The meeting was called =o order by Chairman Norton at 7:30 P.. M.
A. ROLL CALL
Present:. Commissioners' Crisp, Johnson, Kellum, McFalZ and Norton.
Absent: Commissioners Cowlay and O'Rorke.

Commissioner Crisp moved, seconded by Commissioner Johnson, that the
reading of the minutes of 13 December 1965 be waived and that the
minutes be approved subject co the following modifications:
Page 3...Item II, E...Change the word "streets" to "turn-arounds" in
l) the last line of the first paragraph and
2) the third line of the last paragraph.
Page 5...1tam II, I...lnsert the following at the end of the first paragraph:
'Mr. Ronald K. Lindsay (Secretary of Calson
Properties, lnc.) also appeared in person to
affirm his protest."
Item 1I, J...third paragraph...Omit the word "and" in the
second line, insert a comma
in its place, and add the following at the end
of the paragraph:
'~nd inquired about the possibility of land-
scaping along the back of the applicant's pro-
percy. Mr. Leong assured Mr. Feltman that
the trucks would not use the drive off McFar-
land Avenue and 2) landscapin~would be pro-
vided along the rear of the property."
Motion carried unanimously.

I1. PUBLIC HEARINGS
Chairman Norton declared public hearings open for the evening at 7:33 P.
A. C-87 - M.V.S.Corn~any, Saratoga Avenue - Request for Chan~e of Zonin~
from "A" (A~ricultural) to '~-M-~,O00 P-C" (Multiple Residentia~
Planned Connnunity) - Continued from 13 December 1965
Since nothing further had been added to the file and there was no one
present who wished to comment with regard to this matter, the continued
hearing on C-87 was not re-opened at this time.
Commissioner Crisp advised that this matter had been discussed briefly
at the Subdivision Committee meeting earlier in the day, and it was
the consensus of the Cormnittee that C-87 should be continued off the
agenda until the meetin~ on 28 February 1966.
After further discussion, Chairman Norton, with concurrence of the
applicant and the Connnission, so directed.
B. C-92 - Columbus-Founders Savings and Loan Association, Iqardell Road -
Request for Change of Zoning from '~-1-15,000" and '~-1-40,000"
(Single Family Residential) to '~-1-20,000" (Single Family resi-
dential) - Continued from 13 December 1965
The continued hearing on C-92 was resumed at 7:35 P. M. The Secretary
briefly reviewed this matter and advised that nothing further had been
added to the file.
Frank Maggi, applicant's representative, stated l) it was his under-
standing that the Subdivision Committee would like to present its
report relative to this application and 2) he would like to request
that C-92 then (after the report had been placed on record) be con-
tinued further.
Commissioner Crisp 1) confirmed that the Cor~mittee would like
the report on record since it had been prepared several weeks ago 2)
read the report, dated 13 December 1965, which recommended that this
request be disapproved and 3) stated that he could see no reason why
action on this report was necessary at this time.
After discussion, Chairman Norton (7:42 PN), with concurrence of
l~aggi and the Commission, directed C-92 continued until the meeting on
24 January 1966.

II. C. C-93 - John B. Jessup, Big Basin Way - Request for Change of Zoning

Since there 1) were no further additions to the file and 2) was no
one present who wished to comment with regard to this matter, the
continued hearin~ on C-93 was not re-opened at this time.
Commissioner Crisp advised 1) the applicant had not yet complied
with the request for additional plans 2) further time would be
needed for review of these plans when they were submitted and 3) in
view of this, it was the recommendation of the Subdivision Committee
that C-93 be continued until the meetin~ on 24 January 1966.
Chairman Norton so directed.
D. Ordinance NS-3.11 - Proposed Amendment to Ordinance NS-3 - Clarifying
certain definitions, Addin~ the definition of
'Feeping", Clarifying sections relating to the
keepir~ of horses in residential districts, and
Adding sections relating to horses for riding les-
sons - Continued from 13 December 1965
Since 1) the proposed meeting between the Citizens Committee and the
Subdivision Committee had not yet been held 2) there was no one pre-
sent who wished to comment with regard to this matter and 3) nothing
further had been added to the file, the public hearing on Ordinance
NS-3.11 was not re-opened at this time.
The Secretary stated that further developments were expected in con-
nec=ion with the proposed ordinance prior to the next meeting.
In view of the foregoing, Chairman Norton directed the hearing on
Ordinance NS-3.11 continued until the meeting on 10 January 1966.
E. V-265 - John Lyngso, Saratoga-Sunnyvale Road - Request for Variance in
connection with Rear Yard Setback Require~nent - Coutinued from
13 December 1965
Commissioner Johnson advised that it was the recommendation of the
Variance Conmaittee that this matter be continued since the applicant
planned to file a request for an additional variance in connection
with development of this property.
There was no one in the audience who wished to comment with regard to
this application.

II. E. V-265 - John Lyre%so
In view of the foregoing, Chairman Norton 1) advised that the public
hearing on V-265 would not be re-opened at this time and 2) directed
same continued until the meeting on l0 January 1966.
F. V-266 - PaulMasson, Saratoga Avenue - Request for Variance in connec-
tion with Front Yard Setback Requirement - Continued from 13
December 1965
The continued hearing on V-266 was re-opened at 7:46 P. M. The Secre-
tary briefly reviewed this matter and advised that there were no fur-
ther additions to the file.
There was no one in the audience who wished to comment with regard to
this application.
Tom Leong was present to represent the applicant and advised 1) fur-
ther negotiations were under way to obtain the adjacent San Jose
Water Works property and 2) the variance, however, would still be
needed until the Passantino property could be acquired.
Commissioner Johnson read the report of the Variance Committee rela-
tive to this application, recommending that the variance be granted
subject to a requirement for a landscaped strip along the southern
property line.
After discussion, Conmissioner Crisp moved, seconded by Commissioner
McFall, that the hearing on V-266 be closed; motion carried unani-
mously and the hearing was closed at 7:50 P. M.
Commissioner Kellummoved, seconded by CommissionerMcPall, that the
=eporE of the Variance Committee relative to V-266 be approved~ ~hat
the findings required be law be made, and that the Variance be
granted subject to the condition set forth in said report; motion
carried unanimously.
Chairman Norton declared hearings closed for the evening at 7:51 P. M.
IlI. SUBDIVISIONS AND BUILDING SITES
A. SD-592 - Western Hills Investment Company, Pierce Road - Subdivision -
26 Lots - Continued from 13 December 1965
The Secretary read a letter from the applicant~s engineer, requesting
an extension of 60 days in connection with action on the tentative mp
for SD-592. '.

III. A. SD-592 - Western Hills Investment Company
Commissioner Crisp advised that it was the recommendation of the Sub-
division Committee that this request be granted.
After discussion, Chairman Norton directed SD-592 continued until the
meeting on 14 February 1966 with the understanding that it could be
placed on the agenda sooner if the site development plans (which are
now being prepared) are submitted.
B. SD-607 - Douglas Hines, Pierce Road - Subdivision - 5 Lots - Continued
from 13 December 1965
Commissioner Crisp advised 1) the applicant had requested that this
matter be continued until the n~xt regular meeting and 2) it was the
recommendation of the Subdivision Committee that this request be
granted.
Chaiz~Tan Norton so directed.
C. SDR-608 - Donald Kinkel, E1 Quito Way - Building Site Approval - 2 Lots -
Continued from 13 December 1965
There was no one present to represent ~he applicant, but the Secretary
advised that he had discussed the proposed conditions with the appli-
cant's engineer and he had ~xpressed satisfaction with same. ~
Connnissioner Crisp ~ved, seconded by Commissioner Yellurn, that the
Building Site Committee Report of 27 December 1965 relative to SDR-608,
Donald Kinkel, be adopted and than the tentative map (Exhibit '~", filed
29 November 1965) be approved in accordance with the site development
plan (Exhibit 'J", filed 20 December 1965) subject to the conditions
forth in said report; motion carried unanimously.
D. SDR-609 - John Lyngso, Saratoga-Sunnyvale Road - Building Site Approval -
1 Lot - Continued from 13 December 1965
Co~nnissioner Crisp recommended that SDR-609, John Lyngso, be continued
until the next regular meeting since the variance application filed in
conjunction with same had been continued until that time.
Chairman Norton so directed.

III. E. SD-~05 - Haven Investment Corporation, Wardell Court - Revised Tenta-
tive ~p
Commissioner Crisp explained 1) a tentative map showing seven lots
(including the residual parcel) had been approved under SD-605 on
8 November 1965 2) the applicant had now filed a revised map showing
eight lots (including the residual parcel) on this property and 3)
the revised map meets all ordinance requirements.
After discussion, Commissioner Crisp moved, seconded by Commissioner
Kellum, that the revised tentative map for SD-605 Exhibit "A-2",
filed 17 December 1965) be approved subject to the conditions set forth
in the Subdivision Conunittee Report of 8 November 1965 relative to
SD-605, and that the said report be modified accordingly; motion car-
ried unanimously.
IV. DESIGN REVIEW
A. A-203 - Coldwell Banker, Scully Avenue - Final Design Review - Subdi-
vision Homes - Tract No. 3145 - Continued from 13 December 1965
Commissioner Johnson advised 1) the Design Review Conunittee had re-
viewed the subject plans 2) all requirements of the ordinance had been
met and 3) it was the recon=aendation of the Conmittee that final design
approval be granted.
After a brief discussion, it was moved by Commissioner Johnson and
seconded by Commissioner Kellum that final design approval be granted
A-203, Coldwell Banker, for the subdivision homes in Tract No. 3145 on
the basis of Exhibits "A-i", "B-l", "B-2", "B-3" and "C"; motion car-
ried unanimously.
B. A-204 - Robert R. Green, Big Basin Way - Preliminary Design Review -
ConverSion of Apartment BuildinM to Commercial Buildin~
....... ~ommissioner Johnson explained 1) 'the applicant had requested 'pre- ' ....
liminary design approval on the basis that the parking district, when
formed, would provide ample parking and 2) since there was no other
provision for parking, the applicant would be unable to convert the
building until that time.
During the discussion that followed, the Commission 1) expressed con-
cern, because of the present parking situation in the Village, about
granting even preliminary approval contingent upon formation of the par-
king district and 2) raised a question as to why the applicant had re-
quested approval at this time when formation of the district was still
so indefinite. The consensus of the CoYmnission was that 1) perhaps the
application was premature and 2) the matter should be continued until
the applicant (who was not present) could explain his reasons for filing
at this time.
In view of the foregoing, Chairman Norton directed A-204 continued until
the next regular meeting.

IV. C. SS-44 - Dura-Style tbmes, Shubert Drive - Final Design Review - Identi-
fication Sign
Commissioner Johnson advised that the Committee had reviewed the plans
for the subject sign and had found them satisfactory.
After a brief discussion, Co~nissioner Johnson moved, seconded by Com-
missloner Kellum, that final design approval be granted SS-44, subdivi-
sion identification sign, on the basis of Exhibits "A" and "B"; motion
carried unanimausly.
D. ~-189 - Van Dyke and Abrams, Village Drive - Final Design Review - Medi- cal Buildin~ - Medical Village
Dr. Abrams submitted a comprehensive parking plan for the Medical Village
which was reviewed by the Commission and filed for record as Exhibit '~"
of File No. C-43 (the Change of Zoning file for the Medical Village).-
After discussion, it was moved by Commissioner Johnson and seconded by
Commissioner Kellum that A-189, Van Dyke and Abrams, be granted final
design approval on the basis of Exhibit '~-1" of File No. A-189 and
Exhibit '~" of File No. C-43; motion carried unanimously.
RECESS AND RECONVENE
Chaiz~mn Norton extended a welcome to Mrs. Owens of the Good Government Group and
}~s. Ottenberg of the League of Women Voters, and expressed appreciation for the
coffee served by Mrs. Owens at recess. He also extended best wishes (on behalf of
the Commission) to Commissioner O'Rorke's daughter who was celebrating her birth-
day, and commented that thia explained and justified Commissioner O'Rorke's absence.
V. CITY COUNCIL REPORT
Since minutes of the City Council meeting on 15 December 1965 had already been
distributed, the Comission concurred that a report would be unnecessary.
VI. N~W BUSINESS
C-90 - Town & Country Realty, Cox and Saratoga Avenues - City Council Refer- ral relative to Revised Application
The Secretary read a cormnunication revising the subject application to re-
quest the same zoning granted for the adjacent Medical Village, and advised
that the City Council had requested a Commission recommendation in connec-
tion with the revised application.
Ty Papalias, applicant's representative, was present and stated that they were
prepared to submit plans that would comply with all requirements of the Medi-
cal Village zoning.

VI. C-90 - Town & Country Realty
After a brief discussion, Chairman Norton referred this matter to the Sub-
division Committee for study and directed same continued until the meeting
on 10 January 1966.

A. WRITTEN
1. SDR-540 - Dr. Thomas Giannetto, Farwell Avenue - Request for
Extension
After discussion, Commissioner Crisp moved, seconded by Connnissioner
McFall, ~hat an extension of one year from the present dare of ex-
piration be granted in connection with SDR-540, subject to the addi-
tional condition that the applicant provide underground utilities in
connection with development of this property; marion carried
unanimously.
2. SDR-440 - Shannon Lightfoot, Sprin~%er Avenue - Request for Extension
The Secretary read a letter requesting an extension in connection
with SDR-440.
After discussion, Chairman Norton directed this matter continued un-
til the meeting on 10 January 1966 and referred same to the Building
Site Committee for review.
