Absent: Commissioners Johnson, Kasner, and Kellum.
B. MINUTES '-
Commissioner McFall moved, seconded by Commissioner Crisp, that the
reading of the minutes of 14 February 1967 be waived and that. the
minutes be approved as distributed to the Commission; motion carried
unanimous ly.
1I. PUBLIC HEARINGS
A. UP-120 - Sisters of Notre Dame de Namur, Norton Road - Request for
Use Permit for Construction of new Novitiate Facilities -
Continued from 23 January 1967
The continued hearing on'UP-120 was resumed at 7:37 P.M. The Secretary
briefly reviewed this matter and'read a communication from C. P. Alba-
nese favoring the granting of this Us~ Permit.
Commissioner McFall advised that the Subdivision Committee had met with
the applicant's, architect, Mr. Hollis Logue, and he had requested a
continuance to provide time to work out satisfactory solutions with
regard to 1) traffic,. 2) Bohlman Road improvements, and 3) emergency
access.
After discussion, Chairman Norton (7:42 P.M.) directed UP-120 continued
to the next regular meeting and referred same to the Subdivision Com-
mittee for study.
B. V-288 - Brown and Kauffmann, Inc., Ingrid Court -'Request for Variance
in connection with Rear Yard Setback Requirement - Continued
from 23 January 1967
At the request 'of Commissioner Crisp, Chairman Norton directed this
matter continued to some time after 9:00 P.M. when Commissioner Johnson
(another member of the Variance Committee) was scheduled to arrive.
C. V-289 - R.'L. Maahs & Dr. R. D. Young, Saratoga-Sunnyvale Road - Request
for Variance in connection with Minimum Lot Size
The public hearing on V-289 was opened' at 7:45 P.M. The Secretary
1) briefly reviewed this file, 2) advised that Notices of.Hearing had
been mailed, and'3).read a communication from Calson Properties, lnc.,
signed by Mr. Ronald K. Lindsay, stating their objections to the granting
of this Variance.

II. C. Dr. Young was present and stated 1) that the activities involved in the
operation of this Pet Hospital would all be inside and the building
would be sound-proofed and odor-proofed, 2) that the 40,000 square feet
required in this zone would be too much· property for this type of
activity, and 3) it is very expensive to buy 20,000 square feet of extra
property. --'
Dr. Oliver and his attorney, Mr. John Hayes, Jr., were present to voice
their objections to this Variance and stated this seemed to be more of
an application for re-zoning.
Mr. & ~rs. Gordon Knight of Saratoga Manor were present and stated
1) they did not feel that granting a Variance for 20,000 square feet
would compliment the appearance of this area, and 2) they were con-
cerned about the·noise and odor involved in a clinic of this sort.
Mr. Warren Heid, app!icant's architect, was present and advised that
1) if the Variance were granted, 150 feet of frontage would be provided
............. L. instead of the required 100 feet, 2) the coverage would·be 9%, 3) since
the lot is triangular in shape it seems a very natural use for the prop-
erty, and 4) a large piece of property with a small building and abun-
dant landscaping would be more attractive.
Mr. B. T. Galeb, Sea Gull Way, was present and stated he had no objection
but was very interested in seeing the area developed in a proper manner.
Chairman Norton at this time complimented Mr. Caleb on the fine work he
was doing on his property.
After discussion, Chairman Norton (at 8:00 P.M.) directed V-289 con-
tinued until the meeting on 27 February 1967 and referred same to the
Variance Committee for study and. a report.
Commissioner Crisp, on behalf of the Variance Committee, made an appoint-
ment with the applicant for an on-site inspection at 9:0·0 A.M., Saturday,
18 February 1967.
D. C-102 - George Oldham, Saratoga Avenue and Saratoga-Sunnyvale. Road -
Request for Change of Zoning from "P-A" (Professional-Administrative)
to "C-C" (Community-Commercial)
The public hearing on C-102 was opened at 8:01 P.M. The Secretary advised
that 'a Notice of Hearing had been published and briefly reviewed the
subject request.
Mr. Oldham and his representative, Mr. Edward Henshaw, were present.and
stated 1) the property had previously been used for a gas station and
various other things including a Christmas tree lot, and 2) that it would
be a station with modern facilities but the building would be compatible
with the local architectural design of the Village..
Mr. Richard Green, representative for Union Oil Stations, was present and
advised that'l) grading would be necessary to establish ingress and
egress, and 2) that letters had been received from stockholders of the
company seeking the reason for the absence'of a Union Oil Station in this
area.
Mr. Clarence Neale of Neale's Hollowiwas present and spoke in favor of
this proposed.Change of Zoning.

II. D. Chairman Norton then (8:20 P.M.) directed C-102 continued until the
meeting on 27 February 1967 and .referred same to the Subdivision Com-,
mittee for study. .-
E. C-10~ - Saratoga Foothills Development Corporation, Cox Avenue -
Request for Change of Zoning from "A" (Agricultural) to
"R-l-12. a500" (Single Family Residential>
The public hearing on C-103 was opened at 8:21 P.M. The Secretary ad-
vised that a Notice of Hearing had been published and then read a state-
ment of reason submitted by Mr..Splitstone (engineer for the applicant).
There was no one present who wished to speak with regard to this matter.
Chairman Norton (8:23 P.M.) directed C-103 continued to the next regular
meeting and referred same to the Subdivision Committee for study.
F. UP-121 - West Valley Baptist Church, Fruitvale & Allendale Avenues -
Request for Use Permit for Church
The public hearing on UP-121 was opened at 8:24 P.M. The Secretary
briefly reviewed this application and advised that Notice of Hearing had
been mailed.
Pastor Warnock was present and stated that the reason for this applica-
tion for a second Use Permit is that through an oversight the old one
had expired.
The Secretary read the Staff Report pertaining to this matter, recom-
"mending that the Use Permit be granted subject to the conditions stated
in the'Staff Report dated 14 February 1967.
After discussion, Con~nissioner Crisp moved, seconded by Commissioner
McFall, that the public hearing on UP-121 be closed; motion carried
unanimously and the hearing was closed at 8:30 P.M.
Commissioner McFall moved, seconded by Commissioner Crisp, that the
............ Staff Report of 14 February 1967 relative to UP-121 be approved and ·
that the Use Permit be granted subject to the conditions set forth in
said report; motion carried unanimously.
G. UP-122 - Prospect High School,. Prospect Avenue - Request for Use Permit
for School Buildin~
The public hearing on UP-122 was opened at 8:32 P.M. The Secretary
briefly reviewed th'is application and advised that the Notices of
Hearing had been mailed.
Mr. Russell, Assistant Superintendent of Campbell Union High SChool,
was present and stated that 1) plans had been submitted for review,
2) automobile traffic would consist of about 150 automobiles per day,
and 3) Saratoga Creek Drive would not be extended (in answer to an
inquiry from Mr. Rod Fagen and Mr. Netset, residents of the area).
Mr. Bruce Nicol was present and.inquired what the plans included with
regard to eliminating the noise resulting from the various activities
involved in the operation of a high school.
Representatives of the Campbell Union High School explained that all
efforts would be made to keep the noise at a minimum by locating the
areas where most of the activities will take place in a position where
they will not interfere with the people in the neighborhood.

II."' G."'The Secretary read a Staff Report recommending approval of UP-122
subject to conditions listed in said report.
· After discussion, CommiSsioner Crisp moved, seconded by Commissioner
McFall, that the public hearing on UP-122 be closed; motion carried
unanimously and the hearing was closed at 8:47 P.M.
Commissioner McFall moved, seconded by Commissioner Crisp, that the
Staff Report of 14 February 1967 relative to UP-122 be approved and
that the Use Permit be granted subject to the conditions set forth in
said report; motion carried unanimously.
H. UP-100 - Youth Center, Fruitvale Avenue - Request for Use Permit for
Youth Center Buildin~ on the Civic Center Site
The public hearing on UP-100 was'opened at 8:50 P.M. The Secretary
advised that new Notices of Hearing had been mailed and briefly
reviewed this application.
'Mr. Warren Held was present to represent the Youth Center and to
answer any questions the Commission might want to ask.
Mr. Kerwin was present to represent the Kerwin Ranch located near the
proposed Youth Center site and stated that he was not opposed to the
Youth Center but feels that the area is becoming over-crowded with
churches, schools, and other such facilities making it difficult for
the Kerwin Ranch to operate.
After discussion, Chairman Norton (8:59 P.M.) directed this matter
continued until the next regular meeting and referred same to the
Subdivision Committee for study and a report at that time.
Chairman Norton directed that. the minutes show that Commissioner Johnson came
in at this time (8:55 P.M.).
I. C-l~l - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning
from "A" (Agricultural) to '~-M-4,000 P-C" (Multi-Family Planned
Community> - Continued from 9 January 1967
The public hearing on C-101 was not re-opened at this time since the
applicant stated the development plans were not ready for discussion
at this time.
In view of the foregoing, Chairman Norton directed C-101 continued
until the next regular meeting and referred same to the Subdivision
Committee for consideration.
B. V-2.8~ - Brown and huffmann, Inc., lngrid Court - Request for Variance
in connection with Rear Yard Setback Requirement - Continued
from 23 January 1967
The continued hearing on V-288 was reopened at 9:06 P.M. The Secretary
briefly reviewed'this application and advised that nothing. further had
been added to the file.
There was no one present who wished to comment further with regard to
this matter.
Commissioner Crisp read the report of the Variance Committee relative
to this request, recommending denial of same.

II. B. It was moved by Commissioner Johnson and seconded by Commissioner
McFall that the'public hearing on V-288 be closed; motion carried
unanimously and the hea[ing was closed at 9:13 P.M.
Commissioner Crisp moved, seconded by Commissioner Johnson, tha't
the Variance Committee Report of 14 February 1967 relative to V-288
be approved and that, accordingly, the request for variance be denied
since the findings required by Section 17.6 of Ordinance NS-3 could
not be made; motion carried unanimously.
RECESS AND 'RECONVENE ,
III. BUILDING SITES AND SUBDIVISIONS
A. SDR-669 - Frank Pringle, Canyon View Drive - Building Site Approval - 1 Lot - Continued from 23 January 1967
Commissioner McFall advised that additional time had been requested by
both the Director of Public Works and the applicant and suggested that
this matter be continued until the next regular meeting.
Chairman Norton so directed.
B. SDR-670 - Douglas .Hines, Sobey Road - Buildins Site Approval - 1 Lot
The applicant was present and 1) questioned conditions II-A and II-J
and 2) requested that SDR-670 be continued until the next regular
meeting to allow time to discuss these same conditions with the Director
of Public Works.

C. SDR-671 - Richard L. Allen, Pierce Road - BuildinM Site Approval - 1 Lot
The applicant was present and 1) protested Condition II-G of the proposed
conditions of approval, 2) explained that this would be a costly stipu-
lation, and 3) requested this matter be continued to the next regular
meeting to permit time to resolve this matter with the Director of Public
Works.
In view of the foregoing, Chairman Norton directed this matter continued
to the next regular meeting.
D. SD-672 - Saratoga Foothills Development Corporation, Cox and Cumberland
Subdivision - 41 Lots - Continued from 14 February 1967
Commissioner McFall advised that the applicant has submitted further
plans· and suggested this matter be continued to the next regular meeting
to allow the Committee time to give these plans proper consideration.
E. SDR-673 - Church of Jesus Christ of Latter Day Saints, Allendale Avenue -
BuildinM Site Kpproval - 1 Lot
Mr'. Bernard Dove was present to represent the church and 1) asked for
clarification of Conditions II-C and II-H,.and 2) stated that they plan
to put a fence along the private driveway near the church property.
Commissioner McFall moved, seconded by Commissioner Johnson, that the
Building Site Committee Report of 14 February 1967 relative to SDR-673
be adopted and that the tentative map (Exhibit "A" filed 3 February 1967)
be approved subject to the conditions set forth in said report; motion
carried unanimously.

III. F. SDR-674 - West V~lley Baptist Church, Allendale & Fruitvale Avenues -
Buildin~ Site Approval - 1 Lot
Commissioner McFall advised that the Building Site Committee Report had
not been completed because the Director of Public Works required more
time to. Check the street improvements relative to the matter.
In view of the foregoing, ~hairman Norton directed SDR-674 continued
.until the meeting on 27 February. 1967.
G. SDR-675 - Campbell Union High School District, Prospect Avenue - Buil~in~ Site Approval - 1 Lot
Commissioner McFall stated the conditions of approval had not been
prepared since the Subdivision Committee needed more time to study the
plans and the Director of Public Works had requested a continuance to
the next regular meeting..
Chairman Norton so directed.
IV. DESIGN REVIEW
A. A-238 - Youth Center, Fruitvale Avenue - Preliminary Design Review -
Youth Center Buildin~ - Continued'from 23 January 1967'
After brief discussion, Commissioner McFall moved, seconded by Commis-
sioner O'Rorke, the Preliminary Design Approval be granted in connection
with A-238, Youth Center, for the Youth Center Building as shown on
" Exhibit "A" and subject to the conditions listed in the Staff Report
of;~14 February 1967; motion carried unanimously.
B. A-239 - Paul Masson, Inc., Saratoga Avenue - Final Design R~view -
Warehouse
Commissioner McFall briefly reviewed this application and, after discus-
sion, moved that .Final Design Approval be granted A-239 as shown on
Exhibit "A" and "B" subject to the conditions stated in the Staff Report
of 14 February 1967 with the following additional condition:
"Landscaping must be underway prior to issuance of a
Building Permit."
Motion carried unanimously.
C. A-240 - Sam Hernandez, Big Basin Way - Final Design Review - Addition
to Laurel Motor Court
Commissioner McFall briefly reviewed this application and, after discus-
sion, moved, seconded by CommisSioner O'Rorke, that Final Design Approval
be granted A-240 as shown on Exhibit "A" subject to the conditions 'stated
in the Staff Report of 14 February 1967; motion carried unanimously.
D. A-24~ - Prospect High School, Prospect Avenue - Final Design Review -
High School Buildin~
Commissioner McFall advised that approval.of SDR-675 (Campbell'Union
High School District) was still pending; therefore recommended that this
matter be.continued to the next regular meeting.
Chairman Norton'so directed.

V. CITY COUNCIL REPORT
Commissioner Crisp gave a brief report on discussion and action at the City
· Council meeting on 1 February 1967 with emphasis on items of particular
interest to the Commission.
VIi NEW BUSINESS
FinneMan Construction Co., Inc. - Encroachment Permit for Signs on City of
Sarato.ga Street Signs at Via Monte & Glen
Brae/Via Escuela & Ten Oaks Way
The Secretary briefly reviewed this application and then read the Staff
Report of 14 February 1967 recommending that the Encroachment Permit appli-
cation be granted for a period not· tO exceed six (6) months from date of
app 1 i ca t ion.
Commissioner Crisp moved, seconded by Commissioner McFal·l, that the Staff
Report of 14 February 1967 be approved and the Encroachment Permit be
granted 'for the time stated in said report; motion carried unanimously.
VII. OLD BUSINESS
E. H. Renzel, quito Park Business Center - Request for Home Decoration and
Repair Supply Shop
The Secretary briefly reviewed this matter and then read the Staff Report of
14 February 1967 recommending denial of this request.
Commissioner Johnson moved, seconded by Commissioner McFall, that the Staff
Report of 14 February 1967 be approved and that subject request be denied;
motion carried unanimously.
Kosich Property Proposal
Commissioner McFall gave a report on the Kosich property and stated they had
submitted an informal preliminary plan and. asked that Chairman Norton refer
this to the Subdivision Committee for study.
Chairman Norton so directed.
VIII, COMMUNICATIONS
A. WRITTEN

The Secretary recommended this matter be continued to the next regular
meeting and referred to the Subdivision Committee for study.

B. ORAL
The Chairman acknowledged, with pleasure, .the presence of Mrs. Ruth
Owens of the Good Government Group and expressed appreciation for the
coffee served by Mrs. Owens at recess.
