B. MINUTES

II. PUBLIC HEARING5 ..................
The Chairman declared public hearings open for the evening at 7:34 P.M.

The public hearing on C-93 was not re-opened at this time since :~:
nothing further had been added to the file and there was no one
present who wished to comment with regard to same.
Commissioner Kellum suggested that this application be continued off
[he agenda since the additional exhibits had not been filed by the
applicant.
After discussion, Chairman Norton directed C-93 continued until the
meeting on 14 March 1966, and requested that the Secretary advise
the applicant accordingly- "

II. B. V-267 - Richard Travers, Canyon View Drive - Request for Variance in
connection with Rear Yard Setback Requirements - Continued

The hearing on V-267 was re-opened at 7:37 P.M. The Secretary
briefly reviewed this matter and advised that nothing further had
been added to the file.
The applicant was present but stated that he had-no further comment
at this time.
There was'no one else present who wished to speak with regard to
this matter.
Commissioner Crisp read the report of the Variance Committee rela-
tive to V-267 (recommending approval of same). and advised that
while Conmaissioner Johnson (third member of the Committee) had not
yet signed the report~ he had confirmed by telephone that he con-
curred with the contents of the report.
Chairman Norton observed that the granting of this variance in
accordance with the report would indicate that the Commission would
be willing to grant a similar variance on the ~.;o adjacent sites.
The Commission concurred with this observation.
Commissioner Kellum moved, seconded by Commissioner McFall, that the
public hearing on V-267 be closed; motion carried unanimously and
the hearingwas closed at 7:41 P. M.
It was moved by Commissioner McFall and seconded by Commissioner
O'Rorke that the variance requested under V-267 be granted in accor-
dance with the Variance Committee Report of 14 February 1966 rela-
tive to this matter; motion carried unanimously.
C. V-268 - Gerald Schmidt, Houston Court - Request for Variance in con-
nection with Side Yard Setback Requirements - Continued from
24 Janusry 1966
The continued hearing on V-268 was resumed at 7:42 P. M. The Secre-
tary reviewed this matter briefly and advised that there were no
further additions to the file.
Mr. Schmidt was.present But advised that he had no further comment
at this time.
There was no one else present who wished to speak with regard to this
matter.

II. C. V-268 - Gerald Schmidt
Commissioner Crisp read the report of the Variance Committee rela-
tive to this application (recommending approval of same) and ad-
vised that Commissioner Johnson had verified by telephone his con-
currence with the ~ontents of this report although he had not yet
had an opportunity to sign it.
After discussion, ft"was moved by'Commissioner Crisp and seconded
by Commissioner Kellum that the public hearing on V-268 be closed.;
motion carried unanimously and the hearing was closed at 7:46 P.M.
Commissioner McFall moved, seconded by Commissioner Kellum, that the
variance requested under V-268 be granted in accordance with the
Variance Committee Report of 14 February 1966 pertaining to this
application; motion carried unanimously.
Mr. Schmidt expressed appreciation for the Commission's time and
courtesy during the processing of his application.
D. V-269 - D. J. Viviani,Oahu Lane - Request for Variance in connection
with Side Yard Setback Requirements
The public hearing on V-269 was opened at 7:49 P. M. The Secretary
advised that Notices of Hearing had been mailed and there were no
written communications on file. He then briefly reviewed this appli-
cation and read the applicant's statement of. reason.
Mrs. Viviani was present but stated that she had nothing to add to
the statement read by the Secretary.
Mrs. Frances M. Jamison of 19137 Oahu Lane stated that she was opposed
to the granting of the subject variance if the proposed 'tool shed
would extend above the fence line.
After discussion, Chairman Norton (7:58 P. M.) directed V-269, D. J.
Viviani, continued until the next regular meeting and referred same
to the Variance Committee for study and a report at that time.
E. UP-~5 - Marion Day,'Cumberland Drive - Request for Use Permit for
Model Home Sales Office
The public hearing on UP-95 was opened at 7:59 P. M. The Secretary
advised that Notices of Hearing had been mailed and there were no
written communications on file.

II. E. UP-95 - Marion Day
After a brief discussion, it was suggested that this matter be refer-
red to a committee for review since the applicant had requested a
construction office as well as a model home sales office, and there
were other model home sales offices in the same general area.
Chairman Norton (8:05 P. M.) directed UP-95 continued until the next
regular meeting ~nd~eferred same to the Subdivision Committee for
review and a report at that time.
The Chairman then (8:06 P. M.~ declared public hearings closed for the
evening.
· ,III. SUBDIVISIONS AND BUILDING SITES
A. SD-592 - Western Hills Investment Company, Pierce Road - Subdivision -
26 Lots - Continued from 27 December 1965
The Secretary advised that the applicant's engineer, Mr. Heiss, had
submitted a letter requesting a 60 day extension .of time in connec-
tion with action on this tentative map.
After discussion, Chairman Norton directed SD-592 continued until the
meeting on 28 February 1966.
B. SDR-612 - William Shoenhard, Montalvo Road - Building Site Approval -
1 Lot
The Secretary advised that the proposed conditions of approval had
been read to }~s. SchoepAqard over the telephone and she had expressed
tentative approval of same.
Commissioner Kellummoved, seconded by Commissioner Crisp, that the
Building Site Committee Report of 14 February 1966 relative to SDR-612,
William Schoenhar~be adopted'and that the tentative map (Exhibit '~",
filed 24 January 1966) be approved subject to the conditions set forth
in said report; motion carried unanimously.
C. SD-613 - Coltunbus Founders Savings and Loan Association, Wardell Road '-
Subdivision - 25 Lots
Commissioner Kellum 1) advised that the Committee had met with the
applicant's representatives in the afternoon to discuss various pro-
blems to be worked out in connection with this map and 2) requested
that SD-613 be continued until the next regular meeting to allow ade-
quate time for further study and revision of the map.
Chairman Norton so directed.

IV. DESIGN REVIEW
A. A-205 - Tidewater Oil Company, Saratoga Avenue - Preliminary Design
Review - Plans for Remodeling Service Station - Continued
from 24 January 1966
The Secretary advised that a review of the plans for the proposed
sign revealed that, the size of the'sign exceeded that allowed under
the ordinance.
Commissioner O'Rorke advised that with the exception of the sign
(which would have to be reviewed at a later date) the Committee: had
found the plans acceptable.
After discussion, Commissioner O'Rorke moved, seconded by Commis-
sioner McFall, that final design approval be granted A-205, Tide-
water Oil Company, on the basis of Exhibits "A-i" "B" and "C" with
, ,
the exception of the flying "A" sign on the post· at-the front of the
property which is to be reviewed as a separate item at a lateri. date;
motion carried unanimously.
B. A-206 ' Town& Country Realty, Saratoga and Cox Avenues - Preliminary
Design Review - Professional Building - Continued from
24 JanuarX 1966
Commissioner O'Rorke recommended that this application be continued
until the next regular meeting since no further exhibits had been
submitted in connection with same.
Chairman Norton so directed.
C. A-208 - Samuel L. Tyler, Fourth Street - Final Design Review - Change
of Use from Youth Center Buildins to Commercial Build.~g ..
Commissioner O'Rorke advised that the Committee had reviewed the
plans submitted by the applicant and had later visited the site
individually.· After various comments and discussion, it was agreed
that 1) there ~?peared to be ample room for the required number of
parking spaces 2) the parking area should be properly surfaced
3) while the natural growth gives a nice appearance, removal of
enough macadam to put in a landscaped strip along Fourth Street would
improve the appearance of the front of the building and 4) preliminary
design approval could be granted with a request that plans·showing
landscaping detail and parking lot surfacing be submitted for final
approval.

IV. C. .A-208- Samuel L. Tyler
The applicant expressed willingness to accept preliminary design
approval at this time and submit further plans before receiving
final design approval.
Commissioner O'Rorke moved, seconded by Commissioner Cowley, that
preliminary design. approval be granted A-208, Samuel L. Tyler, on
the basis of Exhibits "A", "B" and "C"; motion carried unanimously..
D. A-209 - Quito Pharmacy, Cox Avenue - Final Design Review - Identi-
._ fication Sign
The Secretary explained that through checking with the applicant
he had learned 1) the man who drew the plans had never seen the
building 2) this accounted for the fact that the drawing indicated
that the pharmacy would occupy the other corner of the shopping cen-
ter and 3) the details for the sign, however, were correct.
After discussion, Commissioner O'Rorke moved, seconded by Commis-
sioner Cowley, that A-209, Quito Pharmacy, be granted final design
approval on the basis of Exhibit "A"; motion carried unanimously.
E. A-210 - W. C. Garcia, Saratoga-Sunnyvale Road - Preliminary De-~;ign
Review - Restaurant
Commissioner O'Rorke advised that the Committee was at a disadvan-
tage in reviewing the subject plans since site approval had not yet
been obtained. He explained 1) the disposition of the large trees
on this corner was of major interest to the Committee 2) the appli-
cant had explained that he was prepared to preserve those on his
property but that to the best of his knowledge, most of the trees
would be in the right-of-way for the frontage road .3) site approval
would furnish the necessary information relative to the trees, the
frontage road, etc. and 4) the Committee felt that the tentative
map for this property should be filed before proceeding. He further
'advised ~) 'when the Committee expressed concern about 'the poee~tial ......................
for outside eating areas, it had ·been assured that the intent was to
serve food inside the building only and 2) the applicant had been
informed that the' Committee felt the sign did not meet the aesthetic
standards hoped for in this particular location (since this property
is located at the entrance to the City). Commissioner O'Rorke! then
stated that the Committee felt that with adequate screening th~·- pro-
posed building could be placed on the site effectively. 'i.

IV. E. A-210 -W. C. Garcia
After discussion~ the Commission concurred that with respect to
this site 1) it would be difficult to intelligently appraise the
plans filed for design review until conditions of approval had~2
been established under the building site application and 2) for
this reason, no action should be taken on A-210 until building,.site
approval had been Obtained. .. ;
The applicant's representative discussed this matter with the Com-
mission and expressed willingness to file a tentative map prior to
close of the agenda for the next meeting.
In view of the foregoing, Chairman Norton directed A-210 continued
until the meeting on 28 February 1966.
V. CITY COUNCIL REPORT
Commissioner Crisp observed that the minutes of the last Council meeting
had been distributed and advised that he had nothing further to add.
Several items of interest to the Commission were then briefly discussed.
Chairman Norton extended a welcome to Councilmen Hartman and Tyler. and
.. to Mrs. Stark of the Good Government Group. He also expressed app~e-
clarion for the coffee served earlier by Mrs.. Stark.
VI. I~rEW BUSINESS
A. Setbacks for Swimmin~ Pools
Commissioner Crisp advised that the filing of several applications
for variance in connection with the installation of swimming pools
had prompted him to review the ordinance requirements relative to
.. same and 2) after consideration, he felt that perhaps an amendment
to Ordinance NS-3 was warranted, establishing a 10 foot minimum set-.
back from the rear property line and from the side property lines at
the rear of the house.
The Planning Director observed that while such an amendment would
benefit some people (as indicated by Commissioner Crisp), the re-
quirement for a 10 foot minimum from the rear property line (in
lieu of the existing 6 foot minimum) might well 6reate a problem
for property owners with smaller lots.
After discussion, Chairman Norton requested that the Planning Direc-
". tor make a study in connection with this matter and report back to
the Commission at his convenience.

VI. B'o Signs along 'SaratoKa-Sunnyvale Road
The Chairman observed that the street signs posted along Saratoga-
Sunnyvale Road by the State Highway Department were much larger
than other such signs in Saratoga and requested that the Planning
Director check into the matter to determine whether they could 'be
modified.
VII. OLD BUSINESS "'
C-90 - Town& Country Realty, Saratoga and Cox Avenues - City Council
Request'for Recommendation on Revised Application - Continued
from 24 January 1966 '
Connnissioner Kellum 1) advised that the Committee had been unable'to
confer with the City Attorney about this matter since he had been in
court and 2) requested that same be continued until the next regular
meeting.
After a brief discussion, Fir. Papalias, applicant's representative, ex-
pressed satisfaction with the proposed continuance.
Chairman Norton then directed C-90 continued until the meeting on
28 February 1966.
VIII. COMMUNICATIONS .~
A. WRITTEN
1. SD-473 - Bro~.~a & I~Uffmann.~-inc., Scully Avenue - Request for
Extension
Commissioner Kellum advised that the Subdivision Committee had
reviewed this request for extension and that approval of same
was recommended.
After discussion, Commissioner Kellummoved, seconded by Com-
missioner Crisp, that an extension of one year from the present
date of expiration be granted in connection with SD-473, Brown.
& Kauffmann, Inc.; motion carried unanimously.
2. SDR-545 - R. B. Wilds, Ambric Knolls Road - Request for Extension
The Secretary read a communication from the applicant reques-
ting an extension in connection with this building site approval.
VIII. A. 2. SDR-545 - R. B. Wilds
Since this request had been filed too late for review of the
Building Site Committee, Chairman Norton directed same con-'
tinued until the next regular meeting.
