The meeting was called to order by Chairman Norton.

Chairman Norton said that he had received a postcard from
Commissioner Smith from Virginia saying he would be back on
the 15th, and asked if it would be appropriate to put him
back on the various committees?
Commissioner Crisp said the Subdivision Committee has a
meeting on the 15th, but can't have four people, and that
Commissioner Lively has. been filling in on the Subdivision
Committee.
Chairman Norton said that if it made no difference to the
Subdivision Committee, he would let it go as It is for the
present, and that Commissioner Smlth'will..be on deck when ..........
needed.
II. PUBLIC HEARINGS
A. C-115 - Edwin E. Cox, Cox Avenue - Request for Change of Zoning
from "A" (Agricultural) to "R-12,500" (Single Family
Residential) - Continued from 24 june 1968.
Commissioner Crisp said that there is one serious stumbling block
on this; that there is no objection to recommending the zoning
in question, however, on the tentative map there is a garage
repair shop, which is non-conforming. He said the Committee is
unwilling to go ahead without notifying applicant that if and
when it is approved, the garage be eliminated. He said that is
why a continuance is recolmmend'ed, and said that it would make
little difference in the time in getting the zoning.
Chairman Norton felt that the City Attorney should be consulted.
Commissioner Crisp said that they had consulted with the City
Attorney who stated we could make a condition concerning this
in recommending the chang~ of zoning.
Chairman Norton opened the public hearing at 7:47 p.m. and asked
the Secretary if he had anything to offer. The Secretary said "-
he did not-'at this time.
Paul Rose, Vice-President of Brown & Kauffman, said that it ....
was the intention of the parties to have a definite number
of lots required to support the garage use; that they are
unable to get the operator of the garage to sell at this time,
and not wanting to leave it out of ~ e map, it was left in,
and in original discussions with Mr. Walker and the Subdivision
Commit'tee, they said it could remain for a time, but since it
was outlined on the map, the operator would have to eliminate
the garage, then he would have conforming lots. Hopefully,
Mr. Rose said, they could brin9 him around to selling. He
said they would request that the map be approved for zoning,_.
excluding raw acreage that would be necessary for the Cox
Garage.

Chairman Norton ask&d for the advice of the Secretary, who
said it could be excluded so as not to necessitate another
notice and hearing -- that it is not adding to the application
-- but as a matter of policy, we should not exclude It.
Commissioner Crisp felt that further consultation would be
in order.
Chairman Norton closed the hearing at 7:50 p.m. and referred
the matter to the Subdivision Committee for a report at the
next regular meeting.
C-116 - Albert L. Hanson and Clayton F. Thomas, Allendale
Avenue - Request for Change of Zoning from ~'R-I-~O,O00"
(Single Family Residential) to "R-1-20,O00" (Single
FamilV Residential)
Chairman Norton opened the public hearing at 7:50 p.m.
The Secretary reported that notice was published and mailed;
that the applicant requests a change of zoning for two acres
located on Allendale, between Portos and Dolphin Drive. He
read a letter from Mrs. 3ohn R. Nickel favoring division of
the lots, stating that they were the closest neighbors to both
lots and saw no objection -- in fact, believed such action
would enhance the area.
Mr. Hanson was present representing the applicants. He offered
to answer any questions the Commission might have.
In response to a question from Chairman Norton, the Secretary
said that the zoning in this area has recently been changed
to R-1-20,O00, and that the other lots a~ready built on are
1-acre lots.
Chairman Norton asked Mr. Hanson if his property was built on
at this time, and Mr. Hanson said that he has a home on it.
In response to another question from the Chairman, Mr. Hanson
said that he felt' he could change the lot lines to conform
with the zoning.
The Secretary said that there didn't appear to be any need
for a variance.
Chairman Norton closed the hearing at 7:54 p.m. and referred'
.the matter to the Subdivision Committee for a report at the
next regular meeting.
UP-I~2 - Patricta A. McAllen, Quito Road - Request for Use
Permit to Allow a Day Care Nursery (Nursery I'School) -
Continued from 24 J~ne 1968
Chai'rman Norton reopened the public hearing at 7:55 p.m. and
the Secretary read a communication from Laurlds J.Hansen 'stat-
ing that he had no objection whatsoever to having the proposed
Day Care Nursery next door to his property.
Mr. and Mrs. McAllen were present but had no comments to offart
Mrs. Stinnet, who was in the audience, spoke in behalf of
granting this use permit, stating that this type of Nursery
Care is needed in this area. She said that she has a nursery
school and knows the problems and that this type of Nursery
Care school would be of particular value to working parents
because it would open earlier and close later than her own
nursery school.

Commissioner Crisp called for the staff report and Secretary
Walker read the ·report which reco~nended denial on the grounds
1) That present traffic conditions and projected future develop-
ment as a major expressway would be detrimental from a safety
standpoint; 2) Adequate offstreet parking would be difficult to
provide with good access points, and 3) The establishment of
this Nursery School would set an undesirable precedent of future
non-residential development along Quito Road.
Edward DudocR, a realtor, spoke from the audience and said
there are a number of schools of this nature -- one in Los
Altos, where there is much heavier traffic than Quito; another
at the corner of Los Gatos-Almaden Road; another at Meridian
and Isabel -- all with heavier traffic which is not a factor.
H. C. Biggs repeated his objection to the introduction of the
Nursery School since it would change the complexion of the area
generally, and further that traffic on Quito early in the
morning and in the evening was already difficult to negotiate
without increasing the load.
Chairman Norton closed the public hearing at 8:01 p.m.
Commissioner Lively said that the Planning Commission has shown
its desire to have Day Care Schools or Nursery Schools of this
type, but that the primary objection is location.
Chairman Norton said he was concerned because this is one of
those danger areas --a borderline area that is hard to maintain.
He asked the Secretary about requirements for parking, whether
it would be adequate.
The Secretary said that it was figured only from the number of
teachers and personnel and adequate loading and unloading area
and that it was sufficient.
Commissioner'Crisp moved approval of the staff report and re-
commended that the use permit be denied for reasons stated in
0 the report.· The motion was seconded by Commissioner Lively,
and carried, with Commissioner Kasner abstaining.
D. V-319 - Raymond A. Long, Sarahills Court - Request for Variance
in connection with Distance between Structures and Side
Yard Setback Requirements - Continued from 24 June 1968
Chairman Norton re-opened the hearing at 8:05 p.m. Mr.-Long was
present in his own·behalf and said that he had·nothing to say
but was there to answer any questions that· might arise.
Chairman Norton asked if anyone wished to be heard on V-319 and
there was no response.
Commissioner Crisp read a report from the Variance Committee
which recommended approval of the request for Variance.·
There being no questions or con~nents, Commissioner Johnson
moved and Commissioner Crisp seconded a motion to close the
hearing. The motion carried and the hearing was closed at
8:09 p.m.
Co~nissioner Crisp moved, seconded by Commissioner Johnson
that the report of the Variance Committee be approved and the ..
variance be granted subject to conditions recommended in the
report. The motion carried unanimously.

VISITOR COMMERCIAL - Proposed New Visitor Commercial Zoning
District - Continued from 24_June 1968
The public hearin9 was re-opened by Chairman Nortm at 8:10 p.m.
The Secretary read a communication from Sherman Miller, Presi-
dent of the Saratoga News Publishin9 Company, Inc., which
stated that he believed "Publishing and Printing Houses" should
be placed under Permitted Uses, instead of Conditional uses
in the Visitor Commercial District.
Chairman Norton saw no objection to Publishin9 and Printing
Houses bein9 included, but said it is not a specialty retail
use. He felt that the newspaper business is a nice, clean
industry. He said this was not aimed at restrictin9 news-
papers.
John Hayes, representing Dr. Oliver, said it seemed that the
Commission has neglected to take care of a problem which
exists for more people than just Dr. Oliver. 'He said that Dr.
Oliver and others have spent a lot of money to build structures
in the C-S area between Blue Hills and Azule, and he felt
there should be provision for amortization wherein, over a
period of time, the uses which were proposed at the time the
structures were built, can be amortized. He felt that the
present method is a travesty of justice.
Chairman Norton asked Mr. Hayes if he had prepared any language
suitable for use In accomplishin9 this, and he replied that
he had not, but volunteered to prepare it and convey this
material to the City as soon as possible.
Chairman Norton told Mr. Hayes that the Subdivision Committee
doesn't believe it would be proper to delay, however the
matter would have to 9° to the Council and that if he wished
to discuss it with the City Administrator and City Attorney
he could persuade the Council to give it more consideration.
B. T. O.aleb said he thought the whole commercial zonin9 of
Saratoga should be upgraded, with sufficient restrictions.
Chairman Norton said he believed it is designed to do that,
in line with research.

Commissioner Crisp moved, seconded by Commissioner Lively, that
the Ordinance now before the Commission, with the additional
use of furniture specialty, be approved ,and the resolution be
adopted, recommending the':proposed. C-V ordinance to the Council.
Commissioner Kasner said he felt the Commission should con-
sider the proposal by Mr. Hayes.and that he opposed the motion.
Chairman Norton said the desire is to upgrade the area. He
said he didn't know how difficult it would be to prepare an
amortization clause, but the suggestion made last time was
that a certain amount of administrative leeway might relieve
some of the shock. He felt that the objectives of the City
of Saratoga were betn9 met by this proposed Ordtnance~ and
he called for a vote on the motion. The motion carried, with
Commissioner Kasner dissenting.
Mr. Hays asked when this would come before the Council am
was told it would be the first Wednesday in August.

III. BUILDING SITES AND SUBDIVISIONS
A. SDR-?~2 - Franklin Homes Company, Fourth Street and Saratoga
Creek - Building Site Approval - 1 Lot - Continued

Chairman Norton ordered that this be continued until the next
regular meeting.

Chairman Norton asked if there were any questions or comments
on this matter.
Mr. Kirkham asked about item E of Specific Conditions which
specified the driveway approach should be 16-feet wide at the
property line, flared to ~ feet at the street paving and that
a double seal coat of oil and screenings or better on a 6-inch
base rock be applied.
The Secretary explained that this was only a few feet -- just
flared out.
Chairman Norton asked Mr. Kirkham what his present driveway
is and'Mr. Kirkham said there is no driveway there at present.
" The Secretary'said that the only part Mr. Kirkham would have
to pave is the driveway approach.
Commissioner Crisp moved, seconded by Commissioner Lively,
that t. he Building Site Committee Report dated 22 April 1968
relative to SDR-744 be adopted and that the tentative map
(Exhibit "A", filed 9 April 1968) be approved subject to the
conditions set forth in said report. He asked that the date
of the Building Site Committee Report be changed to 8 July 1968,
since that is when it was acted on. The motion carried unani;
mous ly.
C. SD-746 - Dr. Michael Stepovich, Sobey Road - Subdivision
Approval - 21 Lots - Continued from 24 June 196_8
Commissioner Crisp said the applicant is familiar with most of
the conditions but that Items 14 and 15 were added today.
Jack Kuzta, of MacKay and Somps, said he felt Item 14 would go
to the deed restrictions'.
Chairman Norton reminded applicant that no trees were to be cut
down, as covered in Ordinance N5-5, and that if it were neces-
sary, it should be taken up with the Public Works Department.
If this is in the deed restrictions, he said, it can't be varied.
Commissioner Crisp said that the Commission controls trees based
on the tentative map; that there is no control subsequent to
approval. He mentioned that recently, a beautiful Eucalyptus
tree was deliberately cut down, and this is an attempt to pro-
hibit further unnecessary destruction of trees. If the appli-
cant doesnit agree., he said, it could be taken up with the
Counc i 1. .,
Chairman Norton said the best answer is for Dr. Stepovtch to
file a letter with Mr. Walker.
Mr. Kuzta asked if Item 11 wouldn't cover Item 16.
Chairman Norton suggested that the Committee try to work it out,
and wondered if there .isn't some language t.hat would make 'it
easier to work with.
Mr. Mohr, realtor involved, said he could forsee difficulty
with the deed restrictions in this respect, and mentioned that
Palo Alto has 'an...ordtnance requiring certain handling on removal
of trees.

The Chairman asked the Secretary if he had a copy of that Ordi-
nance, and if not, could he get one. Mr..Walker said he believed
he had one.
Chairman Norton said that if there were any specific suggestions,
they should be given to the Committee, and Mr. Mohr said he
would try to get them to the Committee because, in his mind,
this presented a real question.
Commissioner Crisp moved, seconded by Commissioner Lively, that
the Building Site Committee Report relative to SD-746 be adopted
and that the tentative map (Exhibit "A", filed 28 J~ne 1968) be
approved, subject to the conditions set forth in said report,
and acknowledged that there will be further consideration on
Condition 14. The motion carried unanimously.
D. SDR-758 - Scott and Associates, Inc., Wardell Road - Building
Site Approval - 1 Lot
Chairman Norton order this continued until the next regular
meet ing.
E. SD-759 - Pete Rajkovich, Prospect Road - Subdivision Approval -
112 Lots
Chairman Norton ordered this continued until the next regular
meeting.
F. SDR-760 - Myra Benson, Boyce Lane - Building Site Approval - 1 Lot
Chairman Norton asked if there were any questions or comments
on this matter, and Mrs° Noggerath, who was in the audience,
said she didn't understand why a turnaround was necessary.
Chairman Norton said that it was so that more than one car
could get in or out of it, including emergency vehicles.
The Secretary said that actually it is just a driveway and
they could not give an easement to themselves.
Chairman Norton said this is required from a safety point of
view, so cars could come in and turn around, and other vehicles,
including emergency vehicles, should be able to pass and turn.
Further, he said that the Ordinance requires a lot to have a
certain amount Of frontage and the turnaround would provide
this frontage requiring the' least amount of property.
Commissioner Crisp moved, seconded by Commissioner Lively, that
the Building Site Committee Report dated 8 July 1968 relative
to SDR-760 be adopted and that the tentative map (Exhibit "A",
filed 24 June 1968) be approved subject to the conditions set
forth in said Report. The motion carried unanimously.
G. SDR-761 - Franz O. Ibisch, Pike Road - Building Site Approval -
1 Lot
There.being no questions nor comments, Commissioner Crisp moved,'
seconded by Commissioner Lively, that the Building Site Committee
Report of 8 July 1968,'relative to SDR-761, be adopted and that
the tentative map (Exhibit "A", filed 24 June 1968) be approved
subject to the conditions set forth in said report; motion
carried unanimously.

IV. DESIGN REVIEW
A. A-238 - Youth Center - Fina.1 Design Review - Revised Parking
- Continued from 10 June 1968
Commissioner Kasner said he was not present at the last meeting
and asked to be brought up-to-date on what happened.
Commissioner Ltvely said that the Design Review Sub-Committee
met and reviewed the parking around Saratoga Youth Center and
that. Mr. Walker was asked to review it with the Youth Center
people.
The Secretary said that no final plan proposal has yet been
reached.
The Chairman directed that the matter be continued to the next
regular meeting.
B. A-269 -Abel Carreia, Saratoga-Sunnyvale Road -Ftnal Design
Review - Commercial Service Buildinq
Commissioner Metcalf asked if Applicant was satisfied with the
provisions contained tn the Staff Report. Mr. Men~r. dr~ repre-.
sent inS the applicant, said they were satisfactory.

for Final Design approval in accordance with the conditions
stated in the Staff Report. dated 8 July 1968, and on the basis

Identification Stqns
Chairman Norton called for .any comments or questions on this
matter. There were none.

Commissioner Hasnet moved, seconded by Commissioner Lively,
for Final Design approval in accordance with the-conditions
stated in the Staff ~nnrt dated 8 July 1968 and on :the basis
of Exhibit "A",. The motion carried unanimously.
V. COUNCIL REPORT
Commissioner Crisp presented his report on the Council Meeting
of 3 July 1968, commenting particularly on Paragraph/4 regard-
in9 Dr. Clemmer Peck's being 9ranted a waiver of Record of
Survey requirements, based on the fact he had a single site
of 21 acres, which he did not propose to subdivide. The land
had been surveyed 30 years ago, he said, and, subsequently,
the surveyor died. Commissioner Crisp said he knew of many
similar cases, and he felt this was setting a possible unde-
sirable precedent.
Chairman Norton thanked Commissioner Crist for his detailed
report on the Council meeting.
VI. OLD BUSINESS
A. UP-136 - B. T. Galeb, Saratoga-Sunnyvale Road - Request to
Relocate Kinq Dodo PlaVhouse
Commissioner Crisp moved that the Staff Report dated 8 July
1988 be approved, in accordance with the conditions stated
in said Reportl Commissioner Lively seconded, and the motion
carried unanimously.
B. C-106 - I. N. Abrams (M.V.S. Company) Saratoga Avenue - Request
for Extefision - Continued from 2L~ESune 1968
Chairman Norton asked Dr. Abrams if he were familiar with the
recommendations, and Dr. Abrams said that he was;
Chairman Norton told him that he must submit a tentative map
for Design Review approval within six months, and Dr. Abrams
said that he had applied for tentative map already, but he
didn't know how long it would take -- he estimated six to
eight months, if things 9o smoothly, and Chairman Norton
said that if he could show he was making progress, 30 days
one way or the other wouldn't make a great difference.
Commissioner Kasner asked, assumin9 the design is not submitted
by, say, July 1969, what the status of the zonin9 would be.
Chairman Norton said it would go back to agricultural.
Commissioner Kasner asked what if it were' submitted but not
approved? COmmissioner' Crisp said that he felt that, as far
as the Subdivision Committee is concerned, it would accept .'
the submission as complain9 with the conditions. Commissioner
Kasner felt that it was not clear,. and that it was too in-
definite' to act OD. and suggested it be amended to make it clear.
'Chairman Norton asked if there was a motion to approve the
the Staff Report as amended .and that the Planning Commission
recommend to the Council that the extension as recommended
in the report be granted. .
Commissi~er Kasner so moved and the motion carried unanimously.
VII. NEW BUSINESS "
A. C-80~ Clarence Neale, Saratoga-Sunnyvale Road - Request to Add
Additional New Uses to List of Uses Permitted Under the
Conditinal Community CQmmercial Zoning
Mr. Neale was .present and asked for additional permitted uses"
in the area at Neale's Hollow, stating that he is suffering a

loss of rental income due to the present restrictions on uses,
and recent loss of tenants. He requested that the uses in-
clude: 1) Poodle Grooming Salon (no boarding); 2) Office Uses;
3) Tea Room and Fountain, and 4) Manufacturer's Representative.
He said that there are now 25 additional parking spaces -- down
by the antique shop which has moved out, and in back of the
building.
Commissioner Kasner questioned Mr. Neale about how many square
feet would be required for the tea room, and Mr. Neal said it
would take about 725 square feet, including the restrooms.
Chairman Norton closed the discussion on the matter and~ferred
it to the Subdivision Committee for a report at the next meet-
ing.
B. TREE S.,.~Y - TO PREVENT UNNECESSARY DESTRUCTION
Commissioner Johnson, Chairman of the General Plan Committee,
volunteered his Committee to study the problem of unnecessary
destruction of trees on private property with a view to amend-
ing the Ordinance to prohibit. or control removal of trees..
The Secretary said that the City Attorney did make a very broad
research of ordinances of other communities regarding trees and
made a lengthy report to the City Administrator which is avail-
able for use by the Committee.
Commissioner Johnson asked the Secretary to provide the Com-
mittee with copies of the Palo Alto ordinance-.,concerning trees.
C. PROVISION FOR HORSE TRAILS IN FUTURE SUBDIVISIONS
Commissioner Lively suggested the Commission should give con-
sideration to requiring provision for horse trails. and the
necessary easements in future subdivision developments, ex-
pecially in equesk~.'an zones.
Chairman Norton asked the Secretary whether this could be done
and the Secretary said that it could possibly be done through
the Parks and Recreation Commission, and that he felt there
would be little difficulty.
Commissioner Crisp asked that this matter be placed on the
Agenda for some future meeting. Commissioner Johnson suggested
the August 12th meeting, since that would allow a period of
five weeks for study.
Chairman Norton referred this matter of horse trails to the
Subdivision Committee for a report at the meeting of August 12.
VIII. COMMUNICATIONS
A. WRITTEN
1. A letter from Mrs. Helen J. Bonnell of 5258 Yorkton Way,
San Jose, protesting special Condition and use permit
requiring removal of a Eucalyptus trees.
Chairman Norton referred this to the General Plan Committee
in connection with the preservation of trees.

2. Copy of a communication to the Council from the District
Superintendent of the Saratoga Union School District re-
garding utilization of school sites for park development
and possible exchange of school site property for park
purposes -- particularly concerning the Redwood school
site, and suggesting another. meeting to discuss this
matter if the Council is interested in an exchange of
property.
Chairman'Norton directed that this letter be filed since it
requires no action by the Planning Commission, and is for
informational purposes only.
B. ORAL - None.
Commissioner Lively invited the members of the Commission to
review the work Flood Control has done on San Tomas Creek
from Pollard Road northward. He said that if they would
drive by and look, they could see what has been done to destroy
the.beauty of the creek.
Chairman Norton acknowledged the presence of Mrs. Stark and Mr.
Lewis of the Good Government Group and remarked that no Council-
man was present at this meeting because.the Council was in
special meeting .tonight.
The meeting was adjourned at 10:20 p.m.
