PLACE: City Council Chambers, 13777 Fruitvale Avenue, Saratoga, California 95070 TYPE: Regular Meeting , I. ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton. A. ROLL CALL Present: Commissioners Crisp, Kraus, Martin, Metcalf, Norton, and Smith. Absent: Commissioner Lively B. MINUTES Commissioner Smith moved that the reading.of the minutes of 14 September 1970 be waived and that they be approved as distributed to the Commission with the following amendments: Page 7, II.E., Line 2: remove third'°s°ffrom discuss; second paragraph line 2 should read UP-194 continued to October 13th meeting. Page 10, I.V.B. first paragraph should read: Commissioner Metcalf explained that the sign already exists and has received tentative approval b y the Design Review Committee. Page 11, last paragraph, first line: the word, "'detain" should read "delay", seconded by Commissioner Metcalf; carried unanimously. II. PUBLIC HEARINGS A. .~.-133 M.W. Frazier, Saratoga Avenue & Cox Avenue - Request for Change of Zoning from "A" (Agricul[ural) to "C-N" (Neighborhood-Commercial) Chairman Norton opened the Public H~aring for the evening at 7:37 P.M. The Secretary reported that the Notice'of Public Hearing had been published and mailed and the applicant is requesting a change of zoning from Agricultural to Neighborhood Commercial for the .87 acre parcel at the southwest corner of Saratoga Avenue and Cox Avenue for the purpose of constructing a gasoline service- station. The Secretary read a communication from William S. Michael, M.D. and Gordon S. Leonard, M.D. in which they strongly objected to the request to rezone the .87 acre parcel located at Saratoga Avenue and Cox Avenue and adjacent to their medical building. Donald Tenenbaum, Attorney representing the applicant, who practices law at 777 North 1st Street and is a resident:of Saratoga stated that he had asked a court recorder to record all statements made to be used later, if necessary. He stated that this was an area on the Master Plan which is designated as Commercial and Commercial as Professional Administrative Use. Chairman Norton pointed out the our Ordinance did make a distinction between the tWO, Mr. Tenenbaum continued that an application for Professional-Administrative was previously denied and this is an application for Commercial under commercial use. He noted that the area immediately surr'ounding this property is presently zoned P-A. Two of the doctors have voiced objections to this rezoning, however, as of this time none of the other doctors have voiced objection, including the largest land owner, Dr. Isaac Abrams. The area imn~ediately south is multiple zoning for high density and immediately across' the street is zoned Industrial with commercial usage. Immediately east of this property again it is the same desig- nation and there is conmercial usage whether or not is is actually zoned as such. Planning Commissio~t 25 Septc~i,~bcr 1970 - Immediately east of that particular area we have the commercial Quito Shopping Center which ine-ludes a Richfield Station and diagonally across is a Church which is public use. Mr. Tenenbaum stated that their proposition was to build a Shell'Servic'e Station which. .was unique in construction and design. They realized that this was a special request and that an additional Use Permit would be required. They were asking that this area. be zoned Con~ercial for a specific use. Chairman Norton pointed out that the Commission could not restrict the use because the applicant was requesting Neighborhood Commercial zoning, and the Commission was directing their attention to this at the moment. It was necessary to accept the possibility that any neighborhood commercial use could be put there. Ray White, field representative for Shell Oil Company stated that the service station they proposed to construct would be a business which would gross betCeen $350,000.00 and one half a million dollars per year. There would be 7 full time employees and 2 part time and a payroll of $40,000.00 per year. There would be a taxable retail sales volume of well over $100,000.00. On the basis of a 5% Sales Tax this would mean over $5,000.00 per year. In addition, motor-vehicle fuel-tax would generate well over $110,000.00 to the Federal Government, a portion of which would be distributed to Santa Clara County and ultimately back to Saratoga. The' City of Saratoga has a population of over 26,000 and does not have a Shell Servi'ce Station. According to the Shell printed card files something in excess of 2,300 residents hold shell credit cards. Mr. White stated that the closest Shell station was an outdated one which has been at the Saratoga and Quito location for some fourteen years. The Company is anxious to remodel this station, however, additional .property is not available to them. Mr. White felt that this use was most appropriate to this corner at the present time. The present daily vehicle count averages 21,000 cars. This count is estimated after completion of the West Valley.interchange in 1975 to increase by nearly 65% - in excess of 35,000 vehicles per day. This is the reason the company is anxious to create a location at this particular point. Chairman Norton expressed concern as to construction plans for the West Valley Freeway and asked whether Mr. White had any further information. Mr. White said that the State had provided him with a budget appropriate schedule which stretches over 1973-75. The Freeway is now practically complete to Stevens Creek' and thenext phase will bring it fairly close to the intersection in question and ~11 be advertised for bids sometime in 1973. The ultimate completion date is scheduled for sometime during 1975. Mr. White stated that there is a 210 unit California West Apartment' immediately to the south which is a higher density use than the original General Plan anticipated. There iS a manufacturing entity, the Paul Masson Winery and a commercial entity, the Quito Shopping Center which Mr. White felt were a basis for their requept for a more intense use for this property. If rezoning is considered possible, Shell Oil Company are prepared to install something unique. He referred the architectural design awards which Shell Oil had won in Carmel and Carmel Valley, and an award from the American Nursery Association for landscaping. This station has no gas pumps. This is an attempt to do something which has never been done before. There is a system called non-space or remote dispensing system. The product is still 'stored underground but the dispensing devices are suspended from overhead. This has been perfected by the Japanese and and is in use extensively in Asia and Europe. The Company has asked Shell' Oil to experiment with their system. Shell Oil Company has applied to the Santa Cl. ara. C~unty. Fire Marshal's office for approval for this type of system and there is a letter on file with the City from the Fire Marshal's office endorsing this sySt'em and stating that it has been checked out and found to be in compliance with all safety regulations. The Fire Marshal made certain reconmendations for modifications which which have been devised and gave his approval for this type of installation. When you drive into the island area there is fan area of exposed aggregate i~nediately below the covers to break up the expanse of concrete. This would be color coded to direct customers to the service area which they require. At the same time there would be a telemetric device on the wall giving the volume, price per gallon and total price. - 2 - .Planning Co~Tmission Min~ 28 September 1970 - Continued In conclusion, Mr. White hoped that the City Of Saratoga would give Shell Oil Company the opportunity to create the most inventive service station design concept. An architectural rendering of the proposed station was available to the· Commission° ~' "in ·reply to g·.question.' from Chairman NortOn as to whether the Company had considered ........... the reverse entrance design, Mr. White stated that this is a modification of that design in that it has a side entry lubrication base. The side entrance does fit a property of this type in that this property i~ not completely square to both streets. From the point 6f view of customer relations, Mr. White felt it was more desirable to have the lubrication facility visible to the public. He reaffirmed his desire to build and maintain an attractive facility° Commissioner Crisp asked for a copy of the transcript which had been recorded during the meeting. In response to a question from Commissioner Martin as to the location of the existing P-A offices in relation to this property, Mr.' Tenenbaum stated that the~ were to the west and south of their proposed facility. The medical facility is immediately contiguous to this property. There is a setback line on both sides which is about 25 ft. Dwight Steinberg, a resident of Saratoga Glen' Place was present and stated that he had been in attendance at the hearing when the medical center building was discussed. One of the principle reasons for approval was the landscaping and general contiguity of the property. He did not think that a service station of any type would be in keeping with what was discussed at that hearing. He noted that on the corner, the shrubbery and trees were just coming up. He felt that any additional buildings should fit in with the existing background and anything else would give it a congested look. Fred·Styles, Saratoga Park Woods Homeo~,~ers Association stated that the Association was in the process of preparing a petition·in strong opposition to the rezoning and · also to the proposal for a service station there. Rev. Stanley Anderson, Prince of Peace Church commented on the excellent"homework" which Shell Oil had obviously done. He stated that his congregation have submitted to the Planning Commission a proposal for a similar operation and would like to have them consider this. They had no objection to the rezoning. Gene Mooring, 12824 Saratoga·Glen Place voiced his objection to the rezoning of all four corners. Mr. Tenenbaum stated that they would submit further detailed reasons for their request at a further hearing. He pointed out that many people had a misconception about that particular corner, which looks like part of the medical village. ,The only reason that trees are growing and landscaping is maturing is that the o~,mers have allowed the adjoining property o~.~ers to landscape this property so it will blend with the medical · center until such time as a rezoning takes p]sze. He felt it was obvious that this parcel could not remain as agricultural zoning and some other use would have to be found. An application was submitted in 1965 in an attempt to use this property for P-Aand was denied and they are now seeking to have it used for commercial purposes. As a resident, he felt it would be a good use. The architectural planning is 100% compatible with the surroundings. Landscaping will blend with the designing at the medical center. If this use is not allowed to be rezoned for this purpose some other use will have to be found whether it be planting of vegetables or some type of farming. He stressed that this was not part of the medical center. Mr. Styles requested that a member of the Planning Conm~ission or staff review the files to determine what discussion took place at the time of the original application by the medical center when this particular piece of'property was omitted. Without objection, Chairman Norton closed the Public Hearing for the evening at 8:14 P.M. and referred the matter to the Subdivision Conmittee. The Hearing is continued to the next regular meeting on Tuesday, October 13, due to the holiday on October 12. B. UP-186 - Lawrence E. D. uP-195 - c & I DeVelopment, Paramount DriVe and ttighway 85 - Request for Use Permit to Allow a Model Home Sales Office - Continued from 14 September 1970 Chairman Norton opened the Public Hearing] for the evening at 8:15 P.M. The Secretary stated there were no new communications on file. No one in the audience wished to conm~ent relative to this matter. The applicant was not in attendance. The Assistant Planner read the staff report dated 28 Septenter 1970 recommending that the Use Permit be granted for a period of one year subject to certain conditions. E. UP-196 - Cal-West Communities, Inc., Saratoga Avenue - Request for Use Permit to Allow a Model Home Sales Office - Continued from 14 September 1970 The Secretary stated there were no new communications in the file. The Chairman opened the Public Hearing for the evening at 8:19 P.M. The applicant was present but did not wish to con~ment. Th'e ASSistant planner read the staff report dated 28 September 1970 recommending that the Use Permit be granted for a period of one year subject to certain conditions. Moved by Commissioner Smith, seconded by Contmissioner Krause that the staff report dated 28 September 1970 on UP-196 request for Use Permit for Model Home Sales Office be approved and that the Use Permit be granted, subjection to the conditions stated in the report; carried um~nimously. V-351 - St. Patrick Fathers Missionary Society, Eric Drive - Request for Variance to Allow Conversion of the Existing Garages for a Study - Continued from 14 September 1970 Commissioner Krause asked that this matter be postponed until after the intermission for the purpose of modifying the staff report. Chairman Norton so ordered. G. V-353 - William Greathead, Marie Lane - ~equest for Variance to Allow a Reduction in Side Yard Setback Requirements - Continued from 14 September 1970 Chairman Norton opened the Public }learing on V-353 for the evening at 8:22 P.M. The Secretary stated there were no new comn~unications in the file. Ed Myers, Architect for Mr. & Mrs. Greathead referred to a sub-committee meeting held on the site the previous week. He stated that he was aware that the City of' Saratoga is not prone to granting variances but felt the following points should be considered. The site was graded ~ith a pad which requires a minimum of 2,000'ft. The Greatheads are planning a 2700 ft. house which is in the neighborhood of 31 or 3200 square feet. He felt that fulfilling of the specifications by Mr. and 'b~s. Greathead did the best job° He did not feel that inclusion of a 10 x 20 garage area into the hillside was imposiBg on any ofthe neighbors and it was not changing the sideyard requirements. -4- Planning Commission Minutes - 28 September 1970 - Continued The Assistant Planner read the staff report dated 28 September 1970 recommending that the variance be denied. III. BUILDING SITES AND SUBDIVISIONS A. SDR-849 - Thomas L. Dashiell, Bohlman R6ad - Building Site Approval - Revised Tentative Map - 3 Lots - Continued from 14 September 1970 Without objection, this matter was cont{nued indefinatel'y. until the applicant submits further plans. B. SDR-864 - Saratoga Foothills Development' Corporation, Fruitvale Avenue, Subdivision Approval - 39 Lots - Continued from 14 September 1970 Commissioner Smith referred to a study session the previous week at which the full Conmtission 'were present. It was agreed .that Saratoga Foothills would bring in some sketches showing some proposed layouts on a straight subdivision and as a Planned Development Subdivision as alternatives to the Planned Community proposal which is now' before the City Council. Jerry Lohr stated that the Commission was aware that his company had made nk~ny studies of this property. He thanIced the City Planning staff for inviting them to the Study session. He was impressed with the suggestions made by the principal speaker, who had been involved in the s.tudy of slope density. development application in the Carmel Valley, Portola Valley and Los Altos ttills. He recommended the use of the concept to apply to the entire property by figuring the slope of the entire property, then using whatever lot reduction formula you have and calculating the number of sites you would allow, then leaving it at the discretion of the developer · and the staff tO work out the best site-development plan using that number of lots. He also felt that a minimum lot-size should be indicated. Immediately following the meeting the George Nolte Association measured the slopes and calculated average slope on each particular property which came out to approximately 15.5%. Using the City of Saratoga's fornpala. for decrease of total number of sites it comes out to 1.1 or 39 sites.They also laid out a subdivision map to make each building site what'Mr. Lohr considered from a design point of view and from an aesthetic point of view to be the best possible plan. They have met with the Subdivision Com~mittee and would like to. present this plan t6 the Comanission for further consideration. Cormnissioner Metcalf did not feel that ~his conformed to the letter of" '6h~""spif{~' .... of the slope-density requirements. Chairman Norton asked about the suggestion that Saratoga Foothills consider .a ....... try at the Planned~devel.opm~nt. ap'proaCh_.'and what the 'results had beenTa!0ng .. that line. FIr. Lohr replied that they did try to w6rk out a Planned development. There are 10 lots under 40,000 square feet and the remaining number is over 40,000 so technically this would meet the plannedTdevelopment requirements. From the long range aesthetic point of view they.could find nothing to reconmend the planned-development feature. Mr. Smith stressed that the purpose of this meeting was to get full conmission feeling as to alternatives to be submitted by Saratoga Foothills engineers. Chai~n Norton asked if the Conm~ission felt that the Planned Development avenue should be further explored even if the number of lots would be reduced and Comissioner Smith felt there was a choice of three - Planned Conmxnity, straight subdivision or Planned development. Of' the- three, he found planned development the least attractive. It was the consensus of the Connnission that we not go ahead with planned development and that standard subdivision is the S~ro'a~h' [i~a["~hould b~ fgilowed. - 5 - Planning ~onnnission Minutes 28 September 1970 - Continued Jerry I~ohr conm~ented that as the map was presently laid out there was little on. site grading to do. Commissioner Crisp stated that Mr. Lohr would have site-develOpment plans in detail when he submits his tentative map. .tie will .~ke a co~itment as to what type of · house ~.~ill be built on each lot. Mr. Smith stated that based on what was discussed at the study session it would seem appropriate that ~e could apply slope-density standards to the whole development without t~ severe penalty of applying it to indvidual lots ~hich heretofore ou~ Resolution has stated. Mr. Smith added that there was an'amend~d"'resoluti6n in the fife."'~iS seemed to be the most practical approach to the slope-density problem and far superior to the one previously considered in Saratoga. Mr. Lohr stated that his company still believed in the Planned Co~nity concept. However, 'it was still their desire to withdraw that proposed development and subsequent rezoning. The Council had encouraged them to file this tentative ~p. The Planned Co~nity concept comes before the Council in nine days and they hoped that the Council would take the property o~,~ers' desire into account. It is the intention of Saratoga Foothill Development Company to submit a 38-1ot map to ~e Subdivision Comnittee. C. SDR-857 - Cal-West Co~nities, Inc., Saratoga Avenue - Revision of Tentative Map and Request for Exception The Secretary stated that the Planning Co~ission had the authority to approve exceptions or modifications and forward their recommendations to the Council. Co~issioner Crisp pointed out that thes~ lots are not residence lots, although they are technically called lots. Lots ~3 and 4'are recreation and pool areas. Moved by Commissioner Crisp, seconded by Co~kmissioner Crisp to approve the staff report dated 28 September 1970 on SDR-857 with the appended Building Site Cox~ittee report and revision of tentative ~p and that it be fon~Tarded to the City Council as the reco~endation of the Conmission; carried unanimously. At 9:00 P.M., Chairman Norton called for a ten minutes recess, following which the Co~ission returned to Item II. F. V-351 - St. Patrick Fathers Missionary Sgciety, Eric Drive - Request for Variance to Allow conversion of the Existing .Garages for a Study - Continued from 14 Sept.1970 Chairman Norton. opened the' P~blic He~ring for the evening at 9:16 P.M. The Secretary stat'ed that there were no new coxm~nications in the file. James Sevilla, representing St~ Patrick's Fathers stated that at the meeting ~ith s6me of the Planning Commission on Eric Drive the previous Saturday, it was stated that a two_car garage was required or a car port. With the Priests' study in the garage, it is only possible to fit one car and they would like to use the existing garage as is with this study. It was suggested that a carport at the rear of the house entering from Miller Drive would be acceptable and Mr. Sevilla had a plan which he submitted to the Commission. They will take out a building permit if this is acceptable to the Commission. Mr. Sevilla noted that the pool equipment would be removed to another storage area. Chairman Norton pointed out that if they did this they would not require a Variance. The Secret'ary stated that this was in order.. The applicant informally requested to withdraw the variance. CrITY COUNCIL REPORT Commissioner Crisp gave a sun~nary of items reviewed and action taken at the City Council meeting of 16 September 1970 with emphasis on items of particular interest to the .Co~ission. V. OLD BUSINESS A. REVISION OF SLOPE DENSI~ STAND~DS Continued from 14 September 1970 Comnissioner Smith stated that in view of the meeting with the Policy Planning Con~ittee and the Consultant, he had taken the liberty of talking with the Planning Directo~ who had drawn up a proposed revision to the resolution previously been adopted. The changes x~ere in the Preamble, the second paragraph ~.Thich.gives some of the reasons which the consultant gave for slope density standards, one of the most important things being fires on hillside and also the septic-tank drainage-field problem which is apparently quite important in ~he slide hill area because of the slippage caused by disturbing the ~tural terrain. In view of the consultants comnents in application of slope-density for~la, they had changed the nomenclature to read'~average lot"rather than"mini~m lot~ and based on the entire subdivision He was submitting this for consideration of the Commission, not necessarily for approval at this time, but for further discussion, In response to a question from Co~issioner Martin as to whether a planned development would allow some lots less than the minimum, the Secretary replied that this was tr'.ue and that he had always been of the feeling that the slope-density Ordinance should be applied to standard subdivisions and this Would allow lapplication in a ~ch more flexible ~nner and would be a more reasonable way to approach it. Co~issioner Crisp wondered whether for hillside lots we should go back to the standard acre since the 40,000 had been established purely to give a man more sites. Chairman Norton suggested that the Subdivision Cox~ittee consider this ' and decide in tenns ~or '~e wh0i'e' 'city in cons61t~{on ............................... with the staff a~ City Attorney.' ...................................................... Co~issioner Martin asked how this affected the Planned Co~nity if the PC area were in an a~ in which slope-density would be applied. Chairman Norton replied that he would suppose we would use the same rules but there is a wide flexibility in Planned Cox~nity. In PC we can use smaller size lots but have to compensate in total green area which does not exceed the zoned total of lots. With regard to Paragraph 2 on page 2, Mr. Walker stated that this paragraph was intended to be substituted in the Resolution as it was originally applied and if we applied it on the entire parcel then possibly this paragraph is not necessary. Chairma~ Norton felt that cuts and fills should be shown as an additional requirement and not as an alternate. Conunissioner Metcalf agreed that we should ~ve a positive requirementz. Without objection, this matter of slope density provisions was continued to the next regular meeting for futher consideration. B. UP-173 - Franklin Homes, Sevilla Lane - Request for ExtenSion - Continued from 14 September ].970. The Secretary stated that Mr. Franklin has asked for withdrawal. be approved and that further proceedings be abandoned i "' ~7 - Planning~Co~m~ission M !tes 28 September 1970 - Continued C.~ A_~300 - Brown & Kauffmann, Cox Avenue and Miller - Approval of Additional Landscape Plan. Chairman Norton stated that this was based on the Commission's request for additional landscape plans and does have the approval of Design Review. Comnissioner Martin noted that between the sidewalk and the curb there was asphalt paving which would look like an extension of the street. He would prefer to see ice-plant ~ich would require minimum maintenance and water. There is a sidewalk. The applicant was present and concurred with the modification~ In response to a question from Con~issioner Martin as to whether Broken.&' Kauffmann had contacted the Homeowners Association which would take over this landscaping, Mr. Rose stated that.there has been contact but he was not sure whether this particular aspect had been discussed. Without objection, the matter of A-300 with regard to additional landscaping was continued to the next regular meeting. Design Review Committee to review this one week from now. D. Chairman Norton referred to a letter from Planning Conm~issioner. Martin suggesting (a) that scheduled committee meeting times and names of members of the connnittee be prominently posted'in the City Hall and at the Council Chambers during a Planning Con~nission meeting; (b) that interested individuals attend committee meetings and make constructive suggestions that will contribute to determing a policy for a report. If a large group of persons are in attendance, the questions and suggestions be restricted to a spokesman for each group; (c) that if the number of interested citizens attending a committee meeting exceeds the capacity of the usual meeting room, the Chairman should attempt to obtain a larger meeting'place; and (d) At the.request of an individual prior to the close of a working day of the Planning Commission meeting, a copy of a staff report or conm~ittee report shall'be made available. Co~mnissioner Martin's letter Went on to justify his reasons for each of these suggestions. it was the. Chairman's feeling that large numbers of people should not be encouraged t o attend contmittee meetings. It is time consuming and by and large the Commission likes to get the opinion of residents at a public hearing without being affected by the Committee Report. Mr. Martin's main concern was that interested residents attending a Planning Commission Public Hearing often' were not in possession of enough background information. Commissioner Metcalf could see a dangeF is having people denouncing the committee report rather than speaking to the facts. Mr. Martin stated that his letter was a suggestion for a general policy for Comnission and Council sub conmLittees. Chairman Norton replied that there was no objection to posting this schedule ~- ......... for Planning committee meetings.. As far as the Council committees are concerned, they are very flexible and informal and he did not know whether guests were invited or not. This would be a matter forthe City Council to decide. Commissioner Smith stated that he had checked with the City Attorney and were told that they could restrict people to one or two spokesmen for a group if they wished. As a matter of public relations, they have allowed as r0~ny people in the room who could sit down comfortably. It was the consensus of the Conmissionzthat paragraphs (a) and (b) were approved in principle, paragraph (c) should be held in abeyance for the moment and (d) was rejected completely. VI. SDR-811 - Donald A. Barnett~ Via Regina - Request for Extension The Secretary stated that this was a similar situation to UP-172 and asked that it also be referred . PROPOSED AMENDMENT - Sign Amendment for Multi-Family Residential Without objection, Chairman Norton set the public hearing at the earliest convenience. D. Commissioner Krause stated that the proposed convalescent hospital on Saratoga- Sunnyvale Road and Fruitvale bothered him a great deal and he wished .to suggest elimination of convalescent hospitals from'R-1 as a conditional use. Commissioner Krause noted that t~is was a BUsiness and buying R-1 land was cheaper than buying other types of land. ~ Chairman Norton agreed that it clearly was a business with all its relevant problems traffic employee parking, etc. He noted that there was a demand for senior citizen housing in Saratoga and he would like to explore public opinion on both these matters. .. Commissioner Crisp stated that studies have indicated that Davi. and Westmoreland hospitals are sufficient to handle the Saratoga area. The Assistant Planner suggested that some of the figures in the the senior-citizen housing-study currently undem~ay would possibly help in this matter and Mr. Walker suggested that the staff make a report on this conditional use in R-1 zones as to whether they are appropriate or not. ~ Chairman Norton instructed the staff to review and report on the desirability of various conditional uses now authorized in R-1 zoning as opportunity and their .other duties allow. E. UP-169 - Ge~'rge'Day Model"Home Sales Office~ Farwell Avenue - Request for Extension The Secretary stated that this was a non-agendized item which he would like referred. There was no objection to the matter being considered at this time. Without objection, Chairman Norton referred UP-t69 to the Subdivision Committee · and continued it to the next regular meeting. F. Comnissioner Martin stated that he had attended the last Planning Policy Committee meeting for Conm~issioner Krause and bad copies of reports presented there. ·He stated that Councilman Smith had presented a very comprehensive report from the hillside committee and he recomnended that it be read carefully.
