II. PUBLIC HEARINGS
A. b~-'120 - Sisters of Notre Dame de Namur, Norton Road - Request for
Use Permit for Construction of New Novitiate Facilities -
Continued from 10 April 1967..
The continued hearing on this request was not re-opened at this time.
The Secretary ~dvised that nothing further had been added to the file.
Commissioner McFall requested that this matter be continued to the next
regular meeting to allow time to work out a solution with regard to a
lack of agreement between the applicant and the City over the improve-
ment of Bohlman Road.
On this basis, Chairman Norton directed UP-120 continued to the next
.regular meeting on 8 May 1967.
B. C-105 - Ge'orge W. Day Construction, Allendale Avenue - Request for
Change of Zoning from "R-i-40,000" (Single Family Residential)
to "R-i-20,000" (Single Family Residential) - Continued from
10 April 1967
The continued'hearing on C-105 was resumed at 7:46 P.M. The Secretary
briefly reviewed this matter and advised that there was nothing new in
the file.
Mr. Jim Day was present to represent the applicant .and stated that he
had no further co~ent at this time.
There was no one else present who wished. to comment with regard to this
application. ..
Commissioner McFall read the report of the Subdivision Committee of
24 April 1967, recommending that the requested Change of Zoning be
approved subject to the conditions listed in said report.
In answer to a question raised by Commissioner O'Rorke, the Secretary
advised that there is a possibility that road improvements on Allendale
Avenue may have to be increased to 64~feet on a 90 foot right-of-way
(in lieu of the proposed 40 foot widening on a 60 foot right-of-way)
on the basis that the street traffic volumes along Allendale Avenue
have been under estimated.
I/~. Jim Day explained that.he realized that there may be a possible
change in the street width of Allendale Avenue and that the homes
to be constructed,.facing Allendale Avenu~ would be set back further
than the required 30 feet.
After discussion, Commissioner Crisp moved, 'seconded by Conunissioner
Kasne~ that the public hearing on C-105 be closed; motion ~arried
unanimously and the.hearing was closed at 7:54 P.M.

Commissioner McFall moved, seconded by Commissioner Smith, that the
Subdivision Co,mmittee of 24 April 1967 relative to C-105, recommending
.approval, be approved and transmitted to the City Council as the
recommendation of the Commission; motion carried unanimously.
C. C-106 - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning
from "A" (Agricultural)' to "R-M-3,000" (Multiple Residential) -
Continued from 10 April 1967
The continued hearing on C-106 was re-opened'at 7:58 P.M. Commissioner
McFall requested that this matter be continued to the next regular meet-
ing to allow time to take the matter into consideration at a study session.
· There was no one present who wished to speak with regard to this mztter.
The Secretary read a petition filed previously (and resubmitted at this
time) in support of the subject application and signed by seventeen (17)
merchants of the Quito Shopping. Center.
After discussion, Chairman Norton (8:00 P.M.) directed C-106 continued
to the next regular meeting on 8 May 1967.
D. UP-130 - R. B. Beers, Sobey Road .- Request for Use Permit for the Keeping
of One (1) Horse - Continued from 10 April 1967
The continued hearing. on UP-130 was resumed at 8:01 P.M. The Secretary
briefly reviewed this application and advised that nothing further had
been added to the file.
The applicant was present but stated that he had no further comment at
this time.
There was no one in the audience who wished to speak with regard to
this application.
The Secretary then read the Staff Report pertaining to UP-130, recommend-
ing, with concurrence of the Subdivision Committee,. that the Use Permit
be granted subject to the conditions listed in the Staff Report.
Chairman Norton explained that the stable,~nich is connected to the main
residence by a continuous building consisting of a car port and.storage
room, will have to be considered either part of the dwelling or nor part
of'the dwelling and it was up to the Commission to make that interpretation.
He further stated that if it was decided by the Commission that the stable
was part of the dwelling then i't would be in violation of Ordinance NS-3
with'regard to setback requirements.
After further discussion, Commissioner McFall moved,. seconded by Commissioner
Kasner, that the public hearing on UP-130 be closed; motion carried unanimous-
ly and the hearing was closed at 8:08 P.M.
Commissioner McFall moved, secohded by Com~issioner Smith, that the Staff
Report of 24 April 1967 relative to UP-130, be approved and that the.' "r~
Use Permit be granted subject to the conditions listed in said report;
the motion carried with the following vote:

.Commissioner Johnson explained that, he felt, this application would set
a precedent and similar requests would be forthcoming.
E. V-292 - Rayne Soft Water, Saratoga-Sunnyvale Road - Request for Variance
in Connection with Sign Location - Continued from 10 April ].967
The continued hearing on V-292 was re-opened at 8:11 P.M. The. Secretary
briefly reviewed this file and stated there was nothing new in the file.
The applicant was present but Stated he had no further comment at this
time. =
.There was no one else present who wished ~o speak with regard to this
matter.
Commissioner Kasner read the report of the Variance Committee pertaining
to thi~ matter, recommending that V-292 be denied.
.Commissioner Johnson advised that paragraph 2. .line 4~ .of the subject
report should be changed to read "due 24 April 1967V.
The applicant inquired as to what his alternative was.:~ stating that he had
purchased a business license, but without proper signs nobody could locate
his place of business.
Chairman Norton explained that a joint sign arrangement (to be worked out
with the owner of the property and the applicant) embodying'proposed sign
area for all existing and proposed business establishments in this center
could be Submitted to the Con~nission for consideration.
At 8:20 P.M. Commissioner Crisp moved, Seconded by Commissioner johnson,
that the public hearing for V-292 be closed; motion carried unap~mously.
Commissioner Crisp moved, seconded by Commissioner Kasner, that the report
of the Variance Committee of 24 April 1967 relative to V-292 be approved,
as amended, and that the Variance be denied since the findings required
by Ordinance NS-3,.Section 17.6' cannot be made; motion carried unanimously.
F. C-71 - ~xmar Investment Company, Walnut Avenue - Request for Change of
Zoning from "R-1-12,500" (Single Family Residential) to "R-M-3,000
P-C" (Multi-Residential. Planned Community) - Continued from 10 April
1967
The Continued hearing on C-71 was resumed at 8:24 P.M. The Secretary briefly
reviewed this file and advised that a letter filed in opposition to this
request had been received from l~. Oberhaus~- ~f Alt~ Vista Avenue. He further
advised that the applicant had submitted a letter requesting his request for
Change of Zoning be changed to read R-M-3,000 instead of R-M-3,000 P-C.

There was no one present to represent the applicant.
There was no one else present who wished to comment with regard
to this matter.
Commissioner McFall stated the Subdivision Committee met with the
applicant to discuss this matter and then reguested that this matter
be continued to allow°~time fo~ further study and review of this
r.equest.
After discussion, Chairman Norton (8:32 P.M.) directed C-71 continued
until the next regular meeting and referred. the matter to the Subdivision
.. Committee for further study.
G.' V-293 - Harry Maynard, Springer Avenue - Request for Variance in Connection'
x~ith Lot Size, Lot Width and Frontage Requirements
.. " The public hearing on V-293.was opened at 8:33 P.M.i The Secretary advised
that Notices bf Hearing had been mailed and then read a communication from
' 1) Mr. & ~ms. Joe A. Foster 2) Mr. & Mrs. Leland Bice, of Springer Road and.
3) Mr. & Mrs. H. Arnold Mercer filed in opposition to this application.
The applicant was present and stated that it was his intention to erect
a structure that would be.adaptable to this long narrow.lot.
There was no one else present who wished to comment with regard to this
matter.
After discussion, Chairman Norton (8:41 P.M.) directed V-293 continued to
the next regular meeting and referred the matter to. the Variance Committee
for study and a report at that time.
Commissioner Crisp, on behalf of the Variance Committee, made an appointment
with the applicant for an on-site inspection at 8:30 A.M., Saturday, 29 April
1967.
H.. C-104 - Roy Kosich, Saratoga Avenue and Radoyka Drive - Request for
Change of Zoning from "R-l-10,000" (Single Family Residential)
to "C-N" (Neighborhood Commercial) and from; "R-l-10,000" (Single
Family Residential) to "R-M-4,000" (Multi-Family Residential)
The public hearing on C-104 was opened at 8:42 PoM.: The Secretary
1) stated that a Notice of Hearing had been published 2) briefly
reviewed this application and 3) advised that the applicant had
requested permission to show some slides.
Mr. Foust, architect, proceeded to show the slides that indicated:'
1) Similar arrangements as the ones proposed.

Chairman NortoA stated that 1) at the present· time the General
Plan did not call for this type of development and 2) the General
.' Plan specified that there should be a sharp cut-offZ here rather
than a transition.
Mr; Foust explained that 1) this particuiar piece of property was
bordered by Commercial area, San Jose, and the Lawrence Expressway
therefore, there are many difficult problems involved in trying· to
develop this parcel since it is not suitable for residential use.

Mr. Ed Demmler, of the Saratoga Park Woods Association, was present
and submitted, and read, a communication from R. G. fMensor, President
of the Board of Directors of the Saratoga Park Woods Association,
stating their arguments..; against this proposed Change of Zoning.

II. H. C-104 - Continued
In answer to an inquiry from Chairman Norton, Mr. Foust explained
that about ninety (90) units, with approximately seventy-four (74)
apartments, were planned for this development.
Fir. Latham w~s present and stated that'the slides tha~ were 'shown
were taken in an area located on San Antonio Road near E1Camino
· . '.in Los Altos and were developed as condominiums rather than regular·
apartments.
Mr. Dell L. Hathaway, 12511 Saratoga Avenue, was present and
· stated that 1) his residence was situated two (2) blocks from
the proposed project 2) the traffic is much too heavy along ..
this area and 3) if this Change of Zoning were appr0ved the
traffic would· be a serious problem.
After further discussion, Chairman Norton (9:09 P.M.) directed
C-104 continued to the next regular meeting and referred this
matter to the Subdivision for further study.

Iii. BUILDING SITES AND SUBDIVISIONS
A. SDR-674 - West Valley Baptist Church, Allendale & Fruitvale Avenues -
Buildin~ Site Approval ~ 1 Lot - Continued from 10 April 1967
Commissioner McFall advised that the applicant had requested that this
matter be continued to allow time to work out the street improvements
with the Director of Public Works in accordance with the new plan.
Chairman Norton so directed.·
B. SDR-685 - Dr. Michael D. Kowitz, Pike Road - Building Site Approval -
1 Lot - Continued from 10 April 1967
Commissioner McFall recommended that this matter be Continued to the next
regular meeting to allow the applicant adequate time~to submit a site
... development··plan.
On this basis, Chairman Norton directed SDR-685 continued to the next
regular mpeting.
C. SDR-687 - Richard V. Beck, Carnell Avenue - Building Site Approval.-
1 Lot :
There was no one present to represent the applicant and the Secretary
stated that h~ had attempted to contact Mr. Beck by phone (to discuss
the conditions of approval) but was unable to do so.
.Commissioner McFall advised that conditions of approval were standard
and 'called attention to the Note listed in the Building Site Committee
Report of 24 April 1967 relative to setback requirements with regard
to the proposed gasoline pump and house shown on Exhibit "A".
After discussion~ Commissioner McFall moved, seconded by Commissioner
Smith, that the Building Site Con~nittee Report of 24 April 19'67 relative
.. to SDR-687 be adopted~and that the tentative map (Exhibit "A", filed
12 April 1967) be approved subject to the conditions set forth in said
report; motion carried unanimously.
D. SDR-688 - Harry Maynard, Sprin5er Avenue - Buiidin5 Site Approval - 1 Lot
Commissioner McFall recommended that this matter be continued to the next
regular meeting since approval for this applicationwas contingent.upon
the decision reached with regard to V-293.
In view of the foregoing, Chairm~n Norton directed this matter continued
to the next regular meeting on 8 ~y 1967.
E. SDR-689 - Dr. Clemmer Peck, Ten Acres Road - Building Site Approval -

Commissioner McFall advised that a site development plan was necessary
in'order. to process this application and suggested, with concurrence of
the. Subdivision Committee, that this matter be continued to the next
regular meeting on 24 April 1967.

III. E. SDR-689 - Continued
The applicant and his architect, ~.· W~rren Heid, were present and
}~. Held made the following com~entS:
1. The applicant hoped that by informing the Commission
of the following facts some decision could be reached
· at this meeting since time ,was short because of property
" negotiations.
2) The main l~ouse now located on the site will be remodeled.
and is worth~i!e saving.
3) There are about 40,000 bricks on this property and 40%
to 50% can still be used.
4) There are two other dwellings on this property:
a) a guest house ~ith a kitchen built
around 1935 and
b) a caretaker's cottage with a kitchen
built around 1952
5) The development on this property w~s started in 1933-34
and was buil~ above present day construction standards.
6)This property maintains its own water and electrical
supply and has a septic tank.
7) The applicant!is interested in 1) living on the twenty-one
(21) acres and would provide a connection to Chester Avenue
at the time he subdivides this property and 2) having the
structures remain in their existing locations.
Commissioner Crisp 1) stated that it would be necessary to dedicate some
property for future road improvement and 2) suggested that the applicant
and his representative meet with the Subdivision Con~ittee to discuss same.
Commissioner McFall ~uggested that the applicant submit'·a revised map showing
the right-of-way and explained that without a complete se~ of plans it
difficult to reach a decision.
Chairnmn Norton explained that there ·need to be so~e arrangements n~de with
regard to the driveway approach,· road dedication and use of the additional
homes located on the premises.
Dr.P~ck stated that he was not particularly anxious to cut new roads through
the property especially since there were roads available that were serviceable.
After further disucssion, Chairman Norton directed this matter continued to
the next regular meeting and referred same to the Subdivision Committee for
further study.
F. SDR-690 - Allen B. Creek~ Marion Road - Buildin~ Site Approval - 3 Lots
The applicant was present and 'expressed satisfaction with the proposed
conditions of approval.
Commissioner McFall moved, seconded by Commissioner Smith, that the Building
Site Committee Report of 24 April 1967 relative to SDR-690 be adopted and
that the tentative map (Exhibit "A", filed 14 April 1967) be approved subject
to the conditions set forth in said report; motion carried unanimoulsy.

IV. DESIGN REVIEW
A. A-246 - Church of Jesus Christ of Latter Day Saints, Allendale Avenue
- Final Design Review - Church Building - Continued from 10

Conmissioner O'Rorke briefly reviewed this file and then the Secretary
read a communication filed by A. L. Hansen of Dolphin Drive stating his
objections and proposed changes with regard to this n~tter.
Commissioner O'·Rorke advised that the Design Review Corm~.ittee had met
with ~,~. Hansen and the applicant (on separate occasions) to discuss
the contents of the letter submitted by 14-. Hensen. He further advised
that as a result of these meetingS. the following conclusions were reached
by the Design Review Committee:
1) The property is to be landscaped as shown on Exhibit "B".
2) The landscaping sha]·l,be completed 18 months from the
date of issuance of a Building Permit.
3)A 6' fence shall be placed on the east side of the
boundary of the church.
· ·· 4) The planter strip sho~m on the east side of ~he p·roperty
be increased from 3' to 5'.
After further discussion, Commissioner O'Rorke moved, seconded by
Commissioner Kasner, that Final Design approval be granted in connectio~
with A-246, Church of Jesus Christ of Latter Day Saints, as shown on
E~hibits "A" and "B" and subject to the above stated conditions; motion
carried unanimously.
B. A-249 - Pacific Shore Properties, ProspeCt and Via Roncole - Final Design
Review - Subdivision HOmes
Commissioner O'Rorke briefly reviewed this application an~ stated that
the Design Review Co~it'~ee had met with the applicant to discuss this
~tter and found that all plans meet the Design Review standards.
The Secretary then read the Staff Report relative to A-249 recommending
· . that Final Design Review be granted on the basis of Exhibit "A" through "E".
After discussion, Commissioner O'Rorke moved, seconded by Commissioner
Kasner, that Final Design approval be granted in connection with A-249,
· Pacific Shore Properties, as sho~.m on 'Exhibits "A" though "E" subject
to the conditions stated in the Staff Report 0f 24 April 1967; motion
carried unanimously.
V. CiTY COb~CIL REPORT
Commissioner McFall gave a brief report on discussion and action at the City
~Council meeting on 19 April 1~67 with emphasis on items of particular interest
to the Commission. He noted that .one occurrence of particular interest ~s the
presentation of a large mosaic plague of the City of Saratoga Seal by the Girl
Scouts.

VI. NEW BUSINESS
A. SDR-609 , John Lyngso, SaratoBa-Sunn~vale Road - Request for Extension
The Secretary Briefly reviewed this application and then read the Staff
· Report, relative to this matter, recommending that the request for exten-
sion be granted until 24 January 1968 subject to the following new condi-
tions:
· 1) Offer to dedicate 20 feet along Manor Drive
for entire frontage.
· 2)· Perform obligations of. agreement made with
Lindsay concerning the completion of Manor Drive.
After discussion, Commissioner Crisp moved, seconded by Commissioner
Kasner, that the Staff Report of 24 April 1967 relative to SDR-609
be approved and that the extension be granted·subject to compliance
with the two new conditions set·forth in said'report; motion carried
unanimously.·
VII.· OLD BUSINESS
A. SDR-678 - Dr. John E. Cox, Jack'S Road - Request for Modification of
Conditions - Continued from 10 April 1967
The Secretary briefly reviewedlthis request and then read the Staff
. Report of 24 April 1967 recommending that Condition II-A of the Build-
ing Site Committee Report of 13 March 1967 be modified to read:
"Widen road paving on Jack's Road and minimum
access road to 18 feet to provide 100 feet of
frontage for each lot, using oil and screening
on 6-inch AB where grade is less than 15% and
using 2-inch PMS on 6-inch AB where grade exceeds
'15% from Big Basin Way to end of joint use of
access road (approximately 540 feet) as·approved
by Director of Public Works."
After discussion, Commissioner McFall moved, seconded by Commissioner
Smith, that the Staff Report of 24 April 1967 relative to SDR-678,
· recommending approval of the subject request for modification, be
approved and transmitted to the City Council as the recommendation
of the Planning Commission; motion carried unanimously.=
B. SD-478 - Claude T. Lindsay, Cox Road - Request for Extension - Continued
from 10 April 1967
The Secretary briefly reviewed this application and then ·stated
that the City Attorney had advised that this request'for extension could
not be approved since an extension had previously·been granted.
After discussion, Commissioner Smith moved, seconded by Commissioner
Crisp, that the request for extension in connection with SD-478 be
denied; motion carried unanimously.

C. ITEMS FOR STUDY SESSION
· ·Commissioner McFall stated that he would like to propose several
· .items·for discussion at a study session at which the entire Commission
'.'. would be. present namely:
1) The proposed Horse Ordinance ..
'· 2) The various applications submitted
for Multi-Residential Zoning (Kosich,
MVS Company, Maxmar etc.)
After 'discussion, Chairman NOrton recommend'ed that the Horse Ordinance
~. be scheduled for:<~.L~Study Session and that the other matters be brought
up for discussion'as soon as possible at a regular Planning Commission
meeting.
Commissioner ·Smith advised that the applicants such as Kosich, Maxmar,··.
and MVS Company have spent a lot of time and gone through a lot of
expense and some decision should be reached as to how mu~b acreage
should be allowed for Multi-Residential and if thejCity i~ ready for
this type of development.·
Commissioner Kasner stated that, perhaps, these applications were
coming before the Commission at this time for the Sole purpose of
getting an opinion from the Planning Commission prior to the General
Plan Review. '.'. "
Commissioner Johnson suggested that statistics regarding apartment
rentals in the surrounding areas be obtained as a format to use in
making a decision. ~, .'
After further discussion, Chairman Norton directed, with concurrence
of the Commission, that a Study Session be held to~discuss the Horse
Ordinance on Friday, 5 May 1967 at 7:30 P.M. in the 'Redwood School .'
located on Fruitvale Avenue. ".
VIII .. 'COMMUNICATIONS
A. WRITTEN
.1. REQUEST FOR ADDITIONAL USE
The Secretary read a communication from Mr. Clarence W.
Neale requesting that permission be granted to~move the'
Chamber of Commerce into one of the vacant offices in
Neale~s Hollow on Saratoga-Sunnyvale Road.
Commissioner McFall recommended that this request'be denied
since this additional use is not permitted under the existing
zoning on this property.
Commissioner Kasner suggested that this matter.be added to
Mr. Neale~s existing list of.requests scheduled for consider-
ation at the. meeting of 8 May 1967. ..

In view of the foregoing, Chairman Norton directed the
.. Secretary to inform Mr.'Neale that this request be continued
to the next regular meeting on 8 May 1967.
2. MORTUARY FACILITY
The Secretary read a short note submitted by Alan A.
" Alameda requesting that Mortuary Facility be added to
· ' the list of permitted uses in the 'C-S Zoning.District'.
· ' ." .' After discussion, Chairman Norton directed that this matter
· ' be placed on the .agenda as an Informal Hearing for the 'meeting
" on 8 .May 1967.
B. ORAL
The Chairman acknowledged, with pleasure, the presence of
