CITY OF SARATOGA PLANNING COMMISSION
TIME: Monday, 8 August 1966, 7:30 P. M.
PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California
TYPE: Regular Meeting
I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:30 P. M.

Present: Commissioners Crisp, Kasner, Kellum, Norton and O'Rorke.
Absent: Commissioners Johnson and McFall.
B. MINUTES
Commissioner Kellum moved, seconded by Commissioner O'Rorke, that
the reading o~ the minutes of 25 July 1966 be waived and that the
minutes be approved as distributed to the Commission; motion car-
ried unanimously.
C. LEAVE OF ABSENCE - Commissioner McFall
Chairman Norton read a letter from Commissioner McFall advising
1) he had been detained in London by the seaman's strike 2) he was
now scheduled to return about. the 15th of September and 3) .he hoped
his leave could conveniently be extended until that time.
The Commission agreed that Commissioner McFall need not be concerned,
that his leave would be extended to cover the time he' needed.
D, COMMITTEES .....
Chairman Norton extended a welcome to Commissioner Kasner who had
just returned from vacation, and requested that he relieve Commis-
sioner Johnson (who had covered for him while he was away) on the
Variance and Design Review Committees.
Chairman Norton advised that he would continue to fill-in for Com-
missioner Johnson on the Subdivision and Building Site Committee un-
til September (when school begins).

II. PUBLIC HEARINGS
A. UP-111 - Church of Jesus Christ of Latter Day Saints, Allendale Ave-
nue - Request for Use Permit for Church - Continued from
25 July 1966
The continued hearing on UP-111 was re-opened at 7:37 P. M. The Se-
cretary briefly reviewed this application and advised that nothing
further had been added to the file.
Bishop Nelson was present to represent the Church, but stated that he
had no further comment at this time.
Mr. A. L. Hanson of Dolphin Drive (corner of Allendale Avenue) ob-
served that the church parking lot, as proposed, would be located
across the street from 'his home and questioned the adequacy of the
required 5-foot landscaped strip. After discussion, Chairm~n Norton
requested that the Secretary advise Mr. Hanson when complete plans
had been filed with the City so that he could review same.

II. A~ UP-111 - Church of Jesus Christ of Latter Day Saints
The Secretary read a Staff Report pertaining to this application,
recommending that the Use Permit be granted subject to certain con-
ditions.
After discussion, Commissioner Crisp moved, seconded by Commissioner
Kasner, that the public hearing on UP-ill be closed; motion carried
unanimously and the hearing was closed at 7:47 P.. M.
Commissioner Crisp moved, seconded by Commissioner O'Rorke, that the
Staff Report,.of 8 August 1966 relative to UP-111!'be approved and
that the Use!Permit be granted subject to the conditions set forth
in said report and the additional condition that the coverage not
exceed that permitted in R-1 zones under Ordinance NS-3; motion car-
ried unanimously.
B. V-280 - Bell-Scott Developers, Bank Mill Road - Request for Variance
in connection with Front Yard Setback Requirement - Continued
from 25 July 1966
The Secretary read a letter from RayMathis of Bell-Scott Developers
requesting that this application (V-280) be withdrawn.
Commissioner O'Rorke moved, seconded by Commissioner Kellum, that
applicant's request for withdrawal of V-280 be granted; motion car-
ried 'unanimously.
C. V-281 ~ Robert L. Lavender, Gemell Court - Request for Variance in
connection with Rear Yard Setback Requirement - Continued
from 25 July 1966
The continued hearing on V-281 was re-opened at 7:50 P. M. The Secre-
tary briefly reviewed this application and advised that nothing fur-
ther had been added to the file.
The applicant was present but stated.that he had no further comment
at this time.
There was no one else in the audience who wished to comment with re-
gard to this matter.
Commissioner Crisp read the report of the Variance Committee relative
to V-281, recommending approval of same.
After discussion, Commissioner Kellummoved, seconded by Commissioner
Crisp, that the hearing on V-281 be closed; motion carried unanimously
and the hearing was closed at 7:53 P. M.
It was moved by Commissioner Crisp and seconded by Commissioner Kellum
that the Variance Committee Report of 8 August 1966 relative to V-28!,
Robert L. Lavender, be approved and that the Variance be granted .in
accordance with said report; motion carried unanimously.
D. V-282 - Saratoga Foothills Development Corporation, Upper Hill Drive
Request for Variance in connection with Rear.Yard Setback
~equirement for Lot 66 of Tract 3101
The public hearing on V-282 was opened at 7:55 P. M. The Secretary
advised that Notices of Hearing had been mailed and there'were no
written communications on file. He then briefly reviewed this appli-
cation and explained that the additional request for relief from the
slope easement would have to be decided by the City Council.
Burney Turgeon of the Saratoga Foothills D~Velopment Corporation was
present to discuss this request.with the Commission and advised

II. D. V-282 - Saratoga Foothills Development Corporatioh
1) the existing slope easement is in the wrong lodation and extends
deep into the lot 2) because of the unusual shap~ of the lot, the
50-foot rear yard setback cuts deep into the lot and 3) the proposed
retaining wall will eliminate the drainage problem (previously called
to the City's attention) on this street.
George Phillips, owner of the lot, observed 1) if the variance was
granted, a single story home could be fitted onto the site and 2)
'without a variance, it would be necessary to use a hi-level or tri-
level plan'in order to build a house of adequate size.
Mr. Finn of Saratoga Properties. advised 1) previous attempts to
design a house for this property had not been successful and 2) he
felt that a variance would been needed in order to construct a quality
home on-.this site.
After further discussion, Chairman Norton (8:06 P. M.) directed V-282
continued until the meeting on 22 August 1966 and referred same to the
Variance Committee for study and a report at that time.
Commissioner Crisp, Chairman of the Variance Committee, made an ap-
pointment for Mr. Turgeon to meet the Variance Committee for an on-
site inspection at.9:00 A. M. on Saturday, 13 August 1966.
III. SUBDIVISIONS AND BUILDING SITES
A. .SDR-630 - W. Austin Elmre, Canyon View Drive - Building Site Approval -
1 Lot - Continued from 25 July 1966
The applicant was present and advised that the requested plans would
be filed with the Planning Department within the next ten days. He also
submitted a le%ter granting,a 14 day extension of the time for action on
the tentative map.
· In view of the foregoing, Chairman Norton directed SDR-630 continued
until the next regular meeting.
B. ~DR-636 - Roman T. Chavez, Canyon View Drive - Building Site Approval -
1 Lot - Continued from 25 July 1966
The Secretary advised 1) he had informed the applicant of the Commis-
sion's recently adopted policy to remove from the agenda all applica-
tiom that were not pursued with due diligence and 2) he had heard
nothing more from Mr. Chavez since that time.
After discussion, Commissioner Xellummoved, seconded by Commissioner
Rasher, that SDR-636, Roman T. Chavez, be denied. since the site
development plan had not been filed and the time for action on the
tentative map would expire prior to the next regular meeting; motion
carried unanimously.
C. SDR-646 - Samuel E. Pace, Saratoga-Los Gatos Road - Building Site
Approval - 1 Lot - Continued from 25 July 1966
The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Kellummoved, seconded by Commissioner O'Rorke, that the
Building Site Committee Report of 8 August 1966 relative to SDR-646,
Samuel E. Pace, be adopted and that the tentative map (Exhibit '~",
filed 29 June 1966) be approved subject to the conditions set forth
in said report; motion carried unanimously.

III. Di SDR-648 - Dr. Colin Beaton, E1 Camino Grande - B~ilding Site Approval -
l'Lot - Continued from 25 July 1966
Mr. Shebs, present to represent the applicant, expressed appreciation
to the Building Site Committee for the time spene in reviewing this
matter, and accepted the proposed conditions of ~pproval.
Commissioner Kellummoved, seconded by Commissione=iCrisp, that the
Building Site. Committee Report of 8 August 1966 relative to SDR~'648,
Dr. Colin Beaton~ be adopted and that the tentative'.'map (Exhibit "A",
filed 15 Ju~y 1966) be approved subject to the c~nditions set forth'
in said report; motion carried unanimously.
E. SDR-650 - Charles Harden, Sobey Road - Building. Site Approval - 2 Lots

The Secretar~ advised that the Health Departmen~..'had approved only one
septic tank on this property, and recommended that SDR-650 be continued
until the next regular meeting to allow adequate time for the applicant
to confer with the Health Department regarding same.
Chairman Norton so directed.
F. ~ - Bernard Alter, Glen Una Drive - Building Site Approval - 1 Lot=
The applicant was not present but the Secretary advised that this was
only a renewal of a previous application and the applicant was aware
of the conditions.
Commissioner Kellummoved, seconded by Commissio.ner O'Rorke, that the
Building Site. Committee Report of 8 August 1966 relative to SDR-651,
Bernard Alter, be adopted and that the tentative map (Exhibit
filed 28 July 1966) be approved subject to the conditions set forth
in said report; motion carried unanimously.
G. SDR-652 - L. G. Tenbrummelers Montalvo Road - Building Site Approval - 3 Lots
The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Kellummoved, seconded by Commissioner Crisp, that the
Building Site Committee Report of 8 August 1966 relative to SDR-652,
L. G. Tenbr~u~eler, be adopted and that the tentative map (Exhibit "A",
filed 29 July 1966) be approved subject to the conditions set forth-
in said report; motion carried unanimously.
H. SD-653 - C & I Development Company, Prospect Road - Subdivision - 60 Lots
The applicant's engineer (of MacKay & Somps) was present and, after
discussions expressed satisfaction with the..proposed conditions of
approval.
Commissioner Kellummoved, seconded by Commissioner O'Rorke, that the
Subdivision Committee Report of 8 August 1966 relative to SD-653s
C & I Development Company, be adopted and that the tentative map (Ex-
hibit "A", filed 29 July 1966) be approved subject to the conditions
set forth in said report; motion carried unanimously.
Commissioner O'Rorke suggested that it would benefit the developer
as well as the home owners if the pathway along Prospect Road was
completed prior to occupancy of the homes.

IV. DESIGN REVIEW
A. A-222 - Manuel Lozano, Prospect Road - Preliminary Design Review -
Car Wash - Continued f~om 25 July 1966
Commissioner O'Rorke advised i) the revised plans had not yet been
submitted 2) no further information had been received from the ap-
plicant and .3) it was the recommendation of the Design Review Com-
mittee that this matter be continued.
The Secretary advised that the Sheriff's Department had submitted
an oral report relative to the access to this site advising 1)
the access, as proposed, would be very hazardou~ and 2) if the
ingres~ and egress were reversed, however, the access would be
satisfactory!'
After further discussion, Chairman Norton directed A-222 continued
until the meeting on 22 August 1966 and requested that the Secre-~
tary 1) contact the applicant and inform him that due diligence
was required in completing this application 2) obtain a written
report from the Sherifles Department relative to the access and
3) transmit a copy of-the report from the Sheriff's Department to
the applicant.
B. A-22.6 - Dr. John Oliver, Saratoga-Sunnyvale Road - Preliminary
Design Review - Commercial Building - Continued from
25 Ju~y 1966
Commissioner O'Rorke advised that after reviewing the revised plans
and discussing the matter with the applicant, it was the consensus
of the Committee that the coverage was too great, that this was re-
flected in both the parking and the access, but other than this, the
plans appeared satisfactory.
Commissioner Crisp observed .1) approximately 2/3 of the subject
building was indicated as storage 2) this constituted warehouse use
3) "warehouse" is not a permitted use in the Con~nercial Service Zone
and. 4) in view of this,.he felt there was no. way the Commission..
could approve these plans.
Dr. Oliver was present to discuss this application with the Commis-
sion and advised 1) many of the uses in the existing building
utilize most of their space for storage 2) it was anticipated, there-
fore, that the additional uses would need large storage areas and 3)
all of the area indicated as storage was proposed in conjunction with
permitted uses.
After further discussion, Chairman Norton advised Dr. Oliver that it
seemed to be the general consensus of the Commission that a narrower
building was needed for the site. Dr. Oliver then discussed with the
Commission the possibility of taking the footage off the rear of the
building instead of reducing the width. I1~e Commission agreed to per-
mit him. to work it out to his best advantage, so long as the size of
the building was reduced by 1,000 square feet.
With reference to the parking, the Secretary reminded the Commission
that the Business License now required for each of the occupants of
the building would give the City continuing control over the parking.
Commissioner O'Rorke moved, seconded by Commissioner Kasner, that
preliminary design approval be granted A-226 subject to 1) a writ-
ten agreement granting a perpetural 5-foot wide easement along the
southerly property line (235 feet) 2) not less than 37 parking spaces
and 3) the building being reduced in size by 1,000 square feet (from
8,500 square feet to 7,500 square feet); m6tion carried with Commis-
sioner Crisp abstaining.

V. CITY COUNCIL REPORT
The Chairman explained that the last City Council meeting had been post-
poned so there would be no report at this time.
VI, brEW BUSINESS
VII, OLD BUSINESS .
The Secretary advised that at the meeting on 22 Augu4t he hoped to pre-
sent a draft of the proposed ordinance relative to the keeping of horses,
as well as more information on the Capital Improvement Program.
VIII, CO~E4UNICATIONS
A, WRITTEN
1. UP-87 - University Pre-School of Saratoga, Big Basin Way - Request for Renewal of Use Permit
The Secretary read a communication from Mrs. Stinnett requesting
renewal of her Use Permit to operate the University Pre-School of
Saratoga.
Mrs. Stinnett was present to discuss this request with the Commis-
sion. '
It was decided that an informal hearing should be held in connec-
tion with this matter, so Chairman Norton 1) directed UP-87 con-
tinued until the next regular meeting 2) asked the Secretary to
notify the press of the informal hearing to be held at that time
and 3) requested that the Subdivision Committee review this Use
Permit prior to that time.
2. C-80 ·- Clarence Neale, Saratoga.-Sunnyvale Road - Request for Addi-
tional Use under Conditional Zoning and Additional Building
on P.rope. rty
The Secretary advised of the applicant's request that "Dental
Office" be approved as an additional use under his conditional
zoning ·and that he be permitted to move the Saddle Shop building
from its former location onto the· subject property.
Mr. Neale was· present to discuss this request with the Commission
and advised· 1) the building is 16 x 28 feet and in good condition
2) he hopes to acquire the property between his site and the high-
way through a trade with Flood Control and 3) the additional use
is needed for additional income from the property and "Dental
Office". is one acceptable possibility.
After discussion Chairman Norton 1) directed C-80 continued until
the next regular meeting 2) requested that the Secretary set an
informal hearing for that time 3) referred Mr. Neale's request to
the Subdivision Committee for study and a report 4) asked that
the Design Review Committee inspect the site for the purpose of
determining possible locations for the building, further landscaping
and additional parking and 5) suggested that the applicant submit
a proposal to· the Committees for their review.
B, ORAL
1. Commercial Service Zone Study
For the benefit of Commissioners Kasner and O'Rorke who had not
artended the meetings with representatfves of Riches Research, Inc.,
Chairman Norton reviewed the results of the study conducted by this
firm in connection with the Commercial Service Zoning District.
He also explained that the Planning Commission recommendation (ap-
proximately a year ·ago) that additional uses be considered for this

Chairman Nor=on acknowledged, with pleasure, the presence 'of Mrs.
Owen and Mr. Lewis of the Good Government Group and expressed

.. evening~ He also observed that Councilman Hartman had been pre-
sent for =he earlier part of the meeting andsexpressed the Com-
