ROUTINE ORGANIZATION : The meeting was called to order by Chairman Lively at 7:30 P.M. A. MINUTES Commissioner Smith moved, seconded by Commissioner Kraus, that the reading of the minutes of the 14~June 1971 meeting be waived and they be approved as distributed with the following change: page 5. . .under C. II. PUBLIC HEARINGS A. C-137 - Alfred F. Dumas, Inc., Prospect Road - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "R-l-10,000" "P-C" (Single-Family Res{dential Planned Community) - Continued from 14 June 1971 Chairman Lively reopened'r. the hearing at 7:36 P.M. Mr. Bob McBain, architect, was p~esent to .represent the applicant, and stated he would be happy to answer any questions. Mr. Art Grafe, 12121 Saraglen Drive, stated that 1) he did meet with the Subdivision Committee to discuss~ this matter and he feels that the matter of the available square footage was resolved and 2) the residents of the area would like to see a reduction in the number of houses presently pro- posed for the property in order to pr~i~'I6~'(i~' the proposed fhg~ are i~' same size ~'S ~hose now existing in ~h~ Blue Hills area. : Commissioner Smith read the Subdivision Committee Report dated 28 June 1971 recommending that the subject Change of Zoning be approved. tie then amended the report on page ~. . .condition (c). . .add "as approved by the Planning Commission." iCommissioner Smith, in answer to an inquiry from Chairman Lively, stated, ithat a Maintenance District would be formed to maintain the common greeB~ ~area in this "P-C" development andv~f"maintenance is n~t performed by the .,Di~fc'6%"'~he City will take over~and tax the residents of the "P-C" develop- 'ment. Chairman Lively read the SubdiviSion Committee Report dated 28 June 1971 recommending approval of the tentative map for SD-902 filed by the applicant in connection with C-137 and stating that a Park Maintenance District to maintain open-space and common green is to be established. Plannin5 Commission Minutes - 28 June 19~1 - Con~nued II. A. C-137 - Continued Commissioner Metcalf read the Staff Report relative to application A-373 recommending that Final Design Approval be granted for the subject planned community development. Commissioner Smith explained that only the report relative to C-137 would be approved at this time ~nd that the reports relative to SD-9027and A-373 would be acted, upon as they came up in the regular order of the agenda. Commissioner Fagan stated that the Subdivision Committee, during its deliberations of the proposed "P-C" development, did take into consider- ation the fact that the propose~ subdivision would provide a buffer zone between the adjacent proposed freeway and the existing Blue Hills residen- tial area. Commissioner Smith moved, seconded by Commissioner Kraus, that the hearing relative to C-137 be closed at 8:02 P.M.; motion carried unanimously. Commissioner Smith moved, seconded by Commissioner Kraus, that the Subdivision Committee Report dated 28 June 1971 be adopted and the subject change of zoning to "P-C" (Single-Family Residential Planned Community) be recommended to th~ City Council for approval on the basis the objectives of Section'4 A.6(d) and 18.6 of Ordinance NS-3 can be made subject to the conditions'stated in said report; motion carried with Chairman Lively voting No. B. C-139 - Malachy J. Moran, SaratQga Avenue - Request for Change of Zoning from "R-1-20,O00" (Single-Family Residential) to "R-l-15,000" (Single-Family Residential) - Continued from 14 June 1971 Chairman Lively reopened the hearing at 8:04 P.M. The. Secretary recommneded that C-1B. be continued since the Staff is in the process of doing a study of transitional areas such as the Moran property and a~.~reliminary report will be submitted at this meeting under old business. No one in the audience wished to comment. The applicant was not present. Chairman Lively closed the hearing for the evening at 8:06 P.M., ~{~e~ the matter continued to the next regular meeting and referred C-139 to the Subdivision Committee. C. C-145 - B. T. Galeb, Ted Avenue - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "R-M-5,000" (Multi- Family Residential) - COntinued from 14 June 1971 Chairman Lively reopened the hearing at 8:06~P~M. The Secretary advised that the applicant has requested that this matter be continued in order to allow time for him to develop further revised plans and meet again with the homeowners in the area. Mr. Dick Green~ 12350 Goleta Avenue, that the residents of the area did meet with the applicant and there does seem to be some discrepancy in the actual number of duplexes that can be placed on the subject property. He is interested in obtaining information as to when the actual number allowed will be established. Chairman Lively answered that the number of units that will eventually be allow.~d will be determined at the time of the change of Zoning approval (if it is indeed approved). C-145 - Continued Mr. Fred Adolph, 20255 Sea Gull:Way, stated that 1) he wondered if the Planning Commission did take into account the situation that exists in the area of the proposed change. of zoning 2) there have b~en many problems in this area which the applican~ has been asked to correct such as a general clean-up of the area and paving2of the driveway; which, has never been_,~one 3) he has lived in the area fo~ six and one half.~6~ ·~·ea~s·and has tolerated various and numerous indignities from the app!t.~cant and his tenants living in the apartments directly to the rear of his (Mr. Adolph's) property 4) the orchard and commercial district (owned by the applicant')· is a mess 5) Mr. Galeb has stated many times that he intends to upgrade the area in Azule, but he does nothing to accomplish this 6) the applicant allows motorcycle racing, weeds~ loose dogs, and a general collection of debris on his property and the request to have him do something.,about the situation go unacknowledged ;7) the sh~f~'fhas been called t'O talk to the applicant on many occasions, but the ~ar~ings go unheeded.and 8) he urges the Planning Commission t~ require the applicant to clean-up the area before he allowed to proceed with any further construction of develop- ment. Chairman Lively closed the hearingSfor th~ evening at 8:14 P.M., directed the matter continued to the next regular meeting an~ referred C-145 to the Subdivision Committee. D. C-146 - Aubrey Johnston, Quito Road - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "C-N" (Neighborhood- Commercial) - Continued. from 14 June 1971 The hearing relative to C-146 w~s reopened at 8:15 P.M. The applicant was present and stated that 1) he has lived on this property for twenty (20) years and the Seate Highway Department told him at that time (twenty (20) years'ago) that they were going to buy the property and he is still waiting and 2) he has declared hardship and the State Highway has bought property all around him and he cannot understand why they do not buy his since he does want to retire. The Secretary read the Staff Report dated 28 June 1971 recommending that the subject change of zoning in:connection with C-146 be denied. .Commissioner KrauS~~"~,~on~ed by Commissioner Smith, to close the hearing relative to C-146 at 8:22 P.M.; motion carried unanimously. Commissioner Smith moved, seconded by Commissioner Kraus, to adopt the Staff Report dated 28 June 1971'relative to C-146 and recommend to the City Council that the subject application for Change of Zoning be·denied on the basis the objectives of Zoning Ordinance NS-3, Section 1.1 cannot be achieved for the reasons stated in said report; motion carried unanimously. E. C-148 - George W. Day, Fruitvale Avenue and Douglas Avenue - Request for Change of Zoning from "A" (Agricultural) to "R-i-40,000" (Single- Family Residential) - COntinued from 14 June 1971 Chairman Lively reopened the hearing at 8:23 P.M. Mr. Victor A. Chargin, attorneylrepresenting the Ljepava family, stated that 1) his client is opposed to the subject change of zoning since it would establish a precedent tha~ would adversely affect the Ljepava property located in the area and 2) the:Ljepava family has other plans for the development of the property. ~ Commissioner Fagan asked if Mr.·Chargin was saying that the proposed change of zoning would be inconsistent or m~.y be inconsistent with what the Ljepava family wants to do With their property. Mr. Chargin stated that the proposed change of zoning would be inconsistent with what his client intends for his property. -3~ Planning Commission Minutes - 28 June 197~ - Continued II. E. C-148 - Continued Commissioner Metcalf explained that in the general area of the subject property all the land is' shown as very low density on the General Plan Map. Mr. Chargin stated he was under the impression the area was to be used as a Central Park site. The Secretary explained that the! portion fronting on Fruitvale is designated for park use. Dolly Gay, 234 Marshall Street, Redwood City, a realtor representing the Ljepa~a and Novakavich famil{es, stated that 1) her clients are long'~time taxpayers in the City Of Saratoga 2) it was the understanding of her clients that the applicant was going to request "R-i-20,000" zoning for the subject property 3) "R-I-40,000" zoning is not financially reason- able for the said property sincelit is located in the middle of the civic center and adjacent to the West Valley Junior College 4) with interest rates what they are a home on an."R-1-40,000" lot in this area would cost in the~neighborhood of $100,000.'5) anyone who can afford a home in that price range will not want to buy~in the middle of a civic center complex and 6) it is the hope of her client that the applicant will reconsider his request for "R-1-40,O00" zoning and instead consider a request for "R-I-20,000" zoning for the subject property.' Chairman Lively explained that t~e said property is one of two locations proposed for a Central Park site~ The second site is located at the corner of Saratoga Avenue and Fruitvale Avenue; however, the City has not decided which site they Willzuse for the park. Mr. Edward Panelli,~attorney for~the applicant, stated that he finds himself in agreement with the opposition; however, the "R-i-20,000" zoning suggested by Mrs. Gay would be inconsistent with the General Plan. Chairman Lively closed the heariDg for the evening at 8':37 P.M., directed the matter continued to the next'regular meeting and referred C-148 to the Subdivision Committee for further study. III. BUILDING SITES AND SUBDIVISIONS A. SD-902 - A1Dumas, Prospect Road - Subdivision Approval - 19 Lots - Continued from 14 June 1971 Mr. Charles J. Schneider, engineer for the applicant, was present and stated he had reviewed the proposed conditions of approval and expressed satisfaction with same. Commissioner Smith moved, seconded by Commissioner Kraus, that the Subdivision Committee Report dated 28 June 1971 relative to SD-902 be adopted and that the tentative m~p (Exhibit "A-2", filed 14 June 1971) be approved subject to the conditions set forth in said report; motion carried with Chairman Lively voting"'~"~ Chairman Lively explained that h& voted !'~" because he is not in agreement with the number of lots proposed~for the subject'~subdivision. B. SD-904 - George W. Day, Fruitvale Avenue and Douglas Avenue - Subdivision Approval - 15 Lots - Continued from 14 June 1971 Commissioner Smith stated that because of the continuance of C-148 under -public hearings it is recommended that SD-904 be continued to the~next meeting on 12 July 1971. SDR-907 - Donald Comer, Pierce Road - Building Site Approval - 4 Lots - Continued from 14 June 1971 Commissioner Smith recommended that SDR-907 be continued to allow time for further study of the matter. ~.~'Chai·rman Lively so directed. D. SDR-909 - Manuel Costa, Quito Road - Building Site Approval - 1 Lot - Continued from 14 Jun~ 1971 The Secretary read a communication received from the applicant requesting that SDR-909 be withdrawn. , Commissioner Smith moved, seconded by Commissioner Kraus, that the request for withdrawal in connection with SDR-909 be approved and a~ proceedings relative Ito same:~'terminated; motion carried.unanimously. E. SDR-910 - Terry J. Bowman~ Pier~e Road - Building Site Approval - 1 Lot Commissioner Smith recommended [hat SDR-910 be continued to the next regular meeting. Chairman Lively so directed. F. SDR-911 - Willard Thompson, OakiStreet and St. Charles Street - Building Site Approval - 1 Lot: Commissioner Smith explained that this request for building site approval was previously approved and then it expired and the applicant is now re- applying. Commissioner Metcalf stated that 1) before any action is taken relative to SDR-911 he would~.like to inquire what has been done about the traffic study for S't·~· Charles Street and the village area that was proposed as a result of the 1971 General Plan Review and 2) the recommendation was that there be no further.development on St. Charles Street pending comple- tion of the subject traffic study. The Secretary explained that th~ City Council has not authorized the Staff nor anybody else to do such'a study. Chairman Lively read the recommendation of the Planning Commission con- tained in the General Plan Committee Report as follows: St. Charles Street "~his street is very narrow, and anfi integral part of'~h~ ov~'I' ~illage circulation and parking problem. Because of this, we recommend that no further "R-M" development ~e permitted~' pending the results ~of the professional studX recommended elsewhere." Chairman ~ively then stated that he felt this request for building · ~site approval should be held in abeyance until the traffic study in connection with St. Charles Street is resolved and the City Council takes.some action on the recormhendation made by the Planning Commission in the General Plan Report of 12 April 1971. Commissioner Metcalf read the following portion of the General Plan Committee Report of 12 April 1971; which, was forwarded to the City Council by the Planning CommisSion: "We recommend~a professional s~udy be undertaken to determine the feasibility of peripheral parking districts combined with no parking on Big Basin Way. This tudy should, also, include 6th Street, St. Charles, and Oak Street as possible methods of easing the traffic problem in. the Village area." -5- Planning Commission Minutes - 28 June 1971 - Continued III. F. SDR-911 - Continued The Secretary explained that according to State Law some action must be taken realtive to SDR-911 prior to 5 August 1971 since that is when the fifty (50) day limitation on the map expires. Chairman Lively directed SDR-911 continued to the meeting of 26 July 1971~ and referred same to the Subdivision Committee. He encouraged each individual Commissioner to make an effort to go look at the property prior to the next meeting. G. SDR-912 - Russell Reed, Saratog~-Sunnyvale Road - Building Site Approval - 1 Lot Commissioner Smith recommended [hat SDR-912 be continued to the meeting of 12 July 1971. Chairman Lively so directed. H. SDR-913 - Clayton F. Thomas, Allendale Avenue - Building Site Approval - 1 Lot The Secretary explained that th{s matter should not have been included on this agenda since the maps were submitted too late for proper distribution to the necessary agencies. RECESS AND RECONVENE IV. DESIGN REVIEW A. A-325 - United Presbyterian Church, Herriman Avenue and Highway 85 - Final Design Review - Revised Parking Lot Layout Commissioner Metcalf read the Staff Report dated 28 June 1971 recommending that Final Design Approval be g~anted for the revised parking-lot layout for the United Presbyterian Church. Commissioner Smith asked how many seats were included in the original sanctuary since two (2) parkingispaces are required for every five (5) SeatS. The Secretary advised that ther~ are three hundred and fifty (350) seats (approximately) in the original .sanctuary.. Commissioner Smith explained that with three hundred and fifty (350) seat one hundred and forty (140~ parking places are required. The Secretary explained that the representatives for the church have explained that the parking spaces now provided are never all in use at the same time. Commissioner Kraus stated that the reason the parking lot is never filled is because the members of the church park in the street and he wondered if some provision to eiiminate street parking should be included in the Staff Report relative to'A-325. Commissioner Marshall explained !that 1) the Church Board was prepared to provide the required parking~and 2) the suggestion to reduce the required number of parking spaces by six (6) and instead provide more landscaping rather than more concrete was submitted by the Church Youth Group. Commissioner Metcalf explained that the ~i~"t'Of the entire matter is that by allowing the revised parking-layou~ six (6) parking spaces will be sacrificed and a green-area Will be gained. Commissioner Kraus stated, he felt, the plan had merit but he would like to see the church members park off the street. Planning Commission Minute~ - 28 June 1971 - Continued IV. A. A-325 - Continued The Assistant Planner stated tha~ a recommendation can be submitted to the City Council to have the Curb area in the street (now used. for parking) painted red; thereby, restricting parking in the street. Commissioner Marshall explained Chat 1) the church has a unique situation in that they have a high-school parking lot right across the street that can be used on SUndays and 2) it seems reasonable to s~bstitute a green-area instead of more asphalt. The Secretary explained that theznumber of actual seats in the church is open to interpretation because it is qu"~fion"~'l~how many persons ~can actuariy be seate~'~ a pew.. The Assistant Planner explained that the applicant has had a bond posted for about six (6) years for the required parking and now the church would like to go ahead with the parking plan;hhowever, they wish to modify the 'original plan. Chairman Lively stated that the applicant would be granted an automatic variance by changing the number Of required parking spaces from one hundred thirty nine (139) to one!hundred thirty three (133). Commissioner Smith Stated that the only place in the ordinance where an automatic variance is allowed is'in a "P-C" (Planned Community Develop- ment); however, the applicant could make a formal request for a variance to allow only one hundred thirty three (133) parking spaces in lieu 0f the required one hundred thirty ~ine (137). Chairman Lively requested the SeCretary to check the original plans submitted by the church to determine the actual seating-capacity and exactly how many parking spaces are required in accordance with that plan. Commissioner Martin stated that the revised plan could be approved if a condition were added to the Staff Report stating that additional parking could be provided in the future.: Commissioner Kraus stated that t~e Variance Committee could meet with the applicant on Saturday morning, 3:July 1971 if the applicant should decide to apply for a variance in connedtion with the subject parking spaces. Chairman Lively directed A-325 continued to the next regular meeting in order to allow time to determine the seating-capacity of the church and referred the matter to the DesigB Review Committee. The matter was, also, referred to the Variance Committee if it is decided a variance is necessary. B. A-360 - Grace United Methodist C~urch, Prospect Road - Final Design Review - Fellowship Hall Commissioner Metcalf read the Staff Report dated 28 June 1971 recommendin~ that Final Design Approval be granted for the fellowship hall for the Grace United Methodist Church. Commissioner Metcalf explained t~at 1) the only landscaping that will be done is in the actual constructi6n area and 2) the proposed traffic-plan was submitted to the Public Works' Department and approved by them. (Exhibit "F") Commissioner Metcalf moved, seconded by Commissioner Marshall, that the Staff Report dated 28 .June 1971 be adopted, as amended, and that Final Design Approval be granted for the fellowship-hall as shown on Exhibits "B" through "F" in file A-360 and subject to the conditions stated in said report; motion carried ~i.th~Eommissioner Martin abstaining. C. A-373 - A1F. Dumas, Inc., Prospect Road - Preliminary Design Review - Planned Community Development - Continued from 14 June 1971 Commissioner Metcalf explained that the Staff Report dated 28 June 1971 had been read earlier in the meeting at the time C-13'7 (Alfred F. Dumas) was considered. The said report. recommends that Final Design Approval be granted for the subject planned community development. Commissioner Metcalf moved, seconded by Commissioner Martin, that the Staff Report dated 28 June 1971 be adopted and that Final Design Approval be granted for the planned community development as shown on Exhibits "B" and "C" in file A-373 and subject to the conditions stated in said report; motion carried with Chairman Lively voting"'~"~-- D. SS-68 - Highland Development Company, Prospect Road - Final Design Review - Temporary Subdivision Sign Commissioner Metcalf read the Staff Report dated 28 June 1971 recommending that Final Design Approval be granted for SS-68. He then recommended that condition (b) of the subject report be amended to read as follows: (b) "Sign not to exceed eight (8) feet in overall height with one (1) foot pilings. Commissioner Metcalf moved, seconded by Commissioner Marshall, that the Staff Report dated 28 June 1971 be adopted, as amended, and that Final Design Approval be granted for the temporary subdivision sign as ~hown on Exhibit~"A" and '!B" and subject to the conditions stated in said report; motion carried unanimously. V. CITY COUNCIL REPORT Commissioner Smith gave a summary of items reviewed and action taken at the City Council meeting of 16 June 1971, with emphasis on items of particular interest t~ the C~mmission. VI. PLANNING-POLICY COMMITTEE REPORT COmmissioner Kraus stated that 1) he attended the 24 June 1971PPC meeting 2) an Airport Land ~Use Commission will be appointed - the first meeting tobcbe held 12 August 1971 3) the CommisSion'~ill look into. the whole airport situation in the Santa Clara Valley 4) the proposed revised budget for ALUC was approved 5)'~.~%Councilman Jerry Smith presented the report of the Santa Cruz Mountain Study and 6) Councilman Smith is now Chairman of PPC and Lee Lynch is Vice-Chairman. VII. OLD BUSINESS ~ A. Malachy J. Moran, Saratoga Avenue.- Request for General Plan Adjustment - Continued from 14 June 1971 Commissioner Metcalf explained that the General Plan Committee must postpone their recommendation on the subject request until such time as the Staff has completed a study on all border-line zoning-areas as requested at the Joint Council and Planning Commission meeting of 27 May 1971. Moran - Continued The Secretary explained that th~ Staff has raady a lengthy preliminary report and maps in connection with these border areas; which, report includes a three (3) page summary of the Moran property. The Secretary ~stated that Since the report is~rather lengthy and complex the matter could be continued to allow tim~ for review of same. Chairman Lively referred the matter to the General Plan Committee and requested that..~hey prepare a recommendation to the City council relative to the Moran request. Commissioner Metcalf, Chairman of the General Plan Committee, arranged with the General Plan Committee to meet on Saturday, 3 July 1971, at 9:30 A.M~ to discuss the subject request. B. SDR-895 - S. B. Walton, Saratog~ Hills Road - Request for Reconsideration of Building Site Approval Condition - Continued from 14 June 1971 The Secretary stated that the applicant did meet with the Subdivision Committee and requests that the ~matter be continued to allow him=~'. additional time to gather further informatfon. C~airman Lively directed the matter continued to the next regular meeting. C. Aesthetic Gradin~ Standards The Secretary stated that 1) thze aesthetic grading standards were created (along with the slope density formula)7~to protect the hillsides 2) a copy of the standards have been placed in each Commissioner's i~dividual folder 3) many of thze figures in the standards are require- ments of the Fire Department andz4) the Staff Report dated 28 June 1971 recommends that the Planning Commission approve the standards and incorporate them into Section 10.3 of SubdiVision Ordinance NS-5. Commissioner Kraus stated that he would like additional time to review the subject aesthetic standards. Chairman Lively suggested that the Commissioners study their copies of the aesthetic grading standards and directed the matter continued to the meeting of 12 July 1971 and referred the matter to the Subdivision Committee. D. Sanitary Sewer Policy Commissioner Smith read the Subdxvision Committee Report dated 28 June 1971 stating that the Committee ~oncurs with the Staff Report of 14'!v~t~tne 1971 relative to a policy requiring sanitary sewers for new subdivisions of five (5) lots or more. Commissioner Smith moved, seconded by Commissioner Kraus, to adopt the Subdivision Committee Report dated 28 June 1971 and the Staff Report dated 14 June 1971 relative to a%policy requiring sanitary sewers for new subdivisions of five (5) or more lots and forward same to the City Council for its consideration; motion carried unanimously. VIII. NEW BUSINESS Balkan Festival - Villa Montalvo The Assistant Planner stated that a request has ~een received for permission to place a large banner between the. two (2) stone posts which mark the original entrance to MontalVo onj~Montalvo Road to advertise a Balkan Festival on 30, and 31 July and 1 August.1971. Balkan Festival - Continued Commissioner Metcalf stated he would abstain from any discussion relative to this matter since his wife is C~-Chairman of the Festival and he is on the Board of Trustees for Montalvo~ C~airman Lively, after a brief discussion, referred the matter to the .Staff for their administration. Galeb) that the Planning Commission would give~ some consideration to requiring Mr. Galeb to clean up his properties in the Azule area and 2) the Code Enforcement Officer could~ take a look at the properties and if he finds any violations of the Zoning Ordinance or sanitation standards he could submit a written report to the Planning Commission for review at the meeting of 12 July 1971 or as soon as possible. The Secretary explained that the Planning Commission could state~;. they will proceed no further with the Change of Zoning until the area is cleared of all debris. Chairman Lively encouraged each 'Commissioner to make an on-site inspection of the area and bripg their comments to the next regular meeting. He, also, referred the matter to the Code Enforcement Officer for reviewsand a written report.
