I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Lively at 7:30 P.M.
A. ROLL CALL
Present:Commissioners Fagan, Kraus, Lively, Marshall, Martin, Metcalf,
and Smith.
Absent: None.
B. MINUTES
Commissioner Smith moved, seconded by Commissioner Kraus, that the reading
of the minutes of 8 March 1971 ~eeting be waived and they be approved as
distributed with the following changes:

The hearing was reopened at 7:34. P.M.
The Secretary stated that a letter was submitted by the applicant's
representative requesting that C'-137 be continued since the plans are
still being revised and the applicant would again like to meet with the
Subdivision Committee to further' discuss the proposed plans.
Mr. Arthur H. Grafe, 12121 Saraglen Drive, asked if interested residents Could
attend the Subdivision Committee~ meetings when the subject application is
discussed with the applicant.
Chairman Lively explained that the Committee meetings are not public hearings;
however, if an4 appointment is made with the Committee they will meet with
individuals to discuss certain applications and listen to comments.
Chairman Lively closed the hearing for the evening at 7:38 P.M., directed
C-137 continued to the next regu..lar meeting and referred same to the Sub-
division Committee.

Chairman Lively reopened the hearing at 7:39 P.M.

No one in the audience wished to comment relative to this request.
The Secretary read the Staff R~port dated 22 March 1971 reco~u~ending
that the subject request for Variance be denied.
Commissioner Sn~ith moved~ seconded by Commissioner Kraus, to close the
hearing at 7:41 P.M.; motion carried unanimously.
Commissioner Kraus moved, seconded by Commissioner Fagan, that the Staff
Report dated 22 March 1971 be adopted and that the subject request for
Variance V-354 be denied on th~ grounds that the findings required by
Section 17.6 of Zoning OrdinanCe NS-3 cannot be made for the reasons
stated in said report; motion darried unanimously.

The applicant was not present.
Mr. Warren Whe~le__r,_ 20800 Prospect Road, stated he is opposed to this
_a_p_plication and ,would like anot. her o,.~portunity to comnent after the Staff
Report is read.
At the request of a gentlement '.in the audience about thirty (30) people
stood up in opposition of the Subject application.
The Secretary read the Staff Report dated 22 March 1971 recommending
that the request for Variance in connection with V-357 be denied.
Mr. Wheeler had no further comments.
Cor~f, issioner Kraus moved, seconded by Commissioner Smith, to close the
hearing relative to V-357 at 7:!46 P.M.; motion carried unanimously.
Commissioner Kraus moved, seconded by Commissioner Martin, that the Staff
Report dated 22 March 1971 be a:dopted and that the subject request for
Variance V-357 be denied on the'. basis the findings required under Section 17.6
of Ordinance NS-3 cannot be made for the reasons stated in the subject report;
motion carried unanimously~ :
Commissioner Marshall stated that at the time of the on-site inspection it
was determined that two (2) trees identified as redwood and=.LocuSt~ are not
suitable for retention. He fur.ther stated that PG&E has sawed off about
20-feet from the top of the redwood for wire clearance.
Con-~issioner Kraus pointed out ;that the trees, 'if left.~ will become a
._s_i_ght problem for traffic in th'e area.7 .....

Chairman Lively reopened the hearing at 7:48 P.M.
The' Secretary stated that the applicant's representative submitted a letter
r. eqU~sting that the subjec request for Variance be withdrawn on the basis
that the power lines previously! thought necessary to move are not going to have
to be moved; therefore, the Var.'ianCe is not necessary.

II. D. V-358 - Continued
No one in the audience wished to comment.
Co,m, issioner Kraus moved, seconded by Commissioner Fagan,'to close the
hearing relative to V-358 at 7:56 P.M.; motion carried unanimously.
Commissioner Kraus moved, seconded by Commissioner Martin, that the
request to withdraw this request for Variance (V-358) be approved and
all considerations relative to ~same be terminated; motion carried unani-
mously.
E. UP-199 - Sisters of Notre Dame,= Bohlman Road - Request for Use Permit to
Allow Demolishmerit of Main Novitiate Building and Remodeling of
Smaller Livin~ quarters.
Mr. Rod Heft, architect, was present and stated 1) the two (2) buildings
are very old and are used very !little and 2) the buildings should be
abandoned since they are too old to be repaired.
C~m~issioner Metcalf requested ,the applicant submit a picture of the
buildings that are to be torn down.
Chairman Lively closed the hearZing for the evening at 7:59 P.M., directed
UP-199 continued to the next r~gular meeting and referred same to the
Subdivision Committee for study and a report.
F. UP-200 '.~ Arthur H. Iversen, Sob=ey Road - Request for Use Permit ~oAllow a
Commupit~ Stable
Chairman Lively opened the hearZing for UP-200 at 8:00 P.M. The Secretary
stated the Notices of Hearing were mailed and then read communications filed
in opposition to the proposed Use Permit by the following residents:
Mr. David P. Arata, 18615zMaud Avenue, Saratoga.
Dr. and Mrs. Cornelius, 12270 Sobey Road, Saratoga.
Dr. and Mrs. Fred Kurzwei~l~ Jr., 18667 Montewood Drive, Saratoga.
Mr. and Mrs. Millerr, 15131 E1 Quito Way, Saratoga.
The Secretary, also, read the Statement of Reason filed by the applicant.
Mr. Iversen, applicant, stated khat 1) when he first moved to Saratoga he
came with the thought that this' area was the wide-open spaces, but he now
realizes this is not the case 2:) his original philosophy, in making the
subject proposal, was to provide a suitable setting where, not only his
childrens but other children as, well could devote themselves to the care
of horses and 3) after being ipformed by neighbors and hearing the comments
filed in opposition he requestsI that his petition for a Use Permit to allow
a community stable be withdrawn.
Commissioner Kraus moved, seconded by Commissioner Metcalf, to close the
hearing relative to UP-200 at 8::11 P.M.; motion carried unanimously.
Cof~u~issioner Smith moved, seconded by Commissioner Kraus, that the request
to withdraw UP-200 be approved (subject to receipt of a written request
for withdrawal from the applicant) and any further proceedings relative to
the subject request for Use Permit be &bandoned; motion carried unanimously.
G. UP-201 - West Valley Ambulance Service, Saratoga-Los Gatos Road - Request for Use Permit to Allow an Ambulance Service
The hearing relative to UP-201 ~as opened at 8:12 P.M. The Secretary stated
the'Notices of Hearing were mailed. The Secretary further stated that 1) a
Statement of Reason was filed by the applicant and 2) the applicant has been
operating out of the proposed 16cation and he was directed to cease and desist
this illegal use.

II. G. UP-201 - Continued
Coamtissioner Metcalf suggested that no action be taken on this
request until the illegal use ceases,
Commissioner Smith agreed agd further suggested that the Statement
of Reason filed by the applicant not be read until the applicant is
no longer in violation. He!then stated that the violation indicated
a high disregard for City Ordinance.
Mr o Rex Brunner, present toirepresent the applicant, stated that 1) the
use in violation of the City Ordinance has been abated 2) in the haste
to establish a location in Saratoga the mo~.e.. was, untentionally, made
without proper authorization from the City and 3) County Communications
did request that this ambulance service be established in the City and
the City has, also, requested this service.
The Secretary explained that the City Council did request that this
service be provided; hovevet, they did not, necessarily, indicate they
wanted an office~ established in the City.
Commissioner Smith stated that the said location seemed unsuitable from
the traffic-circulation vieWpoint.
The Secretary, without further objection, read the applicant's Statement
of Reason.
Chairman Lively closed the hearing for the evening at 8:25 P.M., directed
the subject Use Permit continued to the meeting of 12 April 1971, and
referred same to the Subdivision Committee for study.
H. UP-202 - Boy Scouts 'of America - Troop 505, Sobey Road - Request for Use
Permit to Allow a Boy Scout Meeting Buildin~
Chairman Lively opened the hearing relative to uP-202 at 8:26 P.M. The
Secretary stated the Notices of Hearing were mailed and briefly reviewed
the subject applicationoand~pointed out that the subject property is in
very bad shape and the applicant will be glad to clean it up and improve
its appearance.
Co~m~issioner Metcalf stated.he would be more favorably inclined to
approve this request if a s~ipulation of approval would be that the
applicant would be responsible for the cleanup and improvement of this
property.
Mr. Don Boren, representing!the applicant, stated that the property is
badly in need of attention and the buildings will need alterations before
they can be used~ however, he feels the Scouts will be,able to make a
.significant change by working together to c~eanup the area.
Chairman Lively explained that the subject use, if approved, would be
a conditional use in an "R-i" zone the same as a church or school.
Dr. Darwin Barrett, 1405OMarilyn Way, stated that he would recommend
that the subject request be;denied since approval would set a precedent
to allow other similar uses.in the area.
Mr. Clyde Duffy, 18666 Ravenwood Drive, stated that his property backs
up to the subject eleven (1i) acre site; which, is literally covered
with trash. He further stated that 1) it will take an awful lot of labor
to cleanup this area and fix up the buildings 2) the~f~HSuse has bl~.n
so destroyed by vandals thezowner has considered tearing it down and 3) it
seems the nearby school would be a more desirable location for this use.

II. H. UP-202 - Continued
Mr. Boren stated that 1) the Scouts have been meeting at the school.
for the past six (6) or seven (7) years 2) it is unfortunate the
Scouts do not have a place *here they can store their equipment since
they do not have their own meeting place 3) the equipment is being
kept in various homes and is very often forgotten and is not brought
to the meetings and 4) it is realized the cleanup project will be a large
job, but it can be done by the Scouts and establish a s. ens.~ of accomplish-
ment for the boys.
Dr. Maurice R. Tripp, 15231 ',Quito Road, stated that he lived in the
immediate area of the subject site and if anyone has any doubts as to
what a group of Scouts can do they can look ~e'~h~'B~irdi~' behind the
Los Gatos High School; which, has been maintained and kept from becoming
an eye sore by the Scouts.
The Secretary, in answer to !an inquiry from Commissioner Fagan, stated
that the owner has been informed of the condition of the property and
legal action has been proposted requiring the owner to cleanup the site;
however, nothing has been done pending the outcome of the requested
Use Permit.
Chairman Lively closed the hearing for the evening at 8:39 P.M., directed
UP-202 continued to the meeting of 12 April 1971, and referred same to the
Subdivision Committee for st~udy and a report.
III. BUILDING SITES AND SUBDIVISIONS;
A. SDR-883 - Thomas Fryer, Saratoga Hills Road - Building Site Approval -
2 Lots - Continued from 8 March 1971
The Secretary stated that the applicant has submitted a letter granting
a thirty (30) day extension.
Commissioner Smith recoA~ended that SDR-883 be continued to.the n~'

B. SDR-887 - Don Cart, Via Regina - Building Site Approval - 1 Lot~-.-
Continued from 8 March 1971
The applicant was present and stated he had reviewed the proposed
conditions of approval and expressed satisfaction of same.
Commissioner Smith moved, seconded by Commissioner Kraus, that the
Building Site Committee RepOrt dated 22 March 1971 relative to SDR-887
be adopted and that the tentative map (Exhibit "A-I" filed 19 March 1971)
be approved subject to the conditions set forth in said report; motion
carried unanimously.
C. SDR-888 - Thomas Dashiell, Bohlman Road - Building Site Approval - 3 Lots
- Continued from 8 March 1971
Commissioner Smith recommended that SDR-888 be continued to the next
regular meeting to allow time for further study.

III. D. SDR-889 - Neal P. Kirkham,=TSobey Road -.Buildins Site Approval - 1 Lot'
The applicant was present and stated he had reviewed the proposed condi-
tions of approval and expressed satisfaction with same.
The SeCretary explained that the Fire Department has required the
applicant to establish a hTdrant and main ~d'to contact the~a"[~TM.
company to determine what provisions can be made for adequate water
supply.
Commissioner. Smith moved, Seconded by Commissioner Kraus, that the
Building Site Committee Report dated 22 March 1971 relative to SDR-889
be adopted and that the tentative map (Exhibit '~", filed 11 March 1971)
be approved subject to the!conditions set forth in said report; motion
carried unanimously.
E. SDRo890 - Geno Castello~ Montalvo R.oa~ - Building Site Approval - 2 Lots
.The Secretary stated that the',.applicant is aware of the conditions
of approval and has in fact already complied with most of them.
Commissioner Smith moved, aeconded by Commissioner Fagan, that the
Building Site Committee Report dated 22 March 1971 relative to SDR-890
be adopted and that the tentative map (Exhibit '~", filed 12 March 1971)
be approved subject to the:conditions set forth in said report; motion
carried unanimously. :
F. SDR-891 - George H. MdKenzie, Montalvo Road and Vickery Avenue - Building
Site Approval - 2 Lots
The applicant was present and stated he had reviewed the proposed
conditions of approval and advised that he has considered dedicating
a poNtion of their property to the City; thereby, eliminating some of
the requirements stipulated. in conditions II-A and II-B of the Building
Site Committee Report.
The Secretary stated the a~plicant can obtain approval at this time and
then submit a request for reconsideration of the aforementioned conditions
on the basis of the proposed dedication.
Commissioner Smith moved, seconded by Commissioner Kraus, that the
Building Site Committee Re~ort dated 22 March 1971 relative to SDR-891

be approved subject to the~conditions set forth in said report; motion
carried unanimously.
G. SDR-892 - James R. Davi, seusa Lane - Building Site Approval - 1 Lot
Commissioner Smith stated that in his opinion any action re.l~tive to
SDR-892 should be postponea until the City Council makes a recommendation
on the Use Permit appeal filed by the applicant after the Planning
Commission denied a request for ext~n'eion for UP-189.
Commissioner Kraus stated that he agreed with Commissioner Smith.
Commissioner Marshall stated that he felt the applicant should not be
held up because of formalities since he has very little time and already
has enough other problems. z
Commissioner Smith moved, Seconded by Commissioner Marshall, that the
Building Site Committee Report dated 22 March 1971 relative to SDR-892
be adopted and that the tentative map (Exhibit "A", filed 12 March 1971)

Commissioner Smith stated 'that this is a refile on a previously
approved tentative map which has expired and the applicant is
aware of the proposed conditions of approval.
Commissioner Smith moved, ~seconded by Commissioner Kraus, that the
Building Site Committee Report dated 22 March 1971 relative to SDR-893
be adopted and that the t~ntative map (Exhibit "A", filed 12 March 1971)
be approved subject to the conditions set forth in said report; motion
cart led unanimous ly.

The Assistant Planner read the Staff Report dated 22 March 1971
recommending that Final De.lsign Approval be granted for A-356.
Counnissioner Martin moved,'; seconded by Commissioner Marshall, that the
Staff Report dated 22 March 1971 be adopted and that Final Design
Approval be granted for A-356 as shown on Exhibits 'E" ~' and "G"
and subject to the conditi6ns stated in said report; motion carried
unanimous ly. ..
B. A-36~. - M, E. Frazier, Cox!and Saratoga Avenues - Preliminary Design
' "' "' Review - Office Buildin~ - Continued from 8 March 1971
The Assistant Planner advised that ah" interim Staff Report dated
22 March 1971 has been prepared recommending that the applicant revise
his preliminary plans to reflect specific items as stated in said report.
Mr. Ralph Ramon, architect,': stated that upon advisement of the Staff,
])8Sign Review Committee, and Archite'ctural Advisory Committee of the
recommendations in the rep6rt a new plan was prepared in accord with
the said recommendations and the reconnnendations of the residents of
area and the medical-villa~.'e tenants.
Commissioner Marshall explained that 1) the Architectural Advisory
Committee recommended that ]the setbacks be the same as those required
for the Medical Village 2) ': intensive landscapi_n_~, properly done, would
create a view compatible with the'Medical Village and 3) the corner of
Cox and Saratoga Avenues should be stripped of all concrete to avoid
people stopping their cars and walking across the grass. He further
stated that 1) all the changes suggested were intended to be greater
than the ones shown on the revised plan 2) parking !on Saratoga and ...............
Cdx Avenues should be prohibited and 3) the parking now allowed on
Saratoga Avenue constitutes:a dangerous situation and should be eliminated.
Commissioner Smith stated that in order to eliminate parking on~'toga'
Avenue a recommendation (separate from the subject application) will have
to be made to the City CounCil.
Commissioner Lively directed A-362 continued to the next regular meeting
and referred same and the elimination of parking on Saratoga Avenue to
the Design Review Committee ':for further study.

Commissioner Martin moved, seconded by Commissioner Marshall, that the
Staff Report dated 22 March 1971 be adopted and that Final Design
Approval be granted for A-368 as shown on Exhibit '~" and subject
to the condition stated in Said report; motion carried unanimously.
D. A-369 - Sisters of Notre Dame, Bohlman Road - Preliminary Design Review -Remodelin~ Zof Novitiate Build inn
The Assistant Planner read the Staff Report dated 22 March 1971
recommending that Preliminary Design Approval be granted for A-369.
After discussion, the StaffSReport was extensively amended. A copy
of the revised report has been placed in file A-369.
Commissioner Martin moved, seconded by Commissioner Marshall, that the
Staff Report dated 22 March'1971 be adopted, as amended, and that
Preliminary Design Approval.be granted for A-369 as shown on Exhibits
'~", "B", and "C" and subject to the conditions stated in said report;

E. A-~7~ - James R. Davi, Sousa Lane - Preliminary Design Review -
Convalescent Hospital
C~m~issioner Marshall stated that the plans currently under consideration
are essentially unchanged from the original plans.
Chairman Lively recommended i that the Staff Report dated 22 March 1971
recouunending that Preliminary Design Approval be granted for A-370 be
amended as follows:
ADD CONDITIONS (d) and (e) as listed:
"(d) All air-conditioning units and other mechanical
equipment shall be properly screened from view
and l~d~I~'~d."
"(e) Exterior!lighting and illumination of the premises
shall be=restricted to that which is reasonable and
proper for a private residenCe."
Commissioner Marshall movedi seconded by Commissioner Fagan, that the
Staff Report dated 22 March 1971 be adopted, as amended, and that Pre-
liminary Design Approval beigranted for A-370 as shown on Exhibits'~"
and subject to the conditions stated in said report; motion carried with
Co~m,~is~ioners Kraus and Smith voting No.
V. CITY COUNCIL REPORT
Commissioner Fagan gave a summary of items reviewed and action taken at the
City Council meeting of 17 March 1971 with emphasis on items of particular
interest to the Commission.
VI. OLD BUSINESS
A. CONDITIONAL.USE STUDY - By Planning Department Staff - Continued from 8 M~rch 1971
The Secretary stated that c~pies of this study were distributed to
each Commissioner at the last ~lanning Commission meeting and each
Cou~issioner is asked to submit his comments to the Staff for consolid-
ation into the report. He then recommended that the matter be continued
to the next regular meeting; in order to allow time for submittal of said
c oum~ent s.

VI. B. SDR-824 - John B. Walsh, Herriman Avenue - Request for Extension -
Continued from 8 =March 1971
Commissioner Smith moved, seconded by Commissioner Fagan, that a one
(1) year extension be granted from the durrent date of expiration for
SDR-824; motion carried unanimously.
C. SDR-82q - John Cox, M.D., Jacks Road - Request for Extension - Continued
from 8 March 1971
The Secretary read the Staf'f Report dated 22 March 1971 recommending
that a one (1) year extensi'o~ be granted for SDR-828 with the stated
modification for condition II-A of Building Site Committee Report dated
27 October 1969. He further stated that the reason for the modification
is that from Big Basin Way ~p Jacks Road there is a very.confined
right-of-way with very large vegetation along the road and further up
Jacks Road 'towards the site on the minimum access road it~ is recoxmx~ended~\.
that as wide a road as possZible be provided without disturbing the row
of substantial Monterey Pines. He added that the Public Works Department
concurs with the said modification.
The Secretary, in answer to' an inquiry from Commissioner Smith, stated
that it is in order for the Planning Comm~sslbn"to revise a conditi6n.~
.'of approval if they see fit to ~o so. '
Chairman Lively recommended. that the Planning Commission be allowed
time for further review of this matter and directed the request in
connection with SDR-828 continued to the next regular meeting.
D. GAPITAL IMPROVEMENT PROGRAMFOR 1970-71 thru 1975-76 - Continued from 8 March 1971
The Secretary explained that a report including the Planning Commission
recommendation to the City ~ouncil relative to the Capital Improvement
Program must be prepared by. the Staff or General Plan Committee.
Co~m~issioner Metcalf stated;that the General Plan Committee will prepare
a report in time for the meeting of 12 April 1971
In view of the foregoing, Chairman Lively directed this matter continued
to the next regular meeting;and referred it to...the General Plan Committee
for study and a report.
E. WEST VALLEY JUNIOR COLLEGE ASSESSMENT DISTRICT - Continued from 8 March 1971
The Secretary stated that this is a formal referral from the City Council
to the Planning Commission to determine if the Saratoga Campus Recreational
Facilities Assessment District conforms with the approved campus Master
P.lan~
Chairman Lively directed the matter continued to the next regular
meeting and referred it to-'.the~.Subdivision Committee for study and a
report.
VII. NEW BUSINESS
West Vall.ey Chapel - Request tozAdd Ambulance Service to the List of
Conditional Uses in the "C-C" (Community-Commercial)
Zonin~ District
The Secretary stated that the dsual procedure for similar requests has
been to refer them to the Subdivision Committee and let them render a
decision as to whether an informal public heat.ing should be scheduled.

VII. NEW BUSINESS - Continued
George Day Developer - Preliminary Map
The Secretary stated that 1) ~George Day has filed a preliminary map
for a 20-acre parcel located next to the Toll Gate subdivision 21 the
applicant has met awith the Subdivision Committee and with the.~3'di'~lhg
property owner and 3) in orddr for the applicant to work out street
patterns the Planning Commission must issue an opinion on the preliminary map
presented by the applicant at ;this time.
Chairman Lively stated that the applicant would like some notification of
the intent of the Planning Conmission so that the adjoining property owner
can get the lots that he wants and in return will be able to provide the
applicant with access right-ofi-way so he can proceed with development.
Morrie Abrahams, engineer for the applicant, in answer to an inquiry from
Chairman Lively, stated that the maximum slope for the BoisserancC property
is 15% and down through the ra~ine it should be considerably less~ ".
Commissioner Smith stated that' the Subdivision Committee felt that the
preliminary map was very well done.
Conunissioner Kraus recommended. that the other Commissioners take a look
at this property and they will' see that the applicant is proposing a'=very
good plan."for this difficult piece of land. The Planning Commission must
determine whether Mr. Boisseranc~-.]ca'~get five (5) lots out of his property.
Commissioner Smith, in answer to an inquiry from Commissioner Metcalf, stated
that the road will go in there at'.:the same time the subdivision goes in and
it is not necessary to specify andT. lay-out the full road on the preliminary
map all the applicant needs to' show is the emergency access road,j~which,
he has done. The acceptance of this preliminary map would simply indicate
it appears feasible to make five (5) lots out of the subject property.
Chairman Lively recommended that each Commissioner take a walk over this
property and if they have any Comments they can be submitted to the Sub-
division Committee.
Overhead Utilities
Commissioner Kraus stated that~ 1) on several occasions the Variance
Committee has gone out to look at overhead utilities where new construction
is going on and the developer has been required to underground the utilities
2) the existing overhead wireb still exist and it may be beneficial to con-
tact PG&E about undergrounding~the above ground utilities and 3) he would
be happy to serve on a Committee to meet with PG&E representatives.
Chairman Lively referred the nmtter to the Variance Committee irequested
~.~_~'~ they meet with the PG&E people.
Commissioner Kraus requested the Secretary to contact PG&E and arrange
meeting toadiscUss! this matter,

The Secretary read a letter from the applicant requesting
permission to remove a: 24-inch locust tree and a 20-inch
redwood tree that have.been topped by PG&E and as a result
have been fairly well ~uined
Chairman Lively referred this request to the Staff for consideration.

with Use Permit
The Secretary stated that the site of this Use Permit was
inspected to ascertaih compliance with the provision of the
conditions of the Use. Permit relative to the maximum number
of employees housed in the two (2) buildinSs. A Staff Report
dated 22 March 1971 states that on the basis of this investiSation
there was no violation of the Use Permit nor of any other City
Ordinances.
