ROLL CALL Present: Commissioners Belanger, Lively, Marshall, Martin, Matteoni, Smith, and Woodward. B. MINUTES Commissioner Marshall moved, seconded by Commissioner Martin, that the reading of the minutes of the May 29, 1973'meeting be waived and that they be approved as distributed to the Commission with the following change: page 9. .second to the last paragraph. .line 1. .change "Martin" to "Matteoni"; motion carried with Commissioner Smith abstaining. Special Meetin~ - Open Space Element and Conservation Element - Minutes Commissioner Marshall moved, seconded by Commissioner Martin, that the reading .... of the minutes of the Special Meeting of June 4, 1973 be waived and that they be approved as distributed to the Commission; motion carried with Commissioner Smith abstaining. C. CITY COUNCIL REPORT "~Commissioner Matteoni listed the following items discussed at the City Council meeting of june 6, 1973 as.being of significant interest to the Planning Commission: 1) Agreement between Flood Control, City of Saratoga, and the developer for a pathway along Saratoga Creek. 2) Resolution adopted by Council to to prohibit parking on the east side of Scully adjacent to Temple Beth David. 3) Village Parking District 4) Gatehouse Condominium - 18 year age limit for residents. 5)West Valley Junior College Parking Assessment District. 6)Planning Director's report on Urban Development - Urban Service Area. II. PUBLIC HEARINGS A. Open Space and Conservation Elemen[ of Saratoga General Plan - Continued from June 4~ 1973 Chairman Lively reopened the hearing at 7:48 P.M. The Secretary explained that the revisions of the Open Space Element and the Conservation Element have been distributed to the Commission_'for their review. -i- Planning Commission?Minutes - June 11, 1973 - Continued II. A. Open Space - Continued Chairman Lively explained that at. the special meeting these~.matters.~were referred to the Planning Consultant and General Plan Committee for study and revision. The main question {s does the City want to stipulate a a specific set of goals or action plans or would a general brief recommend~ ation for action be more suitable.. Commissioner Marshall explained that 1) the'General Plan Committee did meet with the Planning Consultant on Thursday, June 7, 1973 2) the revisions pro- posed as.an'-outeome ot.'that meeting are stated in the Open Space Element dated June 8, 1973 and 3) these changes meet the requirements of State Law and provide the City with an interim policy that will leave the City some flexibility. ~ Chairman_Lively read the majorsportions of the Open Space Element Draft ...... '~pointing out that'the report had been significantly condensed f~om'the Planning ~onsUlt~nt's original version. Commissioner Matteoni stated that since this matter has been?proposed for studyTin conjunc~i~f~h'the Major General Plan Review; therefore, resulting " in a great deal ~f'work for'the C{ty and for this Commission, a Study Session should be held With the Planning Consultant to discuss the Commissions reactions on an informal basis. For that reason we might indicate that the required action ~p~ogram for the Open Space Element needs further study and that during the General Plan Review that program..". would be further refined. Commissioner Marshall explained that a number of the items listed as goals and proposals are already in effect and Will require little additional work. In addition, a fair amount of the work has been made the responsibility of the Parks and Recreation Commission. The Secretary stated that a permanent Open Space Element will have to be adopted at a later date; therefore, it may not be prudent to spend a great deal of extra time and effort on the red~a.fts. of the preliminary element. Commissioner Smith advised that the work of the Planning Commission for."!the General Plan Review is not limited to the Open Space Element and the Conser- vation Element. These elements d0~.ho.t represent even 10% of the work that will be necessary before completion of the General P~an' ReView. Commissioner Marshall explained .that the legislature has nmnd~t~d that open space be preserved before it.disappears; therefore', it is required that each City adopt a plan for potential open space. Chairman Lively stated that in a way the City is forced to have a very specific action plan and the preliminary draft dated June 8, 1973 appears to meet this requirement ~or the Open Space Element. Conservation Element The Secretary explained that there is available two (2) drafts of the Conservation Element - the most recent draft"exclud~s,~he action policies and is dated June 11, 1973. ~ . Chairman Lively stated that the~eliminary draft of the Co o Element nservatx n dated June 11, 1973 represents'~the recommendations of' [he P~anning Commission and is the one he would recommend.for adoption. Commissioner Matteoni recommended.that a study session be held with the Planning Consultant in order to make sure that the proposed element is consistent with current development and meets the requirements of State Law. Commissioner Smith explained that a Joint Study Session will be held after the General Plan Committee completesits review and recommendations to the Planning Commission. Chairman Lively advised that the Study Session could be expanded to include the City Council, Parks and Recreation Commission, and the Planning Commission. -2- Planning Commission Minutes - JuneTll, 1973 - Continued II. A. Conservation Element - Continued Ms. Meg Monroe, Planning Consultant, was present and stated she had no additional comments to make in' connection with this matter. No one else present wished to speak'On this subject. Commissioner Marshall moved, seconded by Commissioner Smith,~ to close the hearing at 8:22 P.M.; motion carried unanimously. Commissioner Marshall moved, seconded by Commissioner Smith~ that the Open Space Element ~Preliminary D~aft) dated June 8, 1973 be adopted and forwarded to the City Council as t~e recommendation of the Planning Commission; motion carried unanimously. Commissioner Marshall moved, seconded by Commissioner Martin, that the Conservation Element (PreliminaryDraft) dated June 11, 1973 be adopted and forwarded to the City Council as the recommendation of the Planning Commission;~ motion carried unanimously. B. V-394 - Jeanne Dodd, Ten Oak Way - Request' for Variance to Allow. Reduction in Rear Yard Setback Requirements - Continued from May 29~ 1973 Chairman Lively reopened the hearing at 8:29 P.M. The Secretary read the Staff Report dated June 11, 1973 ~ecommending that the Variance request in connection with V-394 be denied. The applicant was not present and-no one in the audience wished to comment. Commissioner Smith moved, seconded by Commissioner Martin, that the hearing relative to V-394 be closed at 8:30 P.M.; motion carried unanimously. Commissioner Martin moved, seconded by Commissioner Matteoni, that the Staff Report dated June 11, 1973 relative to V-394 be adopted and that the Variance ,request %to allow a reduction in rear yard setback requirements be denied; motion carried unanimously. C. V-395 - Ray Wood, Short Hill Court - Request for Variance to Allow Reduction in Side Yard Setback Requirements - Continued from May 29, 1973 Chairman Lively reopened the hearing relative to V-395 at 8:31 P.M. The Secretary read the Staff Report dated June 11, 1973 recommending that the subject Variance request be granted, but for a lessor setback than requested by the applicant. Commissioner Martin explained that 1) .originally the applicant requested only a 10-foot setback 2) the Variance Committee walked over the property and it appeared that when the design of the house was devised the applicant and/or designer did not take into consideration the construction of a pool on the site 3) if the house had been moved up on the lot it would not have been necessary to request a Variance 4) the Variance Committee suggested that the pool be redesigned, but that has not been accomplished 5) the house on the lot is in the process of being built 6) it appears that along the eastern boundary of this property [here has been some fill and is an indication that a horse trail goes along this easte~lylboundary, b~t it has been obliterated with fill dirt. The SeCretary stated that if that'is the case then he would recommend the matter be continued for further study. Commissioner Marshall stated that this seems7' to be a classic exampl~ of a house designed for the lot without considering a pool location. Commissioner Smith explained that ~his request for' Variance is not due to a hardship and if any exists it iS because of lack of foresight on the part of the architect and/or owner. -3- Planning Commission Minutes - June 11~ 1973 - Continued II. C. V-395 - Continued Mr. Ray Wood, applicant, stated that 1) six (6) months ago when he purchased the subject lot the pool,' was slated for another location and the pad for the house was cut 2) then an underground spring was discovered which made it necessary to request a Variance for the pool and 3) it was his impression that the trails mentioned were no more than trespassing trails through this property. Commissioner Marshall inquired if the applicant had discussed, with his engineer, the possibility of diverting the hatUKal springs. The applicant explained that in order to do that an enormous retaining wall would be ~equired and the cost would be prohibitive. The Secretary explained that the subdivision in which this lot is located was approved long before any proposals for horse trails in that p~rticular area were recommended. Mr. Wood advised that there is a covenant in that subdivision that pro- hibits the residents of that area from keeping a horse. Commissioner Marshall pointed out· that keeping a horse and riding one are two (2) different things. No one else present wished to comment relative to this matter. C-169 - Osterlund Enterprises, Fruitvale Avenue and Allendale Avenue - Request for Change of Zoning from "R-I-40,000" (Single-Family Residential) to "R-I-20,000" (Single-Family Residential) - Continued from May 29~ 1973 Chairman Lively reopened the hearing relative to C-169 at 8:49 P.M. The Secretary read the Staff Report dated June 11, 1973 recommending that the · requested Change of Zoning be approved.on the basis the findings required in Section 18.6 and 18.11 of the City of saratoga zoning Ordinance can be made. The Secretary explained that historically this section of the Zoning Ordinance has been used to define the findings necessary for a Change of Zoning and he would have to contact the City Attorney to resolve the matter. Conmnissioner Belanger inquired if there had been any input on this matter from the Parks and Recreation Conmnission. The Secretary answered that they had expressed a desire to further review this site in con~ection with trees, fencing and landscaping and the Secretary of the Parks and Recreation Commission was~.i'nformed that this would be a Conditional Change of Zoning approval subject to Design Review-Approval of each house. The Parks and Recreation Commission could review their areas of interest at the time Design Review plans are submitted. -4- Planning COmmission Minutes - June 11~ 1973 - Continued II. D. C-169 - Continued Chairman Lively noted that while the developer has put forth a very valid proposal it is his (Chairman Lively's) opinion that the proposal is not consistent with the current General Plan and the zoning should remain "R-i-40,000" (Single-Family Residential), becasue of the importance of this corner and its close proximity to the City Civic Center. He would vote against this proposed Change of Zoning request. Mr. Dick Checci, applicant's engiDeer, stated that two-story homes'are proposed for this property. Since the property is densely populated by tall trees it would be more logical to construct two-story homes on the site. Chairman LiVely stated that the neighbors to the east are concerned that there will be a two-story home constructed adjacent to where a one-story home now exists. Mr. Checci explained that it is possible greater setbacks would be required for two-story homes and this would be to the advantage of the neighbors and the view of the neighbors would be considered in placing the two-story homes on the site. Commissioner Marshall noted that the neighbors are concerned because the developer is proposing that at least 50% of the homes proposed for construc- tion on this site will be two-story. Chairman Lively stated that the effect of two-story homes along the Fruitvale Avenue-Allendale Avenue intersection would not be as objectionable as two-story homes on the interior lots adjacent to the existing residences. / Mr. Tersini~..presgnt to represent the applicant, stated that, perhaps, it should be pointed out that there is a two-story house already in existence adjacent to the subject property and it is the future homeowner in the pro- posed subdivision that may be adversly affected if a single-story home is constructed contiguous to a twosstory. Chairman Lively stated that on the other hand the new home owner will be aware of the two-story at the time he purchase~ his lot; however, there is not much the existing homeowner can do if a two-'story house is con- structed adjacent to his lot. Two of the number of residents of the area that were present expressed their objections to 'the possible 50% two-story dwellings proposed for construction on this property. Chairman Lively closed the hearin~ for the evening at 9:09 P.M., directed C-169 continued to the next regular meeting, and referred same to the Sub- division Committee for further study and a report. Report to include specific recommendations relative to two-story residences for this site. Eo UP-226 - C & I Development, Saratoga Avenue and Palo Oaks Court - Request for Use Permit to Allow Model Home Sales Office Chairman Lively opened the public hearing relative to uP-226 at 9:10 P.M. The Secretary stated the Notice of. Hearing was mailed.and then read a petition containing sixteen (16) signatures requesting that the Planning Commission re- view the grading being done for this subdivision. The petition further states that the foundation and grading for the new homes seems to be above the grade level of the existing residences. -5- Planning Cormnission Minutes - June 11~ 1973.- Continued II. E. UP-226 - Continued Mr. Lou Tersini, present to represent the applicant, stated that the grading done on this property Lis identical to that shown on the approved · grading plan. The lots are Class "A" pads and the drainage is toward the street. Perhaps, the concern of the neighbors stems from the dirt stockpiled at the back of the lots;'~..~hich, will be removed at a later date~ The Secretary explained that the Building Department and Department of Public Works gave very careful attention to the grading plans approved for this property. Mr:~ Dan Trinidad¥.Assistant Director of Public Works, explained that the pad levels on~th~ .site.are same ~s'=~ shown on the grading plan and both have been carefully reviewed and there were no discrepancies found between the actual pads and the grading plan. Mr. Fred Styles of 18990 Saratoga Glen Place stated that the house adjacent to his residence has a foundation~ that was not set down in the ground, but was instead constructed right on top of the ground; therefore, the new house will be higher than his own house. Chairman Lively referred the aforementioned grading problems to the Depart- ment of Public Works and Planning Staff for review and a report at the next regular meeting. Commissioner Marshall noted that the proposed model home sales' office appears to be in use or in a state of conversion to a sales office prior to approval of the Use Permit for same. Mr. Mark Roberrs, present to represent the applicant, stated that the superintendent that was scheduled' to con~ert this existing house into a model home was led to believe that City approval had been granted; however, he has been told to cease further work. The Secretary, in answer to an inquiry from Commissioner Smith, stated that' it is the policy of the City notto grant a Use Permit for a model home sales office for a subdivision with less than sixteen (16) lots - in this case there are only eight (8) lots involved.' However, the sixteen (16) lot requirement is a policy and not an ordinance requirement. Commissioner Marshall stated that!the usual policy in matters of?this nature is to grant the Use Permit for a period of six.'l~', months rather than one (1) year with a stipulation that no extension ~e granted for the Use Permit. Commissioner Martin explained that some other model home sales offices that were allowed'in this area in the past-were ne~er restored to their original condition. Commissioner Marshall stated that., perhaps, the City should more strongly enforce the requirement to reCon~ert a structure used for such a use and if it is not then the City should. call for payment of the bond posted for Same. Mr. Tersini stated that the Staff will verify that any model home sales office the applicant has ever'had was always converted back to its original condition. Commissioner Smith stated he will vote against the subject request for Use Permit since it is a long-standing policy of the City not to grant a Use Permit for a model home sales office unless there are sixteen (16) lots or more involved. There may as well not be a policy if it is not to be enforced. ~ Mr. Fred Styles explained that there is a lot of traffic at the intersection of the proposed sales office and if parking along there could be prohibited it would solve a safety problem. Mr. Trinidad advised that the Public Works Dep~rtment has already taken some steps to eliminate some parking along this area. -6- Planning Commission Minutes - June lip 19'~3 - Continued II. E. UP-226 - Continued Commissioner Marshall moved, seconded by Commissioner Smith, to close the hearing relative to UP-226 at 9:30 P.M.; motion carried unanimously. Commissioner Smith moved, seconde~ by Commissioner Marshall, that the subject request for Use Permit (U~-226) to allow a model home sales office at the corner of Saratoga Avenue and Palo Oaks Court be denied; motion carried unanimously. RECESS AND RECONVENE - Commissioner Smith did not return after the recess since it was necessary for him to leave at that time. III. BUILDING SITES AND SUBDIVISIONS A. SDR-1020 - Donald Comer,· Pierce Rbad - Subdivision Approval - 7 Lots - Continued from April 23~ 1973 The Secretary recommended that SDR-1020 be continued to the next regular meeting; however, the applicant has submitted some revised maps for review by the Planning Commission. Commissioner Marshall stated that 1) sdme memb~rs.~OfTthe,.Subdivision.·.Committee with Commissioner Woodward· did walk this property and found it would be poor to allow this applicant to cover the natural terrain of the existing ravine '~·7·..·~ with an access road 2) the applicant was asked to move the road and the revised map shows the road moved to the other sideof the hill; however, nothing has been done to minimize the lots - there is some question in the minds of the Subdivision Committe~e w~ether the developer will be able to achieve the number of lots he presently has' and 3) the number of lots should really be of secondary importance. Chairman Lively directed SDR-1020 continued to the next regular meeting and referred the matter to the Subdivision Committee for further st·udy. B. SDR-1028 - KingHomes, Inc., CanyOn View Drive·- Building Site Approval - 1 Lot - Continued from April 23~ 1973 The Secretary recommended that SDR-1028 be denied on the basis that the time on the tentative map ;.~····~ witl'~·'expire prior to the next meeting and the proposed map does not meet the requirements of Zoning Ordinance NS-5. Chairman Lively so directed. D. SDR-1040 - Osterlund Enterprises,· Fruitvale and Allendale Avenues - Subdivi- sion Approval - 8 Lots Chairman Lively directed SDR-1040 continued to the next regular meeting since action is still pending on the Change of Zoning (C-169) directly related to this subdivision approval requests. E. SDR-1045 - Orville L. Lykins, Mt. Eden Road - Building Site Approval - 1 Lot,·- Continued from 14ay 29~z1973 The Secretary recommended that SDR-1045 be continued to the next regular meet~ ing in order to await submittal of further cross sections on the grade of this property. Chairman Lively reconmended that the Sta!fz.Rep0rt-.dated=.June 11, 1973 be amended by changing condition II-J to read as follows':~ "J. Obtain Soils Inve'stigation and report." and adding condition II-Q as follows: "Q. Subject to additibnal conditions of Design. RevieW." Commissioner Marshall moved, seconded by Commissioner Belanger, that Staff Report dated J.une 11, 1973 relative to SDR-1048 be adopted, as amended, and that the tentative map (Exhibit "A", filed May 16, 1973) be approved subject,, to the conditions set forth in said report; motion carried unanimously. G. SDR-1049 - Gordon E. Jensen, Quito Road - Building Site Approval.- 1 Lot - Continued from May 29~ 1973 The Secretary stated that~'/the applicant did review the proposed conditions of approval and expressed satisfaction with same. The Staff Report dated June 11, 1973 relative to SDR-1049 was amended by adding the following conditions:' "P. Provide parcel map showing the property as one lot." Commissioner Marshall moved, seconded by Commissioner Belanger, that the Staff Report dated June 11, 1973 relative to.SDR-1049 be adopted, as amended, and that the tentative map (Exhibit "A-I",' filed June 6, 1973) be approved subject to the conditions set forth in said report; motion carried unanimously. H. SDR-1050 - ViCtor 'Thureson~ Pierce Road - Building Site Approval - 3 Lots .The applicant was present and stated he had reviewed~...the proposed conditions of approval and expressed satisfaction with same. The Staff Report dated June '11, 1973 relative to SDR-1050 was amended by adding the following conditions: "R. Subject to additional conditions of Design Review." "S. Construct access road 18-feet wide using double seal oil and screening on 6-inch2A. B. from Pierce Road to turn-around." Commissioner Marshall moved, seconded by Commissioner Belanger, that the Staff Report dated June 11, 1973 relative to SDR-1050 be adopted, as amended, and that the tentative map (Exhibit "A", filed May 31, 1973) be approved subject to the conditions set forth in said report; motion carried unanimously. I. SDR-1051 - Robert P. Schiro~ Glenmont Drive - Buildin~ Site Approval - 1 Lot The Secretary stated that the applicant did review the proposed conditions of approval and expressed satisfaction with same. Commissioner Marshall moved, seconded by Commissioner Belanger, that the Staff Report dated June 11, 1973 retat]~ve to SDR-1051 be adopted and that the tentative map (Exhibit "A", filed June 1, !973) be approved subject to the conditions set forth in said report; motion carried unanimously. -8- Planning Commission Minutes - June 11~"1973.- Continued III. J. SDR-1052 - Osterlund Enterprises, Fruitvale Avenue and San Marcos Road - Subdivision Approval - 26 Lots Commissioner Marshall briefly reviewed the proposed· tentative map and explained that some agreement will have to be made with the I.O.O.F relative to road improvements ~atL the time the subject property is developed. Mr. Conklin, present to representSthe I00.O.F., stated that 1) representatives of the I.O.O.F. have met with this developer relative to the proposed road improvements 2) there is one difficulty and that is that the developer expects us to share in the expense of theimprovements; however, the I.O.O.F. does ·not feel they want to share in the cost to the ext ent::.. expected by the developer 3) also, the I.O.O.F. is anxious that a 6~inch~·private water line be replaced by the applicant and .4) the arch!'at the entrance of the I.O.O.F. will be -- -relocated. Commissioner Martin stated that another area. of concern is the open ditch on the property. Is that tO remain on the property in its present state? Mr.-.Dick Checci, applicant's engineer, explained that a lot of the'.storm water in the ditch will be taken· care of in a drainage system. It reduced and concentrated into a storm drain.-- The developer is willing~to put in 40~feet of the road improvements which involves approximately $26,000. and that would leave a-sum of approximately $16,000. for I.O.O.F.· to pay. Also, the developer has offered to·contribute money toward relocation of the arch at the entrance to I.O.O.F.·l'Th'e water facility--and road improvements will be advantageous to both the developer and the I.O.O.F. people. If an agreement cannot be worked out, perhaps, the subdivision can be redesigned. Mr. Conklin stated ·that it is thelhope of the I.O.O.F. people that the new road. can be named I.O.O.F. Drive. Chairman Lively directed SDR-1052,continued/Tto the~next reular meeting to allow time for further study and review of' the tentative map. K. SDR-1053 - Anatol Romanoff~ Foothill Lane - Building Site Approval - 1 Lot The applicant was-present and sta~ed he had reviewed the·proposed conditions of approval and·expressed satisfadtion with same. Commissioner Marshall moved, seconded by Commissioner Belanger, that the Staff Report dated June 11, 1973 relative to SDR-1053 be adopted and that the tentative map (Exhibit "A", filed June 1, 1973) be approved subject to the conditions set forth in said report; motion carried·unanimously. IV·. DESIGN REVIEW A. A-391 - George W. Day, Douglass ahd Fruitvale Avenues - Final Design Review - Final Landscape Plans for Common Areas of "P-C" Development - Tracts #5150, #5327~ and #5408 The Secretary read the Staff Report recommending that the landscape plans for common areas of the "P-C" development for Tracts #5150~·#5327, and #5408 be granted Final Design Approval.~ Commissione~ B~langer stated thatZshe is pleased that the developer is trying to preserve the natural-look of this ·area. The s~aff Report dated June 11, 1973 relative to A-391 was amended by adding the following conditions: "4)'All existing walnut tree~ to remain.'·'· "5) Size, spacing, and quanti6y of all planrings shall be shown on the plan and shaI1 be subject to Design Review Approval." -9- Planning Commission Minutes - June 11, 1973 - Continued IV. A. A-391 - Continued Commissioner Belanger moved, seconded by Commissioner Matteoni, that the Staff Report relative to A-391 (Tracts ~5150, #5327, and #5408) be adopted as amended, and that the Final Design Approval be granted for the final l~ndscape plans for common areas of this "P-C" development as shown on Exhibit "X" and subject to the conditions set forth in said report; motion carried unanimously. : B. A-417 - FirstChurch of Christ Scientist, Saratoga-Los Gatos Road - Final Design Review - New Off-Site Directional Sign' The Secretary read the Staff Repor't dated June 11, 1973 recommending that Final Design Approval be granted for a new off-site directional sign for the First Church of Christ Scienti'st. Commissioner B~langer moved, seconded by Commissioner Matteoni, that the Staff Report relative to A-417 dated June 11, 1973 be adopted and that the Final Design Approval be granted for the new off-site directional sign as shown on Exhibit "A" and subject to the condition stated in said report; motion carried unanimously. C. Tract 5244 - Osterlund Enterprises., Cox and Saratoga Avenues - Final Design Review - Decorative Fencing and Final Landscape Plans Chairman. Lively stated that in view of the question about the grading elevat.ions and foundations in this tract this. matter will be referred back to the Design Review Committee for further study' and continued to the next regular meeting. V. ENVIRONMENTAL IMPACT REPORT The Secretary advised that no~:items for consideration under this category are necessary at this time. VI. MISCELLANEOUS ITEMS A. SDR-932 - George A. Akers~ E1 Camino Senda - Request for Extension The Secretary stated that the applicant has requested a timely extension for SDR-932. : Commissioner Marshall moved,· seconded by Commissioner Belanger, that a one (1) year extension be granted for SDR-932 in compliance with the request submitted by the applicant (George A. Akers); motion carried with~-'ehaihnan Lively abstaining. B. Bohlman Road - Study Area The Secretary stated that additional material will be made available at a later date mainly to do with the number of sites eventually possible for this · area; however, a model has been prepared along with some maps and statistics. The material relative to the utilities in the area has not yet been prepared since the aerial work has just recently been made available. The model does · show existing roads and homeS, as Well as, the different grade of the study area. It would be his recommendation that the matter be continued to the next regular meeting at which time:a preliminary ordinance could be considered. Chairman Lively so directed. WRITTEN Letter from Saratoga Fire District re SDR-895 and SDR-1014 The Secretary read a letter regarding water main and hydrants on Saratoga Hills Road and .then?~r.ecd~mend~d~th~t the matter be referred to the Sub- d~ivision Committee and Staff. Chairman Lively so directed and requested the Secretary to contact the owners of these lots and inquir'~ Why these improvements have not been accomplished. Letter re Congregation Beth David and Church of Ascension Landscaping The Secretary read a letter from Prides CrOssing Homeowners Association regarding the landscaping for the two (2) Churches. Chairman Lively referred the matter to the Design Review Committee and and requested the Secretary to forward a letter to the two (2) churches involved relating the concern of the Homeowners Association. Quarry Reclamation and Ridgel~ne Mining The SeCretary read a communication received from K~iser Cement and Gypsum Corporation containing a progressZreport on the quarry reclamation and r~dg~line mining operated by this firm. Request to Add Use to "C-V" (Visitor-Commercial) Zoning District The Secretary read a letter reque§ting that Abe Carreia (property owner) be allowed to operate a ~e'ad~Lxconcrete business and engage in the sale of sawdust and that this use be,added as a conditional use in the "C-V" Zoning District. The applicant's attorney was present and stated that the applicant at one time did sell some of his property to the Handy Andy people. Fn~,.~ Carreia does at present operate this business atZthe rear of this property and would like to move the operation to the front of the property. COmmissioner Belanger inquired If the applicant has in fact already moved his operation to the front of the property. The attorney explained that to a certain extent he is already operating at the proposed location;hhowever, he has been made aware that it is'illegal and will curtail further activities until permission is granted by the City. Chairman Lively referred the matter to the Subdivision Committee and requested that theyt~i~cuss the. matter to determine whether anDihformal public hearing should be Scheduled in connection with this request. Bo ORAL Montalvo - Road Commissioner Belanger i~quired if there is anything that can be done about the ~oad at Montalvo? The Assistant Director of Public Works' stated that there is not much the City can do since that is strictly a private road-way and is under County jurisdiction and under private ownership. ~" Commissioner' Belanger explained that when driving on that road, unless extreme care is taken, one wheel could easily go off the road since it is not very wide. Montalvo - Continued The Assistant Director of Public Works stated that he would· check into the matter. Trees Commissioner Martin reported that it appears that Osterlund Enterprises has not fulfilled the requirements for street tree planrings in the area of Cox and Saratoga Avenue. Chairman Lively requested the Secretary to determine if ·these. require- ments can be met. Truck Storage at Quito Road and Marshall Lane and Other ViOlations Chairman Lively asked that the SeCretary request the Code Enforcement Officer to check into the following violations: 1) Truck-parking and storage at · Q. uito Road and Marshall Lane. 2) Debris at Marshall Lane School. 3)Margolis Law Offices at Saratoga- Sunnyvale Road. Guests Chairman Lively acknowledged, with pleasure, the presence of Councilmen Diridon and Kraus, City Manager RObert Beyer, Mrs. Maas and Mr. Sitney of the Good Government Group.
