B. MINUTES
Commissioner Lustig moved, seconded by Commissioner Woodward, that the reading
of the minutes of the June 25, 1975 Planning Commission be waived, and that
they be approved as distributed to the Commission subject to the 'following
correction: page 1, Commissioner Lustig moved and it was seconded by Commis-
sioner Woodward the motion to approve the minutes of June 11, 1975. The
motion was carried unanimously.
C. CITY COUNCIL REPORT
Commissioner Belanger gave a detailed report of the City Council meeting of
July 2, 1975..A copy of the minutes of ~his meeting is.on"file at the City's
Administration Office.
II. PUBLIC HEARINGS
A. UP-239 - Boething Treela~d Nursery Company, Prospect Road, Request for Use Per-
mit to Allow the Construction of an 8-Ft. High Storage Shed to be
Erected in the West Valley Freeway Right-6f-Way; Continued from
June 25~ 1975
The Secretary stated that the~applicant had requested a continuance of this
matter in order to provide information not previously submitted, and he recom-
mended this matter be continued to the Planning Commission meeting of July 23rd.
It was noted, however, that there were m~mbers of the audience who wished to
give public testimony on this matter; consequently, Chairman Marshall reopened
the public hearing on UP-239 at 7:40 p.m.
· Mr. Don Wolfe, vice president of the Greenbriar Homeowners Association, stated
that they had received numerous complaints from members of the Association
relative to the activities involving this use, most of which stemmed from
the problems created by mixing the fertilizer materials. He requested con-
sideration be give~ to this.
· Mr. Wolfert, 12243 Goleta Avenue, Specifically complained that: (1) the
location of the deciduous trees m~ned by the Nursery were placed next to
his property, and that leaves fell into his swimming pool; (2) that the
sawdust used in mixing the fertilizer material blew into his pool thus
causing him a great deal of expense in emptying and cleaning the pool; and
(3) there was a noise problem from the trucks presently being used in the
operation of this business; further, that he felt there would be an addi-
tional high noise factor resulting from use of the motor used for mixing
the liquid fertilizer. Commissioner Lustig requested Mr. Wolferr transmit'
a letter to the Boething Treeland Nursery listing his complaints, and carbon
copy same to the City Planning Commission as documentation on this matter.
S~aff noted that it was attempting to resolve the problems associated with the
blowing sawdust and falling leaves, and that this complaint would not go unnoticed.

II. A. UP-239 - Boethin8 Treeland Nursery - Cont'd
At this time, Chairman Marshall closed the public hearing on UP-239, continued
same to the Planning Commission meeting of July 23, 1975, and referred this mat-
ter to the Subdivision Committee and Staff for further review and report.
B. UP-276 - Robert C. Truax, 12401 Green Meadow Lane, Request for Use Permit to
Allow the Construction of an Accessory Structure in the Required Rear-
yard Setback (Ordinance NS-3~ Section 3.7-1); Continued from June 25, 1975
The Secretary noted that it had been determined a variance would be required on
this matter in lieu of a use.permit, and he reco~mLLended that further proceedings
on'UP-276 be terminated. He added that the applicant had applied for such a
variance, and that the public hearing on same would be agendized for July 23rd.
He suggested the Variance Committee schedule an on-site inspection at 9:00 a.m.
on Saturday, July 12, 1975. This was agreeable with the Committee, and Staff
was requested to notify the applicant of this date.
Commissioner Belanger moved, seconded by Commissioner ~rtin, that the Planning
Commission terminate proceedings on UP-276. The motion was carried unanimously.
C. UP-277 - Saratoga Foothills Development Corporation 14404 Black Walnut Court,
Request for Use Permit to Allow a Model Home Sales Office to be Located
on Black Walnut Court (Ordinance NS-3, Section
Chairman ~rshall opened the public hearing on UP-277 at 7:52 p.m. Mr. Burt,
Staff member, stated that the Subdivision Committee had reviewed this matter,
and that a Staff Report had been prepared recommending approval. He added that
Exhibit "C" had been modified, at the Staff's request, to specify the list of
trees and the type of landscaping that would be used.
Commissioner Belanger cautioned the applicant that the Commission did not and
would not in the future look with favor on a developer building a model homer
.-' sales office prior to applying for a use permit for same; espedf~i~'~=,light
of the fact that City policy pr.ohibited a model home sales office to"b'~ on a
corner lot. No~ was made that this model home sales office fronted'on Douglass
.. Lane but had access on Black Walnut Court. The applicant's representative was
present and acknowledged said warning. No other comments were made.
Commissioner Woodward moved, seconded by Commissioner Lustig, that the public
hearing be closed on UP-277. The motion was carried unanimously, and the
public hearing was closed at 7:55 p.m.

D. UP-278 - Stanley Roakes, 20024 Puente Court, Request for Use Permit to Allow
the Construction of an Accessory Structure in the Required Rearyard
Setback (Ordinance NS-3~ Section 3.7-1)

Note was made that a letter dated July 3, 1975 from James B. Howat, 20036
Puente Court, had been submitted protesting granting of this use permit in
that it would "eliminate any vestige~rof privacy" he might have. The applicant
was not present, but note was made that a copy of the agenda as well as the
Staff Report had been mailed to the applicant prior to the meeting.
Commissioner Lustig moved, seconded by Commissioner Woodward, that the public
hearing on UP-278 be closed. The motion was carried unanimously, and the
public hearing on UP-278 was closed at 8:03 p.m.
Commissioner Belanger moved, seconded by Commissioner Woodward, that the
Planning Commission deny application UP-278. The motion was carried unanimously.

II.! E. V-427 - Osterlund Enterprises, Radoyka Drive, Request for a Variance to Allow
the Construction of an 8-Ft. High Fence Along the Rear Property Lines
~ of Tract #5631 (Ordinance NS-3~ Section 3.4)
.... Chairman..~rshall opened the public hearing on V-427 .at 8:04 p.m. Staff noted
that the three members of the Variance Committee had reviewed this on-site,
and that a Staff Report had been prepared recommending approval. Staff suggested
that, insOmuch as Design Review application A-480 was directly related to this
Variance, that A-480 be addressed concurrently with V-427.
Chairman Marshall suggested thatlas a ~ondition of the variance, the applicant
be required to landscape, prior to occupancy, the property-ow~er side of the
fence in order to provide a buffer against noise from Lawrence Expressway.
Considerable discussion followed on this suggestion. Many of the Commissioners
felt it would be more appropriate to require landscaping on the street-side of
the fence, and obtain agreement from the County of Santa Clara and the school
district board (both of which have jurisdiction over this area and are abhtting
the subdivision property and fence) to maintain such plantings. }~. Tersini,
applicant's representative, indicated a willingness to provide such landscaping,
and to Begotlate a maintenance agreement for the landscaping with the County
and school board.
The consensus of the Planning Commission was to close the public hearing on
V-427, continue both V-427 and A-480 to the Planning Commission meeting of
July 23, 1975, and refer this matter to the Variance Committee and Staff for
further review and report. Mr. Tersini x~as asked to provide appropriate land-
scaping plans for the Lawrence Expressway-side of the fence, and to provide
to the City written consent from the school board and the County of their wil-
lingness to maintain such landscaping.
F. C-179 - Albert Hanson, 13761 Dolphin Drive, Change of Zoning Request from
"R-i-20,000" (Single-Family Residential, Low Density) to "R-1-12,500"
(Single-Family Residential, Medium Density) the Parcel Designated as

Chairman }Mrshall opened the public hearing on C-179 at 8:33 p.m. }~. Burt
noted that this matter had been reviewed by the Subdivision Committee and Staff,
-'- and that a Staff Report had been prepared reco~f~f~ending approval of the request
to rezone the property located on the northwest corner of Allendale ~venue and
Dolphin Drive. He stated, however, that the request was for a change of zoning
from "R-I-20,000" to "R-1-12,500," and that the Staff recommended this be
rezoned to "R-l-10,000" in order-to avoid spot;zoning'and to be consistent with
the ab~tting subdivision~ zone. Note was made that the property was .741 acres
comprising approximately 31,000 square feet, and that the "R-l-10,000" zone
would not allow ~y additional density.than that allowed under the "R-1-12,500"
designation.
A slide was shown describing the zone designations of the surrounding properties
as being "R-l-10,000," "R-1-40,O00" and "R-1-20,O00" on the north, south, east
and west sides of the property respectively. Note was made that physically the
property associated with the "R-l-10,000" zoning district, Tract 1963, was
adjacent to its northernmost property line, and that this site was originally
part of Tract 1963. Mr. Burr stated that he felt this matter was/lo"~f6~ily .a ....

Considerable discussion followed on whether this property should in fact be
rezoned. It was felt by some of the Commissioners that rezoning the property
might constitute spot zoning within the property to the south of Allendale which
was zoned "R-I-20,000." Commissioner Belanger expressed a concern that rezoning
the property' to "R-l-10,000" would encourage greater density in the Allendale/
Quito area if other "R-i-40,000" and "R-i-20,000" zoned properties requested
similar change of zoning% .... She expressed a further concern that there could
be~greater traffic congestion caused by such an overall community increase in
density.

II. F. C-179 - Albert Hanson - Cont'd
'~ Mr. Hanson, applicant, pointed out that his lot was originally part of Tract
1963, and that somewhere in the past the City had changed the zoning of Tract
1963 but had left his property out of the change of zoning. He argued that
land was the most valuable asset in Saratoga, and that he felt it was a waste
to put a house on one-side of an acre and not use the other portion of the
property. Mrs. Hanson added that they had lived on the corner of Allendale/
Dolphin for 11 years, and that the traffic had increased significantly; further,
that they wanted to split this property and build on the innermost-side of the
lot. Note was made that both properties would have access on Dolphin Driye,
not Allendale Avenue. She explained that the situation now was a vacant .lot
between their house and the adjacent property o~ner, which was not only aesthe-
tically displeasing, but also difficult to maintain. The Hansons urged the
Commission to make an on-site inspection of the property in order to more
accurately judge the situation.
This suggestion was me~ _With acceptance by t~e Con~nission, and the consensus
of the Planning CoxL~f~ission was to close the public hearing on C-179, continue
same to the Planning Commission meeting of July 23, 1975, and refer this mat-
ter to the Subdivision Committee and Staff for an on-site inspection and
further review.
III. Bb~LDING SITES AND SUBDIVISIONS-
A. SDR-1189 - Charles Bilek, Sobey Road, Building Site Approval - 1 Lot (Expires
July 9~ 1975); Continued from June 25~ 1975
Mr. Burt stated that this matter had been reviewed by the Subdivision Committee,
and that a Staff Report had been prepared recommending approval. He noted that
the lot was 'legal non-conforming, but that the zone setbacks would be met. The
__applicant was.present and indicated acceptance of the Staff Report.
Commissioner Belanger moved, seconded by Commissioner Callon, that the Planning
Commission grant'tentative building sit~ appr6val to application SDR-1189 per
Exhibit A-1 filed June 11, 1975, and subject to G~neral Conditions I and
Specific Conditions II (a) through (1) of the Staff Report dated July 1, 1975.
The motion was carried unanimously.
B. SDR-1190 - James Keator, San ~rcos Road,-Building Site Approval - 1 Lot
(Expires July 28, 1975); Continued from June 25, 1975
Mr. Burr stated that the Subdivision Committee had ~eviewed this matter, and
that a Staff Report had been p~epared recommending approval.
this was a legal lot with an existing structure, with a planned addition thereon
in excess of 50%. He drew the Commission's attention to the guest house presently
-- existing on the property, and pointed out that this house did not have a kitchen
and therefore met City ordinances; further, that the Bu~lding Department would
make an on-site inspection of this to assure that City requirements had been
met. The applicant was not present but note was made that the applicant had
been mailed a copy of the Staff Report 6 days prior to this meeting.
Commissioner Belanger moved, seconded by Commissioner Callon, that the Planning
Commission grant tentative building site approval to application SDR-1190 per
Exhibit A filed Ju~e 9, 1975, and subject to the conditions, General and
Specific, of the Staff Report dated July 1, 1975. The motion was carried
unanimously.

(Expires July-30, 1975); Continued from June 25, 1975
M~. Burr stated that the Subdivision Committee had reviewed this matter, and
that a Staff Report had been prepared recommending approval. He explained that
this was part of an existing tract which had expired, and that the slope of the
property was approximately 25%. The applicant was not present, but note was
made'that a copy of the Staff Report had been mailed to the applicant 6 days
prior to this meeting.

Commissioner Belanger moved, seconded by Commissioner Callon, that the Planning
Commission grant tentative building site approval to application SDR-1191 per
Exhibit A-l-filed July 3, 1975, and subject to the conditions, General and
Specific, of the Staff Report dated July 1, 1975. The motion was carried
unanimously.
Note was made that the files on the following applications were not complete, and
Chai{-man Marshall directed that same be continued to the Planning Commission meeting

applicant's representative, was present and indicated acceptance of both Staff
Reports.
Commissioner Woodward moved, seconded by Commissioner Zambetti, that the Planning
Commission grant final.design review approval to application A-447, Lots #9 and
#10 of Tract ~5408 per Exhibits ~ and I, and subject to the Staff Report dated
July 1, 1975. The motion was carried unanimously.

Mr. Loewke noted that this matter had been reviewed by the Design Review Commit-
tee, and that a Staff Report had been prepared recommending approvaI. Commis-
sioner Woodward pointed out that the applicant had been very cooperative in
working with the Design Review Committee on this matter, and that she felt he
had done a very good job. ~The applicant was present and indicated acceptance
of the Staff Report.
Commissioner Woodward moved, seconded by Commissioner Zambetti, that the Plan-
ning Commission grant final design review approval to appliaation A-485 per
Exhibit A-1 and subject to the Staff Report dated July 1, 1975. The motion
was carried unanimously.

Mr. Lo~ke noted that this matter had been reviewed by the Design Review Commit-
tee, and that a Staff Report had been prepared recommending approval. The
applicant was not present, but it was noted that a copy of the Staff Report had
been mailed to the applicant 6 days prior to this meeting.
Commissioner WoodWard moved, sec'onded by Commissioner Zambett~ that the Planning
Commission grant final design review approval*-to application A-487 per Exhibit A
and the Staff Report dated July 1, 1975. The motion was carried unanimously.
H. A-489 - Ira Kirkorian~ Moran Lane~ Final Design Review Approval - 1 Lot
Mr. Loewke noted that this ma~ter had been reviewed by the Design R~view Commit-
tee, and that a Staff Report had been prepared recommending approval. He
pointed out that the drawings had been modified reflecting wood siding, as
proposed in the front elevations, to be carried all around the house. l.He ex-
plained that per Zoning Ordfnance NS-3, Section 13.2, Design Review Approval
was required for this house because more than 3 building permit~ for one-family
~dwellings on one block within one year had been applied for by the same developer.
Commissioner Woodward moved, seconded by Commissioner~Zambetti, that the Plan-
ning Commission grant final design review approval to application A-489 per
Exhibit A and subject to the Staff Report dated July 1, 1975. The motion was
carried unanimously.

The following correspondence was introduced into the record:
Ai- Letter dated June 20, 1975 from Gerda Story, Brookview Homeowners Association,
responding to questions asked by the City relative to the Association's organi-
zation.
"B. Letter from Mrs. Caryl Symonds, 20753 Norada Court, dated July 2, 1975 expressing
concern over the development of the Parker Ranch. Staff was directed to ma~e
this part of the C-172 file.
C. Letter from Alan Rubnitz, attorney at law, stating that he felt the condition
placed on the 4th Street stairway project by the Planning Commission at its
meeting of June 25, 1975 was not acceptable. He pointed out that a bond
had been posted to insure completion of the stain~ay, and he requested that
~the Coff~f~ission rescing its stipulation that a certificate?f. qccupancy would

Discussion followed on this request. Chairman Marshall noted that when approval
was given to this condominium project originally, the Commission had stipulated
at that time that the condominium project had to be completed concurrently
with the stairway. It was pointed out that the applicant had requested the
Commission to consider and approve. revised plans for the stairway; and that
because the request was made on the part of the applicant, this was not a
compromise situation. After further consideration, it was the consensus vote-
of the Planning Commission t o direct Staff to draft a letter to Mr. Rubnitz
incorporating the Commission's comments regarding this matter.
D. Newspaper article from the S.F. Sunday Examiner & Chronicle entitled "The Bay
Area Greenbelt Plans Revisited" sent by Mrs. Clarence Frizzell, 21281 Canyon
View Drive. Along with the article a note was included fromMrs. Frizzell

opposing the y s proposed hillside residential district ordinance as en-
couraging growth in the hillside areas. Staff was directed to make this part
of the file on the proposed hillside residential district ordinance.
E. Letter. dated July 9, 1975-from Dr. I. Abrams requesting a meeting with the
Subdivision Committee and Staff regarding the proposed library site on Cox/
Saratoga Avenues. This matter was more thoroughly addressed uner Oral
Communications.
VII. CO~RINIGATIONS - ORAL
A. Mrs. Margaret Dunn, 19521 Douglass Lane, read into the record a statement by
her relative to tennis court lighting at West Valley College. Mrs. Dunn pointed
out that in November 1973 a group of homeowners requested the West Valley
College Board of Trustees to use a low profile-type of lighting on the new
tennis courts; however, she pointed out that this was not done. She added that
on December 21, 1973 these homeo~mers received a copy of a letter sent to the
College from Stanley Anderson, consulting electrical engineer, inwhich he
stated that if the brightness of the lights were found to be excessive, stan-
dard shielding hoods were available to apply to those units. She stated that
the~-hom~oi~ners had requested on several occasions that the College install these
shields on all tennis court lights at the College, but that their requests had
not been complied with. She pointed out that they were sending a request to the
Board_'of Trustees ;~in'~'i~'~'e money b'~"~rl~c"~d'i~hl College's 1975-76 budget
for these shielding hoods;' Mrs. Dunn asked the Commission to request the Board
of Trustees to install adequate shield hoods on all tennis court lights, and
based this request on the January 1967 Staff Report on UP-119 which stipulated
that outdoor lighting and specific lighting for athletic areas be submitted to
the appropriate Saratoga City officials for review and recommendation.
After brief discussion of this request; Commissioner Callon moved, seconded by
Commissioner Lustig, that Staff be directed to contact in writing the West Valley
College Board of Trustees, on behalf of the Planning Commiss ion, and encourage
the College to meet the terms of the January 1967 Staff Report on UP-119 and
install lighting shields on all tennis courts. The motion was carried unanimously.

B. Dr. I. Abrams, with reference to his letter of July 9, 1975, urged a meeting
be scheduled as soon as possible between himself and the Subdivision Committee
on the proposed library site on his property located at Cox and Saratoga
Avenues. He pointed out that the City Council at its recent Committee-of-the
I~ole meeting had scheduled a public hearing on July 29, 1975 to consider ~ther
possible locations for the library site in that too much time had expired in
considerations of the Cox/Saratoga Avenues site. After brief considerations,
it was the-Subdivision Committee's consensus to schedule such a meeting next
week; Commissioner Belanger informed Dr. Abrams that Staff would be contacting
him with the exact date and time.
C. Chairman }~rshall reminded the Commission that Subcommittee organization had
been assigned through July of this year, and that the Commissioners should be
considering what committees they would be interested in serving upon. He
requested the Commissioners notify him of their feelings on this prior to the
July 23, 1975 Planning Corf~f, ission meeting.
D. Mr. Loewke pointed out to th[ CommisSion that, per their request at the June 25th
meeting, review and further consideration had been made by Staff and the Des~gn
Review Committee on hmv best to condition applications for assurance that proper'
"'ll~d~aping would be install~ He noted that a simple cash bond (the sum of
which could be determined on an individual basis) agreement had been prepared
whereby the applicant would deposit with the City a cash bond, release of such
bond contingent upon completion of the landscaping. This cash bond agreement
concept met with the approval of the Commission.
E. Commissioner Woodward noted that vacation schedules of the Commission should be
noted with the Planning Staff in order to insure that proper quorums would be
had during the upcoming Planning Commission meetings.
F. Chairman ~rshall acknowledged the presence of Ms. Runyan of the American
Association of the-University of Women, Mr. John Power of the Chamber of
Commerce, and Mr. Charles Huff of the Prides Crossing Homeowners Association;
further, he expressed appreciation to Ms. Aberle of the Good Government Group
.. for serving coffee.
