I. ROUTINE ORGANIZATION
The meeting was called to .~rder by 'Vice Chairman Johnson.

Commissioner McFall moved, seconded by Commissioner Smith, that the
reading of the minutes of the ·11 December 1967 meeting be waived and
that they be approved as distr. ibuted to the Commission; motion Carried
unanimous ly. · ' . .
II. PUBLIC HEARINGS
A. C-110 - Franklin Homes Company, Fourth Street at Saratoga Creek -
Request for Change of Zoning from "R-M-4,00OX" (Multi-Family
Residential) to "R-M-3,000" (Multi-Family Residential) -
Continued from 11 December 1967
The hearing was opened at 7':32 P.M.
Commissioner McFall stated that the applicant was not present since
he was.aware (after meeting with the Subdivision Committee) that no
action would be taken relative to C-110 at this meeting and then
recommended that C-110 be continued to ailow the Committee time to
meet again with the applicant .prior to preparing a report for the
meeting of 8 January 1968.
Mr. Sam Hernandez, local mote]. owner, asked if the development would
be strictly an apartment complex or would it include' motel units?
Commissioner McFall explained that the applicant proposed 1) a common-
green, cluster-apartment development and 2) an adult community with .the
density permitted under R-M-3,000 zoning. He further explained that the
applicant at one time proposed to provide two or three rooms to accomodate
guests and relatives of the occupants' in the ·development but 'this proposal
is not included in the present plans.
i,~.' l~ernandez explained that 1) he welcomed open-competition 2) if the
above mentioned aCcomodations were permitted it would be. an unfair method
of taking business away from him·and 3) he felt this development (without
tb~
,e guest accomodations) would definitely be an. asset to the City.

B. V-313 .-. Pete Pasetta, Saratoga-Los GatosRoad - Request for Variance
" -in Connection 'with Side Yard Setback Requirements '
".'. The Chair~n opened the hearing relative to V-313 at 7:37 P.M. The
Secretary stated that the Notices of Hear.ing were mailed and.then
"." briefly reviewed the subject application.
The applicant was present and Stated that i) he built his present
house (located in the hai~-acre' Zoning) without a garage 2) the
proposed garage location would De 264-feet back from the.highway
3) with this arrangement only 2-feet would remain for the side
yard setback since anymore would interfere with the driveway 4) his
property is composed of 3.8 acres.
In answer to inquiries from Commissioner O'Rorke, Mr..Pasetta explained
that 1) the property adjoining his own is owned by Dr. and Mrs. Pace
'and 2) .the topography of the subject property is 'level.
Dr. Sam Pace, 20271 Saratoga-Los Gatos Road, stated that 1) his
property encompassed about one-half of Mr. Pasetta.'.s property 2) he
felt that since Mr. Pasetta had nearly four-acres of land it seemed
it would be possible to build a garage without a Variance of the pro-
posed size and 3) a letter he submitted states the reasons he and Mrs.
Pace were objecting to the subject application.
The Secretary, ~t the reques[ of Chairman Johnson, read the letter
filed (by Dr. and Mrs. Pace) in opposition to the proposed Variance.
Mr. Pasetta stated that l) he cou'ld not find anything in the Zoning
Ordinance that governed his particular application 2) the Ordinance
.states that an accessory structure can be built on the property line
3) he is only asking approval to build a garage in the only place
suitable on his property and 4) he felt his request is in accord with
what the Saratoga community is' trying to accomplish.
Commlssioner McFall moved, seconded by Commissioner Crisp, at 7:45 P.M.
to close the hearing for the even~:n~; motion carried unanimously.
M~-. Pasetta requested that V~313 be continued to the'meeting of
13 February 1968 since he would be Unavailable to attend a meeting
prior to that time.
I~ view of the foregoing, Chairman Johnson directe~ that V-313 be'
continued off the agenda until the meeting. of 13 February 1968.'...
III. BUILDING SITES AND SUBDIVISIONS "' ~

· Commissioner McFall'stated that the'applicant has reviewed the proposed
conditions a~d expressed satisfaction of same.
" Commissioner McFall moved, seconded by 'Commissioner Smith, that the
.Building Site' Committee Report of 26'December 1967.relative to SDR-725
be adoptedand that the tentative map (Exhibit "A", filed 8 December 1967)
be approved subject to the conditions set forth'in said report; motion
carried unanimously.

Commissioner McFall stated 'that the applicant was present'and had
expressed satisfaction with the proposed conditions of approval.
After discussion~ Commissioner McFall moved,.seconded by Commissioner
Crisp, that the Building Site Committee Report'of 26 December 1967
relative to SDR-726 be adopted and that the tentati've map (Exhibit
"A", filed 15 December 1967) be approved subject to the Conditions
set forth in said report; motion carried unanimously.

A. A-268 - Kirby M. Caseb01t, Big Basin Way - Final Design Review -
Identification Sign
Commissioner O'Rorke~ stated it was his understanding that the inform-
.. · ,. ation submitted for review is insufficient and a recommendation has
not been prepared for that reason.
The Secretary stated that the members of the Design Review Committee
did not meet to review the proposed plans'since it is necessary for
Mr. Flanagan (developer 'of th~ shopping center in which the proposed
sign is to be located) to submit plans showing the overall picture.

On this basis Commissioner O'Rorke recommended that A-268 be continued
to the next regular meeting. ..

Commissioner O'Rorke stated that the minut'es of the City Council meeting
of 20 December 1967 had been distributed and he had no further comments.
