N. The Secretary advised that nothing further ~ad been added to the file. Fir. Frank Naggi, applicant *s representative~ requested that this mat- tar be continued until the next regular meeting. C-92 - Co_~umbus-Founders Savings and Loan Association '- Commissioner Crisp advised that the Subdivision Committee had pre- pared a report in connection with C-92 but had no objection to hol- ding the report and havin~ the matter continued. After a brief discussion, Chairman Norton (7:33 P. M.), with concur- rence of the Commissions directed C-92 continued untie the meeting on 27 December 1965. C. C-93 - John B. Jessup, Big Basin Way - Request for Change of Zonir~ from '~-M-4,000-X" (Multiple Residential) to '~-N-3,000 P-C" · (Nultiple Residential Planned Community) - Continued from 22 November 1965 The continued hearing on C-93 was re-opened at 7:34 P. N. The cretary advised thac a communication had been received from the ap- '. plicant, requesting that his application be amended Co request . '~-M-4,000 F-C' zoning. The Commission granted this request. In answer to a question from Mr. Sam Hernandez, the Chairman ex- plained that the appllcation had been amended since 1) the appli- cant had abandoned plans to include a motel in the proposed develop- ment and 2) the motel had been the reason for the original request for '~-M-3,000 P-C' zoning. Mr. Jessup presented new plans which (he advised) were the outgrowth of further study and discussions with the Subdivision Committee. He then reviewed these plans (which were similar inmost respects to those previously submitted) with the Commission. During the discussion that followed, the Commission explained 1) even though this development was being proposed under a lon~-range program, it would be necessary (because of the request for Planned Community zoning) to submit complete plans for the entire develop- ment ac this time and 2) with Planning Commission approval, it would be possible co make minor modifications at a later date. The Commission warned Mr. Jessup, however, of the risk in submitting plans in which he expected to make major changes when he was ready to build. ~hen Mr. Jessup explained that the architectural fees that would be incurred in submitting complete plans for the entire development would be prohibitive at this time, the Co~nission advised 1) it would be necessary for the Con~ission to have a reasonably accurate General Plan for the entire area before action could be ~aken on the application and 2) the Ordinance was clear on this point. -2- Plannin~ Connnission Hinutes - 1B December 1965 - Continued II.. Jessup, con- tinued until the meeting ou 27 December D, prdinance NS-3.~ll ~ Proposed Amendment to Ordinance NS-3 - Clarify- ing certain definitions, Addir~ the definition of 'Keeping", ClarifyiD4~ sections relating to the keeping of horses in residential districts, and Addin~ sections relating to horses for riding lessons - Continued from 22 November 1965 Since 1) the proposed meeting between the Citizens Committee and the Subdivision Committee had previously been deferred until after the 15th of December 2) there was no one present who wished to con~ent with regard to this matter and 3) nothing further had been added to the file~ the public hearin~ on Ordinance NS-3.11 was not re-opened at this time. Chairman Norton directed same continued until the next regular meetin~. E. 9rdinance NS-3~ Section 3.5 - Proposed Amendment relative to Corridor Lots The public hearing on the proposed amendment to Section 3.5 of Ordi- nance NS-3 was opened at 8:22 P.M. The Secreta~V advised that a Notice of Hearing had been published and there were no communications on file. He then briefly reviewed this proposed amendment which would prohibit corridor lots on cul-de-sac streets. After discussion, Commissioner Crisp moved, seconded by Commissioner Kellum, that the public hearing be closed; motion carried unanimously and the Chairman declared the hearing closed Counuissioner Crisp moved, seconded by Connulssioner Cowley, that the proposed amendment to Section 3.5 of Ordinance NS-3, which would pro- hibit corridor lots on cul-de-sac streets, be approved by the Commis- ' sion and forwarded to the City Council with the recommendation that be enacted; motion carried unanlmously. F, Commercial Service Zone - Proposed Change in Existing Uses and Additions Thereto The informal hearing on this matter was opened at 8:25 P. M. The Secre- tary advised that a Notice of Hearing had been published av~ there were no c~unications on file. After discus-~ion and further review of the Subdivision Conmittee Report submitted previously in connection with this matter, Commissioner Crisp moved, seconded by Commissioner McFall, that the public hearin8 be closed; marion carried unanimously and the hearin~ was closed at 8:29 Commissioner Crisp raoved, seconded by Commissioner }lcFall~ that the Commission approve the Subdivision Committee Report of 8 November 1965 relative to the proposed change in existing uses in the Conmmercial Ser- vice Zone and transmit same to the City Council for its acquiesence or ob3ection; motion carried unanimously. G. UP-93 - George ~4. Day, Via Monte Drive - Request for Use Permit for }~odel Home Sales Office The public hearing on UP-93 was opened at 8:30 P.M. ~he Secretary advised that a Notice of Nearing h~d been mailed and there were no com- munications on file. l~r. Ed Kolstad was present to represent the applicant buc stated that he had no comment at this time. The Chairman read a Staff Report reco~nending that the sub3ect Use Per- mit be granted. Commissioner Crisp moved, seconded by Commissioner Cowlay, that the public hearing on UP-93 be closed; motion carried unanimously and the hearing was closed at 7:32 P. M. Conmissioner Kellum moved, seconded by Co~unissloner Crisp, that the Staff Report of 13 December 1965 relative to UP-93 be approved and that the Use Permit be granted for a period of one year in accordance with said report; motion carried unanimously. H. UP-94 - Dr. Crosst Quito Read - Reques.C. for Hse Permit for Horse The public hearinS on UP-94 was opened at 8:34 P. M. Connissioner Kellummoveds seconded by Conm~issioner Crisps that the public hearing on UP-94 be closed; motion carried unanimously and the hearing was closed at 8:36 P. H. Connnissioner Crisp moved, seconded by Commissioner Kellum, that UP-94, application for Use Permit for a horse, be granted subject to compli- ance with Ordinance NS-3; motion carried unaD~mnusly. 1. V-265 - John Lyn~so, Saratoga-Sunnyvale Road - Request for Variance .- in connection ~ith Rear Yard Setback Require~ent The public hearing on V-265 was opened at 8:37 P. M. The Secretary 1) advised that Notices of Hearing had been mailed and 2) read a communi- cation si~ned by the Secretary of Calson Propertiess Inc. opposing the grantin~ of this Variance. Warren Heids architect, was present to discuss this matter with the Commission on behalf of the applicant. After discussion, Chairman Norton (8:48 P. M.) referred V-265 to the Variance Committee for study and directed same continued until the meetin~ on 27 December 1965. J. V-266 - Paul Masson, Saratoga Avenue - Request for Variance in connec- ~iqn with Front Yard Setback RequiEement The public hearing on V-266 was opened at 8:51 P. M. The Secretary advised that Notices of Hearing had been mailed and read 1) appli- cantss statement of reason and 2) communication filed by L. G. Wolf of Mantrose Avenue opposing the granting of this Variance.. Mr. Tom Leong, applicant's representatives was present to discuss this matter with the Commission. Mr. Harold Feltman of Mantrose Avenue discussed the proposed Variance with the Con~ission and expressed fear that trucks would use the drive off McFarland Avenue. At 9:03 P. H.s Chairman Norton referred V-266~ Paul Masson, to the Variance Committee for study and directed same continued until the next regular meeting. SDT.592 - Western Hills Investment Company, Pierce Road - Subdivision - 26 Lots - Continued from 22 November 1965 Cowmissioner Crisp advised 1) site development plans had not yet been ,submitted in connection with SD-592 and 2) it was the recommendation /~ of the Committee that this matter be continued until the meetin~ on \ / 27 December 1965. SD-607 - Douglas Hines, Pierce Road - Subdivision - 5 Lots - Continued from 22 November 1965 Connnissioner Crisp advised 1) the applicant had requested that this application be continued until the next regular meeting and 2) it was the recommendation of the Co=~nittee that this request be Eranted. Chairman Norton so directed. C, SDR-608 - Donald Kinkel~ E1Quito Way - Bui.l~ir~ Sitq ApRrov~! - 2 Lots Commissioner Crisp advised 1) the Co~uittee was undecided about the requirement for underground utilities in connection with this property 2) an opinion had been requested from P.C,&E. and 3) it was the recom- mendation of the Comittee that this matter be continued until the opinion had been received. In view of the foreEoing, Chairman Norton directed SDK-608 continued until the next regular meeting. D, SDR-609 - John Lyngso, Sarato~a-Sunnyvale Road - Building Site Approval - 1 Lot ..... Commissioner Crisp advised that V-265 had been filed in conjunction with this application, av~ since no action had been taken in connection with the Variance, it was the recon~endation of the Committee that SDR-609 be continued until the meetin8 on 27 December 1965. - ...... Commissioner Cowley advised that the ComiCtee had found both the large identification sign and the two smaller signs (to be placed o~ the building) quite satisfactory. It was moved by Con~issioner Cowley and seconded by Com~issioner John- son that final desiEn approval be granted in connection with A-202~ See~s Candies~ on the basis of Exhibit ~" of that file; motion carried unanimously. B. A-203 - Coldwell Banker~ Scully Avenue - Final Design Review - Subdivi- sion HSmes - Tract No. 3146 Commissioner Cowley advised 1) the Design Review Co~,~ttee had me= with the developer 2) the Connnittee had made su~estions which the developer had agreed to Eive further s~udy and 3) it was the recom- mendation of the Conm~ittee that this matter be continued until the nex~ regular meeting. Chairman Norton so directed. C. SS-43 - Saratoga Manor~ Sarato~a-Sunnyvale Read - Final Design Review - Identifica~ion Sign After discussion~ Conmissioner Cowley moveds seconded by Commissioner Johnson, that final design approval be granted SS-43, Saratoga l~anor Subdivision identification signs for a period of one year~ with the usual provision tha~ the approval could be rene~ed at that rime if the subdivision had no= been comple=ed; motion carried unanimously. V. CITY COUNCIL REPORT Connnissioner McFall suggested that perhaps a report on the last City Council meetin~ was unnecessary since che minutes had already been distributed to the Comission. The Conmission concurred with this su~gestion. Chai~nan Norton extended a welcome to Hrs. Owens ana Mr. Pierce of the Good Goverxnnent Croup and to Fu:s. Ottenberg of the League of Women Voters. NEW BUSINESS OLD BUSINESS Amendment to Subdivision Ordinance re Dual Access - Recon~endation to City Council relative to Amendment of Subdivi- sion Ordinance in con- nection wt~h Dual Access The Secretary read a proposed'amendment to Subdivision Ordinance NS-5 re- latlug to dual access. After discussion, Comuissioner Crisp moved, seconded by Connnissioner Kellum, that the Connnission recommend to the City Council that the proposed amend- ment be enacted and that the Secretary be directed to transmit this recom- mendation to the Council prior to the meeting on 15 December 1965; motion carried unanimously. SDR-463 - Francis Minsha11, Saratoga Avenue - Request for Extension Continued from 22 November 1965 Connuissioner Crisp moved, seconded by Commissioner McFa11, that an extension of one year from the present date of expiration be in connection with SDR-463, Francis Minshall; motion carried unanimously. 2. SDK-461 - Dolores Hickman, SobeyRoad - Kequest for Extension - Con- tinued. from 22 November 1965 Commissioner Crisp moved, seconded by Commissioner }icFa11, that an extension of one year from the present date of expiration be granted in connection with SDR-461, Dolores Hickman, and that the Co.~.ission reques~ that the Secretary recommend to the applicant that he give serious consideration to installing underground utilities; metion carried unanimously. 3. SDR-532 - J. J. Fon~ Verde Vista Lane - Request for Extension The Secretary read a letter requesting an extension of one year in connection with SDR-532. After discussion, Commissioner Crisp ~oved, seconded by Commissioner Kellum, that an extension of one year from the present date of expira- tion be granted in connection with SDR-532; metion carried unanimously.
