II. PUBLIC HEARINGS
A. UP-120 - Sisters of Notre Dame de Namur, Norton Road - Request for Use Permit
for Construction of New Novitiate Facilities - Continued from 27 March
1967
The continued hearing on this request was not resumed at this time since nothing
further had been added to the file and there w~s no one present who wished to
comment wit~ regard to this application.
Commissioner McFall advised .that the applicants and their representative, Mr.
Hollis Logue, were still studying the alternate cost estimates for the improve- ..
ment of Bohlman Road and recommended 'that this matter be continued to the next
regular meeting.
Chairman Norton so directed.
B. C-105 - George W. Day Construction, Allendale Avenue - Request for Change of
Zoning from "R-1-40,O00" (Single Family Residential) to "R-i-20,000"
(SinKle Family Residential) - Continued from 27 March 1967
The continued hearing on C-105 was not re-opened at this meeting. Commissioner
McFall explained that a revised map showing the necessary information needed to
prepare a recommendation with regard to this matter would be submitted by the.
applicant, before the next regular meeting on '24 April 1967.
In view' of the foregoing, Chairman Norton directed C-105 continued until the
meeting on 24 April 1967.
C. C-106 - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning from "A"
(Agricultural) to "R-M-3,000" (Multiple Residential) - Continued from
27 March 1967.
The continued hearing on C-106 was not resumed at this time. Commissioner McFall
advised that the Subdivision Committee had met with the applicant and are now
awaiting the submission of specific information relative to this matter.
There was no one present who wished to comment with regard to this request.
· Chairman Norton directed C-106 continued to the next regular meeting on 24 April
1967.

II. D. V-291 - John L. Terry, Woodbank Way'- Request for Variance in Connection
with Side Yard Setback Requirements - Continued from 27 March 1967
The continued hearing on V-291 was resumed at 7:44 P.M. The Secretary
briefly reviewed this application and. stated that a detailed map, show-
ing the exact location of the stable and corral and the trees that would
be removed if the setback ~equirements were met, had been submitt·ed by
· the applicant.
Mr. Terry was present but stated that he had no further comment at this
time.
· · There was no one else present who wished to. speak with regard to this matter.
Commissioner Johnson read the report of the Variance Committee relative·
to V-291, recommending denial on the basis that "the only possible hard-
.. ship incurred would be the removal of two orchard trees of which there
are many".
Commissioner Johnson advised that the Variance Committee report should
be amended to read "two additional trees" in paragraph 3.'. .line 2.
Commissioner O'Rorke stated that the City still maintained its present
policy with regard·to preserving trees, but in this case thirty (30)
odd trees would remain in the orchard surrounding the proposed stable
and corral.
After discussion, Commissioner Crisp moved, seconded by Commissioner .'
McFall, that the public·hearing on V-291 be closed; motion carried un-
animously and the hearing was closed at 7:48 P.M.
It was moved by Commissioner Crisp and seconded by Commissioner Johnson
that the Variance Committee Report of 10 April 1967 rela~.ive to V-291,
John L. Terry~ be approved, as amended, and that the Variance be denied
since the required findings could not be made; motion carried unanimously.
E. C-80 - Clarence Neale, Saratoga-Sunnyvale Road - Informal Hearing on
Request to Add Additional Uses to the List of Uses. Permitted Under
the Conditional Community Commercial Zoning - Continued from 27 March
1967
The continued hearing on C-80 was resumed at 7:49 P.M. .The Secretary briefly
reviewed this matter and advised that nothing further had been added to the
file.
The applicant, Mr. Neale, was present and stated he would prefer to reserve
his comments until after the reports relative to this matter had been read.
Conmissioner McFall read the Staff Report prepared jointly with the Sub-
division Committee, recommending that this request for additional uses
be denied and any increase in the existing building square footage or
the addition of any new building to the property be disapproved. He then
read the report of the Planning Director reviewing Mr. Neale's development
from the standpoint of compliance with conditions imposed and plans sub-
mitted under his various applications.

II. E. C-80 - Continued
The applicant then made the following comments:
1. The State of California and the County of Santa
Clara had issued himan Encroachment Permit for
the use of the 35 foot area (located between the
embankment and the roadway) for parking..
2. The State of California and the County of Santa
Clara had requested that the landscaping on the
property belonging to the State be postponed since
there is a drainage in-let located here that would
be obstructed by shrubbery.
3. A key shop had been maintained in the old Barn;
therefore, the Milerich Key Shop should be considered
a legal use.
" .. 4~ .The Planning Con~nission was inconsistent in their
interpretation and application of the Zoning Ordi-
nance, particularly in reference to parking and
claimed that he provided more parking than any
other business in Saratoga.
5. Many times people park at Neale's Hollow and then
walk to the Village to do their shopping or they
go to visit tenants in the adjacent apartment
build ing.
6.' He had been in contact wi[h a chartered sight-seeing
bus service that would make a single stop daily in
Saratoga (at Neale's Hollow) during the summer months
if the necessary conveniences for a stop-over station
could be arranged.
7. Several of the tenants' from the adjacent apartment
building drive sports cars and when they are on the.
right-of-way going through his property they~ drive
at a speed which is unsafe especially for the elderly :
customers who shop at the center.
8. The parking spaces referred to in the report were
· . ·incorrectly marked at a time when he (Mr. Neale) "
was not present and they will be remarked as
specified in the report. '.
9.In closing he stated that, he felt, that his requests'
were in conformance with the ZoniDg efdinance.

II. E~ C-80 - Continued
. Chairman Norton explained that 1) certain concessions with respect
to parking have had to be made until the formation of the proposed
Village Parking District is accomplished 2)' Mr. Neale's parcel is
zoned ·Conditional Commercial with limited uses and now it must be
maintained as such and 3) the Zoning Ordinance is complicated,
but the Planning Commission endeavors to enforce it as fairly as
possible.
Commissioner O'Rorke suggested that Mr. Neale be given a copy of
each of the reports read by Commissioner McFall so that he may
'. study them and then return at a later date to discuss the various
items mentioned in the report with the Commission.'.
Mr. Bob Ewing, member of the Chamber of Commerce and loca'l merchant,
was present inquired why the Garcia request (Retail Specialty Shopping
Center) was considered and recommended to the City' Council for approval
by the Planning Commission··~·'·~.- when Mr. Neale is not able to get additional
uses for his development.
Chairman Norton explained that it was the intent of. the Planning Commission
to.upgrade the entire· area where the Garcia property is located since it is
.one..of the entrances to the Cit~whereas, Mr. Neale's property is bordering
a residential area'. He further explained that when an application is being
studied the Planning Commission must consider what affect it would have on
the City as a whole rather than the advantages that would be gained· by an
individual.
Mr. Bastianelli, owner of Brookside Glen Apartments adjacent to Neale's
Hollow, was present·and stated he was not opposed to the applicant'.s
proposal as long as it does not affect the County easement and his right-
of-way.
Commissioner Smith inquired of the applicant how, if ·he remarked his pa~king
spaces to the widths required, would he be. able to realize the same number
parking spaces.
Mr. Neale. explained that an area in the rear of his property has never been
landscaped or black topped and by'using this he could supply any additional
space needed for parking. 'He then requested that this matter be continued
to the meeting on 8 May 1967 to allow him time to consider all points men-
tioned in the reports.
In view of the foregoing, Chairman Norton (8:28 P.M.) directed C-80 continued
to the meeting on 8 May 1967.

II. F. Ordinance NS-3.15 - Proposed Amendment to Ordinance NS-3, which Amendment
would add Certain Provisions to Section 14.7 Relating
to Exceptions to Side Yard Requirements, and Amending
Section 14.3 in Relation to Non-Conforming Sites by
Reason of Widt~ - Continued from 27 March 1967
The continued hearing on this proposed amendment (Ordinance NS-3.15) was
re-opened at 8:29 P.M.' The.Secretary stated there was nothing new in the
file.
Chairman Norton briefly reviewed this proposed ordinance.
There was no one. in the audience who wished to comment with regard to
this matter.
Commissioner McFall stated that it was his recommendation, with full concurrence
of the Subdivision Committee, that this matter be taken off the agenda and that
all further action with regard to same be terminated.
At 8:30 P.M. Commissioner McFall moved, seconded by.CommiSsioner Kasner,' that
the public hearing for/"this proposed amendment .be closed;!motion carried
unanimously.
Commissioner McFall moved, seconded' by Commissioner Kasner, that the proceed~.'.,':~.~
ings'.on/',thiS:~.; proposed amendment be abandoned and that the Planning Department
be directed to interpret the zoning laws as stated in the Zoning Ordinance and
as instructed by the City Attorney with regard to the items mentioned in subject
.amendment; motion carried unanimously.
G.' UP-130 - R. B. Beers, Sobey Road - Request for Use Permit=for the Keeping of One (1) Horse
The public hearing on UP-130 was opened at 8:36 P.M. The.Secretary advised .....
that Notices of Hearing had been mailed and read a communication from Mr. &
Mrs. Brookman filed in support of this application.
Commissioner O'Rorke 'stated that the applicant had notified him that he could
not be in attendance at this meeting. :
There'was no one else present who wished. to comment with regard to this matter.
Chairman Norton (8:39 P.M.) directed UP-130 continued to the next regular meet-
ing and.referred same to the Subdivision Committee for study and a report at
that time.
H. V-292 - Rayne Soft Water, Saratoga-Sunnyvale Road - Request for Variance.in
Connection with Sign Location
The public hearing on V-292 was opened at 8:40 P.M. The Secretary advised that
Notices of Hearing had been mailed and no written communications had been received'.'
He then briefly reviewed this application.
The applicant was present to further explain the need for the requested Variance.
There was no one else present who wished to comment with regard to this matter.
'After discussion, Chairman Norton (8:30 P.M.) directed V~292 continued until the
next regular meeting and referred the matter.to the Variance Committee for study
and a report at that time.

Commissioner Crisp, on behalf of the Variance Committee, made an appointment
with the applicant for an on-site inspection at 8:30 A.M., Saturday, 15 April
1967.
I. C-71'- Maranar Investment Company, Walnut Avenue - Request for Change of
Zoning from "R-1-12,500" (Single Family Residential) to "R-M-3,000 P-C"
.(Multi-Residential Planned Community)
The public hearing on C-71 was opened at 8:43 P.M. The Secretary stated that
a Notice of Hearing had been published and briefly reviewed this application.
He then read communications from Mrs. Mary Ruth Owens of Victor Place, Arthur
L..Cooley, M.D. of Squirrel Hollow Lane and Pray and Elbrecht, attorneys for
Mr. Ba~tianelli, filed in opposition to this Change of Zoning.
Mr. Herbert Resner was present to represent the applicant and stated:
1) A smilar application was before the Commission
about two (2) years ago.and was considered
impractical. by the applicant due to the required
construction of retaining walls at a cost of
'$135.,000. The new plans show the buildings set
back from the creek so-that retaining walls will'
· '. not be essential.
2) The previous approved request had been for
R-M-5,000 PC ·Zoning and allowed for the ..... I-
construction· of 34 Units. The new request
is for R-M-3,000 PC Zoning with the construc-
tion of 66 units, but using less land by
having five to six family units per structure
rather than the three previously approved. The
reason for the new request is that the 34 units
with R-M-5,000 PC.is economically unfeasible.
3) In any event when Flood Control improvements
get under way on Saratoga Creek a conc'rete
channel placed down the creek will eliminate ..if ...
· the necessity of expensive retaining walls. - ·
... 4) The applicant has a Resolution that permits him ...-.
· ' right-of-way over Mr Bastianelli's property .'
"' (Brookside Glen Apartments).
· ' ... 5) One of the previous owners of the Maxmar property,
Mr. Lee, had exchanged one right-of-way for another
· as explained in the memorandum of 7 October 1964.
6) The development is still designed for occupancy
by people past ftf..t.y (50) years of age.
The general opinion zseems to be that this type of
development is needed in Saratoga and the best loca-
tion would be near the downtown area, but the"people
objecting seem to feel (and understandably so) it
should not impose on anyone's privacy.
8)The rentals on these units will be approximately $250.00
depending upon the size of the unit.
9) 'These unit's are built together, but will be maintained as
separate structures.

· Commissioner McFall stated that this plan does not conform with t~e
present Planned Community Ordinance.
The· Secretary advised that hd had'discussed this matter with the City
Attorney and had been advised that to avoid complications with regard
to the Planned Community Ordinance this application could be changed·
to strict Multiple Zoning.
Mr. H. J. Oberhaus of Alta Vista Avenue was present and stated that
even if the problem with regard to'Arbelec~e Lane is resolved the
increase in traffic, with these additional units, will still present
problems.
Mr. Bastianelli, Brookside Glen Apartments, stated that the right-of-way
agreement worked out with Mr. Stern (former owner of Brookside Glen Apart-
ments)·was not legal. He then stated that since the applicant for a Change
of Zoning must be the owner/·and· since this particular property had been
repossessed by the Dollar Savings and Loan Company how was it possible '
for Mr. Resner to file this application.

c. Mr. Resner explained that he had a contract with the Dollar Savings and.
Loan Company by which they owned the larger portion of this property and
he '(Mr. Resner) maintained ownership of the two smaller parcels.
Mr. Clarence Neale, local merchant, was present and stated that 1) this ..,
· type of community is needed in Saratoga 2) this development would enhance
-the appearance of the entire area and 3) he felt this would attract
desirable citizens.
Mrs. Dorothy Hilbrecth, ViCtor Place, was present and stated she did not
like the idea of having this sort of development almost in her back yard.
Mr. Wilbur Worden of Squirrel Hollow Lane, was present and stated that
he did not·object to the previous application, but felt that this plan
would be·completely unacceptable..
· ·After discussion, Chairman Norton (9:15 P.M.) directed C-71 continued to
the next regular meeting and referred the matter to the Subdivision Committee
for study.
J. UP-128 - John L. Terry, Woodbank Way - Request for Use Permit for the Keeping
of One (1) Horse - Continued from 27 March 1967
The public 'hearing on UP-128 was resumed at 9:16 P.M. The Secretary
.... briefly reviewed this application and advised that nothing further had.
been added·to the file.
The applicant was present but stated that he-had no further comment at
this time.
There.was no one else present who wished to comment with regard to this
application.
The Secretary then read the Staff Report pertaining to UP-128, recommending
that the Use Permit be granted subject to compliance with all applicable
provisions·of Ordinance NS-3 Section 16.6. ' :"

Commissioner McFall moved, seconded by Commissioner Crisp, that the
public hearing on UP-128 be closed; motion carried unanimously and· the
hearing was closed at 9:18 P.M.
Commissioner McFall moved, seconded by Commissioner Kasner, that the Staff
· Report of 10 April 1967 relative to UP-128 be approved and that the Use
Permit be granted subject to compliance with all applicable provisions of
Ordinance NS-3, Section 16.6; motion carried unanimously.

III. BUILDING SITES AND SUBDIVISIONS
A. SDR-674 - West' Valley Baptist C~urch, Allendale and Fruitvale Avenues -
Building Site Approval - 1 Lot - Continued from 27 March 1967
Commissioner McFall advised that the new plan had not been made available
· .' .to the Subdivision Committee in time for study prior to this meeting and
recommended that this matter be continued.
Chairman Norton so directed.
B. SD-684 - C. T. Lindsa7~ Inc.~ Cox Avenue - Subdivision - 54 Lots
Mr. Jim Kaiser, engineer fromMacKay and Somps~ was present to represent the
applicant and expressed satisfaction with proposed conditions of approval.
Commissioner McFall moved, seconded by Commissioner Kasner, that the Subdivision
Committee Report of 27 March 1967 relative to SD-684 be adopted and that the
tentative map (Exhibit "A", filed 27 March 1967) be approved subject to the
conditions set forth in said report; motion carried unanimously.
C. SDR-685 -.Dr. Michael D. Kowitz,'Pike Road - Buildins Site Approval - 1 Lot
Commissioner McFall advised that the Subdivision Committee was not yet prepared
to make a'recommendation in connection with this application and suggested that
· "" same be continued until the meeting of 24 April 1967.
On this basis, Chairman Norton directed SDR-685 continued to the next regular
meeting.
D. SD-686 - Starlite Homes, Pierce Road - Subdivision - 69 Lots
Mr. Jim Kaiser, MacKay and Somps, was present to represent the applicant and
questioned Conditions 10 (pertaining to topsoil on all cut and fill areas),
14 (relative to final approval of Lots 46 to 67) and 15 (concerning revision
of alignment of West Valley Drive). He then suggested that 1) since the grade
on this property was quite level Condition 10 be amended to read "as specified
by·soils engineer" 2) Condition 14 should be amended to read "No final approval
of final map on Lots 46 to 67" and' 3) Condition 15 should not be. included,since
this condition has alreadybeen met.

On this basis, Chairman Norton directed that Condition 10 be amended to
read "as approved by Director of Public Works" and recommended that Condi-
tion. 14 be amended to read as suggested by Mr. Kaiser. He further stated
that since"Condition 15 had already been complied with there is no reason
to remove it from the report.
Commissioner McFall inquired of the applicant if there were any plans
to develop any facilities other than the ones shown on the map.
Mr..McInerny, President of Starlite Homes, was present and stated they
planned no facilities other than the ones shown on the map.
Commissioner McFall moved, seconded by Commissioner Smith, that the
Subdivision Committee Report of 10'April·1967 relative to SD-686 be
adopted, as amended, and that the tentative map (Exhibit "A", filed
27 March 1967) be approved subject to the conditions set forth in said·
report; motion carried unanimously.
IV. DESIGN REVIEW
A. A-246 - Church of Jesus Christ of Latter Day Saints, Allendale Avenue - Final Design Review - Church BuildinMs
Commissioner O'Rorke briefly reviewed this application and then requested
that the Secretary give a report on the status of this application,
The Secretary advised· that this application had not been granted pre'liminary
· design approval but all the plans required for final approval had been submitte~
by the applicant's representatives.
Mr. A1 Hansen, Dolphin Drive, was. present and 1) stated that he had not been
notified that this matter would be considered for final approval at this meet-'
ing and 2) requested that this matter be continued to allow him ample time
to study the proposed·plans.
In view of the foregoing, Chairman Norton directed this'umtter continued to
the next regular meeting on 24 April 1967.
V. CITY COUNCIL REPORT
Commissioner Kasner gave a brief report. on discussion and action at the City
Council meeting on 5 April 1967 and noted that the high light of the evening
was the appointment of Mr. James R. Huff to the position of City Clerk-Administrator..
VI. NEW BUSINESS
A.. C-86 - Neil K. Chases Saratoga Avenue - Request for Extension
The Secretary read a communication from Mr. P. L. Merrick, current property
owner, requesting an extension of time in connection with C-86.
Commissioner Crisp advised that this was a parcel zoned Conditionally for·
apartments and stated that there could. be.problems relating to the road with ...
regard to adequate ingress and egress.
Commissioner McFall moved, seconded by Commissioner Crisp, that the Planning
Commission-.'..' recommend to the City Council that an extension be granted in
connection with C-86 for a period of one year from present date of expiration';
motion carried unanimously.

VI. NEW BUSINESS
· B. C-83 - Starlite Homes (formerly Hamilton Development), Pierce Road -
Request for Extension
.. The Secretary briefly reviewed this application and then read a communication
requesting.an extension of one (1) year in connection with C-83.
Commissioner McFall moved, seconded by Commissioner Crisp, that the Planning
Commission recommend to the City Council that.an extension be granted in connec-
tion with C-83 for a period of one'=year from present date of expiration; motion
carried unanimously.
C. SDR-678 - Dr. John E. Cox, Jack's Road - Request for Modification of Conditions
Commissioner McFall advised that the applicant'.s representative had met with
the Subdivision Committee to discuss the required improvement of the access
road reiative to SDR-678 and had requested that this matter be continued to
allow him to work out an alternate plan with the Director, of Public Works.
Mr. G. C. McKinney, present to represent the applicant, stated that 1) this
is a private driveway rather than a public street 2) there is only a 20'
.easement to work with on one side and a slope off into the canyon on the other
side 3) the present driveway about occupies the remaining space and 4) the
'amount of the inspection seems to be excessive.
In view of the foregoing, Chairman Norton directed SDR-678 continued to the
next regular meeting on 24 April 1967.
D. SD-607 - Douglas P. Hines, Pierce Road - Request for Extension
..
The Secretary briefly reviewed this application and stated that this was the'
applicant's first request for extension with regard to SD'607 and recommended
that the extension be granted for one (1)'year. :. .'
Commissioner'McFall moved, seconded by Commissioner Smithi that an extension
of one (1) year be granted in connection with SD-607; motion carried unanimously.
VII. OLD BUSINESS
A....SDR-670 - Douglas Hines, Sobey Road'- Request for Modification of Conditions
- Continued from 27 March 1967
Commissioner McFall explained that this request has been continue~ for=.-~? some time
to'allow the applicant time to meet with the Director of Public Works and work
out an alternate plan with regard to drainage and after doing so the Director of
Public Works still recommends that this condition be imposed.
The applicant was present and stated that he did not'disagree with the Director
of Public Works that this drainage was needed, but felt that he was being
burdened with'a.problem that should'be shared with.the other property owners
in the area who would benefit.
'Commissioner Crisp stated t~is requirement was in accord with the procedure
'followed in similar cases.
The Secretary stated that Mr. Hines would be reimbursed for 75% of his cost
out of the Storm Drainage Fund and .then read the Staff Report of 27 March 1967
recommending, with concurrence of the Subdivision Committee, to the City Council
that this request for modification of condition be denied.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Staff Report
of 27 March 1967 relative to SD,R-670, be approved and that the subject request
be denied and same be recommended to the City Council for disapproval.;

VII. A. SDR-670 - Continued
A Roll Call vote was taken with the following result:

with Commissioner O'Rorke abstaining, stating that he 'was a business
associate of Mr. Hines and the motion did not carry..'.
In view of the foregoing, Commissioner Smith moved, seconded by Commissioner
Johnson, that the. City Council be informed that the Planning Commission had
split on the vote regarding the recommendation of this request and were of '.
the opinion that th'e City Council should resolve the matter; motion carried
unanimously.
B. SD-478 - Claude T. Lindsay, Cox Road - Request for Extension
The Secretary briefly reviewed this application and recommended that
this matter be continued to the next regular meeting.

C. HORSE ORDINANCE
Commissioner McFall advised that the Subdivision Cormnittee had reviewed
the latest revision'with regard to the Horse Ordinance and would be ready
to make a recommendation after 1) consulting with the City Attorney and 2)
meeting for a study'session to discuss the proposed ordinance.
D. GENERAL PLAN REVIEW '
Commissioner McFall advised that the Kosich representatives had submitted
· another proposal, which will be on the agenda for 24 April 196~ similar
to the one proposed earlier. He then stated that the applicant, at a meeting
with the Subdivision Committee, had been informed that 1) enthusiasm for this
type of plan was lacking and 2) the General Plan was under review and the City
Council would probably refer' subject request to the General Plan Committee for
further study.
CommisSioner McFall further stated that he had discussed!this matter with'
. .;. the consultant, Mr. Livingston, and had inquired if this particular problem
could be acted upon independently of the other matter being considered.
Chairman Norton explained that it would not be proper to ask advance
consideration of any special application.

Chairman Norton introduced and' extended a welcome to newly appointed Commissioner
Charles H. Smith. He observed that Mr. Smith, a retired professional engineer,
was a long time resident of Saratoga and it was fortunate for the City as well
as.the Planning Commission that the City Council appointed him.
D. COMMISSIONER KELLUM
Chairman Norton read a rough draft of a letter, written on behalf of the Planning
Commission to Commissioner Kellum, expressing appreciation for services rendered
and observing that he would be missed byall.
After discussion, Chairman Norton, with concurrence of the Planning Commission,
directed the Secretar~ to type the letter in final form for signature by the
Chairman.

Bill Driscoll, present to represent the applicant, stated 1) it was difficult
to sell the homes in this particular unit since it was quite a distance from
any main thoroughfare and 2) the proposed model home sales offices would be
in direct route to the new unit.
The Secretary read the Staff Report of 27 March'1967 recommending approval of
UP-126 for a period not to exceed four (4) months.

their objections to this application with particular emphasis on the uncared for
fountain at the entrance to the Arroyo de Saratoga Subdivision.

reviewed this request and read communications from 1) Fir. &Firs. A.L. Fansen
of Dolphin Drive and 2) Floyd W. Davis, representing Daniel Roberrs and James
W. Kramer both of Harleigh Drive, filed in support of the subject application.
Fir. Nestor Barrett, Planning Consultant, was present to.represent the applicant
but stated that he had no further comment at this time.
Commissioner McFall stated that this matter was being studied by the Subdivision
Committee and requested the subject application be continued to the next regular
meeting.
On the basis of this request, Chairman Norton (8":'11 P.M.) directed C-105

a Notice of Hearing had been published and briefly reviewed the subject request.
He then read communications from Mr. & F~s. Gerth Dickens and Fir. Robert D.
Heffelfinger filed in .opposition to this application.and related a phone
message received from Firs. F~y Gober, Douglas Lane, in ~avor of the proposed
change of zoning.
Chairms. n Norton explained that this application was not inconsistent~"since

a number of things are considered when a request for Change of Zoning is
requested and then listed 'the following as some points he felt should be
considered:
1) The great need in the community for this type of
development as indicated by .'numerous letters filed
in the Saratoga Green file submitted previously by
the applicant.
2) The subject property is'located across the street
from Paul M~sson Winery, near a free~y and railroad
track and abutting a Professional Development.
3) The proposed development would be within walking.
distance of a library and shopping center.
4) The land in this area is being rapidly developed
and when the need for this type of development
becomes serious there will be no place to go
" except.'.: into the back yards.
5) With older adults living in this area there would not
be the additional cost of $350.00 per year, per child~ "
in tax money which would be the case if this land were
to be developed with single family residential homes.
6)The appearance of this development can be as appealing
as that of the Medical Village.
7) ~he people ~no have expressed an interest in this develOp-
ment are the type that would be an asset to the City of
Saratoga such as widows who have lived in the community
for many years and are now being forced to move elsewhere.
Dr. McHa!e, former School Board Member, ~s present and stated that this type
of development would relieve the school tax burden and'would in this way benefit
the schools, the City and the expensive home buyer.
~. &Mrs. John Core, Det~villand Drive, were present and stated that 1) this.
property ~s not located in the Saratoga or Los Gatos School District but t~s
situated in the Campbell Union School District 2) their home is a one story
single family residence and a lot of their living is done in the back yard which
would be near the.proposed development and 3) a one. story structure would be
more acceptable than a two story buiM ingo
M~s. Raise Kocher and F~. Clarence Neale, shop owners in the Village, were
present and spoke in favor of the proposed request.
Fir. Latham, present to represent the Saratoga Park District Home Owners Associa-
tion, stated 1) Dr~ Abrams had discussed this matter with the Association 2) the
home o~ners in this district are located on the outskirts of Saratoga and approval
of this request would be another encroachment on their area and 3) a high density
development of this type is not warranted in this district.
!~ ..Bob Menzer, President of the Saratoga Park District Home Owners Association,
was present and stated that 1) he felt consideration of this request should be
postponed until after the General Plan Review 2) the Association is not convinced
that this development would be beneficial to this section and 4) since this pro-
perty was at one time zoned Multiple and then changed again indicates some
uncertainty.

Chairman Norton advised that a good number of people in the co~,m~unity were
ready to retire and some consideration should be given to providing them

that a notice had been published and briefly reviewed the subject request. He
then read a communication submitted (along with pictures) by John M. Bastianelli
stating his objections to the proposed request.

The Secretary explained that he had discussed with Mr. McInerney, Santa
Clara County Public Works Department, the subject property Mr. Bastianelli
referred to in his letter and he was told by Mr. McInerny that Mr. Neale
was negotiating to purchase this property and that he .(Mr. Neale) had a
permit that did not prohibit him from parking along this strip.
Mr. Neale advised that 1) Mro Bastianelli did not purchase his apartment
property until July, 1966 2) he was aware at the time of purchase that
the strip of land in question was to be used for parking and 3) 'the
acquisition of the subject property would be negotiated in good order.
The Secretary· then read the list of additional uses requested by Mr. Neale.
The applicant explained that since some vacancies would be available in his
shopping center on l'May 1967 he would lik~ additional uses to make rental
of same more feasible.

Commissioner O'Rorke 1) briefly reviewed this application 2) stated that
while the signs themselves conformed with the Ordinance the Design Review
Committee concluded that they should be treated as four separate items
3) explained that the identification sign shown on Exhibit "A" was already
up and should be removed since it sets a dangerous precedent as far as having
signs so far from the subdivision presently being developed.
Commissioner Kasner explained that the sign is located on a subdivision the
applicant developed previously and not on the one in progress.
After discussion, Commissioner O'Rorke moved, seconded by Commissioner Kasner
that Final Design approval be granted the signs shown on Exhibits"B" and "C"
of file A-243 and that the sign shown on Exhibit "A" of'file A-243 be denied;
motion carried unanimously.
D. A-244 - Richard Bragunier, Cox Avenue - Final Design Review - Quito Home
Decoratin~ Center - 13 March 1967
Commissioner O'Rorke advised that the 'Committee had reviewed the plans for the'
proposed sign and recommended approval of same as shown on Exhibit "B".
Commissioner O'Rorke moved, seconded by Commissioner McFall, that Final Design
approval be granted ~.:'i+..-~ for this sign as shown on Exhibit "B"; motion carried
unanimously.
E. A-247 - BrOwn & Kauffmann, Northampton Drive - Final Design Review - Subdivision Homes (Tract 3738) Unit #7
Commissioner O,Rorke briefly reviewed this application and stated that 1) there
were sixty-two (62) lots in this subdivision and 2) the applicant plans to
construct sixteen (16) homes, four (4) of which will be model homes, and the
remaining twelve (12) will be'homes sold in advance of construction.
After discussion, Commissioner O'Rorke moved, seconded by Commissioner Kasner,
that Final Design approval be granted in connection with A-247, Brown &
.Kauffmann,. as shown on Exhibit "A" and subject to the following conditions;
1. Approval is limited to sixteen (16) houses to be located on
Northampton Drive, Dover Court and Newport Court.
2. Approval is. subject to all provisions of Ordinance NS-3.7.
3.' Applicant shall adjust setbacks to stagger the homes a
minimum of five (5) fee~ at the front to prevent a row-like
appearance.

Subdivision Identification Sign
After a' brief discussion, Commissioner O'Rorke moved, seconded by Commissioner
Kasner, that final design approval be granted SS-52, Desmond Johnson, for the'
proposed Identification Sign in accordance with Exhibit "A"; motion carried
unanimously.

Commissioner Johnson stated that [he minutes of the last City Council meeting had
been distributed and noted that the following items were of particular interest

1) The Mayor's letter to Commissioner Kellum, who resigned
from the Planning Commission, complimenting him on the
fine. job he did while serving on the Commission.
2) The Oath of Office taken by Mr. Charles H. Smith who
will fill the position left vacant by Commissioner .~

Chairman Norton at the request of Commissioner'O'Rorke directed the Secretary
to remind the applicant of the required landscaped strip (trees and shrubs)
along the entire eastern boundary of the applicant's property from the rail~
road tracks to McFarland Avenue which must be underway prior to issuance of
a Building Permit.
The Secretary then read the Staff Report relative to this request recommending,
with concurrence of the Subdivision Committee, approvaI of same.

O'Rorke, that the Staff Report of 27 March 1~67 relative to this matter·be
approved and that this request for extension be recommended by the Planning

Commissioner McFall read the report of the Subdivision Committee with regard
to this matter, recommending that th~ applicant's request for modification
and waiver of conditions be denied.
Commissioner McFall moved, seconded by Commissioner Kasner, that the Subdivision
Committee Report of 27 March 1967 relative to SDR-680, Donald Ljepava, recommend-
ing denial, be approved and transmitted to the City Council as the recommendation
of the Commission; motion carried unanimously.
VII. OLD BUSINESS
A. SDR-673 - Church of Jesus Christ of Latter Day Saints, Allendale Avenue - Request for Modification of Conditions - Continued from 13 March 1967
The Secretary briefly reviewed this request and stated that the Director of Public

of 27 March 1967 recommending approval, be adopted and transmitted to City Council
as the recommendation of the Planning Commission; motion carried unanimously.

Commissioner McFall 1) briefly reviewed this application 2) informed Mr. George
Heiser, who'was present to represent the applicant, that a bond could be posted
for the proposed sidewalk and 3) read the report of the Subdivision Committee'
recommending denial of subject request.
