PLACE: Civic Theater, 13777 Fruitvale Avenue, Saratoga CA TYPE: Regular Meeting Roll Call: Present: Chairwoman Burger, Commissioners Harris, Siegfried, Guch, Callans, Tucker Approval of Minutes: Meeting of March 25, 1987. Commissioner Siegfried asked that on Page 5, Miscellaneous, fifth paragraph, first sentence be changed to read, "Commissioner Siegfried related his experience of a shared driveway. He did not believe there were any significant safety Concerns regarding this matter." GUCH/TUCKER MOVED APPROVAL OF~ MINUTES OF MARCH 25, 1987, AS AMENDED. Passed 5-0-1, Commissioner Harris abstaining. Election of Officers: Comnfissioner Tucker nominated Commissioner .Harris for the Office of Chairwoman. SIEGFRIED/TUCKER MOVED TO CLOSE THE NOMINATION FOR CHAIRPERSON OF THE PLANNING COMMISSION. Passed 6-0. Chairwoman Burger nominated Commissioner Guch for the Office of Vice Chairwoman. SIEGFRIED/TUCKED MOVED TO CLOSE 'THE NOMINATION FOR VICE CHAIR- PERSON OF THE PLANNING COMMISSION. Passed 6-0. Planning Director Hsia called for a vote on the:nomination of Commissioner Harris for the Office of Chairwoman of the Planning Commission. Passed 6-0. Planning Director Hsia called for a vote on the nomination of Commissioner Guch for the Office of Vice Chairwoman of the Planning Commission. Passed 6-0. Deletions to the Agenda: None. ORAL COMMUNICATIONS; None. REPQRT OF CLERK ON POSTING OF AGENDA; Pursuant to Government Code 54954.2, the agenda for this Meeting was properly posted on April 3, 1987. PUBLIC HEARINGS CONSENT CALENDAR; 1. DR-86-071 Case, request for design review approval of plans to construct a 2,081 sq. ft. two-story addition to an existing single story residence at 15300 E1 Camino Grande in the R-1-40,000 zoning district per Chapter 15 of the City Code. 2. SDR-1590-1 Liccardo, request for a one-yea.r extension of time to complete requirements of a tentative building site approval for subdivision of 2.64 acres into three (3) lots at 20045 Mendelsohn Ln. in the R-1-20,000 zoning district. 3. SDR-1591-1 Jackson, request for a one-yea.[ extension on time to complete requirements of a tentative building site approval for one (1) lot at 18642 Montewood Dr. in the R-1-40,000 zoning district. A-1101-1 Vittal, request for modification2 to original design review conditions to allow construcuon of a porte cochere in front of a new two-story single family dwelling at 15265 Montalvo Heights Ct. in the R-1-40,000 zoning district. 5. DR-87-005 Maas, request for design review approval of an 817 sq. ft. addition to an existing one-story single family home which will exceed the 6200 sq. ft. allowable floor area standard at 13948 Camino Barco in the R-I-40,000 zoning district. ; 6. V-86-014 Holic, request for variance approval to allow a garage addition that will be setback 10 ft. from the side property line where 12.7 ft. is required at 13305 Pierce Rd. in the R-I-40,000 zoning district. 7. DR-86-072 Cunningham, request for desig;n review approval for a 617 sq. ft. addition to an exisung one-story single family home which will exceed the 4,000 sq. ft. allowable floor area standard at 19771 Junipero Way in the R-1-12,500 zoning district. Chairwoman Burger and Commissioner Sie~ried requested removal of Item 4. Commissioner Tucker requested removal of Iterri 5 from Public Hearing Consent Calendar. HARRIS/GUCH MOVED APPROVAL OF PUBLIC HEARING CONSENT CALENDAR WITH REMOVAL OF ITEMS 4. AND 5. Passed 6-0. 4. A-1101-1 Vittal, request for modification to original design review conditions to allow construction of a porte cochere in front of a new two-story single family dwelling at 15265 Montalvo Heights Ct. in the R-I-40,000 zoniug district. Commissioner Siegfried questioned grading; COmmissioner Guch added that rotation of the house on the lot was also of concern during consideration of the original application. Planner Caldwell noted that Condition 15 of the Resolution required removal of the porte cochere and part of the terrace to protect an Oak tree in the front of the site; in addition, the house was to be shifted if possible, in order to protect adjacent property. The Public Hearing was opened at 7:10 P.M. Mr. Michael Layne, representative of the Vittals, confirmed that the porte cochere was part of the original application of two and a half years ago; he cited the specific Condition stating that the port cochere must be removed in order to save the Oak tree. The rotation of the house and the requirement that grading for the driveway no.[ exceed 15% were additional Conditions; the grading of the site impacted the Oak tree consider.ably. SIEGFRIED/TUCKER MOVED TO CLOSE THE PUBLIC HEARING AT 7:14 P.M. Passed 6-0. SiEGFRIED/GUCH MOVED APPROVAL OF A-1101-1. Passed 6-0. 5. DR-87-005 Maas, request for design review approval of an 817 sq. ft. addition to an existing one-story single family home which will exceed the 6200 sq. ft. allowable floor area standard :at 13948 Camino Barco in the R-l~40,000 zoning district. Commissioner Tucker noted concern regarding Other homes in the area and felt that a 12.5% increase in size of the house was excessive. She stated she would not vote in favor of this application. SIEGFRIED/GUCH MOVED APPROVAL OF DR-87-005. Passed 4-2, Commissioners Harris and Tucker opposed. PUBLIC HEARINGS; ' 8. UP-87-002 Novakovich, request for use permit and design review approval of plans to construct a 2,400 sq.ft. accessory structure (barn) at 14251 Fruitvale Ave. in the Agricultural zoning disti'ict. Planning Director Hsia presented the Report to tlie Commission, dated April 8, 1987. Commissioner Tucker reported on the site visit. ' The Public Hearing was opened at 7:22 P.M. Tl-/'e Applicant was not present. Mr. Peter Joachim 14287 Okanogan Dr., Sarat6ga, president of the Montpere Homeowners Association, noted the following: Implications in the Staff Report that the building had not already been built; when in fact, it was already built. Storage of used cars and other debris on the broperty. Questioned the purpose of the barn and noted the unsightly appearance of the structure. Concerns of neighboring area regarding the state of this property. If this barn were to assure clearing of the junk and cars, the neig,hbors would probably prefer to have the barn. Commissioner Siegfried suggested that the Pubiic Hearing be continued and that a letter be addressed to the Applicant raising the above: concerns. He favored a site visit by the commission as a whole. Consensus reached by the Commission on the above actions. SIEGFRIED/CALLANS MOVED TO CONTINUE THE PUBLIC HEARING ON UP-87-002 AND DR-86-038 TO APRIL 22, 1987, SENDING A LETTER REQUESTING THAT THE APPLICANT ADDRESS THE CONCERNS RAISED AT THE UPCOMING HEARING: PLANNING COMMISSION WILL MADE A SITE VISIT IN THE INTERIM. Passed 6-0. MISCELLANEOUS: 9. SUP-12 Bolander, 14231 Douglass Land, setting public hearing for April 22, 1987, to revoke a second unit use permit due to noncompliance with conditions of approval. Planning Director Hsia provided an update of this.' Application and noted that the Applicant had not complied with the Conditions imposed. He s~iggested for consideration: Continuance of the Application to the April 22, 1987, meeting or, Setting of the date for a Public Hearing on the revocation of the Use Permit. Planner Caldwell added that the plans be submitted by the Applicant had not met the basic requirements of the building department. Mr. Charles Bolander, Applicant, apologized for the delay, stating it was his understanding that the Commission wanted an inspection report: and required a building permit; he presented the inspection report. Requirements of the building department were cited. $1500 in required fees Drawings rendered by an architect He stated that he could not financially afford to have an architect draw plans on a building which had existed for 40 years. He presented an 'estimate from Mr. Dick Powell, architect, on the cost of the required drawings and asked for a further extension since Mr. Powell was out of town during the coming week. PLANNING COMMISSION MEETING Page 4 APRIL 8, 1987 MISCELLANEOUS Continued Commissioner Siegfried questioned the length of time the Applicant had taken to raise the above concerns; in response to a further question, Mr. Bolander stated that he understood the cost of fees involved only two months ago. The City Attorney reviewed the process of obtiining necessary use and building permits and noted that it was a standard requirement that bu. ildings be brought up to code. He suggested that standard operating procedure of the building department was to require architectural drawings; however, it was the Applicant's responsibility to contact the building department for the necessary inforn~ation. Commissioner Siegfried was willing to consider a continuance with an understanding that a study session, if considered necessary, and the Public Hearing be set for a specific date. Staff recommended that a Public Heating for revocation of the Use Pem~it be set for April 22, 1987; Planner Caldwell noted the April 14, 1987, Meeting of the Committee of the Whole wherein the Applicant could present further information. Commissioner Tucker favored setting a date for a public hearing; she noted the Planning Commission's continuance of this Application on more than one occasion. Mr. Bolander responded that he was scheduled to be out of town on April 14th and his architect was out of town until the fifteenth of the month. GUCH/HARRIS MOVED TO HOLD THE PUBLIC HEARING FOR REVOCATION OF THE USE PERMIT ON APRIL 22, 1987. PasSed 6-0. COMMUNICATIONS: Written: 1.
