Roll Call Present: Commissioners Crowther, Hlava, McGoldrick, Nellis, Schaefer and Siegfried Absent: Commissioner Bolger PUBLIC HEARINGS - 1. A-893 Gerald ButIer, Montalvo Road.(near Montalvo Lane), Request for Design Review Approval to construct a two-story single family dwelling in the R-I-40,000 zoning district; continued from July 27, 1983 Staff described the proposal and gave th~ history of the project. The public hearing was opened at 7:10 p.m. Donald Call, President of the Montalvo Homeowners Association, commented that they feel the neighborhood is special in a unique part of Saratoga, and they would like to preserve this. He added that he feels this is also at a dangerous intersection. He described the sizes of the other homes in the area. Mrs. Marino asked for assurance that after the homes are built there will be no tennis courts. She also expressed concerned about the hours of construction. Staff indicated that they would' discuss this subject with the developer. They noted that there is no restriction on tennis courts in this subdivision; how- ever, because of the impervious coverage limit, a variance would be required on this lot for a tennis court. Bill Vinson, who owns the lot next to Mr.' Shortino, stated that he does not ent'irely agree with the Homeowners Association. He commented that they would all like to see the area remain undeveloped; however, Mr. Butler has his approval for the subdivision. He stated that he fee'is the home'Mr. Butler is building is certainly acceptable and he has a real problem saying the developer should not build a home.if it meets the ordinance requirements. He added that if the home- owners do-not like the ordinances they could try to have them changed. Mr. Butler described the proposal and discussed the other homes in the area. He commented that there is no.objection from the immediate neighbors. The con- · st'ruction schedule was also addressed. Commissioner Siegfried moved to close the public hearing. Commissioner Hlava seconded the motion, which was carried unanimously. Commissioner Siegfried stated that, while this is a large structure, he does not think it will impact the neighborhood at.all. He commented that he feels it will impact less than a 4500 or 5000 sq. ft. single story house that could be very high and imposing and dominate the lot much more than this. Commissioner Crowther expressed concern about the impact from the north, since the lots will be developed in the future. He asked about the turnaround, and it was noted that there is a full turnaround driveway. COmmissioner Nellis stated that he had voted against the applicant's previous application because of the size, which clearly exceeded the standards of the ordinance. He commented that he can make the findings with this new proposal and would be in favor of it. The front yar.d setback was discussed. Commissioner Nellis moved to approve A-8~3,.per the Staff Report dated July 21, 1983 and Exhibits "B", "C'.' and "D". Commissioner McGoldrick stated that she was voting in favor of it with reservationsbecause='= of the bulk. 2. UP-536 S. Simonsen, 18433 Montewood Drive, Request for Use Permit Approval to construct solar collectors which exceed 6 feet in height and maintain an 8 foot setback where 25 feet is required in the R-i-40,000 zoning district; continued from July 27, 1983 Staff explained the application. The public hearing was opened at 7:30 p.m. It was moved and seconded to close the public hearing. The motion was carried unanimously. Commissioner Crowther moved to approve UP-536, per the Staff Report dated July 20, 1983 and Exhibits "B" and "C". Commi.ssioner Siegfried seconded the motion, which was carried unanimously 6-0. 3a. SDR-1542 - Abel and Leila Carreia (Public Storage), 12299 Saratoga-Sunnyvale 3b. A-883 - Road, Request for Design Review Approval and Building Site Approval to allow a mini-storage facility in the C-V (Visitor- Commercial) zoning district; continued from July 27, 1983 Staff gave the background of the project and explained the present proposal. The public hearing was opened at 7:35 Dan Brown, from Public Storage, gave a presentation on the project. He dis- cussed the location of the driveways. Staff discussed the condition regarding the Deferred Improvement Agreement for improvements to Saratoga-Sunnyvale Road. They suggested that a condition be added requiring the applicant to enter into a Deferred ImproVement Agreement for the pro rata share of a traffic signal at Saratoga-Sunnyvale Road and Seagull. The' hours of operation and exterior light- ing were discussed. Mr. Brown addressed the conditions of the. Staff Report, and it was determined that Condition V-D should read "prior to construction of any buildings", rather than "prior to issuance of building permits." Staff noted that they would review this condition with the Fire Chief. Mr. Brown asked to have a 15 ft. easement instead of an 18 ft. easement. Discussion followed on this condition. Regarding Condition VIII-F re the eave overhangs on Building D, Staff clarified that a variance would be needed to extend these. The City Attorney commented that tile use permit could also be amended concerning the overhan~.. Mr. Brown briefly discussed the sign program. Fred Tater, 20577 Manor, stated that he was basically for the development. He cited the following concerns: (1) appearance of the front, (2) grading, (3) si n, (4) wall, ('5) maintenance of landscaping, and C~)' ~6~'e~ii~'~6~'.'~ti~ ""~'~'uipm~e'~F-,76'~ ......... .~- ...... ... the retail operation. Bill Lang, Julie Lane, discussed the easement and Sandy Sifferman addressed the hours of operation. It was noted that Hubbard and Johnson cannot be conditioned under this application. Another resident of JUlie Lane discussed the driveway and commented that l~e feels there are going to be some bad accidents. Further discussion followed on tile conditions of the Staff Report. Commissioner Hlava moved to approve the Negative Declaration for SDR-1542. Commissioner McGoldrick seconded the motion, which was'carried unanimously 6-0. Commissioner Hlava moved to approve SDR-1542, per ExHibit "B", and A-883, per Exhibits "B", "C", "D", "E", "F" and "G", both subject 'to the conditions of the Staff Report dated July 21, 1983, amended as follows: Condition II-E amended to read: "Construct 15 ft. access road ( to be clearly delineated) ..... ". Con- dition II-T added to read: "Enter into Deferred Improvement Agreement and pro- vide bond for payment of pro rata (25%) share of traffic signal. at Saratoga- Sunnyvale Road and Seagull. Agreement and'bond to run 5 years a:fter completion of all on site public improvements." Condition V-D amended to read "prior to construction of any buildings, instead of."prior to issuance of building permits" Condition VIII-D amended to read: "Tl~e applicant shall enter into a Landscape Maintenance Agreement with the City for those landscaped areas within the site and the public right-of-way. The applicant or subsequent property owner shall maintain these areas." Condition VIII-I amended to read: "All exterior lighting, 2 Flanni~ng Commission Page 3 ~i'hg Minutes 8/2/83 SDR-1542 and A-883 (cont.) excluding signs, shall be turned off at closing time except for security light- ing. Security lighting to be reviewed by Staff." VIII-J shall be amended to read: "Itours of operation shall be from 8:00 a.m. to 7:00 p.m." VIII-N is to be added, to read: "There shall be no storage, use or discharge of hazarous. or toxic materials in or from the storage units." VIII-O'shall be added, to read: "There shall be no electrical power supply for other than lighting in the storage units." VIII-P shall be added, to read: "The commercial building in front shall be a retail building and shall be constructed and maintained so as to encourage an equipment retail store." VIII-Q shall be added, to read: "There shall be no outside storage of the equipment from the retail business." VIII-R shall be added, to read: "Applicant is to clean out adjacent creek site of debris with. appropriate consent of Santa Clara Valley Water District." VIII-S shall be added, to read: "East and southwest side of Building D .to have evergreen land- scaping subject to Staff approval." Commissioner Siegfried seconded the motion, which was carried'unanimously 6-0. Commissioner Siegfried commented that he had originally voted no on the use permit; bowever, he voted approval of these applications because of the reduction in the size of the units. He added that he still is concerned by buildings of this size and the intense use in Saratoga. COMMUNICATIONS Oral 1. Staff reported that the applicant, Mr. Renna, has asked for clarifi- cation of the Commission's intent with the approval of the Renna variance V-609. They explained that the applicant is asking that the conditions of approval for the wall be separated so as to allow the applicant to obtain a building permit to install the solar panels.
