I. ROUTINE ORGANIZATION
A. ROLL CALL
Present:Commissioners Crisp, Johnson, Kasner, McFall., Norton, O'Rorke
and Smith.·
Absent: None.
B. MINUTES
Commissioner McFall moved,'seconded by Commissioner Johnson, that the reading
of the minutes of 13 March 1967 be waived·and that the minutes be approved
subject to the following change:
page 14. .paragraph 4. .line 2.. .delete:
"Mesdames Owen and Sims"
and insert:
"Mrs. Owen and Mr. Sims"
motion carried unanimously.
C. NEW COMMISSIONER
Chairman Norton introduced and extended a welcome to newly appointed Commissioner
Charles H. Smith. He observed that Mr. Smith, a retired professional engineer,
was a long time resident of Saratoga and it was fortunate for the City as well
as the Planning Commission that the City Council appointed him.
D. COMM!SSIO~R KELLUM
Chairman Norton read a rough draft of a letter, written on behalf of the Planning
Commission to Commissioner Kellum, expressing appreciation for services rendered
and observing that he would be missed by all.
After discussion, Chairman Norton, with concurrence of the Planning Commission,'
directed' the Secretary to type the letter in final form for .signature by the
Chairman.
II. PUBLIC HEARINGS
A. UP-120 - Sisters of Notre Dame de Namur, Norton Road - Request for Use Permit
for Construction of New Novitiate Facilities - Continued from 13 March
1967
The continued hearing On UP-120 ~ms not re-opened at this time since·nothing
further had been added to the file and there was no one present who wished to
comment with regard to same.

Conmissioner McFall stated that 1) the Subdivision Committee had met on two
(2) different occasions with the applicant'.s representative, Mr. Hollis Logue,
the Planning Committee of the City Council, and the Director of Public Works
to discuss alternate cost estimates for the improvement of Bohlman Road and
2) he would like to request that this matter be 'continued to the next regular
meeting.
Chairman Norton so directed.
B. UP-125 - Donald McConnell, ProspeCt Road - Request for'use Permit for Car ~sh with Gasoline Sales - Continued from 13 March 1967
The continued hearing on UP-125 was resumed at 7:37 P.M. The Secretary briefly
reviewed this application and advised that a letter had been submitted by the
owners of the Subject property stating that the Lozano Use Permit was now void
since the property has been leased to Mr. D. H~ McConnell.
The applicant was present but stated he had no further comments at this time.
There was no one else present who wished to speak with regard to this matter.
The Secretary ~ead the Staff Report relative to this matter, recommending
approval of this=application subject to the conditions stated in said report.
After discussion, Commissioner McFall moved, seconded by Commissioner Crisp,
that the public h~aring on UP-125 be closed; motion carried unanimously and
the hearing was closed at'7:37 P.M.
It ~s moved by Con~nissioner McFall and seconded by Commissioner Smith, that
the Staff Report of 27 March 1967 relative to UP-125, Donald MuConnell, be.
approved and that the Use permit be granted subject to conditions listed in
report; motion carried unanimously..
C.' UP-126 - Brown & Kauffmann, Inc., Ingrid Court and Eric Drive - Request for
Use Permit for Model Home Sales Office - Continued from 13 March 1967'
The continued hearing on UP-126 w-as.re-opened at 7:42 P.M. The Secretary briefly
reviewed this application and stated there was nothing new in the file.
Bill Driscoll, present to represent the applicant, stated! 1) it was difficuit
to sell the homes in this particular. unit since it was quite a distance from
any main thoroughfare and 2) the proposed model home sales offices would be
in direct route to the new unit.
The Secretary read the Staff Report of 27 March 1967 recommending approval of
UP-126 for a period not to exceed four (4) months.
At 7:46 P.M. Co=~issioner Kasner moved, seconded by Commissioner Johnson, that
the public hearing on UP-126 be closed; motion carried unanimously.
Commissioner McFall moved, seconded by Commissioner Kasner, that the Staff Report
of 27 March 1967 relative to UP-126, Brown & Kauffmann, be approved in accordance
with said report; motion carried unanimously.

II. D. UP-127 - Gene C. Buthenuth, Palomino Way - Request for Use Permit for the Keepin~ of ~o (2) Horses - Continued from 13 March 1967
· The public hearing on UP-127 ~s re-opened at 7:48 P.M. The Secretary briefly
reviewed this matter and advised that nothing further had been added to the
file.
There ~.ms no one in the audience'who wished to comment with regard to this
matter. · · , .
Commissioner Crisp read the report of the Subdivision Committee relative to
UP-127, recommending approval of same.
The applicant, ~-. Buthenuth, was present and stated that the setback require-
ments specified-in the Subdivision Report have been complied with in accordance
with the Ordinance.
Commissioner Crisp moved, seconded by Commissioner JohnSon, that the hearing
on'UP-!27 be closed; motion carried unanimously and the hearing was closed at
7:52 P.M.
It was moved by Commissioner McFall and seconded by Commissioner Smith that
the Subdivision Committee Report of 27 March 1967 relative to UP-127, Gene C.
Buthenuth, be approved and that the Use Permit be granted for one (1) horse
in accordance with said report; motion carried unanimously.
E. UP-128 - john L. Terry, Woodbank Way - Request for Use Permit for the Keeping of One (1) Horse
The public hearing on UP-128 was opened at 7.:54 P.Mo The Secretary advised that
Notices of Hearing had been mailed and read a communication from Mrs. Walter W.
Powers of Woodbank Way filed in support of this application.
Mr. Terry w~s present and stated that 1) the proposed stable would require a
Variance (applied for under File No. V-291) to meet the setback requirements
of the Ordinance and 2) the corral would be no problem since it would be within
the setback limitations as shown on Exhibit "A".
There was no one else present who wished to comment with regard to this matter.
Commissioner McPall requested that the applicant submit a more detailed map
showing exactly %~at was'proposed.-with regard ~o construction and location of
the stable and corral.
Commissioner Crisp, on".behalf of the Variance Committee, made an appointment.
with .Mr. Terry.for an on-site inspection at 9:00 A.M., Saturday, 1 April.1967
in connection with subject application (UP-128) and V-291 scheduled later on
the agenda.
Chairman Norton (7:58 P.M.) directed UP-128 continued to the nex~ regular
meeting and referred same to the Subdivision Committee for study a~d a report
at that time.

II. F. D'P-129 - George W.'Day Construction, Glen Brae Drive - Request for Use Permit for Model Home Sales Office
The public hearing on UP-129 ~.ms opened at 7:59 P.M. The Secretary 1) advised
that Notices of Hearing had been mailed 2) briefly reviewed this application
and 3) read a con~nunication from Dr. & F~s. Patterson qf Via Grande Drive stating
their objections to this application with particular emphasis on the uncared for
fountain at the entrance to the Arroyo de Saratoga Subdivision.
The Secretary explained that the C~ty is in the process of arranging maintenance
for this entrance way.
~ Ed Xolstad was present to represent th~ applicant but stated he had no
further comment at this time.
The Secretary read the Staff' Report relative to this request, recommending
approval of same.
Commissioner i<asner moved, seconded by Commissioner McFall,. that the public
hearing on UP-129 be closed; motion carried and the hearing was closed'at
8:03 P.M.
Commissioner McFatl moved, seconded by Commissioner Smith, that the Staff
RepOrt of 27 March 1967 relative to UP-129 be approved and'that the request
for a UsePermit be granted accordingly; motion carried unanimously.
G. C-105 - George W. Day Construction, Allendale Avenue - Request for Change of
Zoning from "R-i-40,000" (Single Family Residential) to"'R-1-20,000"
(pip~le Family Residential) - Continued from 13 March 1967
The continued hearing on C-i05 was re-opened at 8:04 P.M. The Secretary briefly
reviewed this request and read communications from 1) Mr. & Mrs. A.L. Hensen
of Dolphin Drive. and 2) Floyd W. Davis, representing Daniel Roberrs and James
W. Kramer both of Harleigh Drive, filed in support of the subject application.
Mr. Nestor Barrett, Planning Consultant, was present to represent the applicant
but stated that he had no further comment at this time.
Cor~nissioner McFatl stated that this matter was being studied by the Subdivision
Committee and requested the subject application be continued to the next regular
meeting.

continued to the next regular meeting on 10 April 1967 and referred same to
the Subdivision Committee for study and a report at that time.
H~. C-106 - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning from
"A~' (Agricultural) to "R-M-3,000 P-C" (Multiple Residential Planned
Co~..~munity)
The public hearing on C-i06 was opened at 8:12 P.M. The Secretary advised 'that'
a Notice of Hearing had been published and briefly reviewed the subject request.
He then read communications from I,~. & ~s. Gerth Dickens and Mr. Robert D.
Heffelfinger filed in opposition to this application.and related a phone
message received from Mrs. May Gober, Douglas Lane, in favor of the proposed
change of 'zoning.
Chair~-n Norton explained that thislapplication was not inconsistent~'since
the original General Plan called for Multiple Zoning in this area.

It. H. C-106 - Continued
Dr. Abrams, present to represent the MoV.S. Company, stated that usually
a number of things are considered x~aen a request for Change of Zoning is
requested and then listed'the following as some points he felt should be
considered:
1) The great need in the community for this type of
development as indicated by 'numerous letters filed
in the Saratoga Green file submitted previously by
the applicant.
2) The subject property is located across the street
from Paul F~sson Winery, near a free~.~y and railroad
track and abutting a Professional Development.
3) The proposed development would be within walking,
distance of a library and shopping center.
4) The land in this area is being rapidly developed
and when the need for this type of development
becomes serious there will be no place to go
except,'. into the back yards.
5) With older adults living in this area there would not
be the additional cost' of $350.00 per year, per child~ "
in tax money which. would be the case if this land were
to be developed with single family residential homes.
6)The appearance of this development can be as appealing
as that of the Medical Village.
7) The people who.have expressed an interest in this develop-
ment are the type that would ~e an asset to the City of
Saratoga such as widows who have lived in the community
for many years and are now being forced to move elsewhere.
Dr. McHaie, 'former School Board Member, x~s present and stated that this type
of development would relieve the school tax burden and would in this way benefit
the schools, the City and the expensive home buyer.
Mr. &Mrs. John Core, DeHavilland Drive, were present and stated that 1) this
property x~s not located in the Saratoga or Los Gatos School District but was
Situated in the Campbell Union School District 2) their home is a one story
single family residence and a lot of their living is done'in the back yard which
would be near the proposed development and 3) a one.,story structure would be
more acceptable than a two story buiM ing.
~s. Raisa Kocher and Fa-. Clarence Neale,.shop o~ers in the Village,.were
present and spoke in favor of the proposed request. .'
~. Latham, present to represent the Saratoga Park District Home Owners Associa-
tion, stated 1) Dr. Abrams had discussed this m~tter with the Association 2) the
home o~aers in this district are located on the.outskirts'of Saratoga and approval
of this request would be another encroachment on their area and 3) a high density
development of this type is not warranted in this district.
l~. Bob Menzer, President of the Saratoga Park District Home Owners Association,
was present and stated that 1) he felt consideration of this request should be
postponed until after the General Plan Review 2) the Association is not convinced
that this development would be beneficial to this section and 4) since this pro-
perty was at one time zoned Multiple and then changed again indicates some
uncertainty.

II. H. C-106 - Continued
Chairman Norton advised that a good' number of people in the community were ·
ready to retire and some consideration should be given to providing them
with a home in Saratoga.
Mr. Menzer then stated he was not opposed to the plan but would like additional
time to study this matter.
After further discussion, Chairman Norton (8:42 P'M.). directed (C-106), M.V.S.
Company, continued until the next regular meeting and referred same to the Sub-
division Committee for further study.
I. C-107 - Saratoga Foothills Development, Cox Avenue - Request for Change of
Zoning from "A" (Agricultural) to "R-1-12,500" (Single Famil]z Residential)
The public hearing on C-107 was opened at 8:43 P.M. The Secretary advised that
a Notice of Hearing had b. een published and there were no written communications
on file: He then briefly reviewed the subject application.
There was no one present who wished to comment with r~gard to this request.
The Secretary then read a Staff Report recommending, with concurrence of the
Subdivision Committee, approval of the subject application.
Commissioner McFall moved, seconded' by Commissioner Johnson, that the public
hearing on C-107 be' closed; motion carried unanimously and the hearing was
closed at 8:46 P.M.
Commissioner McFall moved, seconded by Commissioner Smith, that the Staff Report
of 27 March 1967 relative to C-107, recommending approval, be approved and trans-
mitted to the City Council as the recommendation of the Commission; motion carried
unanimous ly.

J. V-291 - John L. Terry, Woodbank Way - Request for Variance in connection with Side Yard Setback Requirements
The public.hearing on V-291 was opened at 8:48 P.M. The Secretary advised that--I).
Notices of Hearing had been published 2).'.' briefly reviewed this application and
3) read a statement of reason filed by the applicant.'
The applicant, Mr. Terry, was present but stated he had no further comment at
this time.
There was no one. else present who wished to speak with regard to this matter.
Chairman Norton (8:50 P.M.) referred this matter to the Subdivision Committee
for study and a report and directed same continued until the next regular meeting.
K. C-80 - Clarence Neale, Saratoga-Sunnyvale Road - Informal Hearing on Request to
add Additional Uses to the List of Uses Permitted Under the Conditional
Community Commercial Zonin~
The informal hearing on this matter was opened at 8:51 P.M. The Secretary advised
that a notice had been published and briefly reviewed the subject request.· He
then read a communication submitted (along with pictures) by John M. Bastianelli
stating his objections to the proposed request.

II. K. C-80 - Continued
The Secretary explained that he had .discussed with Mr. McInerney, Santa
Clara County Public Works Department, the subject property }dr. Bastianelli
referred to in his letter and he was told by Mr. McInerny that Mr. Neale
was negotiating to purchase this property and that he (Mr. Neale) had a
permit that did not prohibit him from parking along this strip..
Mr. Neale advised that 1) Mr. Bastianelli did not purchase his apartment
property until July, 1966 2) he was aware at the time of purchase that
the strip of land in question was to be used for parking and 3). the
acquisition of the subject property would be negotiated 'in good order.
The Secretary then read the list of additional uses requested by Mr. Neale.
The applicant explained that since some vacancies would be available in his
shopping center on 1 May 1967 he would-like additional uses to make rental
of same more feasible.
After · further discussion, Chairman Norton (9 :'02 'P~.'M.) directed C-80
continued to the next regular meeting and referred same to the Subdivision
Committee for study and a report at that time.
L.. ORDINANCE NS-3.15 -.Proposed Amendment to Ordinance NS-3, which Amendment
would add Certain Provisions to Section 14.7 Relating
to Exceptions to Side Yard Requirements', and Amending
Section 14.3 in Relation to Non-Conforming sites by
Reason of Width

The public hearing on' proposed Ordinance No. NS-3.15 was' opened at 9:03 P.M.
The Secretary advised that a Notice of Hearing had been-published' and there
were no written communications in the file.
Chairman Norton briefly explained the context of the first section of this' :,.
proposed Ordinance.
Mr..Sam Hernandez was present and stated he was in favor of the subject
Ordinance.
CommiSsioner Crisp advised that 'he would submit a written statement.at the
'next regular meeting listing his objections to the Ordinance under discussion· .
Commissioner Kasner stated that he was opposed to this Ordinance and would
comment further at the meeting of 10 April 1967 i'
The Secretary read the second part of the sub jet. Ordinance and explained
that this portion of the Ordinance was necessary ~o the main body of same
and related specifical.ly to non-conforming sites ag to width.
At this time Chairman Norton br'ought up the subject of the amendment concerning
Conditional Zoning and stated that he had understood that this would be included
with the-., amendment relating to two stories.
The Secretary recommended that the amendment for Conditional Zdning be made
a separate ordinance.
After further discussion, Chairman Norton (9:13 P.M.)directed this matter
continued to the next regular meeting.

III. BUILDING SITES AND SUBDIVISIONS
A. SDR-669 - Frank Pringle, Canyon View Drive - Building Site Approval -
1 Lot - Continued from 13 March 1967
The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Commissioner McFall moved, seconded by Commissioner Kasner, that the
Building Site Committee Report of 27 Marc. h 1967 relative to SDR-669
be adopted and that the tentative map (Exhibit "A", filed 6 February 1967)
be approved in accordance with the site development plan (Exhibit "B",
filed 24 March 1967) subject to the conditions set forth in.said report;
motion carried unanimously.
B. SDR-674 - WeSt Valley Baptist Church, Allendale & Fruitvale Avenues -
Building Site Approval - 1 Lot - Continued from 13 March 1967
Commissioner McFall advised that a revised plan, regarding the improvement
of Fruitvale Avenue and the required parking, had been submitted to the
representatives of the church by the Director of Public Works and then requested
that this matter be continued to the next regular meeting to allow the applicant .~.
time to study the subject plan and discuss same with the Subdivision Committee.
On this basis, Chairman Norton directed this matter continued to the next
regular meeting and referred it tO the Subdivision Committee for further study.
C. SDR-683 - George W. Day Construction, Quito Road'- Building'Site Approval - .".

Mr. Ed Kolstad was present to represent the applicant and expressed satisfaction :'
with the proposed conditions of approval.
Commissioner McFall moved, seconded by Commissioner Crisp, that the Building
Site Committee Report.of 27 March 1967 relative to SDR-683 be adopted and
that the tentative map (Exhibit "A", filed 20 March 1967) be approved subject
to'the conditions set forth in said report; motion carried unanimously.
IV. DESIGN REVIEW
A. A-241 - Prospect High School, Prospect Avenue - Final Design Review - High
School Building - Continued from 13 March 1967
Commissioner O'Rorke advised that !) the Design Review Committee had met to
review this matter 2) the landscape and color maps that were needed to grant
final design approval-had not been submitted 3) the applicant has been notified
in writing concerning the subject maps and 4) this matter should be continued .'

The Secretary stated that the applicant was in conflict with the City Council
regarding objections.to the Building Site Committee Report.
On this basis, Chairman Norton directed this.matter continued off t~e agenda
until the necessary .material. is submitted for review.

IV. B~ A-242 - Rayne Soft Water, Saratoga-Sunnyvale Road - Final Design Review -
Identification Sign - Continued from 13 March 1967
Commissioner O'Rorke 1) briefly reviewed this application 2) stated the appli-
cant would be required to get a Variance for the proposed ~ign and 3) recom*...~.~:.~'~
mended that A-242 be removed from the agenda.
Commissioner O'Rorke moved, seconded by Commissioner McFall, that A-242 be
removed from the agenda and further proceedings be terminated; motion carried
unanimously.
C. A-243 - C. T. Lindsay, Inc., Cox Avenue - Final DeSign Review - Identification
Sign - Continued from 13 March 1967
Commissioner O'Rorke 1) briefly reviewed this application 2) stated that
while the signs themselves conformed with the Ordinance the Design Review
Committee concluded that they should be treated as four separate items
3) explained that the identification sign shown on Exhibit "A" was already
up and should be removed since it sets a dangerous precedent as far as having
signs so far from the subdivision presently being developed.
Commissioner Kasner .explained that the sign is located on a subdivision the
applicant developed previously and not on the one in progress.
After discussion, Commissioner O'Rorke moved, seconded by Commissioner Kasner
that Final Design approval be granted the signs shown on Exhibits"B" and "C"
of file A-243 and that the sign shown on Exhibit "A" of'~ile A-243 be denied;
motion carried unanimously.
D. A-244 - Richard Bragunier, Cox Avenue - Final Design Review - Quito Home ~e. coratin~ Center - 13 March 1967
Commissioner O'Rorke advised that the Committee 'had reviewed the plans for the "
proposed sign and recommended approval of same as shown on Exhibit "B".
Commissioner O'Rorke moved, seconded by Commissioner McFall, that Final Design
approval be granted ~i..? for this sign as shown on Exhibit "B"; motion carried
unanimously.
E. ~-247 - Brown & Kauffmann, Northampton Drive - Final Design Review - 'Subdivision Homes (Tract 3738) Unit #7
Commissioner O'Rorke briefly reviewed this application and stated that 1) there
were sixty-two (62) lots in this subdivision and 2) ~he applicant plans to
construct sixteen (16) homes, four (4) of which will be model homes, and the '
'remaining twelve (12) will be homes sold in advance of construction.
After discussion, Coam,issioner O'Rorke moved, seconded by Commissioner Kasner,
that Final Design approval be granted in connection with A-247, Brown &
Kauffmann, as shown on Exhibit "A" and subject to the following conditions;
.1.. Approval is limited to sixteen (16) houses to be located on
Northampton Drive, Dover Court and Newport Court.
2. Approval is. subject to all provisions of Ordinance NS-3.7.
3. Applicant shall adjust setbacks to stagger. the homes a.
minimum of five (5) feet at the front to prevent a row-'like
appearance.

F.' A-248 - Donald McConnell, Prospect Road - Preliminary Design Review - Automatic Car Wash with Gasoline Sales
Comanissioner O'Rorke briefly reviewed this application then moved, seconded
by Commissioner Crisp, that preliminary d~sign approval be granted A-248,
Donald McConnell, for the proposed car wash as shown on ExhiBit "A"; motion
carried unanimously.
G. SS-52 - Desmond Johnson, Quito and Twin Creeks - Final Design Review - Subdivision Identification Sign
After a brief discussion, Commissioner O'Rorke moved, seconded by Commissioner
Kasner, that final design approval be granted SS-52, Desmond Johnson, for the
proposed Identification Sign in accordance with Exhibit "A"; motion carried
unanimously·
V. CITY COUNCIL REPORT
Commissioner Johnson stated that the minutes of the last City Council meeting had
been distributed and'noted that the following items ~ of particular interest to
the Commission:
1) The Mayo~s letter to Commissioner Kellum, who resigned
from the Planning Commission, complimenting him on the
fine job. he did while serving on the Commission.
2) The Oath of Office taken by Mr. Charles H. Smith who
will fill the position left vacant by Commissioner
Kellum on the Planning Commission.

The Secretary briefly reviewed this application and then read a communication
filed by the applicant requesting a two year extension.

Chairman Norton at the request of Commissioner O'Rorke directed the Secretary
t8 remind the applicant of the required landscaped strip (trees and shrubs)
along the entire east'ern boundary of the applicant's property from the rail-
road tracks to McFarland Avenue which must be underway prior to issuance of
a Building Permit.
The Secretary then read the Staff Report relative to this· request recommending,'
with concurrence of the Subdivision Committee, approvaI of same.
After further discussion, Commissioner McFall moved, seconded by Commissioner
O'Rorke, that the Staff Report of 27 March 1~67 relative to this matter.be

to this matter, recommending that the applicant's' request for modification
and waiver of conditions be denied.
Commissioner McFall moved, seconded by Commissioner Kasner, that the Subdivision
Committee Report of 27 March 1967 relative to SDR-680, Donald Ljepava, recommend-
ing denial, be approved and 'transmitted to the City Council aS the recommendation
of the Commission; motion carried unanimously.
VII. OLD BUSINESS
A. SDR-673 - Church of Jesus Christ of Latter Day Saints, Allendale Avenue - Request
for MOdification of Conditions - Continued from 13 March 1967
The Secretary briefly reviewed this request and stated that the Director of Public
Works had studied the proposed modification and had expressed satisfaction of same.
The Secretary then read the Staff Report·relative to this request.. recommending,
with concurrence of the Subdivision Committee, approval of subject request.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Staff Report
of 27 March 1967 recommending approval, be adopted and transmitted to City Council
as the recommendation of the Planning Commission; motion carried unanimously.
B. SDR~665 - Westhope Presbyterian Church, Saratoga Avenue - Request for Modification
of Conditions - Continued from 13 March 1967
Commissioner McFall 1) briefly reviewed this application 2) informed Mr. George
Heiser, who'was present to represent the-applicant, that a bond could be posted
for the proposed sidewalk and 3) read the report of the Subdivision Committee'
.. recommending denial of subject request.
Commissioner McFall moved seconded by Commissioner Crisp, that the Subdivision
Committee Report of 27 March 1967 relative to SDR-665, Westhope Presbyterian
Church, be approved and transmitted to the City Council as the recommendation
of the Commissioner; motion carried unanimously.
C. SDR-670 - Douglas Hines~ Sobe~ Road - Request for Modification of Conditions
The Secretary 1) briefly reviewed this application 2) stated ·that a Staff
