DR-87-164 Pan Cal, 12308 Crayside Ln., request for design review approval of plans to construct a new 4,740 sq. ft. two-story home in the NHR zone district. Continued from April 13, 1988 2. DR-87-048 Cunningham, 14230 Paul Ave., modification to previously approved site plan to increase the size of the deck at the rear of the home. 3. UP-88-003 Jamello, 18548 Paseo Pueblo, request for use permit for plans to construct a new 504 sq. ft. 'garage, 6 ft. from the rear and side property line, in the R-1-10,000 zoning district. 4. DR-87-048 Cunningham, 14230 Paul Ave., modification to previously approved site plan to increase the size of the deck at the rear of the home. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. PLANNING COMMISSION MEETING Page 2 APRIL 27, 1988 PUBLIC HEARINGS CONSENT CALENDAR'. Continued Commissioner Burger stated that she was concerned about a deck extension in this rather small rear yard; furthermore, she questioned the rear elevation, considering the slope of the property. The Planning Director provided information on the design and elevation of the deck. The Public Hearing was opened a 7:43 P.M. : Mr. Dave Cunningham, Applicant, stated that ihe revised deck plans had never been incor- porated into the final approval even though plans :were submitted at the time of the modification application; with respect to height of the deck, there were three levels. The City Attorney added that when the resolution for the appeal was prepared, such was very specific with respect to the modifications; however, the deck was not separately identified as a modification and thus was not incorporated into the resolution. HARRIS/BURGER MOVED TO CLOSE PUBLIC HEARINGS AT 7:46 P.M. Passed 4-0. Commissioner Burger stated that concerns noted above had been addressed. SIEGFRIED/BURGER MOVED APPROVAL OF DR-87-048. Passed 4-0. 3. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. The Public Hearing was opened 7:47 P.M. Mr. Joe Jamello, Applicant, clarified the following information: Exhibit "A" 11. Driveways, plans submitted suggested that the driveway would not be 14 ft. wide but rather, approximately 8 ft. wide Technical Information/Staff Analysis, Materials and Colors Proposed: should read "Roof: Composition shingles" BURGER/SIEGFRIED MOVED TO CLOSE THE PUBLIC HEARING AT 7:50 P.M. UP-88-002 Saratoga Country Club, 21990 Prospect Rd., request for approval of grading plan to expand the golf course. Continued from April 13, 1988. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. The Public Hearing was opened at 7:52 P.M. Mr. Richard Bigler, Architect, reviewed the history of the Application and stated that drawing submitted had been corrected to reflect City/County boundary lines; Applicants were in the process of submitting amended drawings for County approval. In response to Commissioner Siegfried's question regarding a neighbor's concern, Mr. Bigler stated that the grade of the golf course was considerably lower than the grade on the neighbor's property; ground water pollution/runoff would not go onto this property. Commissioner Harris questioned the access way to the driving range; Mr. Bigler responded that a pathway would be built into the hill by the ninth green and the fairway to improve visibility from the tee and the fairway. BURGER/HARRIS MOVED TO CLOSE PUBLIC HEARINGS AT 7:59 P.M. Passed 4-0 SIEGFRIED/BURGER MOVED TO APPROVE UP-88-002 PER THE MODEL RESOLU- TION. Passed 4-0. PLANNING COMMISSION MEETING Page APRIL 27, 1988 PUBLIC HEARINGS; 7. AZO-87-004 City of Saratoga, consideration of an ordinance amending various provisions in Chapter 15 of the City code concerning structure height, site coverage, fences, parking requirements, tree removal permits, and variance finding. A Negative Declaration has been prepared for the project. Continued from January 13, January 20 and February 24, 1988 The City Attorney reviewed information complied in response to the Commission's request. Planning Director Hsia noted a correction in Parking Analysis, to read, "Commercial 17" The Public Hearing was opened at 8:00 P.M. There were no speakers. SIEGFRIED/HARRIS MOVED TO CLOSE THE PUBLIC HEARING AT 8:01 P.M. Passed 4-0. Commissioner Harris was favorable to the proposed ratio of "One space for each two hundred square feet of gross square area in the PA district." SIEGFRIEDBURGER MOVED APPROVAL OF AZO-87-004. Passed 4-0. 8. V-87-028 Lawrence, 21833 Via Regina, request for variance approval to allow the expansion of an existing detached garage within the required front yard, 27 ft. from the front property line in lieu of 30 ft. required in the NHR zoning disu'ict per Chapter 15 of the City Code. Item 8, V-87-028 Continued to May 11, 1988, per request of the Applicant. 9. SD-87-021 Eshleman, 14130 Alta Vista Ave., request for building site and design DR-87-153 review approval for a 3,223 sq. ft. two-story addition to a 1,410 sq. ft. V-88-008 existin.g one-story home. A variance approval is requested to allow the expansmn of the existing garage to within 4 ft. 7 in. of the side property line in lieu of 6 ft. required. The lot is located in the R-l-10,000 zoning district. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. Commissioner Harris requested information on the sideyard setback distance. The Public Hearing was opened at 8:05 P.M. Mr. Dave Eshleman, Applicant, stated that when the house was purchased the garage was being used as living space; they wished to restore the garage use. With respect to height, the house had already been reduced; further reduction would affect the architectural integrity. Mr. Erwin Haws, Architect, commented as follows: House had been reduced in height from 30 ft. to 26 ft. The lower the roof pitch, the greater the reduction in volume of the second floor space; Applicants intended to place two bedrooms and a bath in this area Roof over the living room could be tipped; ho~vever, the slope of the roof as shown seemed to be the most appropriate; tipping the roof would reduce the volume of available space Was reluctant to further reduce the height of the roof over the living room area Noted the difficulty of the site and requested approval of the proposal submitted Ms. Connie Eshleman, Applicant, commented as '.follows: Living room had already been reduced 4 ft; asked that further reduction not be required Provided information on dimensions of the house Commissioner Siegfried stated that the clarification on the front elevation and visibility satisfied his concerns; he questioned what would be gained from reducing the rear height of the house. Chairwoman Guch added that the rear of the house would not be visible to adjacent neighbors. Mr. Steel, Walnut Ave., Saratoga, stated that tit was a pleasure to see new homeowners come into the area; he strongly favored the Application under consideration. PLANNING COMMISSION MEETING Page 4 APRIL 27, 1988 PUBLIC HEARINGS Continued Commissioner Burger had no concerns since the height of the front elevation was addressed; it appeared there would be no privacy impacts from the rear. Commissioner Harris added that while she ordinarily would not approve a 30 ft. hight, there was no benefit to be gained from lowering the rear height, since the exterior appearance of the house would not change. Commissioner Siegfried concurred. BURGER/SIEGFRIED MOVED APPROVAL OF SD-87-021 PER THE MODEL RESOLU- TION. Passed 4-0. BURGER/SIEGFRIED MOVED APPROVAL OF V-88-008 PER THE MODEL RESOLU- TION, MAKING THE FINDINGS AS STATED IN EXHIBIT B-1. Passed 4-0. BURGER/HARRIS MOVED APPROVAL OF DR-87-153 PER THE MODEL RESOLUTION Passed 4-0. 10. GPA-87-004 Maynard, P.G.& .E. Easement, request for General Plan amendment to ZC-87-004 designate the 19 acres of P.G.& E. easement along the railroad between Calabazas Creek at the west and Quito Road at the east as Open Space Managed Resource Projection in lieu of the residential (M- 10, M- 12.5) and PUC designation and fezone the area from R-l-10,000 and R-1- 12,500 zoning district to agriculture. The amendments will allow the growing and sale of Christmas trees. A Negative Declaration has been prepared. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. Chairwoman Guch noted for the record a petition received opposing this Application. Planner Caldwell commented as follows: - Neighbors had not reviewed the plans presented at this hearing - Noted the 15 ft. Santa Clara Water District easement that would remain open space, a 60 ft. wide tree planting area, fencing to be installed and the 30 ft. emergency access road - Sheriff, Fire, Water District and P.G.& E. concerns had been incorporated into the project The Public Hearing was opened at 8:33 P.M. Mr. Maynard, Applicant, deferred to other speakers. Ms. Judy Heintz, 12260 Fredericksburg Dr., Saratoga, commented as follows: Cited pedestrian access, traffic and parking problems that would result for the area Area was not zoned for business; this was a residential area Ms. Carolyn Smith, 12313 Fredericksburg Dr., Saratoga, commented as follows: Neighbors did not realize that this issue was still active and were not prepared for a hearing ' Trees would provide unwanted screening and prevent police from driving on the access Had understood that the area in question would remain open space - Felt that the proposed operation would create problems; only those living adjacent to the proposed operation should be able to determine the use - Cited the maintenance and appearance of a working tree farm along with traffic impacts Ms. Linn Pillsbury, 18541 Aspesi DrY, Saratoga, cited her letter of March 23, 1988, and added that this area was a residential neighborhood; she objected to an agricultural use of the site. Mr. Bill Witmer, 12291 Fredericksburg Dr., Saratoga, commented as follows: - Objected to comments made in Staff Report Issues regarding impacts involved - Estimated the size/impact of the operation and questioned the facts/integrity of the plan - Disagreed with the statement that the proposed trees would reduce the noise from the train; in fact, the train went through the area once a day and was looked forward to by the children - Key issue was the zoning change requested - Questioned whether the proposal was fair to all concerned; petitions cited - Proposal was the beginning of the deterioration of a residential area Mr. Don Landberg, 12253 Fredericksburg Dr., Saratoga, commented as follows: - Cited the severe impacts to the neighborhood, namely, security and privacy impacts - Project was not a three week operation; maintenance of property cited PLANNING COMMISSION MEETING Page APRIL 27, 1988 PUBLIC HEARINGS Continued Mr. Howard Hagen, 12200 Fredericksburg Dr., Saratoga, concurred, noting concerns of increased traffic; stated that illegal drugs could be grown in this area. Mr. Michael E. Hayden, 20125 Guava Ct., Saratoga, commented as follows: - Cited concern regarding access and parking impacts during the selling season - Questioned the aesthetic appearance of 6 ft. chain length fence and cut trees Ms. Mary Almassy, 12300 Fredericksburg Ct., Saratoga, commented as follows: - Cited traffic, noise impacts and an increase in undesirable individuals in the area - Questioned who would benefit from the proposed operation Mr. Elwoed Maynard, Applicant, commented as follows: - Operation would extend from the weekend after Thanksgiving for three weeks only - With respect to the zoning change, they were only interested in growing Christmas trees; they had no other interest in using the property for any other purpose - Applicants would be responsible for removal of any rubbish - Cited other operations; adjacent residents were very happy with these operations - Acerage was originally 19 acres; current proposal was 9 - 10 acres of trees - Outlined location of parking sites and noted that customers would be prohibited from entering the farm except through designated entrances Mr. Chris Hagen, 12200 Fredericksburg Dr., Saratoga, requested information on site access. BURGER/HARRIS MOVED TO CLOSE PUBLIC HEARING AT 9:04 P.M. Passed 4-0 Commissioner Siegfried felt that the project proposed was not appropriate for this site; such would be too impactful for residents. He concurred with the speaker who stated that fencing and cut trees would not be aesthetically pleasing; Commissioners Harris, Burger concurred. Chairwoman Guch noted her sensitivity to the neighbor's concerns; she cited the objections of the overwhelming majority of residents who would be impacted. Furthermore, she had reservations about traffic, parking and access. SIEGFRIED/BURGER MOVED TO RECOMMEND TO THE CITY COUNCIL DENIAL OF GPA-87-004 AND ZC-87-004. Passed 4-0. Break: 9:10 - 9:25 P.M. 11. GP-87-003 Florence Nelson Foundation, 20851 Saratoga Hills Rd., request for General Plan Amendment Of 5.1 acres of partially developed property to change the land use designation from OSOR (Open Space, Outdoor Recreation) to medium density residential (M-12.5) in order to construct a maximum of 9 new homes.. A Negative Declaration has been prepared. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. The City Attorney reviewed Application procedures and issues before the Commission. Planner Caldwell introduced into the record letters from the following individuals: Mr. Richard M. Eiler, 13982 Pontiac Ave., Saratoga, dated April 21, 1988 M.A. Cicerone, 14014 Saratoga Hills Rd., Saratoga, CA, 95070, dated April 22, 1988 Mr. Robert T. Cager, President, Saratoga Hills Road Association The Public Hearing was opened at 9:38 P.M. Ms. Linda Callon, Representing F. Nelson Foundation and Ainsley Development, commented: Introduced Mrs. F. Nelson, Mr. J. Higgins of the Foundation, Mr. Wagner from Ainsley Reviewed the Application and cited the conservative Staff Recommendation Applicant had originally requested an R-1-12.5 on the entire property Added comments to Staff Report on GP-87-003, 1. Amended in the Public Interest: - Cancellation of the Williamson Act Contract required a substantial donation to the City Parks fund and Hakone Garden or other open space the entire community could enjoy - Cited the vandalism problems, complaints from neighbors re: noise, public usage - It was in the public interest to allow a development compatible with the neighborhoed - A General Plan Amendment would accomplish the Public Interest - Reviewed the Report of Barfie M. Coates PLANNING COMMISSION MEETING Page 6 APRIL 27, 1988 PUBLIC HEARINGS Continued Ms. Mary Guth, 20785 Reid Ln., Saratoga, commented as follows: Challenged statements in Staff Report on GP-87-003, Description of Property Disagreed with statements in the Criteria for Determining Significant Environmental Impacts Felt that the trees on the property were dying because they had not been watered Presented a written statement objecting to the lack of a timely notice of the cancellation of a Williamson Act Contract and lack of study sessions to discuss the development of the site Mr. Gary Nemetz, 13960 Pontiac Ave., Saratoga, cited his letter of April 14, 1988, and added: Asked that any decision be delayed pending study of the effects of the proposed change Cited existing traffic hazards; development would create two more blind comers Reiterated concerns that the project would not be consistent with the neighborhood Preferred larger lots even with larger homes allowed on such properties Mr. Mark Cicecone, 14014 Saratoga Hills Rd., Saratoga, cited his letter and added: Question of contiguous development depended on which street was crossed Urged the Commission to carefully review this issue before making a decision Ms. Ann Waltonsmith, 21060 Saratoga Hills Rd:, Saratoga, commented as follows: Read portions of her April 20, 1988, letter into the record Felt that the City was below average in parks/open space lands per person Potential use of the property took precedence over development of nine homes While opposed to any change in the land use designation, if developed, she commented: - Lots 4 and 5: cited the too steep access (over legal grade) to these lots N Guest parking could not be accommodated on the narrow Saratoga Hills Rd. N Hillside slippage had already occurred; questioned City liability Asked that a decision be delayed to assess impacts of development Mr. William Young, 21400 Saratoga Hills Rd., Saratoga, asked that trees be identified on an individual basis and requested information on the proposed access road and slope density. Mr. Robert Gager, President, Saratoga Hills ROad Association, was interested in preserving Pistachios and large Oaks on site; he noted the steep primary access shown on maps. Dr. Adrian Prieto, 13901 Upper Hill Dr., Saratoga, commented as follows: Statements made in the Environmental Impact Assessment were incorrect Statements made regarding noise were incorrect Favored larger lots (fewer homes) for the proposed development Ms. Lori Nemetz, 13960 Pontiac Ave., Saratoga, was reluctant to see open space disappear. Mr. Roger Ross, Nelson Foundation, stated that trees on site were native and never watered; dying trees were diseased. He favored preservation of Pistachios and Oaks trees and a well developed project Ms. Callon responded to issues as follows: ' - Access to the property: such was within the Commission's jurisdiction at a later date - Tree Preservation: Reports recommended removal of some Pistachios as well as other trees; however, designs could be such that other Pistascho n~ees could be preserved - Soils and slippage: Geologic investigation would be required - "Razing" of the land: such was not the case; the natural slope of the land was noted - Zoning/General Plan Designation were consistent/inconsistent with the surrounding area: the R-l-40 and R-1-12.5 proposed zoning cited; reference made to Zoning Maps - Design of the homes: such was within the jurisdiction of the Commission; Applicant intended to build houses compatible with the neighborhood - Environmental Assessment: cited Reports already submitted; preservation of the natural habitat was within the planning process - Single-story vs. two-story homes: such was within the design review process; there were existing two-story homes adjacent to the property in question - Stream on-site: there is no stream on the property; however, there is an underground culvert - Traffic, Streets: Public Works will review and require improvements as needed Use of site by Community Gardens: Council discussion of January 20, 1988, reviewed Open Space/Acerage: issue raised at the February 17, 1988, Meeting of the Council Decision be delayed until after election: such would be unfair to Applicants PLANNING COMMISSION MEETING Page 7 APRIL 27, 1988 PUBLIC HEARINGS Continued ':' Mr. Nemetz stated that the above speaker misquoted him. Ms. Waltonsmith commented that neighbors had not complained regarding use of the property; on the contrary, they had favored more access to'the public. Ms. Nemetz stated that the property had been watered by sprinklers; concerns reviewed. BURGER/SIEGFRIED MOVED TO CLOSE THE PUBLIC HEARING AT 10:30 P.M. Passed 4-0. Commissioner Siegfried stated that concerns raised would be addressed; however, this was not the appropriate time. He concurred that he did not wish to see houses which significantly deviated from the existing homes; other issues wbuld be addressed in the planning process. Commissioner Burger concurred regarding heiight and square footage to be allowed in the development; she suggested consideration of an R- 1-20 zoning designation. Commissioner Harris asked for information on the existing specimen or rare trees; the site was known for such and she wished to consider these trees in making any decision on the property. She asked that a Zoning Map and other information be available for review and concurred with the neighbor's interest in retaining as much open :space as possible. Consensus reached that further information be made available; Item to be Continued. Mr. Roger Ross stated that an artificial recycling pond existed on-site. Mr. Bruce Bowen provided additional information on the culvert and easement on the property. BURGER/SIEGFRIED MOVED TO CONTINUE GP-87-003 TO MAY 11, 1988. Passed 4-0 12. DR-88-004 Blosk, 13941 Damon Ln., request for design review approval of plans to construct a new 5,557 sq. ft. two-story single family home in the NHR zoning diswict per Chapter 15 of the City Cede. .................................................. · Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. The Public Hearing was opened at 10:42 P.M. : Mr. Bob Blosk, Applicant, answered questions on colors, roof tiles and design of the house. BURGER/SIEGFRIED MOVED TO CLOSE;THE PUBLIC HEARING AT 10:44 P.M. Passed 4-0. BURGER/SIEGFRIED MOVED APPROVAL OF DR-88-004 PER THE MODEL RESOLU- TION. Passed 4-0. 13. SD-87-008 Cocciardi, 22631 Mr. Eden Rd., request for tentative map approval to subdivide 52.5 acres of land into a total of 5-lots; four of which will be developed with single family homes (21.5 acres), the last parcel (31 ... acres) will remain under a Williamson Act contract. Planning Director Hsia presented the Report to the Planning Commission, April 27, 1988. The City Attomey stated that the General Plan designation was residential with an NHR zoning classification; density of the subdivision had been determined in accordance with such. The Public Hearing was opened at 10:50 P.M. Mr. George Tobin, Attorney, reviewed the background of this property and the settlement reached between the City and the Applicant and he concurred with the Staff Report. Mr. Wilhem Kohler, President, Pierce Can:yon Homeowners Association, presented photographs of the area and commented as follows: - Was no Negative Declaration nor Environmental Impact Report for this unstable, steep area - Asked that an EIR be prepared on this property - Cited drainage and erosion problems in this area PLANNING COMMISSION MEETING Page 8 APRIL 27, 1988 PUBLIC HEARINGS Continued Mr. Bill Peretti, 13485 Old Oak Way, Saratoga, commented as follows: - Main concern was the unusual sequence of events surrounding development of this site - Property was cleared and leveled for development before cancellation of the Williamson Act - There was no Environmental Impact Report - There were no roads to the site; drainage for this project would go through his back yard - While not opposed to the project, he wished a resolution of issues addressed above Mr. William T. Brooks, 20230 Merrick Dr., Saratoga, cited Staff Report Exhibit "A": Con- ditions 40. and 41. and commented as follows: Noted the considerable diversity in equestrian trail easements between various subdivisions Condition 41. to be modified to 8 ft. easement and all weather surfaces required on the trails Asked that overall view of equestrian trail easements be done by the Commission Asked that citizen involvement be allowed in the review of these easements Ms. Dora Grens, 13451 Old Oak Way, Saratoga, commented as follows: Cited concerns regarding the lack of an Environmental Impact Report The crux of the issue was drainage; such was .the cause of the initial problems Topography of the subdivision was the same as the land slippage that had occurred Strongly urged that an Environmental Impact Report be completed Mr. Papken Der Torossiav, 21978 Via Regina, Saratoga, commented as follows: Was favorable to the development of four lots Was concerned regarding the drainage pipe; should such break, his house would be flooded Had already had land slides in his rear property; was concerned regarding further sliding Ms. Rosemary Neuman, 22641 Mr. Eden Rd., listed her concerns regarding the project. Mr. Vince Garrod requested information on the proposal under consideration. Mr. Tobin stated that an Environmental Assessment was completed; approval of the proposal requested. In response to Chairwoman Guch, he reviewed agreements with the Water District. The City Attorney provided additional information on the proposed water source. Mr. Kohler stated that an Environmental Impact Report had not been completed. BURGER/HARRIS MOVED TO CLOSE PUBLIC HEARINGS AT 11:35 P.M. Passed 4-0. Commissioner Siegfried suggested that a site visit would be beneficial. Commissioner Burger stated that she was not concerned regarding the proposed development.
