I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Lively at 7:30 P.M.
A. ROLL CALL
Present: Commissioners Marshall, ~acon, Lively, Metcalf, Smith, M~rtin
and Belanger.
Absent: None.
B. MINUTES
Commissioner Belanger referred to Page 9, Paragraph C, Section 3, and said
that it should read: "that houses along Saratoga Avenue be required to face
Saratoga-Avenue, thereby eliminatihg the usual fences."
Commissioner Marshall referred to ~age l~, noting Time of Adjournment should
be added.
Commissioner Smith moved that readlng of the Minutes be waived and approved
as corrected. The motion was seconded by Commissioner Bacon; carried
unanimously.'
II. PUBLIC HEARINGS
A. General Plan Review - 1972 Yesrl~ RevieW
Commissioner Metcalf reported that~ the General Plan Committee met last Tuesday
and has another meeting scheduled for Wednesday, July 12, in order to consider
a complete preliminary draft, and following that meeting, he felt there would
be a report ready at the next Planning Commission meeting.
The Secretary told the Commission that on the Open Space Element required for
all Cities and Counties to adopt by July 1, 1972, the deadline to submit and
adopt an interim Open Space Element has been set at August 31, 1972, and
the deadline for adoption of the permanent Open Space Element moved to July 31,
1973. Chairman Lively directed that the Public Hearing on the General Plan
Review be continued until the next regular meeting.
B. UP-21~ - Challenger Pre-School, Saratoga Avenue - Request for Use Permit to

Chairman Lively reopened the heari.zng relative to UP-214 at 7:39 P.M. Applicant
.~w a s present. The Secretary reported that a Use Permit is required ,. similar to
that required for adjacent proper~y on Cox Avenue. There were no coEents.
Commissioner Smith moved that the Public Hearing be closed. Public Hearing
closed at 7:~2 P.M. Commissioner Smith moved that the Staff Report on Use

Permit 214 be approved and that the subject Use Permit be granted, subject to
the conditions contained therein; ~econded by Commissioner Bacon; motion
carried unanimously.
C. V-B81 - Malachy J. Moran, Saratoga Avenue - Request for Variance to Allow
Lot Size and Width Reduction - Continued from 26 June 1972.
The Secretary reported that Mr. Moran requested this matter be continued, due
'to forthcoming surgery he has to undergo. The Chairman directed that this
be continued until the next regular meeting.
D. V-382 - Richard A. Staffiery, 'Vilew Oak Drive - Request for Variance to
Allow Decrease in Side Yard Setback for Second Story Addition
Chairman Lively opened the hearing relative to V-382 at 7:44 P.M.
The Secretary said that applicant is requesting a variance to allow a lO-foot
Side Yard Setback in lieu of the required 13-foot side yard setback for a
Second Story Addition, and that there are no communications on file concern-
ing this matter. Applicant said that his reason in requesting this is for
aesthetic appearance. He said that he had owned the property for five years
in Pride's Crossing Estates. The~Secretary said this is an extension of the
old Blue Hills Subdivision. . ...........................................................................

are other two-story houses in that in~Aediate area, and was told there are
two across the street and a couple in back. The Chairman closed the hearing
for the evening at 7:51 P.M., directed that V-382 be continued to the next
regular meeting, and referred same to the Variance Committee for study and
report at that time.
E. C-157 - Frank Shephard, DoubiasS Lane - Request for Change of Zoning from
"R-1-40,O00" (Single Family Residential) to "R-1-40,O00" P.C.
(Single Family Residential -.Planned Community) - Continued from
26 June 1972.
Chairman Lively reopened the Public Hearing at 7:52 P.M.
The Secretary advised that Mr. Henderson was present representing the Appli-
cant. ! The Secretary read the Staff
Report of 7 July 1972.
Commissioner Belanger wanted to know the relation, if 'any, of Paragraph l)
and Paragraph 4). The Secretary explained that the reason for Paragraph 4)
is so that the Commission can ha~e modifications made if it felt them to be
desirable. :

Commissioner Metcalf questioned the labeling of the Plans as "Tentative p
and referred to as "Final Site D~velopment Plan in the report. The Secretary
explained that this was the Engineer's label, not necessarily intended to be
used, and said it should be labeled "Site Development Plan." Commissioner
Metcalf asked if the word "Final'~ could be scratched, and the Secretary
said that it could and wouldn't Change the conditions. The Public Hearing
was closed at 8:00 P.M. ~
Commissioner Smith moved that the Staff Report dated 7 July 197~-be approved,
and that Request for Change of Zoning from "A" to "P.C." be .~nt~e~~ since
the findings of 18.6 and 18.11 of the Zoning Ordinance NS-B ~an~'be met, subject
to the conditioning in the StaffnReport. The motion was seconded by Commis-
· sioner Bacon; motion carried unanimously.

III. BUILDING SITES AND SUBDIVISIONS
A. SDR-963 - James J. Asher, Kittridge Road - Building Site Approval - 1 Lot -
Continued from 26.June 1972.
Commissioner Smith pointed out that this matter has been in dispute with the
Health Department for some time, and that it expires before the next meeting,
so he moved the Building Site ApprOval for SDR-963 be denied without preju-
dice, which wDuld allow the applicant to reapply as soon as he gets clearance
from the Health Department. The motion was seconded by Commissioner Bacon;
carried unanimously.
B. SD-~-973 - Frank Shephard, Douglass Lane - Building Site Approval - ~ Lots -
Continued from 26 June 1972.
Chairman Lively asked how grading is ~oing to be controlled on this develop-
ment, and the Secretary said that it is a subdivision and they have to pro-
'vide. a grading plan; then the Public Works and Building Departments will
review.it, and if desired, the Planning Commission, too. The Chairman said
that the Commission would like to have a look at the grading plans.
Qommissioner Bacon wanted to know about the cuts and fills, and the Secretary
'%aid that under Paragraph 14 of the Subdivision Committee Report, dated
10 July 1972, this would be set out fully.
Commissioner Smith asked about limiting fencing and the Secretary referred
him'.zto Paragraph 9 of the Conditions set forth in the aforementioned Report.
Commissioner Smith moved that the Subdivision Committee Report dated 10 July
i972, with re~ard to SD-9_7-3~be adopted and that the Tentative Map, Ex. "A-2"
filed 10 July '1972 be .~urove.~, s~ject to the Conditions set forth in said
Report. The motion was ~ec'~ed by Commissioner Bacon; carried unanimously.
C. SD-974 - Saratoga Foothills Dev. Corp., Sevilla Lane - Subdivision Approval - 6 Lots - Continued from 26 June 1972.
When'asked for a plat showing what: trees would be removed, the Applicant,
Mr. Bernie Turgeon, said that only fruit trees will be removed. In order to
preserve trees, he said, they had 'left the old house in the original location. No
trees will be removed except orchard trees, unless approved by the Planning Director.
Commissioner Smith moved that the Subdivision Committee Report, dated 10 July
1972, with regard to SD-97~,o-~or~6. Lots, be accepted, and that the Tentative
Map filed 1~ June 1972 be~pproved, subject to Conditions 1 through 7; 8 revised,
9, and Condition 10, a ne~l'~e'~.'The motion was seconded by Commissioner
Bacon; carried unanimously. ;
D. SD-976 - M~i de Selle, Vickery Avenue - Building Site Approval - 1 Lot -
Continued from 26 June 1972.
In this matter, Commissioner Smith said that our main interest is. in the road-
way -- to see that it complies wit~ the requirements of the Fire Department --
and saving of trees.
Chairman Lively directed that this2 matter be.continued until the next regular
meeting, with special emphasis on 2saving trees, and directed the Secretary
to arrange for an appointment between the Applicant and his Architect to go
over the matter with the Subdivision Committee and Staff.

E. SDRo977 - Robert Pulver, Bountiful !Acres - Building Site Approval - 3 Lots -
Continued from 26 June 1~72.
The Secretary stated that the Applicant is familiar with the Conditions and
has no objections.
Commissioner Smith moved that the ~Building Committee Report dated lO July
1972, re SDR-977, Bountiful Acres !be adopted, and the Tentative Map filed
9. DJune 1972 be approved~,-subject to the Conditions in said Report. The
motion was secon~'by Commissioner Bacon; carried unanimously.
F. SD-733 - (Tract 4477) - Stoneson Construction Corp., Big Basin Way - Revised
Map submitted to Sho~ Resubdivision of Lots i through l0 and 23
through 28.
The Applicant was represented by McKay and Somps, Engineers.
.Commissioner Smith moved that the Subdivision Report dated l0 July 1972 be
adopted on SD-733, and that'the Tentative Map, Exhibit A-5, filed 30 June
1972, bec~.~P%~d, subject to Conditions i through 9 of the Report; seconded
by Commissioner Bacon; motion carTied unanimously.
G. SD-959 - Stoneson Construction Co~p., Big Basin Way - Revision in Tentative
The Chairman directed that this m~tter be continued to the next regular meeting
for further study.
IV. DESIGN REVIEW
A. A-391 - George W. Day, Fruitvale and Douglass Lane - Final Design Review -
Two Residences.
The Secretary presented the Staff Report on this matter and Commissioner Bacon
remarked that some of the stucco outside the Master Bedroom wing had been' eliminate,
and suggested that Condition a) b~ changed to read: "Provide wood siding
on exterior walls of both houses ~hroughout."
Commissioner Metcalf moved for adoption of the Staff Report on A-391, and
'that Final Design Approval be granted on Lots 11 and 13,with the following
Conditions: a) as amended; b) as stated in the report, and c) as stated in
the report.
Commissioner Bacon seconded the mOtion;.motion carried unanimously.
B. A-396 - West Valley College,Frui;tvale Avenue - Final Design Review -
Warehouse and Maintenance Buildings - Continued from 26 June 1972.
The Secretary read a letter dated ~7 July 1972 from Walter Muir, 14156 Short
Hill Court, Saratoga, also one from Ernest T. Barco, Jr. 18873 Dundee, re
the.proposed location of the warehouse and maintenance buildings on West
Valley College campus· Each of t~em stated the buildings could easily be
located elsewhere -- where they would no~ oe 'eyesores.' Commen~s from the
audience concurred that the location would be best "over behind the ridge"
towards the rear of the campus.
Commissioner Marshall felt that the matter should be referred back to the
architect. Commissioner Bacon said that the problems in changing the design
would not be too great. The Chairman said that there should be another look
taken of it -- that it might well make more sense to move the location than
to leave it where it is.

Mr. Erickson, the Architect, said it was designed to save three large oak
trees which are still there, but i~ it is considered from an ecological
standpoint, we could be in troubleiwith other people. The Chairman agreed
that it would be well to look at other optional sites.
Commissioner Metcalf said that in All fairness to the Design Review Committee
the matter was continued from last!meeting, and now the "monster has inflated."
He thanked M~. Erickson for looking into the matter over the weekend, and
said he felt that the treatment shown in Alternate A was very good.
The Secretary was asked to make arrangements for the Design Review Committee
to take a look at the sites
Mr. Miles McMullen, of Short Hill ~ourt, said that on financing, he was active
in the creation of Foothill College; since then, he moved to Los Angeles and
was engaged in the financing of Canyon Country College at Newhall, where the
area was too small for a regular C~ollege District, so they established a
special district and thecampus has! now been completed and is ready to receive
students this September. He felt 'that State Financing could be prevailed on
for assistance in this case.
Mr. Herbert Wilkinson, of Short Hill Court, Saratoga, expressed appreciation
· ~or the interest the Planning Commission has t~en in this matter, and said
residents of the area are interested in the site and the view the residents
of the areawill have of the College, and are interested in maintaining the
beautiful architecture, and that ~hey will be happy to participate in resolving
the situation.
Chairman Lively continued the matter to the next regular meeting, and referred
it back to the Design Review Committee.
C. A-397 - AVCO Community Developers,= Cox Avenue - Final Design Review - Subdivision Approval.
The Staff Report, dated lO July 1972, was considered and the matter of colors
to be used on exterior walls and trim was discussed. The builder said that
only earth tones would be used, aS submitted. Commissioner Metcalf advised
him that if colors other than those submitted, are to be used, he must first
get approval of the Design Review Committee.
Commissioner Smith moved that the.Staff Report be approved on A-397, and
Design Review approval be granted, subject to the Conditions set forth in
the Staff Report, plus two added Conditions: g) that no two-story homes shall
be built on Lots 16, 17, 18, 19, 20, 22 and 23, and h) that the two-story
homes shall be scattered elsewhere throughout the subdivision. The motion
was seconded by Commissioner Bacon; carried unanimously.
V. CITY COUNCIL REPORT
Commissioner Martin, who attended.the last Council meeting, reported on the
items of interest to the PlanningiCommission, including the matter of
AngelinaArata's request for reconsideration, and John L. Richardson's one
(1) Lot on Quito Road, re street improvements not required, but dedicaiton required
VI. OLD BUSINESS
A. The request by MWM, Inc., for an additional use in P-A Zoning District on the
building located opposite the Post' Office, for the purpose of a Veterinary
Clinic, with no boarding of animals, was considered and the Chairman referred
the matter to the Subdivision Committee and Staff and asked the Secretary
to set it up for a Public Hearing. The Secretary said it would be set for
Public Hearing at the next regular meeting.
B. SDR-gB5 - John Richardson, 1 Lot, ~uito Road - Request for Reconsideration by
Direction of the City CoUncil.
Chairman Lively moved adoption of ~he Building Site Committee Report dated
lO July 1972, with Condition D amended for improvement of the road by elimi-
nating the words "right-of-way" an~ that Conditiona "A" through "0" be adopted.
The motion was seconded by Conunissioner Smith; carried unanimously.
C. SDR-955 - Angelina Arata - i Lot - Maud Avenue - Request' for Reconsideration
by Direction of the City'. Council.
Chairman .~ Smith moved adoption of the Building Site Committee Report dated
lO July 1972, and Tentative ~p, Exhibit "A-B" be approved subject to Condi-
tiona A through K of said Report. 'The motion was secnnded by Commissioner
Bacon; carried unanimously.
D. Retirement Housing Study~ Surve~t Criteria ~nd Standards.
The Secretary stated that the Standards proposed are for the Commission's
information.
Commissioner Metcalf asked about the Average Number of Persons Per Dwelling
Unit (Item III- B) and the Secret.ary said that the County Housing Depart-
ment developed'. those figures -- th,ey are a county-wide average; that it may
vary somewhat in Saratoga because .'of the incomes here.
Chairman Lively referred to Item ~I-F - Age Restrictions. Bernie Turgeon
spoke from the audience and said the report' follows much of their thinking
on the matter, but they are thinkipg in terms of small groups -- not large
enough to justify medical care, a~bulances, and the like, which requires a
large unit to support it. He said that they were striving for a place that
is well kept, for people still abl'e to get around.
Commissioner Belanger said she wou'.ld like to see a comparison of the
difference between retirement hous.ing and apartment houses -- could end up,
she said, that there would be more. apartment houses than retirement houses.
Jerry Lohr said they want to keep it as flexible as possible, and mentioned
the Sequoias in Portola Valley, which is a total care development, as com-
pared to others.
The Chairman directed Staff to compile 'further reports on these standards.
E. Code Enforcement
In answer to the question of whom to contact if the Code' Enforcement Officer
were not on duty and if there was a violation, the Chairman said that the
City Manager should be contacted. The Secretary said that if the City
Manager could not be contacted, he would be glad to do what he could. He
said that the Sheriff's Department. would be the only other agency to contact,
and it would make a report.
Commissioner ~rshall said that si'~nce the Code Officer only works 40 hours a
weeA,' it should be more on week-en~ds, and the Secretary advised that he does
work on Saturdays and 'Sundays and ..nights.
C'ommissioner Belanger wanted to kn.'ow if the house on Kilbride and MilJevich
had a permit to add the Second sto'ry. The Secretary said he felt sure it
did, but would check it out.
