I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman'Nortonat 7:30 P. M.
A. ROLL CALL .'
Present: Commissioners Crisp, Johnson, Kasner, Kellum, ..
Norton and 0'Rorke.
Absent: Commissioner McFall.
B. MINH.TES
Commissioner Johnson moved, seconded by Commissioner Kasner,
that the reading of the minutes of 9 May 1966 be waived.and
that the minutes be approved as submitted to the Commission;
motion carried unanimously.
Chairman Norton extended a welcome to Mrs. Evelyn Voges,.
Recording Secretary for the Commission, who had just returned
from vacation, and expressed appreciation to Mrs. Joan Loher
of the Planning Department for her assistance.during Mrs.
Voges' absence.
II. PUBLIC H~RINGS
The Chairman declared public .hearings open for the evening at
7:34 P. M.
A. C-97 - Margot A. Arenchild, Fruitvale Avenue - Request for
Change of Zoning from "R-l-#O,OOO" (Single Family
Residential) to "R-1-40,OO0 P-C" (Single Family Resi-
dential Planned Community) - Continued from 9 May.1966
The public hearing on C-97 was not re-opened at this time
since nothing further had been added to the file and there
v~as no one present who wished to comment with regard to same.
Commissioner Kellmm suggested that this matter be continued
off the agenda until the second. meeting in June.
Chairman Norton'brought to the attention of the Commission
a recent suggestion that the public:be notified when a hearing
(continued for a period of time) was to be resumed, and raised
a question ~ith respect to possible ways to bring this to the
ppople's attention.
After discussion, the Chairman directed C-97 continued until
the meeting on 27 June 1966 and requested that the Secretary
notify the press that the hea~ing would be re-opened at that
time.
Chairman Norton then referred the matter of giving additional
notice (on items that have been continued on the.agenda for
some time) to the Subdivision Committee for study and a report
to the Commission at its convenience.

iI. B. UP-103 - Manuel Lozano, Prospect Road·- Request for Use Permit
for Automatic Conveyor System Car Wash with Gasoline
Sales - Continued from 9 May. 1966
The continued hearing on UP-103 was resumed at 7:39 P. M. The
Secretary advised that nothing further had been added to .the
file.
Frank Crist, Jr., representing the applicant, b~riefly reviewed
this proposal and stated that he felt the-subject location was
highly desirable for this purpose, both from the applicant's
viewpoint and that of the City.
There was.no one else present who wished to comment with regard
to this request for a Use Permit.
Com,,nissioner Kellum read the report of the Subdivision bommit-
tee relative to this matter, reconmending that UP-103 be held
in abeyance pending actual construction of such a facility un-
d er UP-97.
Mr. Crist discussed the report with the CommisSion and stated
l) from a planning standpoint, 1..Jr. Lozano's proposed location
was better than that of Mr. ~.Vestly 2) Mr. Lozano had proposed
a buffer between the car wash and the'adjacent property 3) Mr.

ifter further discussion, Comnissi0ner Crisp moved, seconded
by CoEissioner Johnson, that the public hearing on UP-103 be
closed; motion carried unanimously and the hearing was closed
at 7:45 P.M. :
Comissioner Kell~ moved, seconded by Commissioner Crisp,
that the report of the Subdivision Committee (dated 23 l,~y ...
1'966) relative to UP-103 be adopted and, in accordance with
same, that action on UP-103 be deferred until one year from.
the date of approval of UP-97; motion carried with Chairman
Norton casting a negative vote.
Commissioner Kellum advised l) there were indications that
construction 'of the car wash on the adjacent properrye(UP-97)
would begin i~.ediately or the proposal would be abandoned
completely within the next few we':.'~l~s.and 2) it 'was possible,
therefore, that the Commission mi~;ht be able to make a deci-
sion in much less than a year.
Chairman Norton stated l) 'he could not understand wh~ both
of the Use Permits (UP-97 and UP-103) should not be approved
2) the Commission had been aware of both applications·for
some time and 3) he could not force any harm to the com-
munity in granting both requests.(
~. UP-104 - james Davi, Souza Lane - Request for Use Permit for
Convalescent Hospital - Continued from 9 May 1966
The public hearing on UP-104 was not re-opened at this time
since there was nothing new in the file and no one present
who wished to speak with regard to same.
Chairman Norton directed this matter continued until the next
regular meeting.

it was moved by Commissioner Crisp and seconded by Commissioner
Johnson that the public hearing on V-273 be closed; motion car-
ried unanimously and the hearing was closed at 7:5'4 P. M.
Commissioner Crisp.moved, seconded by CoEissioner Johnson,
that the report of the Variance Cormittee (dated 23 i~y 1966)
relative to V-273, Michael E. hrcell, be adopted and that the
variance be granted subject to the conditions set forth therein;
motion carried unanimously.

in connection with Side Yard Setback Requirements -

The applicant was present but advised that he had no further.

Comnissioner Kasner read the report of the Variance Comittee
relative to this appliation, recomending disapproval of same.
Co~maissioner Crisp moved, seconded by Commissioner Kasner, that
the public hearing on V-277 be closed; motion carried .unanimous-
ly and the hearing was closed at 7:57 P. M.
It was moved by Commissioner Crisp and seconded by Cor~.issioner
Kasner that the Variance Comnittee Report of 23 May 1966 rela-
tive to V-277, Harry E. R. Carlson, be adopted and that the
variance be denied in accordance with same; motion carried
unanimously.
F. UP-lOS - Gary L. Xenzemer, Saratoga. Avenue - Request for Use
Permit for Horse
The .public hearing on UP-105 was opened at 7:58 P. M. The
Secretary advised that No~ices of Hearing had been mailed and
there were no written communications on file. He then briefly
reviewed the subject application.
The applicant was present and explained l) although the area
of his property exceeds the 40,000 square feet required for
the keeping of a horse, the lO0 foot width of the property
makes it impossible to meet the requirements for the Z[ocation
of a stable 2) the' property is bordered on three sides by
streets and the church parking lot is located directly ac~ss
the street from the proposed stable area and 3) in view of
this, he felt that the stable would-not be a nuisance. to
anyone.

II. F. UP-f05 - ~ary L. Menzemer
~er discussion, it was moved by Commissioner .0'Rorke and
seconded by Commissioner Kasner that action on UP-105 be
postponed pending application for a variance in coPmection
with location of the stable; motion carried unanimously.
After further explaining to the applicant the ~eed for ap-
plying for a variance prior to action on his request for a
Use Permit, Chairman Norton (8:05 P. M.) direc%ed UP-105
continued until the next regular meeting.
Commissioner Crisp, as Chairman of the Variance Committee,
advised P~. Menzemer that if his application was filed
'promptly the Committee would endeavor to make the on-site
inspection prior'to the date of hearing.
G. UP-10g - Dr. Marvin Rowe, San Marcus Road - Request for Use
Permit'for Horse
The public hearing on UP-lOg was opened at 8:06 P.,M. The
Secretary advised that Notices of Hearing had been mailed,
then read a letter filed by Mrs. James R. Hughes of San Mar-
cus Road protesting the granting 0f this Use Permit.
The applicant was present and after discussion requested
that UP-lOg be continued so that revised plans could be
filed, relocating the proposed stable to meet the require-"
merits of the Ordinance.
Mrs. Hughes was present and stated' that she had no objec-
tion to the granting of the subject Use Permit if the corral.
was relocated to meet Ordinance requirements.
At 8:09 P. M., Chairman Norton directed UP-106 continued
until the next regular meeting and referred same to the
Subdivision Committee for .study and a report.
The Chairman declared public hearings closed for the evening at.
8:10 P.M. '..
III. SUBDIVISIONS AND BUILDING SITES
A. SDR-630 - ~. Austin ~'lmore, Canyon View Drive - Building Site
A~roval - 1 Lot - Continued from 9..-May 1966
The Secretary advised that the applicant had filed a letter
granting a 30 day extension of time for action on his ten-
tative map and had requested .that SDR-630 be continued to
allow adequate time for preparation'of a site development
plan.
On the basis of the foregoing, Chairman Norton directed SDR-630
continued until the meeting on 13 June 1966.
B. SDR-632 ' Robert M. Leeper, Palomino Way - Building Site
Approval - 1 Lot - Continued from 9...~Y 1966
The applicant was present and after a brief discussion, ex-
pressed satisfaction with the proposed conditions of approval.
Commissioner Kellummoved, seconded by Commissioner Crisp,

III. B. SDR-6~2 - Robert M. Leeper
to SDR-632, Robert M. Leeper, be adopted and that the ·tenta-
tive map (F~xhlbit "A", filed 14 April 1966) be approved in
accordance with the site development plan' (Exhibit "B", filed
4 May 1966) ~subJect to the conditions set forth in said re-
port; motion carried bunanimously.
C. SDR-635 - Manuel Lozano, Prospect Road - Building Site Appro-
val - I Lot - Continued from 9 May 1966
Both ,Mr. Lozano and Mr. Crist had left the meeting after the
hearing on UP-103, so there was no one present to represent.
the applicant. The Secretary advised that Xr. Lozano had not
yet been made aware of the specific conditions proposed in
connection with this application.
After discussion, Chairman Norton directed SDR-635 continued
until the meeting on 13 June 1966, and requested tihat the
Secretary contact the applicant prior to that time'-'and in-
quire as to whether he would (in view of the lack of action
on the Use Permit) still like to have the subject building
site approved.
D. SDR-6~6 - Roman T. Chavez~ Canyon View Drive - Building Site
Approval - 1 Lot - Continued from 9 May 1966
The applicant was not present.
Tae Secretary advised that Mr. ChaVez had requested that
this matter be continued since he needed time to obtain a
soils report, but further advised that bunless a letter granting
an extension was filed by the applicant, time for action on'the
tentative map would expire prior to the next meeting.
After discussion, Commissi'o~er Crisp moved, seconded by Com-
missioner Kasner, that SDR-636 be denied unless an appro-
priate extension was received from the applicant prior to ex-
piration of time for action on the tentative ·map, in which
case the application would be continued until the next regular
meeting; motion carried unanimously.
E. SDR-638 - Walter E. Hileman, Peach Hill Road ~ Building Site
A~roval - i Lot
The Secretary advised that a site development plan was re-
quired in connection with the subject site and suggested that
SDR-638 be continued until the next regular meeting to allow
adequate time for preparation of same.
Chairman Norton so directed.
F. SD-63~ - Margot A. Arenchild, FrUitvale Avenue - Subdivision -
37 Lots
After reviewing the proposed conditions of approval, Jim
Kai ' '
set, applicant s engmneer, questioned the requirement for
standard R-36 curb and gutters on both sides of the interior
streets (Condition No. 11 ). Mr. Kaiser observed that 24 inch
rolled curbs had been proposed for one side of the interior
streets and that no decision had 'been reached during his
meeting with the Subdivision Committee.
After discussion, i~.lr. Kaiser agreed to accept the conditions
as proposed and file a request for reconsideration if the ap-
plicant so desired.

III. F. SD-639 - Margot A. Arenchild
Commiss.ioner.Kellummoved, seconded by Commissioner Crisp, that the
Subdivision Committee Report of 23 May 1966 relative to SD-639, Margot
A. Arenchild, be adopted and that the tentative map and site develop-
-ment plans (Exhibit "A-i", filed t9 May 1966) be approved subject to
the conditions set forth in said report; motion carried unanimously.
IV. DESIGN REVIEW
A. A-22Q - Roy M. Westly, Prospect Road - Final Design Review - Car Wash -
Continued from 9 May 1966
..................... Commissioner O'Rorke advised 1) the Committee had met with the appli-
cant to.review the new exhibit 2) both the 12-foot access and the
landscaped belt requested at the last meeting had been shown on this
exhibit with the exception of a small area of landscaping west of the
equipment area which the Committee felt would be satisfactory 3) the
fence along the rear property line would screen this operation from
the Church and 4) in view of the foregoing, it was the recommendation
of the Committee that final design approval be granted.
After discussion, Commissioner O'Rorke moved, seconded by Commissioner
Kasner, that final design approval be granted A-220 as shown on
Exhibit "A-2" subject to the condition that the fence along the Church
boundary be constructed so that it will completely screen the property;
motion carried unanimously.
B. A-221 - Blue Hills Market, Saratoga-Sunnyvale Road - Final Design Review -
Identification SiMns - Continued from 9 May 1966
Commissioner'O'Rorke advised that the Committee had found that both of'
the proposed signs met the requirements of the Ordinance and, in view
of this, approval was recommended.
It was moved by Commissioner O'Rorke and seconded by Commissioner Kellum
that final design.approval be.granted A-221 on the basis of Exhibits "A"
and "B"; motion carried unanimously.
C. A-22~ - Manuel Lozano, Prospect Road - Preliminary Design Review - Car
Wash - Continued from 9May 1966
Commissioner O'Rorke advised that it was the recommendation of the
Design Review Committee that action on A-222 be continued until the next
regular meeting pending action on the applicant's other applications-
Chairman Norton so directed.
D. A-223 - James K. Beadnell, Saratoga Avenue - Final Design Review - Iden-
tification Sign
On the basis of the recommendation of the Design Review Committee,
Chairman Norton directed A-223 continued until the next regular meeting
and requested that the Secretary contact the applicant and ask that he
submit more comprehensive drawings of the proposed sign.
E. A-184 - Mijo Corporation, Saratoga-Sunnyvale Road - Final Design Review -
Commercial BuildinM (Garage)
Commissioner O'Rorke advised 1) the Committee had reviewed the final
plans for this building 2) the.principle concern at the time of pre-
liminary design review had been screening which has noW been provided .
and 3) it was the recommendation of the Committee that final design
approval be granted.

IV. E. A-184 - Mi~o Corporation
After discussion, Commissioner 0'Rorke moved, seconded by Commissioner
Johnson, that final design approval be granted A-184, Mijo Corporation,
on the basis of Exhibits "A-I" and "A-2" with the understanding that
the details of Exhibit '~-2" prevail in.the event of conflict; motion
carried unanimously.
F. A-197 - Church of the Ascension, Prospect Road - Final Design Review -
Church Buildin~
Commissioner O'Rorke advised 1) the Committee had reviewed the final
plans filed in connection with A-197 2) only one building .(~7) will ·
be constructed at this time 3) while this building will eventually
accommodate 900, it will have a seating capacity of 500 at this time
4) 250 parking spaces will be provided now and a bond' will be posted
guaranteeing improvement of the additional 110 spaces 5) the appli-
cant understands that construction of additional buildings will neces-
sitate additional parking spaces (for which there is ample room) and
6) the Committee recommends that final design approval be granted.
After discussion, Commissioner O'Rorke moved, seconded by Commissioner
ICasner, that final design approval be granted A-197 as shown on Exhi-
bit "A-i" subject to the condition that 250 parking spaces are to be
improved prior to occupancy and a bond, amount of which is to be deter-
mined by the Director of Public Works, is to be posted guaranteeing
improvement of the remaining ll0 spaces; motion carried unanimously.
G. A-218 - Paul Flanagan, Big Basin Way - Final Design Review - Commercial
Buildin~
After discussion of the final plans for'the proposed commercial building,
Chairman Norton raised a question as to whether approval of these plans
would constitute a violation of the General Plan with respect to the by-
pass. The Secretary advised 1) this matter had been brought to the
.. attention of the City Council 2) the Council had requested that the
Staff meet with the Highway Department in connection with same 3) the
Highway Department had advised the City Administrator, Planning Director
and Director of Public Works that not even a study could be justified in
connection. with this by-pass route at present and that a projection of
current traffic information did not indicate that one would be warranted
in the foreseeable future and 4) even if the need for such a by-pass
materialized in the distant future, there was no way now to determine
the location or route of same.
'After discussion, Commissioner Crisp moved that final design approval
be granted A-218 subject to the condition that the applicant provide
suitable Off-street parking in compliance with the Ordinance, and that
the Council's attention be invited to'the fact that the proposed off-
street parking violates the General Plan.
Councilman Tyler advised 1) the applicant owns other property that
has a common boundary with the subject property 2) Mr. Flanagan has
already posted a bond and signed an agreement guaranteeing provision
'of parking in accord with the proposed Parking Assessment District or
as required by the Ordinance and 3) as he recalled, the by-pass had
been left in the General Plan only to give notice to the State that
Saratoga was thinking of a possible by-pass, somewhere, some day.
After further discussion, Commissioner Crisp withdrew his motion rela-
tive to A-218 and Chairman Norton directed same continued until the
next regular meeting with a request that the Secretary 1) obtain a
general policy statement from the City Council as to whether approval.

IV. G. A-218 - Paul Flana~an
of this application would violate the General Plan and 2) seek clari-
fication as to the degree of assurance at this time that the proposed
Parking District will be completed.
V. CITY COUNCIL REPORT
Commissioner Kellum, who artended the City Council Meeting on 18 May 1966
on behalf of the Co~-anission, reported briefly on discussion and action at
the meeting, 'with emphasis on items of particular interest to the
Commis s ion.

VII. OLD BUSINESS
A. C-80. - Clarence Neale, Saratoga-Sunnyvale Road - City Council Request
for Recommendation relative to Request for Additional Signs -
Continued from 9 May 1966
The Secretary advised that the 'committee' was not prepared to make a
recommendation at this time and had requested that same be 'continued
until the next regular meeting.
Chairman Norton so directed.
B. SDR-624 - LeRoy Hiatt, Saratoga-Los Gatos Road - Request for Exception
on Conditions of Site Approval·- Continued f~Dm 9 MaT 1966 .
Commissioner Kellum called attention to j the Building Site Committee
Report relative to SDR-624 which had been placed in the Commissioners'
folders.
After the Commission had read and discussed the subject report, Com-
missloner Kellum moved, seconded by Commissioner Kasner, that the
Building Site Committee Report of 23 May 1966 relative to SDR-624 be
approved and that, in accordance with the report, the Commission recom-
mend to the City Council that the applicant's request for exception in
connection with conditions of site approval be denied; motion carried
unanimously.
C. UP-74 - Dr. Robert Wade, Souza Lane - Request for Extension in connec-
tion with Use Permit for Convalescent Home - Continued2' from
9 May 1966
The Secretary suggested that this matter be continued until the next.
regular meeting in view of the lack of further developments in connec-
tion with UP-104.
Chairman Norton so directed.
D. Proposed Amendments to Ordinance NS-3
The Commission authorized the' Secretary to set a public hearing in
connection with the proposed amendments to Ordinance NS-3 for the
first possible meeting after the final draft of the proposed ordinance
had been completed.

1. SDR-572 - Fmns J. Zweig, Madtone Hill Road - Request for Extension
The Secretary read a· letter from Mr. Zweig requesting an extension
in connection with SDR-572.

VIII. A. 1. SDR-572 - Hans J. Zweig
After a brief discussion, Commissioner Kellum moved, seconded by
Commissioner Johnson, that the applicant's request for an exten-
sion in connection with SDR-572 be granted for a period of one (1)
year from the present date of expiration; motion carried unanimously.
2. SD-592 - Western Hills Investment Company, Mr. Eden Road - Request
for Exception on Conditions of Subdivision Approval
The Secretary read a letter filed by Robert G. McDermott, engineer,
requesting (on behalf of the applicant) financial assistance from
the adjoining benefiting property owners and the City of Saratoga.
in connection with compliance with Conditions 6 and 7 of the Condi-
tions of Approval established by the Commission under SD-592.
Mr. McDermott was not present to discuss this matter with the
Commis s ion.
After discussion, Chairman Norton referred this communication to
the Subdivision Committee for its consideration and directed same
continued until the next regular meeting.
Fir. McDermott arrived at this time and stated 1) the letter was
self-explanatory so no further comment was necessary at this time'
and 2) he would be happy to meet with the Committee to discuss
this matter at its convenience.
B. ORAL
Chairman Norton acknowledged, with pleasure, the presence of Councilman
Tyler and Mrs. Dorothy Parker of the' Good Government Group, and expres-
sed appreciation for the coffee served by Mrs. Parker at recess.
