Commissioner Crisp moved, seconded by Commissioner Lively, that the

Secretary stated nothing further had been added to the file.
The Secretary read the Staff Report dated 10 June 1968 recommending
that C-liB be denied.
'Chairman Johnson, in answer to an inquiry from the applicant, stated that'
C-113 will be forwarded to the City Council and another public hearing
will be held.
No one in the audience wished to comment.
Commissioner Crisp ~:38 P.M.) moved seconded by Commissioner Kasner,
that the public hearing for C-1!3 be closed; motion carried unanimously.

The hearing relative to C-!14 was resumed at 7:40 P.M. The Secretary
stated nothing new had been added to 'the file.
No one in the audience wished to comment.
The Secretary read the Staff Report dated 10 June 1968 recommending
that C-!!4 be approved.
At 7:z~3 P.M., Commissioner Kasner moved, seconded by Commissioner
Crisp, that the public hearing relative to C-114 be closed; motion
carried unanimously.
Commissioner Crisp moved, seconded by Commissioner Lively, that the
Staff Report dated I0 June 1968,'.r. ecommending.that C-114 be approved,
be adopted,//an~j~'that subject rezoning be recommended for C~j~X_~__v.~!~ to
the City Council on the basis that the subject request.'conforms with
the 1968 Sara.toga General Plan and meets the requirements of Zoning
Ordinance NS-3, Section' 1.1; motion carried unanimously.
C. UP-!50 George W. Day, Allendale Avenue - Request for Use Permit to
· Allow a Model Home Sales Office Continued from 27 May 1968
The Chairman re-opened the hearing relative to UP-150 at 7:44 P.M.
The Secretary stated that the applicant has modified his original
application (requesting an Administrative Sales Office) to now request
a Model Home Sales Office. The Secretary then read a communication
received from _~. Vincent Faso, General Construction Manager, explain-
~n~,' what functions would be conducted in the Model Home Sales Office
The Secretary then read the Staff Report dated 10 June 1968 recommending
that the request for a Use Permit for a Model Home Sales be granted. sub-
ject. to the conditions stated in said report.
?~ Faso app!icant's representative~ was present aria stated he had
no objections to the conditions stated in the subject report.
After discussion, Commissioner Kasner m..oved at 7:47 P.M., seconded by
Co~nissioner Crisp, to close the hearing for UP-150; motion carried
unanimous iy.
Commi'ssioner Metcalf moved, seconded by CommissiOner Crisp, .that' the
Staff Report of '!0 June 1968 be adopted and the Use Permit e-granted
in accordance with .said report and subject o the cond~t~ ns st te

D. SI~LL PET ORDINANCE - Pro~6sed Amendment to Ordinance .No. NS-3 Relating
to the. Keeping of Cer. tain Birds and Small M~n~mals
as Pets in "R:'-Districts - Continued from 27 May
1968
The Chairman opened the hearing at 7:48 P.M.
The Secretary 1) stated the City Attorney has corresponded with
Commissioner Kasner and 2) read an addendum (Section 8-15.3) reconm~ended
by the City Attorney for addition to the original proposed ordinance and
a letter submitted by the City Attorney dated 3 June 1968.

Ii. D. SMALL PET ORDINANCE - C'O~T!NUED
~. Martin, Prides Crossing Homeox~aers Association, stated I) the Board
of Directors voted to support this ordinance since they do not feel the
County Ordinance is adequate and 2) the residents of this area have
complained that dogs running loose have attacked animals that were on
leashes while being walked by their o~ers.
The Secretary, in answer to an inquiry from Chairman Johnson, stated that
this ordinance will be published in the newspaper if it is adopted by the
City Council upon the recon~mendation of the Planning Commission.
Chairman Johnson stated that the public should be made aware of what the
ordinance contains and it should get sufficient publicity prior to the
City Council hearing.
Co~missioner Kasner stated that 1) the Planning Commission has held
numerous public hearings relative to this matter 2) Notice of these
· hearings have been in the newspaper 3) the Health Department has become
aware of this' ordinance through publicity 4) he felt there has been
sufficient publicity "~":~i's.:-m~-~ter.._a~__~) when it goes before the
City Council a'~Notice"shou!d be published, to make the public aware
of the forthcoming hearing.
The Secretary, in answer to an inquiry from Commissioner Lively, stated
that the ordinance has not been published in its present form.
Co~nissioner Kasner explained that it would be costly to publish this
entire ordinance and it is the responsibility of each interested citizen
to attend the meetings in order. to acquaint themselves with the proposed
ordinance.
The Secretary advised that the Notice of Hearing that is published states
that copies of the.proposed ordinance are available at City Hall for anyone'
who is interested in obtaining a copy.
At 7:50 P.M., Comnissioner Kasner moved, seconded by Commissioner Crisp,
that the hearing relative to the Small Pet Ordinance be closed; motion
carried unanimously. :
Commissioner .Crisp moved, seconded by Commissioner Kasner, that a Resolution
be prepared containing the proposed S~all Pet Ordinance and the addendum
(Section 8-15.3), an amendment to Zoning Ordinance NS-3, and that said
Resolution be forwarded. to the City Council as the recommendation of the
Planning Commission; motion carried with the following vote:

E. V-318 - Evelyn O. Geoffroy, Komina Avenue - Reques't for Variance in
Connection With Corridor Width-Access Road and Side Yard Setback
Requirements
The baaring relative to V-318 ~s opened at 8:04 P.M.
~. Warren Heid, architect represen.ting the applicant, stated that 1) new
drawings have been submitted 2) the property is restrictive because of the
narrow width of the corridor 3) the parcel is located close to the village
and 4) the applicant would like to utilize this property in some ~y.

Dr. Barney Rosasc·o, resident of the area, stated 1) he was a neighbor
of the applicant 2) he ~as opposed to this application 3) this would
be opening up the back yard of the applicant and other residents in the
. neighborhood 4) if this application is approved it will present problems
and 5) he. urged the. Planning Cormmission to deny this request.
~k'. P. W. Brubaker, 14725 Aloha Avenue, stated 1) his back yard would
be right up to the rear of this property 2) the previous owners brought
this same type of application before the Planning 'Commission and it was
denied and 3) he was opposed to this request for Variance.
The applicant, M~s. Geof~oy, I) stated she did not understand the
objections raised by Dr. Rosasco and 2) invited the members of the
Planning Commission to visit her property.
~. Brubaker, in answer to an inquiry from Commission Kasner, stated
that both he and Dr. Rosasco o~,m. ed ~:IT~,50O-square foot lots.
At 8:15 .P.M., Chairman Johnson closed the public hearing for the evening,
directed V-318 continued to the next regular m.ee.t.~._n_g, and referred same
to the Subdivision Committee for study.~.
Con~missioner Crisp, on behalf of the Variance Committee, arranged an
appointment with M~. Heid and the applicant for Saturday at 8:00 P.M.
on 15 june 1968 for an'on-site inspection of the property. He, also,
invited Mr. Brubaker and Dr. Rosasco to attend.
F. b?-15! - James R. Davi, Souse Lane - Request for Use Permit to Allow a
Convalescent Hospital
The hearing relative to UP-15! was opened at 8:17 P.M. The Secretary stated
the Notices of Hearing were n~iled and then read a con~nunication from the
applicant explaining why the previous Use Permit (UP-104) relative to this
matter expired.
I,~r. Cuenca,-.~.Sousa Lane, stated he would like more information relative
to the road wi~en'~ng"on-~-Sousa_..I~__ne in connection with this project.
The Secretary showed the plans, relative to UP-151, to M~. Cuenca. He
then asked Mr. Ben White, engineer fo½ the applicant, to explain the
road-widening plans to M_~. Cuenca.
No one else present wished to comraent.
Chairm~n Johnson, at 8:19 PoM., closed the hearing for the evening,
directed the matter continued to the next regular meeting, and referred
same to the Subdivision Co~nittee for study.
G. VISITOR CO~,iERCIAL - ProDosec] New Visitor Commercial Zoning District
The hearing ~ras opened at 8:20 P.Mo The SecretarX briefly reviewed this
matter and then read .·" communication recieved from ~. Abel M. Carreia,
stating that if the change to 'Visitor Con~mercial does not void the present
permitted uses on'.his property he has no objection to the proposed change.
Commissioner Crisp stated that the City Attorney has not yet put this
ordinance into legal form;· therefore, he, with concurrence of the Sub-
division Con~nittee, recommends that this matter be continued to such
time as this ordinance is ~r~-itten up in legal form by the City Attorney.
Chair'man Johnson closed the hearin.g for the evening at 8:30 and directed
that the matter be continued to the meeting of June 24, 1968.

b'h~. David Franklin was 'present and stated that it had been nine to ten
months since 'they started working on this site' approval and had done
ever3,~hing asked of' them'. He had worked with his architect and at the re-
quest of the ~bchitecturai Co~Fmittee had made changes and the plans were
approved and the Site Committee ~,:~hich approved~ subject to Flood Control
approval~ and after receivinfg w~j- from Flood Control today, he feels a
little '~ '
...... ~ about the matter. He stated that his architect will mzke
.whatever changes the Co~mission wants~ but he would appreciat~ a letter
from the Commission as to 'what i't wants. He further stated he had
~.zorked with Public Works on design of streets and tried to do everything
asked of him~ but said he needs a letter from the Commission specifying
what they ~.~s~+ in the

. Chaii?ma.n johnson asked i'f all problems had been solved with Flood Control
anS~ Commissioner Crisp stated that they had not been solved but it is

the Commission has held him up. He asked the Secretly if some sort of
answer could be given to Iv~. Franklin by the end of the week. The Secre-
tary said that it could be done within a couple of ~ys.
Nr. Franklin asked that .the letter also sho~j .where this Flood ContrOl
~ainwould be and whether the streets could be narrowed~ in view of this.

more money on more plans because ever~hing may change~ ~d tb~t is why
he needs a letter.
The Secretary also mentioned that there is a time limit for the Planning
Commission to act since this application expires on june 13th~ and that
an extension would be needed by Mr. Fraiilin.
The Chairman agreed that~ under the conditions~ this Would be the appro-
priate thing ~o do.
!;'~~. Franklin said that he had already informed P~. Walker that they are

Chairman johnson directed that. SDE-732 be continued until the next
meeting~ s~oject to receipt of a grant of extension of time from Franklin

Dr.Abra.ms sffbmitted two letters requesting extension '1) requesting exten-
sion of .0-43~ Medical Village of Saratoga for one year from the current
expiration date for 'both zoning and subdivision approval~ and 2) requesting
ex'~ension of C-I06~ MoVoSo Company (a~artments) for one year.
The Secretary stated that since these matters are somewhat complex~ he
would recommend that they be referred to the Subdivision Committee for
clarification with 'the City Attorney ~ and a report at the next meeting.
