HomeMy WebLinkAbout06-01-1982 Planning Commission Minutes CITY OF SARATOGA PLANNING COMMISSION MINUTES DATE: Tuesday, June 1, 1982 - 4:30 p.m. PLACE: Community Center Meeting Room, 19655 Allendale Avenue, Saratoga TYPE: Regular Adjourned Meeting Roll Call Present: Commissioners Bolger, Crowther, King and Zambetti Absent: Commissioners Laden, Monia, Schaefer 1. Kier & Wright, Action-Direction from Commission Staff reviewed letter requesting the reconsideration of two points: first, the relocation of the pole on the property to accommodate a driveway and future building to the north, and, second., the load- ing space which cannot be provided in the originally designated location because of changes in the Conditions imposed by neighbor- ing property owners. The newly proposed location does meet requirements but would change'the design of the site. Since by code a loading space must be provided, the request asks for the relocation of said loading space to the rear of the site where they will also be able to provide the necessary parking. The Commission suggested a variance be applied for, at which time the matter would be considered at length. The Regular Adjourned Meeting was opened at 5:02 p.m. 2. General Plan - Area Plans for Areas "A" , "C" , "I" , and "J" Area A Staff outlined the recommendations of the City Attorney, indicating that Item 14, the cancellation of the Williamson Act contract was in contradiction of the Robinson Act which allows people to cancel contracts prior to expiration. Since the area plan cannot supercede the State law, t~e~cj.t~.. Attorney recommends the deletion of Item 14. Staff contends that Item 15 is not feasible since the City Geologist could not assure in writing the specific safety before the approval of any utility extension. Therefore, it is recommended that Item 15 be modified. Because of a'conflict with the Specific Plan in which there is an assessment district formed for water, the City Attorney recommends that Item 16 be deleted since it asks that. the City not participate in the formation of any future assessment districts in this area. Dora Grens read for the record a letter prepared by Area A affirming their position on their proposals, and citing examples for its necessity. Discussion followed on the area. Commissioner Bolger moved to approve the proposal as written. in Items 1-13 of the action program for the area. Commissioner '.', °Crowt·her~.seconded-the motion. A'vote·was.taken· width ·Commissioners u.jj·. Bolger'and·i-Crowther in favor, and Commissioner~'.Ki-hg-=and~Z'a~etti opposing. The· status of Items 14, 15 and 16 was not resolved and the decisi6n was ·postponed until the full Commission could review. Commissioner Zambetti moved to.approve Items 2-13 and to have Staff review Item 1. Commissioner King seconded the motion. The motion carried unanimously. With respect to Item 14, ComMissioner Crowther moved to add "with exception of applications received under the time limit of the time period." Commissioner Bolger seconded the motion. A vote was taken ~'~ith Commissioners Bolger and Crowther in favor, and Commissioners King and Zambetti opposing. Commissioner Crowther moved to'amend Item 1·5 to replace the word "assured" with "approved". Commissioner Bolger seconded the· -motion,· with Commissioners Crowther, Bolger and Zambetti in favor, and Commissioner King opposed because he would like to have the City Attorney's approval on the proposal first. In regard to Item 16, Commissioner Crowther moved to adopt Ms. Grens' suggestion. Commissioner Bolger seconded the motion with Commissioners Bolger and Crowther voting in favor of the motion, and Commissioners King and Zambetti opposed. Area- 'C Staff outlined the proposal indicating changes in the map of the area,.particularly the Texaco station on the corner of Prospect Road and Saratoga-Sunnyvale Road and the partially developed Carreia property. Joyce Hlava reviewed the area's recommendations noting the desire for residential, or low'density con~ercial zoning on the Carreia property which would provide allowances for a minisstorage development. Don Hoffman spoke on behalf of Public Storage, developers of mini- .s~orage units. He. maintained that his company had looked extensively at the property and that they feel it would'be suitable for a company such as their own, provided that the present zoning be extended and redefined to include a mini-warehouse as a commercial usage. CommisSioner Crowther moved to2approve Items 1-5, 7, Item 9 with the word residential deleted, "commercial or office use", substi- tuted, Item 10 with the las.tl sentence omitted, and finally Items 11-15 as taken from the Arguello homeowner's letters and appearing .as their Items 1-5. Commissioner Bo'lger seconded the motion. "C0mmi~s'10~er"'Zambetti noted that Item 6 should be included because this area has the most deferred improvement bonds outstanding. Item 6 was not included. For this reason he voted against the motion. Commissioner Crowther and Bolger-voted in favor with Commissioner King opposed because of.the change proposed in Item 9 and the inclusion of Items· 11-15.' Commissioner Crowther then moved to approve Items 1-5, 7 and 10 with the last sentence in Itemil0 omitted. 'Commissioner King seconded the motion... Commissioner Zambetti moved toiamend the motion to include that the City should assist and advise the property owners for the merits of the special assessment districts in Commercial and. PA .2 areas within this General Plan.Area·A in order to accomplish projects such as landscaping medians and creating frontage roadS. Further he wished to add that Special assessment districts be limited to the PA, ·CN and the CV Districts. Commissioner King seconded the· motion. Commissioner Crowther voted in opposition of the motion because he was not fully aware of the implications of the special assessment districts and would like this clarified by the City Attorney. He also felt this proposal was broader than the Specific Plan Area C. In agreement with Commissioner Crowther, Commissioner Bolger voted against the amended motion, leaving Commissioners King and'Zambetti in favor of the motion. It was the consensus of the Commission to leave out Item 8. With· respect to Item 9, Commissioner King·indicated he would like to see the wording "residential or commercial" Commissioner Crowther moved to include Item 9 with the word "residential" stricken from the proposal and the word "or" inserted between commercial and office. Commissioner Bolger seconded the motion·. Commissioners Bolger and Crowther voted in favor of the motion, with Commissioners King and Zambetti opposing. Commissioner Crowther then moved to include in Item 11 that Hillmoor and Kreisler Court not be extended. Commissioner Bolger seconded the motion and the motion carried unanimously. Commissioner Crowther moved that through traffic be minimized on Arroyo de Argue!lo. Commissioner Zan~etti seconded the motion and the motion carried unanimously. In regard to Item 13, Commissioner Crowther moved that the scenic quality of adjacent and hill ridgelines shall be preserved. Commissioner Bolger seconded the motion and the motion carried unanimously. In Item 14, Commissioner Crowther moved that the proposal be accepted as written. Commissioner Zambetti seconded the motion and the motion carried unanimously. Commissioner Crowther moved to adopt Item 15 as written. Commissioners Crowther, Zambetti and Bolger voted in favor of the motion, while Commissioner · King voted in opposition.· Area I Staff outlined the proposal before area residents spoke on the matter. Only one resident indicated the desire to keep her property zoned as R-1-20,000~ Discussion followed and the Commission recommended that staff research how many lots exj_st that are zoned R-1-20,000 and which are greater than one acre parcels.
