4. DR-87-044 BAS Homes, Inc., 13937 Albar Ct., request for design review approval
of a new 3, 854 sq. ft. two-' story home in the NHR zoning district per
Chapter 15 of the City Code.
Planning Director Hsia presented the Report to the Planning Commission, July 8, 1987.
The City Attorney noted that Staff also wished this Item removed from Public Hearings
Consent Calendar. He asked that a Condition 20 be added, stating, "The Applicant shall
execute and record an agreement to hold the City harmless from any liability as a result of
approving the driveway to be constructed over the: designated fault easement area."
The Public Hearing was opened at 7:10 P.M.
Mr. Steven R. Stern, BAS Homes, noted that after being placed on the Agenda, they were
notified that the proposed structure was 2 feet in excess of City requirements; reduction of this
structure would result in a two week delay in being placed on the Public Hearings Calendar.
Now there was a request that the building be lowered 4 feet. He noted the coherent design of
the building, conformity with requirements, house was significantly under allowable square
footage and was specifically designed for the site in question.
Mr. Allen Coon, Designer, estimated that no more that 15% of the roof was above the 26 ft.
height.

Commissioner Siegfried felt that given the size of the house on a 1.2 acre site and the design
proposed, the 30 ft. height was not significant for him. Applicants noted that the height was
not apparent from the exterior of the residence and confLrrned that a reduction in height would
require a redesign of the structure; they had no objection to the addition of Condition 20.

Commissioner Burger was not opposed to the proposed height of a portion of the roof at 30 ft.
when shown in relationship with the size and placement of the house; she noted that a reduction
in height would damage the integrity of the home and require a redesign. Commissioner Guch
concurred and added that the proposed design fit the site.
SIEGFRIED/BURGER MOVED APPROVAL OF DR-87-044, ADDING A CONDITION 20,
"THE APPLICANT SHALL EXECUTE AND RECORD AN AGREEMENT TO HOLD THE
CITY HARMLESS FROM ANY LIABILITY AS A RESULT OF APPROVING THE
DRIVEWAY TO BE CONSTRUCTED OVER THE DESIGNATED FAULT EASEMENT
AREA." AND ALLOWING A HEIGHT OF 30 FEET. Passed 6-0.
Commissioner Siegfried noted for the record that this house was proposed at 4300 sq. ft.
where 7200 sq. ft. was allowed and commended the Applicant for this design.
10. UP-87-009 Ramono, 13206 Kevin St., request for conditional use permit to, allow a
new 520 sq. ft. detached garage to be constructed within the required rear
yard, 7 ft. from the rear property line and 8 ft. from the left side property
line in the R-l-10,000 zoning district per Chapter 15 of the City Code.
Commissioner Tucker reported on the land use visit.
Planning Director Hsia presented the Report to the Planning Commission, July 8, 1987.
Planner Caldwell answered questions regarding the side and rear yard setback requirements.
The Public Hearing was opened at 7:30 P.M.
Mr. Amed, 13192 Kevin Street, requested information regarding side yard setbacks and cited
his experience in requesting approval from the Ci.ty for a request similar to this Application.
Mr. Basil Ramono, Applicant, questioned what the objection to his Application was; he
confirmed that the wall to the rear of the garage was concrete block.
BURGER/GUCH MOVED TO CLOSE THE PUBLIC HEARING AT 7:36 P.M. Passed 6-0.
Commissioner Tucker noted that the request was for a modification of the existing Code
regulations; she noted her concern regarding safety and questioned whether the Applicant was
willing to move the garage forward 11 ft. Commissioner Siegfried responded that such would
destroy the property and added that the maximum garage height was 10 ft. high. The City
Attorney stated that the Use Permit process was being used to modify the height requirement.
Commissioner Tucker requested the addition of a Condition prohibiting use of the garage as a
second unit; Chairperson Harris and Commissioner Burger concurred with this Condition.
Commissioner Burger concurred that moving the' garage forward would destroy the use of the
rear yard with no logical use of the property behind the detached garage; Commissioner Guch
concurred.

12. DR-87-073 J. Lohr Properties, 19569 Chardonnay Ct., request for design review
approval for a new two-story single family home in the R-1-12,500
zoning district per Chapter 15 of the City Code.
Planning Director Hsia presented the Report to the Planning Commission, July 8, 1987.
The Public Hearing was opened at 7:43 P.M.
Mr. Steve Lohr, Project Manager, reviewed the Application and noted that the proposed house
would be built on an approved two-story lot and that a height limitation of 26 ft. had been met.
Dr. Wood, 19661 Junipero Way, Saratoga, stated that he had previously expressed the
concern that too many two-story houses were being zoned for this area. This Application
would exceed the one third limitation on two-story houses promised by Mr. Jerry Lohr during
the zoning process. In addition, the house would appear massive from the Glen Brae side.
Mr. Steve Lohr responded that the one-third limitation on two-story houses applied to the entire
Congress Springs subdivision; a total of ten two-story houses on twenty eight lots only slightly
exceeded the one-third limitation promised.
Commissioner Siegfried noted approval of the 682 sq. ft. garage with a first floor footprint of
only 2400 sq. ft; he noted the appropriateness of the design presented for the lot in question.

SIEGFRIED/GUCH MOVED APPROVAL OF DR-87-073. Passed 6-0.
PUBLIC HEARINGS:
13. AZO-87-003 City of Saratoga, Revision of Design Review Regulations. A Negative
Declaration has been prepared for this application. Continued from May
13, 1987.
The City Attorney presented a revised Ordinance, June 30, 1987; he noted that f. Scope of
Design Review, "the various circumstances requiring design review approval have not been
changed" referred to the circumstances as compared to the previous draft Ordinance.
He reviewed the draft Ordinance and noted that While there was a consensus that a mechanism
be included in the Ordinance to allow a height range of between 26-30 ft., there was no specific
agreement on the mechanism itself; he suggested' that roof area rather than roof line be used as
the mechanism. A figure of 20% of total roof area extending to the 30 ft. height was
suggested as the trigger for requiring a Variance application.
Commissioner Siegfried favored allowing up to a 30 ft. height to accommodate design
variables. Commissioner Burger favored the suggested made by the City Attorney since it
allowed for architectural interest. Architects were asked to address the acceptable percentage of
roof area during the Public Hearing.
The Public Hearing was opened at 7:57 P.M.
Mr. Wendall Roscoe, Architect, was pleased with progress made on the Design Review
Ordinance and favored a 30% figure. He noted' his objection to a massive roof at the 26 ft.
height and would rather see an A-line roof which exceed the 26 ft.height limitation in part.
Mr. Bill Heiss, Engineer, noted approval of draft Ordinance prepared by the City Attorney and
felt that any concerns he had were addressed in the draft presented.
Mr. Ray Cobb, Architect, favored the 30% figure.
A letter from Mr. Kurt Anderson was submitted for consideration.

Commissioner Siegfried wished to defer to the Architect's request for the 30% figure and noted
that numerous variance requests would be requested if an inadequate percentage were allowed;
Planning Director Hsia suggested a compromise at 25%. Commissioner Guch was not
favorable to the 30% figure and stated that she strongly favored a 26 ft. height limitation; she
felt that applicants would consistently seek the maximum height allowed. Commissioner
Siegfried was agreeable to a 25% compromise; consensus reached that 25% was acceptable.
Commissioner Clay noted the potential cumulative impact of a row of large homes, even
though all requirements were met, which would result in a negative effect. He questioned
whether the proposed Ordinance adequately addressed the relationship between bulk of a
house, the property and the required setbacks. The City Attorney responded that other than
the setback requirements imposed, it was at the discretion of the Commission in the design
review process to require additional setbacks.
Commissioner Burger concurred with the validity of the concern expressed by Commissioner
Clay; she suggested that the issue be addressed by reaching a consensus on increased setbacks
imposed on structures in excess of 26 ft. in height; Commissioner Guch noted that designs
currently being submitted often had stepped back fronts.
Consensus reached by the Commission that initial work on the Handbook would begin
immediately. :
SIEGFRIED/GUCH MOVED APPROVAL OF AZO-87-003 WITH THE CHANGE THAT
THE 30 FOOT HEIGHT ON STRUCTURES BE REDUCED TO 26 FEET AND THE 20%
OF TOTAL ROOF AREA BE INCREASED TO 25%. Passed 6-0.
14. V-87-004 Imperial Savings, 20473 Saratoga-Los Gatos Rd., request for variance
approval of plans to install a monument sign and increase the size of
lettering on the existing fascia signs at the above location in the C-C
zoning district per Chapter 15 of the City Code. Continued from June 10,
1987.
Planning Director Hsia reviewed the Report to the Planning Commission, July 8, 1987.
The Public Hearing was opened at 8:22 P.M.
Mr. David Uman, Federal Sign, Inc., made himself available for questions and questioned
whether the 5 ft. limitation on height of the sign would include the bar and posts. He was
agreeable to lowering the sign about a foot. He added that the sign would be illuminated with
mercury vapor floodlights of 500 watts located at the ground level on either side of the sign;
this lighting would be regulated by a time clock.
Ms. Marlene Dippell, Imperial Savings, stated that the conference facilities were used an
average of 25 times a month. Commissioner Siegfried noted that the community's use of these
facilities was one of the reasons he favored illumination of the sign during early evening hours.
Ms. Dippell stated that the illumination on the proposed sign could be coordinated with other
illumination which went off at 9 P.M.
The City Attorney noted that a special Permit for an externally illuminated sign was required; he
added that the Code limited such illumination on Signs to 200 watts.

Commissioner Siegfried concurred with Staff recommendation that the sign be reduced to 5 ft.
in height, measured to the top of the crossbar, excluding the posts.

S1EGFRIED/GUCH MOVED APPROVAL OF V-87-004, WITH A REDUCTION OF THE
SIGN TO 5 FT. IN HEIGHT EXCLUDING THE POSTS.
Planner Caldwell noted the change in Exhibit A, Condition 2, to read, "The height of sign not
to exceed 5 ft. measured from the ground level to the horizontal cross bar."
Commissioner Tucker suggested consideration of Commissioner Burger's suggestion to move
the sign on the east side of the building toward the street; with proper pruning of the trees,
visibility would be greatly increased.
She noted that the main issue was safety of the citizens from the potentially dangerous traffic
problem at this intersection. Officers from the Sheriffs department stated that the driveways
were confusing to motorists and that many drivers were making illegal left hand turns onto
Highway 9; in their estimation, the proposed sign would not increase the safety of motorists.
In fact, they expressed the concern that the sign would block the view of motorists making left
turns onto Highway 9.
In summary, Commissioner Tucker stated that this request appeared to be for an additional sign
over that allowed by the Code; she cited a recent article in the San Jose Mercury News and
concluded that she was unable to make the necessary findings, especially Findings 4, 6, and 7
since she believed that it would be granting special privilege, defeat efforts to maintain the
character of the Village and set an undesirable pre. cedent.
Commissioner Siegfried noted for the record that he understood the above concerns as well as
the uniqueness of the building in that it did not serve as a bank only; the meeting and
conference rooms were used for numerous community activities regardless of whether these
individuals were customers of the bank. He noted the difficulty of finding the location of the
bank during the early evening hours.
Commissioner Tucker explained the ingress/egress to the bank, the fire department and the post
office; the City Attorney suggested a Condition stating that the matter shall be further reviewed
by the Commission or by the City Engineer to determine whether there was traffic obstruction.
This would be saying, in effect, that the CommisSion reserved jurisdiction to require additional
setbacks if the location of the sign was determined to be a safety hazard.
Commissioner Burger favored only the two foot Setback of the proposed sign and reducing the
height to five feet was adequate.
SIEGFRIED/BURGER MOVED APPROVAL OF THE MOTION ON V-87-004 AS
AMENDED. Passed 4-2, Commissioners Tucker, Clay opposed.
15. SD-87-005 Brown, 14470 Oak PI., request for tentative building site and design
DR-87-043 review approvals of plans .to construct a new 2,426 sq. ft. one-story
single family residence in the R-1-10,000 zoning district per Chapters 14
and 15 of the City Code. Continued from June 10, 1987.

Planning Director Hsia presented the Report to the Planning Commission, July 8, 1987,
recommending that DR-87-043 be continued to August 12th as stated in the Staff Report.
The City Attorney called attention to and reviewed his Memorandum of June 22, 1987.
Planner Caldwell noted that in Staff Analysis the proposed trellis had been removed and
replaced by cantilevered beams with cross members, thus actual square footage would be 2125
sq. ft., a reduction of 301 sq. ft.

Mr. David Pines, Architect, reviewed the Revised Submission to Planning Commission, dated
June 14, 1987, and noted for the record that in his view, the height reduction of 2 1/2 ft. did
not affect the bulk of the house, it reduced the slope of the roof to one that was not as
acceptable as the original roof peak proposed at 22.6 ft.
He stated that the garage had not been rotated in order to present why he felt that the current
position was more beneficial to the neighborhood and noted the decrease in landscaping if the
garage were turned as suggested at the previous meeting. He added that the repositioned
garage would require cars to essentially drive up to the front door of the house; such was not
considered good planning and noted for the record that there was precedence for placement of
the garage as originally proposed.
Ms. Holly Davies, 14478 Oak Place, Saratoga, presented a written statement noting her
continuing opposition to the proposed plan:
Proposed house was too large for the lot
Lot 11 and 12 should be considered as one property due to: the invasion of the setback
area by the Polli Mansion and the fact that the original house on Lot 12 (Polli) had a
driveway easement across the front yard of Lot 11 (Brown)
Excess structure on Lots 11 and 12 as allowed in R-l-10,000 zoning
Required ratios for the R-1-10,000 district had been maintained on Lot 10 (Pinel)
Lot 12 (Polli) house was a 3400 sq. ft. house 'on a 6750 sq. ft. lot.
The small triangle piece of property to the rear of the properties in question had nothing
to do with the appearance or development of Oak Place.
Mr. Pines commented that several of the above items did not even address the property under
consideration; he reviewed the square footage of the proposed house.
The City Attorney stated that the City had initiated proceedings for the merger of the triangular
parcel with the Protiva parcel; this item was not relevant to the application under consideration.
Ms. Jane Pinel, 14472 Oak Place, Saratoga, urged that the: Driveway/garage be facing from the east and not to the property front
New survey be done to ascertain the east boundary in relation to the Protiva home
Further consideration of the proposed color which was still in the gray range

Commissioner Siegfried commented that the reduced height and square footage of the house
had been addressed by the Applicant; however, he continued to favor a change in the placement
of the driveway with access off the existing easement. The City Attorney suggested that the
Commission indicate their approval of the design in concept, if so inclined; thus the only
remaining issue on the continued DR-87-043 would be access of the driveway.
Mr. Pines proposed that approval of DR-87~043 be conditioned to require a change in
placement of garage/driveway and asked that the entire project not be delayed to August 12th in
order to rotate the garage and install a window, subject to Staff review. The Planning Director
noted the established policy of not approving plans without review by the Commission;
consensus reached that this policy would be followed.
Planner Caldwell suggested that there were architectural and landscaping concerns resulting
from the necessary changes; however, revised plans could be presented to the Commission at
the July 22nd Meeting, without a Staff Report,; if such were the desire of the Commision.
Commissioner Siegfried objected to a five week delay for the Applicant and felt that such a
delay was inappropriate. Chairwoman Harris noted that Mr. Pines had chosen to delay
submitting such a change in time for consideration to night even though the Commission had
expressed its desire previously. Mr. Pines noted that a drawing/site plan was already on file in
the City. Commissioner Burger favored following the procedures and policy already in place,
namely, voting on SD-87-005 with a Continuance of DR-87-043, pending review by Staff.

color of the house were acceptable. Rotation of the garage to be submitted for review.
Commissioner Clay noted his concern with the 'size and compatibility of the proposed house;
he concurred with the proposed rotation of the driveway/garage.

16. DR-87-055 Poellot, 12441 Parker Ranch Rd., request for design review approval of
V-87-009 plans to construct a new 7, 121 sq. ft. one-story single family residence
in the NHR zoning district. Also consider granting variance approval to
allow an increase in the impervious coverage limit to 14,950 sq. ft. (40%)
where 9,244 sq. ft. (25%) is permitted per Chapter 15 of the City Code.
Continued from June 10, 1987.
Planning Director Hsia provided an update on this Application.
Planner Caldwell answered technical questions :addressed by the Commission and confirmed
that there were no other variance applications along this section of Parker Ranch Road.
The Public Hearing was opened at 9:28 P.M.
Mr. Mike Poellot, Applicant, presented a Conceptual landscape plan, implementing
recommendations of the Commission; Items revised were the following:
- Impervious coverage had been reduced significantly
- Reduction of the square footage of the home to within the range acceptable to the
Commission; he noted that the lot was almost 2 1/2 acres in size, that the only adjacent
homes were over 130 ft. away, that there would be no special status granted as existed for
other homes within the Parker Ranch subdivision, that there were no homes above the
proposed home and noted the unique, secluded nature of the site
- Only remaining requirement was preparation of the conceptual landscape plan.
Mr. Bill Heiss, Engineer, reviewed the history of this easement and noted the differences on
the property in question as opposed to adjoining lots along Parker Ranch Rd. with regard to the
nature of the Creek area. As such, a variance was a reasonable and appropriate method to
equalize the situation; he felt that removal of portions of the easement where the underground
pipeline existed from consideration would be an unfair burden on the Applicant and asked that
a variance be granted. The Water District was agreeable to removal of some of the area from
the easement if necessary.
BURGER/GUCH MOVED TO CLOSE THE PUBLIC HEARING AT 9:37 P.M.
Commissioner Guch noted the uniqueness of this situation in that much of the property was
visible due to the underground pipe; in addition2 the proposed design of the home had open,
glassed in areas, incorporation of several Oak trees into the design and landscaping further
mitigated the size of the house.
GUCH/BURGER MOVED APPROVAL OF V-87-009, MAKING THE FINDINGS THAT
DUE TO THE UNIQUE SITUATION OF THE PROPERTY IN RELATIONSHIP TO THE

Commissioner Siegfried reviewed approvals given to other houses in this area and stated that
the proposed house should blend with the single story hornes rather than two-story homes. He
noted the reslrictive side yard setbacks in this portion of the: development and suggested careful
consideration of the placement and design of home on Lots 32-35; Commissioner Burger
concurred. Chairwoman Harris added that any benefit of a one-story house was not gained by
residents of the Arroyo De Arguello area, due to the proposed roof design.
Commissioner Siegfried favored a Continuance 'to a Study Session and requested information
on other homes already approved. :

17. UP-87-012 Broner, 12246 Via Roncole, request for a conditional use permit to allow
a glass pool enclosure to be located within the required rear yard, 5 ft.
from the rear property line and 1 ft. from the left side in the R-l-10,000
zoning district per Chapter 15 of the City Code.
Commissioner Tucker reported on the land use visit.
Planning Director Hsia presented the Report to the Planning Commission, July 8, 1987.
The Public Hearing was opened at 9:46 P.M.
Mr. Preston Hill, Representative of the Applicants, stated that Mr. Broner had met with his
builder and would address compliance with all the requirements of the Code with the exception
of an encroachment at one point of the proposed structure. He added that the request would
not result in an intensification of use since the Applicant, due to health, wished to use his pool
for non-weight bearing exercise; thus the Applicant would be removing several amenities of the
pool such as the diving board.
Mr. Maurice Broner, Applicant, reviewed his health needs which require non-weight bearing
exercise, the building materials of the proposed structure and asked for consideration of the
following:
- Parcel was 10,829 sq. ft. in the R-l-,10,000
- Accessory structure will not reduce any landscaped area nor increase impervious coverage
- Open area was and would remain landscaped and/or plantedwith a garden
- No grading would be required
- The pool structure would replace an existing 8 ft. privacy fence
Mr. Mike Louthan, Contractor, reviewed the dimensions of the structure, the proposed design
which would reduce the size of the structure and answered questions addressed.
Ms. Lavadia Palmer, 12234 Via Roncole, Saratoga, felt her rights were being denied by the
encroachment of the proposed structure into the Side yard setback. She noted that her property
was a foot or two lower than the Broner's yard and added that there would be serious drainage
problems from water flowing off the roof of the pool cover and into her property; examples
were cited of other drainage and flooding problems.
Mr. Louthan confirmed that this structure was designed with a gutter system and downspouts
could be designed to direct the water away from Ms. Palmer's property.
Commissioner Tucker, noting that the plans had been redrawn and not made available to the
Commission for review, asked that this Item be continued; Applicants were not opposed to a
Continuance. Commissioner Siegfried suggestedthat the Applicants address the following:
Increase the setback at the location adjacent to Ms. Palmer's property
Plans for gutter and downspout system
Commissioner Burger concurred with the above.

18. DR-87-05 1 Day, 20822 Beauchamps Lm, request for design review approval for a
6,058 sq. ft. two-story single family dwelling in the NHR zoning district
per Chapter 15 of the City Code.

Mr. Bill Day, Applicant, noted that the overall height would be reduced to 28 ft. 6 inches as
shown in the revised plans; however, the issue of excessive bulk was unresolved in meetings
with Staff. He cited other houses that had been approved on Beauchamps Lane which had also
been designed by the architect, Mr. Oakley. He reviewed design elements of the house.
