I. ROUTINE ORGANIZATION
A. ROLL CALL
Present: COmmissioners Crisp, Kraus, Lively, Martin, Metcalf, Norton & Smith
Absent: None
B. MINUTES
Commissioner Smith moved that the' minutes of 9 November 1970 be approved as
distributed and that reading thereof be waived, seconded by Commissioner
Crisp;'carried unanimously. Commissioner Metcalf abstained.
II. PUBLIC HEARINGS
A. ~-]37 - Alfred F. Dumas, Inc., P~ospect Road, Request for Change of Zoning
from "R-I-IO~000" (Single Family Residential) to "R-10,O00" "P-C"
(Single-Family Res{dential planned Community) - Continued from
9 November 1970
Chairman Norton opened the Public Hearing for the evening at 7:33 'P.M.
The Secretary stated that there was a request from the applicant to continue
the matter until the next regular meeting. The engineering is not completed
and they are working on the site.development plan.
No one present wished to comment.
Chairman Norton closed the public hearing for the evening at 7:35 P.M.,
directed C-137 continued to the next regular meeting and referred same to
the Subdivision Committee for study.
B. C-138 - Vince S. Garrod, Mt. Eden Road - Request for Change of Zoning from
"R-1-40,O00" (Single-Family Residential) to "A" (Agricultural)
Chairman Norton opened the Public Hearing at 7:36 P.M.
The applicant was present and stated that this is a proposal to change the
zoning for fifty-one acres from R-1-40, O00 to Agricultural since this
property has been put under the Williamson Act and a ten-year contract
signed with the City of Saratoga to keep it as an opensspace area. This
is a rolling contract automatically renewed every year until one or the
other party gives notice that they want to have it terminated, after which
it has nine years to go. In order to do this it is necessary to request
a change of zoning.
Chairman Norton stated that the City was grateful to the applicant for
having taken t he initiative in applying the Williamson Act to this
property. The Williamson Act permits Mr. Garrod to keep the property
in undeveloped condition and have it appraised for property taxation on
that basis. The City gets the benefit of the open space and Mr. Garrod
gets some compensation in terms of less taxation.
No one else present wished to con~ent. Moved by Commissioner Crisp, seconded
by Connnissioner Smith to close the Public Hearingat 7:43 P.M.
The Secretary read the staff report dated 23 November 1970 which recommends
with concurrence of the Subdivision Committee, that the subject application
be 'approved and recommended to the City Council ~n the basis (1) the
objectives of Section 1.1 of Zoning Ordinance NS-3 can be met.(2) the
proposal complies with the goals of the General Plan and (3) for.the
reasons set forth in the Staff Report of 7 October 1970 and subject to
the following condition: Permitted Uses one (1) t~rough eleven (11) as
set forth in City Council Resolution No. 550 adopted 4 November 1970.

Commissioner Smith moved that the changei of zoning be granted subject to the
conditions stated in the Staff Report dated 23 November 1970. and forwarded to
the City Council as the reconm~endation o~ the Commission, seconded by Coxm~issioner
Martin; carried unanimously.
C. UP-197 - Claude T. Lindsay, Norada Court - Request for Use Permit to Allow a Model
Homes Sales Office - Continued from 9 November 1970
Chairman Nortoh 'Opened the Public Hearing for the evenin at 7:44 P.M.
The Secretary noted that nothing new had been added to n'~e file.
The Assistant Planner briefly reviewed this application and noted that the Staff
Report.dated 23 Noventer 1970 recommends that the Use Permit be granted for a
period 8f'one (1) year 'subject to conditions (1) through (4) as outlined in the
report.
No one in the audience wished to comment; relative to this matter.
Commissioner Smith moved, seconded by CommisSioner Crisp that the Public Hearing
be closed; carried unanimously. Public Hearing closed at.7:47.P.M.
Commissioner Smith moved that the Staff Report dated 23 November 1970 relative'to UP-197
be approved,subject to the conditions stated in the report and that the Use Permit
be granted, seconded by Commissioner crisp; carried unanimously.
D. ZONING ORDINANCE AME~D~'~NT - Amending Ordinance NS-3 by Adding Section 11.12 to
Article 11 Prohibiting Use of MotOr Vehicles for
Advertising Purposes
Chairman Norton opened the Public Hearing at 7:49 P.M.
The Secretary stated that this was an amendment to the Zoning Ordinance which would
take care of parking-lot situations such as the one at Argonaut.
Without objection, Chairman Norton closed the Public'Hearing for [he evening at
7:53 P.M., directed the matter continued to the next regular mee[{ng and referred
same to the Subdivision Committee for study and recommendation. ~ "'
No one in the audience wished to con~ent relative to this matter.
Discussion by [he Commission indicated concern that the. draft be re-written so
as not to apply to private driveways.
III. BUILDING' SITES AND SUBDIVISIONS
A. SD-870 - Peter Pavlos, Chester Avenue - Subdivision Approval - 9 lots - Continued
from 9 November 1970
Commissioner Smith recommended that SD-870 bO continued to the next regular meeting
to allow time for further study. Chairman Norton so directed.
B. SDR-873 - George Stathakis, Michaels Drive - Building Site Approval - 1 Lot -
Continued from 9 November 1970
Commissioner' Crisp recomnended that SDR-873 be continued to the next regular meeting
to allow time for further study. Chairman Norton sO directed.
C. SDR-874 - Dr~ Hector N. MacKinnon~ Glen Una Drive - Building Site Approval - 1 Lot
Warren Held, Architect was present and asked for clarification of Condition B.
The Secretary replied that this would be a flare-out at the driveway approach
which would probably be mostly off site between the property line and the highway,
in the right-of-way.
Mr. Heid wished to go on record that there were some major oak trees which might inter-
fere, however, he thought this could be worked out with the State.
Chairman Norton noted that the closest Oak tree was quite far back from the property
line and the entrance is fifty or sixty .feet'beyond that. He felt there was little
danger,' and stated that Mr. Held should contact Mr. Walker and.the Commission if there
was any problem.
The Secretary stated that the garden-ho~se was about 8 ft. from the line and meets
the setback requirements.
Commissioner Smith moved that the report of the Building Site Con~ittee dated
23 November 1970 on SDR-874 be accepted .and that the tentative map, "Exhibit A"
filed 13 Noventer 1970 be approved subjqct to the General Condition 'I. and

Specific Condition II. A through I of the report, seconded by Commissioner
Metcalf; carried unanimously.
IV. DESIGN REVIEW
A. A-356 - AllCO (Formerly Richfield),' Big Basin Way and at the Corner of Cox
Avenue and Paseo Presada - Final Design Review - Replacement of Two
Identification Signs
Commissioner Metcalf requested a continuance on this matter since there was
a quorum lacking for the last Design Review committee meeting.
Without objection, A-356 was cont{nued to the next regular meeting.
B. A-358 - Nancy Franckx, Saratoga-L~s Gatos Road - Final Design Review -
Business Identification Sign
The Assistant Planner stated that the applicant wishes to withdraw her
application. She is going to ins[all a smaller· sign and perhaps reapply at
a later date.
Moved by Commissioner Metcalf tha~ the request of the applicant to withdraw
A-358 be approved, seconded by Commissioner Lively; carried unanimously.
V. CITY COUNCIL REPORT
The Secretary gave a sumnary of.items'reviewed and action ~aken at the City Council
meeting of 18 November 1970.
VI. OLD BUSINESS
A. SDR-832 - David L. Mendenhall, Mt. Eden Road - Request for Reconsideration
of Condition - Continued from 9 Noventer 1970
The Secretary reported that Mr. Mendenhall had requested an exception from his
underground utility requirement which was quite extensive as far as cost and
size of the project. He has now submitted all the cost figures necessary and the
SubdiviSion Co~mnittee and staff have reviewed·them. The Secretary recommended
that the matter be continued to the next regular meeting.
Without objection, Chairman Norton continued the request for reconsideration
in SDR-832 to the next regular meeting.
B. C-117 - M.V.S. Co., Cox Avenue and Saratoga Avenue - Request for Extension -
Continued from 9 November.1970
The Secretary stated that this matter was referred to the Subdivision Committee
as a routine ~equeSt for extens~o~ for one year.-There is no park fee requi~ed.

Commissioner Smith moved that the' extension be approved by the Commission and
forwarded to the City Council, seconded bY commissioner cr{sp; carried·unanimously.
VII. NEW BUSINESS
There was no new business.
VIII. CO~D~NICATIONS
A. WRITTEN
Chairman Norton stated that he had received a memorandum from the City Manager
with regard to the thoroughfare street lighting study and asked Commissioner
Metcalf to serve as the Planning Commission~s representative on the Citizen~s
Committee

Co~nissioner Crisp referred to. an article in.the San Jose Mercury with regard to the
danger of fire in the hillside areas.
Commissioner Kraus stated that ha had attended a Hillside Sub Committee meeting of
the PPC. .: ...
He felt it was necessary.to
consider Chis"0n'the basis of whether or not:there is a buildable site.. He also
discussed Marin's view on development and their concerns about the erosion of land,
and scarring of the hillside area. Commissioner Kraus stated this was a very
interesting and'appropriate talk with regard to the areas we are interested in and
felt that the newspaper article was very close to the truth. He stated that the
next meeting will concern itself with recommendations in regard to fire control.
Commissioner Kraus' noted that following the fire in Berkeley every house with a
shake roof was gone. . .................................................................. -...-..
After discussion,
Chairman Norton ~sked the Subdivision Committee, at its convenienc~ to bring this
suggestion as to altitude at which fire~resistant roofs should be required, back
to the Commission. Some guidelines which could be considered are terrain, presence
of flammable material, availability of fire fighting equipment, access for escape
etc.
B. ORAL
Commissioner Lively requested that the Agenda for the Joint Study Session include
an item which would involve the schedule for the General Plan Review for 1971.
Commissioner Crisp asked that the matter of communication between the Council and
the Commission also be included.
IX. ADJOURNMENT
Chairma~ Norton acknowledged the presence of Councilman and Mrs. ~¢yer; Mrs. Ottenberg
from the League of Women Voters; and Mr. Hubbard and Mrs. McGuire from the Good Government
Group.
The meeting adjourned at 8:32 P.M.
