I. ROUTINE ORGANIZATION
A. ROLL CALL
Present:Commissioners Belanger, Lively, Marshall, Martin, Matteoni,
and Smith.
B. MINUTES
Commissioner Smith.moved, seconded by Commissioner MarShall, that the
reading of the minutes of the April 23, 1973 meeting be waived and that
they be approved as distributed to the Commission with the following
changes:

page 3. .under D. SDR-1034. .iast paragraph. .change #3 to read. .
"acceptable grading plans." and the last sentence to read. . ."The matter was

C. CITY COUNCIL REPORT
Commissioner MarShall listed the following items discussed at the City
Council meeting of'Nay 2, 1973 as being of significant interest to the
Planning Commission:

3) Anderson Appeal
4) George Day Appeal
Planning Policy C'onference
Commissioner Marshall stated he did attend the PPC meeting of the Airport
Land Use Commission and explained that he was instrumental in breaking a
tied vote in connection with the request of Dunn Properties for the proposed
construction of a planned development for an industrial park, motel, restaurant,
service station and office complex~
Chairman Lively expressed his appreciation to Commissioner MarshaYi' for
attending the meeting in his place~
D. ELECTION OF VICE-CHAIRMAN

II. PUBLIC HEARINGS
A. V-392 - S. T. Moisenco, Woodbank Way - Request for Variance to Allow
Overhead Utilities in Lieu,of the Required Underground Utilities -
Continued from April 23~ 1973
Chairman Lively reopened the hearing relative to V-392 at 7:45 P.M.
The Secretary read a letter submitted by the applicant's representative
requesting that the subject variance request be withdrawn'.
Commissioner Smith moved, seconded'by Commissioner Marshall, that the
hearing in connection with V-392 be closed?at 7?4~'P'iM.; motion carri~d'~nanimously.
Commissioner Martin moved, seconded by Commissioner Marshall, that the
request for withdrawal by V-392 be.approved; motion carried unanimously.
B. V-393 - Roald Rindal, Paramount Drive - Request for Variance to Allow Reduction in Side Yard Setback Requirements
Chairman Lively opened the hearing relative to V-393 at 7:47 P.M.
The Secretary stated the Notice of 'Hearing was mailed and ~o~.Communications
had been filed in connection with this application.
The applicant was present and'stated that 1) the.request for variance is
based on practical difficulty rather than physical hardship 2) the pool
could be rotated; however, that would require"p~rtial~L. removal of a concrete
parking area and locate the deep end of the pool right next to the house
3) another option would be to put the pool in the front yard and this would
require that existing landscaping be removed and some grading 4) the pro-
pool site is the furtherest away fr'om the three (3) surrounding structures;
whereas, if the setbacks are met the pool site would be located on top of
a hill where it.would be visible to all surrounding residents and 5) he feels
the intent of the ordinance will be served by granting the proposed variance.
Mr. Rindal then read communicationsl~l~d' in favor qf the proposed variance by
the following neighbors:
1) Mr. and. Mrs. Michael Shea of
20660 Rice Court.
2) Mr. and Mrs. Charles Kitz of
13163 Paramount Drive.
3) Mr. and Mrs. Ray Berry of

4) Mr. and; Mrs. William Dunton of
13199 Paramount Drive.
Commissioner Marshall stated that he believed that the subject request for
variance results more from an annoyance to the applicant rather than a hard-
ship.
The applicant explained that this case involves a side yard being located
adjacent to a rear yard and this presents a practical difficulty since in
most cases one rear yard adjoins another rear yard; therefore, he,interpre[Is
this variance request as being totally~'keeping with the Zoning Ordinance.

II. B. V-393 - Continued
Chairman Lively closed the hearing for the evening at 8:04 P.M., directed
V-393 continued to the next regular meeting and referred same to the Variance
-· Committee for study and a report at that time. He, also, requested the appli-
cant toplace stakes~ around the area that would be involved with the variance.
Commissioner Martin, on behalf ofzthe Variance Committee, ·arranged for an
appointmentY~with the applicant for an on-site inspection of the property

C. C-168 - Westbrook Annexation, ProSpect Road - Request for Change of Zoning
from "R-i-40,000'-' (SinglerFamily Residential) to "R-l-10,000"
(Single,Family Residential) - Continued from April 23~ 1973
Chairman Lively reopened the hearing relative to C-168 at 8:05 P.M.
The Secretary read a communication received from Mr. Gary N. Britten,
President of Westbrook Improvement Association requesting that the
Westbrook are~be rezoned toz~R-l-~2,500'~.an~ "R-l-15,000" (Single Family Resiential~
rather than "R-l-10,000" (Single-Family Residential).
Commissioner Marshall noted that if the higher zoning were approved'the
result would be the establishment'of non-conforming lots.
The Secretary agreed that that would be the result along with non-conforming
setbacks in many situations.
Commissioner Smith stated that after reviewing the map for the subject area
he would favor the "R-l-10,000" zoning for the Westbrook area.
The Secretary read the Staff Report recommending that "R-l-10,000" zoning
be established for Tracts 1222 and 1179 in order to bring this area into
zoning conformity with the surrounding ne'ighborhoods in Saratoga.
Commissioner Smith recommended that the last paragraph of the subject report
be deleted.
Chairman Lively noted that the applicant has no real argument against accepting
"R-I-iO,O00", but due-to the varying lot sizes in the subject area does desire
the larger lot zoning.-
The Secretary explained that if the "R-l-15,000" zoning is approved and
the corresponding setbacks are enforced there will be some property owners
who will not be able to meet these setbacks due to the fact that their lots
are under the 15,000-square feet in size.
Commissioner Smith moved, seconded by Commissioner Marshall, to close the
hearing in connection with C-168 at 8:20 P.M.; motion carried unanimously.
Commissioner Smith moved, seconded by Commissioner Marshall, that the Staff·
Report relative to C-168 dated May 14, 1973 be adopted, as amended, and
same be forwarded to the City council as the recommendation of the Planning
Commission and that the subject Change of Zoning (C-168)/request to rezone
!·-~h~We~brook area to "R-l-10,000" be approved; motinn carried unanimously.
D. C-169 - Osterlund Enterprises, Fruitvale Avenue and Allendale Avenues -
Request for Change of Zoning from "R-I-40,000" (Single-Family Resi-
dential) to "R-1-20~000" (Single-Family Residential)
Chairman Lively opened the hearing relative to C-169 at 8:'21 P.M.
The Secretary stated the Notice of Hearing was mailed and published and that
no written communications had bee~ filed in connection with the subjectchang~
of zoning application.
Mr. Lou Tersini was present to represent the applicant but had no comments
to make at this time.

II. D. 'C-169 - Continued
Mr. Dean Gordon Of 20299 Blauer Drive presented ·the Commission with
photos of the subject property showing the numerous trees existing thereon
and stated that he is concerned about what will happen to all these trees
should the property be approved for development. He further stated that
the present zoning of the property ("R~l-40,000) would provide for removal of
all~ fewer '..number of trees than would the requested zoning ("R-I-20,000").
Ms. Sherri Mahon of 19841 Buckhaven Lane stated that her concern, also,
is about the beautiful trees situated on this property and she then read
and submitted a petition·~h"~..~39'signatU'res. Said petition requesting
that the change of zoning not be granted unless it is ·proven to be
absolutely necessary and that if the rezoning is approved every effort
be made to enforce all ordinances applicable to cutting and/or tree removal.
Mr. Ed Basanese of 19313 Athos Place stated ·that he is a resident of the area
and it is zhis, and his neighbo'rs, z sincere hope that every effort be made to
preserve the tree'~ located on the· subject property. Also, two-story homes
should ~not be permitted on this property, because some of the trees will be
removed' if this land is rezoned and if two-story homes are constructed the
skyline will be replaced by houseS.
Commissioner Marshall observed that if the exiSt.!ng zoning remained intact
it appears all the trees could be~preserved, but with the applicant'·s pro-
posed plan some of the trees will definitely have to be removed in order
to build houses. According to the subject plan it appears some of this
property-goes to the center of Allendale Avenue and so belongs to the City
of Saratoga. ~
The Secretary explained that the plan is correct and that the portion of the
property that goes to the center line of Allendale Avenue would have to be
dedicated to the City.
Mr. Dan Trinidad, Assistant Director of Public Works, stated that he suspects
that the portion of property in qdestion has alre~.dy been dedicated to the
City by the current property owner.
The Secretary explained that the northern portion of this property is actually
zoned-'~ "R-I-20,000" and the southern portion is zoned "R~l-40,000"; however,
on th~ General Plan the entire property is shown as ~one-half_.·_§~.re sites.
Chairman Lively requested the Sec'.retary tO.-.determine when and why the General
Plan was changed to show one-half acre sites for. the subject property.
The Secretary~ in answer to an inquiry from Commissioner Matteoni, stated that
any trees proposed for removal by~ the applicant will have to be shown on the
tentative map, which is subject tO review by the Planning Commission.
Chairman Lively closed the. hearing .rfS~"~he evening at 8:39 LP.M., directed
C-169 continued to the next regular meeting ·and 'referred same to the Sub-
division Committee for further review.
E. UP-224 - Saratoga Tennis Club, ~Komina A~,enue - Request for Use Permit to
Allow Expansion of Tenn~:s Club"- Continued from April 9~ 1973
Chairman Lively reopened the hearing relative to UP-224 at 8:40 P.M.
Mr. Warren Held, architect, present to represent the applicant, stated
that at· the time this matter was last befdre the Planning Commission a
request was made to have the tennis club members meet and review the
overall program.~ A meeting of the membership did take place and a new
Board was elected and new Committees appointed;-therefore, due to these
changes it is requested that UP-224 be continued to an uncertain date
and that the neighbors be renotified at the time the necessary information
is available and the hearing for ·UP-224 is reopened.

Chairman Lively stated that under the circumstances it might be
best to deny .(without prejudice) ~he subjec~·,Use Permit; thereby,
giving the applicant the option to reopen' the hearing relative to
this matter at a later date.
Mr. Tom Tisch of 14735 Aloha Avenue stated 1) he and other residents
of the area are opposed to the subject Use Permit 2) he would suggest
that the Planning Commission continue-Lthe matter for a peri'od of six
· (6) months 3) the tennis club representatives should meet with the
neighbors and discuss the proposed Use Permit - this would be very
appropriate and help expedite mattea considerably.
Commissioner Smith moved, seconded by Commissioner Marshall, to close
the hearing relative to UP-224 at 8:45 P.M.; motion carried unanimously.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
subject application for UP-224 to allow expansion of the tennis club
be denied without prejudice; motiSn carried unanimously.
III. BUILDING SITES AND SUBDIVISIONS
A. SD-1024 - George W. Day Construction Co., Fruitvale Avenue - Revised ~
Tentative Map - 14 Lots
Mr. Rick Augrisani, engineer present to represent the applicant, stated
that the tentative map was revised to comply with ·suggestion made by the
Subdivision Committee.
Conmissioner Marshall explained that the revised map allows for more
open-space than was originally proposed.
Chairman Lively stated that some open-space has been provided, but the
size of the lots appears to be smaller in some cases.
Commissioner Smith explained that'some of the additional open-space was
formerly to be used for street construction.
The Secretary stated that it is a fact that all the lots were reduced
in area to allow for more open-sp~ce.
Chairman Lively pointed out that the lot sizes were reduced, but the
actual number of lots was not reduced.
Mr. Lou Leto, applicant's representative, explained that it is economically
unfeasible for the developer to reduce the number of lots.
Commissioner Smith recommended that condition #21 be deleted from the Staff
Report dated May 14, 1973 relative to SD-1024.
Chairman Lively stated that· in his opinion the number of lots should be
reduced to thirteen (13) since the lot sizes are too small. By reducing
the number of lots the square footage of the remaining lots could be
increased.
Commissioner Smith pointed out that all the lots meet the requirements
of the "P-C" ordinance. ~
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973 relative to SD-1024 be adopted,..-a~ amended,
and that the revised tentative map (Exhibit "A-3", filed May 12, 1973) be
approved subject to the conditions set forth in said report; motion carried

III. Bo SDR-1033 - E. T. Barco, Jr., Aliendale Avenue - Building Site Approval -
4 Lots - Continued from April 23~ 1973
Commissioner Smith explained that the problem relative to the access
road for this development has been resolved and the tentative map has
been altered to reflect same. The Assistant Director of Public Works
has prepared a set of conSlu~iomwhich tie into the Staff Report dated
'May 14, 19~3 relative to SDR-1033. It was, also, determined that a second easement is not required~
Chairman Lively noted that there are some fine oak trees on this property
and he recomme~ids that condition II-B of the Staff Report be amended to
read as follows:
"B. Tree removal is proh'ibited unless approved by the
Planning Director."
The applicant was present and stated he had reviewed the proposed
conditions of approval as stated in the Staff Report and expressed
satisfaction with same.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973 relative to SDR-1033 be adopted, as
amended, and that the tentative map (Exhibit "A-i", filed May 14, 1973)
be approved subject to the'conditions set forth in said report; motion
carried unanimously.
C. SDR-1034 - John M. Kirkpatrick,.Pierce Road - Building Site Approval -
1 Lot - Continued.from April 23~ 1973
The Secretary stated that the significant thing about this site is that
extensive grading would be required in order to realize a suitable building
pad; therefore, the applicant chose instead to build a pole house. As a
result of that decision no grading is shown for this lot at this time.
The Secretary, in answer to an inquiry from Commissioner Marshall, explained
that it would be practical for [he Planning Commission to require Design
Review Approval for this site since a pole house is proposed for this hill-
side lot.
Commissioner Marshall recommended that the Staff Report dated May 14, 1973
relative to SDR-1034 be amended by adding the following condition II-S:
"S. Design Review Approval required."
The applicant was present and stated he had reviewed the proposed conditions
of approval and expressed satisfaction with all but two (2) of them (II-G
and II-H) because of undue hardship and impracticality.
Chairman Lively explained that the applicant could request reconsideration
of these conditions at a later date.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973 relative to SDR-1034 be adopted, as
amended, and that the tentative map (Exhibit "A-i" filed April 30, 1973)
be approved subject to the conditions set forth in said report; motion
carried unanimously.
D. SDR-1037 - R. J. Hunter Developments, Ltd., Comer Drive - Building Site
Approval - 4 Lots - dontinued from April 23~ 1973
The Secretary explained that SDR-1037 should be continued to the next
regular meeting to allow time for further study.

III. E. SDR-1038 - Emil Kissel, Lutheria Way - Building Site Approval - 1 Lot -
Continued from April 23, 1973
Commissioner Smith explained that this matter was continued in order'
to allow the Assistant Director. of Public Works time to do a study
in connection with Lutheria Way' and a report relative to the matter
has been prepared to be considered along with the Staff Report in
connection with SDR-1038.
The applicant was present and stated he had reviewed the proposed
conditions of approval and expressed satisfaction with same.
Conmmissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973. relative to SDR-1038 be adopted and
that the tentative map (Exhibit"'A", filed April 13, 1973) be approved
subject to the conditions set forth in said report; motion carried unani-
mously.
F. SDR-1041 - Sherrel Kirk~ Pierce Road - Building Site Approval - 1 Lot
The applicant was present and stated he had reviewed the proposed
conditions of. approval and expressed satisfaction with same.
.Commissioner Smith moved, seconded by'Commissioner Marshall, that the
Staff Report dated May 14, 1973~ relative to SDR-1041 be adopted and
that the tentative map (Exhibit "A-I", filed May 14, 1973) be approved
subject to the conditions set forth in said report; motion carried
unanimously.
G. SDR-1042 - Congregation Beth DaVid Synagogue, Prospect and Scully Avenues
Buildins Site Approval - 1 Lot
Commissioner Martin reviewed the Staff Report relative to SDR-1042 and
noted that a recommendation should be made saying that "No Parking" will
be allowed along Scully since parking along there will congest the area.
Commissioner Smith explained that the synagogue will be using this parking
on Saturday only, but the recommendation for "No Parking" can be forwarded
to the City Council since it will have to be a Council decision.
Mr. Cohn, Board of Directors of[Beth David, stated that after a lengthy
discussion it was agreed that the bushess.and trees would remain at the
Scully Avenue entrance and the planting would be designed to discourage
any access from Scully.
Mr. Trinidad explained that the Public Works Department did not recommend
that "No Parking" be enforced on Scully Avenue; however, they would not'
object to elimination of this parking.
Commissioner Matteoni recommended that the matter be taken .up. und~r'?~ ....
Design Review and by the Department of Public Works prior to forwarding a
recommendation for "No Parking". along Scully to the City Council.
Chairman Lively agreed that a recommendation regarding "No Parking" along
Scully Avenue can be made under Design Reivew ~ppearing t~ter'.on?the~agenda.

The applicant's representative was present and stated he had reviewed
the proposed conditions of approval and expressed satisfaction with same.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973zrelative to SDR-1042 be ~dopted and that
the tentative map (Exhibit "A",:filed May 1, 1973) be approved subject
.. to the conditions set forth in said report; motion carried unanimously.

III. H. SDR-1044 - George Ao Lundquist, Peach Hill Road - Building Site Approval - 2 Lots
The Secretary recommended that SDR-1044 be continued to the next regular
meeting to allow further study of same.
Chairman Lively so directed.
I. SDR-1046 - Dr. Julian Henry~ Qu{to Road - Buildin8 Site Approval - 1 Lot
The Secretary explained that this applicant plans to remodel over 50% of
of the building involved; therefore, building site approval is required.
and the applicant is subject to provide or bond for all improvements.
Commissioner Smith explained that when and if the .required.'-s't~eet improve-
ments are put into effect the building in question will be cut in half.
If the West Valley Freeway goes'through the State Highway Department will
have to buy this property.
Mr. Trinidad, in answer to an inquiry from Chairman Lively stated that
the applicant could go into a D~ferred Improvement Agreement with the
City for the road improvements.' He further stated that the City does
not have any plans to widen Quito Road in that area - it was to be.
widened under the County Expressway Program or the West Valley Freeway
construction.
It was the consensus of the Commission that the Staff Report dated May%it4,
1973 relative to SDR-1046 be amended by adding the following condition:
"P. P~oVide maintenance of westerly portion of property
to insure a neat and o~derly appearance."
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated May 14, 1973. relative to SDR-1046 be adopted, as
amended, and that the tentative map (Exhibit "A", filed May 4, 1973)
be approved subject to the conditions set forth in said report; motion
carried unanimously.
IV. DESIGN REVIEW
A. A-391 - George W. Day Construction Co., Fruitvale Avenue and Douglass Lane -
Final DesiSn Review - Lots 1 and 15 of Tract 5150
The Secretary read the Staff Report dated May 14, 1973[relative to Lot'l
of Tract 5150 recommending that'the applicant's client come to'the Planning
Commission to air his request before a final decision is made.
Mr. Lou Leto, representing George DaysConstruction Co., was present and
stated that his client, Mr. Simmons, feels that the noise factor would
not be as great for Lot #1 if his design for the house is used.
Mr. Simmons was present and stated that 1) he would request that the"
Planning Commission allow him to reverse the house on the lot in order
to locate the bedroom wing as far as possible from Fruitvale Avenue
2) he has hired a landscape architect.and intends to provide full
grown trees as part of the landscaping 3) it is his intent to keep
the entertainment section of the house away from the neighbors by
using his revised plan and 4) the plan he proposes. will be Very
desirable and an asset to the n~ighborhood.
Chairman Lively stated that in his opinion the proposed plan is again
a major change from the one approved originally for this lot.
Commissioner Marshall advised that, he felt the developer should point
out to prospective buyers and explain to them that minor deviations "from
the plan will be tolerated, but. major ones will not be approved by the
Planning Commission.

Chairman Lively stated that it is his feeling the Planning Commission
should stick with the original p.lan.
Commissioner Marshall agreed that the original house design for this
18t'.Lshould not be allowed a major change and the. applicant's client
does have the right to appeal the decision of the Planning Commission
to the City Council.
Commissioner Marshall moved, seconded by Commissioner Belanger, that

..for a major alteration to the basic Site Development Plan for Lot 1

A-3.91 - Lot 15 - Tract 5150
The Secretary read the Staff Report dated May 14, 1973 relative to
Lot 15 of Tract 5150 recommending that Final Design Approval be granted
for the house on Lot #15.
Commissioner Belanger recommended that cbnd~tion~-b).-:of the subject
Staff Report be amended to read as follows:
"b) Provide a minimum 40-foot side yard setback from east
property line of ~jot 16. to right side elevation of home."
Commissioner Belanger moved, seconded by CommiSsioner Marshall, that the
Staff Report relative to A-391 (Lot '15 - Tract 5150) dated May 14, 1973
be adopted~'~'d'~hat Final Design. Approval be granted as shown on Exhibit
"Q" subjec~ to the conditions, aS modified, in said report; motion
carried unanimously.
B. A-413 - Hugh Fassett, Big Basin Way and Third Street - Final Design
Review - Remodeling of Interio~ and Exterior of Saratoga Washette
Commissioner Belanger explained that there are many questions which. have
not been resolved in connection With this matter; therefore, the 'DeSign
Review Committee felt it was best to discuss it with the other members
of the Commission.
The Secretary explained that he did discuss this proposal with the City
Attorney. The applicant pt'ans to convert the existing washette into a
do-it-yourself'laundromat-. It would be a contemporary facility and it
would not invol'~e "a cha~ge in the basic use; however, because of T~h'~ nature
of the use it would require a minimum number of parking spaces. 'That
whole complex of buildings has virtually no off-street parking except,
~'a. ps, the use 8f the parking on the Third Street right-of-way. The
a'ppl'icant propose~ five (5) new parking spaces - two (2) on the property and
~n~ther.y., three (3) at the Third Street right-of-way area. If this
meets with the approval of the C6mmission the requirements of the

that a car could not be driven through the area leading to the proposed
parking spaces.

The Secretary agreed it would be difficult if the area were left in
its present state; however, the situation will be improved by eliminating
some articles at the back of the' property.
Commissioner Smith noted that the existing use is legal non-conforming
and if the use is modified or changed the requirements of the ordinance
must be met.
The Secretary explained that the% proposed use of this building would
increase the capacity of the laundry machines by 40%.
Mr. Fassett, applicant, explained that the nature of the business would
reduce the actual people traffic~o~ince with the existing_
facility a customer must make two (2) trips (one to drop the laundry
and another to pick it up). With the new'facility they would bring the
laundry, do same and then take it out.
The Secretary explained that the2 Planning Commission must decide whether
this is a major alteration or not and if they find to the affirmative
it would mean that the entire property and building will be required to
meet the parking and other requirements of the Zoning Ordinance.
Commissioner Smith noted that he did not feel that the proposal involved
a major remodeling, but it is a substantial change in the use.
Commissioner Belanger advised that at this point the applicant does not
really have any parking spaces of his own for this building.
Mr. Fassett explained that in September, 1967 an agreement was made with
the City where the City =@greed tO accept the rear parking on'the
extension of Third Street; therefore, that half of the parking would be
for this property.
Commissioner Belanger explained that there is parking all along Big
Basin Way but that does not exclude other businessmen in the Village
from providing parking for their own individual establishments.
Chairman Lively recommended that. A-413 be continued until such time as
1) a detailed report can be prepared relative to this matter 2) the
legal aspects in connection with the subject request can be cleared up
3) the agreement made with the City regarding Third Street can be
clarified and 4) a?definition of the Zoning Ordinance can be obtained
from the City Attorney.
Co A-415 - Congregation Beth David !Synagogue, Prospect and Scully Avenues -
Final Design Review - New Synagogue
The Secretary read the Staff Report dated May 14, 1973 recommending that
Preliminary Design Approval be granted for A-415.
Chairman Lively noted that the exhibit does not show any type of buffer
for the homes located in the area of the entrance driveway.
Commissioner Martin explained that there is a 6-foot fence there at
present.

Mr. William Hedley, architect for the applicant, stated that 1) there
aretwo (2) homes to the rear of the subject parcel and both have existing
=fences and rather substantial landscaping 2) included in the pilans~,.~is~a
provision for a row of buffer shrubs on the side of these homes 3) Mr.
Hedley presented a model of'the proposed synagogue for review by the
Planning Commission 4) he has never designed a Jewish synagogue before;
therefore, he did request someone to do a second model of a more conventional
nature than the one '~resented to the Commission at this time - the second
model was presented to the Building Committee 'of the Synagogue 5) the
Committee decided the model presented to the Commission this evening was
most appropriate to solve their ~eeds 6) the model presented at this
time depicts an old temple in Jerusalem in the HolyLand 7) the flat
portion of the roof will be crushed stone with rolled edges 8) the
structure will be constructed in. two (2) phases and 9) the color of
the building will be an off-white.
Commissioner Matteoni stated thai his impression of this model is that
it appears it would be an award Winning church. The adjacent 'Church of
Ascension and this proposed synagogue seem to fit together.
Commissioner Belanger explained that she, also, feels this building
is a highly creative design and Something that will be a definite
asset to the community.
Commissioner Marshall noted that a stark white would cause a reflection
and will tend to illuminate the walls~
Mr. Hedley, in answer to an inquiry from Commissioner Smith, stated that
there will not really be very much light reflected from these walls into
the house across the street, because the building will be more of an off-
white color.
Chairman Lively stated that the part that bothers him is how well will
a church of this size, age and blend in with the City itself.
Mr. Hedley explained that he cannot possibly design something that
everybody will like the thing that should be considered is whether
it is or is not a good design. There will be included in the landscaping
a small leaf-clinging-type plant. that will climb up over the building.
Chairman Lively stated that it w{ll be a long time before the planting
will soften the lines of this proposed structure. He does appreciate
the Effort made to design a historic building, on the other hand, this
building is widely different from what has been seen in Saratoga up to
now. It is a massive building with a stark and abrupt look.
Commissioner Martin explained that he can understand the feeling voiced
by Chairman Lively that this structure might not fit in with Saratoga
since it is different from anything 'that-l.has been seen in the City;
however,.the same thing was probably said about the adjacent Church of
Ascension when it was first built. It is his feeling that it is not
fair to label something unacceptable just ~ecause it is different.
Commissioner Matteoni stated that 1) unfortunately the model gives
the impression that the pr0pqsedlsynagogue.will have great impact, but
the~=design does reach back'historically 2) th~ st~rk-~hite color used
on the model will not be the actual color used on the structure 3) 'the
light reflected off the building is an important consideration, but there
will be screening and no glare will be caused according to the architect
4) this structure is complimentary and will blend nicely with the adjacent
church and 5) the proposed s3magogue reflects the heritage of the Jewish
Faith.

Commissioner Matteoni moved, seconded by Commissioner Belanger, that
the Staff Report~'~l~tive to A-415 dated May 14, 1973 be adopted and
the Preliminary Design ApprSval be granted the new synagogue building
as shown on Exhibit "A" subject to the conditions set forth in the
subject report; motion carried unanimously.
PARKING ALONG SCULLY
Mr. Ray Muzzy, Vice-President ofzthe Prides Crossing Homeowner's
Association, stated the Homeowner's Group met with the representatives
of the Church and they have agreed that Scully Avenue should be posted
"No Parking" at the church area.. The remaining residents of Scully
can make similar arrangements if'they so desire.
Chairman Lively explained that the Planning Commission can only recommend
to the. City Council that they issue a directive to restrict parking in the
subject area of Scully.
Commissioner Matteoni moved, seconded by Commissioner Belanger, that the
Planning Commission recommend to the City Council that "No Parking" be
permitted on Scully from the synagogue entrance to the northerly boundary
of the property (Prospect Road).
D. A-416 - Gatehouse Condominium Apartments, Springer Avenue and Fourth
Street - Final DesiSn Review - Temporary Identification Sign
The Secretary read the Staff Report dated May 14, 1973 relative to A-416
recommending Final Design Approval for the temporary identification sign
for the Gatehouse Condominium Apartments.
Chairman Lively recommended that condition a) of the subject report be
d~leted.
Commissioner Belanger moved, seconded by Commissioner Matteoni, that the
Staff Report.dated May.14, 1973 ~elative to A-4!6 be adopted, as amended,
and that Final Design Approval be granted for the temporary identification
sign as shown on Exhibits '~" an~ "B" subject to the conditions set forth
in said report; motion carried unanimously..

VI. MISCELLANEOUS ITEMS
A. SDR-929 -.Gerald Kendall~ Sobey ROad - Request for Extension
The Secretary read a request from'the applicant for a one (1) year extension
for SDR-929.
Commissioner Smith moved, seconded by Commissioner Marshall, that a one
year extension be granted for SDR-929 from the current date of expiration;
motion carried unanimously.
B. Consideration of P.P.C. Monte Bello RidSe Study Alternatives
The Secretary explained that this.matter was placed on the agenda because
the Commission indicated at the last meeting that they would make.a .r~commend-
ation for an alternate plan for the Monte Bello Ridge Area as requested by
the County. Alternative Plan "A'!zlis:-the most conservative as far as develop-
ment is concerned.
Commissioner Marshall moved, seconded by Commissioner Smith, that the
Planning Commission endorse alternative Plan "A" and forward said endorsement
to the City Council as the recommendation of the Planning Commission; motion
carried unanimously.

VI. C. Osterlund Law Suit
The Secretary stated that the information included in the Conunissioner's
folders relative to a suit filed by Osterlund Enterprises, Inc. is for
information purposes only.
· D. General Plan Meeting
The Secretary advised that on Monday, May 21, 1973 there will be a
General Plan meeting to discuss"..the conclusion of the Citizen!~s
Committee Conference as prepared by the Planning Consultant.
E. Pronger Property - Lomita Avenue
The Secretary stated that a request has been received to review the
Pronger building site on Lomita Avenue., The tentative map approved
for this building site i's, not accurate. When the improvement plans
were prepared by another engineer, it was found that the required
improvements would jeopordize the existing house and inv. ol~e:, three
(3) large oak trees. Three (3) alternative plans have been proposed
and he feels everyone will agreez that the trees should be saved. A
revised tentative map should be prepared and the Assistant Director
of Public Works has prepared an alternate design.
Commissioner Marshall moved, sec6nded by Commissioner Smith, that the
street improvements be relocated. in order to save the oak trees as
shown in concept #3 as modified by the Public Works Department; motion
carried unanimously.
F. Trails - West Valley Junior College
The Secretary stated that DelaptaineliMcDaniel has supplied the Planning
Commission with correspondence between the West Valley Junior College
and representatives of the City ~egarding pedestrian/equestrian trails.
Commissioner Matteoni advised that there might be additional information
available relative to this matte~ in the back issues of the Park and
Recreation Commission minutes.
Commissioner Belanger inquired if there is a Master Plan from the
college showing these trails.
The Secretary explained that a proposal was worked up for trails, but
it was not shown on the Master Plan.
Chairman Lively requested someone from the Staff to look through the
Park and Recreation Commission minutes to see if there is any informati:on
relative to trails at the south westerly boundary of the West Valley
Junior College previously discussed and apparently agreed to by Dean
Arnold of the College.
