Commissioner Smith moved, seconded by Commissioner Kraus, that the reading
of the minutes of 8 March 1971 meeting be waived and they be approved as

The Secretary stated that a letter ~+a.s submitted by the applicant~s
representative requesting tb. at C-137 be continued since the plans are
still being revised and the applicant would again like to meet with the
Subdivision Com,nittee to further discuss the proposed plans.
Mr. Arthur H. Grafe, 12121 Saraglen Drive, :asked if interested {'esiden~ could
attend the Subdivision Committee meetings when the subject application is
discussed with the applicant.
Chairman Lively explained that the Coms~ittee meetings are not public hearings;
however, if an appointment is made with the Co~nittee they will meet with
individuals to discuss certain applications and listen to comments.

The Secretary read the Staff Report dated 22 March 1971 recommending
that the subject request for Variance be denied.
Commissioner Smith moved, seconded by Comn~issioner Kraus~ to close the
hearing at 7:41 PoM.; motion carried unanimously.
Commissioner Kraus moved, seconded by Commissioner Fagan~ that the Staff
Report dated 22 March 1971. be adopted and that the subject request for
Variance V-354 be denied on the grounds that the findings required by
Section 17o6 of Zoning Ordinance NS-3 cannot be made· for the reasons
stated in said report; motion carried una'nimously.
C. V-357 - Herion Roofing, Inc.~ Prospect Road - Request for Variance to

The hearing relative to V-357 was reopened at 7:42 P.Mo
The applicant was not present.

At the request of a gentlemen··· in the audience about thirty (30) people
stood up in opposition of the subject application.
The Secretary read the Staff Report dated 22 ~rch 1971 reco'.,nmending
that the request for Variance in connection with V-357 be denied.

Commissioner Kraus moved, seconded by Commissioner Smith, to close the
hearing relative to V-357 at 7:46 Po14.; motion carried unanimously.
Comraissioner Kraus moved, seconded by Com~nissioner l~rtin, that the Staff
Report dated 22 March 1971 be adopted and that the subject request for
Variance V-357 be denied on the gasis the findings required under Section 17.6
of Ordinance NS-3 cannot be made .for the reasons stated in the subject report;
motion carried unanimously.
Con~n~issioner Marshall stated that at the time of the on-site inspection it
was determined that two (2) trees identified as redwood and Locust· are not
suitable for retention. He further stated that. PG&E has sa~;ed off about
20-feet from the top of the redwood for wire clearance.
Comnissioner Kraus pointed out that the trees, if left, will becoine a
sight problem for traffic in the area.

The Secretary stated that the applicant's representative submitted a letter
requesting that the subjec request for Variance be withalfarm on the basis
that the power lines previously thought necessary to move are not going to bare
to be moved; therefore, the Variande is not necessary.

Commissioner Kraus moved, seconded by Commissioner Martin, that the
request to ~,.~ithdraw this request for Variance (V-358) be approved and
all considerations relative to same be terminated; motion carried unani-
mous ly.

Allow Demolishmentof Main Novitiate Building and Remodeling of

Mr. Rod Heft, architect, ~Tas present and stated 1) the two (2) buildings
are very old and are used very little and 2) the buildings should be
abandoned since they are too old to be repaired.
Commissioner Metcalf xequested the applicant submit a picture of the
buildings that are to be torn do~,n.
Chairman Lively closed the hearling for the evening at 7:59 P.M., directed
UP-199 continued to the, next regular meeting and referred same to the
Subdivision Committee for study and a report.

Chairman Lively opened the hearing for UP-200 at 8:00 P.Mo The Secretary
stated the Notices of Hearing ~;~ere mailed and then read co.:m~unications filed
in opposition to the proposed Use Permit by the following residents:

The Secretary, also, read the Statement of Reason filed by the applicant.
Mr. Iversen, applicant, stated that 1) when he first moved to Saratoga he
came ~,~ith the thought that this·. area x,.,as the wide~open spaces, but he no~.~
realizes this is not the case 2) his original philosophy, in making the
subject proposal, ~.;as to provide.a suitable setting where, not only his
children, but other children as well could devote themselves to the care
of horses and 3) after being informed by neighbors and hearing the cormnents
filed in opposition he requests' that his petition for a Use Permit to allow
a com~munity stable be withdra~.
Con~nissioner Kraus moved, seconded by Commissioner Metcalf, to close the
hearing relative to UP-200 at 8:11 P.M.; motion carried unanimously.
Commissioner Smith moved, seconded by ConPaissioner Kraus, that the request
to withdraw UP-200 be approved (subject to receipt of a ~.ffitten request
for ~.~ithdrax~.al from the applicant) and any further proceedings relative to
the subject request for Use Permit be abandoned; motion carriec~ unanimously.
G. UP-20t - West Valley Ambulance Service, Saratoga-Los Gatos Road - Request
for Use Permit to Allow an Ambulance Service
The hearing relative to UP-201 ~..~as opened at 8:12 P.M. The Secretary stated
the Notices of Hearing ~.~ere mailed° The Secretary further stated that 1) a
Statement of Reason ~,~as filed by the applicant and 2) the applicant has been
operating out of the proposed location and he was directed to cease and desist
this illegal use.

Commissioner Metcalf suggest. ed that no action be taken on this
request until tile illegal use ceases.
Commissioner Smith agreed and further suggested that the Statement
of Reason filed by the applicant not be read until the applicant is
no longer in violation° He then stated that the violation indicated
a high disregard for City Ordinance.
~r. Rex Brunner, present to represent the applicant, stated that 1) the
use in violation of the City Ordinance has been abated 2) in tile haste
to establish a location in Saratoga the ~ov.e was~ Untentionally, made
without proper authorization from the City and 3) County Communications
did request that this an~ulance service be established in the City and
the City has, also~ requested this service°
The Secretary explained that the City Council did request that this
service be provided; however, they did not, necessarily~ indicate they
x,:anted an office., established in the City.
Commissioner Smith stated that th.e said location seemed unsuitable from
the traffic.-circulation viex,;point.

Chairman Lively closed the hearing for the evening at 8:25 P.M., directed
the subject Use Permit continued to the meeting of 12 April 1971, and
referred same to the Subdivision Cormnittee for study.
~ H° UP-202 - Boy Scouts of A~ner£ca - Troop 505, Sobey Road - Request for Use
Permit to A].low a BoI Scout Meetini Building.
Chairman Lively opened tile hearing relative to UP-202 at 8:26 PoMo The
Secretary stated tile Notices of .Hearing ~.~ere mailed and briefly revie~.~ed
the subject applicationsand .pointed out that the subject property. is in
very bad shape and;the applicant will be glad to clean it up and improve
its appearance.
Co~ranissioner Metcalf stated he ~,~ould be more favorably inclined to
approve this request if a stipulation of approval would be that the
applicant ~.~ould be responsible for the cleanup and improvement of this
prop er ty.
~r. Don Boren, representing the applicant, stated that the property is
badly in need of attention and the buildings will need alterations before
they can be used; hox,;ever, he feels the Scouts will be able to make a
significant change by working together to cleanup the area.
Chairman Lively explained that the subject use, if approved, would be
a conditional use in an "R-i" zone the same as a church or school.
Dr. Darwin Barrett, 14050 Marilyn Way, stated that he would recommend
that tile subject request be denied since approval ~..~ould set a precedent
to allow other similar uses in the area°
Mr. Clyde Duffy, 18666 Ravenwood Drive, stated' that his property backs
up to the subject eleven (!l) acre site; which, is literally covered
with trash. He further stated that 1) it will take an a~.Tful lot of labor
to cleanup this area and fix up tile buildings 2) the greenhouse has bee. n
so destroyed by vandals tile o~,~er has considered tearing it do~,..~ and 3) it
seems tile nearby school would be a more desirable location for this use.

~.~. Boren stated that 1) t~e Scouts have been meeting at the school
for the past six (6) or seven (7) years 2) it is unfortunate the
Scouts do not have a place ~,There they can· store their equipment since
they do not have their o~.n~ meeting place 3) the equipment is being
kept in various hoxnes and is very often forgotten and is not brought
to the meetings and 4) it is realized tb.e cleanup project will be a large
job, but it· can be done by the Scouts and establish a sc~nse. onU accomplish-
ment for the boys.
Dr. Maurice R. Tripp, 15231 Quito Road, stated that he lived in the
i~nediate area of the subject site and if anyone has any doubts as to
what a group of Scouts can do they can look at the building behind the
.Los Gatos High School; ~hich, has been maintained and kept from becoming
an eye sore by the Scouts.
The Secretary, in answer to an inquiry from Commissioner Fagan, stated
that the owner has been informed of the condition of the property and
legal action has been proposed requir~.ng the o~..ner to cleanup the site;
however, nothing has been done pending the outcome of the requested
Use Permit.
Chairman Lively closed the hearing for the evening at 8:39 P.M., directed
UP-202 continued to t~e meeting of 12 April 197]., and referred same to the
Subdivision Committee for study and a report.

SDR-883 - Thomas Fryer, Saratoga Hills Road - Building Site Approval -

The Secretary stated that the a~plicant has submitted a letter granting
a thirty (30) day extension.
Co~anissioner Smith recommended that SDR.-883 be continued to the next

The applicant was present and- stated he had reviewed the proposed
conditions of approval and expressed satisfaction of same°

Building Site Com=~nittee Report dated 22 March 1971 relative to SDR-887
be adopted and that the tentative map (Exhibit "A-I" filed 19 March 1971)
be approved subject to the conditions set forth in said report; motion
carried unanimously.
C. SD__~R_-888 - Thomas Dashiell, Bohlman Road - Building Site Approval - 3 Lots
- Continued from 8 March 1971
Commissioner Smith recommended that SDR-888 be continued to the next
regular meeting to allo~.~ time for further study.

The applicant was present and stated he had reviewed the proposed condi-
tions of approval and expr~ssed satisfaction with same.
The Secretary explained that the Fire Department has required the
applicant to establish a hydrant and main and to contact the water
company to determine what provisions can be' made for adequate ~ater
supply.
Commissioner Smith moved, seconded by Commissioner ~aus~ that the
Building Site Committee Report dated 22 b[~rch 1971 relative to SDR-889
be adopted and that the tentative map (Exhibit "A" filed 11' l. Yarch 1971)
be approved subject to the conditions set forth in said report; motion
carried unanimously.

The Secretary stated that 6he applicant is aware of the conditions
of approval and has in fact already complied with most of them.
Commissioner Smith moved, seconded by Commissioner Fagan, that the
Building Site CoEittee Report dated 22 I~larch 1971 relative to SDR-.890
be' adopted and that the tentative map (Exhibit "A", filed 12 ~larch 1971)
be apDroved subject to the conditions set forth in said report; motion
carried unanimous ly.
F. SDR-891 - George-H. l,'lCKenzie, blontal. vo Road and Vickery Avenue - Building
Site ~Droval - 2 Lots
The applicant was present and stated he had reviewed the proposed
conditions of approval and advised that he has considered dedicating
a portion of their property' to the City; thereby~ eliminating so!he of
the requirements stipulated in conditions II-A and II-B of the Building
Site Co~mmittee Report.
The Secretary stated the applicant can obtain approval at this time and
then submit a req~est for reconsideration of the aforementioned conditions
on the basis of the proposed dedication.
Commissioner Smith moved, seconded by Commissioner Kraus, that the
Building Site Committee Report dated 22 Harch ].971 relative to SDR-891
be adopted and that the ~entative map (Exhibit "A" filed 12 March 1971)
be approved subject to the conditions set forth in said report; motion
carried unanimous y

Comanissioner Smith stated that in his opinion any action re.laitive to
SDR-892 should be postponed until the City Council makes a recommendation
on the Use Permit appeal filed by the applicant after the Planning
Commission denied a request for extension for UP-189.
Com~issioner Kraus stated that he agreed with Commissioner Smith.
Commissioner Harshall stated that he felt the applicant should not be
held up because of formalities since he has very little time and already
has enough other problems.
Commissioner Smith moved, seconded by C6mmissioner Idarshall, that the
Building Site Committee Report dated 22 March 1971 relative to SDR-892
be adopted and that the tentative map (Exhibit "A" filed 12 1&~rch 1971)
be approved subject to the conditions set forth in said report; motion
carried with CommiSsioners Kraus and Smith voting

Commissioner Smith stated that this is a refile on a previously
approved tentative map ~.~hich has expired and the applicant is

Commissioner Smith moved, seconded by Commissioner ~aus, that the
Building Site Co~ittee Report dated 22 March 1971 relative to SDR-893
be adopted and that the tentative map (Exhibit "A", filed 12 March 1971)
be approved subject to tbe conditions set forth in said report; motion

Replacement of Identification SiJns
The Assistant Planner read the Staff Report dated 22 March 197].
recoEending that Final Design Approval be granted for A-356.
Commissioner Martin moved, seconded by COmmissioner Marshall, that the
St'aff Report dated 22 March 1971 be adopted and that Final Design
Approval be granted for A-356 as sho~ on Exhibits "E" "F" and "G"
and subject to the conditions stated in said report; motion carried

B. A-JSi - M. E. Frazier, Cox and Saratoga Avenues - Preliminary Design
Review - Office Bui].din~ - Continued from 8 March 197.].
The Assistant Planner advised that an interim Staff Report dated
22 March 1971 has been prepared recommending that the applicant revise
his preliminary plans to r(~flect specific items as stated in said report.
[~. Ralph Ramon, architect, st~t:ed that upon advisement of the Staff,
Design Review Com~ittee, and Architectural Advisory Committee of the
recon~n~endations in the report a n.e~,~ plan ~,~s prepared in accord with
the said recommendations and the recommendations of the residents 'of
area an.d the medical-,-..village tenants.
Co~issioner Marshall explained that 1) the Architectnral Advisory
Com~nittee recommended that. the setbacks be the same as those required
for the Mec]ical Village 2) intensive landscaping, properly done, would
create a view compatible wit]~ the Medical Village and 3) the corner of
Cox and Saratoga Avenues should be stripped of all concrete to avoid
people stopping their cars'and ~.Talking across the grass. He further
stated that 1) all the changes suggested ~.~ere intendeel to be greater
than the ones sho~.~ on the revised plan 2) parking on Saratoga and
Cox Avenues should be prohibited and 3) the parking nox.~ allowed on
Saratoga Avenue constitutes a dangerous sitnation and should be eliminated.
Commissioner Smith stated that in order to eliminate parking on Saratoga
Avenue a recommendation (separate from the subject application) will have
to be made to the City Council.
Commissioner Lively directed A-362 continued to the next regular meeting
and referred same and the eliraination of parking on Saratoga Avenue to
the Design Review Com:nittee for further study.

After discussion, the Staff Report was extensively amended. A copy
of the revised report has been placed in file A-369.

Preliminary Design Approval be granted for A-369 as sho~,m on Exhibits

Chairman Lively recommended that the Staff Report dated 22 March 1971
recommending that Preliminary Design Approval be granted for A-370 be
amended as follows:

"(d) All air-Conditioning units and other mechanical
equipmen. it shall be properly screened from view
and sound isolated."

Commissioner Fagan gave a sun~nary of items reviewed and action taken at the
City Council meeting of 17 MD. rcli 1971 ~,~ith emphasis on items of particular
interest to the Co~r~mission.
VI. OLD BUSINESS
A. CONDITiOI~L USE STUDY - By Planning Department Staff - Continued from

The Secretary stated that copies of this study ~ere distributed to
each Commissioner at the last Planning Commission meeting and each
C~nmissioner is asked to submit his com'enents to the Staff for consolid-
ation into the report. He then recom~n~ended that the matter be continued
to the ne~ct regular meeting in order to allow time for submittal of said

The Secretary read the Staff Report dated 22 March 1971 recom~nending
thae a one (1) year extension be granted for SDR-828 with the stated
modification for condition II-.A of Building Site C0m.mittee Report dated
27 October 1969, He further stated that the reason for the modification
is that from Big Basin Way Up Jacks Road there is a very .confined
right-of-way with very large vegetation along the road and further up
Jacks Road towards the site :on the minimum access road it is recon~n~ended
that as ~.yide a road as possible be provided ~ithout disturbing the row
of substantial 1.Ionterey Pines, He added that the Public Works Department
concurs with the said m~dification,
The Secretary, in answer to an inquiry from Commissioner Smith, stated
that it is in order for the Planning Commission' to revibe'a cohdition
of'approval if they see fit to do so,
Chairman Lively recommended that the Planning Commission be allotted
time for further reviex.~ of this matter and directed the request in
connection with SDR-828 continued to the ne~t regular meeting.
D, CAPITAL II.~ROVEMENT PROGRAM FOR 1970-7]. thru 1975-76 - Continued from

The Secretary explained tbat a report including the Planning Con~nission
recommendation to the City Council relative to the Capital Improvement
Program must be prepared by the Staff or General Plan Committee,
Commissioner Metcalf stated that the Genera]. Plan Committee will prepare
a report in time f.or the meeting of 12 April 1971
In view of the foregoing, Chairman Lively directed this matter continued
to the next regular meeting and referred it to the General Plan Committee
for study and a report~

been to refer them to the Subdivision Conm~ittee and let them render a
decision as to whether an informal public hearing should be scheduled,

The Secretary stated that 1) George Day has filed a preliminary map
for a 20,!oacre parcel located next to the Toll Gate subdivision 2) the
applicant has met x=yith the Subdivision Committee and with the adjoining
property o~..~er and 3) in order for the applicant to x.K~rk out street
patterns the Planning Commission must issue an opinion on the preliminary map
presented by the applicant at this time.
Chairman Lively stated that th~~ applicant would like some notification of
the intent of the Planning Commission so that the adjoining property owner
can get the lots that he ~:ants and in return will be able to provide the
applicant ~,Tith access right-of-x~ay so he can proceed with development.
Morrie Abrahams, engineer for the applicant, in answer to an inquiry from
Chairman Lively, stated that the maximum slope for the Boisseranc' property
is 15% and do~.m through the ravine it should be considerably less.
Co~nissioner Smith stated that the Subdivision Committee felt that the.
preliminary map ~.~as very well done.
Commissioner I~aus reco'mrnended that the other Co~issioners take a look
at this property and they will see that the applicant is proposing a very
good plan for this difficult piece of land. The Planning Comm~ission must
determine x,2hether i-Dr. Boisseranc.-can get five (5)' lots out of his property.
Commissioner Smith, in ansx.~er to an inquiry from Conm~issioner Metcalf, stated
that the road xci!l go in there at the same time the subdivision goes in and
it is not necessary to specify and lay-out the full road on the preliminary
map all the applicant needs to. show is the emergency access.road, ~hich,
he has done. The acceptance of this preliminary map ~,~ould simply indicate
it appears feasible to make five (5) !oilout of the subject property.
Chairman Lively recommended that each Commissioner take a ~.~alk over this
property and if they have any comments they can be submitted to the. Sub-
division Connmittee. ;
Overhead Utilities
Commissioner Kraus stated that 1) on several occasions the Variance
Committee has gone out to look at overhead utilities ~,~here new construction
is going on and the developer has been required to underground the utilities
2) the existing overhead ~,~ires'still exist and it may be beneficial to con~
tact P~E about undergrounding .the above ground utilities and 3) he would
be happy to serve on a Committee to meet with PG&E representatives.
Chairman Lively referred the matter to the Variance Committee requested
that they meet ~,,ith the PG&E people.
Commissioner Kraus requested the Secretary to contact PG&E and arrange a..
meeting to discuss this matter.

of Tree Removal
The SeCretary read a letter from the applicant requesting
permission to remove a 24.-inch locust tree and a 20-inch
redwood tree that have been topped by PG&E and as a result
have been fairly x,~ell ruined
Chairman Liyely referred this request to the Staff for consideration.

with-Use Permit
The Secxetary stated that the site of this Use Permit was
inspected to ascertain compliance with the provision of the
conditions of the Use Permit relative to the maximum number
of employees housed in the two (2) buildings~ A Staff Report
. dated 22 March 1971 states that on the basis of this investigation
there was no violation of the Use Permit nor of any other City
Ordinances,
