Siegfried Minutes Commissioners Peterson/Harris moved to approve as amended. Passed 4-0. Commissioner Peterson abstained because he was not present. ORAL COMMUNICATIONS - None Margaret .Shetrill, 14290 Hail Avenue, was concerned about frontage fencing, especially concerning vision when backing out of driveways. Mrs. Shetrill was instructed to leave her name and address so that she can be notified of upcoming meetings on this matter. .CONSENT CALENDAR 1. SDR-1585 - Lorincz, approval of resolution recommending A-1040 revocation of final building site approval for SDR-1585 and suspension of design review approval, A-1040, for parcel behind 19605 Glen Una Drive Commissioners Harris/Peterson moved to approve SDR-1585 and A-i040. Passed 4-0. PUBLIC HEARINGS CONSENT CALENDAR 2. A-1191 - Kozlowski, request for design review approval for 800 sq. ft. second story addition to an existing single family dwelling which would result in total gross floor area of the home exceeding'the 6,200 sq. ft. standard at 15495 Monte Vista Drive, Saratoga, CA. in the R-1-40,000 zoning district 5. 'SUP-17- Kozlowski, request for use permit approval for 800 sq. ft. seconO unit addition to an existing single family dwelling located at 15495 Monte Vista Drive in the R-1-40,000 zoning Oistrict. SDR-1458 - John Rankin, request for final one year extension for a four (4) lot tentative subdivision map at Glen Una Drive in the R-1-40,000 zoning district 6. SDR-1549 - Frank Horvath, request for a one-year extension of time to complete conditions of tentative building site approval to create two (2) lots at 22122 Mt. Eden RoaO in the NHR zoning district Commissioners Harris/Peterson moved for approval of items 2-6 on the Public Hearings Consent Calendar. 7. Negative Declaration - C-253 - City of Saratoga C-233 - Consider amending the Zoning Ordinance in regards to Oesign review for single family residences per Chapter 15 of the City code: (Staff requests that this item be. tabled until more information has been prepared. The project will be readvertised when it is ready for public hearing) 8. A-1177 - Heber Teerlink, request for design review approval to construct a two-story residence on a hillside lot and to grade in excess of 1,000 cu. yds. combined cut and fill on Heber Way, Lot 15, Tr. 6781; (to be continued to 8/25/86) 9. Negative Declaration - G-86-001 - Saratoga Country Club G-86-001 - Saratoga Country Club, request approval of a SM-30 - grading permit to move more than 1,000 cu. yds. of material and to grade on a slope greater than 10% for the relocation of a hole on the golf course at 21990 Prospect Road in the NHR zoning Oistrict. ITEM NO. 9 WAS APPROVED AS A RART OF THE PUBLIC HEARINGS CONSENT CALENDAR. Passed 4-0. 10. A-liB9 - Frank & Marie Saude, request for design review approval for construction of a new, two-story, single family residence which will exceed 26 ft. in height anO 6,200 sq. ft. in area on Lot 9, Tract 6628, Deer Springs Court in the NHR zoning district. The applicant, Frank Saude, explained his request for a .house larger than is normally allowed. He also explained about painting his house an0 that only 5 neighbors could see his house. Commissioner Peterson also felt that the 7800 sq. ft. house was just too large for a one acre site. Commissioner Guch also stated that she thought the 7800 sq. ft. is too extensive for this sized lot. Commissioner Harris stated she woulO eliminate the condition of the color. Commissioners Peterson/Harris moved to approve A-1189 supporting the staff report#s condition No. 2 that total gross floor area for all structures on site shall not exceed 6,200 sq. ft. and changing the exterior colors on pages 63 and 65 from white brick to golden tan. PasseO 4-0. Mr. SauOe has the right of appeal within 10 days. 11. A-1188.-. A. C. Morici, request for design review approval for construction of a 414 sq. ft. addition on. the first level of an existing home which would result in the total gross floor area of the home exceOing the 4,800 sq. ft. standard at 14090 Shadow Oaks Way in the' R-1-20,000 zoniHg district. ITEM NO. 11 ON THE PUBLIC HEARINGS CONSENT CALENDAR WAS APPROVED 4-0. 12. A-1101 Sudin Vittal, request for design review approval for construction of a new, two-story, si,ngle family residence with a proposed height of 28.5 ft. and size which exceeds 6,200 sq. ft. and approval to allow grading in excess of i,000 cu. yds at 15265 Montalvo Heights Ct. in 'the R-1-40,000 zoning district. Michael Layne represented Dr. and Mrs. Vittal. Discussion was held about contour of the land and how the house is situated, removal of trees, and grading o+ the the land. Commissioners Harris/Guch moved for approval 'of Resolution A-1101, Exhibit A, per staff report dated May 14, 1986 changing the following conditions: 2. Total gross floor are for all structures on site shall not exceed 6,700 sq. ft. 12. Total grading shall not exceed the recommendation of the City Engineer and with the approval of staff, taking into consideration that the retaining wall at the back of the should be kept to 5 ft. maximum. 18. This condition shall be subject to staff review and City Engineer's recommendations. 19. Orientation of the house shall be considered at the same time. Negative Declaration - SDR-1621 - Grant Ado~ador A-1181 - Grant Adorador, request f~r .tentative SDR-162i building site and design review approval for a two-story, single family residence which exceeds the allowable floor area standard on the north side of Mendelsohn Ln. about 100 ft. east of Piedmont Rd. in the R-1-20,000 zoning district Planning Director Hsia presented the staff report, and the public hearing was opened at 8:25 P.M. Joseph Walker, 129 Central, Los Gatos questioned condition no. 1 of A-1181, page 95. He requested approval for a rec room which would exceed ~he 4800 sq. ft. Commissioner Harris reported on her site visit. Discussion was held about the early warning fire alarm system required for homes exceeding 5000 sq. ft. Commissioners Harris/Peterson moved for approval of A-1181 and SDR-1621 per staff report changing condition 01 to read 5000.5 sq. ft. and adding a condition that the early warning fire alarm system be installed if the sq. ft. exceeds 5,000 sq. ft. 14a. Negative Declaration - SM-28 Richard Geno 14b. SM-28 Richard Geno, request for site modification approval for grading and retaining wails on a slope greater than 10% and for swimming pool location at 21449 Tollgate Rd. ITEMS 14a. AND 14b. OF THE PUBLIC HEARINGS CONSENT CALENDAR WERE APPROVED AND PASSED 4-0'. 15a. A-1182 - Pan Cal Investment Co., request for design review approval for two-story homes on lots 1, 9, and 10, Tract 7794, Via Escuela Drive in the R-1-12,500 zoning district. Planning Director Hsia presented the staff report, and the public hearing was opened at 8:05 P.M. Dr. Wood, 19680 Junipero Way, wanted clarification about lot 9. Commissioners Peterson/Guch moved for approval of A-1182. Passed 4-0. 16a. Negative Declaration - C-231 - City of Saratoga Planning Commission Minutes - 5/14/86 Page 5 16b. C-251 - Consider amending the zoning regulations of the City of Saratoga to create an ordinance to establish a Planned Development Zoning Classification to allow multiple uses on a single site having such designation pursuant to a PD permit; (continued to 5/28/86) PUBLIC HEARINGS 17. A-1194 Clarence Neale, request for design review approval for a triplex multi-family Owelling unit and variance approval for covered parking to maintain a 2 ft. setback where 25 ft. is required at i4230 Saratoga-Sunnyvale Road in the R-M-4,000 zoning district. Planning Director Hsia presented the staff report. A discussion was held about the variance and revised plans. The public hearing was opened at 8:40 P.M. Richard Miller spoke for the applicant. Mr. Miller requested a clarification about the early warning fire alarm system in the triplex. Commissioners Peterson/Harris moved to approve A-1194 amending Exhibit A as follows. No. 11 should delete ~he first phrase and start tile sentence with (as- amended) "The off street parking shall be provided in compliance with the ordinance, as numbered on the proposed map, both in teems of the number and size of spaces and the required setbacks. Number 15 should be deleted. Passed 4-0. 18. V-732 Bob and Donna Goff, request for variance approval for a first floor addition to maintain an 11.4 ft. left side yard setback where 20 ft. is required and a pool equipment pad to maintain a 10 ft. left side yard setback where 20 ft. is requireO at 21298 Sarahills Dr. in the R-1-40,000 zoning district. Commissioner Guch reported on 'her site visit, and the public hearing was opened at 8:50 P.M. The applicant, Bob Golf, 21298 Sarahills Drive. requested a variance to locate a'pool equipment pad just to the east of its present location, adjacent to his home, screened by mature vegetation in close proximity to solar equipment. Planning Commission Minutes - 5/14/86 Rage Discussion was held about the pool equipment pad (5'x6') and the problems in pumping the pool from the back yard. Staff recommends the pool pad to the rear of the yard, anO applicant wanted it in the same approximate location, but wanteO to move it 5-6 feet. Commissioners Harris/Peterson moved to approve V-732, making the findings as stated by staff and also including that the pool equipment be next to the new aOdition as requested by the applicant. There is considerable distance between the houses in that area, apd the pad would only come out about 5 ft. Passed 4-0. 19. UP-295 Saratoga GarOens Nursery, request for a five-year extension of the use permit for Saratoga Gardens Nursery (initially approved for 15 years with reviews required after each 5-year perioO) to operate as a nonconforming use in the R-1-12,500 zoning district at 12585 Saratoga-Sunnyvale RO., per 'condition A-1 of UP-295 and Chapter 15 of the City Code; (cont. from 5-26-8~ for 50 days to allow applicant time to comply with the concerns of staff and Mr. Drake) Planning Director Hsia presented the staff report. The applicant, Sarath Vidanage, was present and stated he would like an extension for use of the nursery. A discussion was held about a neighbor's request for a siOewalk, and Mr. ViOanage stateO there are no siOewalks on either siOe of his property. Discussion was held about appropriate time periods for use permits of this' type. The City Attorney stated that if the City receives a complaint, the City can initiate a revocation at any time. Chairman Burger stated she would like to see the dumpster area a little cleaner as a part of the permit. Discussion was held about dumpsters in general and who is responsible for picking up the garbage. Planning Director Hsia stated that the infractions were minor, but that the revocation was recommended because the conditions of the permit were made very clear. The applicant is not yet in compliance. Commissioners Peterson/Harris moved for approval for a five-year extension of UP-295 with periodic staff visits for the next year with the conOition that the dumpster be completely enclosed on 4 sides. Applicant has 50 days to Planning Commission Minutes - 5/14/86 Page 7 comply. Staff should look at: (1) Rusting barrels (2) Whether the Oumpster is enclosed in 30 days. Passe0 4-0. 20. A-1185A - Osterlund Enterprises, request for design review approval for a new two-story single family residence over 4,000 sq. ft. in size at parcel B, Tract 7499, SDR-1586, Alta Vista Avenue, in the R-1-12,500 zoning. district ITEM NO. 20 WAS APPROVED AS PART OF THE PUBLIC HEARINGS CONSENT CALENDAR. Oral Oy Commission No City Council report Chairman Burger reminded fellow Commissioners that there is a .County Planning Commission forum on May 22, 1986, 4-6PM regarding design review. There is no agend~ for the study session Tuesday evening, May 20, 1986. Planning Director Hsia presented a copy of the Saratoga Village Planning Program from Mackay and Somps to the Commission and stated that Don Peterson also sits on this task force for the Village. He indicated that he will keep the Planning Commission informed of the progress. Chairman Burger thanked Saratoga News. and the Good Government Group for coming.
