MINUTES
TIME: MONDAY, JULY 26, 1971, 7:30 P.M.

TYPE: REGULAR MEETING
I. ROUTINE ORGANIZATION ..
The meeting was called to order by Vice-Chairman Smith at 7:30 P.M.
A. ROLL CALL
Present: Commissioners Kraus, Fagan, Marshall, Martin, Metcalf and Smith.
Absent: Chairman Lively.
B. MINUTES
Commissioner Kraus moved, seconded by Commissioner Fagan to approve the
minutes of July 12, 1971 and that the reading be waived. Motion carried
unanimously.
II. PUBLIC HEARINGS
A. C-139 - Malachy J. Moran, Saratoga Avenue - Request for Change of Zoning
from '~-1-20,000" (~ingle;Family Residential) to '~-1-15,000"
(Single-Family Residential) - Continued from 12 July 1971
Without objection, continued to September 13, 1971 at the request of the
applicant.
B. UP-203 - Highland Development Company, Prospect Road - Request for Use Permit
to Allow a Model Home Sales Office
Public Hearing opened.at 7:35 P.M~
The Secretary reported that the notices were mailed. The applicant requests
a Use Permit to allow a model home sales office at the Wildwood of Saratoga
Subdivision. The home is being built currently by Bob Mathot's Company.
and has not yet been completed. There are no communications on file.'
Commissioner Kraus moved, seconded by Commissioner Fagan to close the
Public Hearing at 7:40 P.M. Motion carried unanimously.
Commissioner Kraus moved, seconded by Commissioner Fagan that the staff report
dated 26 July 1971 relative to UPs203 for Highland Development Company be
approved, subject to the conditions set forth in subject report; motion
carried unanimously.
III. BUILDING SITES & SUBDIVISIONS
A. SDR-907 - Donald Comer, Pierce Road - Building Site Approval - 4 Lots -
Continued from 12 July !971
The Secretary reported that the applicant is familiar with the conditions.
This has had approval previously and is involved with four lots on the
access road which goes westerly from Pierce Road. These lots did meet slope
density standards. The average grade is 14%. The lots vary in grade
from 12.8% to 18.9%, They have provided the necessary square footage for each.'].L..
lot based on the grade. Lot B requires a specialized home and they have
so designed it as pole-house construction.
Commissioner Metcalf recommended that the Building Site Committee Report
dated 26 July 1971 be amended by adding the following condition:

"T. Submit a report from a qualified soils engineer."
Commissioner Kraus moved, seconded by Commissioner Fagan, that the Building
Site Commit. tee Report dated 26 July 1971 relative to SDR-907 be adopted, as.
amended, and that the tentative map (Exhibit "A~, filed 28 May 1971) be
approved subject to the conditions set forth in.said report; motion carried
unanimously.
B. SDR-914 - Gill SchaDer, Hilltop Way - Buildin~ Site Approval - 1 Lot
Mr. Schaper stated that he was in receipt of the Building Site Committee report
dated 26 July 1971. He asked for a change in Conditions C and I,.and presented
a iet~r. and supporting documents. '
The Secretary reported that it was zthe feeling of the Public Works Depart-
ment that the '~oad should be resurfaced with oil and screening. Mr. Walker
suggested that Mr. Schaper accept the approval and at the same time submit
this letter as a request for exception and the staff could investigate these
conditions further with the Public.Works Department.
Commissioner Kraus moved, seconded '.by Commissioner Fagan, that the Building
Site Committee Report dated 26 July 1971 relative to SDR-914 be adopted and
that the tentative map (Exhibit "A'.', filed 2 July 1971) be approved subject
to the conditions set forth in said report: m~tion carried unanimously.
C. SDR-915 - Dan Urbanik, SDrinEer Avenue - Buildir~ Site Approval - 1 Lot
The Secretary reported that this was a remodelling of over 507. ]' of an existing
home which fronts on Springer and backs up on Paula Avenue. The applicant is
aware of the requirements and they .have already paid some of the fees necessary
for final site approval.
Commissioner Kraus recommended that the Building Site Committee report
dated 26 July 1971 be amended by adding the following condition:
"J. Condition of elm tree to ~be checked by the Planning Department
before removal."
Commissioner Kraus moved, seconded by.CommisSioner Fagan, that the Building
Site Committee Report dated 26 July 1971 relative to SDR-915 be adopted, as
amended, and that the tentative map (Exhibit "A", filed 16 July 1971) be
approved subject to the conditions .set forth in.the report; .motion carried
unanimously.
IV. DESIGN REVIEW
A. A~379 - Landscape Design and Associates, Inc. Quito Road - Final Design
Review - Identification Signs - Continued from 12 July 1971
Commissioner Metcalf moved, seconded by Commissioner Marshall, that the Staff
Report dated 26 July 1971 be adopted and that Final Design .Approval be granted
for identification signs at the Family Food Center on Quito Road, and
subject to the conditions set forth in said report; motion carried unanimously.
B. A-380 - Saratoga Music and Fine Art's Center, Cox Avenue - Final Design
Review - Identification Signs
Commissioner Metcalf ~oved, seconded by Commissioner Marshall, that the Staff
Report dated 26 July 1971 be adopted and that Final Design Approval be
granted three small identification .signs to advertise the music-and fine-
arts business located in the old Westhope Church building, and subject to the
conditions set forth in said report.; mot'ion carried unanimously.

V. CITY COUNCIL REPORT
CommissionerMetcalf gave a summary of items reviewed and action taken at
the City Council meeting on July 21, 1971 with emphasis 6n matters of
particular interest to the CommisSion.:

VII. NEW BUSINESS
Without objection, the matters which have been referred back to the Planning
Commission in connection with the General Plan Review, were referred to the
General Plan Committee for report at the next meeting of the Planning Commission.
VIII. COMMUNICATIONS

B. ORAL·
1. Commissioner Kraus wondered whether a permit had been issued to cut
down the oak tree in the back of Cereal City, the health food store
on Big Basin Way.
The Chairman requested the Planning Director to investigate this matter
and report at the next meeting of the Planning CommisSion.
IX. ADJOURNMENT
Commissioner Smith acknowledged with pleasure the presence of Councilman and
Mrs. Dwyer, and Doroth~ Parker and Noel Bro.wn.of the Good Government Greup.
The meeting was adjourned at 8:17 P.M.
