairman Norton so directed.
B. SD-587 - L. A. Palm, Chester Avenue - Subdivision - 13 Lots - Continued

The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Cowley commented a~bout the lack of curved driveways in this
subdivision.

III~ B. SD-587 - L. A. Palm, Chester Avenue
After discussion it was the consensus of the Commission that this was a
good example of where the need tO apply the rule requiring 25% of the
driveways to be curved did not exist.
Commissioner Crisp moved, seconded by Commission McFall, that Subdivision
Committee Report of 23 August 1965 relative to SD-587, L. A. Palm, be adopt-
ed and that the tentative map (E~hibit "A-I", filed 20 August 1965) be
approved subject to conditions one through nine set forth in said report;
motion carried unanimously.
C. SDR-589 - William R. McKenzie, Belle Court - Buildin~ Site Approval - 1 Lot
Mr. Yearwood, representative for the applicant,° was present and expressed
concern over condition (G), of the Building Site Comuittee Report, regard-
ing underground utilities.
Commissioner Crisp stated that the Subdivision Committee had made an on
site inspection of this property and it was the opinion of the ·Committee
that underground utilities should be required in this case.
The representative, Mr. Yearwood, expressed satisfaction with this explana-
tion and stated ~hat he had no further comment.
Commissioner Crisp moved, SecOnded by CommiSsioner Kellum, that the Build-
ing Site C0mmit[ee Report of 23 'August 1965 relative to 8DR~589 be adopted
and that the te~eative m~p (Exhibit "A",. ·filed 5 AugUst. 1965)~be'apprOved
subject to the Conditions outlined in said ~port; ~otion carried unani-
mously.
D. SDR-590 - Mrs. Pearl C. SaunderS, Live Oak Lane - Building Site Approval -
2 Lots
Mr. Thomas Riley was present to .represent the applicant and questioned
condition (F). He explained that the Director of Public Works had suggest-
ed that the 35' foot radius right-of-way be used instead of the 42 feet.
In view of the foregoing CommisSioner Crisp requested this be continued
until after the recess to give ~he Commission time to discuss this matter
with Mr. Riley.
RECESS AND RECONVENE
After consultation, during the recess, Con~nissioner Crisp moved, seconded
by Commissioner Kellum, that the Subdivision Committee report of 23 August
1965 relative to SDR-590, Pearl'C. Saunders, 2 lots on Live Oak Lane, be
amended under Specific condition (F) to read as follows:
"F. Construct a 32 foot radius turnaround on 35 foot radius right-
of-way at the easterly terminues of the access road, as approved
by Director of Public Works, using double seal coat oil and
screenings or better On 6 inch base rock."
and that the report be adopted as amended and the tentative map (Exhibit
"A", filed 12 August 1965) be approved subject to the conditions set forth
in said report; motion carried Unanimously.
Chairman Norton extended a welcome to Meadames Parker and Stark of the Good Govern-
ment Group and expressed appreciation for~the coffee served at recess.
IV. DESIGN REVIEW
A. A-152 - Wellaire, Inc., Prospect Avenue - Final Design Approval - Commer-
cial Building
The applicant was present but had no comment to make at this time.
Commissioner Cowley, on behalf Of the Design Review Committee, requested
this matter be continued until ~he next regular meeting, because there
were still some questions in regard to the parking facilities.

V. CITf 'COUNCIL REPORT
The S.ecr~.tary artended the City Council meeting and gave a brief report on
action ·.taken at the meeting of 18 August'!965.

Ordinance NS~3.11 ~ Proposed Amendment to Ordinance NS-3 Relating to Certain
Definitions and the Keeping of Horses
1. The Sec~etar~ stated that ~hrough court action it was found that the
Z~ning Ordinance does not Very clearly define what constitutes the keeping
o~ a horse or horses and.that the City Attorney had sent a proposal; which,
should be added ~o the Ordinance.
Chai~man.Nortoa.r~ferred this to the Subdivision Committee for ·study and
a repor~ and continued this until the next regular meeting.
2. The Secretary statedhe had a second proposal from the City Attorney that
involved regulating the keeping of pets and the number of pets allowed.
In this proposal the'City Attorney states that there 'should be something
more definite in the Ordinance pertaining to this matter~
Chairman Norton referred this to General Plan Committee for study.

The Secretary read a letter from Shean and Associates requesting reconsider-
ation of the requirement that a bond be posted, by the developer, for one-
half the cost of the railroad crossing for a period not to exceed ten years
as set forth under Condition 13 in the Subdivision Committee Report of
12 July 1965.
After discussion Chairman Norton directed this continued until the next
meeting and referred it to the Subdivision Committee for study and a
report at that time.
2. SDR-440 - Shannon Li~tfoot, Springer Avenue - Request for Extension
The Secretary ·read a letter requesting an extension of sixty (60) days in
connection with SDR-440.
