I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:30 PoM.
A. ROLL CALL
Present: Commissioners Crisp, Johnson, Kasner, Kel!um, McFall, Norton and
O ' Rorke.
Absent: None
B. MINUTES ~",.
Commissioner Johnson moved, seconded by Commissioner Kellum, that the
reading of the minutes of 28 March 1966 be waived and that the minutes
be approved subject to the following modification:
Page 7. .Item !!I, A... .Change the word v'Commission" to "Committee" in
the fifth line of the second paragraph.
Motion carried unanimously. . ,., ,.
C. CO~.ITTEES
· Chairman Norton announced that Commissioner McFall would be absent for some
time due to a trip abroad and 2) it was necessary tO make the following
changes on the various committees:
SUBDIVISION CO~R~iTTEE
Commissioner Johnson will replace Commissioner McFall. ·
DESIGN REVIEW COMZ~ITTEE
Co~anissioner Crisp will replace Commissioner McFail.
VARIANCE COMMITTEE
Commissioner Kellum will replace Commissioner McFa!l.

The Chairman declared public hearings open for the evening at ·7:37 P. Mo
A. C-96 - joseph j. Pon, Verde Vista - Request for Change of Zoning from
"R-i-40~000'c (Single Family Residential) to "R-1-40,000 P-D"
(Single Family Residential Planned Development) - Continued from
28 ~rch 1966
The public hearing on C-96 was not re-opened at this time since i) nothing
further had been added to the file 2) there was no one present who wished
to con~ment with regard to this matter and 3) Com~nissioner Kellum advised
that the applicant had employed new engineers who were working on a new
tentative m~p, therefore, he felt it would be desirable to continue this
application until the new plans were completed.
In view of the foregoing, Chairman Norton directed C-96 continued until
the next regular meeting on 25 April 1966.

II. B. UP-98 - Clyde D. Duffy, Ravenwood Drive - Request for Use Permit for Horse -
Continued from 28 March 1966
The public hearing on UP-98 ~ms re-opened at 7:40 P~M.
The applicant was present but stated that he had no further comment at
this time.
The Secretary read a Staff Report relative to UP-98, reconnr~ending approval
of this request for a Use Permit for the keeping of a horse.
Coranissioner Kellummoved, seconded by Commissioner McFall, that the public
hearing on UP-98 be closed; motion carried unanimously and the~hearing was
closed at 7:42 P.M.
ConnnisSioner Kellum moved, seconded by Commissioner McFall, that the Staff
Report of 11 April 1966 relative to UP-98 be approved and that the Use Per-
mit be granted in accordance with said report; motion carried unanimously.
Chairman Norton noted that ~ in paragraph 3. .Line 2 of the said Staff
Report the following correction should be made:
"'Section 16.5" should be changed to'Bection 16.6".
C. UP-99 - Finnegan Construction Company, Inc.~ Jaccaranda Court - Request
for Use Permit for Model Home Sales Office - Continued from

The Continued heating on'UP-99 was resumed at 7:44 P.M.
The Secretary ad~i'sed 1) that corrected Not. ices of Hearing had been pub-
lished and 2).read.a communication filed by ~. and b~s. Leo A. Huard of
Via Escuela opposing the requested Use Permit.
The applicant was not present.
~k-. Huard was present and, '.1) stated that the outside phone he objected
to in his letter had'been removed and 2) .inquired for what period of
time a Use Permit.is granted.
Chairman Norton, in answer to b~. Huard'S inquir~ explained that according
to the Ordinance a Use Permit was granted for one (1) year.
Commissioner Kellum stated 1) that the Committee had visited the site
and 2) since there were several houses under construction in this area
the Committee felt 'that this would be a good location for the model home
sales office.
The Secretary then read the Staff Report recommending that the subject
Use Permit be granted.
Commissioner Crisp moved, seconded by Commissioner McFall,. that the pub-
lic hearing on UP-99 be closed; motion carried unanimously and the hear-
ing was closed at 7:53 P.M.
Co~issioner Xellum moved, seconded by Commissioner Crisp, that the. Staff
Report of 11 April 1966 relative to UP-99 be approved and that the Use
Permit be granted for a period of one year in accordance with said report
subject to'the following additional..condition:
"The use of an outside phone will not be permitted
under the subject Use Permit."
Motion carried unanimously.

!I. D. UP-100 - Saratoga Youth Center, Inc., Fruitvale Avenue - Request for
Use Permit for Youth Center Building on Civic Center Site -
Continued from 28 MarCh 1966
The hearing on UP-100 ~ms resumed at 7:55 P. M.
The Secretary explained that i) neither the applicant nor his represen-
tative were present since they understood that the matter would be con-
tinued and 2) the Use Permit application had been made by the architect
mainly to get a consensus'of the Commission as to the suitability of the
site for a Youth Center building with regard to precise building location,
parking, access and landscaping.
Com~issioner Kellum informed the Commission that the City Administrator had
m~.de a request to the Subdivision Committee' that it would be ~se to post-
pone action on this application for a time.
Chairman Norton (8:01 P.Mo), on the basis of the foregoing, directed that
UP-100, Saratoga Youth Center, Inc., be dealt with as follows:
1) Taken off the agenda indefinitely.
2) Re-instated only at the request of the applicant.
3) Studied by the Design Review Co.mmittee and a report. be
prepared for the City Council as to the feasability of
locating the Youth Center on this site.
4) New Notices of Hearing should be published if the appli-
cation is reinstated.
E. b~-101 - R. Fredrik Nylander~ Baranga lane - Request for Use Permit for
Horse - Continued from 28 M~rch 1966
The continued;hearing on UP-101 x, ms resumed at 8:03 P~ Mo The Secretary
advised that;nothing further had been filed, in'connection with this appli-
cation and then read the Staff Report recommending approval of l/P-101.
The applicant was present but stated that he had no.. further cor~ment at
'this time.
After discussion, Commissioner Ke!lummoved, seconded by Commissioner
McFall, that the public hearing on UP-101 be closed at 8:06 P. M.;
motion carried unanimously.
Commissioner McFall moved, seconded by Commissioner Kel!um, that the Staff
Report of 11 .April 1966 relative to UP-i01, Ro Fredrik Nylander:, be approved
in accordance with the conditions listed in subject report; motion carried
unanimously.'
Fo V-271 - Robert jackson, Canyon View Drive - Request for Variance in connec-
tion x,~th Rear Yard Setback Requirements - Continued fr<ym 28 March
1966
The Secretary read a letter from the applicant requesting that this appliJ
cation be withdrawn.
After a brief discussion, the Connnission granted Mr. Jackson's request
that V-271 be withdra~m.
G. V-273 Michael E. Purcell, Pierce Road - Request for Variance in connec-
tion x.~_th Side Yard Setback Requirements - Continued from 28 M~rch
1966
The public hearing on V-273 ~ms re-opened at 8':11P.Mo The Secretary
reviewed this matter briefly and advised that there were no further
additions to the file.
There ~s no one present who wished to comnent with regard to this m~tter.
Commissioner Crisp stated that the Variance Committee had met with the
applicant and his engineers and had suggested an alternate plan. The
applicant agreed to study the matter further and on this basis Con~missioner
Crisp recommended that this application be continued.

II. G. V-273 - Michael E. Purcell
In view of the foregoing, Chairman Norton (at 8:31P.M.) directed V-273
continued until the next regular meeting.
.H. V-274 - C. P. Fernandez, Quito Oaks Way - Request for Variance in connec- tion with Rear Yard Setback Requirements
The public hearing on V-274 ~ms opened at 8:14 P.M. The Secretary advised
that Notices of Hearing had been mailed and stated that the applicant had
filed an extensive application including a petition with fourteen signatures
in support of this request.
At the request of Chairman Norton the Secretary read a summary of the appli-
cation and the enclosed petition.
The applicant was present but stated.that he had no comment at this time.
There was no one else present who wished to speak with regard to this matter.
Commissioner O'Rorke complimented. the applicant on his well prepared and
extensive application.
After a brief discussion, Chairman Norton (8:lg.P.M.) directed V-274'
'continued until the next regular meeting and referred same to the Variance
Committee for study and a report.
I. V-275 - Earl Quirk, Sarahills Drive - Request for Variance in connection with Side Yard Setback Requirements
The public hearihg'on V-275 was opened at 8i20 P.M. The 'Secretary advised
that Notices of;Hea~ing had been mailed. and then read a letter filed by the
applicant, ~. Quirk, listing five (5) factors, which he felt should be taken
into consideration regarding this Variance.
The applicant was present and stated that the. subject property i~ a beautiful
site there were problems involved with regard to grading and steep topograph'~
in locating the pool~
Mr. Thomas Rudy, of 21142 Sarahills Drivei was present and spoke in favor of
this application.
After further discussion, Chairman Norton (at 8:20 P.M.) directed V-275'
continued until the next regular meeting and referred same to the Subdi'vision
CoFmittee for study and a report.
The Chairman declared public hearings closed. for the evening at 8:23 P. M.
ili. SUBDIVISIONS AND BUILDING' SITES
A. SD-592 - Western Hills Investment Company, Pierce Road - Subdivision -
26 Lots - Continued from 28 ~rch 1966
The applicant u,ms not present but the Secretary 1) read a letter submitted by
the applicant's engineer requesting an extension of 30 days time and 2) read a
· letter from Mr. john B. Claborn of 13905 PierCe Road opposing the proposed sub-
division on'the basis that:'
(a) It would cause additional traffic volume on the access road
and bridge from Pierce Road, since both the bridge and road,
~ he felt, were very sub-standard for subdivision traffic.i
(b) It would Create severe drainage run-off problems from the high
new subdivision to the existing residences at the lower end of
the access road.
After a brief discussion, Chairman Norton directed SD-592 continued until the
next regular meeting and referred same to the Subdivision Committee for study
and a report.

III. B. SD-622 - Joseph J. Pon Verde Vista - Subdivision - 10 Lots - Continued from 28 March 1966
Commissioner advised that the applicant had not acquired proper zoning
for this subdivision application.
Chairman Norton stated that .no action could be taken until the applicant
obtained the requested change of ZOning.
In answer to a question from the Chairman, the Secretary explained that
a tentative map is always required with a change of zoning application
and 2) Mr. Pon's tentative map is consistent with Rs zoning application.
I~.view of'the foregoing, Chairman Norton directed this matter continued
until the next regular meeting and requested that Mr. Pon write a letter
requesting an extension for this application.
C. SDR-624- Leroy Hiatt, Saratoga-Los Gatos Road - Building Site Approval
- 1 Lot - Continued from 28 March 1966
The Secretary stated that 1) he had talked with Mr. Fleming of the
State Highway Department 'concerning the question relative to the access
to this property and 2) Mr. Fleming advised that access to this property
had not been approved by the State Highway Department.
The applicant was present and said that he would be willing to wait
for approval of this application until the problem of access could
be worked out satisfactorily.
After discussion,.Chai~ma~ Norton'directed SDR-624 continued until the
next regular' meeting in order to allow time to work out this problem.
D. SDR-625-'MisSion Trail BuilderS, E1Cami~o Grande - Building Site Approval
- 2 Lots - Continued from 28 March 1966
The Secretary advised that the applicant hadreviewed the proposed condi-
tions of approval and .h~d expressed satisfaction with same.
Commissioner Kellum.moved, seconded. by Commissioner McFall, that the
Building Site Committee Report of. 11 April 1966 relative to SDR-625,
Mission Trail Builders, be adopted'and that the tentative map (Exhibit
3'A-I", filed 8 April 1966) be approved subject to the conditions con-
tained in said report; motion carried unanimously.~
E. SDR-627- Flanagan and Egbert, Big Basin Way - Building Site Approval -
1 Lot
The Secretary stated that the applicant had reviewed the proposed condi-
tions of approval and found them satisfactory.
Commissioner Kellummoved, seconded by Commissioner McFall, that the
Building Site Committee Report of 11 April 1966 relative to SDR-627,
.Flanagan and Egbert, be adopted and that the tentative map (Exhibit
"A, filed..1..Apri!'1966)'be approved subject to the conditions set~
forth in said report; motion carried unanimously.
F. Tract 4102 - Davis and Moos~ Ten Oak Way - Reversion to Acreage - 6 Lots
The Secretary explained that reversion to acreage means that all the lot.
lines will be dissolved and that the property goes back to the way it was
prior to the time it was subdivided.
After a brief discussion, Commissioner Crisp moved, seconded by Commissioner
Kellum, to recommend to the City Council that Tract 4102 (6 Lots) be grant-
ed a reversion to acreage; motion carried unanimously.

III. G. SD-628 - D~_vis and Moos, Ten Oak Way - Subdivision - 7 Lots
The Secretary advised that the proposed conditions had been
discussed with the applicant and he had expressed satisfaction
with same.
Commissioner Kellum moved~ seconded by Commissioner Crisp, that
the Building Site Committee Report of 11 April 1966 relative to
SD-628, Davis and Moos, be adopted and that the tentative map
(Exhibit "A", filed 30 March 1966) be approved subject to the
conditions set· forth in said report; motion carried unanimously.
H. SDR-629- RoBert J. DiCkson, Jr., Saratoga Hills Road - Building
S~te Approval - 3 Lots.
The applicant was present and, after discussion, expressed
satisfaction with the proposed conditions of approval
Commissioner Kellum moved, seconded by Commissioner McFall, that
the Building Site Committee Report of 11 April 1966 relative to
SDR-629, Robert J. Dickson, Jr., be adopted and that the tentative
map (Exhibit "A 1" filed 11 April 1966) be approved subject to the

conditions set forth in said report; motion carried unanimously.
IV. DESIGN REVIEW
A. A-218 - Flanagan and Egbert, Big Basin Way·- Preliminary Design
Review - Commercial Buildin5

Commissioner O'Rorke a~ised that··the·Committee had reviewed the
subject pl~n's and recommended approval· for Preliminary Design Review
subject tO development of the proposed Village Parking District.
The Secretary pointed out that the State Highway Department. has
considered widening of Big Basin Way.
In view of the foregoing, the Chairman directed the Secretary to
address a memorandum to the City Council in connection ~ith the
Big Basin by-pass being inconsistent with the General Plan and
a potential conflict with the proposed Village Parking District.
In·addition, Chairman Norton directed, the question of the Big
Basin by-pass referred to the General Plan Committee for a study
and a report as to the proposed route or other alternate routes.
It was moved by Commissioner O'Rorke and seconded by Commissioner
McFall that Preliminary Design approval be granted A-218, Flanagan
and Egbert, as shown on Exhibits "A" "B" and "C" and subject to

parking being· provided under the proposed parking district.
B. A-208 - Left Bank Company, Fourth Street'- Final Design Review -
Change of Use from Youth Center Building to Commercial
Buildin~
Commissioner O'Rorke stated that 1) the building meets all necessary
building standards for the use intended 2) the proposed plan provides
ample parking 3) the front part of the building would be used for a
weaving shop and the rear of the building would be used as a coffee
shop (Brass Knocker) and 4) the proposed uses are acceptable on a
temporary basis.
After a brief discussion, Commissioner O'Rorke moved,'seconded by
Commissioner McFall, that Final Design approval be·granted in connec-
tion with A-208, Left Bank Company, as· shown on Exhibits "A-i",: "B",
"C-I" "D" "E" and "F'~ and' subject to the following conditions:
,
1) Approval is temporary and limited to one (1) year.
2) Parking stalls must be suitably designated and approV'ed by
the Planning Director.
Motion carried unanimously..

RECESS AND RECONVENE
V. CITY COUNCIL REPORT
Chairman Norton gave a brief report on the Council meeting of 6 April 1966
with emphasis on items of'particular interest to the Commission.
VI. NEW BUSINESS
Chairman Norton brought up the problem of the waiting period of one year.
"' before refiling on changes of zoning. He suggested an amendment be made
after the appropriate public hearing.to Section 18.3 of Ordinance NS-3 .,
in order. to solve this problem. ;;:
VII. OLD BUSINESS
As an item of old business Chairman Norton brought up the possible amend-
ment of the Planned'Community'Ordinance to allow limitation on age in the
retirement ~ype of Planned Community Development.
Considerable discussion followed by' the entire Commission as to the different
standards for age limitation in Planned Community developments and the possible
difficulty in setting standards. Chairman Norton stated a developer and/or
;' landlord of a Planned Community gets a certain added privilege over a regular
.... developer, therefore, if standards are once required (such as age) the developer
should not be able to lower these standards without complete approval of the
City of Saratoga.
Commissioner O'Rorke suggested'~h~ amendment or time limits for refiling a
change of zoning ~ight result in the applicants not being required to pay
another fee. The"Cha~rman pointed out this amendment would only affect the
time limits on r~filingand would not'concern the waiving of any fees.
After further discussion the Chairman directed that..the Secretary publish the
notices for the two amendments listed below: ;
1) time"limits on rezonings and
2)' age standards for planned c~unity developments
and set them for hearing either at the next regular meeting or the following
meeting.
After comments from Commissioner Crisp 'the Chairman further directed that any
other pending amendments such as.l) corridor lots 2) site area definitions
and 3) any others that might be in the proposal stage be consolidated into
this one public hearing. "'
VIII. COMMUNICATIONS
A. WRITTEN
1. UP-74 - Dr. Robert Wade, Souza Lane - RequeSt for Extension in connec-
tion with Use Permit for Convalescent Home

Chairman Norton extended a welcome to Councilman Larry Tyler and Mrs. Do~mald
French and Mr. Charles Smith of the Good Government Group and expressed
appreciation for coffee served at recess. He, also, welcomed Mr. Sam Hernandez
and complimented him on his consistent attendance and his interest on matters
of the Planning Commission and City Council
IX. ADJOURNMENT .'
