I. ROUTINE ORGANIZATION
The meeting was called to order by Vice-Chairmn Johnson.
A. ROLL CALL
Present: Con~issioners Crisp~ Johnson, I~aus, Lively, Metcalf, and
Smith.
Absent: Commissioner Norton.
B. MiN~ES
CoF~issioner Smith moved, seconded by CoEissioner Crisp, that the reading
of the minutes of the 23 September 1968 meeting be waived and that they be
approved as 'distributed to the CoEission; motion carried unanimously.
II. PUBLIC HEARINGS
A. C-1!8 - B. T. ~leb and Milan Popovich, Zorka Avenue and Ted Avenue -
Request for Change of Zoning from "R-l-10,000" (Single-Family
Residential) to "R-M-3,000" (Multi-Family Residential) -Continued
from .23 September 1968
The Chair~n relopened the hearing at 7:35 P.M. The Secretary stated that
i) a co~unication received from the applicant requested that C-118 be
postponed for thirty days and 2) additional communications opposing C-118
have been received. '. - .:
Ch ir-D . Johnson directed that 1) C-118,"be continued to the meeting of
12 Novem2oer 1968 and 2) the additional co~rnmunications that were filed
not be read until that meeting.
Y~s. ilia Sheets of 12444 Ted Avenue stated she had heard rumors that if
the' subject Change of Zoning for apartment units is denied the property
would be utilized for a mobile home park.
.- Chairman Johnson advised {in answer to i,~s. Sheet's statement) that no
'plans for such a proposal have baen presented to the City.
At 7:40 P.M. Chairman johnson closed the hearing for the evening and
referred C-118 to the Subdivision Con~nittee..'. ;"

for Change of Zoning from "R-i-40,000" (Single-Family Residential)
to "R-1-!2,500" (SinZ!e-Famity Residential)
The Chair~n opened the hearing relative to C-119 at 7:42 P.M. The Secretary
~ ~ that the Notices of Hearing had been ~iled and published. He further
gtated that th~ following co~unications were received relatiye to C-119:

.1) two petitions with a total of twenty-two signatures stating
they did not object to the proposed Change of Zoning.
2) letters favoring C-I19 were received from ~s. Mildred B.
Russell, 20901 Boyce Dane, Ann P. Va~k, 20840 ~oyce ~ne and
Walter H. and Unetta Ubsdell, 20810 Boyce ~ne;
3) two petitions with a total of twenty-six signatures oppo-' '
sing the subject Change of Zoning; and
4)a letter opposing C-119 filed by Walter and ~rianne Kerl,
20830 Boyce ~ne.
'No one in the audience wished 'to conm~ent relative to C-119.
Coxmn~issioner Smith moved (7:49 P.M.) , seconded by Commissioner Metcalf,
to close the hearing for the evening; motion carried unanimously.
. Chairman Johnson referred C-119 to the Subdivision Conmittee for review
and directed same continued to the meeting of 28 October '1968.
C. UP-156 - Jeanne M. Christiansen, Pierce Road and Saratoga-Sunn~ale Road
- Request for Use Permit to Allow a Day Care Nursery - Continued
from 23 September 1968
"The Secretary stated that the applicant submitted a' letter requesting the
withdra~l of UP-156.
Chairman johnson, in view of the foregoing, did not open the hearing but
advised that the Subdivision Committee had prepared a report (prior to
receiving the request for' withdrawal) ~aich reco~ended denial for UP-156.

forQ~al be approved; motion carried unanimously.
D. L~-157 - John H. and Catherine Wolf, Saratoga ~.venue - Request for Use
Permit to Allow a Home for the Elderly'-..COntinued f~om 23 September

At 7:54 P.M. Cox~isSioner Smith moved, seconded by Comnissioner Crisp, to
close the hearing relative to L~-157; motion carried unanimously.
The Secretary read the Staff Report dated 14 October 1968 recommending
that the subject application be denied. He then stated that in paragraph 2. .

Ill. BUILDING SITES AND SUBDIVISIONS
A. SD-759 - Pete Rajkovich, Prospect Road -.Subdivision Approval - 112 Lots -
Continued from 23 September 1968
Commissioner Smith reco~ended that this matter be continued since the
applicant has not submitted further information required in order for
the Subdivision Con~ittee to recommend approval of the tentative map.
The Secretary stated that the applicant submitted a letter granting
a thirty day extension.
In view of the foregoing Chairman Johnson directed SD-759 continued.
B. SDR~767 - M.V.g.'Compan~, Saratoga Avenue - Building Site Approval -
! Lot - Continued from 23 September 1968
Cop~issioner Smith recommended that SDR-767 be continued to the next
regular meeting in order to resolve problems relative to access.
Chairman johnson so directed.
The Secretary stated that a letter of extension was received from the
applicant.
C. SDR-773 - Don Orlando, Verde Vista and Boyce Lane - Building Site Approval
- 3 Lots - Continued from 23 September 1968
The applicant and his attorney, ~.~. Bruce Oneto, were present and Mr. Oneto
stated a letter had been flied stating their objedtions to the proposed condi-
tions of approval.
The Secretary. read the letter received from the. appliCan~'~"da~ed'4'~ctober"'
1968 in filed SDR-773.
Con~issioner Smith stated that 1) the letter was based on conversations
and not a fornml objection to the conditions but is an informal objection
to '.what "will' be Condition II-B 2) this is'a matter ~nich .~ill have to
be settled between the Boyce's and the Orland.o's.3)..the Planning Co.mmission
will either have to deny the request for 'Building"Site ApproVal-or approve
it and the applicant can request reconsideration!of Condition II-B and
4) because of the proposed Boyce Change of Zoning a full City street will
be required in this area.
Mr. Oneto stated that condition tI-G will require the applicant to give up
5,000 square feet of the property he planned to utilize for construction of
his house..
The Secretary explained that the dimensions of the lot will have to be
revised in order for the applicant to construct his house.
Com~issioner Smith explained that the applicant has gone ahead with house

complications.
Mr. ~aul Frechette, present to represent the applicant, stated that
1) the Orlando's purchased their property with a 20-foot strip right-of-way
2) now Boyce Lane has to be widened and Mr. and t.~s. Boyce wish to sub-
divide their property 3) there is a question ~bout the centerline of this
20-foot strip 4) the Boyce's have moved the centerline to fall between the
Orlando property and the 20-foot strip of right-of-way owned by"Boyce'-'
'5) the Boyce's want to build on their five lots and feel the ~. Orlando can
afford to give away more property and they feel that they cannot.give
away any .of theirs 7) he recommends that Boyce Lane be split equally
do~ the middle and 8)' if this is not achieved it will mean complete
'scrubbing of one of the plans proposed for Mr. Orlando's lot.

ili. C. SDR-773 - Continued
The Secretary stated that if the land is subdivided the Boyce's will
have to dedicate and improve 20-feet and the Orlando's will be required
to dedicate and 'improve an additional 20-feet making a total of 40-feet~ of
right-of-way.
Mr. Oneto stated that 1) when the Orlando's purchased their property
they paid $125 for the 20-foot strip of right-of-way and this became part
of their deed 2) the Orlando' s have a right to use this 20-foot strip
~,xhich ought to be the centerline of the proposed improvements and 3) the
Oriando's will build only one house on Boyce and the proposed Boyce sub-
division will have three houses on Boyce ~ne; so, it seems unfair to
penalize the Orlando' s by requiring them to dedicate and improve the
additional property.
Conunissioner Smith stated that 1) if Condition iI-B is dropped from
the proposed conditions of approval dated 14 October 1968 and it is
later realized a full City straet is needed it will be difficult to
acquire same and 2) he recommends that the Planning Co~ission adopt
the Building Site Committee Report, as is, and if there is a legal
protest it be referred to the City Attorney.
Commissioner Lively stated that 1) it seemed that this ~tter is all
tangled and if the report is approved it will result in further confu-
sion and 2) he recommended that SDR-773 be continued in order to allow
the Boyce's and Orlando's more time to work things out between them.
The Secretary stated that !) it will be necessary for the .applicant
to submit a letter granting an extension if SDR-773 is to be continued
and 2) he will discuss this matter with the City Attorney in order to
obtain a legal opinion.
M~. Oneto stated that his client does consent to a continuance and will
submit a letter of extension.
Chairman johnson directed !) SDR-773 continued to the next regular meet-
ing subject to the receipt of a letter of ext'ension from;thel~applicant and
2) the Secretary to inform the applicant a~Oout t.he...City Attorney's opinion.
D. SDR-778 - RObert P. Lewis, Sobey Road - Building~ Site ADDrova! - 1. Lot
The applicant was present and e}:pressed satisfaction with the proposed
conditions of approval, but did request clarification of Condition II-E.
The Secretary explained that this condition required the removal of any
shrubbery or portion of tree that might interfere with traffic ·sight distance
on Sobey Road and is a Standard Condition.
Corf~issioner Smith moved, seconded by Co~nissioner Crisp, that the Building
Site ~ommittee Report of 14 October 1968 relative to SDR-778 be adopted and
that the tentative nmp (ExhiBit "A", filed 3 October 1968) be approved sub-
j~ct to the conditions set forth in said.report; motion carried unanimously..
E. SDR-779 - Grand of California~ Prospect Road - Building Site Approval - 1 Lot
~. Nielsen ~.~s present to represent the applicant and expressed satisfaction
with the proposed conditions of approval.
Commissioner Smith moved, seconded by Commissioner Crisp, that the Building
Site Com~ittee Report of 14 October 1968 relative to SDR~779 be adopted and
that the tentative map (Exhibit "~" filed 4 October 1968) be approved sub-
ject to the conditions set forth in said report; motion carried unanimously.

IiI. F. SD-7S0 - Western Hills Deveiop~nent, Mt. Eden and Pierce Road - Subdivi-
sion Approval - 26 Lots
Commissj. oner Smith stated that tb-is is a refile for SD-592 and since
the Subdivision Committee wishes to meet further with the applicant to dis-
cuss problems relative to this application it will be necessary to
continue SD-780 to the next regular meeting.
Chairman Johnson so directed.
G. SD-733 - john Rodriguez, Big Basin Way - Subdivision Approval for
Revised Tentative Map - 114 Lots
~- Bil~ Bane, MacKay and Somps ~.~s present to represent the applicant
and inquired if all the conditions refined the same as the ones approving
the original tentative map.
The Secretary stated that Condition 25 and a NOTE relative to pathways
had been added to the proposed conditions of approval.
Mz. 'Bane 1) suggested that the road be constructed in such a way that
a"portion of it can be used for pathways since they are a little tight
for area and 2) pointed out that the Building Site Committee Report of
i4 October 1968 should indicate 114 residential lots instead of 128 lots.
Commissioner Smith moved, seconded by Co~issioner Crisp', that the Building
Site Cop~ittee Report of 14 October 1968 relative to SD-733 be adopted, as
amended and that the tentative ~D (E}~hibits "A-3", "B", and "C"' filed
4 October 1968) be approved subject to the conditions set forth in said
report; motion carried unanimously.
iV. DESIGN REVIEW
A. A-294 - Grand of California, Prospect Road - Preliminary Design Review -
Automobile Supply Store
Coxr~n~issioner,Lively stated ~ the 'Design R~view C0~ittee ~et with the
applicant and reconm~ended some changes" for ~the front of' the' building and
2) A-294 should be continued to the next regular meeting in order to
allow time for the applicant to n~ke the suggested changes.
~. Frank Nielsen, applicant's representative, stated he had no further
comments at this time.

Design Review - Apartment Complex
Corm~issioner Lively stated that the Design Review Co~ittee has reviewed

since there is some problem with the internal flow of traffic.

Cor~issioner Lively stated that the Design Review Committee reviewed the
plans and they are far superior to the original plans that were reviewed
some months ago~

IV. C. A-296 - Continued
The Secretary read the Staff Ileport of 14 October 1968 recormnending
that Preliminary Design Approval be granted A-296.
Com_missioner Lively moved, seconded by Commissioner Metcalf, that the
Staff Report of 14 October 1968 be ad'opted and Preliminary Design
Approval be granted for A-296 as sho~ on Exhibit "A" and subject to
the conditions stated in said report; motion carried-unanimously.

Identification Sign
Con,amissioncr Lively briezfly reviewed this application and stated that
th~ Design Review Committee recomnended that the two (2) stucco side
panels be eliminated from the prdposed subdivision identification
signs.
~. Dave Franklin, applicant, requested another appointment with the
Design Review Committee to discuss the subject alteration.
Chairman johnson, in view of the foregoing, directed SS-59 continued to
the next regular meeting.
E. A-278 - Ann Valk, Big Basin Way - Preliminary Design Review - Revised Plan
for Commercial Buildin1~
Com=~issioner Lively stated that the Design Review Co~ittee would like this
matter continued to allow the Con~nittee time to meet with the applicant
and discuss treatment of the roof of the subject building in relation to
the surrounding buildings.
The applicant was present and stated that the Design Review Committee
had visited the site and there is a problem relative to stablizing
the soil; therefore, it is paramount that they build.'as soon as possible.
Com~aissioner Lively stated'that since this property is the keXstone to
the development of this area the Design Revf'ew Com~aittee feel's it is
imperative they study the m~tter furth.e'r. ..'. ~
Chair~n Johnson directed A-278 continued to the next ~-egu!ar meeting and
referred same back to the Design Review Committee for further review.
F. A-289 - First I. jational Bank, Cox Avenue - Final Design Review - Identification
Sign ....
Corm~issioner Lively reco~.ended that A-289 be continued to the next regular
meeting to allow the applicant time to meet with the DeSign Review Com~mittee
to discuss the original sign proposal. :

V. CITY ~O~fNC!L REPORT
The S~-~c~ena~v' gave a summary of iten~s reviewed and action taken at the City
Council meeting of 2 October 1968, with emphasis on items of particular interest
to the Commission.
C~m~nissioner Smith ~ve a sum~ry of items reviewed and action taken at the
Special City Council meeting of 30 Spotember' 1968, with emphasis on the
follo~,~ing items:
i) The Mayor"s referral, to the Planning Conm~ission,
for study and revie~ of the frequent requests for
Use Permits for nursery schools and rest homes and
simi.lar ~foups for location in R-1 zones~ and

V. CITY COUNCIL REPORT - CONTINUED
2) The ~[2yor's refer~.:al to the Planning Con~nission for study
and a recommendation of the possible oversight in the Gen-
eral. Plan for specific zoning for such services uses as
plumbing and electrical services.
Commissioner Smith then advised that since the V-C
Ordinance was passed no provisions existed in other
areas for these uses.
Comn~issioner Crisp stated that according to the Planning
Consultant all services uses should be eliminated from
the V-C area and any consideration to reinstate said uses
should be given very serious thought.
After discussion, 'Chairman johnson referred these matters
to the Subdivision Con~nittee for study.
V!.. OLD BUSINESS
AMENDED REPORT
The Secretary stated that an amended report for the Foothill-Pierce Road
area (C-ill and C-!13) had been prepared by the General Plan Con~m. ittee.
He then pointed out the changes made in the amended report.
Cox?~issioner Crisp recommended that the report should be directed to the
City Council rather than to"the Chairman of the Saratoga Planning Commission.
Con~-nissioner Smith recommended' that the date of the amended report be stated
as follows:
Amended Report - 14 October 1968
Original Report- 26 August 1968
Commissioner Crisp moved, seconded by Commissioner. Smith, that. the. amended
report (dated 14 October 1968) of the original re;port (dated 26 August 1968)
be adopted, as corrected, and forwarded to the City Council as the'ac%ion of
the Planning Commission; motion carried unanimously. ..
Vii. R~QUEST OF CITY ADMINISTRATOR -' Consideration of specific service uses for
Commercial Zonin$ Districts
Chairman johnson stated that this matter has been referred to the Subdivision
Cozm~ittee for study.
