I. ROUTINE ORGANIZATION
The meeting was ca!le~ to order by Vice-Chairman Johnson.
A. ROLL CALL
Present: Connnissioners Crisp, johnson, Kraus, Lively, Metcalf, and Smith.
Absent: Conunissioner Norton.
B. MINUTES 'l
'Conunissioner Smith moved, seconded by Conunissioner Crisp, that the reading
of .the minutes of the 14 October 1968 meeting be waived and that they be
'approved as distributed to the Commission; motion carried unanimously.
II. PUBLIC HEARINGS
Chairman johnson, in view of the fact that the applicant~s representative was
scheduled to board a plane, directed that the public hearing for UP-158 (item C
on the Agenda) be the first item for discussion.
C. I/P-158 - Seminaries and institutes of Religion - Church of jesus Christ of
latter Day Saints, Allendale Avenue - Request f'or. Use Permit to
Allow a College of Reii~ious instruction and Worship
The hearing relative to UP-158 wzs opened at 7:31 P.M. The Secretary stated
the Notices of Hearing were mailed and then read a statement of reason filed
by the applican~'s representative, Mr. Eiwon lance.
Mr. Elwon lance was .present and stated that 1) he would briefly review
t~is proposal 2) this' building will contain 6,000-square feet 3) the
building will house classrooms, a lounge, kitchen, office space, and the
other normal. facilities associated with a school of this type 4) the
institute will endeavor to serve the students at the W,~'_~st Valley Jr. College
5) the institute will offer fifty-four courses dealing in church history
6) it is necessary t,o round-out the religious ed'acation of young college
students 7) there 'are one-hundred Morn~-on students '.registe;~a~ at the West
Valley jr. College 8) co=anseiing is p~."ovided to help 'these youn~i, people

Cornmis~Loner Crisp stated that the Church of ~tter Day Saints located on
Allendale Avenue had additional acreage and why could the instin~'~e not be
located there instead of in this residential area.

II. C. UP-158 - Continued
}~. La~-nce explained that 1) the Church of latter Day Saints has been
involved in the religious school program since 1927 and 'they have found
that it is best not to locate the religious schools or colleges directly
in associa.tion with the church because:
a) the program of the school is a general program
and has nothing to 'do with the services provided
by the church;
b) the college program, unlike the church, is completely
financed by.Salt Lake City, Utah;
c) the local church is not designed to meet the needs
of college people~
d) the church on Allendale Avenue is the center of the
Stake (or Diocese) and is the Stake headquarters and
is serving at its highest capacity now; and
e) the local church and the institute of religion are
different and serve different needs;
and 2) it is not possible to go into the campus classrooms and teach the
courses offered at the institute.
Co~issioner Crisp inquired about the three-and-one-half (3~) acres not
being used at the present ~tter Day Saints church site on Allendale Avenue.
~.. ~nce explained that this property is proposed for development of a
baseball diamond and recreation area to serve the entire Stake (or Diocese).
M~. ~nc% in an inquiry from Con~issioner Metcalf, stated that they did
not now o~ the property since they wanted to be sure they could obtain
approval to utilize the ro erh~
p p .~ prior to purchasing same.
Com~issioner Smith stated tha~ the m~p showed provisions for e:<pansion
and inquired about the ulti~te total the institute planned to serve'.
~. ~nce answered that the religious intitute would eventually serve
approxi~tely two-hundred students.
Commissioner Smith explained that the institute would have to provide
additional parkiDg to serve these students.
~.~ c~.~'el Athos Place, stated i> ~ lived directly behind the proposed
school 2) he had no. objection to the services provided by the school, but
did object to them l~caCing in a residential area and 3) he felt that if
one school of +h~ ~
~= _s nature is permitted it will set a precedent for others
to try to come into 'this area.
?t~. L~nce stated that 1) the statement made 'by ~. Shibel is true 2) this
s?~ouid be considered a~'p6Sitive attitude rather than a negative one and
q" th~se institutes. cost a lot of money and the Church of Latter Day Saints
does open their doors to permit other churches to n~ke use of their building
at cost to them.

~c. lance, stated that 1) there ~.~ill be ample parking provided
2) not all of the students wi. ll have cars 3) the ~tter Day
Saints Church has facilities of this type all over the state and
are able tD provide ample parking in all of them and 4) all of the
students will not be in class at the same timel
Chair~r~n Johnson explained that no Building Permit will be issued unless
sufficient parking is provided.
~. De Beular, Athos Place, stated that 1) he o~.r~ed a home behind the
proposed building 2) he and his neighbors were familiar with the good
works of the ~tter Day Saints Church 3) the Church anticipates spend-
ing .$259,000. to put this building into operation 4) he and a number
of his neighbors have spent $50,000. to $75,000. for their homes 5) they
paid this much for their homes because of the quiet atmosphere and gracious
~iving provided for by the onej~al'~ acre lots 6) he ~.~s assured this area
would remain residential 7) he did not wish to ouarrel with the Church, but
is .'opposed to this school and 8) he felt it would be far better for them to
enlarge on thei~ presently .o~.med property (3~-acres) not now being used by
the Church.
Dr. Pride, Athos Place, stated that i) he did not find fault x.~ith the
Church, but is opposed to the proposed location for this facility 2) he
felt that the present Church location would adequately serve the students
at Wes~ Valley jr. College 3) he was on the Christian Church Board and if
they had the facilities the Church of ~tter Day Saints have they would
consider themselves very fortunate and 4) his Church found no problems
in having their schools .included as part of their Church.
~,~. john Vance, Athos Place, stated that 1) he would very ~dch like the
Planning Co~nission tO ~ke every attempt to keep Saratoga a rural con'~unity
2) Saratogans have graciously accepted the West Valley jr. College even
though they were opposed to the original idea and 3) he cannot see
the Ch~ch cannot use the 3~-acres available to them.
i.~s. Leland Fry, former o~.a~er of the property, stated that i) she resided
next door to the subject property 2) her Mother sold this property to
George !~y with the understanding that it would be used for Single-Family
Residential homes 3) with the West Valley jr. College already in the area
they did not ~mnt another school nearby 4) they have a beautiful home and
yard and do not want additional traffic and noise in the area and 5) they
strongly object to the proposed Use ['ermit.
~.~s. Bradner Heisy, stated 1) she was relatively new to this neighborhood
2) she agreed with her neighbors that this area should be kept strictly
residential 3) she .felt. that the school would be more appropriaEe!y located
on the 3~-acres they. already o~¢ned'rather than saving it for development of
recreational facilities and 4) the Church. budget .would probably not pr0vid~
for proper landscaping and maintenance to blend in ~.~ith the surrounding
residences.

surrounded by schools o'f this type and the students would be better off
for it 5) he was concerned. about young people and felt that everybody
should be concerned and 6) it would benefit everyone if we showed more
interest in our young people and less interest in naterial thing and the
dollar...

.~fr I/~-nce applicant~s representative stated that 1TM anyone who has
ever viex.~ed a Mormon Church will find them all wel!-groomed 2) the
Mormon Ch~trch has never had any problem raising money for landscaping
and maintenance of their properties and 3) they have never had any
trouble with their neighbors before and they want to cooperate with
them now.
Chairn-an Johnson closed the hearing for the evening at 8:16 P.M., directed
UP-i58 continued to the next regular meeting and referred same to the Sub-
division Corcm~ittee for study.
A. C-1t9 - Allan G. and'jean R. Boyce, Verde Vista and Boyce lane - Request
for Change of Zoning from "R-i-40,000". (Single-Family Residential)
to "R-1-12,500" (Single-Family Residential) - Continued from
'14 October 1968.
The hearing relative to C-119 was re-opened at 8:17 PoM. The Secrenary
stated that two' con~n~.unications had been filed in support of this appli-
cation by I. irs. Mildred RuSsell and Mr. jerome Lohr, President Saratoga
Foothills Development.
No one in the audience wished to com~nent.
Chairman johnson closed the hearing relative to C-119 at 8:20 P.Mo
The Secretary read the Staff Report .recordmending that ';R-l~15.,000 zoning
be granted for C-119. "
The Secretary, in answer to an inquiry from Co~.~nissioner Kraus stated that
the problem in connection with C-119 and Mr. Orlando had been resolved for
'the time being.
Commissioner Smith moved, seconded by Comnissioner Metcalf, that the Staff
Report dated 28 October t968~ reco~r~,~_nding that C-!19 be approved be adopted'
and that the subject rezoning (R-i-40,000 to R-!-15,000) be recom~mended for
approval to the City 'Council on the basis that the request meets the object-
ives of the City of Saratoga Zoning Ordinance NS-3, Section 1.! and subject
to t~e recoranendations stated in said Staff Report; motion carried unanimously.
B. C-120 - Clarence W. Neale, Saratoga-Sunnyvale Road - Request for Change of
Zoning from "Conditional-Con~nunity-Commercial" (C-C) to "Visitor
Commercial" (C-V)
The hearing relative to C-i20 was opened at 8:24 P.M. The Secretary stated
that the Notices of. Hearing were mailed and read a communication filed in
opposition to the 'pi~oposed change of zoning by 1~~. john Bastianeiii.
The Secretary, in answer to an inquiry from ConLmission Crisp, stated that
a'll of the requirements mentioned in the letter are necessary for new develop-
ments~ but not for an existing development.. He further explained that a
'formal or automatic variance would be necessary.
Comm~.issioner Smith pointed out that the parking would! have to checked very
closely. "
>'~r.. S'ceve Brooks, resident-manager of the Brookside Glen. Apartments, stated
that 1) he was speaking on behalf of the tenants in the apart~nent building
2) the drive~;ay into the apartments is hazardous beca'ose of the=~ traffic at
i~eale~s Hollow 3) several tenants have had near accidents 4) parking at
· _b~eale's Hollow is a problem 4) there are so many cars there and one car
can obstruct the entire flow of tra'ffic 5) 'heavy traffic causes cars to
stop out on the highway and 6) the sign at Neale's Hollow is aesthetically
unpleasing and should be removed.

D. UP~159 - Saratoga Heights Mutual Water Company, Quickert Road - Request
for Use Permit to Allox~ Construction of Two (2) New Water Tanks
and a PumR
The hearing reiativ~ to UP-!59 was opened at 8:35 P.M. The Secretary
stated the Notices 'of Hearing were n~iied and briefly reviewed this
application.
~-. John H. Haufe, President Sarato~ja Heights Mutual Water Company,
· explained that' 1) since the last tank was added on Canyon View ]%cive
approximately twenty (20) families have moved into the area 2) this is
the reason the new larger. tank is necessary 3) -the new tank will serve
the additional needed x~ter for domestic and fire uses and 4) the two
(2) existing smaller tanks will be mo~ed from Canyon View ~.ive to Quickerr
Road.
At 8:40 P.M., Chairnmn Johnson closed the hearing for the evening, directed
UP-i59 continued .to the next regular meeting and referred same to the Sub-
division Committee for study.
E. ~-160 ~ Saratoga Heights Mutual Water Company, Canyon View· Frive -
Request for Use Permit to Allow Construction of a New Water
StoraRe Tank
The Chairman-opened the hearing relative to UP-160 at 8:41 P.M. The Secretary
stated the Notices of Hearing ~,~ere mailed and briefly reviewed this application.
Chairran Johnson explained that this application (UP-160) was filed in
conjunction with ~-159 and that the two (2) tanks from Canyon View ~ive
are the ones that will be installed. on Quickerr Road.
~. Haufe, President Saratoga Heights Mutual Water Company~ explained
that !) the proposed tank for Canyon View ])rive ~,zitt have 67,000-gallon
capacity and will be 26-feet in diar,~eter and i6-feet high and 2) the
two (2) smaller tanks will have 8 0']0-gaiton capacity each. and are
16-feet in diameter and 6-feet high.
After discussion, Chairman johnson closed the hearing (8:43 P.M.) for the

A. SD-759 - Pete Rajkovich, Prospect Road - Subdivision. Approval - 112 Lots
- Continued from 14 October 1968
Con~missioner Crisp reco~nended that this matter be continued in order to
alle~.y time for consideration of purchase (by the City) of a fr~e-way right-of-
way for an interim park to be used until said land is needed for free-way
purposes.

Conm~issioner Crisp stated that the applicant has reviewed the proposed
conditions of approval and expressed satisfaction of same.
Cormn~issioner Crisp moved, seconded by Commissioner Lively, that the
Building Site Committee Report of 28 October 1968 relative to SDR-773
be adopted and that the tentative map (Exhibit "A", filed 20 August 1968)
be approved subject to the conditions set forth in said re.port; motion
carried unanimously.
D. SD-780 '- 'West~rn'"Hi!Is 'Developments. Mt. Eden and PierCe Road -
· SUbdivisiOn Approval -- 26 Lots - Continued from 14 October 1968
Com~issioner Crisp explained that this application is a refile for SD-592
and that two new conditions have been added to the conditions of approval.
The Secretary stated that the applicant is aware of the added conditions
and has expressed his satisfaction of same.
Com~.issioner Crisp moved, seconded by Co~nissioner Metcalf, that the
Subdivision Committee Report of 28 October 1968, relative to SD-780
be adooted and that the tentative map (Exhibit "A-l", filed 21 October
1968) be approved subject to the conditions set forth in said report;
motion carried unanimously.
E. SDR-781 - Samuel E. Face~ Monta!vo Road - Buildin~ Site ApDrovai - ! Lot
Commissioner Crisp explained that SDR-781 is a refi!e on an application
that has expired.
.The Secretary ~tated that the applicant has.seen the proposed conditions
of approval and is in agreement with same.
Commissioner Crisp moved, seconded by Commissioner Metcalf, that the
Building Site Conm~ittee Report of 28 October 1968 relative to SD~,-781
be adopted and that the tentative map (Exhibit "A", filed 9 October
1968) be approved subject to the conditions set forth in said report;

The Secretary stated the applicant has reviewed the proposed conditions of
approval and has expressed satisfaction of same.

Comm;issioner Crisp moved, seconded by Commissioner I~1etcalf, that the
Bnilding Site Conunittee Report of 28 October 1968 relative to SDR-782
be adopted and that the tentative map (Exhibit "A", filed 4 October
1968) be-approved subject to the conditions set forth in said report;
motion carried unanimously.
G. SDR-783 - Ross Smith, Oak Street - Buildin:~ Site Approval - t Lot
Com~issioner Crisp briefly reviewed this application and stated that the
applicant was given a copy of the proposed conditions of approval.
Mr. Ross Smith, the applicant, stated that he would like to request
approval of the Building Site Conh~ittee Report dated 28 October 1968,
but would like to reserve the i-ight to request reconsideration of
Condition II~B of said report.
Commissioner Crisp stated that it was the applicants prerogative to ~ke
~his request.
Com~aissioner Crisp moved, seconded by ConLm. issioner Metcalf, that the
Building Site Committee Report of 28 October 1968 relative to SDR-783
be adopted (with the understanding that the applicant reserves the right
to request reconsideration for condition ii-B of said report) and that
the tentative map (Exhibit ';A", filed 18 October 1968) be approved sub-
ject to the conditions set forth in said report; motion carried unanimously.
H. SDR-784 - George B. Clark, Houston Court - Buildin~ Site Approval - ! Lot
The applicant was present and stated that he would like to request approval
of the Building Site Committee Report dated 28 October 1968, but would like
to reserve ·the right to request reconsideration of Condition Ii-D.
Commissioner Crisp instructed the applicant to submit his request in writing
to the Planning Director prior to the next regular meeting of the Planning
C ormn~i s s i on.
Cora-n. issioner Crisp moved. seconded by ConFnissioner Metcalf, that the
Building Site Committee Report of 28 October 1968 relative to SDR-784
be adopted (with the understanding that the applicant may reouest reconsid-
eration of Condition !I-D of said report) and that the tentative map
(E:<hibit "A", filed 16 October 1968) be approved subject to the conditions
set forth in said report; motion carried· unanimously.
I. SD-785 - Ditz and Crane, Cox Avenue - Subdivision A.oproval - 167 Lots
Commissioner Crisp explained !) this was part of an old Lindsay tract
2) this will be a'· Planned Development and 3) a PD permits 25% of the
lots to be the ne~ct lesser lot size than the zoning district requires '.'
in 'this case of a 12,500 zoning district 25% of the lots maybe as small
as i0,000 square feet.

Subdivision Conm'~ittee Report of 28 October 1968 relative to SD-785 be

28 October 1968) be approved subject to the conditions set forth in
said report; motion carried unanimously.'
IV. DESIGN REVIEW
A. A-278 - Ann Va!k, Big Basin Way - Preliminary Design Review - Revised
Plan for Com=~ercial B'u:i. idin~ - Continued from 14 Octo. ber 1968
Co~.~nissioner Lively stated that 1) the Design Review Committee met ~.,zith
the applicant and a Staff Report has been prepared relative to A-278 and
2) this is a redesign of a building x,z~nich was previously approved and
this is a modification of the original plan.
The Assistant Planner. read the Staff Report reconm~ended that Preliminary
Design Review be granted for A-278 on the basis of Exhibit "A-2".
Commissioner Lively moved, 'seconded by Comanissioner Metcalf, that the
Staff' Report of 28 October 1968 be adopted and Preliminary Design Review
Approval be granted for A-278 as shox~ on Exhibit 'vA" and subject to the
conditions stated in said report; motion carried unanimously.
B. A-289 - First National Bank, Cox Avenue - Final Design Review - Identifi-
cation Sign - Continued from 14 October 1968
Commissioner Lively stated that 1) the Design Review Co~ittee met with
the app!icant~s representative and discussed this sign 2) a Staff Report
has been prepared relative to A-289 and 3) it is unfortunate that the
Design Review Con~ittee has not 'had the opportunity to meet with someone
directly ..as.s. ocia~ed with the bank.
The Secretary stated ehe applicant has chosen the people from the Sign
Company to handle the subject reeuest for them; however Mm. Conger from
the First. National Bank is present.
The Assistant Planner read the Staff Report recoms~ending that Final Design
Approval be granted on the basis of Exhibits "A", "B'~. and '~C:'.
I~. Conger stated that 1)' the applicant is not in agreement with Condition b)
set forth in the subject Staff Report dated 28 October 1968 and 2) the bank
feels very strongly about the colors of their sign 3) other free-standing
business signs in the City have been permitted to use their colors.
Comanissioner Metcalf stated that 1) the Design Review Comaittee has
relu.ctantly consented to approve this sign and they agree only on the
advise of the City Attorney that there is no way the Planning Comm~ission
can prevent the applicant from constructing a pole sign 2) the sign is
.most distasteful to the Design Review Committee and 3) it is felt that
· . the color change reco~Tanended in Condition b) of the subject Staff Report
will make the sign a. little less objectionable.
~i~. Conger stated that the applicant is trying to remove a non-conforming
sign and replace it with a conforming sign.
Com=n~issioner Metcalf stated that the Design Review Con~nittee would like to
relate its feelings to the bank officials.
%~r. Cassidy, Federa.1 Sign and Signal Company, stated that the objections of
the Design Review Comanittee have been relayed to the bank officials and they
would like to have the sign approved as originally sho~:~a.
Comxp. issioner Lively stated'that since the bank wants to persist even
though they'are a~.rare of our objections there seems to be no alternative
but to approve the sign as stated in the Staff Report.

Staff Report of 28 October 1968 be adopted and Final Design Approval

C. A-294 - Grand of California, Prospect Road -·Preliminary Design Review

Coma~issioner Lively stated that the Design Review ConLmittee met with the
applicant and reviewed the revised map.
~·Lr. Nielsen, property manager for Grand of California, stated that !) he
wished to go on record as saying that Grand of California initially sub-
mitted what they thought ~s a good design 2) the members of the Design
Review Comanittee brought forth a revision in our own design (by requesting
a revised drawing) and one that will be more workable and 3) he expressed
his gratitude to the entire Planning Con~mission, on behalf of the applicant,
for their much appreciated cooperation.

Con%missioner Lively moved, .seconded by Commissioner Kraus, that the
Staff Report of 28 October 1968 be adopted and Preliminary Design

Final Design ApproVal for twenty-eight (28) homes withholding approval
of the ten (i0) ren~.ining houses requiring curved driveways (a require-
ment ~¥hich has not been sho~.m on the exhibits submitted to date).

b) C-I13 (E.F. Gouveia, Ashley Way) ~as denied by the. City
Council and referred to the Planning Committee of the
City Council for consideration at the time of the Gent. re!
Plan revision.
Comanissioner Crisp stated 1) this matter should have been
referred back to the Planning Commission for consideration
prior to denial by the City Council and 2) if the City
Council intends to take care of these ~tter the P!~nning

Cor~n~issioner Kraus stated that I) a' procedure has been recomanended for naming
of streets that would provide for the County checking to insure a name is used
only once in the process of naming streets in the County 2) the Planning Policy
Committee had in attendance at its last n~ceting.~. Ink, Assistant Secretary for HbD
of the United States Government ~,j~o present~ad one of ten awards to the Santa
Clara County Planning Policy Committee and 3~ a special award was presented to
. ex-Mayor William E. Glennon for his outstanding contributions toward reeking the
Plannin~ Policy Con~mittee a s.uccess.

Commissioner Crisp Stated that a new x,zording should be ~,~'itten for Ordi~nce
NS-3 relative to flag or corridor lots.
The $ecretary e:~plained that in the R-1.-!0,000, R-!-12,500, and R-I-iS,000
zones there are properties that have long narrow roads leading to homes
located on the rear portion o~ a property that already has a home on the
front portion of the property. iie further stated that i) this situation
is causin~ congestion on access raa~s ~.~hich were not intended for this
ad~itiona! traffic and' 2) soma consideration should be given to requiring
flag lots to be 20,0DO-square feet in area.
Chair~n Johnson directed the Planning Director to prepare a report stating
his recom=mendation' for discussion at the next regular meeting on 12 November
1968.
