PUBLIC HEARINGS A. C-i37 - Alfred F. Dunms, inc., Prospect Road - Request for. Change of Zoning from "R-l-10,000" (Single-Family Residential) to "R-l-10,000" "P-C" (Single-Family Residentall Planned Cormsunity) - Continued from 24 May 1971 The hearing'was reopened at 7:38 P.M. The Secretary stated that the applicant has submitted a revised map showing minor changes from the map previously presented to the Planning Commission. Mr. Charles J. Schneider, engineer for the applicant, stated that he and his client have had several meetings with the Subdivision Conn~ittee and the Public Works engineer and have now resolved any problems and differences. Mr. Art Grafe, 12121 Saraglen Drive, stated that 1) he is directly affected by the change of zoning since he lives in the area 2) he and his neighbors petitioned the City several weeks ago to have a survey made to confirm the dimensions of the property 3) according to the Tax Assessor's figures the size of the property is 6.23 acres 4) he is anxious to determine the total number of buildings proposed for this property and the size of the actual " individual lots 5) it appears some lots will be approximately 5,200 square feet in size and he is worried that this will cause degradation of his property :~.2>6) the Planning Commission has historicall~ stuck by the Zoning Ordinance in the past and he urges that this policy be continued and 7) if the property does consist of 6.23 acres then the total square footage available would be 271,378.80 and out of that the following will have to be deducted:' 60 X 275 .= 16,500 square feet -'For Prospect Road Improvements 27~ X 500 = 13,750 square feet - First Section Santa Clara County Flood Control Easement 35 X 361 = 12,635 square feet - Santa Clara County Flood Control Easement 600 X 37 = 22,200 square feet - Road Construction Within the Tract 155 X 37 = 5,~3~ square feet - Road Construction Within the Tract ' 70,820 square feet - Total deductions 271,378.80 - Gross ACreage Available r70,820.00 - Total Deductions 200,558.80 - Net Acreage Available Planning Commission Minutes - 14 June' 1971 - Continued II.. A. C-137 - Continued Mr. Grafe went on tO say that l) he is opposed-to the proposed individual lot sizes since it will result in an increased density in the area 2) a total of sixteen (16) houses·for t·h~ property would not be as objectionabl~ 3)· the. plan currently~under consid- eration by the Planning Commission was not br. ought to the attention . of the residents of the area and 4) he did attempt to meet with· the Subdivision Committee, but was unable to arrange an appointment. Chairman Lively stated that i) the developer and the owner of the property have tried to put forth a plan that is feasible and the Subdivision Committee has attempted to emanate the differences noted by Mr. Grafe 2) obviously the nearest.resident to the subject develop- ment is 75-feet away; so, there is some seperation and 3) Mr. Grafe has had eight (8) weeks to arrange an appointment with the Subdivision Committee; however, the matter will be continued another two (2) weeks only in order to allow Mr. Grafe time to review the plans with the Sub- division Committee. Commissioner Marshall Stated he objected to a continuance since he feels F~. Grafe has had ample opportunity to state his cae and if Mr. Grafe's figures are used twenty (20) houses could go on the property instead of nineteen (19) as proposed by the applicant. The Secretary stated there is no real difference in the figures only in the application of same. Commissioner' Smith stated that 1) the applicant·'s figures and Mr. Grafe's figures are the same and the revised map does not contain any new calculations and 2). this is a "P-C" (Planned-Community) Development and many lots can be under 10,000 square feet in size and the subdivision ~ill contain open-space to compensate for the smaller lots. Cormn~ssioner Kraus stated that he would be willing to continued the matter and meet with Mr. Grafe; however, there is no real reason to do so. Commissioner ~rshall stated he would withdraw his objection to a continuance of this matter if Mr. Grafe agrees to ~lk the subject property and look back towards the existing Blue Hills Subdivision. ~.'Schneider stated that 1). according to the appliCant's figures a total acreage of 5.77 is available 2) he did not feel there is sufficient disagreement to warrant a continuance of the matter and 3) the figures indicate twenty (20) lots could be allowed and only nineteen (19) are proposed. -~. Mr Bob Mathot, developer, stated that 1) it .~s sometime ago that Mr. Grafe first stated that he did not have an opportunity to look at the map and requested a continuance 2) the changes made'on the current revised map are very minor and 3) he believes }~. Grafe's request for another continuance is simply a ploy to further delay the matter. Commissioner Kraus stated that he feels a further continuance is unfair to the developer and it should be '~an~amount ~hat the Planning Commission take action at the next meeting. The Secretary arranged with ~. Grafe for a meeting with the Subdivision Committee for Thursday, 17 June 1971 at 3:30 P.M. Chairman Lively closed the hearing for the evening at 8:06 P.M., directed the matter continued to the next regular meeting and referred same to the Subdivision Committee. -2- Planning Conmission Minutes - 14 June 1971 - Continued II. B. C-139 - Malachy J. Moran, Saratoga Avenue - Request for Change of Zoning from "R-I-20,000" (Single-Family Residential) to "R-l-15~000" (Single-Family Residential) .Chairman Lively opened the hearing relative to C-139 at 8:06 P.M. The Secretary stated the'N0[ices of Hearing were mailed. Commissioner Smith stated the map submitted by the'applicant is not adequate; therefore, iC-139 should be continued to allow time for the applicant to prepare a revised map. The Secretary explained that the revised map should indicateonly the portion of the applicant's property that will be involved in the requested change of zoning. Mr. Moran, applicant, stated that 1) the topography and physical condition of the property affect the development and usage 2) the "R-l-15,000" (Single-Family Residential) zoning would permit a land use compatible with the conditions existing on the property 3) the subject zoning would not increase the density of any.undeveloped land in the neighborhood and 4) the requested zoning would provide a logical transition from the"'R-1-20,000" (Single-Family Residential) on Saratoga Avenue to the "R-I-10,O00" (Single-Family Residential) zoning on Lannoy Court° Mr. Joe Zerboni, 19951 Lannoy Court, inquired iflthe correspondence and petitions filed relative to the applican~Ts previous change of zoning are still pertinent to the current request. Chairman Lively stated that he is not in favor of a blanket reinstatement of all correspondence that was filed in connection with the former change of zoning requestssince that does not seem fair to the applicant. Commissioner Smith recommended that all the correspondence be brought up to date by the individuals involved to apply to the request. Commissioner Kraus agreed that the correspondence should be updated. Mr. Alan Margulis, 19961Lannoy Court, stated that 1) he is opposed to the proposed change of z6ning since it is contrary to the General Plan and would increase the density in the area and 2) he does not feel the applicant should be allowed to continue to revise his request because eventually the opposition may tire of protesting and the appli- cant will OBtain..'!approval of a zoning not in accord with the General Plan. Mr. Moran stated that 1) he has tried to be objective about the , development of this propert~ 2) if he brought in a proposal for "R-1-19,999" square foot lots there would still be some opposition 3) the lot sizes proposed are still larger thant the homes on Lannoy Court and 4) with t~e proposed "R-l-15,000" zoning'there will be only one (1) more house in the area than if the zoning shown on the General Plan were applied° Chairman Lively closed the hearing for the evening at 8:32 P.M., directed C-139 continued to the next regular meeting and referred same to the Subdivision Committee° -3- Planning Cormnission Minutes - 14 June. 1971 - Continued II. Galeb, Ted Avenue - Request for Change Of zoning from "R-l-10,000" (Single-Family Residential) to "R-M-5,000" (Multi- Family Residential) - Continued from 24 May 1971 Chairman Lively reopened the hearing relative to C-145 at 8:33 P.M. The Secretary stated nothing new had been added to the fileo Mr. Richard Foust, architect~ was present and stated 1) he did have a preliminary plan he would ~ike to submit 2) the Subdivision Committee visit the site and 3) the preliminary map shows enlarged lo~sizes of approximately 20,000 square feet in each lot with a total of five (5) lots with four (4) lots of four (4) units and one (1) lot of six (6) units. Commissioner Smith stated that the preliminary studies should be submitted tO the Subdivision Committee prior to a presentation to the Planning Commission. Mr. Raymond Sheets, 12444 Ted Avenue, stated he and other residents of the area are interested in review the plans referred t0 by Mr. Foust. Commissioner Smith stated that 1) the Subdivis~ n Comnittee did make an on-site inspection of the'property and are hot at ~11· happy with· the junk and old autos left on the property and 2) the owner was to clean-up the property sometime ago and he should do so in order to make the property presentable. Chairman Lively closed the hearing for the evening at 8:41 P.M., directed C-145 continued to the next regular meeting and referred · ~ the matter to the Subdivision. Committee. He suggested that any residents of the area interested in reviewing the plans come into City Hall (Planning Department). D. C-146 - Aubrey Johnston, Quito Road - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "C-N" (Neighbor- hood-Commercial) - COntinued from 24 May 1971 Chairman Lively reopened the'hearing at 8:43 P.M. Co:Dmissioner Smith stated that 1) another report from the State Highway Department is forthcoming relative to a possible purchase of this property and 2) the applicant has not yet submitted a bona fide proposal as to a spec.ific use for the subject property° Mr. Johnston, the applicant,'stated that he has had three (3) offers on the property; however, the offers have all been contingent 0n getting the zoning on the property changed to commercial. Chairman Lively closed the hearing for the evex~ing at 8:44 P.M., ·directed · C-46 continued to the next regular meeting and referred same to the Sub- division Committee° E. C-148 - George W. Day, Fruitvale Avenue and Douglas Avenue - Request for Change of Zoning from "A" (Agricultural) to "R-1-40,O00" (Single- Family Residential) Chairman Lively opened the hearing relative ·to C-148 at 8:45 P.M. The Secretary stated the Notices of Hearing were nm iled and published. The Secretary read a memo from the Parks and Recreation Commission recommending that a certain portion of these lands be set aside and dedicated for.park.a~d open-space purposes and suggesting that the appli~anl continue ~o .o side~!'P-C'' (Planned-Community) cn - Planning Connnission Minutes - 14 June 1971 - Continued II. E. C-148 - Continued Mr. Lou Leto, 14928 Jerries Drive, General Manager of George Day, stated that 1) he did meet.with the Parks and Recreation Commission to discuss a' "P-C" (Planned-Connnunity) development, but at that time sixty seven (67) acres were. involved; however, problems prevented purchase of the entire sixty seven (67) acre parcel and now the appli- cant plans to develop only seventeen (17) acres and' 2) in view of all the problems encountered by Saratoga Foothills Development and Mr. DumaS in attempting a "P-C" development the applicant is very hesitant to pursue the "P-C" concept any further. Comanissioner Smith stated that the Subdivision Co~ittee did review the preliminary map and were not particularly impressed with the lay-out of.the subdivision since it appeared to be pretty ordinary~' Mr. Ed Panelli, attorney for the applicant, stated that the applicant would like to obtain approval of the requested change of zoning as soon as possible in order that construction can begin prior to the beginning of the' winter months. ORDINANCE A~ND~NT - Amending the Zoning Ordinance NS-3 by Deleting Certain Conditional Uses from "R 1" Zones and Modifying Certain Off-Street Parking Requirements for Offices - Continued from 24 May 1971 The Chai~an reopened' the""h~aring at 8:56 P.M. The Secretary explained that the City Attorney stated that the State Law requires that private non-~p~fi'l~ '~cho~!s 'and Coll~ges .. .... must be allowed as conditional uses in the "R-I" zoning district if public and parochial school~ are allowed in that zone. No one present wished to comment. CoEissioner Kraus moved, seconded by CoEissioner Smith to close the hearing at 8:58 P~M.; motion carried unanimously. Co~issioner Smith moved, seconded by Co~issioner Kraus, that the ordinance amending Zoning Ordinance NS-3 by deleting certain conditional uses from the "R-I" zones and modifying certain off-street parking require- ments for offices 'be adopted and forwarded to the City Council as the reco~endation of the Planning Commission; motion carried unanimously. III. BUILDING SITES AND SUBDIVISIONS A'.' SDR-900 - Live Oak Realty, Inc., Foothill Lane - Building Site Approval - 1 Lot - Continued from 24 May 1971 The Secretary read a comnunication received from the applicant requesting that SDR-900 be withdrawn. SD-902 - A1Dumas, Prospec~ Road - Subdivision Approval - 19 Lots - Continued from 24 .MaX 1971 Con~nissioner Smith recommended that SD-902 be continued to the next regular meeting since the change of zoning request (C-137) has been postponed. Chairman Lively so directed. C. SDR-903 - David L. Schmidt, Vaquero Court - Building Site Approval - 1 Lot The applicant was present and stated he had reviewed the proposed. conditions of approval and'expressed satisfaction with same. Commissioner Smith moved, Seconded by Coxmnissioner Kraus, that the Building site conmittee Report dated 14 June 1971 relative to SDR-903 be. adopted and that the tentative map (Exhibit "A", filed 14 May 1971) be approved subject to the'conditions set forth in said report; motion carried unanimously. D. SD-904 - George W. Day, Fruitvale Avenue and Douglas AvenUe - Subdivision Approval - 15 Lots Commissioner Smith recommended that SD-904 be continued to the next regular meeting since the change of zoning request (C-148) has been postponed. Chairman Lively so directed. E. SDR-906 - Richard M. Kanazawa, Oriole Way - Building Site Approval - 1' Lot : Mr. David Takamoto, applicant's architect, stated that he reviewed the · proposed conditions of approval and expressed satisfaction with same. Commissioner Smith moved, ~econded by Comnissioner Kraus, that the Building Site Comnittee Report dated 14 June 1971 r~lative to SDR-906 be ~dopted and that the tentative map (Exhibit "A", filed 27 May 1971) be approved subject to the conditions set forth in said report; motion carried unanimously. F. SDR-907 - DonaM Comer,~ Pierce Road - Building Site Approval - 4 Lots Commissioner Smith recommended that SDR-907 be continued to the next regular meeting° Chairman LiVel~ so directed~ G. SDR-908 - Joe Neville, Pierce Road - Buildin~ Site Approval - 2 Lots Mr. Neville was present and stated he did review the proposed conditions ~ of approval and expressed satisfaction of same° Commissioner Smith moved, seconded by Comn~issioner Kraus, that the Building Site Committee Report dated 14 June 1971 relative to SDR-908 be adopted and that the tentative map (Exhihit "A-i", filed 14 June 1971) be approved subject to the conditi'ons set forth in said report; motion carried unanimously° H. SDR-909 - Manuel Costa~ qu~to Road - Building Site Approval - 1 Lot The Secretary stated that the Public Works Department feels that if the use proposed for this property is approved Quito Road should be improved and the sewage system should be given careful consideration. Commissioner Smith recommended that SDR-909 be continued to the next regular meeting to allow time for further study of the matter. A-271 - Stoneson Homes, Big Basin Way - Final Design Review - Review of New ElevatiOns Commissioner Marshall stated that the applicant did meet with the Design Review Coxm~ittee and submitted the exterior elevations for tie' fOurth"building Of'his toi~nhouse development. The Assistant Planner read the Staff Report dated 14 June 1971 reconm~ending that Final Design Approval be granted for A-271. Commissioner Marshall moved, seconded by Commissioner Martin, that [he Staff Report dated 14 June 1971 be adopted and that Final Design Approval be granted for the exterior elevations for the fourth to~nhouse complex for Stoneson tI0mes as shown on Exhibits."J" and "K" and subject to the condition stated in said report; motion carried unanimously. B. A-376 - Highland Development Company', Prospect Road - Final Design Review - Subdivision Approval Commissioner Marshall explained that the applicant proposes to eventually construct nineteen (19) houses in the subdivision. Mr. Bob Mathot, representative for the applicant,' stated that at this time he had ten (10) different elevations for eleven (11) houses. Commissioner Marshall stated that almost all of the elevations show court yard approaches. 'T~'e AssiStant. After discussion, it was decided that the following be added to condition "(b)" of the subjec't report: "'(Lots 2,3,4,6, and' 12 will have curved "driVeWays.)" commissioner Marshall moved, seconded by Commissioner Martin, that the Staff Report dated 14 June 1971 be adopted, as amended, and that Final 'Design Approval be granted fo'r the exterior elevations for eleven (11) homes in Tract 4951 as sho~m on Exhibits "A" through "D"Tsubject to the conditions stated in said report; motion carried unanimously. C. A-349 - Cal-West Communities,. Saratoga Avenue - Final Design Review - Minor Revision of Master Plan Commissioner Marshall explained that the applicant approached the Design Review Committee with a slight modification request stating that the one-(1) and three-(3) bedroom condominiums are selling bettsr than the two-(2) bedroom townhouse units; ther'efore, the proposal is to eliminate fourteen two-(2) bedroom units and replace them wi'th one-(1) and threes(3) bedroom Units. Commissioner Kraus suggested that Unit II of this development be given careful consideration since aesthetically Unit I is not too attractive. Chairman Lively stated that he would not like to see this development become any more crowded than it already is and he would like the matter continued to allow time for further study of the requested modification. Mr. A1 Warnick, President of Cal-West stated that 1) the first phase of this project is all sold 2) the plan followed for development of the condominium-apartment complex is unique and has won several major awards 3) the developer tried to stay within the concept previously approved; however,. the sales to date indicate the one-(1) and three-(3) bedroom condominiUms are selling better than the two-(2) bedroom townhouse units'; thcrcforc, a modification {n thc plans io rcqucotcd and ;,) h ..... ,la appreciate a decision at this time. -7- Planning Commission Minutes - 14 June 1971 - Continued IV. C. A-349 - Continued The Assistant Planner read the Staff Report dated 14 June 1971 relative to A-349 reconmending that Final Design Approval be granted for the requested modification and that 1,000 square feet more building area be allowed. Commissioner Marshall moved, seconded by Commissioner Martin, that the Staff'Report dated 14 June 1971 be adopted and that Final Design Approval be granted for the modificati'on in the Master Plan for Unit I as shown on · Exhibit "X" subject to the conditions stated in said report; motion carried with Chairman Lively voting No. D. A-373 - Alfred F. Dumas, Inc.i, Prospect Road - Preliminary Design Review - Planned Community Development - Continued from 24 May 1971 Chairman Lively, due to the continuance of C-137 and SD-902, directed 'A-3~3 continued to the next regular meeting. E. A-375 - Earl Hinricks, Quito Road - Final Design Review - Subdivision Approval Chairman Lively, due to the c'ontinuance of SDR-909, directed A-375 continued to the next regular meeting to allow time for further study. V. CITY COUNCIL REPORT Councilman Sanders was present and connnented on a few items of interest to the Planning Commission that were discussed at the City Council meeting of 2 June 1971o VI.PLA[~tNG POLICY COM>5TTEE Housing Element StUdX Commissioner Kraus stated that 1)i he did obtain a list of the organizations and individuals in supportof the Housing Element and 2) the Housing Element Study was' approvedo This was done in spite of the valiant effort of Councilman Jerry Smith to add amendments to the Housing Study relating to. Saratoga's goals. Chairman Lively inquired if Saratoga is firmly on record as being opposed to' to the Housing Element Study that was approved? Commissioner Kraus answered that the City of Saratoga is on record as being opposed to the subject Housing'Element and Mayor Robbin's letter stating the City's opposition was read and he (CoFmissioner Kraus) voted against the Housing Element. Hillside Committee Commissioner Kraus stated that at the Hillside Committee meeting, George Mader, representative from Wm. Spangle and Associates was present and he had 'drawn up some hillside maps with standards and in addition to the Slope Density I proposal a Slope Density II proposal was explained which was very interesting° The representative, also, had a number of slides that were taken Of Los Gatos, Monte Sereno, and Saratoga and the apparent cutting of the hillside shown in the slides was very upsetting to see and the Planning Comnissions must be extremely careful as to what they approve for hillside lots in the future° Planning Co~mnission Minutes - 14 June 197]. - Continued VII.' OLD BUSINESS ~ A. WEST VALLEY JUNI'OR COLLEGE ASSESSMEk~I' DISTRICT - First Phase - Parking The Assistant Planner read the Staff Report dated 14 June 1971 stating that the college's original Master Plan and the engineered improvement plans and landscape plans are almost identical to one another; therefore, the Use Permit has not .been violated. Com~nissioner Marshall recommended that a note be added to the subject report as follows: "After review of the proposed parking addition the Planning Com~.ission hereby acknowledges to the City Council that the proposed plan is consistent with the .Use Petit (UP-119) and the college ~ster Plan." Co~issioner Marshall moved, seconded by Cox~issioner Martin, that the Staff Report dated 14 June 1971 be adopted~ as amended, and the new parking lot fronting on Fruitvale Avenue be approved and the subject report be forwarded to the City Council as the reco~endation of the Planning C~ission; motion carried unanimously. B. Malachy J. Moran, Saratoga AvenUe - Request for General Plan Adjustment The Secretary stated that 1) the applicant at the City Council meeting of 5 May 1971 revised his change of zoning application from "R-l-10,000" to "R-l-15,000" and at the same time asked for an amendment to the General Plan to reflect this requested Change and 2) the matter was referred to the Planning Co~ission by the City Council. '~ The Secretary then read a memo from the City Manager requesting the Planning Conmission to submit a .supplementary report relative to the General Plan in connection with the Moran request~ Chairman Lively stated that the ~Planning Co~nission has held public hearings relative to the General Plan and did fon~ard the results to the City Council and now the CoUncil has asked the Planning Co~ission to review this particular request; therefore, the subject request is referred to the General Plan Co~ittee and continued to the next regular meeting. VIII. NEW BUSINESS A. SDR-895.- S. B. Walton, Saratoga Hills Road - Request for Reconsideration · . Building Site Approval Condition "' The Secretary read a comnunicati. on received from Mr. S. B. Walton, applicant, requesting modification of Condition II-B of the Building Site Committee Report dated 10 May 1971. Mr. Walton was present and state'd that the portion of the road to be improved as per Condition II-B is lined by quite a number of trees and they are so close to the road tt~ey will have to be.cut do~ or dirt will be pushed against them which will cause them to die. If the trees are done away with the entrance to Saratoga Hills will be ruined. Chairman Lively directed the matter continued to the next regular meeting and referred the matter to the Subdivision Co~ittee for study~ B. Policy Requirin~ Sanitary Sewers . " The Secretary read the Staff Rep.ort dated 14 June 1971 recox~ending that the-Planning Comnission adopt a policy requiring a sanitary sewer for all new subdivisions with five (5)'or more lots. ORAL " F10~er' Stand on Saratoga-Sunnyvale Road Chairman Lively stated that Cormmissioner Metcalf did call him to say that the flower stand on 'Saratoga-Sunnyvale Road is flying a::.number of American Flags for advertising pruposes. ·The Secretary explained that some businessman in Campbell is being taken to court for doing the same thing and Mr. Gilmore (flower stand owner) was informed he could fly the American Flag, but not for advertising purposes. Commissioner Marshall stated that if the Code Enforcement Officer does go out to talk to Mr. Gilmore he might mention the sandwich· board signs that appear every weekend at the subject flower stand.
