Chanq - DR-89-121, 12500 De Sanka Avenue , Continued to 3/20/90 due to the architect's lateness in providing revised plans. The Planning Commission will receive a staff recommendation for continuance to 3-28-90. 2. Tassara - SD-89-018, 19171 Oahu Lane The Planning Director provided an overview of the grading and compatibility issues discussed at the public hearing on 2/28/90. The Engineer representing the applicant presented his drainage proposal to raise the grade and utilize the proposed driveway to convey storm water to Oahu Lane. The Engineer then responded to the Planning Commission questions regarding his proposal. The Chairman asked neighbors to review the Engineer's proposal to solicit their comments and concerns. The Engineer stated that the grading proposal was superior from his perspective because.the sub-drain would require the relocation of utilities which will be costly and may inconvenient neighbors. Neighbors at the-rear of the proposal expressed concern about raising the grade and any fence that will be over 6 feet in height. Neighbors also ques- tioned the long term effectiveness of the retaining wall and fill areas. The Committee directed staff to discuss engineering alternatives in an attempt to maintain the existing grades between the project and the neighbors~property and to present solutions at the 3-28-90 meeting. 3. Continue Discussion of PropoSed Modifications to Saratoga's Devel- opment Process. The City Manager reviewed with the Planning Commission the discus- sions at the 2/28/90 meeting and emphasized the need for a moni- toring program as required by AB 3180. 'The Planning Commission asked questions to which the City Manager and Planning Director responded. Col. E.T. Barco provided an'oral presentation outlining his con- cerns regarding the violations at the Chadwick/Cocciardi site and the proposed development modifications. There was written presen- Commil -Whole Report -.i.' 3/6/90 Page 2 tation to accompany his report which recommended that no change to the development process be considered until the investigation of the area is received. Jeffrey Johns, representing the Saratoga Board of Realtors, ques- tioned the process of requiring final map approval after the improvements are in place. He also questioned the frequency of the inspection and overburdening the process and the existing staff. The realtors are concerned about the City being involved with the escrow process. Ann Marie Burger asked about~ the origin of the monitoring program and the 26 development process modifications illustrated in the manager's memorandum. The. City Manager responded to Planning Commission questions regarding the tree identification and resolu- tion of ordinance size trees~ Planning Commission felt relocation issue should be de-emphasized or eliminated in favor of requiring new trees to be planted. The Planning Commission wanted to emphasize its point that; 1) this is not a direct response to Chadwick/Cocciardi violations; 2) the City should exercise flexibility in its applying the recom- mended procedures. This sentiment will be conveyed to the Council in their deliberations regarding these changes. The Chairman then suggested that he write a letter expressing support of the current development process and the fact that many of the reforms are already in place.
