PUBLIC HEARINGS A. C-137 - Alfred F. Dunus, Inc., Prospect Road - Request for Change of Zoning from "R-I-IO,000" (Single-Family Residential) to "R-I-IO,000" "P-C" (Single-Family Residential Planned Community) - Continued from 10 Hay 1971) The Secretary recommended that C-137 be continued to the next regular meeting to allow time for the applicant to submit a revised map showing Department of Public Works engineering requirements. No one in the audience wished to comment relative to this application. Galeb, Ted Avenue -.Request for Change of Zoning from '~-1-10,000" (Single-Family Residential) to '~-M-5,000" (Multi-Family Residential) - Continued from 10 Hay 1971 The hearing. was reopened at 7:41 P.M. The Secretary recommended that this matter be continued since there has been some question relative to a proper n~tice of hearing and the list of. names submitted by the applicant requires further verification and it my be necessary for the applicant to render a new list. Commissioner Smith stated that the Subdivision Committee met with Mr. Sheets of 12444 Ted Avenue and another gentlemen from the area who are present at this time and ,nuy want to present: some ~oints for the applicant to consider. Mr. Bogden of 12471 DeSanka Avenuesasked about what type of buildings .that will be put on this property and how the land will.. be..divided? .......... Chairman Lively stated that the plot plan indicates eleven (11) lots and the applicant has proposed a series of duplexes with two (2) lots and a .total of twenty two (22) units. The plan will be available for review at the inter- mission or at the City Offices during office hours. Commissioner Smith stated that the neighbors objected because they are in an '~-1" zoning district and it would lower the value of the property adjacent to the subject property if duplexes were allowed on the property. He further stated that the applicant' and his. neighbors should get together and arrive at a compromise that would be acceptable to both parties. Nr. Wes Kosich, 18867 Kosich Drive, representing the applicant 'stated that 1) the duplexes would not lessen the value of adjacent properties since their value .$6,000 for each duplex building of two (2) dwelling units and the applicant did meet with some of the neighbors and they seemed to be in accord with the proposed plan as long as:.the buildings remained one-story and 2) the largest parcel is 200-feet in depth and 500-feet in width facing on DeSanka and he cannot see any reason for opposition if the property is developed as proposed. C-14__5 - Continued ; Nr. Jack Young, 12385 DeSanka Avenue, suggested that the traffic plan be altered to detour through the ~ommercial area at the corner of Saratoga-Sunnyvale Road and Sea GUll Way and bordering the railroad tracks. Mr..B.T. Galeb, applicant, was p~esent and stated that 1) he is, also, interested in controlling the traffic in the area 2) the neighbors have a right to be heard 3) the Planning Comnission has a responsibility to use their might to do right 4) a:sub-standard development could be put on the property; however, this would not be marketable and he prefers high grade buildings that can be Controlled, but he cannot have this without the cooperation of his neighbors and the Planning Commission and 5) this is a problem area that requires special consideration. Mr. John B. Monney, 12385 Ted Avenue, stated that 1) he has not'.received. (for the second time in a row) a Notice of Hearing relative to this appli- cation and 2) he can see no reason why DeSanka Avenue and Sea Gull Way should not be connected to provid~ ingress and egress for this develop- ment in lieu of the proposed Ted Avenue-DeSanka Avenue connection. Mr. Thomas R. Pocha~i, owner of the propert~ at 20331'Zorka Avenue, stated that 1) he is opposed to the subject· change of zoning and 2) it is his opinion that duplexes on the subject ~roperty would someSat degrade the entire area unless a great number of restrictions were imposed. Chairman Lively closed the hearing for the evening at 8:05 P.M., directed C-145 continued to the meeting of'14 June 1971, and referred the matter to the Subdivision Coum~ittee. C. C-146 - Aubrey Johnston, Quito Road - RequeSt for Change of Zoning from t~-l-10,000" (Single-Family Residential) to "C-N" (Neighborhood- Commercial) - Continued from' 10 Hay 1971 Chairman Lively reopened the hearing at 8:06 P,M. The Secretary recommended that this matter be continued to allow time for further study, Commissioner Smith stated that the applicant has not submitted any information relative to use he intends to make of the property under the requested rezoning. Nr. Aubrey Johnston, the applicant, was present and stated 1) 'he has requested the subject change of zoning because he wants to sell the p~operty so he can retire and move from the area and 2) he has been unable to sell the property with the current "R-I" zoning .due ~to the fact the State Highway Department has indicated that the property will be used for a portion of·the West Valley Freeway sometime in the future. Chairman Lively closed the hearin~ for the evening at 8:08 P.M., directed C-146 continued to the meeting of 14 June 1971, and referred same to the Subdivision Committee. D. C.7147 - Clifford C. D, C-147 - Continued The Secretary stated that a petition containing forty five signatures ~as filed in opposition to the sub]ect change-of-zoning app I icat ion, No one:,..in the audience wished to comment relative to this matter, Chairman Lively closed the hearing for the evening at 8:12 P,M,~ directed C-147 continued to the meeting of. 12 July 1971~ and referred the matter to the Subdivision Committee, E, UP-201 - West Valley Ambulance Se.~vice, Saratoga-Los Gatos Road - Request for .Use Permit to Allow an Ambulance Service - Continued from 10 Hay 197.1 The Chairman reopened the hearing'-at 8:13 P,M, The Staff Report dated 24 May 197:1 was read, The Secretary recommended that th~ condition (a) of the subject report be amended to read as follows: (a) Pave existing driveway and provide nine (9) paved, off-street parking:, spaces as shown on Exhibit "B" and marked in accord with Section 11.3 of Ordinance NS-3. : Commissioner Kraus moved~ seconded by Con~nissioner Fagan to close the hearing for UP-201 at 8:18 P.M.; motion carried unanimously. Commissioner Smith moved, seconded by Commissioner Kraus, that the Staff Report dated 24 May 1971 relative:to UP-201 be adopted, as amended, and that the subject Use Permit be granted for a 24-hour ambulance service on the basis the findings required by Section 16.6 of Zoning Ordinance NS-3 can be made and subject to approval of the request that "Ambulance Service" be added to the list of conditional uses in the "C-C' (Community-Commercial) Zoning District; motion carried unanimously. F. V-363 - Sheldon Frost~ McFarland Avenue - Request for Variance to Allow a Reduction in Rear Yard Setback Requirements - Continued from 10 May 1971 The hearing was reopened at 8:21 P.M. A communication from Charles T. Y0unis of 18747 McFarland Avenue was filed in support of the requested variance. The Staff Report dated 24 May 1971 recommended denial of the subject variance. The applicant was present and sta~ed~a-~he felt, it would be an unfair decision to deny the subject variance. Chairman Lively explained if the Variance is denied the applicant can~ within ten (10) days~ file an appeal to t'he City Council. Commissioner Smith moved, seconded by Commissioner Kraus~ to close the hearing in connection with V-363 at 8:36 P.M.; motion carried unanimously Commissioner Kraus moved~ seconded by Commissioner Marsha11~ that the Staff Report dated 24 May 1971 be adopted and that the subject request for variance to allow a reduction in rear yard !setback requirements be denied since the findings required under Section 17..6 of Zoning Ordinance NS-3 cannot be made for the reasons stated in said report; motion carried unanimously. ~lanniHR Conmission Minutes - 24!May 1971 '- Continued II. G. V-36 5 - Hijo Miljevich, Miljevich' Drive - Request for Variance to Allow Relocation of Non-Conforming Structure and Use - Continued from 10 Ya~ 1971 The hearing relative to V-365 was. reopened at 8:27 P.M. The Secretary read a combination Statement of Reason and summary of the facts surrounding the applicant's! property and the requested variance filed by Douglas R. Korten of the Kahle and Adams law office. Mr. Don Miller, owner of adjacent. property owner at 20399 Kilbride Drive, stated that 1) the building that~ burned down on the MilJevich property last January was not a barn but a. dehydrator 2) he and his family were forced to leave their home because of the fire 3) the new structure that has been moved in is a new bunk h~use and not a barn and it was moved in during the dark of night 4) the original building was much smaller than the three (3) story structure that has been brought in 5) the building is a public nuisance and he and his family have ~curred countless harrass- ments from the Miljevich chi!tdren'and the applicant 6) the children stand on top of the threeS(3) story building and shoot B-B guns and sling shots into his yard 7) he has full knowledge of what was on the Miljevich side of the fence when he bought the ~d].~cen~ pr~pyrty.~nd now there are three (3) illegal buildings there that.the applicant should be required to remove from the property and 8) at the ~i~y Council meeting of 3 March 1971 the Council instructed the City Attorney to take action to get rid of the three (3) story structure. Hr. Korten, respresenting the applicant, stated that 1) it was his under- standing that the old building was not that much smaller than the new one 2) the building is in reality a two--(2) story building and not a three (3) story and 3) the applicant states that the gas station and other buildings have been on the property for many years, but their positions may have been shifted because of the clean up involved in connection with the fire. Mr. Frank Watkins of 20383 Kilbri~e Court ~as present and stated that 1) he wished to go on record as be~g Opposed to the proposed variance request and 2) there has been a complete lack of responsibility on the part of the appli- .cant tO,,,,comply with City Or[dinances. Mr. Korten stated\that if the variance is allowed he would be more than ~yiiling to arrange with the applicant to revamp the buildings or.';.~natever else needs to be done to make the'area look more presentable than it does now. Mr. Hiller stated that 1) the neighbors have already landscaped the area that should have been done by the:applicant 2) the new building is a lot~ longer and higher than the one that was burned down and 3) due to the height of the building he has no privacy in his back yard. The Staff Report dated 24 May 1971, recommending that the subject variance be denied, ms read. Commissioner Marshall rec~,nuended that the subject Staff Report be amended by changing Reason (2) to read as:]follows: "(2) There are several:alternative solutions for solving',..this appl~cant~ particular problems." and that the report be further amended by deleting (a) and ~b) of Reason (2) and by deleting the entire last paragraph of the subject report. Chairman Lively, in answer to an inquiry from Hr. Korten, stated that if .this variance is ~enied it does not prevent this applicant from applying for another variance.~egarding ~construction or use of a new building. G, .V.-.365 - Continued Commissioner Kraus moved, seconded by Commissioner Marshall, that the Staff Report dated 24 May 1971 beZ adopted, as amended, and the subject variance to allow relocation .of a: non-conforming structure and use be denied since the f.~ndings required under Section 17.6 of Zoning Ordi- nance NS-3 cannot be made for the' reasons ~ta~ed in said report; motion carried unanimously, ' H. ORDINANCE AMENDMENT - Amending th~ Zoning Ordinance NS-3 by Deleting Certain Conditional Uses from '~-1" Zones and Modifying Certain Off-Street Parking Requirements for Officesi The Secretary stated that this ma.tter should be continued to'the next regular meeting since the City Attorney has been in court on a case involving the City;['eh~e~'o~'e, the S~taff and Attorney have not been able to get together to discuss the subject ordinancesamendment. Chairman Lively,. in ~.iew of the flregoing, did not open the hearing at this time, directed the subject ordinance-amendment continued to the next regular meeting and referred. same to the Subdivision Committee. III. BUILDING SITES AND SUBDIVISIONS A. SDR-899 - Edward Oliver, Saratoga. Avenue - Building Site Approval - 1 Lot - Continued from 10 May. 1971 Commissioner Smith stated that the applicant did review the proposed conditions of approval and expressed satisfaction with same. Commissioner Smith moved, seconded by Commissioner Kraus, that the Building Site Committee Report dated 24 May 1971 relative to SDR-899 be adopted and that the tentative.map (Exhibit "A-I", fiIed 19 May 1971) be approved subject to the conditions set forth is said report; motion cart ied unanimous ly. B. SDR-900 - Live Oak Realty, Inc., Foothill Lane - Building Site Approval - 1 Lot - Continued from i0 May 1971 Commissioner Smith recommended that SDR-900 be continued to the next regular meeting to allow time for the applicant to submit a revised map. Chairman Lively so directed. C. SDR-905 - Meridith Rosebough, Via:Re~ina - Building Site Approval - 1 Lot The Secretary recommended that the following condition be added to the Building Site Committee Report dated 26 May 1971 relative to SDR-905: "L.Retain tree at corridor access and Via Regina in accordance with Fire District regulations concerning trimming and access." IV. DESIGN REVIEW A. A-37__0 - James R. Davi, Sousa Lan~ - Final Design Review - Convalescent Hospita 1 The Staff Report dated 24 May 1971 relative to A-370 was read. The applicant was present and stated he is in agreement with the subject report. Commissioner Martin moved, seconded by CommisSioner Fagan, that the Staff Report dated 24 May 1971 be adopted and that Final Design Approval be. granted for the convalescent hospital as shown on Exhibits "A", "B",. and "C" subject to the conditions stated in said report; motion carried with Commissioner Kraus voting "no". B. .A.-373 - Alfred F. Dunms, Inc., Prospect Road - Preliminary Design Review - Planned Con=aunity Development Chairman Lively directed A-373 continued to the next regular' meeting since the other applications (C-137 and SD-902) relevant to this particular appli- cation were both continued. V. CITY COUNCIL REPORT The Assistant Planner gave a summary~ of items reviewed and action taken at the City Council meeting of 19 May 1971 i~ith emphasis on items of particular· interest to the Co~,,.~ission. VI. PLANNING POLICY COMMITTEE Commissioner Eraus stated that 1) he did attend the ~9 May 1971 meeting for the discussion relative the Joint· Ho.using Element Study 2) there were approximately fifty (50) organizations present and. they all spoke in favor of the Joint Housing E!.1ement Study and no one spoke against it while he was there and 3) a Committee will study the comments and suggestions made at this meeting. VII. OLD BUSINESS : A. WEST VALLEY CHAPEL - Request to Add Ambulance Service to the List of Conditional=Uses in the "C-C" (Community-Commercial) Zonin~ District - Continued from 10 May 1971 The Staff Report dated 24 May 1971 was read. Commissioner Smith moved, seconded by Commissioner Kraus, to adopt the Staff Report dated 24 May 1971 and add "ambulance service" to the list of Conditional Uses in the "C-C" (Community-Co~umercial) Zoning District ,and B. SDR-891 - George H. Mckenzie, Montalvo Road - Request for Reconsideration of Conditions - Continued :.from 10 May 1971 The Secretary stated that in view, of the applicant's offer of dedication Of a portion of this property which !is pending before the City Council it is recoua-ended that the subject reqdest for reconsideration of conditions be continued off the agenda until the City Council takes some action. -7- Planning Commission Minutes - 24 M~.y 1971 '- Continued VII. SDR-891 - Continued Chairman Lively, without objection, directed the subject request continued off the agenda until a resolution is received from the' City Council relative to the said offer of dedication.~ VIII. NEW BUSINESS A~ C-139 - Malachy J. Moran, Saratoga Avenue - Referral by the City Council for Revision of Application The Secretary stated that 1) the City Council at the meeting of 5 May 1971 referred this matter back to the~Planning Commission on the basis of a "R-l- "'~ request from the applicant to amend his application and requesting zoning instead of t~-1-20,000" zoning for his property on Saratoga Avenue and 2) in light of the subject revised zoning application the applicant further requested that the General Plan be reviewed to include. the properties along Saratoga Creek as to their land Use density. Mr. Moran, the applicant, stated~that 1) the amended application is the result of many discussion with the Staff, Subdivision Committee, Planning Commission and City Council e~en: though he feels the original r~est fair and reasonable 2) approval'of the present application is urgent because of property taxes and his personal co~ittments and the cost of improving the property is going up all the:time 3) the more time that elapses the worse the potential becomes for selling the property; therefore, he would appreciate the Planning Commission holding a public hearing on the amended request as soon a possible and 4) it is his recommendation that the area along Saratoga Creek be reviewed along with the]General Plan. Chairman Lively explained that t~e Planning Commission has already reviewed the General Plan and forwarded same to the City Council and it would be best for the applicant to talk with the City Council relative to any changes in the General Plan. The Secretary stated that a notice of public hearing could be mailed in time for the next regular meeting. Chairman Lively directed the amended request, relative to C-139, continued to the next regular meeting and requested the Secretary to mail a notice of pub'lie%hearing to all residents in the area with~d. OS00-feet of the subject property informing them of the scheduled public hearing. B. Miljevich Prope[.ty. Miljevich Driv~e - Memo to Code Enforcement Officer Conmnissioner Marshall recouuaended that a memo be drafted to the Code Enforcement Officer relative to ~he MilJevich property as follows: ."On 15 May 1971 the Variance Cex~ittee{and a member ~f the Planning Q~partment '. ~i~rd~d'~e property 6{"~h~' Messrs. ~T13evich on MilJevich Drive to determine the potential of the non-confOrming structure on the site. During this visit a number of conditions were noted that should be corrected; consequently, there is a recommendation from the Planning Commission.:aS.~Eollows: That a complete inspection and clean-up of the property should be made including removal of all junk and debris, elimination of non-conforming temporary or permanent buildingd used for dwelling purposes, the obtain- ing of proper permits from the City for buildings, and adequate sanitary conditions. Miljevich - Continued Chairman Lively requested the Secretary to draft a memo in accord with the aforementioned wording and fo~rd same to the Code Enforcement Officer. C. ~rEST VALLEY JUNIOR COLLEGE ASSESSMENT DISTRICT The Secretary explained that the college has had this assessment district reviewed by the City Council and Planning Commission as to the overall plan; however, the .College does want to proceed with the first phase along Fruitvale Avenue and the City Council on the ba~s of the request have asked. the Planning Commission to review first phase and make sure it is] in compliance with the Master Plan for the college and the assessment district. Co~issioner Kraus recommended "that the matter be referred to the Design Review Committee for fur:.ther study. Chairman Lively so directed.and .requested the Secretary to w~ite a letter to WVJC and ask them if 'they have any new designs they would like the Planning Co~maission to review and if there is anything the City can do to help them expedite their plans. IX. COMMUNICATIONS A. ~RITTEN Letter from Dr. R. K. Thompson re Jack"s Road The Secretary read a letter received from Dr. R. K. Thompson requesting the trees and other vegetation be left undisturbed in the area of the required road improvements on Jack"s Road. The Secretary then stated that this matter has been resolved by the Planning Cowanission at a previous meeting and the natural vegetation and trees in that area will be left in their natural state and I)r. Thompson has been made aware of the action of the Planning Commission.
