ITEMS OF DISCUSSION A. DR-88-013 - Ho, 21800 Mt. Eden Road, consider new information regarding the height of the approved 4,991 sq. ft. home showing that at its maximum height, the home will be 26 ft. rather than the 23 ft. maximum previously reported. Mr. Ho, applicant, presented a cross section through the garage which was not shown on the plans approved by the Commission. He explained that the elevations would remain unchanged and that the 26' height would be confined to the garage section; the majority of the height would be 23'. The Committee concurred that the additional cross section did not affect their approval. Construction plans could be approved. B. DR-87-096 - Ross, 11915 Shadybrook Court, consider minor modifications to an approved plan for additions to a one- story single family home on a 23,635 sq. ft. lot in the R-1- 15,000 zoning district. The home was approved to be a maximum of 4,842 sq. ft. where 4,300 was the standard at the time of approval. Mr. Ross and his architect explained the reason for the revisions. The Committee concurred that the modifications were minor; no property owner would be affected and the total square footage remained the same. The construction plans could be approved as presented. C. Prince of Peace, Bob Werling, 12770 Saratoga Avenue, request to defer landscaping on the church property and post a bond to complete installation in 60-90 days. Mr. Werling, from the church, and a representative of Shaw Associates, Landscape Architects, described the proposed landscaping. They presented a letter requesting the deferment (see exhibit A). The Committee agreed to a 90 day deferment; the Building Division can take a security deposit. 1 Committee-of-the-Whole Minutes 7/5/88 Page 2 E. Hwang, 19288 Bainter Ave., review of fencing, enclosing approximately 2.7 acres of property, pursuant to City Code Section 15-29,020(c)(1). Planner Caldwell explained the ordinance, stating that since the Hwang project had been a sensitive project, the Committee-of-the-Whole should review the proposed fencing. Mr. Young, architect, 'described the fencing, showing the site plan with the location of the fencing. The request was being made for safety/security purposes. He presented photographs of the area. The only area without vegetation, at the top of the hill on the southeast, would be planted with vines. The Committee recalled that they approved fencing over 4,000 sq. ft. on a property in the Parnas subdivision some 2 years ago; vegetation and topography essentially camouflaged the fence. The majority of the Committee agreed that the fencing was necessary for safety purposes and was not going to be visible from public streets and adjacent properties due to landscaping and topography. Two of the Committee objected to fencing over 4,000 sq. ft. in the hillside. D. AZ0-88-002 - City of Saratoga, review proposed ordinance amending various sections of the subdivision and zoning ordinance concerning the authority to modify or grant exception from regulations and standards. The Committee had decided that the subdivision ordinance should be amended to require a variance for any exceptions; however, the zoning ordinance should not be changed. Since only about sixteen (16) accessory structures have been considered by the Commission since July, 1986, the ordinance is not abused. The Commission should retain its flexibility to allow improvements on lots in the older areas of Saratoga with a use permit rather than a variance. In the future, if the Commission finds that there is a problem, the code can be changed to require a variance. For now, the use permit findings are appropriate to allow flexibility with conditional uses (churches, schools, etc.) and accessory structures (detached garages, gazebos, etc.). II. This request is submitted for the following reasons: °To gain beneficial occupancy of the bui]_ding while landscaping is in progress. °To release the retention fee for 'the General Contractor who has no responsibility for the landscaping. A landscaping plan was submitted and approved prior to issuance of the building permit. Since that time, a member of the congrega- tion has donated the total ]-andscap'ing package and requested that a new landscape plan be developed. The new plan is to be submitted to the Planning Commission tonight. It is not our intention to delay landscaping. Pre].iminary work was started this morning and we are anxious to complete the enZire project in as short a time as possible. Your consideration in this matter is appreciated.
