PLACE: City Council Chambers, 13777 Fru,itvale Avenue, Saratoga., California 95070 TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was callled to order by Chairman Lively at 7:30 P.M. A. ROLL CALL · Present: Commissioners Fagan, ~aus, Lively, Marshall, Martin, Metcalf, and Smi. th. Absent: None. B. MINUTES Commissioner Smith moved, seconded by Commissioner .Metcalf, that the reading of the minutes of the 22 February 19.71 meeting be waived and they be approved as distributedi with the following changes: page 6.. .under B. C-137 - Alfred F. Dunus, Inc., .Prospect Road - Request for Change of Zoning from "R-I-iO,000" (Single-Family Residential) to '~-1-10,000" "P-C'" (Single-Family Residential Planned Community) - Continued from 22 February 1971 Chairman Lively re-opened the hearing at 7:38 P.M. Connnissioner Smith stated that '.the Subdivision Co~f. ittee did meet with' the applicant and revised plans were submitted; however, they are incomplete. A requirement of "P-C" zoning is that the applicant submit all architectural 'drawings and floor plans. At 'the time these plans are received they will be submitted to the Design Review'Committee for review; thereafter, a report and recommendation will be prep~ared relative to C-137. Mr. Arthur H. Grafe, 12121 Saraglen Drive, stated that the BlUe Hills Homeowners Association held their meeting to review the map for C-137 and there is concern about the main entrance being located at the Rodeo Creek entrance. The Secretary explained that the map 'referred to by Mr. Grafe has been ~Uperse_dediby a later version and Mr. Haines, President Of the Blue Hills Homeo~mers Association, did review the ',current map. : _ ............: ...................\ Plannin~ Commission Minutes - 8 March 1971 - Continued II. A. C-137 - Continued The Secretary stated that thelapplicantts representative submitted a written request for a two (2) week continuance of C-137 in order to allow time for further development of the plan. Chairman Lively closed the hearing for the eveningat 7:45 P.M., continued C-137 to the next regular meeting and referred same to ~ . . the Subdivision Committee. · ~ · . ~ B. V-354 - John Markulin, Leonard Road - ReqUest for Variance to Allow Site Reduction for Corridor Lot - Continued from 22 February 1971 Chairman Lively re-opened the :hearing at 7:45 P.M. The Secretary stated· that the applicant has submitted a written co~uixunication stating that it would be economically unfeasible to provide a city street at the subject site; therefore, he would like to follow throught with his original variance request to allow site-reduction for the subject corridor-lot. No one in the audience wished to comment relative to V-354. ChairmanLively closed the hearing for the evening at 7:47 P.M., referred V-354 to the Variance Coxfmiittee and directed same continued to the next regular meeting. Commissioner Kraus, on behalf!of the Variance Committee, arranged for an on-site inspection of the property for 9:00 A.M., on Saturday, 13 March 1971 and requested the Secretary to inform the applicant. C. V-357 - Herion Roofing, Inc.,:Prospect Road - Request for Variance to Allow'Overhead Utilities The hearing relative to V-357 ~as opened at 7:48 P.Mo 'The Secretary stated the Notices of Hearing .were mailed. He then explained that whether or not the variance iS granted the power poles will remain in approximately the same location with at least the 60KV lines on the pole. The Secretary read a Statement of Reason filed by Mr. Bob Mathot the applicant'srepresentative. The applicant w~s not present !since he understood the matter would be continued and referred to the Variance Committee. Mr. Read Ambler, 20809 Mauree~ 'Way, ms present and submitted a petition' containing sixty four (64) signatures opposing the subject request'for variance. He then stated that: 1) he is an attorney representing residents of the area 2) he was not a~re that the poles would remain, even though, the variance is not granted and 3) the residents ~f the area are most eager to see the poles removed=. Mr. Warren Wheeier, 20800 Prospect Road, inquired if this variance is granted.would that not ~'I~f~ie%~ with the possibility of any of the lines ever going underground? The Secretary explained that the only way all the lines in the area could be put underground would be if' an assessment district were formed for that purpose. Mr. Wheeler stated that he wou.ld not be as opposed to the.requested variance if the applicant would be willing to post bond to place the lines underground if the time ever came when a system were developed to put all the power lines " along this area underground. : Commissioner Metcalf pointed out that an identical situation came up along Cox Avenue and the underground!utility requirement was enforced. .. V-357 - Continued Mr. Dick Rosler, 20718 ProspeCt Road, stated that he signed the petition opposing the requested variance and was present to verbally state his objection. ! ;. -Mr. Ambler. stated that when h~ ms out g~ting signatures for the petition the existing poles could be~'~,from all angles. He 'further stated that there is a new school proposed for this area and then there will be a substantial number 6f residents going in and out of the area and the above-ground utilities will detract from the aesthetic quality of the neighborhood. Chairman'Lively closed the hearing for the evenln~'-~t 8:00 PoM., directed V-357 continued to the meeting of 22 March' 1971 and referred same to.the Variance Committee. Commissioner Kraus, on behalf~of the Variance Committee, arranged for an on-site inspection of the property for _9:30 A.M., on Saturday, 13 March 1971 and requested the ~'~'~a~{ to inform the.applicant. D. V-358 - Saratoga Foothills DeVelopment Corporation, Saratoga-Sunnyvale Road - Request for Variance to Allow Overhead Utilities !.The hearing was opened_et' 8:02 P.M~ The Sec/retary stated the Notices of Hearing were mailed. Mr. Be~nie Turgeon, Vice President of Saratoga Foothills, stated that 1) so far on Highway 85 there has not been any undergrouding of any utility'. lines 2) even if this variance is denied for this side.of the street there.would still be the lines from the subdivision (Osterlund) recently completed across the'street 3) there is a letter from PG&E stating that they would have to tear up Highway 85 to carry this line across' 4) if the?Z: underground utilities are required it'would.mean an additional cost of $800. to $1,000. per lot and that is quite a bill for an individual buyer considering they will not realize very much aesthetic gain since the existing lines will still be there 5) all utility lines within the subdivision are underground and 6) in the next year or two PG&Em/~. become responsible for.undergroundi~'g~I~ power lines. : Mr. ~eeler, 20800 Prospect Road, stated that just because some other subdivider did not provide underground utilities is-really no reason .... for Mr. Turgeon to feet he shOuld.be excused from providing underground .. utilities. III. BUILDING SITES AND SUBDIVISIONS A. SDR-883 - Thomas'Fryer, ~aratoga Hills Road - Building Site Approval - 2 Lots - Conti~ued from 22 February 1971 CommiSsioner Smith recom~.ended! that this matter be continued to allow the applicant time to develop'~a plan to improve. the slope of the driveway and widen it out to conf6rm. with City Ordinances. SDR-884 - Dr. Ralph Merkley,. Pi~.e Road - Buildin~ Site Approval - 1 Lot The Secretary stated that th~ applicant has reviewed the proposed conditions of approval and h~s expressed satisfaction with same. Commissioner Smith moved,'~seCond~d'by Commissioner Kraus, thatiE' the Building Site Committee Report dated 8 March 1971 relative' to SDR-884 be adopted and that the tentative map (Exhibit '~", filed 26 February 1971) be approved subject to the conditions set forth in said report; motion! carried unanimously. C. SDR-885 - Tom Scott', V~a Re~na - Buildin~ Site Approval - 1 Lot The Secretary stated that th~ applicant has reviewed the proposed conditions of approval and has expressed satisfaction with same. Commissioner Smith moved, seconded by Commissioner Kraus, that the Building Site Committee Report dated 8 March 1971 relative to SDR~885 be adopted and that the tentative m~.p (Exhibit .'~", filed 1.March 1971) be approved subject to the"c0nditions set forth in said report; motion carried unanimously. D. SD-886 - Peter F. Fitchen, ~nc~ Anza Drive - Subdivision Approval - 9 Lots Commissioner Smith Stated. that the Subdivision Committee Report listing the proposed conditions of a~proval had been prepared. Mr. Fitchen, applicant, w-as present and stated that all the trees on the property.(except ~for orchard trees which c~dno~e left proper maintenance) will. be'~aved. 'The trees located on.the property' dedicated to the Flood Control District are another matter since it is not possible to state what plans they have for the creek. Mr. Fitchen further stated 1) he would request the alternative of providing Condition 3 (Provide decorative wall or fencing, including tree planting within lots along State Freeway right-of~way.) as he developed the individual lots -because of ~tering and maintenance 2) he does not intend to propose any deed restrictions for this subdivision; therefore, Item No. 23 of the Standard' Engineering Conditi6ns would not be~and 3)'f pedestrian walkways will not be required so Item No. 28 of the Standard Engineering' Conditions is not necessary.: The Secretary. explained that if deed restrictions are not proposed then, of cours% none can be filed ~nd if the Director of Public Works does not require walkways the subdivider is not obligated to provide them. He .. further stated that any tree§ proposed for removal by Flood Control must : be approved for removal by the City and the people at Flood Control are aware of this permi~"~ement. Chairman Lively recommended ~hat the following be added to Condition (1) of the'Subdivision Committee 'Report "Less Item 28." Commissioner Smith moved, seconded by Commissioner Kraus, that the ~Subdivision ~Committee Report dated 8 March 1971 relative to SD~886 be adopted, as amended, and tZhat the tentative map (Exhibit '~", filed 26 February 1971) be approved subject to the conditions set forth in said report; motion carried unanimously. E. SDR-887 - Dgn Carrm Via Re~ina - Buildin~ Site Approval - 1 Lot Commissioner Smith recommende~ that SDR-887 be continued to the meeting of 22 March 1971 to a.llow time for further study. SDR-888 - Thomas Dashjell, Bohlman Road - Building Site Approval - 3 Lots C~issioner Smith recommended that SDR-888 be continued to the meeting of 22 March 1971 to allow time for further study and revie~ of the plans. Chairman Lively so directed. IV. DESIGN REVIEW A. A-362 - M~,,E:~' Frazier, Cox and Saratoga Avenues - Preliminary Design Review - Office Building - Continued from 22 February 1971 .The Secretary explained that the applicant could not be. here at_th~s _",~ '~'ime and has requested ' ~h'~ 'matteF\co~tinued to later on the agenda ae'~he'end'of the"Deaign RevieW matters. A-363 - West Valley Jr. college, Fruitvale and Allendale Avenues - Final Design Review - Fine Arts and Humanities Building - Continued from 22 February 1971 Commissioner Metcalf read the Design Review Commitsee Report dated 8 March 1971 relative to A-363 recommending that design approval f6r the fine-arts'and humanities'buildings be denied. Commissioner Martin explained that 1) he did not agree with some parts of the report read by Commissioner Metcalf, but he does wish to see redeced the height of the proposed b~_l~'i~g 2) he visited Foothill .College to review the looks and size of their auditorium and based on this observation he disagrees with the statement in the report r~lative to visual impact and 3) there are buildings within the vicinity'of the proposed structure that greater affect the visual impact of the.area. Commissioner Smith raised the qu~.stion..Of a further ordinance deviation by ]the fact that !the scenery loft covers ~more than !0% of the total" building area; therefore, the extra 25-feet in height allotted for the scenery loft cannot be made available in this case. Commissioner Metcalf stated he is aware of that provision of the ordinance; however, he felt that could be overcome depending upon how the 10% is applied either 1) against just the auditorium building or 2) against the total building-complex..The Design Review Corm~ittee decided in favor of the latter. Dean Arnold, representing the college, stated that 1) the people involved developed the educational program for the college and its activites 2) after they were developed and approved by the Board they were 'g~ven k~h~'\~rchitect to use as a guide to design a building to meet those requirements 3) as a result the proposed building exceeds the City height-limitation 4) to lower a portion of the building would affect a reaction throughout the entire building and would cause the building to be inoperable for the necessary education-environment 4) to redssign the building would cause a delay of three (3) to four (4) months and the college would lose State funding 5) he hoped this matter could be settled with a variance or by some other measure; so, the building can be put out to bid and the .program can be carried on as prescribed. Chairman Lively stated it is! Unfortu.n~_.te'~the college dealt with its own departments and their architect but not With the City; so, now there is a problem and the college is.not willing to lower the building or make other design arrangements. Cof~m~issioner Metcalf explained that 1) he, also, went to look at Foothill College and itsi'scenery loft.2) the Foothill College scenery loft is about the same height as the one proposed for West Valley Jr. College; however, the auditorium has been designed off the face of a plateau, the auditorium seating follows the slope of the hill and the S.c__ep?~_ ~.oft is dr?pped.' ~!.?Y_ tha~. ~)___ i~..?~he~._w?~, ~he._~Chi___t?Ct ...... took advantage of the contour of the land to cut down the apparent height of the scenery loft and 4) unfortunately, this has not been done for the subject application. -5- Plannin~ Commission Minutes - 8 March ~1971 - Continued IVo B. A.-363 - Continded Commissioner Metcalf moved, Seconded by Commissioner Martin, that the Staff Report dated 8 March i971 be adopted and final design approval {or the Fine Arts and Humanities .Building be denied on the basis the central structure exceeds the maximum height permitted by Zoning Ordinance NS-3; motion carried unanimously. C. A-36____ZY- Saratoga Foothills DeVelopment Corporation, Saratoga Avenue - Final Design Review - Condominium Apartments Coauuissioner Metcalf noted the Staff Report dated 8 March 1971 relative to A-367 recommends that:?~inal design approval be granted for the condominium apartments. : Mr. Bernie Turgeon stated that in reference to condition (b) as stated in the subject report he would request that, if necessary, because of the difficulty in locating the feeder lines, he be allowed to place two (2) air-conditioning units on the~ ground in a sound-proof enclosure. He further stated two (2) uni'ts have already been roof-mounted. Commissioner Metcalf stated that if Mr. Turgeon does find .di~ficultyi~ith the roof-mounted units at a later date he resubmit the aforementioned request. for consideration by 'the Design Review Committee; otherwise~ the condition (b) will remain' as presently stated in the subject report. Commissioner Metcalf then recommended that paragraph 2.. .line 5.. of.the subject Staff Report be amended as follows: delete the word "With" and insert the wor~S "have been employed". . . and in line 6.. .delete "theSe techniquescwould" and insert the word "to" between the words "landsCaping" and "give". Commissioner Metcalf moved, seconded by Coumiissioner Martin, ~hat the Staff Repor.t dated 8 March 1971 be adopted, as amended, and that final design approval be granted as; shown on Exhibits "B", "C", "D" and "E" and subject to the conditions' stated in said report; motion carried unanimously. A. A-362'- M. E. Frazier, Cox and Saratoga Avenues~- Preliminary Design Review - Office Build~n~ - Continued from 22 February 1971 This item was postponed to this portion of the agenda to await the arrival of the applicant's representatives.~' Chairman Lively explained that at t.he last Planning Commission meeting everyone wishing to discuss this matter was encouraged to make an appoint- ment with the Design Review COmmittee. Commissioner Metcalf explained that 1) the Design Review Committee met with the applicant, Dr. AbramS~ representatives from the medical center, and representatives from different Homeowners Associations 2) there were objections voiced relative to the driveway access on Saratoga and Cox Avenues and the internal-parking plan 3) the statement was made by representatives.~f the medical center that they would be.happy to work with the applicant to provide~a different access or easements throughout the medical village and the subject parcel so that the direct access on Saratoga and Cox Avenues would not be required and 4) the Design Review Committee left it with the applicant and the representatives of the medical 'village to work out some type; of'~grie~'~"'~'h~"~e'S~l~. 9~'_..vah~ch was ~o ~e_ made.\ known a~"this"~eeting." A-362 - Continued Mr. Tenenbaum, attorney for the applicant, stated that the applicant has submitted all the required plans and the Staff Report.recommends preliminary design approval be granted. }dr. Joseph Sheredy, 19095 CoX Avenue].] stated that 1) many years ago ~aen the medical village ms first approved the neighborhood ms very concerned and after ]numerous hearings. the neighborhood accepted, with some confidence, the idea that the medical village would.be developed with the ~nterest of the neighborhood in mind 2) the requirements imposed !on the medical village should be ~im. posed on this piece of property in order to maintain the character of the area .3)~ the residents of !this area have always been assured there : would not be ingress or egre~s on to Saratoga or Cox from this property 4) it would be dangerous to'allow such a'=~traffic pattern and it should be avoided by any means possible 5) adequate parking must be provided and under the proposed plan it would hardly seem possible to provi~__e sufficient parking' for the employees much less the clientele dndi6)=.there continues to be a parking preblem ~ith the medical village.clients in front of the neighborhood .homes (even though the doctors do everything to discourage.same) and if t~is plan is approved as proposed Cox Avenue will become a. permanent parking-lot causing a disagreeable and dangerous situation. : Mr. BOb :Menso~.President of the. Saratoga Park Woods Homeowaers Associations stated that 1) his association has had representation at most of the meetings regardin~ the subject development of this .property 2) the main problems concernin~ the Homeowners Association is the parking and ingress-and. caress-plans 3) there are a lovely groupiof\homes in this area and we do not want it to become a commercial area 4) we want to make sure that the architectural design fits in with the medical village, but the size of the proposed building is tYoo large to fit in with the medical village buildinas and the parking facilities are less per square foot than those of the medical village and 5) it may be a good idea to continue this matter and refer it to the Design Review Committee to allow time for further discussion. Mr. Dir~dons President of the Brookview Homeowners Association, stated that if the building and layout is approved, as proposed, an intolerable safety' hazard will result and the entire development will detract from the appear- ance of the neighborhood. Dr. Marcus Bitter, one of the owners of the medical village, stated that the representatives of the medical village did come up with a proposal for. access and the applicantss attorney has been supplied with a.copy of this proposal.. Mr. Tenenbaum stated it is .feilt that 1) the plan proposed h~.he__ representatives of medical vi'llage is unacceptable'since it is unfunctional "\ and will create heavier traff;ic within the lot jr'self 2) the plan .(as propa'a~\, by th~ applicant)'provides up to 50% more. par__.k_i~g than what is required by. Ao A-362 - Continued Dr. Walter Powers, 19079 Cox Avenue, stated that he just wished to " emphasize the Homeowners Associa'tion4.} interest in the proper development of this property and the objections to the ingress-and egress-pattern as proposed by the applicant. Mr. Fred Styles, 18990 Saratoga Glen Place, stated that 1) at the Design Review Committee meeting it was suggested that the property owners and representatives of] the medical village work together to arrange an agreeable ingress and egress and 2) no agreement has been reached to date; however, the' applicant did agree to eliminate the lobby~like entrance. Dr. O'Neil stated 1) he was :one of the first two (2) people to build in the medical village 2) the restrictions were excessive and he thought at the.time that the__restrictions on any adjacent buildings would be of similar qualityi~'nd 3) ~he landscaping in the medical village shields the parking areas and the requirement~'~'~ou~7--~l-So, be imposed on the.proposed building. Commissioner Metcalf stated that'there seem~ to be',two (2D'~i]ferent problems relative to this development 1) the access to and from Cox and Saratoga Avenues 2) the design of the building itself. He further stated that he notes from a past file that his predecessors on the Planning Commission had some doubts concerning the direct access to the subject plot of ground and went on record at least once denying "P-A" (Professional'-Admfnistrative)i for this parcel. Chairman Lively stated that the "P-A" (Professional-Administrative) zoning has been established and the Planning Commission must now decide how tomake it compatible with the surrounding area. Commissioner Metcalf stated' that one other avenue of approach is open to the Commission and that is' to submit. these preliminary plans to the Architectural Advisory Committee for review. Chairman Lively referred the matter back to the Design Review Committee with instructions to get an<-7 opinion from the Architectural Advisory Committee and directed A-362 ~ontinued to the next regular meeting. .V. CITY COUNCIL REPORT Commissioner Smith gave a summary' of items reviewed and action taken at the City Council meeting of 3 March 1971 with. emphasis on items of particular interest to the Commission. VI. OLD BUSINESS '- A. UP-189 - James R. Davi, Sousa;Lane - Request for Extension - Continued from'~'~e~b~y 1971 \ The Secretary explained that the applicant'is'Lptans are the same as originally drawn up several years ago except ~hat they have been somewhat updated. Mr. Davi, the' applicant, explained that the mortgage market has opened .up and, hopefully, within the next three (3) or four (4) weeks further progress can be made on this application. Commissioner Marshall stated ~hat the Staff Report indicates there have been numerious extensions for!this Use Permit. Chairman ~ely i Stated that the State of California requires that the applicant sh~w some above?ground construction by 1 July 1971. -8~ Planning Commission Minutes - 8 March 1971 - Continued VI. A. UP-189 - Continued Commissioner Kraus explained that this application has been before the Planning Commission for t~e past several years and the Planning Commission recommended denial 'of the last extension; however, the applicant appealed to the City.' Council and they did grant the said extension. Commissioner Fagan pointed out] that before acting on this request some consideration should be given to the' need factor for convalescent homes since there seems to be a surplus or at least an adequate number of these facilities. Chairman Lively proposed that .the matter be continued off the agenda until '1"0 May 1971 to see if th'e applicant files for Design Review and Building Site Approval; thereby, indicating his intent to proceed with the application at this time. Commissioner Kraus stated he diid not feel the matter-should be granted a further extension. Commissioner Marshall pointed .out that the su.b. ject Use Permit has been agreed to and approved and to .:deny the extension at this time would be · ' inconsistent. : Commissioner Smith stated thatch, he felt, the request .for extension should be denied (even if the City Council again overrules the decision of the Planning Commission). Commissioner Smith moved, seconded by Commissioner Kraus~.~that the Staff Report dated 8 March 1971, be adopted, and the subject request for extension for UP-189 be denied for the reasons stated in said report; motion carr, ied with the following vote: AYES: Fagan, Kraus', Lively, Metcalf, and Smith. NOES: Marshall ABSTAIN: Martin Commissioner Marshall stated he would like to go on record and say that he voted"no"on the foregoing motion since the Planning Commission has been dealing with this applicant since 1965 and has approved the Use Permit for a convalescent home and it. seems frivolous to deny. an extension of the Use Permit now with only two and a half months to go before the State Permit expires. B. CONDITIONAL USE STUDY.- By Pla~nin~ Department The Secretary recommended thatZ this matter be referred to the Subdivision Committee for study and it be continued to the next regular meeting. Chairman Lively so directed. VII. NEW BUSINESS : 'A. SDR-824 - John B. ]4alsh, Herriman Avenue - Request for Extension The Secretary recommended that2 the subject request for extension be continued to the next regular meeting and referred to the Subdivision Committee for review. Chairman Lively so directed. B. Chairman Lively directed the matter continued to the next regular meeting and referred same to the Subdivision Committee for study. The ,.Secretary explained that the matter of a animal pick-up ordinance has been referred to the Planning Commission by the City Council. Chairman Lively directed the Secretary to schedule a public hearing relative to this matter for 5, April 1971. He further requested that a copy of the proposed ordinance be placed in each Commissioners folder .{!f, or the 'next regular meeting. F. PROPOSED MASTER PlAN FOR TRAILS AND PATHWAYS Commissioner Metcalf .read a r~port relative to the proposed Master Plan for Trails and Pathways dated. 8 March 19~1, which, he stated is an interim report. He further stated that the General Plan Committee will meet with a representative ofi the Parks and Recreation Commission to discuss this matter again at 9:30 A.M. on Saturday. 13 March 1971. G. PROCEDURE ON GRADING ORDINANCE The Secretary explained that a copy of the Procedure on Grading Ordinance has been placed in each folder for information pureposes and if any Commissioner wishes to furthe~ discuss the matter they can do so at the meeting of 22 March 1971.
