I. ROUTINE ORGANIZATION
A. ROLL CALL
Present: Commissioners Belanger, Callon, Laden, Lustig, Marshall,
Willjams and Zambetti
Absent: None
B. MINUTES
Relative to the minutes of November 9, 1977, Comnissioner ~rshall made
the following correction: The first sentence of the third paragraph
on page 2 should read: "Commissioner ~x.~rshall stated that at the original
time of application, different alternatives were explored, but secondary
access alternatives were not possible."
Subject to this correction, Commissioner ~'hrshall moved, seconded by
Commissioner Callon, that the reading of the November 9, 1977 minutes be
waived and approved as distributed. The motion ~eas carried, with Com-
missioner Lustig abstaining because he was not present at the November 9th
meeting.

Conmissioner }t~rshall moved, seconded by Conmissioner Zambetti, to approve
the composition of the Consent Calendar and the following items:

Single Family Residence - 'amendment
b. A-597 - R. W. Kelez, F. W. Kelez, S. Kirk, Sobey Road and Ten
Acres, Final Design Review Approval - Three (3) Single

I I I. TSNTATIVE SUBDIVISIONS
A. SD-1323 - L. Hancock Construction Company, Chester Avenue, Tentative Sub-
Division Approval 6 Lots; Continued from November 9, 1977
Staff reported that the land purchase between the applicant and the Inde-
pendent Order of Odd Fellows had not yet been accomplished on this item.
Mr. Kirkeby, engineer for the applica~t, addressed the Commission. He
stated that the monthly meeting of the Odd Fellows had been held, at which
they considered the proposal of trading a small piece of their property in
exchange for building the Chester Avenue frontage as a requirement of their
development. ~r. Kirkeby commented that the Odd Fellows in theory had
approved this exchange, but still hoped that Chester Avenue would not have
to be improved, since it is a secondary access. Mr. Kirkeby went on to
state that he had confirmed with Staff that improvement of Chester Avenue
as a through street, not as a secondary access, was a specific requirement
of the conditions.
Mr. Kirkeby said that they were going to reformalize their offer to the
Odd Fellows for the exchange of property and expect to have an answer
from them within two weeks. Chairman Belanger asked if there was a need

to clarify the situation with the Board of the Odd Fellows as to
what their requirements are. Staff reported that they had been
in contact with ~[r. Clark of the Odd Fellows, who had been con-
fused by the conditioning. Staff stated that it was explained to
~r. Clark that the condition on the Odd Fellows property is a finn
one; it states dedication and improvement of Chester Avenue, and
their engineer and architect are aware of this. Mr. Kirkeby stated
that his client is willing to pay for the design of the street and
place whatever bond is necessary for the improvements of the street
for the Odd Fellows.
Chairman Belanger stated that it should be clarified to the Odd
Fellows that the street improvement is not negotiable as far as
the City is concerned. She directed that this item be continued to
the December 14, 1977 meeting.
IV. PUBLIC HEARINGS
A. UP-3SS - V. Garrod, L. Cooper & R. Garrod, Mt. Eden Road- SS' Self-
supporting TV TOwers
Comnissioner Marshall reported that an inspection had been made by
some of the members of the Commission of one of the sites, and the
t~ers are placed approximately 20 ft. from the City limits, and
1300' ft~. apart. He-went on to 'expl~in"th~'t" She_total impact is - '
a very small amount of visual impact upon a very small number of homes,
and added that the reception was excellent. Commissioner Marshall
stated that a large oak tree tends to screen the one tower, and the
other tower is less noticeable because of its location. He further
stated that the prime power to operate the amplifiers for the antenna
will be underground. Commissioner ~rshall conmented that the engineer-
ing work done by Video Engineering on this project is outstanding.
The public hearing ~ms opened at 7:48 p.m.
Mr. Ken Daniel, of Video Engineering, addressed the Conmission and
submitted a scale of the tower and the antennas. Mr. Everett Bryan,
of 24681 Avenue, Saratoga Oaks, asked how many homes would be served.
Commissioner Marshall explained that the City of Saratoga will be
served through a cable T.V., and the City is divided into three zones.
Mr. Daniel submitted a map showing the zones, stating that Zone 1 will
be served first, which includes essentially the western part of the
City from the Saratoga-Los Gatos Road.
Since no one else appeared to speak on this matter, it was moved by
Commissioner Zambetti, seconded by Commissioner Callon, to close the
public hearing. The motion was carried unanimously.
Discussion followed as to the various aspects of the proposal. ~r.
Daniel commented that within six months the residents of Saratoga Oaks
will be ~mtching cable T.V. He further explained that this station is
only intended to serve ultimately the City of Saratoga, and there is no
firm plan as yet to serve anything except Zone 1.
Commissioner Zambetti moved, seconded by Commissioner Laden, to approve
UP-355, per Staff Report dated November 15, 1977. The motion was
carried unanimously.
B. GF-315 - City of Saratoga Excavation and Grading Ordinance
Staff reported that the ordinance is undergoing some revision by the
City Attorney and requested a continuance of this matter.
The public hearing was opened at 7:S5 p.m. No one was present to
speak on this matter, and it was directed by Chairman Belanger that
the public hearing be continued to the meeting of January 11, 1977.

V. DESIGN REVIEW
A. A-600 - Richard D. Picone, Padero Court, Final Design Review Approval -
'1 Lot - Sing.le Family Residence
Staff explained that this site was conditioned under Building Site
Approval for a Site Development Plan, and a Staff Report had been
prepared, recommending approval.
Chairman Belanger stated she found Condition 1 of the Staff Report,
referencing the necessity for Design Review Approval, to read rather
permissively. Discussion followed on modification of this condition.
Commissioner Lustig moved, seconded by Commissioner Zambetti, to approve
A-600, per Staff Report dated November 16, 1977, with Condition 1
amended to read: "Further site development is prohibited without approval
of site development plans and design review according to Ordinance
NS-3.33 [HC-RD Ordinance)". The motion was carried unanimously.
VI. CC~MINICATIONS
A. ~ITFEN
1. T~o letter-s had been received from ~,~r. Fallek (Swartz) regarding
Conditional Final Building Site Approval on SDR-1292. It was
stated by Staff that this matter should be reviewed by the Land
Development Committee, and it was directed that it be continued
to their December 1, 1977 meeting.
B. ORAL
1. ~[r. Frank Horvath, Mt. Eden Road, addressed the Commission, stating
he had a 3 lot subdivision. He reported that the Public Works
Department had requested U~o soils reports on this subdivision,
one regarding the road and a second one on the property. Mr.
Horvath commented that the first report on the mad had been sub-
mitted, and he wished to get Conditional Final Building Site Ap-
proval from the Plar~ning Commission. Mr. Horvath explained that
his engineer had covered the whole subdivision, and everything had
been completed except submission of the second soils report on the
property.
Staff explained that a matter could not be agendized until all of
the conditions had been met. Chairman Belanger stated that the
Planning Comission was in full agreement with Staff's position
regarding agendizing. She informed ~r. Horvath that the Commission
could not grant Conditional Final Building Site Approval until the
soils report on the property had been received, and it was confirmed
that it meets the standards the City sets for building.
2. PPC Report - Commissioner Callon reported that the County Housing
Plan and the Environmental ~nagement Plan had been discussed.
A public hearing by the County on the Housing Plan was scheduled
for November 22, 1977 at 1:30 p.m.
3. City Council Report - Commissioner Belanger gave a report of the
City Council Meeting held November 16, 1977. A copy of the minutes
of this meeting is on file at the City Administration Office.
4. Chairman Belanger t~-~ked the Good Government Group for attending
and serving coffee.

Commissioner Zambetti moved, seconded by Commissioner Laden, to adjourn.
It was carried unanimously, and the .ieeting was adjourned at 8:40 p.m.
