Approval of Minutes of August 22, 1990:
commissioner Caldwell requested that, page 1, line 5, under
approval of minutes of August 8, 1990, be amended to read "existing
nonconforming side yard setback enclosures..."
Since Commissioner Caldwell requested numerous revisions to item
13, SD-88-019 and DR-90-050 (Birenbaum), the Commission requested
a verbatim transcript of item 13.
Commissioner Moran requested that the application numbers be
included in the Technical Corrections on page 2o
SIEGFRIED/KOLSTAD MOVED TO APPROVE THE MINUTES OF AUGUST 22, 1990
AS AMENDED. Passed 6-0-1 (Commissioner Tucker abstained).
Approval of Minutes of September 12, 1990:
Commissioner Burger requested the following corrections: On page
4, the first line of the first full paragraph, Rita Hennessey
resides across the creek from the property. Also on page 4 the
second line of the paragraph beginning "Commissioner Burger agrees
with Commissioner Caldwell's remarks" should be amended to read:
"She mentioned the general concern expressed at study session..."
The last paragraph on page 5 should be amended to read: "She
contended that the proposed home is on the most prominent site in
the subdivision and. the lot has no natural vegetation on the pad
per staff report. Her concern is the view impact." on page 6,
seventh paragraph, third line, the word "path" should be "pad". On
page 8 in the paragraph beginning "Planner Walgren summarized...",
in the next to the last line the word "impasse" should be "impact".
On page 10 the sixth paragraph should begin "Frank Saude" and the
following paragraph should begin "Sheldon Blum". On page 11 in the
motion for DR-88-091.1, the second line should read condition that
"the maintenance agreement will be recorded°.."

Approval of Minutes Continued
Commissioner Caldwell requested the following corrections: On page
7, the seventh full paragraph should read "Commissioner Caldwell
prefers..." On page 8 the first paragraph under item 11 should be
amended to read: "Commissioner Caldwell reported that the
neighborhood is primarily one story except for a box-on-box two-
story which is just down the street." On page 9 the motion for
DR-90-046 should be amended to read "...TO A STUDY SESSION TO
REVIEW NEW DESIGNS". Page 10, the fourth paragraph should be
amended to read: "Commissioner Caldwell responded that the
Commission is currently working on a tree ordinance and many
conditions being sought in this case will. be proposed as part of
the new ordinance." Page 11 the motion for DR-88,091.1 should be
amended to include the following paragraph as part of the motion.
Commissioner Moran requested the following addition on page 7
following the motion to close the public hearing on V-90-024:
"Commissioner Moran suggested continuing the application until all
the information is in".
Commissioner Tappan requested the following addition to the last
paragraph on page 12: "He also commented he was in favor of the
City's leaning toward keeping the thoroughfare to a two-lane
thoroughfare.
BURGER/MORAN MOVED TO APPROVE THE MINUTES OF SEPTEMBER 12, 1990 AS
AMENDED. Passed 5-0-2 (Commissioners Kolstad and Siegfried
abstained).
ORAL COMMUNICATIONS:
Colonel E. T. Barco addressed the Commission regarding the
logistics of a land use visit.
Commissioner Siegfried referred to an article in the Saratoga News
regarding his comments to the City Council. He noted that it was
probably the first time he addressed the Council in 10 out of 12
years he has been on the Planning Commission, and he tried to make
it clear that he had not been at the previous meeting. He said he
had not had a chance to see the ordinance and the two comments he
made were certainly not meant to suggest that the moratorium should
be passed or not passed but that there were two significant
problems he saw with the ordinance as proposed. One was the need
to stop any further subdivision of land on an urgency basis and
there had not been any subdivision of land of any significance for
years. Secondly it precluded the conversion of units to second-
story units, two-story, single-family homes, where in fact the
neighborhood might be entirely two story homes and that it did not

make any differentiation and addressed the issue of two-story
conversions where basically there are single-story homes. He
stated he would also address the Council.

PUBLIC HEARINGS CONSENT CALENDAR:
1. SD-90-003 Peninsula Townhomes Assoc., 12297 Saratoga-
UP-90-003 Sunnyvale Rd., request for tentative map approval
DR-90-034 to subdivide a 2.67 acre lot into one two-acre
multi-family parcel and two .3 acre parcels for
commercial use. Use permit approval is requested
to allow a 30-unit multi-family residential
development within a Commercial Visitor (C-V) zone
district. Design review approval is also
requested for the entire project per Chapter 15 of
the City Code. An initial environmental
assessment has been prepared and is incorporated
in this application (cont. to 10/10/90 at the
request of the applicant).
2. DR-90-036 Gerla, 22188 Villa Oaks Ln., request for design
review approval to construct a new 6,681 sq. ft.
two-story single family residence on a 2.5 acre
parcel in the NHR zone per Chapter 15 of the City
Code (cont. to 10/10/90 at the request of
applicant).
3. V-90-005 Ballon, 14070 Arcadia Palms Dr., request for
variance approval to allow an existing satellite
dish to remain located within a required setback
and to exceed the maximum height allowed by
approximately 13 ft. per Chapter 15 of the City
Code. The subject property is located within the
R-i-40,000 zone (cont. to 10/10/90).
4. UP-89-005.1 Fox & Carskadon, 20514 Saratoga-Los Gatos Rd.,
request for use permit modification to expand
parking within the CH-1 zone district per Chapter
15 of the City Code. The increased parking would
permit additional agents at this center.

5. UP-90-008 Fong, 12280 Saratoga-Sunnyvale Rd., request for
conditional use permit approval to operate a
dental office within an existing office building
in the C-V zone district per Chapter 15 of the
City Code.
Commissioner Tappan requested that item 4 be removed.
A member of the audience requested that item 5 be removed.
4. UP-89-005ol Fox & Carskadon, 20514 Saratoga-Los Gatos Rd.,
request for use permit modification to expand
parking within the CH-1 zone district per Chapter
15 of the City Code. The increased parking would
permit additional agents at this center.
Commissioner Tappan requested that this item be removed. He said
he is familiar with the parking lot, and he had a problem with the
addition of four more parking spaces. He stated he could see two
spaces along the planter area but not three because of the
constriction in exiting or entering. He had a problem with a space
along the side of the building on the long L-shaped portion toward
Saratoga-Los Gatos Road because it is a difficult maneuver to pull
out of the diagonal spaces.
Planner Walgren presented the Report to the Planning CommiSsion
dated September 26, 1990.
In response to a question from Commissioner Burger, Mr. Walgren
responded that the Fire Department reviewed the plans preliminarily
and the plans appeared to be acceptable.
The public hearing was opened at 8:00 p.m.
Mr. Warren Heid, representing the applicant, addressed the
Commission. He said a study was made and he had only seen the lot
full on one Monday morning and the rest of the time it has been
only half full.
Commissioner Tappan said he could envision the spaces along the
planter area if they were reserved for compact cars but still had
difficulty seeing how anyone parked in the last diagonal space and
there would be difficulty if there were a car parked parallel to
the building.
Commissioner Siegfried suggested reserving the spaces for compact
cars and restricting the use of the spaces to parking on Mondays
from 8 to 12.

Commissioner Tappan said he could vote for the proposal if the
forward space was changed to a compact space.
Commissioner Moran said she agreed with Commissioner Tappan's
remarks and would like to see the space not included because it is
very difficult to back out of the diagonal space.
BURGER MOVED TO APPROVE UP-89-005.1 CHANGING THE FRONT SPACE
TOWARDS SARATOGA-LOS GATOS ROAD TO A COMPACT SPACE°
Commissioner Siegfried suggested that the space be marked for
employee parking only.
BURGERAMENDED THE MOTION TO APPROVE UP-89-005ol CHANGING THE FRONT
SPACE TOWARDS SARATOGA-LOS GATOS ROAD TO A COMPACT SPACE AND TO
MARK THE SPACE FOR EMPLOYEE PARKING ONLY. Commissioner Siegfried
seconded the motion. Passed 6-0-1 (Kolstad abstained because of a
possible conflict of interest).
5. UP-90-008 Fong, 12280 Saratoga-Sunnyvale Rd., request for
conditional use permit approval to operate a
dental office within an existing office building
in the C-V zone district per Chapter 15 of the
City Code.
Planner Walgren presented the Report to the Planning Commission
dated September 26, 1990.
The public hearing was opened at 8:13 p.m.
Mr. Steve Porter, property manager, stated he was not present to
register any objection to the application. He expressed concern,
however, that there was not enough time to give notice to the
owners of the building to discuss the matter. Mr. Porter indicated
that a number of the owners are concerned' that adequate provisions
be made to ensure that whatever construction work is necessary will
not structurally damage the building.
In response to a question from Chairperson Tucker, Planning
Director Emslie responded that the owners were given notice of the
Planning Commission meeting. Mr. Porter clarified that it was not
possible for the Saratoga Owners Association to meet before the
Planning Commission meeting.

Dr. Dwayne Fong, applicant, stated a meeting was held with the
Board of Directors and a meeting with the owners is scheduled. He
said he spoke with most of the owners and has had a positive
response from all of those he spoke with.

SIEGFRIED/KOLSTAD MOVED TO APPROVE UP-90-008 PER THE STAFF REPORT.

PUBLIC HEARINGS:
6. UP-88-010 Cupertino Union School District/Primary Plus,
12211 Titus Ave., review of Primary Plus preschool
use permit by the Planning Commission to ensure
compliance with all City requirements. The review
is required at 4-month intervals for the school's
first year of operation (coLt. from 8/8/90).
Planning Director Emslie reviewed the Staff Memorandum dated
September 26, 1990.
In response to questions from Commissioner Caldwell, Mr. Emslie
.said he has an oral commitment that the median between Melinda
Circle and the parking lot will be relandscaped. He also responded
that he visited the site and observed school personnel directing
traffic and that there was a long queue of cars waiting in the
white zone adjacent to the school. He said he did not see any
vacant parking spaces but noted that his visit occurred prior to
the District's adding to the parking lot.
Chairperson Tucker said she visited the school between 8:10 and
8:40 a.m. this morning. She said over the 30 minute period she
counted approximately 150 cars and the peak number of cars came in
between 8:25 and 8:30 at which time there were 52 cars° Only one
time was there a backup of two cars on the main road and that was
while a car was waiting to make a left hand turn into the parking
lot. She said there seemed to be no problem and there were no cars
parked on Titus when she arrived. When she left there were two
cars, one was an express truck which seemed to be having a problem,
and the other was parked down the street next to Prospect.

Ms. Carol Freitas, President of Primary Plus, was present and
requested the neighbors present their comments first.

In response to a question from Commissioner Siegfried, Ms. Freitas
responded roughly 20% of the students are half-day students°
Mr. John Power, 12150 Kristy Lane, addressed the Planning
Commission. He said his family is a proponent of the school as a
local school and not a proponent of the use of the school by a
commercial entity. He objected to people parking off the pad near
the fence of his property. He noted there are more cars in the lot
than there were last year. He also noted there was minuscule
landscaping done between the curb and Melinda Circle. He said a
chain fence was put up across the center section but it is a
relatively ineffective fence. He stated the lighting is not
shielded. He indicated that no response was received to a letter
submitted by the neighbors last year. His main question concerned
how many Saratoga residents are using the facility rather than
outsiders.
Mr~ Andy Boogard, 12022 Titus Avenue, addressed the Commission. He
discussed a letter he submitted to the Commission and reiterated
his previous comments regarding traffic problems on Titus.
Commissioner Burger clarified that the suggestion regarding no left
on Prospect has been reviewed by the Public Safety Commission°
Ms. Debbie Lillo, 12054 Kristy Lane, reiterated her concerns which
were outlined in a letter previously submitted to the Planning
Commission.
Ms. Freitas indicated that the Primary Plus program is occupying
approximately two-thirds of the school facility. She also pointed
out that the Primary Plus use of that part of the facility is
definitely the lowest density use that can happen in the school.
Primary Plus has been limited to 175 students. If the program was
a public school program, that same space would probably house
approximately 400 children. If Primary Plus was not limited to 175
students, it could apply for a license for over 300 children. She
said that well over 50% of the children's parents live in Saratoga,
and 80% of the children live within three miles of the school.
Ms. Freitas indicated that whenever an evening event was held at
the school during the year, a letter was sent to the Planning
Department.
Ms. Sonya Schurr, Cupertino Union School District, addressed the
Planning Commission. She said the District is presently working on
a landscaping plan for Melinda Circle but first must develop a plan
for getting water to the area. In response to questions from

Commissioners, Ms. Freitas responded that if the District were to
use this school as an elementary school, the minimum amount of
students would be around 600.
Chairperson Tucker reminded those in attendance that the Planning
Commission only has control over the Primary Plus use permit.
TAPPAN/SIEGFRIED MOVED TO CLOSE THE PUBLIC HEARING AT 8:56 P.Mo
Passed 7-0.
Commissioner Siegfried indicated he would like to see this matter
come to a close. He said he would like to see the concerns
mentioned by the neighbors itemized and reviewed by staff. He
suggested a traffic count be done and said he would also like a
count from the School District as to where the students are coming
from now and where they would likely come from if the school was
open under the open enrollment program. Commissioner Siegfried
suggested continuing the matter for one month.
Commissioner Kolstad said he visited the site a number of times and
made several observations. He stated the backing up of the traffic
on Titus was mainly caused from cars parked on the street at the
corner of Titus and Prospect. He indicated he observed no problem
with making left hand turns. Commissioner Kolstad said he had a
problem with th~TM community feeling that Primary Plus should only
serve the people of Saratoga. He stated he observed on his visits
that it appeared employees were parking at the white curb and
suggested that employees park in the rear loto He suggested the
lighting problem be taken care of immediately. Commissioner
Kolstad indicated that from his visits he is not convinced an
actual nuisance consistently occurs, and he would be willing to
leave everything as is.
Chairperson Tucker stated that from her observation of earlier in
the day she would have to agree with Commissioner Kolstad. She
said she did not feel there is a problem there°
Commissioner Caldwell requested that, if the item is continued, the
question of how many students the school is willing to take with
Primary Plus as a tenant be addressed.
Chairperson Tucker summarized the concerns the Commission wishes to
have addressed. These include the intensity of what the use can be
for both schools, the number of cars that will be coming and going
and from what areas, and where the Christa McAuliffe students are
coming from. The Commission would also like to see the lighting
issue resolved and a landscaping plan.

7. DR-89-111 Bilkey, 22126 Villa Oaks Ln., request for design
review approval to construct a new 5,436 sq. ft.
two-story residence in the Mt. Eden Estates
subdivision on a 1.6 acre parcel and within the
NHR zone district per Chapter 15 of the City Code
(cont. from 9/12/90).
Commissioner Moran reported on the land use visit.
Planner Walgren presented the Report to the Planning Commission
dated September 26, 1990.
The public hearing was opened at 9:35 p.m.
Mr. Michael Davis addressed the Commission on behalf of the
applicant. He described the proposal in detail.
BURGER/SIEGFRIED MOVED TO CLOSE THE PUBLIC HEARING AT 9:39 P.M.
Passed 7-0.
Commissioner Burger said she visited the site and expressed concern
regarding the height of the home. It is prominent because it
enjoys an unobstructed 360 degree view. She stated she would
prefer to see the home limited to a one story or to a height.
Commissioner Caldwell agreed with Commissioner Burger's comments
and suggested limiting the home to a one story of no greater than
22 feet.
Commissioner Siegfried stated he has the same concerns as the other
Commissioners and suggested a height of 23 feet, which would not
preclude a two-story addition and may reduce the bulk.
Commissioner Moran indicated she, too, is in favor of a height
restriction or perhaps a one story. She also suggested looking at
the materials as another avenue of reducing the impact of the house
in that exposed area. She suggested use of natural materials or
natural colors.
Commissioner Tappan said he was agreeable to Commissioner
Siegfried's suggestion of a height of 23 feet°

Passed 7-0.
8. AZO-90-004 City of Saratoga, consideration of recommending
the creation of a new zone district relative to
addressing the unique topography typical to the
unincorporated hillsides northwest of the City
limits. The Planning Commission will consider
creating a new zone district which will establish
lot sizes, setback, permitted and conditionally
permitted uses and requirements for the dedication
of open space for the topographically constrained
hillsides currently under the jurisdiction of
Santa Clara County. The Planning Commission will
consider adding text to the existing zone
ordinance~ The application of this zone to
specific property will require separate and
subsequent action by the Planning Commission and
City Council (cont. from 9/12/90).
City Attorney Toppel reviewed his memorandum dated September 5,
1990 and answered Commissioners' questions regarding the proposed
ordinance.
Commissioner Burger stated the proposed ordinance should be revised
to either reduce the minimum lot size or make some adjustment for
square footage. She felt it was unreasonable to limit a property
owner with 180 acres to 6,000 square feet.
Mr. Emslie and Mr. Toppel discussed a comparison of this ordinance
with the County ordinance.
The public hearing was opened at 10:30 p.m.
Mr. Vince Garrod, 22600 Mt. Eden Road, addressed the Planning
Commission regarding his opposition to the proposed ordinance.
Mr. Clayton Thomas, 22490 Mt. Eden Road, agreed with Mr. Garrod's
comments. He expressed his concern that he and others were not
notified of the public hearing regarding the proposed ordinance.
Mr. John DiManto addressed the Commission regarding his opposition
to the proposed ordinance and his concern regarding lack of notice
to residents of the public hearing.
Chairperson Tucker expressed concern that perhaps proper notice was
not given.

In response to a question from Commissioner Burger, Mr. Emslie
responded that direction for the proposed ordinance came from the
City Council° The Council directed staff to review expanding its
sphere of influence.
There was Commission consensus that better notice should be given
to the public and the public hearing should be continued.
Commissioner Siegfried suggested that the Commission hold a study
session to review the County ordinance as a learning session and
then a session where property owners who could be affected by the
proposed ordinance would be invited.

STUDY SESSIONS ON OCTOBER 16 AND OCTOBER 30, 1990. Passed 7-0.
9. DR-90-058 Hodges, 19875 Park Dr., request for design review
approval to construct a new one-story 4,750 sq.
ft. single family dwelling on a 24,170 sq. ft.
parcel in the R-i-20,000 zone district per Chapter
15 of the City Code.
Commissioner Moran reported on the land use visit.
Planner Walgren presented the Report to the Planning Commission
dated September 26, 1990.
The public hearing was opened at 11:03 p.m.
The architect for the project addressed the Commission. He stated
the garage is shown to be 44 feet from the rear setback. The
garage is a single-story structure and the door opens to the rear
rather than to the side. He said the garage was placed in that
configuration in order to create a courtyard effect on the west
side of the property. He stated that the applicant has agreed to
rotate the garage to the west and.have the garage door to the west
side. The applicant is also willing to plant additional hedges
along the back side and would even agree to a five or six foot wall
on that side. He indicated that if the height of the structure is
a paramount concern with the Commission and with the neighbors the
applicant has agreed to lower the roof height to 18 feet.
Ms. Louise Shaffer, 19874 Park Dr., stated that she was concerned
about the skylight at the higher height but felt that lowering the
height would address her concerns.
Mr. Don Lightbody, 15060 Park Dr., addressed the Commission
regarding his concerns. He stated the placement of the garage is

a significant problem and the proposal to modify the placement of
garage would not change the impact to his property. Cars coming
into the yard and accessing the garage would be a significant
impact to the privacy of his property both visually and from a
noise impact. He stated the height of the garage and the skylights
proposed are excessive and block his views. He said the garage
does not conform with any of the other homes in the area and the
Commission could not provide him with any assurance that there will
be no use of the garage that would be detrimental. Mr. Lightbody
also expressed his concern regarding the skylight° He said at
night the entire length of the house would be lit up on the ridge.
Commissioner Tappan commented that he did not object to the
placement of the garage and said the applicant has been reasonable
in eliminating the guest house and rotating the garage.
Mrs° Lightbody also addressed the Commission and reiterated the
concerns expressed by Mr. Lightbody.
Mr. Lightbody delivered a letter to the Commission from another
neighbor.
The applicant, Mr. Hal Hodges, addressed the Commission regarding
his proposal.
BURGER/MORAN MOVED TO CLOSE THE PUBLIC HEARING AT 11:26 P.M.
Passed 7-0.
Commissioner Burger stated her original concern was the number of
structures on site. She said she is still concerned about the
detached garage and she would prefer to see the garage attached to
the home. She also expressed concern regarding the long,
uninterrupted stretch of skylight and would prefer to see a few
strategically placed skylights rather than a long stretch along the
ridgeline.
Commissioner Tappan said he appreciated Mrs. Shaffer's comments
regarding the skylight as she would likely be most affected by it.
He stated he had no objection to detached garages and there were a
number of them in this neighborhood° He felt the architect and the
applicant have been sensitive to the neighbors' concerns regarding
the guest house and the rotating of the garage. He indicated there
are sufficient mitigating landscaping schemes that could be
conditioned that would sufficiently screen the Lightbody property
from the applicant's.

Commissioner Siegfried stated he is not concerned about the
detached garage but did not understand why it needs to be turned in
the way that it is turned and why it could not be turned to face
forward and in the corner of the setbacks not in the middle of the
back yard. He also indicated he had a problem with the skylights
along the ridge but had no problem with a reasonable number of
skylights.
Commissioner Moran agreed with Commissioner Siegfried about the
placement of the garage and also agreed that it should be attached
to the house. She expressed concerns regarding the height Of the
house and the skylight.
Commissioner Kolstad also expressed concern regarding the skylight
and agreed with the concerns expressed by the other Commissioners.
Commissioner Moran stated she also had a concern regarding the
color.
Commissioner Caldwell said she was not so concerned about the
skylight and agreed with Commissioner Tappan's comments.
Chairperson Tucker also expressed concern regarding the skylights
and said she would rather see the'garage attached. She stated she
was in favor of Commissioner Siegfried's suggestion for placement
of the garage.

A STUDY SESSION ON OCTOBER 16. Passed 7-0.
10. DR-90-030 Ng, 21720 Villa Oaks Ln., request for design

13. AZO-90-005 City of Saratoga, consideration of zone amendment
to Article 15-80 of the City Code to allow certain
cellular telephone transmission structures to be
constructed in the Commercial and Professional
Office zone district subject to height
restriction.
