Commissioner Smith' moved, seconded by Con~missioner Metcalf, that the

A. C'137 - Alfred F. Dumps, Inc., Prospect Road - Request for Change of
Zoning from "R-l-10,000" (Single-Family Residential) to "R-l-10,000"
"P-C" (Single-Family Residential Planned Community) - Continued from
22 February 1971
Chair~n Lively re-opened the hearing at 7:38 P.M.
CoEissioner Smith stated that the Subdivision Co~ittee did meet with the
applicant and revised plans were submitted; however, they are inc~plete.
A requirement of "P-C" zoning is that the applicant submit all architectural
drawings and floor plans. At the time these plans are received they will be
submitted to the Design Review Committee for review; thereafter, a report
and reconm~endation will be prepared relative to C-137.
Mr. Arthur H. Grafe, 12121 Saraglen Drive, stated that the Blue Hills
Homeo~.mers Ass6ciation held their meeting to review the map for C-137
and there is concern about the main entrance being located at the Rodeo
· Creek entrance.
The Secretary explained that the nmp referred to by ~ Grafe has been
Superseded by a later version and ~.~. Haines, President of the Blue Hills
Homeo~,~ers Association, did review the current n~p.

The Secretary stated that the.applicant's representative submitted
a x.rcitten request for a two (2)·x,:eek continuance of C-137 in order
to allow time for further devc:,!opment of the plan.

continued C-137 to the next regular meeting and referred same to

B. V-354 '- John Markulin, Leonard Road - Request for Variance to Allow
Site Reduction for Corridor Lot - Continued from ~2 February 1971
Chairman Lively re-opened the hearing at 7:45 P.M. The Secretary stated
that the applicant has submitted a written co;.,~unication stating that it.
would be economically unfeasible to provide a city street at the subject
site; therefore, he would like to follow through·~ with his original
variance request to allow site-reduction for the subject corridor-lot.
No one in the audience ~.rished'to comment relative to V-354.
Chairman Lively closed the hearing for the e~ening at 7:47 P oM., referred
V-354 to the Variance Committee and directed same continued to the next
regular meeting.
Cormnissioner Kraus, on behalf of the Variance Com. a~ittee, arranged for an
on-site inspection of the property for 9:00 AoM., on Saturday, 13 ~.·~rch
1971 and requested the Secretary to inform the applicant.
C. V-35__7 - Herion Roofing, Inc., Prospect Road - Request for Variance to
Allow Overhead Utilities
The hearing relative to V-357 i~.,~s opened at 7:48 P.Mo The Secretary
stated the Notices of Hearing ~,~ere mailed. He then explained that
whether or not the variance is granted the po~:er poles will remain
in approximately the same location with at least the 60KV lines on the
pole. The Secretary read a Statement of Reason filed by [~. Bob ~·thot
the applicant's representative.
The applicant ~,.~as not present since he understood the matter would
be continued and referred to the Variance Com.mittee.
~r. Read Ambler~ 20809 ~[~ureen Way, ~,.~s present and submitted a petition
containing sixty four (64) signatures opposing the subject request for
variance. He then stated that 1) he is an attorney representing residents
of the area 2) he was not ax,~re that the poles would remain, even though,
the variance is not granted and 3) the residents of the area are most
eager to see the poles removed.
Mr. Warren ~.~rneeler, 20800 Prospect Road, inquired if this variance is
granted would that not eliminate with the possibility of any of the lines
ever going underground?
· The Secretary explained that the only ~ay all the lines in the area could
be put underground would be if an assessment district were formed for that
purpose.
Mr. Wheeler stated that he would not be as opposed to the requested variance
if the applicant would be willing to post bond to place the lines underground
if the time ever came ~,:hen a system ~.:ere developed to put all the po~.;,er lines
along this area underground.
Commissioner Metcalf pointed out that an identical situation came up along
Cox Avenue and the underground utility requirement ~.:as enforced.

II. Co V-357 - Contin~,ed
Mr. Dick Rosier, 20718 Prospect Road, stated that he signed the
petition opposing the requested variance and was present to verbally
state his 'objection.
~k'. Ambler stated that when ~{e was out getting signatures for the
petition the existing poles could be seen from all angles. tie further
stated that there is a new school proposed for this area and then there
will be a substantial number :of residents going in and out of the area
and the above-ground utilities will detract from the aesthetic quality
of the neighborhood.
Chairman Lively closed tb_e hearing for the evening at 8:00 P.M.,
directed V-357 continued to the meeting of 22 I.~rch 1971 and referred
same to the Variance Committee.
Co~nnissioner Kraus, on behalf of the Variance Committee, arranged for
an on-site inspection of the property for 9:30 A.M., on Saturday,
13 March 1971 and requested the 'Secretary to inform the applicant.
D. V-358 - Saratoga Foothills Development CorporatiOn, Saratoga-Sunnyvale
Road - Re.quest for Variance to Allow Overhead Utilities
The hearing ~?as opened at 8:02 P.M. The Secretary stated the Notices
of Hearing were mailed.
Mr. Bernie Turgeon, Vice President of Saratoga Foothills, stated that
1) so far on High~.~y 85 tilere has not been any undergrouding of any
utility lines 2) even if this variance is denied for this side
the street there would still be tile lines from the subdivision (Osterlund)
recently completed across the street 3) there is a letter fr. om PC~E
stating that they would have to tear up High~.~ay 85 to carry this line
across 4) if the" underground utilities are required it would mean an
additional cost of $800. to $1,000. per lot and that is quite a bill
for an individual buyer consi~!'ering they will not realize very much
aesthetic gain since the existing lines will still be there 5) all
utility lines ~.~ithin the subdivision are underground and 6) in the
next year or two PG&E m~y-. become r~sponsible for undergrounding all
power lines.
M~. I.,.~eeler, 20800 Prospect Road, stated that just because some other
sUbdivider did not provide unc]erground utilities is real].y no reason
for ~.~. Turgeon to feel he should be excused from providing underground
utilities.
Chairman Lively closed the hearing for the evening at 8:12 P.Mo,
directed V-358 continued to the next regular meeting and referred
same to the Variance ConLmitte~.

A. 8DR-883 - Thomas Fryer, Saratoga Hills Road - Building Site Approval -
2 Lots - Continued from 22 February 1971
Com~nissioner Smith reco~-~nnended that this matter be continued to allow
tile applicant time to develop .a plan to improve the slope of the drive~ay
and widen it out to conform with City Ordinances.
Chairman Lively, in view of the foregoing, directed SDR-883 continued to
the meeting of 22 March 1971.

The Secretary stated that the applicant has review.Ted the proposed
conditions of approval and has expressed satisfaction with same.
Commissioner Smith moved, seconded by Co~issioner Kraus, that·
the Building Site Com~ittee Report dated 8 March 1971 relative
to SDR-884 be adopted and that the tentative map (Exhibit "A",
filed 26 February 1971) be approved subject to the conditions set
forth in said report; motion carried unanimously.
C. SDR-885 - Tom Scott. Via Re~ina - Building~ !Site Approval - 1 Lot
The Secretary stated that the applicant has reviewed the proposed
conditions of approval and has ezpressed satisfaction with same.
Conunissioner Smith moved, seconded by Commissioner Kraus, that the
Building Site Committee Report dated 8 March 1971 relative to SDR-885
be adopted and that the tentative map (E:<hibit "A" filed 1 March 1971)

be approved subject to the conditions set forth in said report; motion
carried unanimously.
D. SD-886 - Peter F. Fitchen_, Inco_, Anza Drive~- Subdivision Approval - 9 Lots
Commissioner Smith stated that the Subdivision Connnittee Report listing
the proposed conditions of approval had been prepared.
M~.·Fitchen, applicant, ~..~as present and stated that all the trees on
the property (except .for orchard trees ~.Thich could not be left without
proper maintenance) will be saved. The trees located on the property
dedicated to the Flood Control District are another matter since it is
not possible to state ~.~hat plans they have for the creek. Mr. Fitchen
further stated 1) he ~..~ould request the alternative of providing Condition 3
(Provide decorative ~call or fencing, including tree planting within lots
along State Free~,.,ay right-of-~.Tay.) as he developed the individual lots
because of ~,~atering and maintenance 2) he does not intend to propose any
deed restrictions for this subdivision; therefore, Item No. 23 of the
Standard Engineering Conditions ~.~ould not be fulfillc~ and 3) pedestrian
walkx,~ays will not be required so Item No. 28 of the Standard Engineering
Conditions is not necessary.
The Secretary explained that if deed restrictions are not proposed then,
of cours~ none can be filed and if the Director of Public Works does not
require ~,~lk~;~ys the subdivider is not obligated to provide them° He
further stated that any trees proposed for removal by Flood Control must
be approved for removal by tile City and the people at Flood Control are
a~.Tare of this permit requirement.
Chairman Lively recommended that the following be added to Condition (1)
of the Subdivision Conm~ittee Report "Less Item 28."
Commissioner Smith moved, seconded by Commissioner Kraus, that the
Subdivision Conn~nittee Report dated 8 ~.~rch 1971 relative to SD-.886
be adopted, as amended, and that the tentative map (Exhibit "A" filed

26 February 1971) be approved subject to the conditions set forth in

Commissioner Smith reconm~ended that SDR-8~7 be continued to the
meeting of 22 March 1971 to allow time for further study.

IV. DESIGN REVIEW

The Secretary pxp_..!~_ined. that 'the applicant could not be here at this

Bo A_-_363 - West Valley Jr. College, Fruitvale and Allendale Avenues -
Final Design Review - Fine Arts and Humanities Building
Continued from 22 Febr_u~ry 1971
Commissioner Metcalf read the Design Reviex,~ Commiteee Report dated
8 March 1971 relative to A-363 recommending that design approval for
the fine-arts 'and humanities [buildings be denied.
CoFznissioner Martin. explained that 1) he did 'not agree with some
parts of the report read by Commissioner Metcalf, but he does wish to
see reduced the height of the proposed building 2) be visited Foothill
College to review the looks and' size of their auditorium and based on
this observation he disagrees with the statement in the report relative
to v{sual impact and 3) there are buildings within the vicinity of the
proposed structure that greater affect the visual impact of the area.
Commissioner Smith raised the question of a further ordinance deviation by
'the fact that the scenery loft covers more than 10% of the total
building area; therefore, the extra 25-feet in height allotted for the
scenery ].oft cannot be made available in this case.
Commissioner Metcalf stated he is a~;are of that provision of the ordinance;
ho~,;ever, he felt that could be overcome depending upon how the 10% is
applied either 1) against just the auditorium building or 2) against
the total building-complex. 'The Design Review CoFanittee decided in favor
of the latter.
Dean Arnold, representing the college, stated that 1) the people
involved developed the educational program for the college and its
activites 2) after they wer~ developed and approved by the Board they ~:ere
· given to the architect to uge as a guide to design a building to meet
those requirements 3) as a result the proposed building exceeds the City
height-limitation 4) to lower a portion of the building would affect a
reaction throughout the entire building and would cause the building to
be inoperable for the necessary education-environment 4) to redesign the
building would cause a delay .of three (3) to four (4) months and the
college would lose State funding '5) he hoped this matter could be settled
with a variance or by some o~her measure; so, the building can be put out
to bid and the~ program can be carried on as prescribed.
Chairman Lively stated it is. unfortunate ~he college dealt with its
departments and their architect but not with the City; so, now there is
a probl. em and the college is not willing to lower the building or make
other design arrangements.
Commissioner Metcalf explained that 1) he, also, ~..Tent to look at
Foothill College and its scenery loft 2) the Foothill College scenery
loft is about the same height as the one proposed for West Valley Jr.
College; ho~¢ever, the auditorium has been designed off the face of a
plateau, the auditoriun~ seating follows the slope of the hill and the
scenery loft is dropped belox~ that 3) in other words. the architect
took advant_~.ge of the contour of the land to cut dozen the apparent
height of the scenery loft and 4) unfortunately, this has not been done
for the subject application. ~

IV. B. A-363 - Continued
Co.~m~aissioner Metcalf moved, se. conded by Con~missioner I,~rtin, that the
Staff Report dated 8 March 1971 be adopted and final design approval for
the Fine Arts and Humanities Building be denied on the basis the central
structure exceeds the maximum'height permitted by Zoning Ordinance NS-3;
motion carried unanimously.
C. A-367 - Saratoga Foothills Deyelopment Corporation, Saratoga Avenue -
Final Design Review -.Condominium Apartments
Com~missioner Metcalf noted the Staff Report dated 8 March 1971 relative to
A-367 recommends that final design approval be granted for the condominium
apartment s ~
~. Bernie Turgeon stated that in reference to condition (b) as stated
in the subject report he x.~ould request that, if necessary, because of the
difficulty in locating the feeder lines, he be allox~ed to place two (2)
air-conditioning units on the .ground in a sound-proof enclosure.
He further stated two (2) units have already been roof-mounted.
Commissioner Metcalf stated that if ~. Turgeon does find difficulty '~.Tith
the roof-mounted units at a later date he resubmit the aforementioned
request for consideration by the Design Review Committee; otherwise,
the condition (b) will remain as presently stated in the subject report.
Co~raissioner Metcalf then reconmended that paragraph 2. . .line 5. . .
of the subject Staff Report be amended as follows:
delete the ~.7ord "With" and insert the ~ords "have been employed". . .
and in line 6. . .delete "these techniques would" and insert the ~ord

Conmissioner Metcalf moved, seconded by Con~nissioner Martin, that the

A. A-362 - M. E. Frazier, Cox and saratoga Avenues - Preliminary Design
Review - Office Buildin~ - Continued from 22 February 1971
This item ~.~as postponed to this portion of the agenda to await the
arrival of the applicant~s representatives. ~'
Chairman Lively explained that at the last Planning Connnission meeting
everyone ~.~ishing to discuss this matter was encouraged to make an appoint-
ment ~.~ith the Design Revie~ Committee.
Commissioner Metcalf explained that 1) the Design Revie~ C~nmittee met
. with the applicant, Dr. Abrams, representatives from the medical center,
and representatives from different Homeo~ers Associations. 2) there were
objections voiced relative to' the drive~y access on Saratoga and Cox
Avenues and the internal-parking plan 3) the statement ~as made by
representatives of the medical center that they would be happy to ~,7ork
with the applicant to provide a different access or easements throughout
the medical village and the subject parcel so that the direct access on
Saratoga and Cox Avenues ~,~ould not be req~ired and 4) the Design Review
Cox~nittee left it' with the applicant and the representatives of the n~edic~l
'village to '~,zork out some type of agreement the'resUlt of which ~cas to be made
knox.m at this meeting~
The Secretary recommended that a recess be called at this time to await
the arrival of the applicant"s attorney.

RECESS AND RECONVENE
IV. A. A-362 - Continued
Mr. Tenenbaum, attorney for the applicant, stated that the applicant
has submitted all the require'd plans and the Staff Report recommends
preliminary design approval be granted.
Mr. Joseph Sheredy, 19095 Cox Avenue stated that 1) m~nny years
ago x.~hen the medical village ~,ms first approved the neighborhood
~as v.ery concerned and after numerous hearings the neighborhood
accepted, with some confidence, the idea that the m.?dical village
· ~ouid be developed x:,ith the interest of the ne.ighborhood in mind
2) the requirements imposed on the medical. village should be
imposed on this piece of property in order to maintain the character of
the area 3) the residents of this area have al~,.~ays been assured there
w~d.ld nbt "be ingress or egress on to Saratoga or Co:--. from this property
4) it would be dangerous to allo~.~ such a traffic pattern and it should
be avoided by any means possible 5) adequate parking must be provided
and under the proposed plan it would hardly seem possible to provide
sufficient parking for the employees much less the clientele ~.ind 6) there
continues to be a parking problem ~..~ith the medical village clients parking
in front of the neighborhood homes (even though the doctors do everything
to discourage same) and if this plan is approved as proposed Cox Avenue
will become a permanent parking-lot causing a disagreeable and dangerous
situation.
Mr. Bob Menso~ President of the Saratoga Park Woods tlomeox,n~ers Association~
stated that 1) his association has had representation at most of the meetings
regarding the subject development of this property 2) the main problems
concerning the }lomeox,mers Association is the parking and ingress-and
egress-plans 3) there are a lovely group of homes in this area and x.~e
do not ~.~nt it to become a commercial area 4) ~.Te ~nt to make sure thai:
the architectural design fits in xvith the medical village, but the size
of the proposed building is too large to fit in with the medical village
buildings and the parking facilities are less per square foot than those
of the medical village and 5) it may be a good idea to continue this
matter and refer it to the Design Review Committee to allow time for
further discussion.
Mr. Diridon, President of the Brookview Homeo~:~ners Association, stated that
if the building and layout is approved, as proposed, an intolerable safety
hazard will result and the entire development will detract from the appear-
ance of the neighborhood.
Dr. ~rcus Bitter, one of the o~.nLers of the medical village, stated that
· the representatives of the mec!ical village did come up ~,,'ith a proposal
for ·access and the applicant's attorney has been supplied with a copy of
this proposal.
Mr. Tenenbaum stated it is felt that 1) the plan proposed by the
representatives of medical village is unacceptable ·since it is unfunctional
and ~,;ill create heavier traffic x~.~ithin the lot itself 2) the plan (as proposed
by the appliC.a__n.t)_' provides up to 50% more·· pa~kin~ 'than _~,j~at'iS_..l~e'~ir'~.d_._~y
the_ .or_~_l.inance and 3) .. it ~.s tILe applicant's intent to provide an attractive
plan for this corner which will, incidentally, cost considerably more than
any other building in tile area. He further stated that if some agreement
is not reached the matter could be tied up in arbitration for many years.
Dr. Bitter stated that it is~ not his intent to tie the matter up in
arbii:ration since he only wi,~hes to see a fair and equitable assessment
and it is felt that the proposed plan is incompatible with the original
intent for the aesthetic character of this neighborhood.

Dr. Walter Powers, 19079 Cox Avenue, stated that he just wished to
emphasize the Homeox.:ners Associations_-' interest in the proper development
of this property and the objections to th6 ingress-and egress-pattern as
proposed by the applicant.
Y~. Fred Styles, 18990 Saratoga Glen Place, stated that 1) at the
Design Review Committee meeting it ~:,as suggested that the property
o~,.~ers and representatives of the medical village work together to
arrange an agreeable ingress and egress and 2) no agreement has been
reac~ed to date; however, the applicant did agree to eliminate the
lobby.-like entrance.
Dr. O'Neil stated 1) he x%~as one of the first two (2) people to build
in the medical village 2) the restrictions were excessive and he
thought at the time that the restrictions on any adjacent buildings·
would be of similar quality .and 3) the landscaping in the medical
village shields the parking areas and the requirement should~ also, be
imposed on the proposed building.
Commissioner Metcalf stated that there Seem· to be two (2) different
problems relative to this development 1) the access to anti from Cox
and Saratoga Avenues 2) the 'design of the building itself. He further
sta~ed that he notes from a p.ast file that his predecessors on the
Planning Commission had some 'doubts concerning the direct access to the
subject plot·of ground and ~Tent on record at least once denying "P-A"
(Professional-Administrative)' for this parcel.
Chairman Lively stated that the "P A" (Professional-Administr~.tive)
zoning has been established and the Planning Commission must now decide
how to make it compatible with the surrounding area.
Commissioner Metcalf stated that one other avenue of approach is open
to the Commission and that is to submit these preliminary plans to the
Architectural Advisory Commit'tee for review.
Chairman Lively referred the matter back to the Design Review Committee
with instructions to get an opinion from the Architectural Advisory·
Committee and directed A-362 continued to the next regular meeting.
V o CITY COUNCIL REPORT
Commissioner Smith gave a summary. of items reviewed and action taken at
the City Council meeting of 3 March 1971 with emphasis on items of particular
interest to the Commission.
VIo OLD BUSINESS
A. UP-189 - James R. Davi, Sousa Lane - Request for Extension - Continued
from 22 Februa~ 1971 ··
The Secretary explained that the applicant's plans are the same as
originally drax.a~ up several years ago except that they have been somewhat
· updated.

Mr. Davi, the applicant, explained that the mortgage market has opened up
and, hopefully, within the nekt three (3) or four (4) weeks further progress
can be made on this application.
Co~n~issioner Marshall stated that the Staff Report indicates there have
been numerious extensions for this Use Pertnit.
Chairman Lively stated that the State of California requires that
the appiicant show some aboveiground construction by 1 July 1971.

VI. A. UP-189 - Continued
Coxmmissioner Kraus explained that this application has been before
the Planning Commission for the past several years and the Planning
Cormmission recommended denial of the last extension; however, the
applicant appealed to the City Council and they did grant the said
extension.
Commissioner Fagan pointed out that before acting on this request
some consideration should be given to the need factor for convalescent
ade ua
homes since there seems to be a surplus or at least an q te number
of these facilities.
Chairman Lively proposed that the matter be continued off the agenda
until I0 May 1971 to see if the applicant files for Design Review and
Building Site Approval; thereby, indicating his intent to proceed with
the application at this time.
Commissioner Kraus stated he did not feel the matter should be granted
a further extension,
Commissioner 1.~rshall pointed .out that the subject Use Permit has been
agreed to and approved and to .deny the extension at this time would be
inconsistent.
Commissioner Smith stated that, he felt, the request for extension should
be denied (even if the City Council again overrules the decision of the
Planning Com_n~ission)~

for UP-189 be denied for the reasons stated in said report; motion carried
with the following vote:

Commissioner Marshall stated he would like to go on r~cord and say that
he voted"no"on the foregoing motion since the Planning Commission has
been dealing with this applicant since 1965 and has approved the Use Permit
for a convalescent home and it seems frivolous to deny an extension of the
Use Permit now with only two and a half months to go before the State Permit
expires.

The Secretary explained that the matter of a animal pick-up ordinance
has been referred to the Planning Commission by the City Council,

Commissioner Metcalf read a r,eport relative to the proposed I~ster Plan
for Trails and Pathways dated 8 l~rch 197~1, which, he stated is an
interim report. He further stated that the G~neral Plan Committee will
meet with a representative of the Parks and .Recreation Com~,nission to
discuss this matter'again at 9:30 AoMo on Saturday, 13 March 1971o

The Secretary explained that la copy of the Prccedure on Grading Ordinance
has been placed in each folder for information purposes and if any
